		<official-title display="yes">To amend the Small Business Act to expand
		  and improve the assistance provided by Small Business Development Centers to
		  Indian tribe members, Alaska Natives, and Native Hawaiians.</official-title>

		<section display-inline="no-display-inline" id="HD6631E10B85E47EB88D55F81DD812BF" section-type="section-one"><enum>1.</enum><header>Findings and
			 purposes</header>
			<subsection id="H852B8D8F480B4661A40113804B8621D9"><enum>(a)</enum><header>Findings</header><text>Congress
			 finds the following:</text>
				<paragraph id="H9BF8245354F24BFE8E63BDBF928D0900"><enum>(1)</enum><text>The rate for
			 American Indians and Alaskan Natives living below 50 percent the poverty level
			 is 11.2 percent, nearly double the rate of the general population.</text>
				</paragraph><paragraph id="H259F1C6C68284C78BF9F432DAA259B60"><enum>(2)</enum><text>The unemployment
			 rate for American Indians and Alaskan Natives 16 years and over is 13.6
			 percent, nearly double the rate of the general population.</text>
				</paragraph><paragraph id="HAB6E33D4A40A4538B788365600335158"><enum>(3)</enum><text>Indian tribe
			 members and Alaska Natives own more than 201,000 businesses and generate more
			 than $26,000,000,000 in revenues. The construction industry accounted for 16
			 percent of these businesses and 22.5 percent of their total receipts. The next
			 largest was the service industry (13.2 percent and 3.4 percent, respectively).
			 The third largest was the health care and social assistance industry (12.1
			 percent and 4.6 percent, respectively).</text>
				</paragraph><paragraph id="H2E532692D4B94127998370D3CFA218C3"><enum>(4)</enum><text>The Small Business
			 Development Center program is cost effective. Clients receiving long-term
			 counseling under the program in 2005 generated additional tax revenues of
			 $248,000,000, nearly 2.8 times the cost of the program to the Federal
			 Government.</text>
				</paragraph><paragraph id="HCB43447B374648DEB575B368BC2DF84B"><enum>(5)</enum><text>Using the existing
			 infrastructure of the Small Business Development Center program, small
			 businesses owned by Indian tribe members, Alaska Natives, and Native Hawaiians
			 receiving services under the program will have a higher survival rate than the
			 average small business not receiving such services.</text>
				</paragraph><paragraph id="HB369CC2F5D494789868FD1BEF100D02E"><enum>(6)</enum><text>Business
			 counseling and technical assistance is critical on Indian lands where similar
			 services are scarce and expensive.</text>
				</paragraph><paragraph id="H27CA5C27320E450AA48784E915353F91"><enum>(7)</enum><text>Increased
			 assistance through counseling under the Small Business Development Center
			 program has been shown to reduce the default rate associated with lending
			 programs of the Small Business Administration.</text>
				</paragraph></subsection><subsection id="H57F77096EC334883A339696C96BFD4FD"><enum>(b)</enum><header>Purposes</header><text>The
			 purposes of this Act are as follows:</text>
				<paragraph id="HF3E9D1C7B20A42B6B0B528583B2E0044"><enum>(1)</enum><text>To stimulate
			 economies on Indian lands.</text>
				</paragraph><paragraph id="HC7A1E8FE64E34F9E9CC2D7F628E1A38F"><enum>(2)</enum><text>To foster economic
			 development on Indian lands.</text>
				</paragraph><paragraph id="H4951F792137546638C2C063D00F799C7"><enum>(3)</enum><text>To assist in the
			 creation of new small businesses owned by Indian tribe members, Alaska Natives,
			 and Native Hawaiians and expand existing ones.</text>
				</paragraph><paragraph id="H35BC353E4AF24BE19D7B28FD24D97592"><enum>(4)</enum><text>To provide
			 management, technical, and research assistance to small businesses owned by
			 Indian tribe members, Alaska Natives, and Native Hawaiians.</text>
				</paragraph><paragraph id="H8DD450C0D58D47DEA8A8BB25F52C1BA1"><enum>(5)</enum><text>To seek the advice
			 of local Tribal Councils on where small business development assistance is most
			 needed.</text>
				</paragraph><paragraph id="H239B8F101B7E4D3C9BE7262B385F946E"><enum>(6)</enum><text>To ensure that
			 Indian tribe members, Alaska Natives, and Native Hawaiians have full access to
			 existing business counseling and technical assistance available through the
			 Small Business Development Center program.</text>
				</paragraph></subsection></section><section id="HF98681CEBBB94476B0438BED3E5012B9"><enum>2.</enum><header>Small Business
			 Development Center assistance to Indian tribe members, Alaska Natives, and
			 Native Hawaiians</header>
