2.The purposes of this Act are—
(1)to integrate and
organize the administration of the extramural agricultural research, extension,
education, and related programs administered by the Secretary of Agriculture to
respond to 21st century challenges and continue to meet the needs of society
from a local, tribal, State, national, and international perspective;
(2)to minimize
duplication, and maximize coordination and integration, among the programs at
all levels through a solution-based approach;
(3)to
enhance the capacity of all participating institutions to more effectively
carry out the programs, with special emphasis given to 1890 Institutions, 1994
Institutions, Insular Area Institutions, ASCARR Institutions, and Small 1862
Land-Grant Institutions;
(4)to provide for a
more balanced portfolio of available resources and funding between capacity
programs and competitive programs through the enhanced growth of competitive
funds;
(5)to position the
agricultural research, extension, education, and related programs system to
increase the contribution of the system to society through the expansion of the
portfolio of the system; and
(6)to provide funding
to achieve the purposes of this Act and other purposes by enhancing by 100
percent the authorized funding for extramural agricultural research, extension,
education, and related programs over 5 fiscal years.
3.In this Act:
(1)The term 1862 Institution means a
college or university eligible to receive funds under the Act of July 2, 1862
(7 U.S.C. 301 et seq.).
(2)The term 1890 Institution means a
college or university eligible to receive funds under the Act of August 30,
1890 (7 U.S.C. 321 et seq.), including Tuskegee University.
(3)The term 1994 Institution means one of
the 1994 Institutions (as defined in section 532 of the Equity in Educational
Land-Grant Status Act of 1994 (Public Law 103–382; 7 U.S.C. 301 note)).
(4)
(A)The term ASCARR Institution means a public
college or university offering a baccalaureate or higher degree in the study of
agriculture.
(B)The
term ASCARR Institution does not include an institution eligible
to receive funds under—
(i)the
Act of July 2, 1862 (commonly known as the First Morrill Act
) (7
U.S.C. 301 et seq.);
(ii)the
Act of August 30, 1890 (commonly known as the Second Morrill
Act
) (7 U.S.C. 321 et seq.); or
(iii)the Equity in
Educational Land-Grant Status Act of 1994 (Public Law 103–382; 7 U.S.C. 301
note).
(5)The term capacity program means each of the
following agricultural research, extension, education, and related programs for
which the Secretary has administrative or other authority as of the day before
the date of enactment of this Act:
(A)Each program
established under the Act of July 2, 1862 (commonly known as the First
Morrill Act
) (7 U.S.C. 301 et seq.).
(B)Each program
providing funding to any of the 1994 Institutions under sections 533, 534(a),
and 535 of the Equity in Educational Land-Grant Status Act of 1994 (Public Law
103–382; 7 U.S.C. 301 note) (commonly known as financial assistance,
technical assistance, and endowments to tribal colleges and Navajo Community
College
).
(C)The program
established under section 536 of the Equity in Educational Land-Grant Status
Act of 1994 (Public Law 103–382; 7 U.S.C. 301 note) providing research grants
for 1994 institutions.
(D)Each program
established under subsections (b), (c), and (d) of section 3 of the Smith-Lever
Act (7 U.S.C. 343).
(E)Each program
established under the Hatch Act of 1887 (7 U.S.C. 361a et seq.).
(F)Each grant program
established under section 2501 of the Food, Agriculture, Conservation, and
Trade Act of 1990 (7 U.S.C. 2279) providing outreach and assistance for
socially disadvantaged farmers and ranchers.
(G)Each program
established under section 1417(b)(4) of the National Agricultural Research,
Extension, and Teaching Policy Act of 1977 (7 U.S.C. 3152(b)(4)), including
grant programs under that section (commonly known as the 1890
Institution Teaching and Research Capacity Building Grants
Program
).
(H)The animal health
and disease research program established under subtitle E of the National
Agricultural Research, Extension, and Teaching Policy Act of 1977 (7 U.S.C.
3191 et seq.).
(I)Each extension
program available to 1890 Institutions established under sections 1444 and 1464
of the National Agricultural Research, Extension, and Teaching Policy Act of
1977 (7 U.S.C. 3221, 3312).
(J)The program
established under section 1445 of the National Agricultural Research,
Extension, and Teaching Policy Act of 1977 (7 U.S.C. 3222) (commonly known as
the Evans-Allen Program
).
(K)The program
providing grants to upgrade agricultural and food sciences facilities at 1890
Institutions established under section 1447 of the National Agricultural
Research, Extension, and Teaching Policy Act of 1977 (7 U.S.C. 3222b).
(L)The program
providing distance education grants for insular areas established under section
1490 of the National Agricultural Research, Extension, and Teaching Policy Act
of 1977 (7 U.S.C. 3362).
(M)The program
providing resident instruction grants for insular areas established under
section 1491 of the National Agricultural Research, Extension, and Teaching
Policy Act of 1977 (7 U.S.C. 3363).
(N)Each program
available to 1890 Institutions established under section 406 of the
Agricultural Research, Extension, and Education Reform Act of 1998 (7 U.S.C.
7626).
(O)The program
providing competitive extension grants to eligible 1994 Institutions under
section 1464 of National Agricultural Research, Extension, and Teaching Policy
Act of 1977 (7 U.S.C. 3312) and the Equity in Educational Land-Grant Status Act
of 1994 (Public Law 103–382; 7 U.S.C. 301 note) established under section 406
of the Agricultural Research, Extension, and Education Reform Act of 1998 (7
U.S.C. 7626).
(P)Each research and
development and related program established under Public Law 87–788 (commonly
known as the McIntire-Stennis Cooperative Forestry Act
) (16
U.S.C. 582a et seq.).
(Q)Each program
established under the Renewable Resources Extension Act of 1978 (16 U.S.C. 1671
et seq.).
(R)Each grant program
for ASCARR Institutions established under section 202.
(6)Capacity program
critical base fundingThe term capacity program critical
base funding means the aggregate amount of Federal funds made available
for all or individual capacity programs for fiscal year 2007, as
appropriate.
(7)The term competitive program means each of
the following agricultural research, extension, education, and related programs
for which the Secretary has administrative or other authority as of the day
before the date of enactment of this Act:
(A)The competitive
grant program established under section 2 of the Competitive, Special, and
Facilities Research Grant Act (7 U.S.C. 450i), commonly known as the
National Research Initiative Competitive Grants Program
.
(B)The program
providing grants and related assistance established under section 1417(b)(5) of
the National Agricultural Research, Extension, and Teaching Policy Act of 1977
(7 U.S.C. 3152(b)(5)) commonly known as the Higher Education
Multicultural Scholars Program
.
(C)The Food and
Agricultural Sciences grant program established under section 1417 of the
National Agricultural Research, Extension, and Teaching Policy Act of 1977 (7
U.S.C. 3152), commonly known as the Food and Agricultural Sciences
National Needs Graduate Fellowship Grants Program
.
(D)The program
providing grants under section 1417(j) of the National Agricultural Research,
Extension, and Teaching Policy Act of 1977 (7 U.S.C. 3152(j)), commonly known
as Institution Challenge Grants
.
(E)The program
providing grants for Hispanic-serving institutions established under section
1455 of the National Agricultural Research, Extension, and Teaching Policy Act
of 1977 (7 U.S.C. 3241).
(F)The Initiative for
Future Agriculture and Food Systems established under section 401 of the
Agricultural Research, Extension, and Education Reform Act of 1998 (7 U.S.C.
7621) or any substantially similar program or authority.
(G)The integrated
research, education, and extension competitive grants program established under
section 406 of the Agricultural Research, Extension, and Education Reform Act
of 1998 (7 U.S.C. 7626).
(8)Competitive
program critical base fundingThe term competitive program
critical base funding means the aggregate amount of Federal funds made
available for all or individual competitive programs for fiscal year 2007, as
appropriate.
(9)The term Council means The
National Agriculture, Research, Extension, Education, and Economics Advisory
Board.
(10)The
term Department means the Department of Agriculture.
(11)The
term Director means the Director of the National Institutes for
Food and Agriculture.
(12)The term extramural activity includes each
program and related activity administered or otherwise carried out by the
entities or under an authority described in paragraph (5).
(13)The term fundamental research means
research that, as determined by the Director—
(A)advances the
frontiers of knowledge so as to lead to practical results or to further
scientific discovery; and
(B)has an effect
on—
(i)agriculture, food,
forestry, human health, or another purpose of this Act;
(ii)a
priority area of the National Institutes for Food and Agriculture; or
(iii)another goal or
purpose of a National Institutes for Food and Agriculture program.
(14)The term Insular Area Institution has
the meaning given the term eligible institution in section 1489 of
the National Agricultural Research, Extension, and Teaching Policy Act of 1977
(7 U.S.C. 3361).
(15)National
Institutes for Food and AgricultureThe term National
Institutes for Food and Agriculture means the National Institutes for
Food and Agriculture established under section 101.
(16)National
Institutes for Food and Agriculture programThe term
National Institutes for Food and Agriculture program includes each
capacity program, competitive program, and any other program, authority, power,
or activity of the National Institutes for Food and Agriculture, including
those described in section 101.
(17)The
term Secretary means the Secretary of Agriculture.
(18)Small 1862
Land-Grant InstitutionsThe term Small 1862 Land-Grant
Institution means each 1862 institution that received, for the 3 fiscal
years immediately preceding the applicable fiscal year (based on a 3-year
rolling average), less than 1 percent of—
(A)in the case of a
fiscal year beginning before the date of the enactment of this Act and the
implementation of the National Institutes for Food and Agriculture programs (as
determined by the Director), the funds received by each such institution from
among available programs of the Cooperative State Research, Education, and
Extension Service; and
(B)in the case of a
fiscal year beginning after the date of the enactment of this Act and the
implementation of the National Institutes for Food and Agriculture programs (as
determined by the Director), the funds received by each such institution from
among available National Institutes for Food and Agriculture programs, other
than funds reserved or distributed under paragraph (2)(B)(ii)(I),
(2)(C)(ii)(I), or (3)(A)(ii) of section 105(c).
(19)The
term State means—
(A)each of the
several States of the United States;
(B)the Commonwealth
of Puerto Rico;
(C)Guam;
(D)American
Samoa;
(E)the Commonwealth
of the Northern Mariana Islands;
(F)the Federated
States of Micronesia;
(G)the Republic of
the Marshall Islands; and
(H)the United States
Virgin Islands.
(20)The term United States, when used in a
geographical sense, means all of the States.
<enum>I</enum><header>National
Institutes for Food and Agriculture</header>
<section id="HA215D2FC15AB4BF9002E6D4CB84B3154"><enum>101.</enum><header>Establishment
of National Institutes for Food and Agriculture</header>
<subsection id="H9D9332DDD5F34F548482EF76A6A7258"><enum>(a)</enum><header>Establishment</header>
<paragraph id="H83702991CF3E4D4EBF6113F48FD8F7A2"><enum>(1)</enum><header>In
general</header><text>There is established within the Department an agency to
be known as the <quote>National Institutes for Food and
Agriculture</quote>.</text>
</paragraph><paragraph id="H9305CFA13230477200CBEC5820C8C94F"><enum>(2)</enum><header>Members</header><text>The
National Institutes for Food and Agriculture shall consist of—</text>
<subparagraph id="H2A54E6DDE8AB464A8BFDBB003BAA0063"><enum>(A)</enum><text>the
Director;</text>
</subparagraph><subparagraph id="H3A3D369545464D1AB64EA79FAB8F08BA"><enum>(B)</enum><text>the
Council;</text>
</subparagraph><subparagraph id="H46C1D3B781CD44F9AF8870406EAD48C8"><enum>(C)</enum><text>the individual
institutes established under section 103; and</text>
</subparagraph><subparagraph id="H902A17F7F0EA4514B368E28FBE6F87B0"><enum>(D)</enum><text>the staff and
employees of National Institutes for Food and Agriculture.</text>
</subparagraph></paragraph></subsection><subsection id="H175EA5453269453386A5A6D718917E38"><enum>(b)</enum><header>Authorities</header>
<paragraph id="H8571274C0AC643BF97BFD9730325F13"><enum>(1)</enum><header>Transfer of
authorities</header><text>There are transferred to National Institutes for Food
and Agriculture the authorities (including all budget authorities and
personnel), duties, obligations, and related legal and administrative functions
prescribed by law or otherwise granted to the Secretary, the Department, or any
other agency or official of the Department under—</text>
<subparagraph id="H31FB0BE61AC24F9CA7D3281E291F1264"><enum>(A)</enum><text>the capacity
programs;</text>
</subparagraph><subparagraph id="H252B07BDF84945A48E2CCC5F8D164756"><enum>(B)</enum><text>the competitive
programs;</text>
</subparagraph><subparagraph id="H8887C891E7674EFA9439AD0300F3AC24"><enum>(C)</enum><text>the research,
education, economic, cooperative State research programs, cooperative extension
and education programs, international programs, and other functions and
authorities delegated by the Secretary to—</text>
<clause id="H85359E3DDFC4429F8351CFD6B2983F8"><enum>(i)</enum><text>the
Under Secretary of Agriculture for Research, Education, and Economics
(including under section 251 of the Federal Crop Insurance Reform and
Department of Agriculture Reorganization Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/6971">7 U.S.C. 6971</external-xref>));
and</text>
</clause><clause id="H5FADC8F56D214CDA907EE75041005F18"><enum>(ii)</enum><text>the
Administrator of the Cooperative State Research, Education, and extension
Service pursuant to <external-xref legal-doc="regulation" parsable-cite="cfr/7/2.66">section 2.66</external-xref> of title 7, Code of Federal Regulations (or
successor regulations); and</text>
</clause></subparagraph><subparagraph id="HFAFA9C9BF12B4F7E97A146F09F3E01DD"><enum>(D)</enum><text>any and all other
authorities administered by—</text>
<clause id="H47F5245D6C05415F9CE061D700CD0024"><enum>(i)</enum><text>the
Under Secretary of Agriculture for Research, Education, and Economics;
and</text>
</clause><clause id="HA7113AD696074C1EAB097ECADC5EAF58"><enum>(ii)</enum><text>the
Administrator of the Cooperative State Research, Education, and Extension
Service.</text>
</clause></subparagraph></paragraph><paragraph id="HC48C801700DE46CC8CA53EF89CBF5F65"><enum>(2)</enum><header>Consolidation of
authorities</header><text>To carry out this Act, in accordance with the
transfer and continuation of the authorities, budgetary functions, and
personnel resources under this subsection, the administrative entity within the
Department known as the Cooperative State Research, Education, and Extension
Services, shall terminate on the earlier of—</text>
<subparagraph id="H3F1D7ABA03A746E7860039E14780A5B6"><enum>(A)</enum><text>October 1, 2008;
or</text>
</subparagraph><subparagraph id="H65E7FD15575B4E87834EE350F31FEB9"><enum>(B)</enum><text>such earlier date
as the Director determines to be appropriate.</text>
</subparagraph></paragraph><paragraph id="HEBEA0D7E2E1141B4AC3BBBC4CB2B53C"><enum>(3)</enum><header>Reservation</header><text>Notwithstanding
any other provision of this Act, any and all administrative authority over the
functions and activities of the National Agricultural Statistics Service,
consistent with those authorities, functions, and activities as in effect on
the day before the date of enactment of this Act, shall remain under the
authority of the Secretary.</text>
</paragraph></subsection><subsection id="HD33DD4F49C2C40D1815963E082C76DB4"><enum>(c)</enum><header>Powers</header><text>The
Director may—</text>
<paragraph id="HB67B8AD96D3F49A68F47005753B7578"><enum>(1)</enum><text>promulgate such
regulations as the Director determines to be necessary to govern the
operations, organization, and personnel of the National Institutes for Food and
Agriculture;</text>
</paragraph><paragraph id="H2C227AB0F43B4C1E95F000EFAA21DB1E"><enum>(2)</enum><text>make such
expenditures as are necessary to carry out this Act;</text>
</paragraph><paragraph id="H316C883D687A4734931F889CBE523CEE"><enum>(3)</enum><text>enter into
contracts or other arrangements, or modifications of contracts or other
arrangements—</text>
<subparagraph id="H3FE573FB57C748B8981E2EFE9F47BCB9"><enum>(A)</enum><text>to provide for the
carrying out, by organizations or individuals in the United States (including
agencies of the Department and other Government agencies) of such National
Institutes for Food and Agriculture programs as the Director determines to be
necessary to carry out this Act; and</text>
</subparagraph><subparagraph id="H70EB1B10619F4876AA740063F0B04929"><enum>(B)</enum><text>at the request of
the President or the Secretary, for the carrying out of such specific National
Institutes for Food and Agriculture program-related activities as are in the
national interest or are otherwise of critical importance, as determined by the
President or the Secretary, with the concurrence of the Director;</text>
</subparagraph></paragraph><paragraph id="HD2775D9F29CF45F1B695AD7E75D5C85"><enum>(4)</enum><text>make advance,
progress, and other payments relating to National Institutes for Food and
Agriculture programs without regard to the subsections (a) and (b) of section
3324 of title 31, United States Code;</text>
</paragraph><paragraph id="H3CD6BCFA068A427398F38300A000C45"><enum>(5)</enum><text>acquire by
purchase, lease, loan, gift, or condemnation, and hold and dispose of by grant,
sale, lease, or loan, real and personal property of all kinds necessary for, or
resulting from, the exercise of authority under this Act;</text>
</paragraph><paragraph id="H068547E510324C96ACE256D273B3CCB0"><enum>(6)</enum><text>receive and use
donated funds, if the funds are donated without restriction other than that the
funds be used in furtherance of National Institutes for Food and Agriculture
programs or one or more of the purposes of this Act;</text>
</paragraph><paragraph id="H79DE05A5C4C5400BB7FDEC27091B5D66"><enum>(7)</enum><text>publish or arrange
for the publication of information so as to further the full dissemination of
information of value consistent with the purposes of this Act and the national
interest, without regard to <external-xref legal-doc="usc" parsable-cite="usc/44/501">section 501</external-xref> of title 44, United States Code;</text>
</paragraph><paragraph id="H3F344F6BD4CC4E33BB44B03168D00E1"><enum>(8)</enum><text>accept and use the
services of voluntary and uncompensated personnel, and provide such
transportation and subsistence as are authorized by <external-xref legal-doc="usc" parsable-cite="usc/5/5703">section 5703</external-xref> of title 5,
United States Code, for persons serving without compensation;</text>
</paragraph><paragraph id="HB2A5BBF1C3D84FC7ACD3481635D21949"><enum>(9)</enum><text>prescribe, with
the approval of the Comptroller General of the United States, the extent to
which vouchers for funds expended under contracts for authorized activities
shall be subject to itemization or substantiation prior to payment, without
regard to the limitations of other laws relating to the expenditure and
accounting of public funds; and</text>
</paragraph><paragraph id="HBF1CFDA144E04726BEEDDE212193DF"><enum>(10)</enum><text>arrange with and
reimburse the Secretary and the heads of other Federal agencies for the
performance of any activity that the National Institutes for Food and
Agriculture is authorized to conduct.</text>
</paragraph></subsection><subsection id="HEB2BA21F88F847B1B506205D0000F765"><enum>(d)</enum><header>Consultation</header><text>The
Director shall consult with the Secretary on an ongoing basis to ensure that
the national interest is being served by the administration of the National
Institutes for Food and Agriculture, National Institutes for Food and
Agriculture programs, and other authorities provided under this Act.</text>
</subsection><subsection id="H053635DDEE06400AA7D4ED81DA7DCFFD"><enum>(e)</enum><header>Reporting</header><text>Not
later than December 31, 2007, and biennially thereafter, the Director shall
submit to the Secretary, the Committee on Agriculture of the House of
Representatives, the Committee on Agriculture, Nutrition, and Forestry of the
Senate, the Committee on Appropriations of the House of Representatives, and
the Committee on Appropriations of the Senate a comprehensive report that
describes the National Institutes for Food and Agriculture programs and related
activities funded, initially implemented, and otherwise carried out by the
National Institutes for Food and Agriculture during the period covered by the
report.</text>
</subsection></section><section id="H8C61A9600C4D450FAA53D3A22ED8CA39"><enum>102.</enum><header>Offices;
administration</header>
<subsection id="HC336B04A98A24444BC34394BE2297E8D"><enum>(a)</enum><header>Location</header><text>The
National Institutes for Food and Agriculture shall be located in Washington,
DC.</text>
</subsection><subsection id="H1F7B31C52AF74027AEE3E8EB24812879"><enum>(b)</enum><header>Director</header>
<paragraph id="HAFD3CD81EDB44073BA472875C3935049"><enum>(1)</enum><header>Appointment</header>
<subparagraph id="H3DF906F2783346B8BCA02DDBA95CC0BD"><enum>(A)</enum><header>In
general</header><text>The Director shall be—</text>
<clause id="H9F702408A7A34DC2B2F5B5C77FAAA929"><enum>(i)</enum><text>a
distinguished expert in one or more National Institutes for Food and
Agriculture programs (or issues addressed by or fields relating to those
programs); and</text>
</clause><clause id="HBF90A96AAC11434680C54AFEE082ED"><enum>(ii)</enum><text>appointed by the
