<enum>I</enum><header>Science and Mathematics Scholarships and Education Improvement</header> <section id="H19DDD80A0766491C8EEFB82EB1737B76"><enum>101.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> <paragraph id="H059DE287FD3048A2BD6E9B309B080080"><enum>(1)</enum><text>The National Science Foundation has made significant and valuable contributions to the improvement of K–12 and undergraduate science, technology, engineering, and mathematics education throughout its 56 year history.</text> </paragraph> <paragraph id="HD7F46B53E35B4BA4B802B2A13CE7667E"><enum>(2)</enum><text>Under section 3 of the National Science Foundation Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/42/1862">42 U.S.C. 1862</external-xref>), the National Science Foundation is explicitly required to strengthen science, mathematics, and engineering research potential and education programs at all levels.</text> </paragraph></section> <section id="HC0230028F065451AA0C91DE936BDDCF"><enum>102.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text> <paragraph id="HF9D95CF213E2472588B8BD2F9940D24B"><enum>(1)</enum><text>The term <term>cost of attendance</term> has the meaning given that term in section 472 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087ll">20 U.S.C. 1087ll</external-xref>).</text> </paragraph> <paragraph id="HCF6B8A58B98F42ACA0A3618D229B0972"><enum>(2)</enum><text>The term <term>Director</term> means the Director of the National Science Foundation.</text> </paragraph> <paragraph id="H8F9B9C4C58804C14BA6766E1219193ED"><enum>(3)</enum><text>The term <term>institution of higher education</term> has the meaning given that term in section 101(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>).</text> </paragraph> <paragraph id="H9AFA239956EA47FD96846483247E02B0"><enum>(4)</enum><text>The term <term>mathematics and science teacher</term> means a mathematics, science, or technology teacher at the elementary school or secondary school level.</text> </paragraph></section> <subtitle id="HB57984E317C248BC81E05941291B3215"><enum>A</enum><header>Science Scholarships</header> <section id="H08B6FA3363A04C399D53009979A4499D"><enum>111.</enum><header>Short title</header><text display-inline="no-display-inline">This subtitle may be cited as the <quote>10,000 Teachers, 10 Million Minds Science and Math Scholarship Act</quote>.</text> </section> <section id="HA851C7AC07724FC684305876E0681C05"><enum>112.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> <paragraph id="H15AD83B2C97C4A2FAD02E17C1F856BD4"><enum>(1)</enum><text>The prosperity the United States enjoys today is due in no small part to investments the Nation has made in research and development over the past 50 years.</text> </paragraph> <paragraph id="HC93224F9F83742FB9E1807D4EA6C8066"><enum>(2)</enum><text>Corporate, government, and national scientific and technical leaders have raised concerns that current trends affecting the science and technology enterprise of the Nation could result in erosion of this past success and jeopardize future prosperity.</text> </paragraph> <paragraph id="H36C841198B3D406EA389D9669D5FC207"><enum>(3)</enum><text>The National Academy of Sciences, the National Academy of Engineering, and the Institute of Medicine were tasked in a congressional request to recommend actions that the Federal Government could take to enhance the science and technology enterprise so that the United States can successfully compete, prosper, and be secure in the global community of the 21st century.</text> </paragraph> <paragraph id="H7B71619216754E9CB7547EDFCDAA0500"><enum>(4)</enum><text>The Academies’ highest priority recommendation in its report, <quote>Rising Above the Gathering Storm: Energizing and Employing America for a Brighter Economic Future</quote>, is to improve K–12 mathematics and science education, and the Academies’ first recommended action item is to institute a major scholarship program to recruit and educate annually 10,000 mathematics and science teachers.</text> </paragraph></section> <section id="HEA79412FC36749BB986E25F7EA2C08D"><enum>113.</enum><header>Policy objective</header><text display-inline="no-display-inline">In carrying out the program under section 10 of the National Science Foundation Authorization Act of 2002, the National Science Foundation shall seek to increase by up to 10,000 per year the number of elementary and secondary mathematics and science teachers in the Nation’s schools having both exemplary subject knowledge and pedagogical skills.</text> </section> <section id="H5A729C4CCA8547AE961534190000B1B6"><enum>114.</enum><header>Robert Noyce Teacher Scholarship Program</header> <subsection id="HA83FD2E0C3EA4C36B8BC805B0351B2BC"><enum>(a)</enum><header>Program amendments</header><text display-inline="yes-display-inline">Section 10 of the National Science Foundation Authorization Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/1862n-1">42 U.S.C. 1862n–1</external-xref>) is amended—</text> <paragraph id="H52A97DCBF49F4C3FA266E22C5200A9E7"><enum>(1)</enum><text>by inserting <quote><header-in-text level="section" style="OLC">Teacher</header-in-text></quote> after <quote><header-in-text level="section" style="OLC">Noyce</header-in-text></quote> in the section heading;</text> </paragraph> <paragraph id="H073DD765FF8949378BF5DC1E00ED493"><enum>(2)</enum><text>in subsection (a)(1)—</text> <subparagraph id="H2C9D44813633493FBF5986CD17EEC0CA"><enum>(A)</enum><text>by striking <quote>to provide scholarships, stipends, and programming designed</quote>;</text> </subparagraph> <subparagraph id="H8E58136367EE4C82A400EBBAD0F75364"><enum>(B)</enum><text>by inserting <quote>and to provide scholarships and stipends to students participating in the program</quote> after <quote>science teachers</quote>; and</text> </subparagraph> <subparagraph id="HD706E17F42E144E6850719FD1E9D21A3"><enum>(C)</enum><text>by inserting <quote>Teacher</quote> after <quote>Noyce</quote>;</text> </subparagraph></paragraph> <paragraph id="H55BB7B18871844ACBE13E094E9B05CD3"><enum>(3)</enum><text>in subsection (a)(3)(A)—</text> <subparagraph id="H076C76331CFD491285B5D561FF323ED8"><enum>(A)</enum><text>by striking <quote>encourage top college juniors and seniors</quote> and inserting <quote>recruit and prepare undergraduate students</quote>; and</text> </subparagraph> <subparagraph id="HCBCF066B641D4DE3A6FCCC403CBC161C"><enum>(B)</enum><text>by inserting <quote>qualified as</quote> after <quote>to become</quote>;</text> </subparagraph></paragraph> <paragraph id="H2F67FD44548F4BFDAC12647F5E773549"><enum>(4)</enum><text>in subsection (a)(3)(A)(ii)—</text> <subparagraph id="H37B08451713D4179B43304F86F9F0027"><enum>(A)</enum><text>by striking <quote>programs to help scholarship recipients</quote> and inserting <quote>academic courses and early field teaching experiences designed to prepare students participating in the program</quote>;</text> </subparagraph> <subparagraph id="H4BEA38FE71984FD6A3ED4D1825AE1E13"><enum>(B)</enum><text>by striking <quote>programs that will result in</quote> and inserting <quote>such preparation as is necessary to meet requirements for</quote>; and</text> </subparagraph> <subparagraph id="H02BC5E4282334851BD7D9BE33892E47F"><enum>(C)</enum><text>by striking <quote>licensing; and</quote> and inserting <quote>licensing;</quote>;</text> </subparagraph></paragraph> <paragraph id="H8372DFBF08B8499E8DA7B369129D62E6"><enum>(5)</enum><text>in subsection (a)(3)(A)(iii)—</text> <subparagraph id="H20CBA937613546599598FD4443D797C9"><enum>(A)</enum><text>by striking <quote>scholarship recipients</quote> and inserting <quote>students participating in the program</quote>;</text> </subparagraph> <subparagraph id="H29DD3D62563343D7AC5CDBC00F67034"><enum>(B)</enum><text>by striking <quote>enable the recipients</quote> and inserting <quote>enable the students</quote>; and</text> </subparagraph> <subparagraph id="HB328A8CECA664FAFB100B1766104AF1"><enum>(C)</enum><text>by striking <quote>; or</quote> and inserting <quote>; and</quote>;</text> </subparagraph></paragraph> <paragraph id="HFD94F10557824734938BDC44A8515C90"><enum>(6)</enum><text>in subsection (a)(3)(A) by inserting at the end the following new clause:</text> <quoted-block id="HC238363553704E81A2CF868DFF7782B6" style="OLC"> <clause id="H84D7C8AA90A44778A77056EE3525D277"><enum>(iv)</enum><text>providing summer internships for freshman students participating in the program; or</text> </clause><after-quoted-block>;</after-quoted-block></quoted-block> </paragraph> <paragraph id="H2B294F9EA49D40A90031D1AEDF0108E4"><enum>(7)</enum><text>in subsection (a)(3)(B)—</text> <subparagraph id="HFD77E17451A448D7A6BEB1C500C2C075"><enum>(A)</enum><text>by striking <quote>encourage</quote> and inserting <quote>recruit and prepare</quote>; and</text> </subparagraph> <subparagraph id="H9105628CDDC84B77849CFC8DED87D150"><enum>(B)</enum><text>by inserting <quote>qualified as</quote> after <quote>to become</quote>;</text> </subparagraph></paragraph> <paragraph id="HADBF1855913346CD871E00B1DAF7D619"><enum>(8)</enum><text>by amending clause (ii) of subsection (a)(3)(B) to read as follows:</text> <quoted-block id="H71835B5F056747CB84CA28406BD300E0" style="OLC"> <clause id="H32057A7FBB1F4258A168F62720ECB75F"><enum>(ii)</enum><text>offering academic courses and field teaching experiences designed to prepare stipend recipients to teach in elementary schools and secondary schools, including such preparation as is necessary to meet requirements for teacher certification or licensing; and</text> </clause><after-quoted-block>;</after-quoted-block></quoted-block> </paragraph> <paragraph id="H5510B8E310E04B2B911D9CBF98F8D8D2"><enum>(9)</enum><text>in subsection (a) by inserting at the end the following new paragraph:</text> <quoted-block id="H93CC4895140E42D200E541903979C902" style="OLC"> <paragraph id="H46BBDFCAA03D4FF099B061FBC19854E1"><enum>(4)</enum><header>Eligibility requirement</header><text>To be eligible for an award under this section, an institution of higher education (or consortia of such institutions) shall ensure that specific faculty members and staff from the institution’s mathematics, science, or engineering departments and specific education faculty are designated to carry out the development and implementation of the program. An institution of higher education may also include teacher leaders to participate in developing the pedagogical content of the program and to supervise students participating in the program in their field teaching experiences. No institution of higher education shall be eligible for an award unless faculty from the institution’s mathematics, science, or engineering departments are active participants in the program.