		<section id="HF412BC7E84B744458EF171EF60948366" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Spaceport Equality Act of
			 2007</short-title></quote>.</text>
		</section><section id="HA99123B3322146D484B77C9B3FE85335"><enum>2.</enum><header>Spaceports
			 treated like airports under exempt facility bond rules</header>
			<subsection id="H5E8C84A350314D749EA5075CCFA32326"><enum>(a)</enum><header>In
			 General</header><text>Paragraph (1) of section 142(a) of the Internal Revenue
			 Code of 1986 (relating to exempt facility bonds) is amended to read as
			 follows:</text>
				<quoted-block id="H86CB954FE68643768E51A5872F002D2C" style="OLC">
					<paragraph id="H585C25C20176433C92F1ABC218EE2108"><enum>(1)</enum><text>airports and
				spaceports,</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H7CF60488B0EA4C3FA9A1D8C7094EC4F"><enum>(b)</enum><header>Treatment of
			 Ground Leases</header><text>Paragraph (1) of section 142(b) of the Internal
			 Revenue Code of 1986 (relating to certain facilities must be governmentally
			 owned) is amended by adding at the end the following new subparagraph:</text>
				<quoted-block id="HBA41BABECE9C43C7AD97B6C4BB38602B" style="OLC">
					<subparagraph id="H40471EFE0D3243739985456522B93153"><enum>(C)</enum><header>Special rule for
				spaceport ground leases</header><text>For purposes of subparagraph (A),
				spaceport property which is located on land owned by the United States and
				which is used by a governmental unit pursuant to a lease (as defined in section
				168(h)(7)) from the United States shall be treated as owned by such unit
				if—</text>
						<clause id="H89FA3CF839BD4647984BE52F239E94D"><enum>(i)</enum><text>the
				lease term (within the meaning of section 168(i)(3)) is at least 15 years,
				and</text>
						</clause><clause id="HB7CF64DB968B4A64B4893126D66611D6"><enum>(ii)</enum><text>such unit would
				be treated as owning such property if such lease term were equal to the useful
				life of such
				property.</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H9290350C09E742EF00FCD9F296004E08"><enum>(c)</enum><header>Definition of
			 spaceport</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/142">Section 142</external-xref> of the Internal Revenue Code of 1986 is
			 amended by adding at the end the following new subsection:</text>
				<quoted-block id="H5B10DFB406BF4E9EAFDDC75ED071010" style="OLC">
					<subsection id="H2FDD027CDCC04AA79779E5622F6B7585"><enum>(n)</enum><header>Spaceport</header>
						<paragraph id="HC52AD42C5BAC4314B831BEF959175899"><enum>(1)</enum><header>In
				general</header><text>For purposes of subsection (a)(1), the term
				<term>spaceport</term> means—</text>
							<subparagraph id="H10C092A3A94442D78149ADD647041C2C"><enum>(A)</enum><text>any facility
				directly related and essential to servicing spacecraft, enabling spacecraft to
				launch or reenter, or transferring passengers or space cargo to or from
				spacecraft, but only if such facility is located at, or in close proximity to,
				the launch site or reentry site, and</text>
							</subparagraph><subparagraph id="H3C954006DEF64440B631FA74E626B12"><enum>(B)</enum><text>any other
				functionally related and subordinate facility at or adjacent to the launch site
				or reentry site at which launch services or reentry services are provided,
				including a launch control center, repair shop, maintenance or overhaul
				facility, and rocket assembly facility.</text>
							</subparagraph></paragraph><paragraph id="H680AE2579BF24B41833FE8AE98ADC7BE"><enum>(2)</enum><header>Additional
				terms</header><text>For purposes of paragraph (1)—</text>
							<subparagraph id="H3F4AB8D461E149729D6D5F159F7F1381"><enum>(A)</enum><header>Space
				cargo</header><text>The term <term>space cargo</term> includes satellites,
				scientific experiments, other property transported into space, and any other
				type of payload, whether or not such property returns from space.</text>
							</subparagraph><subparagraph id="H534E21EB5F8241A68F73E577F66E98E4"><enum>(B)</enum><header>Spacecraft</header><text>The
				term <term>spacecraft</term> means a launch vehicle or a reentry
				vehicle.</text>
							</subparagraph><subparagraph id="HAA7D61FE815648B3B722DE9021B9420"><enum>(C)</enum><header>Other
				terms</header><text>The terms <term>launch</term>, <term>launch site</term>,
				<term>launch services</term>, <term>launch vehicle</term>,
				<term>payload</term>, <term>reenter</term>, <term>reentry services</term>,
				<term>reentry site</term>, and <term>reentry vehicle</term> shall have the
				respective meanings given to such terms by <external-xref legal-doc="usc" parsable-cite="usc/49/70102">section 70102</external-xref> of title 49, United
				States Code (as in effect on the date of enactment of this
				subsection).</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H7330DC3A4CDB4D27976B75AEBC1820E5"><enum>(d)</enum><header>Exception from
			 federally guaranteed bond prohibition</header><text>Paragraph (3) of section
			 149(b) of the Internal Revenue Code of 1986 (relating to exceptions) is amended
			 by adding at the end the following new subparagraph:</text>
				<quoted-block id="H36E2873DC9E948A5B2B7CEBD0240D3F4" style="OLC">
					<subparagraph id="H3029B55537A3417BA032031B22779461"><enum>(E)</enum><header>Exception for
				spaceports</header><text>Paragraph (1) shall not apply to any exempt facility
				bond issued as part of an issue described in paragraph (1) of section 142(a) to
				provide a spaceport in situations where—</text>
						<clause id="H6899FC3E9C464AC3AB9B0308CA9E1F1"><enum>(i)</enum><text>the
				guarantee of the United States (or an agency or instrumentality thereof) is the
				result of payment of rent, user fees, or other charges by the United States (or
				any agency or instrumentality thereof), and</text>
						</clause><clause id="H630F364F22E44ABFA882B09C0001D3E1"><enum>(ii)</enum><text>the payment of
				the rent, user fees, or other charges is for, and conditioned upon, the use of
				the spaceport by the United States (or any agency or instrumentality
				thereof).</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HCA286142EDBE4F9BB9F3D036093FF1F"><enum>(e)</enum><header>Conforming
			 Amendment</header><text>The heading for section 142(c) of the Internal Revenue
			 Code of 1986 is amended by inserting <quote>Spaceports,</quote> after
			 <quote>Airports,</quote>.</text>
			</subsection><subsection id="H4C6928F81ECA49A6A1B2B4266549A4BA"><enum>(f)</enum><header>Effective
			 Date</header><text>The amendments made by this section shall apply to
			 obligations issued after the date of the enactment of this Act.</text>
