		<section display-inline="no-display-inline" id="HA6D2B24FD72749459CFB7BC434A77097" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Rural
			 America Job Assistance and Creation Act</quote>.</text>
		</section><section id="HB75B6D1480A447358064842F142357D0"><enum>2.</enum><header>Grants for
			 regional skills alliance skill development</header>
			<subsection id="HD803CB817591460980D146E6B483ED9E"><enum>(a)</enum><header>Authorization</header>
				<paragraph id="H93FC41F0EEA041E3AC079C662C1FD00"><enum>(1)</enum><header>In
			 general</header><text>The Secretary of Labor, in consultation with the
			 Secretary of Commerce, shall award grants to eligible entities described in
			 subsection (b) to assist such entities to improve the job skills necessary for
			 employment in specific industries.</text>
				</paragraph><paragraph id="HA99D8940C00B44ABA5928FBEF3BD2F83"><enum>(2)</enum><header>Eligible
			 entities described</header>
					<subparagraph id="H6F289829EDB940E695CA0427F92EECA9"><enum>(A)</enum><header>In
			 general</header><text>An eligible entity described in this subsection is a
			 consortium that—</text>
						<clause id="H1479CF757B744F4F85BFEBCEC370AA49"><enum>(i)</enum><text>shall consist of
			 representatives from not less than 5 businesses, or a lesser number of
			 businesses if such lesser number of businesses employs at least 30 percent of
			 the employees in the industry involved in the region (or a nonprofit
			 organization that represents such businesses);</text>
						</clause><clause id="H431B3DD4831D42E4986C825475D99ED"><enum>(ii)</enum><text>may
			 consist of representatives from—</text>
							<subclause id="H1D3FD01C7A1D45439276FE062CEE40CE"><enum>(I)</enum><text>labor
			 organizations;</text>
							</subclause><subclause id="H29B3C76B38354788A912A409C8EA8D94"><enum>(II)</enum><text>State and local
			 government; and</text>
							</subclause><subclause id="H988FC7BAD20348F794E09210A0B105B5"><enum>(III)</enum><text>educational
			 institutions;</text>
							</subclause></clause><clause id="H2B8AB710DC634FC79F3D19D7007928E7"><enum>(iii)</enum><text>is
			 established to serve one or more particular industries; and</text>
						</clause><clause id="H0CD7E8A0A3D244BF99D0A4AB07546800"><enum>(iv)</enum><text>is
			 established to serve a particular geographic region.</text>
						</clause></subparagraph><subparagraph id="HDFAE22E9AE534DF68CFE567459B871E4"><enum>(B)</enum><header>Majority of
			 representatives</header><text>A majority of the representatives comprising the
			 consortium shall be representatives described in subparagraph (A)(i).</text>
					</subparagraph></paragraph><paragraph id="H723CFD5DF2DF43BC9000C556F8E49F74"><enum>(3)</enum><header>Priority for
			 small businesses</header><text>In providing grants under paragraph (1), the
			 Secretary of Labor shall give priority to an eligible entity if a majority of
			 representatives forming the entity represent small-business concerns (as
			 defined in section 3(a) of the <act-name parsable-cite="SBA">Small Business
			 Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632(a)</external-xref>)).</text>
				</paragraph><paragraph id="HA97F71558B5A4134B67117FC96B550DF"><enum>(4)</enum><header>Maximum amount
			 of grant</header><text>The amount of a grant awarded to an eligible entity
			 under paragraph (1) may not exceed $1,000,000 for any fiscal year.</text>
				</paragraph></subsection><subsection id="H9CB2544CBCC0445E9677F19B81C78FB"><enum>(b)</enum><header>Use of
			 Amounts</header>
				<paragraph id="H758161B9311E46F594B58E81DD4C3E7"><enum>(1)</enum><header>In
			 general</header><text>The Secretary of Labor may not award a grant under
			 subsection (a) to an eligible entity unless such entity agrees to use amounts
			 received from such grant to improve the job skills necessary for employment by
			 businesses in the industry with respect to which such entity was
			 established.</text>
				</paragraph><paragraph id="H045646028F964F078E6225905351F5F8"><enum>(2)</enum><header>Conduct of
			 program</header>
					<subparagraph id="H202DDBE99104432FAD0077C3EDE536FC"><enum>(A)</enum><header>In
			 general</header><text>In carrying out the program described in paragraph (1),
