		<official-title>To amend the Consolidated Farm and Rural Development Act
		  to provide for comprehensive community and economic development in the
		  distressed Southern Black Belt and Mississippi Delta region while leveraging
		  existing efforts, entities, and resources.</official-title>

		<section display-inline="no-display-inline" id="H6486DBEEB71F4037A42C7E7DBE202B3C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Southern Empowerment and Economic
			 Development Act to authorize the Delta Black Belt Regional
			 Authority</short-title></quote>.</text>
		</section><section id="HFC7DDE65867449738DBA50FBD07BC73"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text>
			<paragraph id="H487F06AA06284AB4B9A9DE2DBBCB674"><enum>(1)</enum><text>A
			 University of Georgia study, entitled <quote>Dismantling Persistent Poverty in
			 the Southeastern United States</quote>, finds that counties in the Delta Black
			 Belt region sustained persistent poverty over 3 census periods and comprise the
			 poorest of all regions in the country.</text>
			</paragraph><paragraph id="HA02B0B0BB42941778CCF648E551D7B9B"><enum>(2)</enum><text>A
			 study conducted by the Southern Food Systems Education Consortium and led by
			 Tuskegee University, entitled <quote>Persistent Poverty in the South</quote>,
			 finds that these counties lack a coordinating body, supporting organization, or
			 any central capacity building agency to link and enhance the work of service
			 providers to address the issue of persistent poverty.</text>
			</paragraph><paragraph id="H2B43C7B568C24019B4C8EF2D26DEBADC"><enum>(3)</enum><text>These studies find
			 that the economic peril facing the region results from, and in turn contributes
			 to, the widespread and persistent nature of the region’s poverty.</text>
			</paragraph><paragraph id="HB2D5129C848D493800506218DBB7EF6B"><enum>(4)</enum><text>These studies find
			 that this region would benefit from a sustained, coordinated strategy targeted
			 at the most distressed communities by a regional initiative.</text>
			</paragraph><paragraph id="H63F4E81DB323476796D0F91C5000E6BE"><enum>(5)</enum><text>There is a
			 Federal-State partnership that is targeted at poverty in the Delta region but
			 overlays with the historic Southern Black Belt’s region of persistent
			 poverty.</text>
			</paragraph><paragraph id="H6622D105522D42B48C7EBC3EA9121CD8"><enum>(6)</enum><text>The Delta Regional
			 Authority has shown early promise in addressing causes of persistent poverty as
			 a regional initiative.</text>
			</paragraph><paragraph id="H3A16EE9F13C84E52970436CD31C568B1"><enum>(7)</enum><text>There is value in
			 establishing a collaborative partnership with community-based and faith-based
			 organizations in the distressed region as well as institutions of higher
			 learning in the region as a component of any regional initiative.</text>
			</paragraph></section><section id="HD4B9EBF354784976AD0035A27003E4F"><enum>3.</enum><header>Delta Regional
			 Authority expansion</header>
			<subsection id="HD460552D3633499A8011D573E1F06B0"><enum>(a)</enum><header>Authority</header><text>Section
			 382A(1) of the <act-name parsable-cite="CFRDA">Consolidated Farm and Rural
			 Development Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/7/2009aa">7 U.S.C. 2009aa(1)</external-xref>) is amended to read as
			 follows:</text>
				<quoted-block act-name="Consolidated Farm and Rural Development Act" id="HB0BB78184B3B4B799BBBEC4C00D700AB">
					<paragraph id="HBC89B3E5B82D41F18D68DB3E451C5C52"><enum>(1)</enum><text>The term
				<term>Authority</term> means the Delta/Black Belt Regional
				Authority.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HB8E9A4B20443401982B60094DDE3F8CB"><enum>(b)</enum><header>Scope of
			 Authority</header><text>Section 382B(a)(1) of such Act (7 U.S.C.