President, by and with the advice and consent of the Senate.</text>
</clause></subparagraph><subparagraph id="H1D855876FD3645219F4072F21ECB09E"><enum>(B)</enum><header>Recommendations</header><text>Before
any person is appointed as Director, the President shall afford the Council an
opportunity to make recommendations to the President with respect to the
appointment.</text>
</subparagraph><subparagraph id="H81FD42A563644A8BBA017ED2D122A33F"><enum>(C)</enum><header>Rate of
pay</header><text>The Director shall receive basic pay at the rate provided for
level IV of the Executive Schedule under <external-xref legal-doc="usc" parsable-cite="usc/5/5513">section 5513</external-xref> of title 5, United States
Code.</text>
</subparagraph></paragraph><paragraph id="HFB9BDFFA06E843FDA8DE69E0EDB12F7B"><enum>(2)</enum><header>Term</header><text>The
Director shall serve for a single, 6-year term.</text>
</paragraph><paragraph id="H589B733EB3C84530BDC54D00AF4FD29D"><enum>(3)</enum><header>Authority</header><text>Except
as may be otherwise provided in this Act—</text>
<subparagraph id="H29563E59255F418497F20075285B3CA"><enum>(A)</enum><text>the Director
shall—</text>
<clause id="H6EF85F76003E46A19940F79555784FF1"><enum>(i)</enum><text>exercise all of
the authority granted to the National Institutes for Food and Agriculture by
this Act;</text>
</clause><clause id="H34D0B61C753C4FDDA04258FC87B4BAA4"><enum>(ii)</enum><text>in
consultation with the Council, formulate programs in accordance with policies
adopted by the National Institutes for Food and Agriculture;</text>
</clause><clause id="H451E1275520A421485AACF067F452BB"><enum>(iii)</enum><text>establish
committees and offices within the National Institutes for Food and Agriculture,
as appropriate;</text>
</clause><clause id="HF19C12A8A92B4956AF1FEAA43537B89E"><enum>(iv)</enum><text>establish
procedures for the provision and administration of capacity program funding and
competitive program grants by the National Institutes for Food and Agriculture
in accordance with this Act and other applicable law;</text>
</clause><clause id="H0CDB740DC4044B130000D899CDC136BA"><enum>(v)</enum><text>establish
procedures for the peer or merit review of National Institutes for Food and
Agriculture program activities in accordance with this Act and other applicable
law, as appropriate;</text>
</clause><clause id="HB958672B4DDA42D880434E85D0861F53"><enum>(vi)</enum><text>assess the
personnel needs of research, education, extension, and other fields in the
areas supported by National Institutes for Food and Agriculture programs;
and</text>
</clause><clause id="H83010A7FB1A346B5844786CD8D67BB3E"><enum>(vii)</enum><text>cooperate with
the Council to plan programs that assist in meeting the future personnel needs
of disciplines and activities in the areas supported by National Institutes for
Food and Agriculture programs, including portable fellowship and training
programs, as applicable; and</text>
</clause></subparagraph><subparagraph id="H454199F1C38E4A7400E3B600269FAF11"><enum>(B)</enum><text>all actions taken
by the Director pursuant to this Act shall be final and binding upon the
National Institutes for Food and Agriculture.</text>
</subparagraph></paragraph><paragraph id="HB15EADCB1A8D42E68688E463D03BC6EB"><enum>(4)</enum><header>Delegation and
redelegation of functions</header><text>The Director may, from time to time,
establish such procedures as the Director determines to be appropriate to
authorize the performance by any other officer, agency, or employee of the
National Institutes for Food and Agriculture of any of the functions of the
Director under this Act.</text>
</paragraph><paragraph id="H8B3780F910BE479C8258CCF1C5F406B7"><enum>(5)</enum><header>Formulation of
programs</header><text>The formulation of programs in accordance with the
policies of the National Institutes for Food and Agriculture shall be carried
out by the Director, in consultation with the Council.</text>
</paragraph><paragraph id="HCD9DFC518D2D4AE79F105C1816530204"><enum>(6)</enum><header>Authority to
grant and contract</header><text>The Director may make grants and enter into
contracts and other arrangements pursuant to this Act and other applicable
law.</text>
</paragraph><paragraph id="H01E753C3D2384F9A97FA258EA30925B9"><enum>(7)</enum><header>Status; power to
vote and hold office</header>
<subparagraph id="HEB49254C2C9F4D8C86FBAC83C46DAC6E"><enum>(A)</enum><header>In
general</header><text>The Director shall—</text>
<clause id="HDD1692E6DE9C4851B5FFCEE03FEAADFB"><enum>(i)</enum><text>serve as a voting
ex officio member of the Council; and</text>
</clause><clause id="H438A28797A864ED1AF3C9504E0E8DE44"><enum>(ii)</enum><text>except with
respect to compensation and tenure, serve in a manner commensurate with the
other members of the Council.</text>
</clause></subparagraph><subparagraph id="HE5F35E2E4D2D46CB9CBA15E31634FC47"><enum>(B)</enum><header>Election</header><text>The
Director shall be eligible for election by the Council as Chairperson or Vice
Chairperson of the Council.</text>
</subparagraph></paragraph></subsection><subsection id="HF556D6F04C8C4C868FDA08C7258877C2"><enum>(c)</enum><header>Staff
appointment</header><text display-inline="yes-display-inline">The Director
shall, in accordance with such policies as the Council may from time to time
establish, recruit, hire, prescribe, appoint, and fix the compensation of such
personnel as are necessary to carry out this Act, including the appointment,
for a limited term or on a temporary basis, of appropriate—</text>
<paragraph id="H69B0092697F44C0300E3ECDA43C56996"><enum>(1)</enum><text>scientific and
other expert and accomplished staff; and</text>
</paragraph><paragraph id="H6AD6F36819634EF7BFF4EF3587ABA66E"><enum>(2)</enum><text>other technical
and professional personnel on leave of absence from academic, industrial, or
research institutions.</text>
</paragraph></subsection><subsection id="H8F1B693110AA4F3B95ABB9539F8E6861"><enum>(d)</enum><header>Rotating
credentialed staff</header>
<paragraph id="HDAFEB39B174B4C19B081B2ED83AC00EA"><enum>(1)</enum><header>In
general</header><text>The Director shall be assisted by an
appropriately-credentialed staff of experts in—</text>
<subparagraph id="HEE3A529044EC402592FF7D76CA124D14"><enum>(A)</enum><text>National
Institutes for Food and Agriculture programs; and</text>
</subparagraph><subparagraph id="H94F5B5AFCBFF494CA7146538FA008789"><enum>(B)</enum><text>issues addressed
by, and fields relating to, those programs.</text>
</subparagraph></paragraph><paragraph id="H01BE21F41EAC4C76A16704EAACE521E"><enum>(2)</enum><header>Requirements</header><text>Credentialed
staff members described in paragraph (1) shall be—</text>
<subparagraph id="H6A38665BDAC74E8CBA73AC86E698E434"><enum>(A)</enum><text>recruited from the
community of National Institutes for Food and Agriculture programs or related
fields; and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H72F8D790DB244774BCF521DF485FD6D"><enum>(B)</enum><text>appointed by the
Director to serve on the basis of 4-year rotating appointments.</text>
</subparagraph></paragraph></subsection><subsection id="HCBEA6878535B45C080F339B47D68D74B"><enum>(e)</enum><header>Temporary
staff</header><text>Staff hired by the Director under this section may include
researchers, scientists, and other credentialed, technical, or professional
personnel hired for limited terms, or on temporary bases, including individuals
on leave of absence from academic, industry, research, science, or other
institutions.</text>
</subsection><subsection id="HCE15538045744AD8A683AE94F943EC1D"><enum>(f)</enum><header>Volunteers</header>
<paragraph id="HA295A1940A9A45ACBD003F3B3D3B6D00"><enum>(1)</enum><header>In
general</header><text>The Director may accept the services of voluntary,
uncompensated personnel, on appropriate terms and conditions and in accordance
with other applicable law.</text>
</paragraph><paragraph id="HAF232F9EDFA04F86ACB6A17FDF600F9"><enum>(2)</enum><header>Freedom from
liability</header><text>Voluntary personnel described in paragraph (1) shall be
held free from liability in accordance with the Volunteer Protection Act of
1997 (<external-xref legal-doc="usc" parsable-cite="usc/42/14501">42 U.S.C. 14501 et seq.</external-xref>).</text>
</paragraph></subsection><subsection id="H56C225173E9F453BBE01CBD218EDDAC3"><enum>(g)</enum><header>Transfer of
funds from other government departments or agencies</header>
<paragraph id="H5A057A17E5604E0EBF6C7078FDC11D8C"><enum>(1)</enum><header>In
general</header><text>Funds available to the Department, or any other
department or agency of the Federal Government for activities that are
analogous to, or could contribute to the purposes or goals of, National
Institutes for Food and Agriculture programs, other relevant research,
extension, or education programs, or related or other relevant activities,
shall be available for transfer, in whole or in part, to the National
Institutes for Food and Agriculture, with the approval of the Secretary or the
head of the other appropriate department or agency transferring the funds, for
such use as is consistent with the purposes for which the funds were initially
made available.</text>
</paragraph><paragraph id="H7854821A370D4E418DBA231EB217F2B0"><enum>(2)</enum><header>Use of
funds</header><text>Funds transferred under paragraph (1) shall be expendable
by the National Institutes for Food and Agriculture for the purposes for which
the transfer was made.</text>
</paragraph></subsection><subsection id="HF1FCBED67D454049B3D327E82EF75829"><enum>(h)</enum><header>The
council</header>
<paragraph id="HE71E0EA308CD4A84887633B284D66FA2"><enum>(1)</enum><header>Duties</header>
<subparagraph id="HBB855421BD0E4CDC83D31E5827A5B76B"><enum>(A)</enum><header>In
general</header><text>The Council shall assist the Director in—</text>
<clause id="HB0B107D3616845DA9DE4C8A4C6CA1516"><enum>(i)</enum><text>establishing
priorities of the National Institutes for Food and Agriculture; and</text>
</clause><clause id="HA6ABE48D59314C1080E23F0887C6D8D5"><enum>(ii)</enum><text>reviewing,
judging, and maintaining the relevance of National Institutes for Food and
Agriculture programs.</text>
</clause></subparagraph><subparagraph id="H5EEDF52B5FC747CD9E5472FFE600B7C8"><enum>(B)</enum><header>Oversight
review</header><text>To ensure that the purposes of this Act and the needs of
the United States are being met, the Council shall conduct an annual oversight
review of—</text>
<clause id="H8DC9A7FED98548A485EB1B424CDFD5DF"><enum>(i)</enum><text>the
administration of the National Institutes for Food and Agriculture;</text>
</clause><clause id="H540C93D5031E44E1A2376C1FB4BB01C5"><enum>(ii)</enum><text>activities funded
through the capacity programs;</text>
</clause><clause id="H2AB2F313877748E9973839C1899B42B1"><enum>(iii)</enum><text>proposals and
other activities funded through the competitive programs; and</text>
</clause><clause id="H77E415EDF02C47EFB66227003983BFB3"><enum>(iv)</enum><text>other activities
of the National Institutes for Food and Agriculture.</text>
</clause></subparagraph></paragraph><paragraph id="H24CAC307C9D74FCD96E000488C536C9F"><enum>(2)</enum><header>Meetings</header>
<subparagraph id="HFACB23F307C743B79549A6BD8B1CC9CF"><enum>(A)</enum><header>In
general</header><text>The Council shall hold periodic meetings to provide an
interface between the Council and stakeholders, and to ensure that the National
Institutes for Food and Agriculture is linking national goals with realistic
opportunities.</text>
</subparagraph><subparagraph id="H017B2BD9AB4B490B92064073AFB4F623"><enum>(B)</enum><header>Frequency</header><text>Meetings
described in subparagraph (A) shall be held at the call of the Director, or at
the joint call of the Director and the Secretary, but not less often than twice
annually.</text>
</subparagraph></paragraph><paragraph id="H45A813E80884483CB15F3993F24842C1"><enum>(3)</enum><header>Limitation</header><text>The
expenses of the Council paid by the Director under subparagraph (A) shall not
be counted toward any general limitation on the expenses of advisory
committees, panels, commissions, or task forces of the Department contained in
any Act making appropriations for the Department, whether enacted before, on,
or after the date of enactment of this Act, unless the Act of appropriation
specifically—</text>
<subparagraph id="HFB168BA9646F45D2BF5778007647BE41"><enum>(A)</enum><text>refers to this
paragraph; and</text>
</subparagraph><subparagraph id="H3F74A93FA129419886F0DC9097BA22E1"><enum>(B)</enum><text>includes the
Council within the general limitation.</text>
</subparagraph></paragraph></subsection></section><section id="H5CB98E959AAF490DB6608F46D9E41BDF"><enum>103.</enum><header>Organization of
National Institutes for Food and Agriculture</header>
<subsection id="HC4F5E768F865401985287F9E80D6CA7D"><enum>(a)</enum><header>Organization</header>
<paragraph id="H64663C63EA164A85B5E2C4EFACC2E511"><enum>(1)</enum><header>In
general</header><text>The Director shall organize the National Institutes for
Food and Agriculture into 6 institutes (referred to in this section as
<term>individual institutes</term>) to administer the programs and activities
of the National Institutes for Food and Agriculture in an integrated,
multidisciplinary, interdisciplinary, transdisciplinary, interagency, and
inter-institutional manner, to the maximum extent practicable.</text>
</paragraph><paragraph id="H2622A8FDD4E24659ADD28DD7D7A7E957"><enum>(2)</enum><header>Institutes</header><text>The
individual institutes shall be the following:</text>
<subparagraph id="H64E53B6245FB4284B2704E38726D6417"><enum>(A)</enum><text>The Institute for
Economic Opportunities in Agriculture and Natural Resources.</text>
</subparagraph><subparagraph id="H548D9D6B6E194CB2B0B250D7CAEB00A4"><enum>(B)</enum><text>The Institute for
Nutrition and Health.</text>
</subparagraph><subparagraph id="H6967760AC56E41729FCDCC4202E75171"><enum>(C)</enum><text>The Institute for
Rural and Urban Community Development.</text>
</subparagraph><subparagraph id="H4ACD7198372F45E3991958168C1C2589"><enum>(D)</enum><text>The Institute for
Natural Resources and Environment.</text>
</subparagraph><subparagraph id="H91AFDD3ECC134BBDBDC9C7C5DBD665B1"><enum>(E)</enum><text>The Institute for
Food Safety and Agricultural Security.</text>
</subparagraph><subparagraph id="H09D7FB719CED4E3FBF8900062582F240"><enum>(F)</enum><text>The Institute for
Families, Youth, and Communities.</text>
</subparagraph></paragraph><paragraph id="H96AFF003D706407EAF215EEE67FF5953"><enum>(3)</enum><header>Administration</header>
<subparagraph id="H7E1F3081098F46F4BB844CB59721415E"><enum>(A)</enum><header>In
general</header><text>The Director, in conjunction with the head of each
individual institute, shall carry out National Institutes for Food and
Agriculture programs with the goal of focusing those programs, and the
participants, grantees, and other stakeholders of those programs on—</text>
<clause id="HF0A3085599C5427881D94F214DF0E4D5"><enum>(i)</enum><text>understanding
important problem areas and opportunities relating to a program;</text>
</clause><clause id="HD3F334C34622482E9F6800D66418D029"><enum>(ii)</enum><text>discovering and
implementing solutions to address those problem areas; and</text>
</clause><clause id="H317393A763374EA3BF4B6556F928278"><enum>(iii)</enum><text>exploring other
opportunities provided under the programs.</text>
</clause></subparagraph><subparagraph id="H903B0BB3F95B4E5EA13E7CCCDAF4597D"><enum>(B)</enum><header>Stakeholder
input</header><text>The Director, in consultation with the Secretary, the
Council, and the head of each individual institute, shall solicit input from
appropriate participants, grantees, and other stakeholders of the programs and
activities of the National Institutes for Food and Agriculture relating to the
problem areas, opportunity areas, solution areas, and Institute programs and
related activities carried out by the National Institutes for Food and
Agriculture.</text>
</subparagraph></paragraph><paragraph id="H71B9007D730B476499856D5BD0BB508E"><enum>(4)</enum><header>Modification of
organization</header><text>Beginning on October 1 of the fifth full fiscal year
beginning after the date of enactment of this Act, the Director, in
consultation with the Secretary and the Council, may include in a report
required under section 101(e) any recommendation of the Director with respect
to the organization of the National Institutes for Food and Agriculture or the
individual institutes, as the Director determines to be in the best interest of
the United States.</text>
</paragraph></subsection><subsection id="HE024607164BE4BA6AD320921870543BC"><enum>(b)</enum><header>Program
integration and coordination</header>
<paragraph id="HDD0269F9A25E4D3AB7073D296DE25D76"><enum>(1)</enum><header>In
general</header><text>In accordance with applicable law (including
regulations), the Director, in coordination with the head of each individual
institute and taking into consideration the advice of the Council, shall
ensure, to the maximum extent practicable, that National Institutes for Food
and Agriculture programs are administered, funded, and carried out—</text>
<subparagraph id="H1CCADB92A98B4A93ADDD479FF176B611"><enum>(A)</enum><text>in an integrated,
multidisciplinary, interdisciplinary, transdisciplinary, interagency, and
inter-institutional manner that ensures—</text>
<clause id="HCD0430EDF9C24B7AB9510066E4AA5C21"><enum>(i)</enum><text>the
most efficient collaborative use of resources; and</text>
</clause><clause id="HCD8B97365D6F4B9185CAA4F39C77184"><enum>(ii)</enum><text>the
focus of all resources and activities on strategic, priority, problem,
opportunity, and solution areas identified by the Director and the head of each
applicable individual institute, taking into consideration the advice of the
Council;</text>
</clause></subparagraph><subparagraph id="H71A6F858D8FC49C7A182D5CE6970024"><enum>(B)</enum><text>among applicable
participants, grantees, and stakeholders, in a coordinated manner that
encourages and ensures—</text>
<clause id="H83503060C27849FFAD2F9DF654FEA308"><enum>(i)</enum><text>the
most efficient collaborative application of resources; and</text>
</clause><clause id="HAFCA239281B043E2B3D2DBE7374D2FD4"><enum>(ii)</enum><text>the
focus of all resources and activities on strategic, priority, problem,
opportunity, and solution areas on a local, State, Indian tribal, regional,
national, and international basis, as the Director and the head of each
applicable individual institute, taking into consideration the advice of the
Council, determine to be appropriate.</text>
</clause></subparagraph></paragraph><paragraph id="H0635413CA05F42D99D50732913A21295"><enum>(2)</enum><header>Scope</header><text>The
Director, in consultation with the Secretary and the Council, shall ensure,
through the integration and coordination under paragraph (1), that
opportunities are maximized with respect to—</text>
<subparagraph id="HCF2ED271BC94470BB5FDF93E030EAE5"><enum>(A)</enum><text>the use of
appropriate authorities, agencies, institutions, disciplines, and activities of
the National Institutes for Food and Agriculture; and</text>
</subparagraph><subparagraph id="H1A179D2E8B3340CA8E6BEAA3703600C2"><enum>(B)</enum><text>the inclusion of
appropriate participants and other stakeholders in those activities, including
extramural, government, university, extension, international, and other
appropriate stakeholders, as determined by the Director.</text>
</subparagraph></paragraph></subsection><subsection id="H42F71DBE8343419A909EB82FF100C5A4"><enum>(c)</enum><header>Matching and
leveraging of scarce budget resources</header><text>The National Institutes for
Food and Agriculture and the Director shall provide for the matching and
leveraging of National Institutes for Food and Agriculture resources by
extramural activity program participants and recipients—</text>
<paragraph id="H460DA00D8A2E4CE091EE8FC9B0806F46"><enum>(1)</enum><text>in accordance with
applicable law governing the applicable capacity program, competitive program,
or other authority or activity; or</text>
</paragraph><paragraph id="H8AC86F1C41D242449BE98C15C8AAFB85"><enum>(2)</enum><text>if not otherwise
provided for by law, as the Director, in consultation with the Council,
determines to be appropriate, taking into consideration—</text>
<subparagraph id="H33FFE55B108941AEA3EA70B3F24BE64"><enum>(A)</enum><text>the ability of the
participating or recipient institutions or entities to provide matching funds;
and</text>
</subparagraph><subparagraph id="H1F27A9972E8E4D64B33EF28BA5BC314F"><enum>(B)</enum><text>the treatment of
the institutions or entities with respect to matching fund and similar
requirements under other authorities.</text>
</subparagraph></paragraph></subsection><subsection id="HD35C7F510D9B4E4B8738617C8238E6D6"><enum>(d)</enum><header>Funding
administration</header>
<paragraph id="H0A82722857604BD8938B8BE0DC487B35"><enum>(1)</enum><header>Capacity
programs</header><text>In accordance with other applicable law, in providing
program funding to a particular institution or entity, the Director shall
develop, in consultation with the Council, and implement, a streamlined plan of
work or administrative model designed to simplify, to the maximum extent
practicable, the administration, funding, and oversight of capacity
programs.</text>
</paragraph><paragraph id="HBB5D1F815DB546C3A036B78800C306A4"><enum>(2)</enum><header>Competitive
programs</header><text>In accordance with other applicable law, in making
determinations regarding whether to provide program funding to a particular
institution, entity, or applicant (as applicable), the Director shall, whenever
practicable, implement an administrative model designed to streamline and
simplify, to the maximum extent practicable, the application (as applicable),
administration, funding, and oversight process.</text>
</paragraph></subsection></section><section id="H81788431502B45D5BD22E000CAF8053C"><enum>104.</enum><header>Funding</header>
<subsection id="HFAB43A6FC2DF4214A1C513FC16D79089"><enum>(a)</enum><header>Preservation of
critical base funding</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
funds provided to National Institutes for Food and Agriculture programs shall
be allocated and distributed in accordance with subsection (b).</text>
