		<official-title>To amend title 18, United States Code, to better assure
		  cyber-security, and for other purposes.</official-title>

		<section id="H9EF4C1FA6A68446A80C5C178975EAAB7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Cyber-Security Enhancement Act of
			 2007</short-title></quote>.</text>
		</section><section id="H7C4D806B21AA40398058FFAE9CCF12C2" section-type="subsequent-section"><enum>2.</enum><header>Personal electronic
			 records</header><text display-inline="no-display-inline">Section 1030(a)(2) of
			 title 18, United States Code, is amended—</text>
			<paragraph id="H1DC3E47812D24ED080B34BC581F5D239"><enum>(1)</enum><text>by striking
			 <quote>or</quote> at the end of subparagraph (B); and</text>
			</paragraph><paragraph id="HFCD87598A10D43F196C53093B86E8663"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block id="H4873E861B5BB482E91C7582F2768E920" style="OLC">
					<subparagraph id="HF40A60F6A18349B1961B624C716E7872"><enum>(D)</enum><text display-inline="yes-display-inline">a unique electronic identification number,
				address or routing code, or access device (as defined in section 1029(e)(1)),
				from a protected computer; or</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HE3BA281B170849029238B5236C1E3D8B"><enum>3.</enum><header>Use of full
			 Interstate and foreign commerce power for criminal penalties</header>
			<subsection id="H9D10D586040149E78EC858E72082B6CC"><enum>(a)</enum><header>Broadening of
			 Scope</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/1030">Section 1030(e)(2)(B)</external-xref> of title 18, United States Code, is
			 amended by inserting <quote>or affecting</quote> after <quote>which is used
			 in</quote>.</text>
			</subsection><subsection id="H5490F2FB3B7F444BA4B9C24911315A7"><enum>(b)</enum><header>Elimination of
			 Requirement of an Interstate or Foreign Communication for Certain Offenses
			 Involving Protected Computers</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/1030">Section 1030(a)(2)(C)</external-xref> of title 18,
			 United States Code, is amended by striking <quote>if the conduct involved an
			 interstate or foreign communication</quote>.</text>
			</subsection></section><section id="H0012F9019CD44FFF98BC1F221367C080"><enum>4.</enum><header>Rico
			 predicates</header><text display-inline="no-display-inline">Section 1961(1)(B)
			 of title 18, United States Code, is amended by inserting <quote>section 1030
			 (relating to fraud and related activity in connection with computers),</quote>
			 before <quote>section 1084</quote>.</text>
		</section><section id="H46E2718C34794D54B0A500A8EFD32DA8"><enum>5.</enum><header>Cyber-extortion</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/1030">Section 1030(a)(7)</external-xref> of title 18, United
			 States Code, is amended by inserting <quote>, or to access without
			 authorization or exceed authorized access to a protected computer</quote> after
			 <quote>cause damage to a protected computer</quote>.</text>
		</section><section id="H8E726A74270B4BEFA1DECDEB59E804"><enum>6.</enum><header>Conspiracy to
			 commit cyber-crimes</header><text display-inline="no-display-inline">Section
			 1030(b) of title 18, United States Code, is amended by inserting <quote>or
			 conspires</quote> after <quote>attempts</quote>.</text>
		</section><section id="HE451C0775B6F46258223527187DC4DC5"><enum>7.</enum><header>Penalties for
			 section 1030 violations</header><text display-inline="no-display-inline">Subsection (c) of <external-xref legal-doc="usc" parsable-cite="usc/18/1030">section 1030</external-xref> of title 18,
			 United States Code, is amended to read as follows:</text>
			<quoted-block id="H719E2135A7AD4E9C805D044C86C993FE" style="OLC">
				<subsection id="HAC33B987D227410E9E90D6790503C4BF"><enum>(c)</enum><text>The court, in
				imposing sentence for an offense under subsection (a) or (b), shall, in
				addition to any other sentence imposed and irrespective of any provision of
				State law, order that the person forfeit to the United States—</text>
					<paragraph id="HC4F5031355F94295B5E9F836DF8B7C93"><enum>(1)</enum><text>the person’s
				interest in any personal property that was used or intended to be used to
				commit or to facilitate the commission of such violation; and</text>
					</paragraph><paragraph id="HCCC122A970A94C3BB022B5B2D5EEDBD0"><enum>(2)</enum><text>any property, real
