<official-title display="yes">To require the Secretary of the Treasury to mint and issue coins in commemoration of Native Americans and the important contributions made by Indian tribes and individual Native Americans to the development of the United States and the history of the United States, and for other purposes.</official-title>

<section display-inline="no-display-inline" id="HB2266399D171481192ECCD7DB173DA90" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Native American $1 Coin Act</short-title></quote>.</text> </section>
<section id="HCFF69067605A4D38AD93CBD0AE4C0000"><enum>2.</enum><header>Native American $1 coin program</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/31/5112">Section 5112</external-xref> of title 31, United States Code, is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="HECC0F4E321A5481BB079178B41CD528" style="OLC"> 
<subsection id="HF7C35A6C4FD04F6AA62C979735018FC8"><enum>(r)</enum><header>Redesign and issuance of circulating $1 coins honoring Native Americans and the important contributions made by Indian tribes and individual Native Americans in United States history</header> 
<paragraph commented="no" id="H02653C3B12024F4C81B08D12F4791917"><enum>(1)</enum><header>Redesign beginning in 2008</header> 
<subparagraph id="H3C82533055724F15BDAC5B602DFB2185"><enum>(A)</enum><header>In general</header><text>Effective beginning January 1, 2008, notwithstanding subsection (d), in addition to the coins to be issued pursuant to subsection (n), and in accordance with this subsection, the Secretary shall mint and issue $1 coins that—</text> 
<clause id="H282FACD21E01429290DF7EE084B7401E"><enum>(i)</enum><text>have as the designs on the obverse the so-called <quote>Sakakawea design</quote>; and</text> </clause>
<clause id="HAB6FA9B8369E4A5786DC665382FC9D9D"><enum>(ii)</enum><text>have a design on the reverse selected in accordance with paragraph (2)(A), subject to paragraph (3)(A).</text> </clause></subparagraph>
<subparagraph id="HC8565F2F3404443582976300D50017C7"><enum>(B)</enum><header>Delayed date</header><text display-inline="yes-display-inline">If the date of the enactment of the Native American $1 Coin Act is after July 31, 2007, subparagraph (A) shall be applied by substituting <quote>2009</quote> for <quote>2008</quote>.</text> </subparagraph></paragraph>
<paragraph id="HD844FEEC14454674816109B151000819"><enum>(2)</enum><header>Design requirements</header><text>The $1 coins issued in accordance with paragraph (1) shall meet the following design requirements:</text> 
<subparagraph id="H3307CFF441084128B2E8A7DA1075706F"><enum>(A)</enum><header>Coin reverse</header><text>The design on the reverse shall bear—</text> 
<clause id="H4D50674CC84A4D72AE695BAA5218A894"><enum>(i)</enum><text>images celebrating the important contributions made by Indian tribes and individual Native Americans to the development of the United States and the history of the United States;</text> </clause>
<clause id="H7748C03DB8924BC7B9107333DC5A8D0"><enum>(ii)</enum><text>the inscription <quote>$1</quote> ; and</text> </clause>
<clause id="H949D847CE27842F0A2DA5961FFE82C19"><enum>(iii)</enum><text>the inscription <quote>United States of America</quote>.</text> </clause></subparagraph>
<subparagraph id="HB8389793561B4B6C9F10F1BC41E5324"><enum>(B)</enum><header>Coin obverse</header><text display-inline="yes-display-inline">The design on the obverse shall—</text> 
<clause id="H6BE9044F6C0F4E869481804264225482"><enum>(i)</enum><text display-inline="yes-display-inline">be chosen by the Secretary, after consultation with the Commission of Fine Arts and review by the Citizens Coinage Advisory Committee; and</text> </clause>
<clause id="H26C877EC45C842898B928749ACB6BD8"><enum>(ii)</enum><text display-inline="yes-display-inline">contain the so-called <quote>Sakakawea design</quote> and the inscription <quote>Liberty</quote>.</text> </clause></subparagraph>
<subparagraph id="HA88BE33D374B486585DA6323F4A4E17E"><enum>(C)</enum><header>Edge-incused inscriptions</header> 