</subsection><subsection id="HB36CF4DB591244A9B66CB57B1BE382A3"><enum>(b)</enum><header>Distribution of
funds</header>
<paragraph id="H70E124ABDD394F3986F800157B63CA99"><enum>(1)</enum><header>Priority for
critical base funds</header><text>In distributing funds to carry out capacity
programs and competitive programs during a fiscal year, the Director
shall—</text>
<subparagraph id="HF1DDB86BACD346FE8D9722CBFD767DC6"><enum>(A)</enum><text>first, use funds
made available in an amount less than or equal to the capacity program critical
base funding level only to carry out capacity programs, in accordance with
paragraph (2); and</text>
</subparagraph><subparagraph id="HD1DFE8FD19E748B6A617A9DCE581987F"><enum>(B)</enum><text>after funds equal
to the capacity program critical base funding level have been allocated for
capacity programs for the fiscal year, use any funds made available only to
carry out competitive programs, until funds are allocated in an amount equal to
the competitive program critical base funding level.</text>
</subparagraph></paragraph><paragraph id="H8B2120D31A4441E9A9EDCC00EB817768"><enum>(2)</enum><header>Proportional
funding of capacity programs</header><text>The Director shall apportion funds
distributed under paragraph (1)(A) in accordance with the proportion
that—</text>
<subparagraph id="H978971CF61DD48A600CD5464C6AEB59D"><enum>(A)</enum><text>the amount
received by each applicable capacity program for fiscal year 2007; bears
to</text>
</subparagraph><subparagraph id="H4FD4367B4EC2466986ED903FDC8313B7"><enum>(B)</enum><text>the total amount
made available for all capacity programs for fiscal year 2007.</text>
</subparagraph></paragraph><paragraph id="H8EB5450E75EE4112817864522D7B9200"><enum>(3)</enum><header>Other than
critical base funds</header><text>In distributing funds to carry out capacity
programs and competitive programs during a fiscal year, the Director shall use
in accordance with section 105(c)—</text>
<subparagraph id="HB2900A5084F64663BCDBF3A8E38B961F"><enum>(A)</enum><text>amounts made
available in excess of the sum of the capacity program critical base funding
level and the competitive program critical base funding level; and</text>
</subparagraph><subparagraph id="H177911944D5F4E5A8E9D7BD3D0279DEB"><enum>(B)</enum><text>amounts made
available pursuant to section 105(a).</text>
</subparagraph></paragraph></subsection></section><section id="H0D24EC921278416CB111DA8DF4FE01B7"><enum>105.</enum><header>Enhanced
funding</header>
<subsection id="H695D5C19E383409C82D908D735FFFC9"><enum>(a)</enum><header>Continuation of
mandatory funding</header>
<paragraph id="HE255F023FBD648C983D47C7166D43206"><enum>(1)</enum><header>In
general</header><text>Beginning on October 1, 2007, and each October 1
thereafter, the Secretary shall transfer to the Director $200,000,000 of funds
of the Commodity Credit Corporation to carry out this Act.</text>
</paragraph><paragraph id="H0BF6A32EDB8E4965B60061B0D6E72BE3"><enum>(2)</enum><header>Budgetary
offset</header><text>Section 401(b)(3) of the Agricultural Research, Extension,
and Education Reform Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/7/7621">7 U.S.C. 7621(b)(3)</external-xref>) is amended—</text>
<subparagraph id="H3A25C509D5714F9B88B80890B26ED769"><enum>(A)</enum><text>in subparagraph
(B), by adding <quote>and</quote> at the end;</text>
</subparagraph><subparagraph id="H979E92C5F608469B004BA9C1F564BD25"><enum>(B)</enum><text>in subparagraph
(C), by striking <quote>; and</quote> at the end and inserting a period;
and</text>
</subparagraph><subparagraph id="H82B0B225A225416A98BC4CB2AA003CD9"><enum>(C)</enum><text>by striking
subparagraph (D).</text>
</subparagraph></paragraph></subsection><subsection id="HAA841A6E90CA4AEBA36F35A485D23254"><enum>(b)</enum><header>Increasing
currently authorized funding</header><text>Notwithstanding any other provision
of law, except as otherwise provided in this section, there are authorized to
be appropriated to the Director to carry out programs of the National
Institutes for Food and Agriculture under this Act amounts equal to a level of
the authorized funding for each such program as in effect on the day before the
date of enactment of this Act, to be phased in as follows:</text>
<paragraph id="H890B1BBF92634AD69C86CBAB70739427"><enum>(1)</enum><text>For fiscal year
2008, 120 percent of the level.</text>
</paragraph><paragraph id="HDEB051ACA01F41DB9C3679CADFAE3F1"><enum>(2)</enum><text>For fiscal year
2009, 140 percent of the level.</text>
</paragraph><paragraph id="H0E19F557756F471B9B464C06F71C30C8"><enum>(3)</enum><text>For fiscal year
2010, 160 percent of the level.</text>
</paragraph><paragraph id="HA08BB7E334A741D389F184A949135970"><enum>(4)</enum><text>For fiscal year
2011, 180 percent of the level.</text>
</paragraph><paragraph id="H1BD811BF64534AFFA0CA81EE90507000"><enum>(5)</enum><text>For fiscal year
2012 and thereafter, 200 percent of the level.</text>
</paragraph></subsection><subsection id="H0BD6EA3D84AF46FB8F5719248FF2A718"><enum>(c)</enum><header>Distribution of
enhanced funding</header>
<paragraph id="H0D6F3C2FB3D64DED849FD9616FE921C1"><enum>(1)</enum><header>In
general</header><text>Any funds made available for a fiscal year for the
National Institutes for Food and Agriculture shall be distributed in accordance
with this subsection, if the funds are provided—</text>
<subparagraph id="HD4FFF43C09204448AA6748FBB9E91930"><enum>(A)</enum><text>under subsection
(a)(1); or</text>
</subparagraph><subparagraph id="H61AE2EE8A1374EA095058200DEAC67FC"><enum>(B)</enum><text>under any other
authority under this or any other Act in excess of an amount equal to the sum
of the capacity program critical base funding level and the competitive program
critical base funding level.</text>
</subparagraph></paragraph><paragraph id="H3535902716A242579EBC0000249568C8"><enum>(2)</enum><header>Enhanced
competitive program funding</header>
<subparagraph id="HAA697400B1BE4E1BA6C8061370D3EDA5"><enum>(A)</enum><header>In
general</header><text>The Director shall use 70 percent of amounts described in
paragraph (1) to carry out competitive programs, of which—</text>
<clause id="HF649AF937DA4476497A7A20083903C25"><enum>(i)</enum><text>55
percent shall be used to carry out fundamental research activities in
accordance with subparagraph (B); and</text>
</clause><clause id="HC122A7AF0EDE430C94631CBFB52E439"><enum>(ii)</enum><text>45
percent shall be used to carry out competitive research activities other than
fundamental research activities in accordance with subparagraph (C),
including—</text>
<subclause id="H0C44F0BC65104CA98C9737E346F142B4"><enum>(I)</enum><text>integrated
programs and related activities;</text>
</subclause><subclause id="H4697C167A8EC429AA6A411F5FBBD9C7"><enum>(II)</enum><text>applied research
and related activities;</text>
</subclause><subclause id="H63BC348A88F74DB4B956205754FBD2B5"><enum>(III)</enum><text>translational
research and related activities;</text>
</subclause><subclause id="H48E96CAAF4DE41B6A9C7CAB8DA09063F"><enum>(IV)</enum><text>activities
substantially similar to activities carried out pursuant to the Initiative for
Future Agriculture and Food Systems under section 401 of the Agricultural
Research, Extension, and Education Reform Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/7/7621">7 U.S.C. 7621</external-xref>), as in
effect on the day before the date of enactment of this Act; and</text>
</subclause><subclause id="H9A45118618D54ACDA4A5A2BF2C5CF98E"><enum>(V)</enum><text>education and
extension programs and activities (including grants for outreach, research, or
education).</text>
</subclause></clause></subparagraph><subparagraph id="H5B36B7137F2E42CB86E4CC2873889679"><enum>(B)</enum><header>Fundamental
research activities</header>
<clause id="HF1E3DC1CFE484CB9B8686295F1CD00A2"><enum>(i)</enum><header>Open fundamental
research pool</header><text>The Director shall allocate not less than 80
percent of amounts described in subparagraph (A)(i) to eligible applicants on a
competitive basis, including applicants representing—</text>
<subclause id="H85132D8E86CC4A98B566BB8D73975860"><enum>(I)</enum><text>colleges,
universities, and other institutions of higher education; and</text>
</subclause><subclause id="HD8EC275B044A416E98C4BC58B4B380BA"><enum>(II)</enum><text>other individuals
and entities eligible to receive funding under the National Research
Initiative.</text>
</subclause></clause><clause id="HCA570F91FF4E4EAF9BE2424935ED296B"><enum>(ii)</enum><header>Reservation and
reversion</header>
<subclause id="HBC9DEB65FC33408697E8E84580C94380"><enum>(I)</enum><header>In
general</header><text>The Director shall reserve 20 percent of amounts
described in subparagraph (A)(i) for allocation to 1890 Institutions, 1994
Institutions, Insular Area Institutions, and Small 1862 Land-Grant Institutions
on a competitive basis, subject to—</text>
<item id="H7D1C1C1D9AAE431DBD766BF25B43F521"><enum>(aa)</enum><text>applicable peer
and merit review requirements of Federal law (including regulations);
and</text>
</item><item id="H66F97E573ACF44D7813581ACD7A5BD1"><enum>(bb)</enum><text>such
other peer and merit review requirements as the Director determines to be
appropriate.</text>
</item></subclause><subclause id="H1833B6022ACC4FB8B1F100CEF2495297"><enum>(II)</enum><header>Reversion of
unused reserved funds</header><text>Any amounts reserved under subclause (I)
that are not allocated to institutions under that subclause by the end of the
2-year period following October 1 of the fiscal year for which the amounts are
first made available shall be allocated to open fundamental research pool
applicants on a competitive basis in accordance with clause (i).</text>
</subclause></clause></subparagraph><subparagraph id="H5538D98F13234E9998631739BB571CC"><enum>(C)</enum><header>Other research
activities</header>
<clause id="H99475CA10DF44998A354855DCE571C39"><enum>(i)</enum><header>Open integrated
research pool</header><text>The Director shall allocate not less than 80
percent of amounts described in subparagraph (A)(ii) to eligible applicants on
a competitive basis, including applicants representing—</text>
<subclause id="HBB404460E11946C9A558D40074823E49"><enum>(I)</enum><text>colleges,
universities, and other institutions of higher education; and</text>
</subclause><subclause id="HB336143FE4414DD700A758704D7BAECE"><enum>(II)</enum><text>other individuals
and entities eligible to receive funding under the National Research
Initiative.</text>
</subclause></clause><clause id="H8A2AFFDA42714F5C8CF12F38FEE87D30"><enum>(ii)</enum><header>Reservation and
reversion</header>
<subclause id="HC9FD560A385F4881AF9C82CBD91E35DD"><enum>(I)</enum><header>In
general</header><text>The Director shall reserve 20 percent of amounts
described in subparagraph (A)(ii) for allocation to 1890 Institutions, 1994
Institutions, Insular Area Institutions, and Small 1862 Land-Grant Institutions
on a competitive basis, subject to—</text>
<item id="HF1B3F9657043400AB78B524C7684DE68"><enum>(aa)</enum><text>applicable peer
and merit review requirements of Federal law (including regulations);
and</text>
</item><item id="HA9BD6522C00B4A03815664F99EBEC7C1"><enum>(bb)</enum><text>such
other peer and merit review requirements as the Director determines to be
appropriate.</text>
</item></subclause><subclause id="H880FC1EEB0664C388B8D382FC4B100F2"><enum>(II)</enum><header>Reversion of
unused reserved funds</header><text>Any amounts reserved under subclause (I)
that are not allocated to institutions under that subclause by the end of the
2-year period following October 1 of the fiscal year for which the amounts are
first made available shall be allocated to open integrated research pool
applicants on a competitive basis in accordance with clause (i).</text>
</subclause></clause></subparagraph><subparagraph id="HFB7885D9D42F45A5A845BF85ECE7712"><enum>(D)</enum><header>Education and
extension integration</header><text>The Director shall integrate into
competitive programs of the National Institutes for Food and Agriculture
national and global educational and extension initiatives, to the maximum
extent practicable.</text>
</subparagraph><subparagraph id="HDC2D3B67F3324F9691BE18B93648B86D"><enum>(E)</enum><header>Indirect
costs</header>
<clause id="H4DC2CE40282348C8BDD0931462E16FA"><enum>(i)</enum><header>In
general</header><text>Except as provided in clause (ii), the Director shall
provide for the payment of allowable indirect costs associated with competitive
programs of the National Institutes for Food and Agriculture in accordance with
section 1462 of the National Agricultural Research, Extension, and Teaching
Policy Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/7/3310">7 U.S.C. 3310</external-xref>).</text>
</clause><clause id="HB3A1A01C5EA44CB7AD6DC367D05C4D97"><enum>(ii)</enum><header>Exception</header><text>For
each of fiscal years 2008 through 2012, the Director shall ensure that
allowable indirect costs, associated with competitive programs of the National
Institutes for Food and Agriculture that are funded under section 104(b)(1)(B),
shall not be paid at a rate that exceeds the levels generally provided for
those competitive programs for fiscal year 2007.</text>
</clause></subparagraph></paragraph><paragraph id="H1AB714E078EF46B8AE50B39E1675B281"><enum>(3)</enum><header>Enhanced
capacity program funding</header><text>The Director shall use 30 percent of
amounts described in paragraph (1) to carry out capacity programs, of
which—</text>
<subparagraph id="H6402FF4017D54C46AA0098BB15B52C00"><enum>(A)</enum><text>for each of fiscal
years 2008 through 2012—</text>
<clause id="H776C743D6FCE4F718ECFD86D1514DDFD"><enum>(i)</enum><text>77.5
percent shall be allocated to capacity programs in accordance with the
proportion that—</text>
<subclause id="HE517D6B8F67546BEBEE08484001C5E52"><enum>(I)</enum><text>the amount
received by the applicable capacity program during fiscal year 2007; bears
to</text>
</subclause><subclause id="H01F0029CEAEE4F79A38D00677C882C87"><enum>(II)</enum><text>the total amount
made available for all capacity programs for fiscal year 2007; and</text>
</subclause></clause><clause id="H908BF8ABCB084F20919B3000FE8E5446"><enum>(ii)</enum><text>17.5 percent
shall be allocated to 1890 Institutions, 1994 Institutions, Insular Area
Institutions, Small 1862 Land-Grant Institutions, and ASCARR Institutions for
institutional enhancement capacity programs, of which—</text>
<subclause id="HEB46B5E51072407FA7E0E55504B7A7F3"><enum>(I)</enum><text>36 percent shall
be for 1890 Institutions;</text>
</subclause><subclause id="HBEF8A2BEF7B6413B82C203AA501936D5"><enum>(II)</enum><text>26 percent shall
be for 1994 Institutions, except that an amount from that 26 percent shall be
allocated to Insular Area Institutions in accordance with the proportion
that—</text>
<item id="H5B29A0B687B4460A89B4C963E432C17D"><enum>(aa)</enum><text>the
amount received by the applicable Institution during fiscal year 2007; bears
to</text>
</item><item id="H56F4C44C9B524092B218894D2DFDF76B"><enum>(bb)</enum><text>the
total amount made available for all 1890 Institutions, 1994 Institutions,
Insular Area Institutions, Small 1862 Land-Grant Institutions, and ASCARR
Institutions for fiscal year 2007;</text>
</item></subclause><subclause id="H1AB72BD9791B48A087C5AF43E32E318F"><enum>(III)</enum><text>26 percent shall
be for Small 1862 Land-Grant Institutions; and</text>
</subclause><subclause id="H5E3140E2B57C4442A0A7852BD1ACE4C6"><enum>(IV)</enum><text>12 percent shall
be for ASCARR Institutions; and</text>
</subclause></clause></subparagraph><subparagraph id="HB5193DF282F141AEAB152D10468ED9A6"><enum>(B)</enum><text>5 percent shall be
deposited into the enhancement fund of the National Institutes for Food and
Agriculture to fund capacity investments that are consistent with capacity
programs of the National Institutes for Food and Agriculture, as determined by
the Director, in consultation with the Secretary and the Council.</text>
</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="HCF044BACB0CC42ADB7457759A05FC8FC" section-type="subsequent-section"><enum>106.</enum><header>Single budget
submission</header><text display-inline="no-display-inline">The President shall
submit to Congress, together with the annual budget submission of the
President, a single combined budget line item reflecting the total amount
requested by the President for funding for the National Institutes for Food and
Agriculture, including funding for capacity programs, competitive programs, and
other applicable National Institutes for Food and Agriculture programs.</text>
</section><section id="H3AD05B0E35DC47999EA629ED651DEA"><enum>107.</enum><header>Capacity building
grants for ASCARR Institutions</header>
<subsection id="HB1AAD77A2CC742C8A4EE71242FE2297F"><enum>(a)</enum><header>Grant
program</header>
<paragraph id="HF70FB14CBE3C4A41BA55EB04AFBC1236"><enum>(1)</enum><header>In
general</header><text>The Secretary or the Director, as appropriate, shall make
grants to ASCARR Institutions to assist the ASCARR Institutions in maintaining
and expanding the capacity of the ASCARR Institutions to conduct education,
research, and outreach activities relating to—</text>
<subparagraph id="H0483BB6CFCDE48A496625D9432F7EFF1"><enum>(A)</enum><text>agriculture;</text>
</subparagraph><subparagraph id="H83EE26176A8A4EDB8D37958671FFDE00"><enum>(B)</enum><text>renewable
resources; and</text>
</subparagraph><subparagraph id="H650FEC31FCF04CB7AEFFB44029CC84"><enum>(C)</enum><text>other similar
disciplines.</text>
</subparagraph></paragraph><paragraph id="H36E807FD62E246A28C6D542DA990B9D8"><enum>(2)</enum><header>Requirements</header><text>The
Secretary or the Director, as appropriate, shall make grants under this
section—</text>
<subparagraph id="H7E5CADE60C29414A82C1610500889509"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="HAC12734FD39F42738934708E67AA71E"><enum>(i)</enum><text>through a competitive
application process under which appropriate officials of ASCARR Institutions
may submit applications in such form and manner as the Secretary or the
Director, as appropriate, may prescribe; or</text>
</clause><clause id="H965151014F024A7F90ABDBC93FD4514" indent="up1"><enum>(ii)</enum><text>through a noncompetitive
application process; and</text>
</clause></subparagraph><subparagraph id="HB9021A11D40C4B0D87F7A4ADFDCC6D41"><enum>(B)</enum><text>in such manner as
to ensure geographic diversity with respect to the ASCARR Institutions that are
the subjects of the grants.</text>
</subparagraph></paragraph><paragraph id="H2BFACAFE46BC49F0A88C47C5B0E41706"><enum>(3)</enum><header>Use of
funds</header><text>An ASCARR Institution that receives a grant under
subsection (a)(1) may use the funds made available through the grant to
maintain and expand the capacity of the ASCARR Institution—</text>
<subparagraph id="HAE63E7ABAB134B87969FF200E94E7BEB"><enum>(A)</enum><text>to successfully
compete for funds from Federal grants and other sources to carry out
educational, research, and outreach activities that address priority concerns
of national, regional, State, and local interest;</text>
</subparagraph><subparagraph id="H3C66FD2348734B2283C000BF01665F6D"><enum>(B)</enum><text>to disseminate
information relating to priority concerns to—</text>
<clause id="H6416239E142E4A4C87A4DE79BAE0FA9D"><enum>(i)</enum><text>interested members
of the agriculture, renewable resources, and related stakeholder
communities;</text>
</clause><clause id="H695F51A6470D45579D8395CE2CB7D3B0"><enum>(ii)</enum><text>the
public; and</text>
</clause><clause id="HC7F26CA7BBD44A5A907690D6EEB86679"><enum>(iii)</enum><text>any other
interested entity;</text>
</clause></subparagraph><subparagraph id="H9760159681394462AA7FB83ED2FD143E"><enum>(C)</enum><text>to encourage
members of the agriculture, renewable resources, and related stakeholder
communities to participate in priority education, research, and outreach
activities by providing matching funding to leverage grant funds; and</text>
</subparagraph><subparagraph id="H291106F7EEFA44CDB35C400742CFC464"><enum>(D)</enum><text>through—</text>
<clause id="HADFCB2C980C34866867730B8D0F728DA"><enum>(i)</enum><text>the
purchase or other acquisition of equipment and other infrastructure (not
including the construction of new buildings);</text>
</clause><clause id="H128433665F9849E8B8A6A2D95CECC5E2"><enum>(ii)</enum><text>the
renovation of facilities;</text>
</clause><clause id="H0664CD453C4240E6B4220389F14CF731"><enum>(iii)</enum><text>the professional
growth and development of the faculty of the ASCARR Institution; and</text>
</clause><clause id="H0524B07C6E354A3096DF1E95EDFA265"><enum>(iv)</enum><text>the
development of human capital (including through the use of graduate
assistantships).</text>
</clause></subparagraph></paragraph></subsection><subsection id="H9192627A677943FE004EBFA2E0DB51E4"><enum>(b)</enum><header>Authorization of
appropriations</header><text>There are authorized to be appropriated to carry
out this section—</text>
<paragraph id="H1CA3BAE839B949A7A81DA040D0B0B2B4"><enum>(1)</enum><text>$5,000,000 for
fiscal year 2008;</text>
</paragraph><paragraph id="HAC335171D0284C718866389D96B12816"><enum>(2)</enum><text>$8,000,000 for
fiscal year 2009;</text>
</paragraph><paragraph id="HED48C8BED7114A3A005BC17E50C32135"><enum>(3)</enum><text>$10,000,000 for
fiscal year 2010;</text>
</paragraph><paragraph id="HB0BE83CCDC884A849F7DC0B6ECDFB83B"><enum>(4)</enum><text>$13,000,000 for
fiscal year 2011;</text>
</paragraph><paragraph id="H952BCB597B2642F984B1DCC9FA9BE491"><enum>(5)</enum><text>$17,000,000 for
fiscal year 2012; and</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H715026720706433E801DA738BB08B69E"><enum>(6)</enum><text>such sums as are
necessary for fiscal year 2013 and each fiscal year thereafter.</text>
</paragraph></subsection></section><enum>II</enum><header>Modifications</header>
<section id="HCBDFB7A39C0649A191C8E11D7F19CA3"><enum>201.</enum><header>Merit Review of
Extension and Educational Grants</header><text display-inline="no-display-inline">Section 103 of the Agricultural Research,
Extension, and Education Reform Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/7/7613">7 U.S.C. 7613</external-xref>) is amended in
subsection (a), by striking paragraph (2) and inserting the following:</text>
<quoted-block display-inline="no-display-inline" id="H4DC9B7CF69DD46B683F7CBA6CC32E0F9" style="OLC">