				or personal, constituting or derived from, any proceeds the person obtained,
				directly or indirectly, as a result of such
				violation.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HE699200814774850BC00D3EB8B58C84"><enum>8.</enum><header>Directive to
			 Sentencing Commission</header>
			<subsection id="H8DC3E87379C944DA95CEDF51F8288C7"><enum>(a)</enum><header>Directive</header><text>Pursuant
			 to its authority under <external-xref legal-doc="usc" parsable-cite="usc/28/994">section 994(p)</external-xref> of title 28, United States Code, and in
			 accordance with this section, the United States Sentencing Commission shall
			 forthwith review its guidelines and policy statements applicable to persons
			 convicted of offenses under sections 1028, 1028A, 1030, 1030A, 2511 and 2701 of
			 title 18, United States Code and any other relevant provisions of law, in order
			 to reflect the intent of Congress that such penalties be increased in
			 comparison to those currently provided by such guidelines and policy
			 statements.</text>
			</subsection><subsection id="HC24E91408E8848D8A17DF94802389720"><enum>(b)</enum><header>Requirements</header><text>In
			 determining its guidelines and policy statements on the appropriate sentence
			 for the crimes enumerated in paragraph (a), the Commission shall consider the
			 extent to which the guidelines and policy statements may or may not account for
			 the following factors in order to create an effective deterrent to computer
			 crime and the theft or misuse of personally identifiable data—</text>
				<paragraph id="HB3CA7F5A68DD435493D37BFA489F2370"><enum>(1)</enum><text>the level of
			 sophistication and planning involved in such offense;</text>
				</paragraph><paragraph id="HC7BD33D77245480D9D9D7E35D6505500"><enum>(2)</enum><text>whether such
			 offense was committed for purpose of commercial advantage or private financial
			 benefit;</text>
				</paragraph><paragraph id="HA6C851A326944EF8BBED658DFBDC969"><enum>(3)</enum><text>the potential and
			 actual loss resulting from the offense;</text>
				</paragraph><paragraph id="H6FC49FE801EB47469C2E76C200B57078"><enum>(4)</enum><text>whether the
			 defendant acted with intent to cause either physical or property harm in
			 committing the offense;</text>
				</paragraph><paragraph id="H628B9BFB513C498489E6DE35E588F900"><enum>(5)</enum><text>the extent to
			 which the offense violated the privacy rights of individuals;</text>
				</paragraph><paragraph id="H6D31F90724CD4B3DAF571FB9257A207"><enum>(6)</enum><text>the effect of the
			 offense upon the operations of a government agency of the United States, or of
			 a State or local government;</text>
				</paragraph><paragraph id="H789C516486E24E849829FEB39F76217"><enum>(7)</enum><text>whether the offense
			 involved a computer used by the government in furtherance of national defense,
			 national security or the administration of justice;</text>
				</paragraph><paragraph id="H919D13D485554E888BBC877F1D73177E"><enum>(8)</enum><text>whether the
			 offense was intended to, or had the effect of significantly interfering with or
			 disrupting a critical infrastructure;</text>
				</paragraph><paragraph id="HA0F43952BE354945B98D67F98885A742"><enum>(9)</enum><text>whether the
			 offense was intended to, or had the effect of creating a threat to public
			 health or safety, injury to any person, or death; and</text>
				</paragraph><paragraph id="HFB7A5360C60D4CBFA260008500A38B45"><enum>(10)</enum><text>whether the
			 defendant purposefully involved a juvenile in the commission of the offense to
			 avoid punishment.</text>
				</paragraph></subsection><subsection id="HD7BBD23549A54BA4A98C696686271122"><enum>(c)</enum><header>Additional
			 Requirements</header><text>In carrying out this section, the Commission
			 shall—</text>
				<paragraph id="HCBE6ADAFCBAC439895C906BB2E60BEA7"><enum>(1)</enum><text>assure reasonable
			 consistency with other relevant directives and with other sentencing
			 guidelines;</text>
				</paragraph><paragraph id="H2967086D1ADB485DAEB2B00473F90011"><enum>(2)</enum><text>account for any
			 additional aggravating or mitigating circumstances that might justify
			 exceptions to the generally applicable sentencing ranges;</text>
				</paragraph><paragraph id="H24E000AE84C44C25B16BB550C6C6EBAD"><enum>(3)</enum><text>make any