			 the eligible entity may provide for—</text>
						<clause id="HE37121B7E136405300873B2DFF482D30"><enum>(i)</enum><text>an
			 assessment of training and job skill needs for the industry;</text>
						</clause><clause id="H52C06340E24F43E7AE00E3BF9047442"><enum>(ii)</enum><text>the
			 development of a sequence of skill standards that are benchmarked to advanced
			 industry practices;</text>
						</clause><clause id="H7B14BA6BA265481086B633346FA2EFED"><enum>(iii)</enum><text>the development
			 of curriculum and training methods, including, where appropriate, e-learning or
			 technology-based training;</text>
						</clause><clause id="H03F771CBC1DB481C95CCA02804B1E7F"><enum>(iv)</enum><text>the
			 purchase, lease, or receipt of donations of training equipment;</text>
						</clause><clause id="HA0048F419C554327A62C26C9E8BD1387"><enum>(v)</enum><text>the
			 identification of training providers and the development of partnerships
			 between the industry and educational institutions, including community
			 colleges;</text>
						</clause><clause id="H0B2D27BCFE3E46B1AD84A7201B9E38BE"><enum>(vi)</enum><text>the
			 development of apprenticeship programs;</text>
						</clause><clause id="H996FE5DA284F49EBBA46939F5831E42"><enum>(vii)</enum><text>the
			 development of training programs for workers, including dislocated
			 workers;</text>
						</clause><clause id="H7286A80CD6794E118DFD00F6DD80AD10"><enum>(viii)</enum><text>the development
			 of training plans for businesses; and</text>
						</clause><clause id="H6E3659D1C70448EE9EC71B008D355100"><enum>(ix)</enum><text>the
			 development of the membership of the entity.</text>
						</clause></subparagraph><subparagraph id="H7CA981491695455888E6539242AAD760"><enum>(B)</enum><header>Additional
			 requirement</header><text>In carrying out the program described in paragraph
			 (1), the eligible entity shall provide for the development and tracking of
			 performance outcome measures for the program and the training providers
			 involved in the program.</text>
					</subparagraph></paragraph><paragraph id="HE88C0D40DA40463C89F01B011F39DAF8"><enum>(3)</enum><header>Administrative
			 costs</header><text>The eligible entity may use not more than 10 percent of the
			 amount of a grant to pay for administrative costs associated with the program
			 described in paragraph (1).</text>
				</paragraph></subsection><subsection id="H5D856E40F1044586882FF971736DEEA9"><enum>(c)</enum><header>Requirement of
			 Matching Funds</header>
				<paragraph id="H2463F3F8B36C475EA79209BAAF548827"><enum>(1)</enum><header>In
			 general</header><text>The Secretary of Labor may not award a grant under
			 subsection (a) to an eligible entity unless such entity agrees that the entity
			 will make available non-Federal contributions toward the costs of carrying out
			 activities under the grant in an amount that is not less than $2 for each $1 of
			 Federal funds provided under the grant, of which—</text>
					<subparagraph id="H2B2AB07FFB3E4849A25749B20062C328"><enum>(A)</enum><text>$1 shall be
			 provided by the businesses participating in the entity; and</text>
					</subparagraph><subparagraph id="H163D65B1F5BB45E79661D907979B30D"><enum>(B)</enum><text>$1 shall be
			 provided by the State or local government involved.</text>
					</subparagraph></paragraph><paragraph id="H45169503FF4B4E0B8FCB83D133DC2E7C"><enum>(2)</enum><header>Other
			 contributions</header>
					<subparagraph id="H3EFBCA948F8D4928BB993B98890000D"><enum>(A)</enum><header>Equipment</header><text>Equipment
			 donations to facilities that are not owned or operated by the members of the
			 eligible entity involved and that are shared by such members may be included in
			 determining compliance with paragraph (1).</text>
					</subparagraph><subparagraph id="H7B744809C2AC4A7798E33E155C164EB6"><enum>(B)</enum><header>Limitation</header><text>An
			 eligible entity may not include in-kind contributions in complying with the
			 requirement of paragraph (1). The Secretary of Labor may consider such
			 donations in ranking applications.</text>
					</subparagraph></paragraph></subsection><subsection id="HE0239C57903C46DDB36DC800C4CCB83"><enum>(d)</enum><header>Limit on