			 2009aa–1(a)(1)) is amended to read as follows:</text>

					<paragraph id="HC0E77FB66BF543788355FDE68C48B3D4"><enum>(1)</enum><header>In
				general</header><text>There is established the Delta/Black Belt Regional
				Authority.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H1C298D5AF39644239CE7B8B798887588"><enum>(c)</enum><header>Constituency
			 Representation Board</header><text>Section 382B of such Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2009aa-1">7 U.S.C. 2009aa–1</external-xref>)
			 is amended by adding at the end the following:</text>

					<subsection id="H9B4A4A68FC5E4718BAAA3461009318F7"><enum>(k)</enum><header>Constituency
				Representation Board</header>
						<paragraph id="H64CB853D14CF4898AB8277137743D6DB"><enum>(1)</enum><header>In
				general</header><text>The Authority shall establish a Constituency
				Representation Board (in this subsection referred to as the
				<quote>Board</quote>).</text>
						</paragraph><paragraph id="HF97466C6B0124422B755C074091ED036"><enum>(2)</enum><header>Membership</header>
							<subparagraph id="H2B1C74CF46314647B423C9F84BE2BB3F"><enum>(A)</enum><header>Appointed
				members</header>
								<clause id="HF67BF91BCA8748B9AB9DEE1FDCD98F06"><enum>(i)</enum><header>In
				general</header><text>With respect to each congressional district that includes
				part or all of a county or parish that is in the region, the Governor of the
				State in which the district lies may appoint to the Board 1 individual who has
				(or, if more than half of the population of the district resides in 1 or more
				counties or parishes in the region, 2 individuals who have) the following
				qualifications:</text>
									<subclause id="HF7E7896BF08C4E2894DC634C00637CA7"><enum>(I)</enum><text>The individual is
				a legal resident of the district.</text>
									</subclause><subclause id="HFAD8BDB6AF184B9B8F10CB4DFD3E4046"><enum>(II)</enum><text>The individual
				resides in a county or parish in the region.</text>
									</subclause><subclause id="HF2DBD3CAF420441E9DD56E76397B49F2"><enum>(III)</enum><text>The individual
				is a community leader or economic development and community development
				practitioner who—</text>
										<item id="HBB654063D66D4820B7289ECBF29F1C63"><enum>(aa)</enum><text>represents a
				community-based or faith-based organization or institution of higher learning
				in the region; and</text>
										</item><item id="H3E51E5A01D4B49A3A6009F5591AF8B57"><enum>(bb)</enum><text>has
				direct contact with the persistently poverty stricken population of the
				region.</text>
										</item></subclause></clause><clause id="H51905787099A4F8E806CC5402FDE469"><enum>(ii)</enum><header>Manner of
				appointment</header><text>A Governor shall make an appointment to the Board by
				submitting the appointment in writing to the Authority, which shall maintain
				records of the membership and activities of the Board.</text>
								</clause></subparagraph><subparagraph id="HCC44FE9147AB47A98718F268FB01D9FF"><enum>(B)</enum><header>Federal
				cochairperson</header><text>The Federal cochairperson shall be a member of the
				Board.</text>
							</subparagraph></paragraph><paragraph id="HDD48E69C75004907BB919EF3577D691"><enum>(3)</enum><header>Term of
				office</header>
							<subparagraph id="H22605B8D581D49D9BCA0A69531FDA172"><enum>(A)</enum><header>In
				general</header><text>Each Board member shall be appointed for a 2-year term
				that expires on January 31 of the next odd-numbered calendar year.</text>
							</subparagraph><subparagraph id="H2378176E20D541AA8107A7854EEA98D8"><enum>(B)</enum><header>Continuation of
				service</header>
								<clause id="H50D2C27F6D824D8895F8211728F622B"><enum>(i)</enum><header>In
				general</header><text>A Board member may continue to serve as such after the
				expiration of the term for which appointed, until the earlier of such time as a
				successor for the member is appointed or the date that is 120 days after the
				end of the term.</text>
								</clause><clause id="H838199D010EB4D7B892D5F16A834914B"><enum>(ii)</enum><header>Exception</header><text>If
				a congressional district is eliminated as a result of reapportionment then the
				preceding sentence shall not apply with respect to the Board member
				representing the district.</text>
								</clause></subparagraph><subparagraph id="HE6C76CE0F9BC4F53BABF9F40080482F"><enum>(C)</enum><header>Term
				limits</header>
								<clause id="H092C4CB36831402C8DA1C45FBF4B613"><enum>(i)</enum><header>In
				general</header><text>Except as provided in subparagraph (B) and clause (ii) of
				this subparagraph, an individual may not serve more than a single 2-year term