</text> </paragraph> <paragraph id="H505B29741A3D4BA689AAB1E5453771D"><enum>(5)</enum><header>Awards</header><text display-inline="yes-display-inline">In awarding grants under this section, the Director shall endeavor to ensure that the recipients are from a variety of types of institutions of higher education. In support of this goal, the Director shall broadly disseminate information about when and how to apply for grants under this section, including by conducting outreach to Historically Black Colleges and Universities that are part B institutions as defined in section 322(2) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1061">20 U.S.C. 1061(2)</external-xref>) and minority institutions (as defined in section 365(3) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1067k">20 U.S.C. 1067k(3)</external-xref>)).</text> </paragraph><after-quoted-block>;</after-quoted-block></quoted-block> </paragraph> <paragraph id="H31EB0263592F42D2A2954143A79CF941"><enum>(10)</enum><text>in subsection (b)(1)(A)—</text> <subparagraph id="H1DB18A67BFF34CE1A1B459D2A5144B6D"><enum>(A)</enum><text>by striking <quote>scholarship or stipend</quote>;</text> </subparagraph> <subparagraph id="HEA82A9BDA03945429C8D007FDF695033"><enum>(B)</enum><text>by inserting <quote>and summer internships</quote> after <quote>number of scholarships</quote>; and</text> </subparagraph> <subparagraph id="H7A64BC8536A7423B000043031E801EFB"><enum>(C)</enum><text>by inserting <quote>the type of activities proposed for the recruitment of students to the program,</quote> after <quote>intends to award,</quote>;</text> </subparagraph></paragraph> <paragraph id="H812483027B3B484AA9BF689206E1558B"><enum>(11)</enum><text>in subsection (b)(1)(B)—</text> <subparagraph id="H171B3BE46F2E45CB8DC364E187344EC8"><enum>(A)</enum><text>by striking <quote>scholarship or stipend</quote>; and</text> </subparagraph> <subparagraph id="H4B8A0017BD4B4143A8EF421952E830BE"><enum>(B)</enum><text>by striking <quote>; and</quote> and inserting <quote>, which may include a description of any existing programs at the applicant’s institution that are targeted to the education of mathematics and science teachers and the number of teachers graduated annually from such programs;</quote>;</text> </subparagraph></paragraph> <paragraph id="H8B2A2DAE0CBF49A999987E378CED6E83"><enum>(12)</enum><text>in subsection (b)(1), by striking subparagraph (C) and inserting the following:</text> <quoted-block id="HD5F1B8FF87924E5DBD1165FBB9F3B6B" style="OLC"> <subparagraph id="HE2EF03332F19443A9698DC0068A54900"><enum>(C)</enum><text>a description of the academic courses and field teaching experiences required under subsection (a)(3)(A)(ii) and (B)(ii), including—</text> <clause id="H42523430F1414A84B6C4222600254EAA"><enum>(i)</enum><text>a description of the undergraduate program that will enable a student to graduate within 5 years with a major in mathematics, science, or engineering and to obtain teacher certification or licensing;</text> </clause> <clause id="HBACB457F9D794CA5AF350283C6BF4237"><enum>(ii)</enum><text>a description of the field teaching experiences proposed; and</text> </clause> <clause id="HE889FB3C65884DEDB8DFFAC800174CF5"><enum>(iii)</enum><text>evidence of agreements between the applicant and the schools or school districts that are identified as the locations at which field teaching experiences will occur;</text> </clause></subparagraph> <subparagraph id="H6720ED18A269484C8BBAD5F9BD42C3DB"><enum>(D)</enum><text>a description of the programs required under subsection (a)(3)(A)(iii) and (B)(iii), including activities to assist new teachers in fulfilling their service requirements under this section; and</text> </subparagraph> <subparagraph id="H77FE0FE7C64D42A6B2A86CB30019424B"><enum>(E)</enum><text>an identification of the applicant’s mathematics, science, or engineering faculty and its education faculty who will carry out the development and implementation of the program as required under subsection (a)(4).</text> </subparagraph><after-quoted-block>;</after-quoted-block></quoted-block> </paragraph> <paragraph id="HD65BEE50EC8E4D26AF708B2BC87D382C"><enum>(13)</enum><text>in subsection (b)(2)—</text> <subparagraph id="H0347B1F048D3445EAD2D00D28F2DD100"><enum>(A)</enum><text>by redesignating subparagraphs (B), (C), (D), and (E) as subparagraphs (C), (D), (E) and (F), respectively;</text> </subparagraph> <subparagraph id="H9CB2C69DBA9E48F400C17CBB006624E1"><enum>(B)</enum><text>by inserting after subparagraph (A) a new subparagraph as follows:</text> <quoted-block id="H8F157BEB47854918842987838F7094F7" style="OLC"> <subparagraph id="HB05EDD0A42194093A11E3185D915C05D"><enum>(B)</enum><text>the extent to which the applicant’s mathematics, science, or engineering faculty and its education faculty have worked or will work collaboratively to design new or revised curricula that recognizes the specialized pedagogy required to teach mathematics, science, and technology effectively in elementary and secondary schools;</text> </subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block> </subparagraph> <subparagraph id="HC7BEA42BE898487195DF51D834005386"><enum>(C)</enum><text>by amending subparagraph (F), as so redesignated by subparagraph (A) of this paragraph, to read as follows:</text> <quoted-block display-inline="no-display-inline" id="HEC622AA137394921A0972893B872D8F0" style="OLC"> <subparagraph id="H6D947185E82F4EA49202D0AC004948CC"><enum>(F)</enum><text display-inline="yes-display-inline">the ability of the applicant to recruit students who are individuals identified in section 33 or 34 of the Science and Engineering Equal Opportunities Act (42 U.S.C. 1885a or 1885b).</text> </subparagraph><after-quoted-block>;</after-quoted-block></quoted-block> </subparagraph></paragraph> <paragraph id="H89FD5C0863B941CD976DFB91B62B7E20"><enum>(14)</enum><text>in subsection (c)(1)(B), by striking <quote>2 years</quote> and inserting <quote>3 years</quote>;</text> </paragraph> <paragraph id="H25CD59B0A89B45E7924143F99F77F754"><enum>(15)</enum><text>in subsection (c)(3)—</text> <subparagraph id="H663462BAE42B43BF8F0007871D00C852"><enum>(A)</enum><text>by striking <quote>$7,500</quote> and inserting <quote>$10,000</quote>; and</text> </subparagraph> <subparagraph id="H09F253385E064A80A0577C21C6D2F4EC"><enum>(C)</enum><text>by striking <quote>Service required under this paragraph shall be performed in a high-need local educational agency.</quote>;</text> </subparagraph></paragraph> <paragraph id="H0DBADCD09F124B88923CBF53660380CC"><enum>(17)</enum><text>in subsection (c), by adding at the end a new paragraph as follows:</text> <quoted-block id="HEE393DE2BC5B4DA69623543D29277E9E" style="OLC"> <paragraph id="H49C1E668A3934841A68DD5AD1B14EC73"><enum>(5)</enum><header>Exception</header><text display-inline="yes-display-inline">The period of service obligation under paragraph (4) is reduced by 1 year for scholarship recipients whose service is performed in a high-need local educational agency. The Director shall establish and maintain a central clearinghouse of information on teaching opportunities available in high-need local educational agencies throughout the United States, which shall be made available to individuals having a service obligation under this section.</text> </paragraph><after-quoted-block>;</after-quoted-block></quoted-block> </paragraph> <paragraph id="H84EEA002A05E4AE1B7BA557C55BB4910"><enum>(18)</enum><text>in subsection (d)(1), by striking <quote>to receive certification or licensing to teach</quote> and inserting <quote>established under subsection (a)(3)(B)</quote>;</text> </paragraph> <paragraph id="HBDF144D8AD90441FBA5761F1BF774844"><enum>(19)</enum><text>in subsection (d)(2), by inserting <quote>and professional achievement</quote> after <quote>academic merit</quote>;</text> </paragraph> <paragraph id="H5BF85E30FB814A2CAFF6E2FBA3C7C6E4"><enum>(20)</enum><text>in subsection (d)(3), by striking <quote>1 year</quote> and inserting <quote>16 months</quote>;</text> </paragraph> <paragraph id="H1EBC01D46230478DAD2CAF054399D339"><enum>(21)</enum><text>in subsection (d)(4)—</text> <subparagraph id="H9D98459439B248B6B707A63B9C09B437"><enum>(A)</enum><text>by striking <quote>6 years</quote> and inserting <quote>4 years</quote>; and</quote>; and</text> </subparagraph> <subparagraph id="H270AF0D56EA1483481767714E5B6F6E5"><enum>(D)</enum><text>by adding at the end the following:</text> <quoted-block id="HB49F09B73E9C4D91B83158A0A71FD579" style="OLC"> <paragraph id="H235B63C327C140498F96487B8D6EB15E"><enum>(6)</enum><text>the term <term>teacher leader</term> means a mathematics or science teacher who works to improve the instruction of mathematics or science in kindergarten through grade 12 through—</text> <subparagraph id="HFEE2A87775D04E00BDDEC7F54667EFA"><enum>(A)</enum><text>participating in the development or revision of science, mathematics, engineering, or technology curricula;</text> </subparagraph> <subparagraph id="H524FC4E45AC8490191BCAFDEE740AB3F"><enum>(B)</enum><text>serving as a mentor to mathematics or science teachers;</text> </subparagraph> <subparagraph id="H8291E7866A1D4CA5B6FE77A10316C533"><enum>(C)</enum><text>coordinating and assisting teachers in the use of hands-on inquiry materials, equipment, and supplies, and when appropriate, supervising acquisition and repair of such materials;</text> </subparagraph> <subparagraph id="H74F46C0AA7E047E8954F02D89519C00"><enum>(D)</enum><text>providing in-classroom teaching assistance to mathematics or science teachers; and</text> </subparagraph> <subparagraph id="H74B09B511F4D455D8CD18EE3B1F742FF"><enum>(E)</enum><text>providing professional development, for the purposes of training other teacher leaders, to mathematics and science teachers.