<clause id="H08C97F90E0154F459F00E200F7FF2E83"><enum>(i)</enum><header>In general</header><text>The inscription of the year of minting and issuance of the coin and the inscriptions <quote>E Pluribus Unum</quote> and <quote>In God We Trust</quote> shall be edge-incused into the coin.</text> </clause>
<clause id="HAE997F35C9134B599C9C4357FA022F54"><enum>(ii)</enum><header>Preservation of distinctive edge</header><text>The edge-incusing of the inscriptions under clause (i) on coins issued under this subsection shall be done in a manner that preserves the distinctive edge of the coin so that the denomination of the coin is readily discernible, including by individuals who are blind or visually impaired.</text> </clause></subparagraph>
<subparagraph id="H572694D2FB424E1FA09DCE24AD8C8619"><enum>(D)</enum><header>Reverse design selection</header><text>The designs selected for the reverse of the coins described under this subsection—</text> 
<clause id="H0F1AB31CCF8344ABB5B8780000522054"><enum>(i)</enum><text display-inline="yes-display-inline">shall be chosen by the Secretary after consultation with the Committee on Indian Affairs of the Senate, the Congressional Native American Caucus of the House of Representatives, the Commission of Fine Arts, and the National Congress of American Indians;</text> </clause>
<clause display-inline="no-display-inline" id="HABEBB2DE35104656AD06348CBECF1DD7"><enum>(ii)</enum><text>shall be reviewed by the Citizens Coinage Advisory Committee;</text> </clause>
<clause id="H052E498F94D2491087E7F30132C1BDD"><enum>(iii)</enum><text>may depict individuals and events such as—</text> 
<subclause id="H0F4456CBB83F4BB5A3F07FDCCD779564"><enum>(I)</enum><text>the creation of Cherokee written language;</text> </subclause>
<subclause id="HDB637F65DB454387870067AACA84FDA8"><enum>(II)</enum><text>the Iroquois Confederacy;</text> </subclause>
<subclause id="H99DE367421164743844F012C40745DC1"><enum>(III)</enum><text>Wampanoag Chief Massasoit;</text> </subclause>
<subclause id="H6FA5FE0E7CAD424E82FF85B72F21372E"><enum>(IV)</enum><text>the <quote>Pueblo Revolt</quote>;</text> </subclause>
<subclause id="H257355CA845C409AB2B5F7DE27FE9FF2"><enum>(V)</enum><text>Olympian Jim Thorpe;</text> </subclause>
<subclause id="H1F60F69EF59A49FDB1E72702936EC64"><enum>(VI)</enum><text>Ely S. Parker, a general on the staff of General Ulysses S. Grant and later head of the Bureau of Indian Affairs; and</text> </subclause>
<subclause id="H69564FD75BD2484EA0B4D9F4BAA095A3"><enum>(VII)</enum><text>code talkers who served the United States Armed Forces during World War I and World War II; and</text> </subclause></clause>
<clause id="H48293F6F280545B9BACF00B42E93DDA8"><enum>(iv)</enum><text>in the case of a design depicting the contribution of an individual Native American to the development of the United States and the history of the United States, shall not depict the individual in a size such that the coin could be considered to be a <quote>2-headed</quote> coin.</text> </clause></subparagraph></paragraph>
<paragraph id="HD9A6AD9FB0A84543B800DFB8AC00BABA"><enum>(3)</enum><header>Issuance of coins commemorating 1 Native American event during each year</header> 
<subparagraph id="H1BCBE54CEDF04633872BFFACE6331F00"><enum>(A)</enum><header>In general</header><text>Each design for the reverse of the $1 coins issued during each year shall be emblematic of 1 important Native American or Native American contribution each year.</text> </subparagraph>
<subparagraph id="H51D80B8326614D4EB7CCAB95A9209E19"><enum>(B)</enum><header>Issuance period</header><text display-inline="yes-display-inline">Each $1 coin minted with a design on the reverse in accordance with this subsection for any year shall be issued during the 1-year period beginning on January 1 of that year and shall be available throughout the entire 1-year period.</text> </subparagraph>
<subparagraph id="H177AC32F9B954F69BAC92D7110E68218"><enum>(C)</enum><header>Order of issuance of designs</header><text display-inline="yes-display-inline">Each coin issued under this subsection commemorating Native Americans and their contributions—</text> 