				on the Board.</text>
								</clause><clause id="H44DF17ACB4D94C6BA341AA1900087813"><enum>(ii)</enum><header>Exception</header><text>An
				original Board member may be reappointed to the Board once.</text>
								</clause></subparagraph></paragraph><paragraph id="HAC65CA832A1B4F6C93126F96709B16BA"><enum>(4)</enum><header>Chair and Vice
				Chair</header>
							<subparagraph id="HF2B0DCF57A124295939F78F6641B4702"><enum>(A)</enum><header>In
				general</header><text>The Board members shall elect a Chair and Vice Chair from
				among the members.</text>
							</subparagraph><subparagraph id="H26B454E7F53B4F77866277B0BD85BDB2"><enum>(B)</enum><header>Treatment as
				Governor and Alternate</header><text>The Chair and Vice Chair shall be treated
				as if they were a Governor and Alternate, respectively, of a State
				participating in the Authority for governance, voting, and all other purposes
				under section 382B.</text>
							</subparagraph><subparagraph id="H4B4E3A13C0264BB09DD50910A99E4F85"><enum>(C)</enum><header>Term of
				office</header><text>The Chair and Vice Chair shall be elected for a 2-year
				term that expires on January 31 of the next odd-numbered year.</text>
							</subparagraph><subparagraph id="H254D77BBBC1D44899F902E5BAB6ED3C8"><enum>(D)</enum><header>Other
				duties</header><text>The Chair and Vice Chair shall invite the Executive
				Director of the Authority to each Board meeting and keep the Executive Director
				apprised of the activities of the Board.</text>
							</subparagraph></paragraph><paragraph id="HCA3692F63D8849EFBF88C97F1E45464F"><enum>(5)</enum><header>Regional
				subcommittees</header>
							<subparagraph id="H2DCA85D3D65B4119939244BA8403EB19"><enum>(A)</enum><header>Membership</header><text>The
				Board shall have 4 regional subcommittees, as follows:</text>
								<clause id="H924FC53FD1694209855C6270AD4BF639"><enum>(i)</enum><text>A
				regional subcommittee composed of the Board members from Virginia, North
				Carolina, and South Carolina.</text>
								</clause><clause id="HEEC2E1C5169448A08667C44BC68FB672"><enum>(ii)</enum><text>A
				regional subcommittee composed of the Board members from Georgia, Florida, and
				Alabama.</text>
								</clause><clause id="HE5E430BE031C41BF973D8DB86541AD15"><enum>(iii)</enum><text>A regional
				subcommittee composed of the Board members from Texas, Arkansas, and
				Louisiana.</text>
								</clause><clause id="H7B4B0E8C05214429BC0073A6C96119A7"><enum>(iv)</enum><text>A
				regional subcommittee composed of the Board members from Kentucky, Missouri,
				Tennessee, Mississippi, and Illinois.</text>
								</clause></subparagraph><subparagraph id="H6A5D670D11634451A100AF9117E85400"><enum>(B)</enum><header>Duties</header><text>Each
				regional subcommittee shall review projects proposed to be carried out in the
				region covered by the subcommittee, and determine which projects should be
				submitted to the Executive Committee for final approval.</text>
							</subparagraph></paragraph><paragraph id="H45E62F408B304EF3ABCFBA565D8E0044"><enum>(6)</enum><header>Executive
				Committee</header>
							<subparagraph id="HCC58C1AE78C847A08179EC4855A70213"><enum>(A)</enum><header>Membership</header><text>The
				Board shall have an Executive Committee consisting of the following:</text>
								<clause id="H0B2700D845EA4737AB04789356B4A3FA"><enum>(i)</enum><text>The Chair and Vice
				Chair of the Board.</text>
								</clause><clause id="HC52A5E13B27645DA8215C4DE3589DC1B"><enum>(ii)</enum><text>2
				members of each regional subcommittee, each of whom shall be elected by a
				majority of the members of the regional subcommittee involved.</text>
								</clause><clause id="HB2CC8FA3B6BC487F9401FA3D78210064"><enum>(iii)</enum><text>The Federal
				cochairperson.</text>
								</clause></subparagraph><subparagraph id="HE82820E3BDE74C9DBB9C28E4B20094C0"><enum>(B)</enum><header>Functions</header><text>The
				Executive Committee shall perform the administrative functions of the Board,
				including review and approval of projects submitted by the regional
				subcommittees and disbursement of funds.</text>
							</subparagraph></paragraph><paragraph id="HAC34D7B4D5F8476CA7A7D18E6D12ABE3"><enum>(7)</enum><header>Community
				strategic planning</header><text>The members of the Board shall ascertain and
				communicate to the Authority the strategic planning priorities of communities
				in their respective States and congressional districts. The members of the
				Board shall consult with other community leaders and economic development and
				community development practitioners that represent community-based and