			 Administrative Expenses</header><text>The Secretary of Labor may use not more
			 than 5 percent of the amounts made available to carry out this section to pay
			 the Federal administrative costs associated with awarding grants under this
			 section.</text>
			</subsection><subsection id="HD023CA3493FD4AA4ADA63C9F02E39277"><enum>(e)</enum><header>Authorization of
			 Appropriations</header><text>There are authorized to be appropriated to carry
			 out this section $50,000,000 for each of fiscal years 2007, 2008, and 2009, and
			 such sums as are necessary for each fiscal year thereafter.</text>
			</subsection></section><section id="H65EC6E55644A426CA626B600F278EC12"><enum>3.</enum><header>Grants for
			 regional skills alliance planning</header>
			<subsection id="H53B659EE64F24EFAA400000038E3BD9C"><enum>(a)</enum><header>Authorization</header>
				<paragraph id="HEA6E5923DE0D495283C5000700A40782"><enum>(1)</enum><header>In
			 general</header><text>The Secretary of Labor, in consultation with the
			 Secretary of Commerce, shall award grants to States to enable such States to
			 assist businesses, organizations, and agencies described in section 2(a)(2) in
			 conducting planning to form consortia described in such section.</text>
				</paragraph><paragraph id="H93458082B7094B60B664C4F280F9CEBC"><enum>(2)</enum><header>Maximum amount
			 of grant</header><text>The amount of a grant awarded to a State under paragraph
			 (1) may not exceed $500,000 for any fiscal year.</text>
				</paragraph></subsection><subsection id="HA1E2CEFAF78B4783ACFF9E11D1E51837"><enum>(b)</enum><header>Application</header><text>The
			 Secretary of Labor may not award a grant under subsection (a) to a State unless
			 such State submits to the Secretary an application at such time, in such
			 manner, and containing such information as the Secretary may reasonably
			 require.</text>
			</subsection><subsection id="H2CB876202F984E109CD257D06EA6687C"><enum>(c)</enum><header>Requirement of
			 Matching Funds</header><text>The Secretary of Labor may not award a grant under
			 subsection (a) to a State unless such State agrees that it will make available
			 non-Federal contributions toward the costs of carrying out activities under
			 this section in an amount that is not less than $1 for each $1 of Federal funds
			 provided under the grant.</text>
			</subsection><subsection id="H9D17D47A097F4C6F9E9345E4F790000"><enum>(d)</enum><header>Authorization of
			 Appropriations</header><text>There are authorized to be appropriated to carry
			 out this section $5,000,000 for fiscal year 2007.</text>
			</subsection></section><section id="H08F26C13B0054B51B03E26E6A82C7653"><enum>4.</enum><header>Grants for
			 support of business incubator activities</header>
			<subsection id="H526B1D0DCA1141B99461EA88435FF9F4"><enum>(a)</enum><header>Purpose</header><text>It
			 is the purpose of this section to encourage entrepreneurial creativity and risk
			 taking through the support of the furnishing of business incubator services for
			 newly established small businesses and medium-sized businesses.</text>
			</subsection><subsection id="H284E5BD19CF84FCC8E21FA994E4C28E6"><enum>(b)</enum><header>Grant
			 Program</header><text>To achieve the purpose of this section, the Secretary of
			 Commerce shall carry out a program to provide, through grants, financial
			 assistance for the establishment and support of entities that provide business
			 incubator services in support of the initiation and initial sustainment of
			 business activities by newly established small businesses and medium-sized
			 businesses.</text>
			</subsection><subsection id="HB7EA847B3F5849A0B111CD7586908F2C"><enum>(c)</enum><header>Awards of
			 Grants</header>
				<paragraph id="H6B6BA14C33894331B5AC52EDB695008F"><enum>(1)</enum><header>Eligibility
			 requirements</header><text>The Secretary shall prescribe the eligibility
			 requirements for the awarding of grants under this section.</text>
				</paragraph><paragraph id="HA1E43CE5BE8C4DC1B9B218FF5CF1C28"><enum>(2)</enum><header>Competitive
			 selection</header><text>The Secretary shall use a competitive process for the
			 awarding of grants under this section and, under that process, select