work requirements</header>
<subsection id="H47DE524C2AC04010AB698BBEFF8F3F00"><enum>(a)</enum><header>Extension at

Smith-Lever Act (<external-xref legal-doc="usc" parsable-cite="usc/7/343">7 U.S.C. 343</external-xref>) is amended by striking subsection (h) and

<quote>multistate activity</quote> means a cooperative extension activity in
which 2 or more States cooperate to resolve problems that concern more than 1
State.</text>
</paragraph><paragraph id="HCC21954BA3314DFAB839E000755DCC9"><enum>(2)</enum><header>Requirement</header>
<subparagraph id="HD260A07CF2D44C51AC4B5B99AC486F4E"><enum>(A)</enum><header>In
general</header><text>To receive funding under subsections (b) and (c) for a
fiscal year, a State must have expended on multistate activities, in the
preceding fiscal year, an amount equivalent to not less than 25 percent of the
funds paid to the State under subsections (b) and (c) for the preceding fiscal
year.</text>
</subparagraph><subparagraph id="HB6AA613BC07F4B8DA28431DDB460E4B2"><enum>(B)</enum><header>Determination of
amount</header><text>In determining compliance with subparagraph (A), the
Secretary shall include all cooperative extension funds expended by the State
in the preceding fiscal year, including Federal, State, and local funds.</text>
</subparagraph></paragraph><paragraph id="H2EF72ED9DC5B4B9995287200AE001098"><enum>(3)</enum><header>Reduction of
percentage</header><text>The Secretary may reduce the minimum percentage
required to be expended for multistate activities under paragraph (2) by a
State in a case of hardship, unfeasibility, or other similar circumstances
beyond the control of the State, as determined by the Secretary.</text>
</paragraph><paragraph id="H8A41A6C8BE9D430BA858E51F1C98AB"><enum>(4)</enum><header>Applicability</header><text>This
subsection does not apply to funds provided—</text>
<subparagraph id="HCCBFF57816CD43C89B00C1799BDBA5B0"><enum>(A)</enum><text>to a 1994
Institution (as defined in section 532 of the Equity in Educational Land-Grant
Status Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/301">7 U.S.C. 301</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/103/382">Public Law 103–382</external-xref>)); or</text>