			<subsection id="HEABF40124F784D30B6D9D6D3E805174B"><enum>(a)</enum><header>In
			 general</header><text>Section 21(a) of the <act-name parsable-cite="SBA">Small
			 Business Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/648">15 U.S.C. 648(a)</external-xref>) is amended by
			 adding at the end the following:</text>
				<quoted-block act-name="Small Business Act" id="H063954ED314D4F0E001EEAF9B2A89C9C">
					<paragraph id="H5DC06BBB3B8443F09FDD6D1CF0002CDB"><enum>(8)</enum><header>Additional grant
				to assist Indian tribe members, Alaska Natives, and Native Hawaiians</header>
						<subparagraph id="H77BE8FD4397A4067B879A9002F24EA00"><enum>(A)</enum><header>In
				general</header><text>Any applicant in an eligible State that is funded by the
				Administration as a Small Business Development Center may apply for an
				additional grant to be used solely to provide services described in subsection
				(c)(3) to assist with outreach, development, and enhancement on Indian lands of
				small business startups and expansions owned by Indian tribe members, Alaska
				Natives, and Native Hawaiians.</text>
						</subparagraph><subparagraph id="H803FA827AB3646E89BFE7C70D6DD81E"><enum>(B)</enum><header>Eligible
				States</header><text>For purposes of subparagraph (A), an eligible State is a
				State that has a combined population of Indian tribe members, Alaska Natives,
				and Native Hawaiians that comprises at least 1 percent of the State’s total
				population, as shown by the latest available census.</text>
						</subparagraph><subparagraph id="H9346FDFDA45B4F1CA9D139BCD0F6B3B1"><enum>(C)</enum><header>Grant
				applications</header><text>An applicant for a grant under subparagraph (A)
				shall submit to the Administration an application that is in such form as the
				Administration may require. The application shall include information regarding
				the applicant’s goals and objectives for the services to be provided using the
				grant, including—</text>
							<clause id="H68D234A15D074D22AFE3CCE0EFFCF0F"><enum>(i)</enum><text>the
				capability of the applicant to provide training and services to a
				representative number of Indian tribe members, Alaska Natives, and Native
				Hawaiians;</text>
							</clause><clause id="H3F63F1D1E22F4600877C689EFDB4017B"><enum>(ii)</enum><text>the location of
				the Small Business Development Center site proposed by the applicant;</text>
							</clause><clause id="HAACE25866E434651AFE6D719DF64C75B"><enum>(iii)</enum><text>the required
				amount of grant funding needed by the applicant to implement the program;
				and</text>
							</clause><clause id="H60E060B408CC4A4E8BBF0F3649C1133"><enum>(iv)</enum><text>the extent to
				which the applicant has consulted with local Tribal Councils.</text>
							</clause></subparagraph><subparagraph id="HE486E1084B7749C7B704A2287BD6E000"><enum>(D)</enum><header>Applicability of
				grant requirements</header><text>An applicant for a grant under subparagraph
				(A) shall comply with all of the requirements of this section, except that the
				matching funds requirements under paragraph (4)(A) shall not apply.</text>
						</subparagraph><subparagraph id="H44B34614EC77440094E5F75600E8136C"><enum>(E)</enum><header>Maximum amount
				of grants</header><text>No applicant may receive more than $300,000 in grants
				under this paragraph for one fiscal year.</text>
						</subparagraph><subparagraph id="HE575273DF00D479EB09F617B63A97E88"><enum>(F)</enum><header>Regulations</header><text>After
				providing notice and an opportunity for comment and after consulting with the
				Association recognized by the Administration pursuant to paragraph (3)(A) (but
				not later than 180 days after the date of enactment of this paragraph), the
				Administration shall issue final regulations to carry out this paragraph,
				including regulations that establish—</text>
							<clause id="H45F3ADC72D424989B8B9A79100F8B8A9"><enum>(i)</enum><text>standards relating
				to educational, technical, and support services to be provided by Small
				Business Development Centers receiving assistance under this paragraph;
				and</text>
							</clause><clause id="HBD80C4CBAB2548CB81894FF039A06CEB"><enum>(ii)</enum><text>standards
				relating to any work plan that the Administration may require a Small Business
				Development Center receiving assistance under this paragraph to develop.</text>
							</clause></subparagraph><subparagraph id="H0DEC20B5C9544F9400BDBE540520040"><enum>(G)</enum><header>Definitions</header><text>In
				this section, the following definitions apply:</text>
							<clause id="H99F3644E326D4CA687BF6F3591655221"><enum>(i)</enum><header>Indian