			 recipients of the grants on the basis of merit, with priority given to
			 underserved rural and urban communities.</text>
				</paragraph><paragraph id="HADE62D8350144C25B1CE56C45781C000"><enum>(3)</enum><header>Applications for
			 grants</header><text>The Secretary shall prescribe the form and content of
			 applications required for grants under this section.</text>
				</paragraph></subsection><subsection id="H85B07AAD5B3E4CC89358A4682BC772A"><enum>(d)</enum><header>Additional
			 Administrative Authorities</header>
				<paragraph id="H30B76458504448148103ACE36E89407"><enum>(1)</enum><header>Cost-sharing</header><text>The
			 Secretary may require the recipient of a grant under this section to defray a
			 specific level of its operating expenses for business incubator services out of
			 funds available from sources other than the Federal Government.</text>
				</paragraph><paragraph id="H5AC9CE8CF8CB453B9054EF1400261454"><enum>(2)</enum><header>Additional terms
			 and conditions</header><text>The Secretary, in awarding a grant, may impose any
			 other terms and conditions for the use of the proceeds of the grant that the
			 Secretary determines appropriate for carrying out the purpose of this section
			 and to protect the interests of the United States, including the requirement
			 that entities providing business incubator services that receive a grant under
			 this section develop a plan for ultimately becoming self-sufficient.</text>
				</paragraph></subsection><subsection id="HC9D14657DCEE47489D254DFD6E9702BC"><enum>(e)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="HC54D4947E8D24F600064EEE84338B0D7"><enum>(1)</enum><header>Business
			 incubator services</header><text>The term <term>business incubator
			 services</term> includes professional and technical services necessary for the
			 initiation and initial sustainment of operations of a newly established
			 business, including such services as the following:</text>
					<subparagraph id="HD4E671B9985E47EB854E3FD4F3674207"><enum>(A)</enum><header>Legal
			 services</header><text>Legal services, including aid in preparing corporate
			 charters, partnership agreements, and basic contracts.</text>
					</subparagraph><subparagraph id="H96DF0EFBBC2144218C6369DC0712CC88"><enum>(B)</enum><header>Intellectual
			 property services</header><text>Services in support of the protection of
			 intellectual property through patents, trademarks, or otherwise.</text>
					</subparagraph><subparagraph id="H823FD4540EC1438E8C4D9F930566BF18"><enum>(C)</enum><header>Technology
			 services</header><text>Services in support of the acquisition and use of
			 advanced technology, including the use of Internet services and web-based
			 services.</text>
					</subparagraph><subparagraph id="H4612BF46FD85463A8801AA74EE8751A7"><enum>(D)</enum><header>Planning</header><text>Advice
			 on—</text>
						<clause id="HC932448682EB45DEACEA89F6B8E39B04"><enum>(i)</enum><text>strategic
			 planning; and</text>
						</clause><clause id="H54FD4114C8EC49DCBA973EA8DCC70054"><enum>(ii)</enum><text>marketing,
			 including advertising.</text>
						</clause></subparagraph></paragraph><paragraph id="HEDC4EAE5E74F405B974155A29361CAF"><enum>(2)</enum><header>Small business
			 and medium-sized business</header>
					<subparagraph id="H4248D8E01C6549C6A4A18622234E0089"><enum>(A)</enum><header>Secretary to
			 prescribe</header><text>The Secretary shall prescribe the definitions of the
			 terms <term>small business</term> and <term>medium-sized business</term> for
			 the purpose of this section.</text>
					</subparagraph><subparagraph id="H8510616105CD495FAB14CB07721FE500"><enum>(B)</enum><header>Small business
			 standards</header><text>In defining the term <term>small business</term> for
			 the purpose of this section, the Secretary shall apply the standards applicable
			 for the definition of the term <term>small-business concern</term> under
			 section 3 of the <act-name parsable-cite="SBA">Small Business Act</act-name>
			 (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>).</text>
					</subparagraph></paragraph><paragraph id="HD8D7E446ECFE4F9DBA276264D215F7E6"><enum>(3)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Commerce.</text>
