		  enhanced penalties for marketing controlled substances to

		<section display-inline="no-display-inline" id="H5F0AB9E46FE140590078C180896B2488" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Stop Marketing Illegal Drugs to Minors
			 Act</short-title></quote>.</text>
		</section><section id="H1E0BAE05B7BA4E21BC9DC6871B9FB804"><enum>2.</enum><header>Sentencing
			 enhancements for marketing controlled substances to minors</header><text display-inline="no-display-inline">Section 418 of the Controlled Substances Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/21/859">21 U.S.C. 859</external-xref>) is amended—</text>
			<paragraph id="HB0FB47D448E241878900B64CDD8C007F"><enum>(1)</enum><text display-inline="yes-display-inline">in the section heading, by adding at the
			 end the following: <quote><header-in-text level="section" style="traditional">;
			 marketing to minors</header-in-text></quote>;</text>
			</paragraph><paragraph id="HF44705684E6C419F885F964268933E76"><enum>(2)</enum><text>in subsection (a),
			 by inserting after <quote>twenty-one years of age</quote> the following:
			 <quote>, or who manufactures, creates, distributes, or possesses with intent to
			 distribute a controlled substance that is flavored, colored, packaged, or
			 otherwise altered in a way that is designed to make that controlled substance
			 more appealing to a person under twenty-one years of age, or who attempts or
			 conspires to do so,</quote>;</text>
			</paragraph><paragraph id="HA95A73DB8E0B4F7BA6E515927EF696C"><enum>(3)</enum><text>in
			 subsection (b), by inserting after <quote>twenty-one years of age</quote> the
			 following: <quote>, or who manufactures, creates, distributes, or possesses
			 with intent to distribute a controlled substance that is flavored, colored,
			 packaged, or otherwise altered in a way that is designed to make that
			 controlled substance more appealing to a person under twenty-one years of age,
			 or who attempts or conspires to do so,</quote>; and</text>
			</paragraph><paragraph id="H2381BDF03DB548CD8C00D542DC574FB7"><enum>(4)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H19069AEA88C94CD5BA69F221F5072E4E" style="traditional">
					<subsection id="H2CB2E83A531843368CA3D2BE4C9BFBFC"><enum>(c)</enum><text display-inline="yes-display-inline">If the controlled substance that is
				involved in an offense under this section is methamphetamine, its salts,
				isomers, and salts of its isomers or a mixture or substance containing a
				detectable amount of methamphetamine, its salts, isomers, or salts of its
				isomers, unless a greater term of imprisonment is imposed under another
				provision of this Act, the offender shall—</text>
						<paragraph id="H80ABAA2A30124DC89B1C323317387018"><enum>(1)</enum><text>in the case of a
				first offense—</text>
							<subparagraph id="HC1BD2C0F45C84067987CC129A6B62E7D"><enum>(A)</enum><text>if the amount of
				the methamphetamine involved is 50 grams or more or of the mixture involved is
				500 grams or more, be fined not more than $8,000,000 if an individual and not
				more than $20,000,000 if a person other than an individual, and imprisoned for
				any term of years not less than 20, or for life;</text>
							</subparagraph><subparagraph id="H5032879522934CDEBB9E37D4D7A3273"><enum>(B)</enum><text>if the amount of
				methamphetamine involved is not less than 5 nor more than 50 grams or of the
				mixture is not less than 50 grams nor more than 500 grams, be fined not more
				than $4,000,000 if an individual and not more than $10,000,000 if a person
				other than an individual, and imprisoned for any term of years not less than
				10, nor more than 80; and</text>
							</subparagraph><subparagraph id="HFCFFC84CB90843EABB85078778500432"><enum>(C)</enum><text display-inline="yes-display-inline">fined not more than $2,000,000 if an
				individual and not more than $10,000,000 if a person other than an individual,
				and imprisoned any term or years not less than 5 nor more than 40, in any other
				case;</text>
							</subparagraph></paragraph><paragraph id="H5A666058F1BA489486D239B80435A862"><enum>(2)</enum><text>in the case of a
				second offense—</text>
							<subparagraph id="H2AAF0E0BDEE242788FFB46395C026FF4"><enum>(A)</enum><text display-inline="yes-display-inline">if the amount of the methamphetamine
				involved is 50 grams or more or of the mixture involved is 500 grams or more,
				be fined not more than $16,000,000 if an individual and not more than
				$40,000,000 if a person other than an individual, and imprisoned for any term
				of years not less than 40, or for life;</text>
							</subparagraph><subparagraph id="H871F66241B024E3B804BB6C02417551C"><enum>(B)</enum><text display-inline="yes-display-inline">if the amount of methamphetamine involved
				is not less than 5 but is less than 50 grams or of the mixture is not less than
				50 grams but is less than 500 grams, be fined not more than $8,000,000 if an
				individual and not more than $20,000,000 if a person other than an individual,
				and imprisoned for any term of years not less than 20, or for life; and</text>
							</subparagraph><subparagraph id="H18DBC06D88FD46C6853717C2E72EBD2C"><enum>(C)</enum><text display-inline="yes-display-inline">fined not more than $4,000,000 if an
				individual and not more than $20,000,000 if a person other than an individual,
				and imprisoned any term or years not less than 10 nor more than 60, in any
				other case; and</text>
							</subparagraph></paragraph><paragraph id="HD141B4EB6748425F9B25D71643AE74A1"><enum>(3)</enum><text>in the case of a
				third or subsequent offense—</text>
							<subparagraph id="HB600DA189E114914A1C9721FFD5C3B00"><enum>(A)</enum><text display-inline="yes-display-inline">if the amount of the methamphetamine
				involved is 50 grams or more or of the mixture involved is 500 grams or more,
				be fined not more than $32,000,000 if an individual and not more than
				$80,000,000 if a person other than an individual, and imprisoned for
				life;</text>
							</subparagraph><subparagraph id="H66B82516902E4212A8C4C1D917D205AC"><enum>(B)</enum><text display-inline="yes-display-inline">if the amount of methamphetamine involved
				is not less than 5 but is less than 50 grams or of the mixture is not less than
				50 grams but is less than 500 grams, be fined not more than $16,000,000 if an
				individual and not more than $40,000,000 if a person other than an individual,
				and imprisoned for life; and</text>
							</subparagraph><subparagraph id="H214B7D16483B478181F352130000CDD"><enum>(C)</enum><text display-inline="yes-display-inline">fined not more than $8,000,000 if an
				individual and not more than $40,000,000 if a person other than an individual,
				and imprisoned for life, in any other
				case.</text>