</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
</subsection><subsection id="H61EB7D13A52341E69348D3876600664F"><enum>(b)</enum><header>Funds expended
on integrated research and extension activities</header><text>Section 3 of the
Hatch Act of 1887 (<external-xref legal-doc="usc" parsable-cite="usc/7/361c">7 U.S.C. 361c</external-xref>) is amended by striking subsection (i) and
inserting the following:</text>

activities that integrate cooperative research and extension (referred to in
this section as <quote>integrated activities</quote>), in the preceding fiscal
year, an amount equivalent to not less than 25 percent of the funds paid to the
State under this section and subsections (b) and (c) of section 3 of the
Smith-Lever Act (<external-xref legal-doc="usc" parsable-cite="usc/7/343">7 U.S.C. 343</external-xref>) for the preceding fiscal year.</text>
</subparagraph><subparagraph id="HFEC0085A47354C1B90BB5007AC0735CB"><enum>(B)</enum><header>Determination of

calculate the amount of expenditures for multistate activities required under
subsection (c)(3) of this section and section 3(h) of the Smith-Lever Act (7
U.S.C.

</subsection></section><section id="H26CB2D0F52274214B47F1154B2F7BDE"><enum>402.</enum><header>Expansion of
food and agricultural sciences awards</header><text display-inline="no-display-inline">Section 1417(i) of the National Agricultural
Research, Extension, and Teaching Policy Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/7/3152">7 U.S.C. 3152(i)</external-xref>) is
amended—</text>
<paragraph id="H89A82B350F9A445E84B3B2109F3CDD67"><enum>(1)</enum><text>in the subsection
heading by striking <quote>Teaching Awards</quote> and inserting
<quote>Teaching, Extension, and Research Awards</quote>; and</text>

the areas of teaching, extension, and research of food and agricultural science
at a college or

</paragraph></section><section id="H88E256155E444D149BC32559EFB8894C"><enum>403.</enum><header>Sustainable
human development initiative</header><text display-inline="no-display-inline">Subtitle C of title XIV of the National
Agriculture Research, Extension, and Teaching Policy Act of 1977 (7 U.S.C. 3121
et seq.) is amended by adding at the end the following:</text>
<quoted-block display-inline="no-display-inline" id="H699DC268F6824285830068892B35E386" style="OLC">
<section id="HB61B7B6BB1E04B669B7DFC5E065913C5"><enum>1413C.</enum><header>Sustainable
human development initiative</header>
<subsection id="H7803E5CF9FC345C3819B728200BBC9FA"><enum>(a)</enum><header>In
general</header><text>The Secretary, through the Cooperative State Research,
Education, and Extension Service or any successor organization, shall establish
and carry out a sustainable human development initiative using an
interdisciplinary approach to demonstrate the importance of—</text>
<paragraph id="H7270B073F15D4BD8B0E38342F1371BAC"><enum>(1)</enum><text>enhancing and
sustaining human capital and resources along with economic growth in both
developing and advanced economies;</text>
</paragraph><paragraph id="H88ADA28A9D3142D4BD8FF9367654D8C4"><enum>(2)</enum><text>improving health
and nutrition and supporting the stability and well-being of women, children,
and families throughout the world;</text>
</paragraph><paragraph id="H6A60FF559A3E4B53B3F5C8BC61C9529F"><enum>(3)</enum><text>protecting the
environment while carrying out necessary development activities; and</text>
</paragraph><paragraph id="HCF783A68CBCB4C66A9CF004427C966E0"><enum>(4)</enum><text>achieving and
maintaining social justice along with economic and social opportunity.</text>
</paragraph></subsection><subsection id="HACAFE605CDA046C5A4D873E4154BFC45"><enum>(b)</enum><header>Partnerships</header><text>In
carrying out this section, the Secretary shall enter into partnerships with
colleges and universities and with such other public and private entities as
the Secretary deems appropriate to assemble individuals with appropriate levels
of training and experience in disciplines that can further the
initiative.</text>
</subsection><subsection id="HDAB98D7AC5CF4A36B123DBFE296D1A5"><enum>(c)</enum><header>Integration into
activities</header><text>The Secretary shall endeavor to integrate the
principles of sustainable human development into the research, extension,
teaching, and related activities carried out under this Act and such related
authorities as the Secretary determines
appropriate.</text>