</text> </subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block> </subparagraph></paragraph> <paragraph id="H3A1817328B0B446F8D64D6B3B88CAAB"><enum>(28)</enum><text>by adding at the end the following:</text> <quoted-block id="H15BAB9470AC245FAA4CE19F104A3CC21" style="OLC"> <subsection id="H51260154BFF44E2AAB65DCC81E5D1B47"><enum>(j)</enum><header>Mathematics and Science Scholarship Gift Fund</header><text>In accordance with section 11(f) of the National Science Foundation Act of 1950, the Director is authorized to accept donations from the private sector to support scholarships, stipends, or internships associated with programs under this section.</text> </subsection> <subsection id="HE9C6F087FA4C4043B7CE949259FB29AE"><enum>(k)</enum><header>Assessment of Teacher Service and Retention</header><text display-inline="yes-display-inline">Not later than 4 years after the date of enactment of this subsection, the Director shall transmit to Congress a report on the effectiveness of the program carried out under this section. The report shall include the proportion of individuals receiving scholarships or stipends under the program who—</text> <paragraph id="H3AAE8E31ADE64181AC94200051C48D4D"><enum>(1)</enum><text>fulfill their service obligation required under this section in a high-need local educational agency;</text> </paragraph> <paragraph id="HA1FFAC8A4C0C4A2497A573F67ED1E7F0"><enum>(2)</enum><text>elect to fulfill their service obligation in a high-need local educational agency but fail to complete it, as defined in subsection (g);</text> </paragraph> <paragraph id="H8E6302AD76674714ACA2D366C2CBB92F"><enum>(3)</enum><text>remain in the teaching profession beyond their service obligation; and</text> </paragraph> <paragraph id="H53E6FBDEDF5443209D83655D7FE261B"><enum>(4)</enum><text>remain in the teaching profession in a high-need local educational agency beyond their service obligation.</text> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection> <subsection display-inline="no-display-inline" id="HA23B145ACF9E4E4A8759305E30B35C5F"><enum>(b)</enum><header>Special partnership program for stipends</header><text>The National Science Foundation Authorization Act of 2002 is amended by inserting after section 10 the following new section:</text> <quoted-block display-inline="no-display-inline" id="H2353DC392972476F810000A5969CFD86" style="OLC"> <section id="H51898AE975A0487E9F6B8B95EC737414"><enum>10A.</enum><header>Special partnership program for stipends</header> <subsection id="HACBC36265B674F53944CEFCF9FCEA8E"><enum>(a)</enum><header>In general</header><text>As part of the Robert Noyce Teacher Scholarship Program established under section 10, the Director shall establish a separate type of award for eligible entities described in subsection (b). Stipends under this section shall be available only to mathematics, science, and engineering professionals who, while receiving the stipend, are enrolled in a program to receive certification or licensing to teach.</text> </subsection> <subsection id="HC731579020C0481A99A1CBB475E32BF"><enum>(b)</enum><header>Eligibility</header><text>In order to be eligible to receive a grant under this section, an institution of higher education (or consortia of such institutions) shall enter into a partnership with one or more private sector nonprofit organizations, local or State government organizations, and businesses. The members of the partnership shall provide the teaching supplements described in subsection (f).</text> </subsection> <subsection id="HBDF3CB06AF24493BA77ECA1B8326AD12"><enum>(c)</enum><header>Use of grants</header><text>Grants provided under this section shall be used by institutions of higher education or consortia to develop and implement a program to encourage science, mathematics, or engineering professionals to become qualified as mathematics and science teachers, through—</text> <paragraph id="H24E98C7020B9416FBB4900DA106F5903"><enum>(1)</enum><text>administering stipends in accordance with this section;</text> </paragraph> <paragraph id="H5B707894EB164D84AB54E8D8856AE00"><enum>(2)</enum><text display-inline="yes-display-inline">offering academic courses and field teaching experiences designed to prepare stipend recipients to teach in elementary and secondary schools, including such preparation as is necessary to meet the requirements for certification or licensing; and</text> </paragraph> <paragraph id="H0246A16201F0444DBDCE7C2296F321CB"><enum>(3)</enum><text>offering programs to stipend recipients, both during and after matriculation in the program for which the stipend is received, to enable recipients to become better mathematics and science teachers, to fulfill the service requirements of this section, and to exchange ideas with others in their fields.</text> </paragraph></subsection> <subsection id="H3013D6751B4048659E06A3AA4E01451C"><enum>(d)</enum><header>Selection process</header> <paragraph id="HECF82ED70447421388EDDDE79E714031"><enum>(1)</enum><header>Merit review</header><text>Grants shall be provided under this section on a competitive, merit-reviewed basis.</text> </paragraph> <paragraph id="H8312E78E6E8343BC9DAED83FAF6D8729"><enum>(2)</enum><header>Applications</header><text>An eligible institution of higher education or consortium seeking funding under this section shall submit an application to the Director at such time, in such manner, and containing such information as the Director may require. The application shall include, at a minimum—</text> <subparagraph id="H7953739A04764CB095BF14304529263"><enum>(A)</enum><text>a description of the program that the applicant intends to operate, including the number of stipends the applicant intends to award, the type of activities proposed for the recruitment of students to the program, and the amount of the teaching supplements to be provided in accordance with subsection (f);</text> </subparagraph> <subparagraph id="HE29F6BBD073E4F9F83D7695FEEB18C28"><enum>(B)</enum><text>a description of the selection process that will be used in awarding stipends, including a description of the rigorous, nationally recognized test that will be administered during the selection process in order to determine whether individuals applying for stipends have advanced content knowledge of science or mathematics;</text> </subparagraph> <subparagraph id="H867145B8B23D4E85B58DCB8600002D00"><enum>(C)</enum><text>evidence that the applicant has the capability to administer the program in accordance with the provisions of this section, which may include a description of any existing programs at the applicant’s institution that are targeted to the education of mathematics and science teachers and the number of teachers graduated annually from such programs;</text> </subparagraph> <subparagraph id="H324F58EE77AB4D05B637C2F4E94860C2"><enum>(D)</enum><text>a description of the academic courses and field teaching experiences described in subsection (c)(2), including—</text> <clause id="HB8E7A0C9969C45B697D1701EA7B54053"><enum>(i)</enum><text>a description of an educational program that will enable a student to obtain teacher certification or licensing within 16 months; and</text> </clause> <clause id="H1E27E0FCB8FA44D2BB2301B9B0CC204B"><enum>(ii)</enum><text>evidence of agreements between the applicant and the schools or school districts that are identified as the locations at which field teaching experiences will occur;</text> </clause></subparagraph> <subparagraph id="H49A19840516D495595CA282046176BFB"><enum>(E)</enum><text>a description of the programs described in subsection (c)(3), including activities to assist new teachers in fulfilling their service requirements under this section; and</text> </subparagraph> <subparagraph id="H4EB1D70E04CF45A0009F4EA000B411A1"><enum>(F)</enum><text>evidence that the partnership will provide the teaching supplements required under subsection (f).</text> </subparagraph></paragraph> <paragraph id="H6BC9AAA1639448A58D68AD74438CF4CF"><enum>(3)</enum><header>Criteria</header><text>In evaluating the applications submitted under paragraph (2), the Director shall consider, at a minimum—</text> <subparagraph id="H3A9BC0352591410683A464F1AF49FAE"><enum>(A)</enum><text>the ability of the applicant to effectively carry out the program and to meet the requirement of subsection (f);</text> </subparagraph> <subparagraph id="H9873901BE120463D001F9B3D707F79D0"><enum>(B)</enum><text>the extent to which the applicant’s mathematics, science, or engineering faculty and its education faculty have worked or will work collaboratively to design new or revised curricula that recognizes the specialized pedagogy required to teach mathematics and science effectively in elementary and secondary schools;</text> </subparagraph> <subparagraph id="H45628736CCDF43FC9FA02D1D910079EA"><enum>(C)</enum><text>the extent to which the applicant is committed to making the program a central organizational focus;</text> </subparagraph> <subparagraph id="H9428CF491D894AE1A0F64EB17756347F"><enum>(D)</enum><text>the degree to which the proposed programming will enable stipend recipients to become successful mathematics and science teachers;</text> </subparagraph> <subparagraph id="H233B11081C1F4FBB94A65680AF72913F"><enum>(E)</enum><text>the number and quality of the students that will be served by the program; and</text> </subparagraph> <subparagraph id="H79249D44531849A0A94EB21EBAC75EB2"><enum>(F)</enum><text>the ability of the applicant to recruit students who would otherwise not pursue a career in teaching.