<clause id="HCB8108C7AA7D4338006E7091BABE00F"><enum>(i)</enum><text display-inline="yes-display-inline">shall be issued, to the maximum extent practicable, in the chronological order in which the Native Americans lived or the events occurred, until the termination of the coin program described in subsection (n); and</text> </clause>
<clause id="H029ECBD60E2647608BEB55FBD399A05C"><enum>(ii)</enum><text display-inline="yes-display-inline">thereafter shall be issued in any order determined to be appropriate by the Secretary, after consultation with the Committee on Indian Affairs of the Senate, the Congressional Native American Caucus of the House of Representatives, and the National Congress of American Indians.</text> </clause></subparagraph></paragraph>
<paragraph id="H9A4C4B5958CD43F9B726B958CF300B6"><enum>(4)</enum><header>Issuance of numismatic coins</header><text>The Secretary may mint and issue such number of $1 coins of each design selected under this subsection in uncirculated and proof qualities as the Secretary determines to be appropriate.</text> </paragraph>
<paragraph id="H883538919A6B4E4BBC2CFFC4CDDFD2DC"><enum>(5)</enum><header>Quantity</header><text display-inline="yes-display-inline">The number of $1 coins minted and issued in a year with the Sakakawea-design on the obverse shall be not less than 20 percent of the total number of $1 coins minted and issued in such year.</text> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section>
<section id="H08F6CFCEB91C4E98A8A4CAA300A38DE6"><enum>3.</enum><header>Technical and conforming amendments</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/31/5112">Section 5112</external-xref> of title 31, United States Code, is amended—</text> 
<paragraph id="H771822F542E14846B634D1A465DD3BD"><enum>(1)</enum><text>in subsection (n)(1)—</text> 
<subparagraph id="H026F0D38DDEF4DEEAC59CF93CBBEACE"><enum>(A)</enum><text>by striking the paragraph designation and heading and all that follows through <quote>Notwithstanding subsection (d)</quote> and inserting the following:</text> 
<quoted-block display-inline="no-display-inline" id="H34CF4A8F289942C4ADED672819C6EB24" style="OLC"> 
<paragraph id="HEEC38DE8C1A54D59B8E51CBAF27824EF"><enum>(1)</enum><header>Redesign beginning in 2007</header><text>Notwithstanding subsection (d)</text> </paragraph><after-quoted-block>;</after-quoted-block></quoted-block> </subparagraph>
<subparagraph id="HDB7114C94BF947E286CEEBFF4B6DA1E0"><enum>(B)</enum><text>by striking subparagraph (B); and</text> </subparagraph>
<subparagraph id="H5CFA7E6738664660A0AB9C82074FF837"><enum>(C)</enum><text>by redesignating clauses (i) and (ii) as subparagraphs (A) and (B), respectively, and indenting the subparagraphs appropriately;</text> </subparagraph></paragraph>
<paragraph id="H812395025F7440CEB42EF9FF6524BA79"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (n), by striking <quote>Sacagawea-design</quote> each place such term appears and inserting <quote>Sakakawea-design</quote>; and</text> </paragraph>
<paragraph id="HEB51639196994C079C32BDBE0234FCAE"><enum>(3)</enum><text display-inline="yes-display-inline">in paragraphs (3)(C) and (5) of subsection (p), by striking <quote>Sacagawea-design</quote> each place such term appears and inserting <quote>Sakakawea-design</quote>.</text> </paragraph></section>
<section id="H416A4A9CCA95462AAB6E95006379D72C"><enum>4.</enum><header>Removal of barriers to circulation of $1 coin</header> 
<subsection display-inline="no-display-inline" id="H4B25836691C44148A116A31694454BD1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In order to remove barriers to circulation, the Secretary of the Treasury shall carry out an aggressive, cost-effective, continuing campaign to encourage commercial enterprises to accept and dispense $1 coins that have as designs on the obverse the so-called <quote>Sakakawea design</quote>.</text> </subsection>
<subsection id="H3241A643A2DB4BEDB2BE370068F46838"><enum>(b)</enum><header>Report</header><text>The Secretary of the Treasury shall submit to Congress an annual report on the success of the efforts described in subsection (a).</text> </subsection></section>