				</paragraph></subsection><subsection id="H38E0E912191E4DD0955088EE1EDC649"><enum>(f)</enum><header>Regulations</header><text>The
			 Secretary shall prescribe regulations for the grant program administered under
			 this section.</text>
			</subsection><subsection id="H719BDFB6898447A8997824BF065FFF17"><enum>(g)</enum><header>Authorization of
			 Appropriations</header><text>There are authorized to be appropriated for the
			 Department of Commerce to carry out this section $50,000,000 for fiscal year
			 2007, and $200,000,000 for each fiscal year thereafter.</text>
			</subsection></section><section id="H9917902127294C26B686522500A7ACDF"><enum>5.</enum><header>Notification of
			 Federal and State elected officials prior to dislocation of
			 workers</header><text display-inline="no-display-inline">Section 3(a)(2) of the
			 Worker Adjustment and Retraining Notification Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2102">29 U.S.C. 2102(a)(2)</external-xref>) is
			 amended by inserting <quote>Federal, State, and</quote> after <quote>the unit
			 of</quote>.</text>
		</section><section id="HD2F963A82BEC4EF5BC9D8FE1ADF90BA"><enum>6.</enum><header>Submission of h–1b
			 labor condition application at same time as classification
			 petition</header><text display-inline="no-display-inline">Section 212(n)(1) of
			 the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (8
			 U.S.C. 1182(n)(1)) is amended by adding at the end the following: <quote>The
			 application under this paragraph shall be submitted by an employer at the same
			 time as the classification petition is filed under section 214 relating to the
			 H–1B nonimmigrants who are the subject of the application.</quote>.</text>
		</section><section id="H20D2169F4EA14E58BD92E193159F8100"><enum>7.</enum><header>Exclusion from
			 income of severance payment amounts</header>
			<subsection id="HFE6255E2AD7A4E18B3521D8B55C76055"><enum>(a)</enum><header>In
			 General</header><text>Part III of subchapter B of chapter 1 of the Internal
			 Revenue Code of 1986 (relating to items specifically excluded from gross
			 income) is amended by inserting after section 139A the following new
			 section:</text>
				<quoted-block id="H179F1D7991084113A06570355DE9E161" style="OLC">
					<section id="H43DBED1E92C74CC7AE3D8825B5CAA4C"><enum>139B.</enum><header>Severance
				payments</header>
						<subsection id="H65922ADE4D81468A9212441901D9DA00"><enum>(a)</enum><header>In
				General</header><text>In the case of an individual, gross income shall not
				include any qualified severance payment.</text>
						</subsection><subsection id="HED1B3ADD29304D7381108C244499F024"><enum>(b)</enum><header>Limitation</header><text>The
				amount to which the exclusion under subsection (a) applies shall not exceed
				$25,000 with respect to each separation from employment described in subsection
				(c)(1)(B).</text>
						</subsection><subsection id="HE51B494F484D4DB58F8446FE7595D32"><enum>(c)</enum><header>Qualified
				Severance Payment</header><text>For purposes of this section—</text>
							<paragraph id="H9664C4AAD5EA4DE5984471135DCEE507"><enum>(1)</enum><header>In
				general</header><text>The term <term>qualified severance payment</term> means
				any payment received by an individual if—</text>
								<subparagraph id="H980A7D48DBE74F09B2B6DA3A5C88780"><enum>(A)</enum><text>such payment was
				paid by such individual‘s employer on account of such individual’s separation
				from employment, and</text>
								</subparagraph><subparagraph id="H113C76466D914216BDCD3CF77D1226D3"><enum>(B)</enum><text>such separation
				was in connection with a reduction in the work force of the employer.</text>
								</subparagraph></paragraph><paragraph id="H70216F9C2AD44AF4903C3400DC264514"><enum>(2)</enum><header>Limitation</header><text>Such
				term shall not include any payment received by an individual if the aggregate
				payments received with respect to the separation from employment exceed
				$150,000.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H5E6DC3A29C634DA0A6EA907CB4C77342"><enum>(b)</enum><header>Clerical
			 Amendment</header><text>The table of sections for part III of subchapter B of