</section></subtitle><subtitle id="H3D492F708E4D406E92A0615D3D889D98"><enum>B</enum><header>Nutrition</header>
<section commented="no" id="HA69882736C204531B227DCD5D49B10F1"><enum>411.</enum><header>Expanded food
and nutrition education program</header>
<subsection commented="no" id="H80C73AD893E6483F956226F372997E3D"><enum>(a)</enum><header>Funding to 1862,
1890, and insular area institutions</header><text>Section 1425(c)(2)(B) of the
National Agriculture Research, Extension, and Teaching Policy Act of 1977 (7
U.S.C. 3175(c)(2)(B)) is amended</text>
<paragraph commented="no" id="H16AD9F12BB7C4F640070A4BB8B3D0134"><enum>(1)</enum><text>in the prefatory
material by striking <quote>among the States</quote>;</text>
</paragraph><paragraph commented="no" id="H2A0090CED47C4619B435C1588F798551"><enum>(2)</enum><text>by striking clause
(i) and inserting the following:</text>

each fiscal year thereafter, shall be allocated to each 1890 Institution (as
defined in section 2 of the Agricultural Research, Extension, and Education
Reform Act of 1998) in an amount that bears the same ratio to the total amount
to be allocated under this clause as the population of the State living at or
below 125 percent of the income poverty guidelines prescribed by the Office of
Management and Budget (adjusted pursuant to section 673(2) of the Omnibus
Budget Reconciliation Act of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/42/9902">42 U.S.C. 9902</external-xref>)), bears to the total
population of all the States that have 1890 Institutions living at or below 125
percent of the income poverty guidelines, as determined by the last preceding
decennial census at the time each such additional amount is first appropriated:
Provided, That the total allocated under this clause shall not exceed (I) the
amount of the funds appropriated for the conduct of the expanded food and
nutrition education program for the fiscal year that are in excess of the
amount appropriated for the conduct of the program for the fiscal year ending
September 30, 2007, reduced by (II) any amounts expended pursuant to any
adjustment under subsection (d); and</text>
</subsection><after-quoted-block>;

</paragraph><paragraph commented="no" id="H4A216482D50C4A86A134E009C003CB3"><enum>(5)</enum><text>By amending clause
(iii), as redesignated—</text>

<quote>allocated to each State</quote> and inserting <quote>allocated to the
institution eligible to receive funds under the Act of July 2, 1862 (and

</section><section id="H662A1495662248BB9CD18862CA6496B3"><enum>413.</enum><header>Food stamp
nutrition education reimbursement for 1890 institutions</header><text display-inline="no-display-inline">Notwithstanding any other provision of law,
the Secretary of Agriculture may reimburse a State participating in the Food
Stamp Nutrition Education Program at the rate of 100 percent for allowable
expenditures for nutrition education provided by an 1890 Institution (as
defined in section 2 of the Agricultural Research, Extension, and Education
Reform Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/7/7601">7 U.S.C. 7601(2)</external-xref>), if the Secretary determines that the
1890 Institution would otherwise be unable to provide the Nutrition
Education.</text>

2501(a)(4)(A) of the Food, Agriculture, Conservation, and Trade Act of 1990 (7
U.S.C. 2279(a)(4)(A)) is amended by striking <quote>$25,000,000 for each of
fiscal years 2002 through 2007</quote> and inserting <quote>$50,000,000 for
each of fiscal years 2008 through 2014</quote>.</text>
</subsection><subsection id="H708714CDD977442C9C8F88C944FF7534"><enum>(b)</enum><header>Duration of
agreements</header><text>Section 2501(a)(3)(A) of the Food, Agriculture,

adding at the end the following: <quote>Any grant, contract, or other agreement
under this subsection may be entered into for a period of between 1 and 5

request a multiyear grant, contract, or agreement of at least 3 years in

schools to expand extension capacity</header><text display-inline="no-display-inline">Section 1417(b)(4) of the National
Agricultural Research, Extension, and Teaching Policy Act of 1977 (7 U.S.C.
3152(b)(4)) is amended by striking <quote>teaching and research</quote> and
inserting <quote>teaching, research, and extension</quote>.</text>
</section><section id="H5FA52C2425A44E7100750641838BF039"><enum>428.</enum><header>National center
for the study of socialy disadvantaged farmers</header>
<subsection id="H72FC00F5FED34E71B0BF6478E4B7EF92"><enum>(a)</enum><header>In
general</header><text>The Secretary may make a competitive grant annually to a
consortium of 1890 Institutions for the purpose of establishing and supporting
a National Center for the Study of Socially Disadvantaged Farmers (referred to
in this section as the <quote>Center</quote>).</text>
</subsection><subsection id="HE428E7ED3FF54FC0A7EDADD3DAD4F29"><enum>(b)</enum><header>Purposes</header><text>The
purposes of the Center are—</text>
<paragraph id="H6326EBF8F6E74E078C243F0170D68430"><enum>(1)</enum><text>to conduct
research, analysis, and policy formulation, and to disseminate information
designed to improve the economic viability of socially disadvantaged farmers in
the United States; and</text>
</paragraph><paragraph id="HE04A85162FD14945A184C44B4839D4A7"><enum>(2)</enum><text>to evaluate the
effectiveness and impact of the programs and services of the Department of
Agriculture that serve socially disadvantaged farmers and recommend policies
designed to improve the quality of those programs and services.</text>
</paragraph></subsection><subsection id="H6FEEC0F145D34F2D808EA803EBB7C291"><enum>(c)</enum><header>Definitions</header><text>In
this section:</text>
<paragraph id="HF1B6C0CF67A84B85A58DA47354E5AE9B"><enum>(1)</enum><text>The term
<quote>Secretary</quote> means the Secretary of Agriculture.</text>

<quote>socially disadvantaged farmer</quote> has the meaning given that term in

this section not to exceed $2,000,000 for each of the fiscal years 2008 through

entrepreneurship development program</header>
<subsection id="HDB7CEB14C1FF4F089C1470964C007437"><enum>(a)</enum><header>Research
projects required</header><text>The Secretary shall conduct research and
education projects to obtain data, develop conclusions, demonstrate
technologies, and facilitate multi-jurisdictional initiatives that promote the
purposes of this section, including research and education projects
that—</text>
<paragraph id="H20488E93836440189C91269100F03326"><enum>(1)</enum><text>facilitate and
increase investigation and education in order to—</text>
<subparagraph id="HA58EAF6BDB4B4849A74F3B7118DD713D"><enum>(A)</enum><text>provide the
necessary education, training, and technical assistance in high schools,
community colleges, colleges, universities and through non-formal outreach
education delivery systems to start up and grow rural businesses;</text>
</subparagraph><subparagraph id="H1435FD0C2DA94F87ABAD6C5E2E61CEF3"><enum>(B)</enum><text>provide the
necessary education, training, and technical assistance in English as well as
other languages serving the needs of minority and immigrant populations;</text>
</subparagraph><subparagraph id="H5C509F7E3AE84432BBE2B9A4B710703C"><enum>(C)</enum><text>improve access to
a diverse range of capital resources from microenterprise loans to venture
capital;</text>
</subparagraph><subparagraph id="H8BC074588A4C488986D200818EEAD8D5"><enum>(D)</enum><text>determine the best
methods to train entrepreneurs in preparing business plans, recordkeeping,
compliance with tax rules, financial management, and general business
practices;</text>
</subparagraph><subparagraph id="HDBF82D8558C5418495003D37BFF6E8C2"><enum>(E)</enum><text>promote
entrepreneurship among rural youth, minority populations, women, and low-income
rural residents; and</text>
</subparagraph><subparagraph id="HB3627BF1681A4EB29FA0DDF68B7E1D00"><enum>(F)</enum><text>create networks of
entrepreneurial support and enabling culture among the business community,
government at all levels, nonprofit organizations, educational institutions,
and other sectors; and</text>
</subparagraph></paragraph><paragraph id="H4B4E000A8E104936BC87D0F35228FD55"><enum>(2)</enum><text>facilitate the
conduct of projects in order to—</text>
<subparagraph id="H9977167EA7C0483D863524BEF3180025"><enum>(A)</enum><text>study, to the
extent practicable, the unique entrepreneurial development systems that best
align with the unique needs and strengths of rural areas and rural
communities;</text>
</subparagraph><subparagraph id="HF7A1EBCD73BB4D518BCF9741F830F424"><enum>(B)</enum><text>study rural
entrepreneurs and the education, training, and technical assistance they
employ;</text>
</subparagraph><subparagraph id="H54F3F2DF528C4D6DB777C9B96C64762B"><enum>(C)</enum><text>study rural
entrepreneurial development organizations with regard to the education,
training, and technical assistance they provide, and determine what are the
most promising strategies for building a more integrated system of program
delivery to rural entrepreneurs;</text>
</subparagraph><subparagraph id="HE76BB0108E164DBE9D4617B27632ED3"><enum>(D)</enum><text>take advantage of
the experience and expertise of rural entrepreneurs and rural entrepreneurial
development organizations through their direct participation and leadership in
projects;</text>
</subparagraph><subparagraph id="H1EC80A88ED8B4AA2B83C7D6D78B24933"><enum>(E)</enum><text>transfer
practical, reliable, and timely information to rural entrepreneurs and rural
entrepreneurial development organizations concerning entrepreneurial education,
training, technical assistance, and the development of local and regional
entrepreneurial systems in rural areas and rural communities;</text>
</subparagraph><subparagraph id="H0EBF2BD6B9454C248D749E544776B219"><enum>(F)</enum><text>promote
partnerships among rural entrepreneurs, nonprofit organizations, educational
institutions at all levels, and governmental institutions and agencies at all
levels; and</text>
</subparagraph><subparagraph id="H4CE0D483B8034CF3A1BBF56F0015E3FD"><enum>(G)</enum><text>provide assistance
to local governments regarding the important mix of policies and programs that
can help create and promote entrepreneurial-ready communities in rural
America.</text>
</subparagraph></paragraph></subsection><subsection id="HD8EB7C98EA6048D3AE39309195BA27B8"><enum>(b)</enum><header>Agreements</header><text>The
Secretary shall carry out this section through agreements entered into with
land-grant colleges or universities (including their State Cooperative
Extension Services, Agricultural Experiment Stations, and their Regional Rural
Development Centers), other universities or colleges, community colleges and
other 2-year institutions of higher education, elementary and secondary
schools, the State cooperative extension services, nonprofit organizations, or
Federal, State or local governmental entities. All agreements shall be awarded
on a competitive basis according to criteria set forth by the Regional
Administrative Councils established under subsection (f).</text>
</subsection><subsection id="H6647796FF46C4B43912DC0006FC90069"><enum>(c)</enum><header>Selection,
priority, and duration of projects</header>
<paragraph id="HEA5EFEDA362D41218979E442BCE7C0C6"><enum>(1)</enum><header>In
general</header><text>The Secretary shall select projects to be carried out
under this section on the basis of—</text>
<subparagraph id="HF248394D8E1B47FE9763508E80400005"><enum>(A)</enum><text>the relevance of
the project to the purposes of this section;</text>
</subparagraph><subparagraph id="H36A2624F00A842F295044CFCD89E0665"><enum>(B)</enum><text>the
appropriateness of the design of the project;</text>
</subparagraph><subparagraph id="H66D63C2FDB984FE38288E6EF00E44243"><enum>(C)</enum><text>the likelihood of
attaining the objectives of the project; and</text>
</subparagraph><subparagraph id="H2F37FD110FCB40A7B05312EEA340B3A3"><enum>(D)</enum><text>the national or
regional applicability of the findings and outcomes of the proposed
project.</text>
</subparagraph></paragraph><paragraph id="H6FD2ED54F12A43E5BC71F2904C19EAD9"><enum>(2)</enum><header>Priority</header><text>In
carrying out projects under this section, the Secretary shall give priority to
projects that—</text>
<subparagraph id="HF1DFBF08E085432CA7216900CB21114B"><enum>(A)</enum><text>closely coordinate
research and education activities (including outreach education
efforts);</text>
</subparagraph><subparagraph id="H9D5464D8E7AF4488846C4200E4E773A6"><enum>(B)</enum><text>will best
disseminate the findings of the project in a readily usable manner to rural
entrepreneurs and to rural community leaders;</text>
</subparagraph><subparagraph id="H4AE40270A16849B2B9914C2100B0F8E"><enum>(C)</enum><text>maximize the
involvement and cooperation of rural entrepreneurs;</text>
</subparagraph><subparagraph id="HDF085D9F42934C709CE856F71E71E33B"><enum>(D)</enum><text>involve a
multidisciplinary systems approach; and</text>
</subparagraph><subparagraph id="H55008CEB731749FE84210500E09D7CBC"><enum>(E)</enum><text>involve
cooperation between rural entrepreneurs, nonprofit organizations,
entrepreneurial development organizations, educational institutions at all
levels, and government agencies at all levels.</text>
</subparagraph></paragraph><paragraph id="HEC23545A04B9475886E0003157A5CFE6"><enum>(3)</enum><header>Project
duration</header><text>The Secretary may approve projects to be conducted under
this section that have a duration of more than one fiscal year.</text>
</paragraph></subsection><subsection id="H7C189FA904A8450390CDA91FC68B7D70"><enum>(d)</enum><header>Diversification
of research</header><text>The Secretary shall conduct projects and studies
under this section in areas that are broadly representative of the diversity of
the rural areas of the Unites States and the diversity of rural
entrepreneurship in the United States, including entrepreneurship involving
youth, racial groups, microenterprises, and women, with a focus on either food
and other agriculturally-based businesses (but not directly production
agriculture), or non-agricultural business.</text>
</subsection><subsection id="H7395BD041A7248B88DA0FC2D81592B79"><enum>(e)</enum><header>Program
administration</header><text>The Secretary shall—</text>
<paragraph id="H5DDFF543A22E4A29ACF8120745285FF6"><enum>(1)</enum><text>administer the
programs and projects conducted under subsection (a) through the Cooperative
State Research Service in close cooperation with the Extension Service,
Agricultural Research Service (or its successor agency), and other appropriate
agencies;</text>
</paragraph><paragraph id="H0AD20D68980D4151BB20652C2BA180E4"><enum>(2)</enum><text>establish a
minimum of four Regional Administrative Councils in accordance with subsection
(f); and</text>
</paragraph><paragraph id="H85E7110C3ED745BFB33F2C46EADE62C5"><enum>(3)</enum><text>with the advice of
the Regional Administrative Councils, identify the applicable regional rural
development center as the regional host institution or organization responsible
for carrying out such programs or projects, or identify another regional host
institution where appropriate.</text>
</paragraph></subsection><subsection id="HECB14B934BA647CCB0BA1E53C39CD2F5"><enum>(f)</enum><header>Regional
administrative councils</header>
<paragraph id="H66ABEF8BDB0348EBA9F5E960B3150546"><enum>(1)</enum><header>Membership</header><text>The
membership of the Regional Administrative Councils shall include
representatives of—</text>
<subparagraph id="H96112D092AB644B5BA66A17F9050B039"><enum>(A)</enum><text>nonprofit
organizations that are involved in the direct services to rural entrepreneurs,
small businesses, and microenterprises, or that have demonstrable experience in
rural entrepreneurship;</text>
</subparagraph><subparagraph id="H2291F281DE8C4A5CBE3363FDD27200A7"><enum>(B)</enum><text>regional and state
agencies involved in rural economic development;</text>
</subparagraph><subparagraph id="HFEDA3DD929C047CBB778CD419CB1DBD3"><enum>(C)</enum><text>State Cooperative
Extension Services in the region that are involved in providing direct services
to rural entrepreneurs, small businesses, and microenterprises, or to rural
communities that are engaged in entrepreneurship development efforts;</text>
</subparagraph><subparagraph id="H0CECA141A4CC4CBC9D9BBCF155007615"><enum>(D)</enum><text>representatives
from philanthropic organizations with a strong interest in rural
entrepreneurship and rural development activities in the region;</text>
</subparagraph><subparagraph id="H9C574F327958403A9B2E94F5F8000695"><enum>(E)</enum><text>self-employed
rural entrepreneurs and owners of rural small businesses with more than 5 and
fewer than 50 employees;</text>
</subparagraph><subparagraph id="HA7496F1728E847500019516F00B0C6C6"><enum>(F)</enum><text>institutions of
higher education with demonstrable experience in rural entrepreneurship or
related activities;</text>
</subparagraph><subparagraph id="HA05850C1D39844969D7406AB2C447700"><enum>(G)</enum><text>elementary and
secondary educators with demonstrable experience in rural
entrepreneurship;</text>
</subparagraph><subparagraph id="HE5C815821F0C4B84A832D7A080403F3C"><enum>(H)</enum><text>the director or
representative of the Regional Rural Development Center located in the
region;</text>
</subparagraph><subparagraph id="H3F04146E44D841CB8BC35681B71BCCDF"><enum>(I)</enum><text>owners of rural
businesses with 5 or fewer employees;</text>
</subparagraph><subparagraph id="H12444293EB8F457B00A9559D08B4C341"><enum>(J)</enum><text>State cooperative
extension services with demonstrable experience in rural
entrepreneurship;</text>
</subparagraph><subparagraph id="HBB7B511017CF4189AA63B5D7EEB3F9F"><enum>(K)</enum><text>nonprofit
organizations with demonstrable experience in rural entrepreneurship;</text>
</subparagraph><subparagraph id="HAB9FE8072EA44CA8A3333591069322E8"><enum>(L)</enum><text>tribal
governments; and</text>
</subparagraph><subparagraph id="HB7ECC5C7E35B45C5AC4E3520C7A72F68"><enum>(M)</enum><text>other persons
knowledgeable about rural entrepreneurship and its impact on rural
communities.</text>
</subparagraph></paragraph><paragraph id="H4B907A862DED48F3821389D641C26300"><enum>(2)</enum><header>Responsibilities</header><text>The
Regional Administrative Councils shall—</text>
<subparagraph id="HE1C7C1F2BE02452EAD86AEA4CCEAF12"><enum>(A)</enum><text>promote the
programs established under this section at the regional level;</text>
</subparagraph><subparagraph id="HCF9908DD60BD4C27857C006393E9CC31"><enum>(B)</enum><text>establish goals
and criteria for the selection of projects authorized under this section within
the applicable region;</text>
</subparagraph><subparagraph id="H36543A6ADEFB431CAFE8C784D544981C"><enum>(C)</enum><text>appoint a
technical committee to evaluate the proposals for projects to be considered for
selection under this section;</text>
</subparagraph><subparagraph id="HD405873530644A1E9BBEDEB25059D5FD"><enum>(D)</enum><text>review the
recommendations of the technical committee, and coordinate its activities with
the regional host institution; and</text>
</subparagraph><subparagraph id="HFBD077D920354BA89FEAB5E411743598"><enum>(E)</enum><text>prepare and make
available an annual report concerning projects funded under this section,
together with an evaluation of the project activity.</text>
</subparagraph></paragraph><paragraph id="HF59229C6AC8045D3BFD9C114309BD41C"><enum>(3)</enum><header>Conflict of
interest</header><text>A member of the Regional Administrative Council or a
technical committee may not participate in the discussion or recommendation of
a proposed project if the member has or had a professional or business interest
in, including the provision of consultancy services to, the organization whose
proposal is under review.</text>
</paragraph><paragraph id="H09BC195E113C416993346048DA1D9BBF"><enum>(4)</enum><header>Authorization of
appropriations</header><text>There are authorized to be appropriated to carry
out this section $20,000,000 for each of the fiscal years 2008 through 2014, to
remain available until expended.</text>
</paragraph></subsection></section><section id="H9339FF20993245E2982C6C2FB0E2AC76"><enum>454.</enum><header>Amendments to
the consolidated farm and rural development act relating to 2002 farm bill
programs</header>