</text> </subparagraph></paragraph></subsection> <subsection id="H9051150BAD484A0DB08370F65C0055ED"><enum>(e)</enum><header>Stipends</header><text>Individuals shall be selected to receive stipends under this section primarily on the basis of their content knowledge of science or mathematics as demonstrated by their performance on a test designated in accordance with subsection (d)(2)(B). Among individuals demonstrating equivalent content knowledge, consideration may be given to financial need and to the goal of promoting the participation of individuals identified in section 33 or 34 of the Science and Engineering Equal Opportunities Act (42 U.S.C. 1885a or 1885b).</text> </subsection> <subsection id="H554F20CBB3EE464CBA6009C93EB4D81F"><enum>(f)</enum><header>Teaching supplements</header><text>The members of a partnership shall identify a source of non-Federal funding to provide salary supplements to individuals who participate in the program under this section during the period of their service obligation under subsection (h).</text> </subsection> <subsection id="HBBECC216AECE403B8EA2AE71EA3C393C"><enum>(g)</enum><header>Amount and duration</header><text>Stipends under this section shall be not less than $10,000 per year, except that no individual shall receive for any year more than the cost of attendance at that individual’s institution. Individuals may receive a maximum of 16 months of stipend support.</text> </subsection> <subsection id="H0FDA9AEA54F549EFA3C64CF2DE13322"><enum>(h)</enum><header>Service obligation</header><text>If an individual receives a stipend under this section, that individual shall be required to complete, within 6 years after completion of the educational program for which the stipend was awarded, 4 years of service as a mathematics or science teacher in a public secondary school.</text> </subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> <subsection id="H86299075CD714C00BF7EA3439DA54DAD"><enum>(c)</enum><header>Conforming amendment</header><text>Section 8(6) of the National Science Foundation Authorization Act of 2002 is amended—</text> <paragraph id="H4A13116F116542E7933E5BE5C0802786"><enum>(1)</enum><text>in the paragraph heading by inserting <quote><header-in-text level="paragraph" style="OLC">Teacher</header-in-text></quote> after <quote><header-in-text level="paragraph" style="OLC">Noyce</header-in-text></quote>; and</text> </paragraph> <paragraph id="HEF7A41E979664F258521FD9DDAE31534"><enum>(2)</enum><text>by inserting <quote>Teacher</quote> after <quote>Noyce</quote>.</text> </paragraph></subsection></section></subtitle> <subtitle id="H36B6DCA5C29E445A98F71C4BCEA8CA9E"><enum>B</enum><header>Mathematics and Science Education Improvement</header> <section id="H3BB22F171E0E40869257C4D467EDC310"><enum>121.</enum><header>Mathematics and science education partnerships amendments</header><text display-inline="no-display-inline">Section 9 of the National Science Foundation Authorization Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/1862n">42 U.S.C. 1862n</external-xref>) is amended—</text> <paragraph id="HB334DC33284F449EAD45FD47BC44A98C"><enum>(1)</enum><text>in subsection (a)(2)—</text> <subparagraph id="H55A3979689E548A9827BA32B798B9FC2"><enum>(A)</enum><text>by striking <quote>(A)</quote>;</text> </subparagraph> <subparagraph id="H1B0FBA17D15445BD92B4625C920007C3"><enum>(B)</enum><text>by striking subparagraph (B);</text> </subparagraph> <subparagraph id="H0387332FF3A24B38B7836933D03776CD"><enum>(C)</enum><text>by inserting <quote>, through 1 or more of its departments in science, mathematics, or engineering,</quote> after <quote>institution of higher education</quote>; and</text> </subparagraph> <subparagraph id="HB4C479FB030A47EDBC0464DCE8DEDA5"><enum>(B)</enum><text>by inserting <quote>and laboratory</quote> after <quote>provide technical</quote>;</text> </subparagraph></paragraph> <paragraph id="HC6255969C0914DF98488001F7286A755"><enum>(4)</enum><text>in subsection (a)(3)(I) by inserting <quote>including model induction programs for teachers in their first 2 years of teaching,</quote> after <quote>and science,</quote>;</text> </paragraph> <paragraph id="HC822677FEA6F495289A6D947DDDEA4E9"><enum>(5)</enum><text>in subsection (a)(3)(K) by striking <quote>developing and offering mathematics or science enrichment programs for students, including after-school and summer programs;</quote> and inserting <quote>developing educational programs and materials and conducting mathematics, science, and technology enrichment programs for students, including after-school programs and summer camps for students described in subsection (b)(2)(G);</quote>;</text> </paragraph> <paragraph id="H0B2D87AC96E04843A027466603DFBCF3"><enum>(6)</enum><text>in subsection (a) by inserting at the end the following:</text> <quoted-block id="HEF34505A80474BA5A733B15038BE12EE" style="OLC"> <paragraph id="H2A38F14A9C8F44DF88709CE12F8C7FB"><enum>(8)</enum><header>Master’s degree programs</header><text>Activities carried out in accordance with paragraph (3)(B) shall include the development and offering of master’s degree programs for in-service mathematics and science teachers that will strengthen their subject area knowledge and pedagogical skills, as described in section 123 of the Act enacting this paragraph. Grants provided under this section may be used to develop and implement courses of instruction for the master’s degree programs, which may involve online learning, and develop related educational materials.</text> </paragraph> <paragraph id="HE335E323EFE34965906CDF9FAA2E319"><enum>(9)</enum><header>Mentors for teachers and students of challenging courses</header><text display-inline="yes-display-inline">Partnerships carrying out activities to prepare mathematics and science teachers to teach challenging mathematics, science, and technology college-preparatory courses, including Advanced Placement and International Baccalaureate courses, in accordance with paragraph (3)(B) shall encourage companies employing scientists, mathematicians, or engineers to provide mentors to teachers and students and provide for the coordination of such mentoring activities.</text> </paragraph> <paragraph id="H45D7A189A871413AB1BE70EAD47BE8BC"><enum>(10)</enum><header>Inventiveness</header><text>Activities carried out in accordance with paragraph (3)(H) may include the development and dissemination of curriculum tools that will help foster inventiveness and innovation.</text> </paragraph><after-quoted-block>;</after-quoted-block></quoted-block> </paragraph> <paragraph id="H13FC3D2B612D42059086F7B38B539E37"><enum>(7)</enum><text>in subsection (b)(2) by redesignating subparagraphs (E) and (F) as subparagraphs (F) and (G), respectively, and inserting after subparagraph (D) the following new subparagraph:</text> <quoted-block id="H0B887AAD89FF44D8928B5B5971BD449B" style="OLC"> <subparagraph id="HA97CFC27100A4FF4A513FC331C56CEB0"><enum>(E)</enum><text>the extent to which the evaluation described in paragraph (1)(E) will be independent and based on objective measures;</text> </subparagraph><after-quoted-block>;</after-quoted-block></quoted-block> </paragraph> <paragraph id="HA9545BEACDAB4F59B8F615B5069F5056"><enum>(8)</enum><text>in subsection (b) by inserting at the end the following:</text> <quoted-block id="H7BB8C056D8114F7FA52579EA3776DFA7" style="OLC"> <paragraph id="H99E1F7E870834E44B1FA6E4DA9B68BB1"><enum>(4)</enum><header>Minimum and maximum grant size</header><text>A grant awarded under this section shall be not less than $75,000 or greater than $2,000,000 for any fiscal year.</text> </paragraph><after-quoted-block>;</after-quoted-block></quoted-block> </paragraph> <paragraph id="HEF8806DC8226463D99D1F277F4AFC839"><enum>(9)</enum><text>in subsection (c)—</text> <subparagraph id="H9D1AF40EEE42423B9DCBB700FFD8EECA"><enum>(A)</enum><text>by striking paragraph (2);</text> </subparagraph> <subparagraph id="H4A231F025BE841CD852F2BE65B8B648"><enum>(B)</enum><text>by redesignating paragraphs (3), (4), and (5) as paragraphs (4), (5), and (6), respectively; and</text> </subparagraph> <subparagraph id="H3768C1705F744FF1BC539000BCA52BB"><enum>(C)</enum><text>by inserting after paragraph (1) the following new paragraphs:</text> <quoted-block id="H62ED6D8B9F7A497E98E58CA8E07C6F19" style="OLC"> <paragraph id="H9627DC52069849B6BAC0052CFFAE84D"><enum>(2)</enum><header>Report on model projects</header><text>The Director shall determine which completed projects funded through the program under this section should be seen as models to be replicated on a more expansive basis at the State or national levels. Not later than 1 year after the date of enactment of this paragraph, the Director shall transmit a report describing the results of this study to the Committee on Science and Technology and the Committee on Education and Labor of the House of Representatives and to the Committee on Commerce, Science, and Transportation and the Committee on Health, Education, Labor, and Pensions of the Senate.</text> </paragraph> <paragraph id="HECC6F482BC3D4D0185039B57E830EF5C"><enum>(3)</enum><header>Report on evaluations</header><text>Not later than 4 years after the date of enactment of this paragraph, the Director shall transmit a report summarizing the evaluations required under subsection (b)(1)(E) of grants received under this program and describing any changes to the program recommended as a result of these evaluations to the Committee on Science and Technology and the Committee on Education and Labor of the House of Representatives and to the Committee on Commerce, Science, and Transportation and the Committee on Health, Education, Labor, and Pensions of the Senate. Such report shall be made widely available to the public.