			 chapter 1 of such Code is amended by inserting after the item relating to
			 section 139A the following new item:</text>

						<toc-entry level="section">Sec. 139B. Severance
				payments.</toc-entry>
					</toc>
					<after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HFB79ECA22C2C44BCA4FFAFEE30A581"><enum>(c)</enum><header>Effective
			 Date</header><text>The amendments made by this section shall apply to taxable
			 years beginning after December 31, 2007.</text>
			</subsection></section><section id="H83A0974909504581A1EC23A800491302"><enum>8.</enum><header>Expansion of work
			 opportunity tax credit</header>
			<subsection id="HCF58F5F86F71415BB33500BC8973ECEB"><enum>(a)</enum><header>In
			 General</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/51">Section 51(d)(1)</external-xref> of the Internal Revenue Code of 1986
			 (relating to members of targeted groups) is amended by striking
			 <quote>or</quote> at the end of subparagraph (G), by striking the period at the
			 end of subparagraph (H) and inserting <quote>, or</quote>, and by adding at the
			 end the following:</text>
				<quoted-block id="HA0337FE10C05474E9379A7D5C07EEEA3" style="OLC">
					<subparagraph id="HCEDF11799D684168A0022C7F03E8AB98"><enum>(I)</enum><text>a qualified small
				business
				employee.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HE082D5F72FA84DA18219BB0373EF83B6"><enum>(b)</enum><header>Qualified Small
			 Business Employee</header><text>Section 51(d) of the Internal Revenue Code of
			 1986 is amended by redesignating paragraphs (10) through (12) as paragraphs
			 (11) through (13), respectively, and by inserting after paragraph (9) the
			 following:</text>
				<quoted-block id="H3AC9E78F6C54460D8E722B00D0663B43" style="OLC">
					<paragraph id="H7AF224DFB24B4B7894E1F1AB292D95D"><enum>(10)</enum><header>Qualified small
				business employee</header>
						<subparagraph id="H5A9A4727ACA940D4AACC2833CA0050E4"><enum>(A)</enum><header>In
				general</header><text>The term <term>qualified small business employee</term>
				means any individual—</text>
							<clause id="H2A9377B826D44402B6EEFAED7058D5D3"><enum>(i)</enum><text>hired by a
				qualified small business located in a development zone, or</text>
							</clause><clause id="H5B8487C651BC485E8CC4EFA8FABF55DE"><enum>(ii)</enum><text>hired by a
				qualified small business and who is certified by the designated local agency as
				residing in such a development zone.</text>
							</clause></subparagraph><subparagraph id="H654357C22920445693A22F38F5686F7D"><enum>(B)</enum><header>Qualified small
				business</header><text>The term <term>qualified small business</term> has the
				meaning given the term <term>small employer</term> by section
				4980D(d)(2).</text>
						</subparagraph><subparagraph id="HA6E368C2FEE04B049BA70CC36B15891"><enum>(C)</enum><header>Development
				zone</header><text>For purposes of this section—</text>
							<clause id="H036FA4F960DE4A16B907BC00734040C3"><enum>(i)</enum><header>In
				general</header><text>The term <term>development zone</term> means any
				area—</text>
								<subclause id="H42F9093E837942E3A7F2EDE58A884FA"><enum>(I)</enum><text>which is nominated
				under the procedures defined in sections 1400E(a)(1)(A) and 1400E(a)(4) for
				renewal communities;</text>
								</subclause><subclause id="HF1652B5BBC814EFA81E8EC17C1CDFF3D"><enum>(II)</enum><text>which the
				Secretary of Housing and Urban Development designates as a development zone,
				after consultation with the Secretary of Commerce;</text>
								</subclause><subclause id="H08D19498951F45BBA8D9DDEB00FCA4E"><enum>(III)</enum><text>which has a
				population of not less than 5,000 and not more than 150,000;</text>
								</subclause><subclause id="H0DA298647E194B39BAD8DD82447300C4"><enum>(IV)</enum><text>which has a
				poverty rate not less than 20 percent (within the meaning of section
				1400E(c)(3)(C));</text>
								</subclause><subclause id="H2D77C46454524D45BBDAFC6B3AAE275"><enum>(V)</enum><text>which has an
				average annual rate of job growth of less than 2 percent during any 3 years of
				the preceding 5-year period; and</text>