				faith-based organizations from their respective States and congressional
				districts in performing their duties under this paragraph. The members of the
				Board shall collaborate with their respective Governors, Alternates, and
				Members of the United States House of Representatives in the performance of
				their duties under this paragraph.</text>
						</paragraph><paragraph id="H157B0FF280874DBFAE5772A173CB30D9"><enum>(8)</enum><header>Regional and
				State planning</header><text>The Board shall participate in the development and
				approval of regional plans and priorities developed by the Authority under
				section 382B(d)(1). Members of the Board may participate in the development of
				their respective State development plans.</text>
						</paragraph><paragraph id="HD0487818742D43AB82189FA87148C581"><enum>(9)</enum><header>Programs and
				demonstration projects</header>
							<subparagraph id="HE95CE61B93674286BC31D4727E8FF1FE"><enum>(A)</enum><header>Consideration
				and funding</header><text>The Board shall receive applications for, identify,
				evaluate, develop, and fund programs and demonstration projects to be organized
				and operated by community-based or faith-based organizations in the region or
				the institutions of higher learning in the region, consistent with the purposes
				of the Authority.</text>
							</subparagraph><subparagraph id="H1EEB952232014A19A914746DC0D921E9"><enum>(B)</enum><header>Eligibility for
				funding</header>
								<clause id="HB14867E6C8AB4F59BBB61663B0123C4"><enum>(i)</enum><header>In
				general</header><text>A program or demonstration project shall not be funded
				under subparagraph (A) unless the Board determines that the program or project
				will benefit a county or identifiable community that experiences significant
				economic distress.</text>
								</clause><clause id="H71BE64A0475A49ECB15C32C5B2F77402"><enum>(ii)</enum><header>Definition of
				county or identifiable community that experiences significant economic
				distress</header><text>For purposes of clause (i), a county or identifiable
				community is experiencing significant economic distress if—</text>
									<subclause id="H58DAB797FBBC4F1AA6F0D5FDC88ED564"><enum>(I)</enum><item commented="no" display-inline="yes-display-inline" id="H6E78B978A8C84C07ADC3F14EB61DE500"><enum>(aa)</enum><text>the 3-year average
				unemployment rate for the county or identifiable community is at least 150
				percent of the national average unemployment rate;</text>
										</item><item id="H5513612A26264BC78805657C20DA1B03" indent="up1"><enum>(bb)</enum><text>the per capita income of the county
				or identifiable community is not more than 67 percent of the national average
				per capita income; and</text>
										</item><item id="HF446892827BC4AB7B087B5EFC81DA8F2" indent="up1"><enum>(cc)</enum><text>the poverty rate of the county or
				identifiable community is at least 150 percent of the national average poverty
				rate; or</text>
										</item></subclause><subclause id="H9EC861BEC36B42A5AD00FCB06161CA00"><enum>(II)</enum><item commented="no" display-inline="yes-display-inline" id="H779F38E5480B4A12805F03EEBE00FC34"><enum>(aa)</enum><text>the county or
				identifiable community meets the condition described in item (aa) or (bb) of
				subclause (I); and</text>
										</item><item id="HC1F226D0899B47E1BE2275F525CF75FD" indent="up1"><enum>(bb)</enum><text>the poverty rate of the county or
				identifiable community is at least 200 percent of the national average poverty
				rate.</text>
										</item></subclause></clause><clause id="H1828C1C809E54E199049CDB719F7D352"><enum>(iii)</enum><header>Determinations</header><text>In
				determining whether a county or identifiable community is experiencing
				significant economic distress in accordance with clause (ii), the Board may use
				such information as the Board deems reliable.</text>
								</clause></subparagraph></paragraph><paragraph id="HA3D6562D3E724DC4A767DD4093931EC7"><enum>(10)</enum><header>Source of
				funds</header>
							<subparagraph id="H3BB033D5816142F3A7B300F1BD006C6B"><enum>(A)</enum><header>In
				general</header><text>Not less than 20 percent of the amount appropriated under
				section 382M(a) for a fiscal year shall be available for programs and
				demonstration projects approved for funding under paragraph (9) of this
				subsection.</text>
							</subparagraph><subparagraph id="HC59F91F9B9BA40BBBDEADDDF000A978"><enum>(B)</enum><header>Special rule
				regarding administrative expenses</header><text>Administrative costs and
				expenses associated with the activities of the Board shall not be considered