</text> </paragraph><after-quoted-block>; and</after-quoted-block></quoted-block> </subparagraph></paragraph> <paragraph id="HA0DDD99F7615459F8F70E04C03AF00C"><enum>(10)</enum><text>by adding at the end the following new subsection:</text> <quoted-block display-inline="no-display-inline" id="H361C9220E5E246E9A7003423C7B2D503" style="OLC"> <subsection id="H67FC4D52119D4E778D5776253FCBBE97"><enum>(d)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section—</text> <paragraph id="HE6CE55E36694492495D89EDF5DF45F8F"><enum>(1)</enum><text>the term <term>mathematics and science teacher</term> means a mathematics, science, or technology teacher at the elementary school or secondary school level; and</text> </paragraph> <paragraph id="H8511D260FEDD45AE8639163934CD614"><enum>(2)</enum><text>the term <term>science</term>, in the context of elementary and secondary education, includes technology and pre-engineering.</text> </paragraph></subsection><after-quoted-block>. </after-quoted-block></quoted-block> </paragraph></section> <section id="H3407EF4A2BE244C89532C982A705D482"><enum>122.</enum><header>Teacher institutes</header> <subsection id="H2AAD3A04B1A8435CB4C892D255008B84"><enum>(a)</enum><header>National Science Foundation Institutes</header> <paragraph id="H02BB1148EFE04DE6A97E6F00C920FB43"><enum>(1)</enum><header>In general</header><text>The Director shall establish a grant program to provide for summer or academic year teacher institutes or workshops authorized by section 9(a)(3)(B) of the National Science Foundation Authorization Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/1862n">42 U.S.C. 1862n(a)(3)(B)</external-xref>) and shall allow grantees under the Teacher Institutes for the 21st Century program to operate 1 to 2 week summer teacher institutes with the goal of reaching the maximum number of in-service mathematics and science teachers, particularly elementary and middle school teachers, to improve their content knowledge and pedagogical skills.</text> </paragraph> <paragraph id="H08867F89C40F4EBDA4EE43C11C5B4927"><enum>(2)</enum><header>Preparation to Teach Challenging Courses</header><text display-inline="yes-display-inline">The Director shall ensure that activities supported for awards under paragraph (1) include the development and implementation of teacher training activities to prepare mathematics and science teachers to teach challenging mathematics, science, and technology college-preparatory courses, including Advanced Placement and International Baccalaureate courses.</text> </paragraph> <paragraph display-inline="no-display-inline" id="HEBC5A025D6BA43B4BC00A0DB7929FEFB"><enum>(3)</enum><header>Awards</header><text display-inline="yes-display-inline">In awarding grants under this section, the Director shall give priority to applications that propose programs that will attract mathematics and science teachers from local educational agencies that—</text> <subparagraph id="H3725A2954F4F4F4980C06C61F0852C9D"><enum>(A)</enum><text>are receiving grants under title I of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6301">20 U.S.C. 6301 et seq.</external-xref>) as a result of having within their jurisdictions concentrations of children from low income families; and</text> </subparagraph> <subparagraph id="HBE81B4AFA58542B6A886DB7B607EC45D"><enum>(B)</enum><text>are experiencing a shortage of highly qualified teachers, as defined in section 9101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>), in the fields of science, mathematics, or technology.</text> </subparagraph></paragraph></subsection> <subsection id="H1F0478052C324961A574D82C42D642AA"><enum>(b)</enum><header>Laboratory Science Teacher Professional Development</header><text>There are authorized to be appropriated to the Secretary of Energy for the Laboratory Science Teacher Professional Development program, $3,000,000 for fiscal year 2008, $8,000,000 for fiscal year 2009, $10,000,000 for fiscal year 2010, $10,000,000 for fiscal year 2011, and $10,000,000 for fiscal year 2012.</text> </subsection></section> <section id="HEA37D633B5D94AAEB7AFD0830EF24B"><enum>123.</enum><header>Graduate degree program</header> <subsection id="H4289C6EDA6134F73B90052A759D2EC8"><enum>(a)</enum><header>In general</header><text>The Director shall ensure that master’s degree programs for in-service mathematics and science teachers that will strengthen their subject area knowledge and pedagogical skills are instituted in accordance with section 9(a)(8) of the National Science Foundation Authorization Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/1862n">42 U.S.C. 1862n(a)(8)</external-xref>). The degree programs shall be designed for current teachers, who will enroll as part-time students, and to allow participants to obtain master’s degrees within a period of 3 years.</text> </subsection> <subsection id="H6000864720E54377ABE47B9016F4D061"><enum>(b)</enum><header>Distribution of awards</header><text>The Director shall, in awarding grants to carry out subsection (a), consider the distribution of awards among institutions of higher education of different sizes and geographic locations.</text> </subsection> <subsection id="H05832DD6B2A54FBF9DB1ADA4752A234"><enum>(c)</enum><header>Program activities</header><text>Activities supported through master’s degree programs established under subsection (a) may include—</text> <paragraph id="H36BBE72325124072A27D3B99D204C067"><enum>(1)</enum><text>development of courses of instruction and related educational materials;</text> </paragraph> <paragraph id="HD645E523F6384370BE68A0F8651BA382"><enum>(2)</enum><text>stipends to defray the cost of attendance for students in the degree program; and</text> </paragraph> <paragraph id="HF46D7DC9D4D745AC8335B42E49E18FB"><enum>(3)</enum><text>acquisition of computer and networking equipment needed for online instruction under the degree program.</text> </paragraph></subsection></section> <section display-inline="no-display-inline" id="H97F65FF6CE984152A7DAC059464C0191" section-type="subsequent-section"><enum>124.</enum><header>Curricula</header><text display-inline="no-display-inline">Nothing in this title, or the amendments made by this title, shall be construed to limit the authority of State governments or local school boards to determine the curricula of their students.</text> </section> <section id="H5735D03E6DAA40D78300B018BC8200D9"><enum>125.</enum><header>Science, Technology, Engineering, and Mathematics Talent Expansion Program</header> <subsection id="H0EFD37718CD14657B687FA78DD99F781"><enum>(a)</enum><header>Amendments</header><text>Section 8(7) of the National Science Foundation Authorization Act of 2002 is amended—</text> <paragraph id="H4CE27BB543D347EB8B53E62080435C5"><enum>(1)</enum><text>in subparagraph (A) by striking <quote>competitive, merit-based</quote> and all that follows through <quote>in recent years.</quote> and inserting</text> <quoted-block display-inline="yes-display-inline" id="HFBBC6E4F9D474B83A908B17803408396" style="OLC"> <text>competitive, merit-reviewed multiyear grants for eligible applicants to improve undergraduate education in science, mathematics, engineering, and technology through—</text> <clause id="H0F5012B135A54B71AE9F3C10CCB0F800" indent="up1"><enum>(i)</enum><text>the creation of programs to increase the number of students studying toward and completing associate’s or bachelor’s degrees in science, technology, engineering, and mathematics, particularly in fields that have faced declining enrollment in recent years; and</text> </clause> <clause id="H3728478D49D3446CA9799BD6704FF3D3" indent="up1"><enum>(ii)</enum><text>the creation of centers (in this paragraph referred to as <quote>Centers</quote>) to develop undergraduate curriculum, teaching methods for undergraduate courses, and methods to better train professors and teaching assistants who teach undergraduate courses to increase the number of students completing undergraduate courses in science, technology, engineering, and mathematics, including the number of nonmajors, and to improve student academic achievement in those courses.</text> </clause> <quoted-block-continuation-text quoted-block-continuation-text-level="paragraph">Grants made under clause (ii) shall be awarded jointly through the Education and Human Resources Directorate and at least 1 research directorate of the Foundation.</quoted-block-continuation-text><after-quoted-block>;</after-quoted-block></quoted-block> </paragraph> <paragraph id="H61B1178CF9CC49C1A1FF59CFED636C44"><enum>(2)</enum><text>by amending subparagraph (B) to read as follows:</text> <quoted-block display-inline="no-display-inline" id="H0B5EDD02D859423791253707A5AE9DB3" style="OLC"> <subparagraph id="HA64531A9F7BB47089721C1B049BC0195" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">In selecting projects under subparagraph (A)(i), the Director shall strive to increase the number of students studying toward and completing baccalaureate degrees, concentrations, or certificates in science, mathematics, engineering, or technology who are—</text> <clause id="H8ECD3CD736BF4C69A6417371C5BABD60"><enum>(i)</enum><text>individuals identified in section 33 or 34 of the Science and Engineering Equal Opportunities Act (42 U.S.C. 1885a or 1885b); or</text> </clause> <clause id="H28DB3555056C4C76B0AE56F794877945"><enum>(ii)</enum><text>graduates of a secondary school that is administered by a local educational agency that is receiving grants under title I of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6301">20 U.S.C. 6301 et seq.</external-xref>) as a result of having within its jurisdiction concentrations of children from low income families.