								</subclause><subclause id="H932F4B1A388744DBB732A7B9B3EBD05E"><enum>(VI)</enum><text>which, during the
				period beginning January 1, 1990 and ending with the date of the enactment of
				this section, has a net out-migration of inhabitants, or other population loss,
				from the area of at least 2 percent of the population of the area during such
				period.</text>
								</subclause></clause><clause id="HF32A5C5B83FB46F5B08751D0BB1D624C"><enum>(ii)</enum><header>Number of
				designations</header><text>The Secretary of Housing and Urban Development may
				not designate more than 100 development zones.</text>
							</clause></subparagraph><subparagraph id="H544CD322654C4D20877EDD1B1DD8E4B"><enum>(D)</enum><header>Special rules for
				determining amount of credit</header><text>For purposes of applying this
				subpart to wages paid or incurred to any qualified small business
				employee—</text>
							<clause id="HC10E7911EA9742AB963BD550874ED699"><enum>(i)</enum><text>subsection (a)
				shall be applied by substituting <quote>20 percent of the qualified first,
				second, third, fourth, or fifth year wages</quote> for <quote>40 percent of the
				qualified first year wages</quote>, and</text>
							</clause><clause id="HEFFB1A9DC92745928800392905E91B69"><enum>(ii)</enum><text>in lieu of
				paragraphs (2) and (3) of subsection (b), the following definitions and special
				rule shall apply:</text>
								<subclause id="HB823C79BD41E419598B8C3423838072F"><enum>(I)</enum><header>Qualified
				first-year wages</header><text>The term <term>qualified first-year wages</term>
				means, with respect to any individual, qualified wages attributable to service
				rendered during the 1-year period beginning with the day the individual begins
				work for the employer.</text>
								</subclause><subclause id="HB5C902BA767044F79CCB54AB58DD8F0"><enum>(II)</enum><header>Qualified
				second-year wages</header><text>The term <term>qualified second-year
				wages</term> means, with respect to any individual, qualified wages
				attributable to service rendered during the 1-year period beginning on the day
				after the last day of the 1-year period with respect to such individual
				determined under subclause (I).</text>
								</subclause><subclause id="HBA4D1903B9F84F70B278F8AC3C76ED3"><enum>(III)</enum><header>Qualified
				third-year wages</header><text>The term <term>qualified third-year wages</term>
				means, with respect to any individual, qualified wages attributable to service
				rendered during the 1-year period beginning on the day after the last day of
				the 1-year period with respect to such individual determined under subclause
				(II).</text>
								</subclause><subclause id="H0CFE6CF85CA040B4B07663924B2C8BA4"><enum>(IV)</enum><header>Qualified
				fourth-year wages</header><text>The term <term>qualified fourth-year
				wages</term> means, with respect to any individual, qualified wages
				attributable to service rendered during the 1-year period beginning on the day
				after the last day of the 1-year period with respect to such individual
				determined under subclause (III).</text>
								</subclause><subclause id="HC82B1B2D6DC9461BA7BB86F7C0309083"><enum>(V)</enum><header>Qualified
				fifth-year wages</header><text>The term <term>qualified fifth-year wages</term>
				means, with respect to any individual, qualified wages attributable to service
				rendered during the 1-year period beginning on the day after the last day of
				the 1-year period with respect to such individual determined under subclause
				(IV).</text>
								</subclause><subclause id="H998175926E6B4F61A36E1176BABF187E"><enum>(VI)</enum><header>Only first
				$15,000 of wages per year taken into account</header><text>The amount of the
				qualified first, second, third, fourth, and fifth year wages which may be taken
				into account with respect to any individual shall not exceed $15,000 per
				year.</text>
								</subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H0C444D7765D644348D1E62FD00D63EB4"><enum>(c)</enum><header>Effective
			 Date</header><text>The amendments made by this section shall apply to
			 individuals who begin work for the employer after the date of the enactment of
			 this Act.</text>