<section id="H9FB5ED470B034A55B38986ED2C41CE79"><enum>461.</enum><header>FAS/extension
service internships</header><text display-inline="no-display-inline">Section
1458(a)(10) of the National Agricultural Research, Extension, and Teaching
Policy Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/7/3291">7 U.S.C. 3291(a)(10)</external-xref>) is amended by striking
<quote>establish</quote> and inserting <quote>maintain</quote>.</text>
</section><section id="H2A3FD2E9673543EC006D7EFC714892E"><enum>462.</enum><header>FAS internships;
university-assisted funding</header>
<subsection id="H611B464EBEC749C3B01600E467E2A9C4"><enum>(a)</enum><header>Purpose</header><text>The
purpose of this section is to establish a new internship program to maintain
and strengthen the competitiveness of the United States in international
agricultural trade by authorizing the Foreign Agricultural Service to accept
students who are enrolled in agriculture and related studies in colleges and
universities in the United States to serve as interns for limited terms at FAS
posts outside the United States.</text>
</subsection><subsection id="H194A7590393741C8BC807030F1B7B9DF"><enum>(b)</enum><header>Definitions</header><text>In
this section:</text>
<paragraph id="H80334A52821749BBA6F8F1000006D3FC"><enum>(1)</enum><header>College or
university</header><text>the term <quote>college or university</quote> means an
institution of higher education as defined in section 102(a) of the Higher
Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002(a)</external-xref>); and</text>
</paragraph><paragraph id="H8B286DA9D465449AA2C43DED84A993A"><enum>(2)</enum><header>FAS</header><text>the
term <quote>FAS</quote> means the Foreign Agricultural Service of the
Department of Agriculture.</text>
</paragraph></subsection><subsection id="H5EDDBC07E38B470EA4872D459699E547"><enum>(c)</enum><header>Memoranda of
understanding</header>
<paragraph id="HA41B7CF2BE914F31A16698A03E558541"><enum>(1)</enum><header>In
general</header><text>Each internship shall be planned and administered in
accordance with a memorandum of understanding between the FAS officer-in-charge
at the post and an appropriate senior academic official of the college or
university where the intern is a student.</text>
</paragraph><paragraph id="H18AEC51979364910BF1677B3F8625E15"><enum>(2)</enum><header>Contents</header><text>In
order to assure maximum benefit to the FAS office, the intern, the college or
university, the United States Government, and the United States citizens served
by the FAS, the memorandum shall</text>
<subparagraph id="HECED81B8A3D647C283515CCC2180ED32"><enum>(A)</enum><text>establish the
procedures and terms that will be followed in the relationship between the FAS
and the college or university over a multi-year period;</text>
</subparagraph><subparagraph id="HE481E46A8D6E41399959069939B5D22E"><enum>(B)</enum><text>assign specific
goals for the internship, and responsibility for the supervision of the intern
and for the evaluation of the intern’s performance; and</text>
</subparagraph><subparagraph id="H6C8EA94117B848EE8E7C2836BBF53B4"><enum>(C)</enum><text>contain the
assurances described in subsection (e)(2) in a manner satisfactory to the
FAS.</text>
</subparagraph></paragraph><paragraph id="H4B44507FA6D94B8DA39E8CC393790088"><enum>(3)</enum><header>Supervision</header><text>The
responsibility for supervising and evaluating the work of an intern may be
shared, at the discretion of the FAS officer-in-charge, with non-United States
citizens employed by the FAS, faculty from the cooperating college or
university, or other Federal Government personnel outside the FAS.</text>
</paragraph><paragraph id="HEDED5F435A844C6CAEE3F5F3B9E18E77"><enum>(4)</enum><header>Exchange of
letters</header><text>In the absence of a multi-year memorandum of
understanding, a single internship of a specific student may be arranged
through an exchange of letters between the FAS officer-in-charge at post and
the appropriate senior academic official at the student’s college or
university, specifying the terms of the internship.</text>
</paragraph><paragraph id="HDCA70F51E4D345DD83680728F7A776D9"><enum>(5)</enum><header>Multiple
agreements</header><text>An FAS officer-in-charge may accept interns under
memoranda of understanding with more than one college or university, and a
college or university may have entered into memoranda of understanding with
more than one FAS post. Groups of colleges or universities may jointly enter
into memoranda of understanding with one FAS post for the placement of
interns.</text>
</paragraph></subsection><subsection id="HD1165B8982CF45228348A019CDF6973B"><enum>(d)</enum><header>FAS
duties</header><text>The officer-in-charge at the FAS post shall—</text>
<paragraph id="H4EE29639E6054A5EA47B25BFC4675B88"><enum>(1)</enum><text>provide the intern
with work supervision, work space, support for security clearance, credentials,
and other requirements to perform the assigned tasks for the FAS;</text>
</paragraph><paragraph id="HA169F467D19C46699D2EB444D83DF117"><enum>(2)</enum><text>assist an intern,
when possible, in identifying local housing and transportation that may be
available at reduced or no cost; and</text>
</paragraph><paragraph id="HD959DF10C7644804921D0409E510DF35"><enum>(3)</enum><text>prepare interns
for their expected FAS responsibilities based upon planning between the FAS
posts and cooperating universities.</text>
</paragraph></subsection><subsection id="HBFFA497EE9FC4F098C61D38B08922FE4"><enum>(e)</enum><header>University
duties</header><text>The college or university shall—</text>
<paragraph id="H4E78455CCC454CE3B50599F2CCB4917"><enum>(1)</enum><text>select the intern,
with the concurrence of the FAS; and</text>
</paragraph><paragraph id="H7F29D4463D1A47DD9620BF13F88CDE10"><enum>(2)</enum><text>provide
satisfactory assurances to the FAS officer-in-charge at the foreign post that
the intern has or will be provided sufficient financial resources to cover
round-trip international airfare to the post, medical insurance while at the
post, costs of food and lodging, local travel costs to and from the post, and
any applicable stipend, as agreed upon by the FAS and the college or
university.</text>
</paragraph></subsection><subsection id="H28F3EBFEE4144533B588E71EBCA8D235"><enum>(f)</enum><header>Authorization of
appropriations</header><text>There are authorized to be appropriated to carry
out this section not to exceed $1,000,000 for each of the fiscal years 2008
through 2014. Not more than 10 percent of funds appropriated to carry out this
section in any fiscal year may be used to pay administrative expenses of the
FAS.</text>
</subsection></section><section id="H6B95C483CCB8452E967FAFDBD21CD1E9"><enum>463.</enum><header>Borlaug
international agricultural science and technology fellowship program</header>
<subsection id="H7AB295CFBE114E96AFC1D16F7D85FC5"><enum>(a)</enum><header>Establishment</header>
<paragraph id="H2AC181B8F13B4211A92EFE51D54460F2"><enum>(1)</enum><header>In
general</header><text>The Secretary of Agriculture shall establish a fellowship
program to be known as the <quote>Borlaug International Agricultural Science
and Technology Fellowship Program,</quote> to provide fellowships for
scientific training to individuals from eligible countries (as described under
subsection (b)) who specialize in agricultural education, research and
extension for study in the United States.</text>
</paragraph><paragraph id="H20A7826F96464CCBB7E8F5A89E07F859"><enum>(2)</enum><header>Programs</header><text>The
Secretary shall carry out the program established under paragraph (1) through 3
programs designed to assist individual fellowship recipients as follows:</text>
<subparagraph id="H27B9E763E3EB4979AAE4E0D33C736865"><enum>(A)</enum><text>A Graduate Studies
Program in Agriculture to assist individuals who participate in graduate
agricultural degree training at a United States institution;</text>
</subparagraph><subparagraph id="HAB67CF0FE2B840298FD09DC48845F0A"><enum>(B)</enum><text>An Individual
Career Improvement Program to assist agricultural scientists from developing
countries to upgrade skills and understanding in agricultural science and
technology; and</text>
</subparagraph><subparagraph id="H343506D4696B42A78660EFD77F702823"><enum>(C)</enum><text>The Borlaug
Agricultural Policy Executive Leadership Course to assist senior agricultural
policy makers from eligible countries with an initial focus on sub-Saharan
Africa and from the newly independent states of the former Soviet Union.</text>
</subparagraph></paragraph></subsection><subsection id="H49EB981DEC57480B9D8F40429347C3CA"><enum>(b)</enum><header>Eligible
countries</header><text>Countries described in this subsection shall be
eligible to participate in the program established under this section:</text>
<paragraph id="H6A03D3FFC9C64182008900CCDA733C54"><enum>(1)</enum><header>Low-income
country</header><text>A country with low per capita income that receives
foreign aid assistance from the United States to promote employment
opportunities, increase income levels and levels of living, particularly in the
rural areas, and to reduce rural poverty through increased agricultural
productivity.</text>
</paragraph><paragraph id="HE18B700689C14599B8C2E3D818AFCBC"><enum>(2)</enum><header>Middle-income
country</header><text>A country that has developed economically to the point
where it no longer qualifies for bilateral foreign aid assistance from the
United States because its per capita income level exceeds the eligibility
requirements of such assistance programs (hereafter referred to in this section
as a <quote>middle-income</quote> country).</text>
</paragraph><paragraph id="HBB3E9787078741FBA90587B9B443393F"><enum>(3)</enum><header>Ongoing
relationship</header><text>A middle-income country that has never qualified for
bilateral foreign aid assistance from the United States, but with respect to
which an ongoing relationship with the United States, including technical
assistance and training, would provide mutual benefits to such country and the
United States.</text>
</paragraph><paragraph id="H1D36F5FC712A49C0AD33E04018E00DE"><enum>(4)</enum><header>Type of
government</header><text>A country that is transforming its system of
government from a non-representative type to a representative democracy and
that is encouraging democratic institution building, and the cultural values,
institutions, and organizations of democratic pluralism.</text>
</paragraph><paragraph id="H8CA59C4E31BE440D95DE2CE12FEC9E00"><enum>(5)</enum><header>Independent
states of the former soviet union</header><text>A country that is an
independent state of the former Soviet Union as defined in section 102(8) of
the Agricultural Trade Act of 1978 (7 U.S.C. 5602 (8)), to the extent that the
Secretary of Agriculture determines that the United States and the country
could benefit from the eligibility and participation of the country in the
program established under this section.</text>
</paragraph></subsection><subsection id="H7A05B920E4694D8A9858F4C9BEAAB8D9"><enum>(c)</enum><header>Purpose of
fellowships</header><text>Fellowships under this section shall promote food
security and economic growth in eligible countries by educating a new
generation of agricultural scientists, increasing scientific knowledge and
collaborative research to improve agricultural productivity, and extending this
knowledge to users and their intermediaries in the market place. Fellowships
shall support—</text>
<paragraph id="H25221EEA71BF4E319CB2BB311D66C9E7"><enum>(1)</enum><text>training and
collaborative research opportunities through exchanges for entry-level
international agricultural research scientists, faculty and policymakers from
eligible countries;</text>
</paragraph><paragraph id="H8F9AF93D9D6D414A962CD3DC00EEB5E"><enum>(2)</enum><text>collaborative
research to improve agricultural productivity;</text>
</paragraph><paragraph id="H0B5264ACFDCF445697B54E76EFECB5D0"><enum>(3)</enum><text>the transfer of
new science and agricultural technologies to strengthen agricultural practice;
and</text>
</paragraph><paragraph id="H6100AE530BA3477DBE5FBB6D7B18C042"><enum>(4)</enum><text>the reduction of
barriers to technology adoption.</text>
</paragraph></subsection><subsection id="H91A0174B32E449CDB7492DACF8DDF196"><enum>(d)</enum><header>Fellowship
recipients</header>
<paragraph id="HE5AE16C733F3486881103496359793B3"><enum>(1)</enum><header>Eligible
candidates</header><text>The Secretary may provide fellowships under the
program authorized by this section to individuals from eligible countries who
specialize in or have experience in agricultural education, research,
extension, or related fields, including individuals from the public and private
sectors, and private agricultural producers.</text>
</paragraph><paragraph id="H058BBC8A48AA477885D97B2496B55278"><enum>(2)</enum><header>Candidate
identification</header><text>The Secretary shall utilize the expertise of
United Statesland-grant and similar universities, international organizations
working in agricultural research and outreach, and national agricultural
research organizations to help identify program candidates for fellowships
under this section from both the public and private sectors of eligible
countries.</text>
</paragraph></subsection><subsection id="H108E019E047145A68F4216C8D480C863"><enum>(e)</enum><header>Use of
fellowships</header><text>Fellowships shall promote collaborative programs
between agricultural professionals of eligible countries with those of the
United States and the international agricultural research system and, as
appropriate, with United States entities conducting research. They will be used
to support fellowship recipients through the Graduate Studies Program in
Agriculture established under subsection (a)(2)(A).</text>
</subsection><subsection id="H8A0A8E54B8D64694802D6FE0ECAC3B9B"><enum>(f)</enum><header>Program
implementation</header><text>The Secretary shall provide for the management,
coordination, evaluation and monitoring of the overall Borlaug International
Agricultural Science and Technology Fellowship Program and for the individual
programs described in subsection (a)(2), except that the Secretary may contract
out to one or more collaborating universities the management of one or more of
the fellowship programs.</text>
</subsection><subsection id="HB7E615E924C54A4BBEA50C73E6B7C60"><enum>(g)</enum><header>Oversight
board</header><text>The Secretary shall establish an oversight board to oversee
activities of the Borlaug International Agricultural Science and Technology
Fellowship Program. The board shall consist of—</text>
<paragraph id="H01B3CC8FE5094FB30089F27314D5C415"><enum>(1)</enum><text>two
representatives from the Latin American region;</text>
</paragraph><paragraph id="H2314BBF3D02E443B9B5FB52BFBE91048"><enum>(2)</enum><text>two
representatives from the African region;</text>
</paragraph><paragraph id="HB96DAF65FD984B298273009CAEB7F6EE"><enum>(3)</enum><text>two
representatives from the South Asian region;</text>
</paragraph><paragraph id="H15CE8107C3B64A68A327008C6DF9E2DE"><enum>(4)</enum><text>two
representatives from the East Asian region;</text>
</paragraph><paragraph id="HE74ECB131F394CC097EC2235A8D0FC6B"><enum>(5)</enum><text>two
representatives from United States land-grant universities;</text>
</paragraph><paragraph id="H680B1AC3EAC34D35AB930087D4F82E57"><enum>(6)</enum><text>two
representatives from development or donor organizations;</text>
</paragraph><paragraph id="HC539651CCC714EB786C5D7710057E900"><enum>(7)</enum><text>two
representatives from agricultural industries.</text>
</paragraph><continuation-text continuation-text-level="subsection">The board
will advise the office in the Foreign Agricultural Service of the Department of
Agriculture responsible for managing the program on program priorities and
related matters, including annual priority regions and countries, annual
priority topics for exchanges, and sources of complementary funding and other
alternative funding.</continuation-text></subsection><subsection id="H807D1C29AEB8450BBF6CDDC18825B0AC"><enum>(h)</enum><header>Authorization of
appropriations</header><text>There are authorized to be appropriated without
fiscal year limitation such sums as may be necessary to carry out the program
established under this section, except that the amount of such funds in any
fiscal year shall not exceed—</text>
<paragraph id="H4987AB18401F445EAD18268541B31BB"><enum>(1)</enum><text>for the Graduate
Studies Program in Agriculture established under subsection (a)(2)(A),
$1,250,000;</text>
</paragraph><paragraph id="HC4C0CF4F9BD14D03AFE89C95A3DA36DC"><enum>(2)</enum><text>for the Individual
Career Improvement Program established under subsection (a)(2)(B), $2,500,000;
and</text>
</paragraph><paragraph id="H87E26F7B57744B5AA2A2EFDFFE2BC6B4"><enum>(3)</enum><text>for the Borlaug
Agricultural Policy Executive Leadership Course established under subsection
(a)(2)(C), $1,250,000.</text>
</paragraph></subsection><subsection id="H5A02D47966B24ABDADEF1555B42994E3"><enum>(i)</enum><header>Complementary
funds</header><text>If the Secretary of Agriculture determines that it is
advisable in furtherance of the purposes of the program established under this
section, the Secretary may accept money, funds, property, and services of every
kind by gift, devise, bequest, grant, or otherwise, and may, in any manner,
dispose of all such holdings and use the receipts generated from such
disposition as general program funds under this section. All funds so
designated for the program established under this section shall remain
available until expended.</text>
</subsection></section></subtitle><subtitle id="H5995882AB4FD49569386B677971C71DC"><enum>G</enum><header>Energy</header>
<section id="HFA9CDD04DA2E4BEF95C8395F43185FCA"><enum>471.</enum><header>Procurement of
biobased products</header><text display-inline="no-display-inline">Section 9002
of the Farm Security and Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/8102">7 U.S.C. 8102</external-xref>) is
amended—</text>
<paragraph id="H57DBD68DFC5B40C4A79372D73779A2CF"><enum>(1)</enum><text>by redesignating

Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/8106">7 U.S.C. 8106</external-xref>) is amended by adding at the end the

research and development</header>
<subsection id="H78DF37069D8D42B784247057AEEF64A1"><enum>(a)</enum><header>Enhanced
coordination</header><text>Section 304 of the Biomass Research and Development
Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/7/8603">7 U.S.C. 8603</external-xref>) is amended by adding at the end the

effort</header><text>Section 1240B(a)(1) of the Food Security Act of 1985 (16
U.S.C. 3839aa–2(a)(1)) is amended by adding at the end the following:
<quote>The Secretary shall work with the heads of all appropriate departmental
agencies and organizations to develop a coordinated effort, using an integrated
team approach, to provide farmers and ranchers state-of-the-art research,
information, technical assistance, education, extension, and access to
resources to implement eligible practices under this chapter.</quote>.</text>
</subsection></section><section id="H08C7D6EDCF0A45A186FD3C21D8D6C59F"><enum>479.</enum><header>Conservation
technical assistance and education by extension service</header>
<subsection id="HABD049A9D26147E4B9BBC91AD93B2F0"><enum>(a)</enum><header>In
general</header><text>Section 1242 of the Food Security Act of 1985 (16 U.S.C.
3842) is amended by adding at the end the following new paragraph:</text>

<paragraph id="HFB3CF1F1DDF14DA0B8CEE565A700A8C9"><enum>(5)</enum><header>Cooperative
extension service</header>
<subparagraph id="H07B49562DD0C477F9C58C900B3054029"><enum>(A)</enum><header>Technical
service provider</header><text>The Cooperative Extension Service in each State,
and the appropriate officials and employees thereof, shall be eligible to
provide technical assistance to carry out programs under this title, to become
approved providers of technical assistance, and to provide other necessary
educational activities and materials regarding the programs under this title
and appropriate related matters to producers, eligible participants, and other
persons.</text>
</subparagraph><subparagraph id="H22B904DA5FF44F4C9116CB12332BFA6"><enum>(B)</enum><header>Reimbursement</header><text>The
Secretary shall pay to the Cooperative Extension Service in each State to
compensate for the conservation technical assistance and related education
provided under this paragraph. Such payments for technical assistance and
education may be made from</text>
<clause id="H538D722421D744739D186E03155DBCC9"><enum>(i)</enum><text>funds available
for technical assistance under section 1241(b);</text>
</clause><clause id="HCFBC3F8E88C944E8B3CAA356BF44BB5"><enum>(ii)</enum><text>funds made
available to the Natural Resource Conservation Service; and</text>
</clause><clause id="H66BBCC76388B43589BB3FD98889FE747"><enum>(iii)</enum><text>such other funds
that may be appropriated or otherwise made available to the Secretary for
technical assistance or education regarding the programs in this title, or
related or similar
programs.</text>
</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
</subsection><subsection id="H38DB24EFCE194CBEA9DB2688F2EFD96"><enum>(b)</enum><header>Conforming
amendment</header><text>Section 1241(b) of the Food Security Act of 1985 (16
U.S.C. 3841) is amended by adding at the end thereof the following
sentence:</text>

<text display-inline="no-display-inline">For the purposes of this section and section
1242, technical assistance shall include the necessary education regarding the
programs under this title, and appropriate related matters, as provided under

</subsection></section><section id="HF4F5A2FD45854184B15E00C8B7BAFA00"><enum>480.</enum><header>Asssessment and
reform of conservation programs</header>
<subsection id="HEA711100BFBA4E830050D98897002614"><enum>(a)</enum><header>In
general</header><text>The Secretary of Agriculture (hereafter referred to as
the <quote>Secretary</quote>) shall develop a plan to coordinate land
retirement, forestry, and agricultural working land conservation programs that
are administered by the Secretary by integrating the activities of departmental
agencies to achieve the goals of—</text>
<paragraph id="H8095921BA788422D9F00F2847629500"><enum>(1)</enum><text>eliminating
redundancy;</text>
</paragraph><paragraph id="HBE12DB999CBE483585C9FDA14F6B6FD6"><enum>(2)</enum><text>streamlining
program delivery; and</text>
</paragraph><paragraph id="HB7B14CC267864E96804C732F3B5B7F02"><enum>(3)</enum><text>improving services
provided to agricultural producers, including the provision of science-based
technical assistance through integrated interagency programs of research,
education, and extension.</text>
</paragraph></subsection><subsection id="H3FD46485BDC84CFFBE927901B9D59C2E"><enum>(b)</enum><header>Consultation</header><text>The
Secretary shall consult with the Under Secretaries in the Department of
Agriculture to develop a plan of strategic research, education, and extension
programs to ensure that the goals outlined by the programs described in
subsection (a) can be achieved in an integrated and highly focused manner that
includes determination of national priorities, cost sharing, and collaborative
management. The Under Secretaries shall ensure that the Department’s
programmatic resources and partnerships available within their areas of
responsibility are involved in the development and implementation of the
strategic plan.</text>
</subsection><subsection id="H7E247F9A24514A6AAA94929681DBE7C0"><enum>(c)</enum><header>Report</header><text>Not
later than September 30, 2008, the Secretary shall submit to the Committee on
Agriculture of the House of Representatives and the Committee on Agriculture,
Nutrition, and Forestry of the Senate, a report that describes—</text>
<paragraph id="H1BD949713C6047DAAE9CBBB5684D81C0"><enum>(1)</enum><text>the plans
developed under subsections (a) and (b); and</text>
</paragraph><paragraph id="HBB4CDFCEFA2B4821B6C9A9FA0087EB"><enum>(2)</enum><text>the
means by which the Secretary intends to achieve the goals described in
subsections (a) and (b).</text>