</text> </clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block> </paragraph> <paragraph id="HC1FDF6DE2713407E833640DCB358A11F"><enum>(3)</enum><text>in subparagraph (C)—</text> <subparagraph id="H2C0E6DF7E14B4D7AB1629B68953C5653"><enum>(A)</enum><text>by inserting <quote>(i)</quote> before <quote>The types of</quote>;</text> </subparagraph> <subparagraph id="HA9B323ED361C4592BD97AED9900FB83"><enum>(B)</enum><text>by redesignating clauses (i) through (vi) as subclauses (I) through (VI), respectively;</text> </subparagraph> <subparagraph id="HE58792FC4B0A48759878AAC142BADAEF"><enum>(C)</enum><text>by striking <quote>under this paragraph</quote> and inserting <quote>under subparagraph (A)(i)</quote>; and</text> </subparagraph> <subparagraph id="H2C1BD0688B77442FAFF0F451599786CD"><enum>(D)</enum><text>by adding at the end the following new clause:</text> <quoted-block id="H5F2ED51C3C6A4699AB7D5DF210FABF40" style="OLC"> <clause id="H682FADD6981346DFBB89CB1266D4EB" indent="up2"><enum>(ii)</enum><text>The types of activities the Foundation may support under subparagraph (A)(ii) include—</text> <subclause id="H5C36C54339EE40959F9159181CCD9E00"><enum>(I)</enum><text>creating model curricula and laboratory programs;</text> </subclause> <subclause id="HC00D705C1B53458EBDF942EE0057E63C"><enum>(II)</enum><text>developing and demonstrating research-based instructional methods and technologies;</text> </subclause> <subclause id="H5A4F94F787D441E6AD8275DD028EA214"><enum>(III)</enum><text>developing methods to train graduate students and faculty to be more effective teachers of undergraduates;</text> </subclause> <subclause id="H2508C2ED87A748E78FFBF28C62ECE15B"><enum>(IV)</enum><text>conducting programs to disseminate curricula, instructional methods, or training methods to faculty at the grantee institutions and at other institutions;</text> </subclause> <subclause id="HF22F28C100EF4D328FCB1EC7F973BDD"><enum>(V)</enum><text>conducting assessments of the effectiveness of the Center at accomplishing the goals described in subparagraph (A)(ii); and</text> </subclause> <subclause id="HD077F2E0883B44FC8279401576D340F0"><enum>(VI)</enum><text>conducting any other activities the Director determines will accomplish the goals described in subparagraph (A)(ii).</text> </subclause></clause><after-quoted-block>;</after-quoted-block></quoted-block> </subparagraph></paragraph> <paragraph id="H6C7EA45394A145D08761F6AE6EDE172C"><enum>(4)</enum><text>in subparagraph (D)(i), by striking <quote>under this paragraph</quote> and inserting <quote>under subparagraph (A)(i)</quote>;</text> </paragraph> <paragraph id="H0ED85FD65F314A1EB80004D165C0FD03"><enum>(5)</enum><text>in subparagraph (D)(ii), by striking <quote>under this paragraph</quote> and inserting <quote>under subparagraph (A)(i)</quote>;</text> </paragraph> <paragraph id="H2E80031DFB5740F79EF298E1A0AD8355"><enum>(6)</enum><text>after subparagraph (D)(iii), by adding at the end the following new clause:</text> <quoted-block id="H46C0C41175FE43539FC2F5A202D7CB00" style="OLC"> <clause id="H785688A390FB49BE944E47C6A6EABB00" indent="up2"><enum>(iv)</enum><text>A grant under subparagraph (A)(ii) shall be awarded for 5 years, and the Director may extend such a grant for up to 2 additional 3 year periods.</text> </clause><after-quoted-block>;</after-quoted-block></quoted-block> </paragraph> <paragraph id="HAB9577B0CC694F6383FA96F0ABFE6580"><enum>(7)</enum><text>in subparagraph (E), by striking <quote>under this paragraph</quote> both places it appears and inserting <quote>under subparagraph (A)(i)</quote>;</text> </paragraph> <paragraph id="H5415CBBF82ED40168D72C8252C35DFBF"><enum>(8)</enum><text>by redesignating subparagraph (F) as subparagraph (J); and</text> </paragraph> <paragraph id="HDF41967F0A624B42942115FCF3ECAB15"><enum>(9)</enum><text>by inserting after subparagraph (E) the following new subparagraphs:</text> <quoted-block id="HA85565A276A8409CA0FAA2CB1C6838E" style="OLC"> <subparagraph id="H7EB3A48E691A4EFC8B2D858B82520335" indent="up1"><enum>(F)</enum><text>Grants awarded under subparagraph (A)(ii) shall be carried out by a department or departments of science, mathematics, or engineering at institutions of higher education (or a consortia thereof), which may partner with education faculty. Applications for awards under subparagraph (A)(ii) shall be submitted to the Director at such time, in such manner, and containing such information as the Director may require. At a minimum, the application shall include—</text> <clause id="H3D7B0D8D386A4372902202E5CD170410"><enum>(i)</enum><text>a description of the activities to be carried out by the Center;</text> </clause> <clause id="HE2A321B2CE2045D6A61399027437EEF1"><enum>(ii)</enum><text>a plan for disseminating programs related to the activities carried out by the Center to faculty at the grantee institution and at other institutions;</text> </clause> <clause id="H3E415B9CEE66495D84A3A36CB9E8E379"><enum>(iii)</enum><text>an estimate of the number of faculty, graduate students (if any), and undergraduate students who will be affected by the activities carried out by the Center; and</text> </clause> <clause id="H1E4EDA9B55B244E089A44908BCB5CEC3"><enum>(iv)</enum><text>a plan for assessing the effectiveness of the Center at accomplishing the goals described in subparagraph (A)(ii).</text> </clause></subparagraph> <subparagraph id="HA9430FAD34B9467DAEF092C085EA4681" indent="up1"><enum>(G)</enum><text>In evaluating the applications submitted under subparagraph (F), the Director shall consider, at a minimum—</text> <clause id="H3730310C10DA4A989512B2DD8FFC59B2"><enum>(i)</enum><text>the ability of the applicant to effectively carry out the proposed activities, including the dissemination activities described in subparagraph (C)(ii)(IV); and</text> </clause> <clause id="HA635D2A6BFFF4B12B42005B148FC496"><enum>(ii)</enum><text>the extent to which the faculty, staff, and administrators of the applicant institution are committed to improving undergraduate science, mathematics, and engineering education.</text> </clause></subparagraph> <subparagraph id="H5DE2AE8104014BE49CC5521BF0F332A5" indent="up1"><enum>(H)</enum><text>In awarding grants under subparagraph (A)(ii), the Director shall endeavor to ensure that a wide variety of science, technology, engineering, and mathematics fields and types of institutions of higher education, including 2-year colleges and minority-serving institutions, are covered, and that—</text> <clause id="HEA62C6E0FB344E848882ACD400A68034"><enum>(i)</enum><text>at least 1 Center is housed at a Doctoral/Research University as defined by the Carnegie Foundation for the Advancement of Teaching; and</text> </clause> <clause id="H66BAA9D2D29B413BB856DA90711C9516"><enum>(ii)</enum><text>at least 1 Center is focused on improving undergraduate education in an interdisciplinary area.</text> </clause></subparagraph> <subparagraph id="HC3C32ADB5A204B98B16793A9A8F65F93" indent="up1"><enum>(I)</enum><text>The Director shall convene an annual meeting of the awardees under this paragraph to foster collaboration and to disseminate the results of the Centers and the other activities funded under this paragraph.</text> </subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection> <subsection id="H6168745CF2E84570B800E6E9496D6504"><enum>(b)</enum><header>Report on Data Collection</header><text>Not later than 180 days after the date of enactment of this Act, the Director shall transmit to Congress a report on how the Director is determining whether current grant recipients in the Science, Technology, Engineering, and Mathematics Talent Expansion Program are making satisfactory progress as required by section 8(7)(D)(ii) of the National Science Foundation Authorization Act of 2002 and what funding actions have been taken as a result of the Director’s determinations.</text> </subsection></section> <section id="HED25592DFA4A4F8C842B392EBD7B271E"><enum>126.</enum><header>High-need local educational agency definition</header><text display-inline="no-display-inline">Section 4(8) of the National Science Foundation Authorization Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/1862n">42 U.S.C. 1862n</external-xref> note) is amended to read as follows:</text> <quoted-block display-inline="no-display-inline" id="H84CC04A1F997424CA4ED00440053BA6E" style="OLC"> <paragraph id="H64D78B0C71E746B8B3DD356D3F5CE520"><enum>(8)</enum><header>High-need local educational agency</header><text display-inline="yes-display-inline">The term <term>high-need local educational agency</term> means a local educational agency that—</text> <subparagraph id="H286C70C1A7E548DAA797F2005647D4CD"><enum>(A)</enum><text>is receiving grants under title I of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6301">20 U.S.C. 6301 et seq.</external-xref>) as a result of having within its jurisdiction concentrations of children from low income families; and</text> </subparagraph> <subparagraph id="H6810C43EB7EC4FC99EABDE06CD5EF5A4"><enum>(B)</enum><text>is experiencing a shortage of highly qualified teachers, as defined in section 9101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>), in the fields of science, mathematics, or engineering.</text> </subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </section> <section id="HC7A318EFAF1444A2A000B6E7FDF300A"><enum>127.</enum><header>Teacher leaders</header><text display-inline="no-display-inline">The National Science Foundation Authorization Act of 2002 is amended—</text> <paragraph id="H6FFC373A533441C000A8A85EAE2939A"><enum>(1)</enum><text>in section 4(11)—</text> <subparagraph id="H7531CA9FF30644DCBF68A7AF909250F9"><enum>(A)</enum><text>by striking <quote><header-in-text level="paragraph" style="OLC">master teacher</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">teacher leader</header-in-text></quote>;</text> </subparagraph> <subparagraph id="H7D3BDEEFF60442D29148F6AB11A0A53D"><enum>(B)</enum><text>by striking <quote>master teacher</quote> and inserting <quote>teacher leader</quote>; and</text> </clause> <clause id="H760204434C144FF884ADD4D5E70478F6"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking <quote>master teachers</quote> each place it appears and inserting <quote>teacher leaders</quote>.