				lands</header><text>The term <term>Indian lands</term> has the meaning given
				the term <term>Indian country</term> in
				section
				1151 of title 18, United States Code, the meaning given the
				term <term>Indian reservation</term> in <external-xref legal-doc="usc" parsable-cite="usc/25/151">section 151.2</external-xref> of title 25, Code of
				Federal Regulations (as in effect on the date of enactment of this paragraph),
				and the meaning given the term <term>reservation</term> in section 4 of the
				Indian Child Welfare Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/25/1903">25 U.S.C. 1903</external-xref>).</text>
							</clause><clause id="H317B7FE74C9349CDB562502C4C84E72"><enum>(ii)</enum><header>Indian
				tribe</header><text>The term <term>Indian tribe</term> means any band, nation,
				or organized group or community of Indians located in the contiguous United
				States, and the Metlakatla Indian Community, whose members are recognized as
				eligible for the services provided to Indians by the Secretary of the Interior
				because of their status as Indians.</text>
							</clause><clause id="HCF82E96ACA9C4A45ABEFE939E640D0E9"><enum>(iii)</enum><header>Indian tribe
				member</header><text>The term <term>Indian tribe member</term> means a member
				of an Indian tribe (other than a Alaska Native).</text>
							</clause><clause id="HDE99654EF60941B29FAC1DAAE7C43208"><enum>(iv)</enum><header>Alaska
				Native</header><text>The term <term>Alaska Native</term> has the meaning given
				the term <term>Native</term> in section 3(b) of the Alaska Native Claims
				Settlement Act (43
				U.S.C. 1602(b)).</text>
							</clause><clause id="H68673AA40654414CA4E7A8385D9F23F8"><enum>(v)</enum><header>Native
				Hawaiian</header><text display-inline="yes-display-inline">The term
				<term>Native Hawaiian</term> means any individual who is—</text>
								<subclause id="H8C6F2773DD9048778C7FE6250DB4C09"><enum>(I)</enum><text>a citizen of the
				United States; and</text>
								</subclause><subclause id="HFDD6006C45FC483C8186E3542F81A22"><enum>(II)</enum><text>a descendant of
				the aboriginal people, who prior to 1778, occupied and exercised sovereignty in
				the area that now constitutes the State of Hawaii.</text>
								</subclause></clause><clause id="H79A8B8F402E140289461F6472B7DA8B7"><enum>(vi)</enum><header>Tribal
				organization</header><text display-inline="yes-display-inline">The term
				<quote>tribal organization</quote> has the meaning given that term in section
				4(l) of the Indian Self-Determination and Education Assistance Act (25 U.S.C.
				450b(l)).</text>
							</clause></subparagraph><subparagraph id="HA5FDA28130A54876A563C9EEB0026D6"><enum>(H)</enum><header>Authorization of
				appropriations</header><text>There is authorized to be appropriated to carry
				out this paragraph $7,000,000 for each of fiscal years 2008 through
				2010.</text>
						</subparagraph><subparagraph id="H97CC082DCD56479C00BFAEC11684DD87"><enum>(I)</enum><header>Funding
				limitations</header>
							<clause id="H690309EC16BB496C9B77CAB7569D8691"><enum>(i)</enum><header>Nonapplicability
				of certain limitations</header><text>Funding under this paragraph shall be in
				addition to the dollar program limitations specified in paragraph (4).</text>
							</clause><clause id="H13E7D8CBBFAA48FFBDA375006B805616"><enum>(ii)</enum><header>Limitation on
				use of funds</header><text>The Administration may carry out this paragraph only
				with amounts appropriated in advance specifically to carry out this
				paragraph.</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H229D30134FD745AF9715E2FE39BF4732"><enum>3.</enum><header>State
			 consultation with tribal organizations</header><text display-inline="no-display-inline">Section 21(c) of the
			 <act-name parsable-cite="SBA">Small Business Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/648">15 U.S.C. 648(c)</external-xref>) is
			 amended by adding at the end the following:</text>
			<quoted-block act-name="Small Business Act" id="HA6E7E8A0AA42481A9DA3F4B54274E82F">
				<paragraph id="HF9FFC04ED5BE4BECAA6036D610DB48C1"><enum>(9)</enum><header>Advice of local
				tribal organizations</header><text>A Small Business Development Center
				receiving a grant under this section shall request the advice of tribal
				organization on how best to provide assistance to Indian tribe members, Alaska
				Natives, and Native Hawaiians and where to locate satellite centers to provide
				such
				assistance.</text>
				</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