				administrative expenses for purposes of section 382M(b).</text>
							</subparagraph></paragraph><paragraph id="HFE125386DCC14D5FB0C1C84D646EE059"><enum>(11)</enum><header>Other
				functions</header>
							<subparagraph id="H3E09A9F42D2E4CE2A2A8E27CF2BB5670"><enum>(A)</enum><header>Hearings</header><text>The
				Board shall hold no less than 4 public hearings annually, no less than 1 in
				each region covered by each regional subcommittee, on how the Board and the
				Authority are serving the community-based and faith-based organizations in the
				region that interface directly with the persistently poverty stricken
				population of the region. The Board shall include the information obtained in
				the hearings in the annual reports required by paragraph (12).</text>
							</subparagraph><subparagraph id="H1ED51970C66A46D9BCEFBC00DC001DE7"><enum>(B)</enum><header>Assessment of
				relevant matters</header><text>The Board may assess any matter involving the
				region or the Authority, including the criteria for distress, programs of the
				Authority, or allocation formulas, and shall and communicate the findings of
				the Board to the Federal cochairperson.</text>
							</subparagraph></paragraph><paragraph id="H406861E382CA405BBFAFD8C1DA0065CC"><enum>(12)</enum><header>Annual
				reports</header><text>The Board shall prepare and submit to the Congress an
				annual report on—</text>
							<subparagraph id="HA178AE90CE5E4E95A83D8B1C4F30CF59"><enum>(A)</enum><text>the activities and
				plans of the Board for supporting community-based and faith-based organizations
				in the region;</text>
							</subparagraph><subparagraph id="H38A4B9802E304DAA808934D52E4FA6A9"><enum>(B)</enum><text>the state of the
				community-based and faith-based organizations in the region that interface
				directly with the persistently poverty stricken population of the
				region;</text>
							</subparagraph><subparagraph id="H8956CD3996F64551BB73A704E393CCD3"><enum>(C)</enum><text>the programs and
				demonstration projects funded under paragraph (9) of this subsection;
				and</text>
							</subparagraph><subparagraph id="H265C4A99F4114A3EB8C82D917F998FA0"><enum>(D)</enum><text>such other matters
				relating to the activities described in section 382C(a) as the Board wishes to
				bring to the attention of the
				Congress.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H7E034B1CC95F4545BE5745B3A2AF404B"><enum>(d)</enum><header>Program
			 areas</header><text>Section 382C(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2009aa-2">7 U.S.C. 2009aa–2(a)</external-xref>) is
			 amended—</text>
				<paragraph id="H2B8BD5E6334E48969B9093F963A21876"><enum>(1)</enum><text>by striking
			 <quote>and</quote> at the end of paragraph (4);</text>
				</paragraph><paragraph id="HFEACAD02E3D149C69EE38550E4499DB6"><enum>(2)</enum><text>by redesignating
			 paragraph (5) as paragraph (8); and</text>
				</paragraph><paragraph id="HCCBB5C2B3C0C4483B3A46D2B8FA1BA29"><enum>(3)</enum><text>by inserting after
			 paragraph (4) the following:</text>
					<quoted-block id="H01100D0BC19C423A901F969DAB4B7C19">
						<paragraph id="H82AE65D7A5F04CF98793F3FC2DCD26D8"><enum>(5)</enum><text>to provide
				assistance to severely distressed and underdeveloped areas that lack resources
				for improving educational opportunities including adult and remedial
				education;</text>
						</paragraph><paragraph id="HBC1E70A328774DFFB631B8195F57739B"><enum>(6)</enum><text>to provide
				assistance to severely distressed and underdeveloped areas that lack resources
				for improving access to affordable, quality health care in rural areas;</text>
						</paragraph><paragraph id="HA0614F0EBE57434B8847F189754FB3C9"><enum>(7)</enum><text>to provide
				assistance to severely distressed and underdeveloped areas that lack resources
				for eliminating sub-standard housing facilities;
				and</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H55A8DE96A32348E48768B100FD9BAB00"><enum>(e)</enum><header>Expansion of
			 funding priorities</header><text>Section 382C(b)(2) of such Act (7 U.S.C.
			 2009aa–2(b)(2)) is amended by adding at the end the following:</text>
				<quoted-block id="H103B081A07464F87909600E9146F5B06">
					<subparagraph id="HDB0194555F44432BB93E79CC00F5217C"><enum>(E)</enum><text>Educational
				improvement including adult and remedial education.</text>
					</subparagraph><subparagraph id="HDCDB2D53CD4D4FFFAEB2C217746FA060"><enum>(F)</enum><text>Access to
				affordable, quality rural health care.</text>
					</subparagraph><subparagraph id="H92A0A56E0A964D35A4DB4F278D032141"><enum>(G)</enum><text>The elimination of
				sub-standard housing
				facilities.</text>