</text> </clause></subparagraph></paragraph></section> <section id="H143722C379F944388FE5218ED68E4FEA"><enum>128.</enum><header>Laboratory science pilot program</header> <subsection display-inline="no-display-inline" id="H4BAF990D727E43169500278FA9E754E"><enum>(a)</enum><header>Findings</header><text>The Congress finds the following:</text> <paragraph id="H8252295AB2F747BFA64DA3940711FC42"><enum>(1)</enum><text>To remain competitive in science and technology in the global economy, the United States must increase the number of students graduating from high school prepared to pursue postsecondary education in science, technology, engineering, and mathematics.</text> </paragraph> <paragraph id="HD4E4103F9CD54A2A971F71A1DD5FE725"><enum>(2)</enum><text>There is broad agreement in the scientific community that learning science requires direct involvement by students in scientific inquiry and that laboratory experience is so integral to the nature of science that it must be included in every science program for every science student.</text> </paragraph> <paragraph id="HE1A0DE5C009449E2A8B3FEEE08002EE5"><enum>(3)</enum><text>In America’s Lab Report, the National Research Council concluded that the current quality of laboratory experiences is poor for most students and that educators and researchers do not agree on how to define high school science laboratories or on their purpose, hampering the accumulation of research on how to improve labs.</text> </paragraph> <paragraph id="H9B0329543EBE4781AD006CEFEE088CC9"><enum>(4)</enum><text>The National Research Council found that schools with higher concentrations of non-Asian minorities and schools with higher concentrations of poor students are less likely to have adequate laboratory facilities than other schools.</text> </paragraph> <paragraph id="HF974C1EE24E14B6DA87DA6CDEC123E3B"><enum>(5)</enum><text>The Government Accountability Office reported that 49.1 percent of schools where the minority student population is greater than 50.5 percent reported not meeting functional requirements for laboratory science well or at all.</text> </paragraph> <paragraph id="HBDD147030AEB43F5834000AE21D773CB"><enum>(6)</enum><text>40 percent of those college students who left the science fields reported some problems related to high school science preparation, including lack of laboratory experience and no introduction to theoretical or to analytical modes of thought.</text> </paragraph> <paragraph id="H93892A7C84914C8794A7B0DB8776EF4E"><enum>(7)</enum><text>It is in the national interest for the Federal Government to invest in research and demonstration projects to improve the teaching of laboratory science in the Nation’s high schools.</text> </paragraph></subsection> <subsection display-inline="no-display-inline" id="H171D06B39DB74939916269D52233677D"><enum>(b)</enum><header>Grant program</header><text>Section 8(8) of the National Science Foundation Authorization Act of 2002 is amended—</text> <paragraph id="HEE887BE3AF12449100683D4D578BE969"><enum>(1)</enum><text>by redesignating subparagraphs (A) through (F) as clauses (i) through (vi), respectively;</text> </paragraph> <paragraph id="H13EAEDCDB9C9418789B3007581CEE8E7"><enum>(2)</enum><text>by inserting <quote>(A)</quote> before <quote>A program of competitive</quote>; and</text> </paragraph> <paragraph id="H92242835C74C44568C86198B7D52AEF5"><enum>(3)</enum><text>by inserting at the end the following new subparagraphs:</text> <quoted-block id="HD191464A312C4895BEB82F1D2B333C8B" style="OLC"> <subparagraph id="H1EA9672A7B4C4257B7EE123E33A970DB" indent="up1"><enum>(B)</enum><text>In accordance with subparagraph (A)(v), the Director shall establish a research pilot program designated as <quote>Partnerships for Access to Laboratory Science</quote> to award grants to partnerships to improve laboratories and provide instrumentation as part of a comprehensive program to enhance the quality of mathematics, science, engineering, and technology instruction at the secondary school level. Grants under this subparagraph may be used for—</text> <clause id="H791BAB27FD7D4D42944C31CA4936A7D"><enum>(i)</enum><text>purchase, rental, or leasing of equipment, instrumentation, and other scientific educational materials;</text> </clause> <clause id="H2A1412DFE78349D18E6F741F7848AD3B"><enum>(ii)</enum><text>maintenance, renovation, and improvement of laboratory facilities;</text> </clause> <clause id="H61FA5F508D1A47AC912DDAD78000EDDB"><enum>(iii)</enum><text>development of instructional programs designed to integrate the laboratory experience with classroom instruction and to be consistent with State mathematics and science academic achievement standards;</text> </clause> <clause id="H6A6AB70BF84B4B66AE2238A4072BB822"><enum>(iv)</enum><text>training in laboratory safety for school personnel;</text> </clause> <clause id="H3397F1FFC4F546EBBDDD01DB7203429C"><enum>(v)</enum><text>design and implementation of hands-on laboratory experiences to encourage the interest of individuals identified in section 33 or 34 of the Science and Engineering Equal Opportunities Act (42 U.S.C. 1885a or 1885b) in mathematics, science, engineering, and technology and help prepare such individuals to pursue postsecondary studies in these fields; and</text> </clause> <clause id="H57EF68765E434F87867761B8B2A52C7D"><enum>(vi)</enum><text>assessment of the activities funded under this subparagraph.</text> </clause></subparagraph> <subparagraph display-inline="no-display-inline" id="H558E7418E321413292F0B1282D00FCF7" indent="up1"><enum>(C)</enum><text>Grants may be made under subparagraph (B) only to a partnership—</text> <clause id="H62ECC76E0A794228837B826F30C682E9"><enum>(i)</enum><text>for a project that includes significant teacher training and professional development components; or</text> </clause> <clause id="HBA77CDD5EE774F50A2FAA573F865AB67"><enum>(ii)</enum><text>that establishes that appropriate teacher training and professional development is being addressed, or has been addressed, through other means.</text> </clause></subparagraph> <subparagraph id="H6A1F466C36704FEF9E2EDE56C21BB279" indent="up1"><enum>(D)</enum><text>Grants awarded under subparagraph (B) shall be to a partnership that—</text> <clause id="H53E3AAB9D0454F54ACBE6EC9A3FD001C"><enum>(i)</enum><text>includes an institution of higher education or a community college;</text> </clause> <clause id="H836A9B1B0D29406CBB401393940021C3"><enum>(ii)</enum><text display-inline="yes-display-inline">includes a high-need local educational agency;</text> </clause> <clause id="HE09DD0F1FDD54749B500004295A04230"><enum>(iii)</enum><text>includes a business or eligible nonprofit organization; and</text> </clause> <clause id="H1017C8407DC04C698F94C2B92047A93D"><enum>(iv)</enum><text>may include a State educational agency, other public agency, National Laboratory, or community-based organization.</text> </clause></subparagraph> <subparagraph id="H29DBB7FE6195499DA94BCE2D201B8624" indent="up1"><enum>(E)</enum><text>The Federal share of the cost of activities carried out using amounts from a grant under subparagraph (B) shall not exceed 50 percent.</text> </subparagraph> <subparagraph id="H9E11FBECA12B45AB8109D8AD4E5E75CF" indent="up1"><enum>(F)</enum><text>The Director shall require grant recipients to submit a report to the Director on the results of the project supported by the grant.</text> </subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection> <subsection id="H8DC4947991DE44B19E49002FAC050008"><enum>(c)</enum><header>Report</header><text>The Director shall evaluate the effectiveness of activities carried out under the research pilot projects funded by the grant program established pursuant to the amendment made by subsection (b) in improving student performance in mathematics, science, engineering, and technology. A report documenting the results of that evaluation shall be submitted to the Committee on Science and Technology of the House of Representatives and the Committees on Commerce, Science, and Transportation and on Health, Education, Labor, and Pensions of the Senate not later than 5 years after the date of enactment of this Act. The report shall identify best practices and materials developed and demonstrated by grant awardees.</text> </subsection> <subsection id="H0288D7C051A841F296DCC502C6B0B007"><enum>(d)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">From the amount authorized in section 303(a)(2)(B), (b)(2)(B), and (c)(2)(B) of this Act, there are authorized to be appropriated to carry out this section and the amendments made by this section $5,000,000 for fiscal year 2008, and such sums as may be necessary for each of the 2 succeeding fiscal years.</text> </subsection></section> <section id="HCD6F049237F24583B16700811B9CB691"><enum>129.</enum><header>Study on laboratory equipment donations for schools</header><text display-inline="no-display-inline">Not later than 2 years after the date of enactment of this Act, the Director shall transmit a report to the Congress examining the extent to which institutions of higher education are donating used laboratory equipment to elementary and secondary schools. The Director, in consultation with the Secretary of Education, shall survey institutions of higher education to determine—</text> <paragraph id="HC54D8332C96240818F00C856FC481DDD"><enum>(1)</enum><text>how often, how much, and what type of equipment is donated;</text> </paragraph> <paragraph id="H73ADC5E0371A4081AEBAF4AC6FA9217E"><enum>(2)</enum><text>what criteria or guidelines the institutions are using to determine what types of equipment can be donated, what condition the equipment should be in, and which schools receive the equipment;</text> </paragraph> <paragraph id="H395E1A2FD7EC4479A4940000418CFD17"><enum>(3)</enum><text>whether the institutions provide any support to, or follow-up with the schools; and</text> </paragraph> <paragraph id="H5E5BF9B9BC4D4FDC99AEE863D85E1C8C"><enum>(4)</enum><text>how appropriate donations can be encouraged.