			 conforming changes to the sentencing guidelines; and</text>
				</paragraph><paragraph id="H65243478EBB74F76A39D78C53DBD0616"><enum>(4)</enum><text>assure that the
			 guidelines adequately meet the purposes of sentencing as set forth in section
			 3553(a)(2) of title 18, United States Code.</text>
				</paragraph></subsection></section><section id="H90E06DB7381A4A2D9768E57311DC3C13"><enum>9.</enum><header>Damage to
			 protected computers</header>
			<subsection id="H54BB0AA028824679B87704481E40C8E7"><enum>(a)</enum><text>Section
			 1030(a)(5)(B) of title 18, United States Code, is amended—</text>
				<paragraph id="H9990C1D9DC55402F85AFDF77F88F2F"><enum>(1)</enum><text>by
			 striking <quote>or</quote> at the end of clause (iv);</text>
				</paragraph><paragraph id="H9393AE05A5E24E51A5286E2DF2D1DD6"><enum>(2)</enum><text>by
			 inserting <quote>or</quote> at the end of clause (v); and</text>
				</paragraph><paragraph id="HD2E40CD613D842D2BEA748DF00D10588"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block id="H70980C7E8A694956BEFA3E9300E4C84" style="OLC">
						<clause id="HB21A429876E24A579DBD70EBD4EB3107"><enum>(vi)</enum><text>damage affecting
				ten or more protected computers during any 1-year
				period.</text>
						</clause><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H889D28CF48EA41AF9DDA044D00DA65E7"><enum>(b)</enum><text>Section
			 2332b(g)(5)(B)(i) of title 18, United States Code, is amended by striking
			 <quote>(v) (relating to protection of computers)</quote> and inserting
			 <quote>(vi) (relating to the protection of computers)</quote>.</text>
			</subsection></section><section id="H3668C8CD77144340946FF8AC142D00C1"><enum>10.</enum><header>Additional
			 funding for resources to investigate and prosecute criminal activity involving
			 computers</header>
			<subsection id="H3B35B1D3D51346FC81C749DA4337B"><enum>(a)</enum><header>Additional Funding
			 for Resources</header>
				<paragraph id="H2EDFF109070D462F9B21ABF45E492BB5"><enum>(1)</enum><header>Authorization</header><text>In
			 addition to amounts otherwise authorized for resources to investigate and
			 prosecute criminal activity involving computers, there are authorized to be
			 appropriated for each of the fiscal years 2007 through 2011—</text>
					<subparagraph id="H5EA4552542BA41B781A67CA0B85D00B7"><enum>(A)</enum><text>$10,000,000 to the
			 Director of the United States Secret Service;</text>
					</subparagraph><subparagraph id="HCBBA98AC714A482DABC99C2E258BE4C4"><enum>(B)</enum><text>$10,000,000 to the
			 Attorney General for the Criminal Division of the Department of Justice;
			 and</text>
					</subparagraph><subparagraph id="HE344B4F985104D6D88141EA72443F640"><enum>(C)</enum><text>$10,000,000 to the
			 Director of the Federal Bureau of Investigation.</text>
					</subparagraph></paragraph><paragraph id="HB046DC565DBF430EA6EACB197E9179F3"><enum>(2)</enum><header>Availability</header><text>Any
			 amounts appropriated under paragraph (1) shall remain available until
			 expended.</text>
				</paragraph></subsection><subsection id="H4C78FF6A8B134CCD9ED0351CC2106FF1"><enum>(b)</enum><header>Use of
			 Additional Funding</header><text>Funds made available under subsection (a)
			 shall be used by the Director of the United States Secret Service, the Director
			 of the Federal Bureau of Investigation, and the Attorney General, for the
			 United States Secret Service, the Federal Bureau of Investigation, and the
			 criminal division of the Department of Justice, respectively, to—</text>
				<paragraph id="H78783E8AC91E41A9A4B1A0C0BEE6657B"><enum>(1)</enum><text>hire and train law
			 enforcement officers to—</text>
					<subparagraph id="H82FB5B12DB0E4D0C81F848B9A8E07022"><enum>(A)</enum><text>investigate crimes
			 committed through the use of computers and other information technology,
			 including through the use of the Internet; and</text>
					</subparagraph><subparagraph id="H02525F017F6F48D1847758AD935B8F95"><enum>(B)</enum><text>assist in the
			 prosecution of such crimes; and</text>
					</subparagraph></paragraph><paragraph id="HE3C2AEC89C774743966CEE3B0C2A96B"><enum>(2)</enum><text>procure advanced
			 tools of forensic science to investigate, prosecute, and study such
			 crimes.</text>
				</paragraph></subsection></section></legis-body>