</text> </paragraph></section></subtitle> <enum>II</enum><header>Science and Engineering Research</header> <section display-inline="no-display-inline" id="H8FBA4BADB8734FCC8DA8F2CBC700F000" section-type="subsequent-section"><enum>201.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Sowing the Seeds Through Science and Engineering Research Act</short-title></quote>.</text> </section> <section id="H893C5886C61B4AF1AD455F38956F7F42"><enum>202.</enum><header>National Science Foundation early career awards for science and engineering researchers</header> <subsection id="HB7B12FD24F3C4D998E5976FED9EAF762"><enum>(a)</enum><header>In General</header><text>The Director of the National Science Foundation shall carry out a program to award grants to scientists and engineers at the early stage of their careers at institutions of higher education and organizations described in subsection (c)(2) to conduct research in fields relevant to the mission of the Foundation. The existing Faculty Early Career Development (CAREER) Program may be designated as the mechanism for awarding such grants.</text> </subsection> <subsection id="H18DF3498387648CCBCBD55D7AE003CAE"><enum>(b)</enum><header>Size and Duration of Award</header><text>The duration of awards under this section shall be 5 years, and the amount per year shall be at least $80,000.</text> </subsection> <subsection id="H702CABD4735D4C8FAA973DF347940F0"><enum>(c)</enum><header>Eligibility</header><text>Award recipients shall be individuals who are employed in a tenure-track position as an assistant professor or equivalent title, or who hold an equivalent position, at—</text> <paragraph id="HC43B7385F485420588600017BAF18702"><enum>(1)</enum><text>an institution of higher education in the United States; or</text> </paragraph> <paragraph id="H65E14F92A93346B38544E8E11996792B"><enum>(2)</enum><text>an organization in the United States that is a nonprofit, nondegree-granting research organization such as a museum, observatory, or research laboratory.</text> </paragraph></subsection> <subsection id="HD54034B5EF884166842E055E154DC78F"><enum>(d)</enum><header>Selection</header><text>Award recipients shall be selected on a competitive, merit-reviewed basis.</text> </subsection> <subsection id="H9D0BA421E5C2441FA91240486BD2C400"><enum>(e)</enum><header>Selection Process and Criteria for Awards</header><text>An applicant seeking funding under this section shall submit a proposal to the Director at such time, in such manner, and containing such information as the Director may require. In evaluating the proposals submitted under this section, the Director shall consider, at a minimum—</text> <paragraph id="HF52D49F676B24DC9BD1B4B153169BFC3"><enum>(1)</enum><text>the intellectual merit of the proposed work;</text> </paragraph> <paragraph id="H4019C9AC182344A6801D55729FFAFE9C"><enum>(2)</enum><text>the innovative or transformative nature of the proposed research;</text> </paragraph> <paragraph id="H5A07D323AA194BD4B55CA2B439F09DB5"><enum>(3)</enum><text>the extent to which the proposal integrates research and education, including undergraduate education in science and engineering disciplines; and</text> </paragraph> <paragraph id="H70BB5C06EDC24A2D8DB4E2CF410052A1"><enum>(4)</enum><text>the potential of the applicant for leadership at the frontiers of knowledge.</text> </paragraph></subsection> <subsection id="H9490C414B0274E0A9F959182D6779D8B"><enum>(f)</enum><header>Awards</header><text display-inline="yes-display-inline">In awarding grants under this section, the Director shall endeavor to ensure that the recipients are from a variety of types of institutions of higher education and nonprofit, nondegree-granting research organizations. In support of this goal, the Director shall broadly disseminate information about when and how to apply for grants under this section, including by conducting outreach to Historically Black Colleges and Universities that are part B institutions as defined in section 322(2) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1061">20 U.S.C. 1061(2)</external-xref>) and minority institutions (as defined in section 365(3) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1067k">20 U.S.C. 1067k(3)</external-xref>)). In awarding grants under this section, the Director shall give special consideration to eligible early-career researchers who have followed alternative career paths such as working part-time or in nonacademic settings, or who have taken a significant career break or other leave of absence.</text> </subsection> <subsection id="H2DB41E73666B483A9800B2007259EC45"><enum>(g)</enum><header>Authorization of Appropriation</header><text display-inline="yes-display-inline">For each of the fiscal years 2008 through 2012, the Director shall allocate at least 3.5 percent of funds appropriated to the National Science Foundation for Research and Related Activities to the grants program under this section, except to the extent that a sufficient number of meritorious grant applications have not been received for a fiscal year.</text> </subsection> <subsection id="H993BE5C8C86D4EA3A3FA2EDBF2BB5B6F"><enum>(h)</enum><header>Report</header><text>Not later than 6 months after the date of enactment of this Act, the Director shall transmit to the Committee on Science and Technology of the House of Representatives and to the Committee on Commerce, Science, and Transportation of the Senate a report describing the distribution of the institutions from which individuals have participated in the Faculty Early Career Development Program since fiscal year 2001 among each of the categories of institutions of higher education defined by the Carnegie Foundation for the Advancement of Teaching and the organizations in subsection (c)(2).</text> </subsection> <subsection id="HB57921EF05C444BBBD32CE386400E3BA"><enum>(i)</enum><header>Evaluation</header><text>Not later than 2 years after the date of enactment of this Act, the Director shall transmit to the Committee on Science and Technology of the House of Representatives and to the Committee on Commerce, Science, and Transportation of the Senate a report evaluating the impact of the program carried out under this section on the ability of young faculty to compete for National Science Foundation research grants.</text> </subsection></section> <section id="H02D2240D2C54427E8B99EA8900855631"><enum>203.</enum><header>Department of Energy early career awards for science and engineering researchers</header> <subsection id="H8AE1D23F3FAB4C47AA14E862003FF33E"><enum>(a)</enum><header>In General</header><text display-inline="yes-display-inline">The Director of the Office of Science of the Department of Energy shall carry out a program to award grants to scientists and engineers at the early stage of their careers at institutions of higher education and organizations described in subsection (c)(2) to conduct research in fields relevant to the mission of the Department, giving priority to grants to expand domestic energy production and use through coal-to-liquids technology and advanced nuclear reprocessing.</text> </subsection> <subsection id="HD3FEA8AACD714355BC1017AB00EFB534"><enum>(b)</enum><header>Size and Duration of Award</header><text>The duration of awards under this section shall be up to 5 years, and the amount per year shall be at least $80,000.</text> </subsection> <subsection id="H8C83F3DA9DFA419390DFC774B85033E0"><enum>(c)</enum><header>Eligibility</header><text>Award recipients shall be individuals who are employed in a tenure-track position as an assistant professor or equivalent title, or who hold an equivalent position, at—</text> <paragraph id="H27A464A0773540C4A543E41226FFD56D"><enum>(1)</enum><text>an institution of higher education in the United States; or</text> </paragraph> <paragraph id="H7B7AC88259A24E27AC6800005318302F"><enum>(2)</enum><text>an organization in the United States that is a nonprofit, nondegree-granting research organization such as a museum, observatory, or research laboratory.</text> </paragraph></subsection> <subsection id="H66D2B633843245FFA0237F9BEBD13FBD"><enum>(d)</enum><header>Selection</header><text>Award recipients shall be selected on a competitive, merit-reviewed basis.</text> </subsection> <subsection id="HBBF5E975F0364970BA1681B3A06BC006"><enum>(e)</enum><header>Selection Process and Criteria for Awards</header><text>An applicant seeking funding under this section shall submit a proposal to the Director of the Office of Science at such time, in such manner, and containing such information as the Director may require. In evaluating the proposals submitted under this section, the Director shall consider, at a minimum—</text> <paragraph id="H93242D4ADE7948599D00849610928826"><enum>(1)</enum><text>the intellectual merit of the proposed work;</text> </paragraph> <paragraph id="H24FECEF8E8BE4A17A4DB5DBABA8FC286"><enum>(2)</enum><text>the innovative or transformative nature of the proposed research;</text> </paragraph> <paragraph id="H29C884FEB85B4F82BAD1923E4DCDD526"><enum>(3)</enum><text>the extent to which the proposal integrates research and education, including undergraduate education in science and engineering disciplines; and</text> </paragraph> <paragraph id="H2965CBCE43CF4DAE90AEF5DD45FE11"><enum>(4)</enum><text>the potential of the applicant for leadership at the frontiers of knowledge.</text> </paragraph></subsection> <subsection id="HF9CA2692A16D4E3A001477485919D57D"><enum>(f)</enum><header>Collaboration With National Laboratories</header><text>In awarding grants under this section, the Director shall give priority to proposals in which the proposed work includes collaboration with the Department of Energy National Laboratories.</text> </subsection> <subsection id="HFF87EDE8799C47738F8B65D63D2DE01C"><enum>(g)</enum><header>Awards</header><text>In awarding grants under this section, the Director shall endeavor to ensure that the recipients are from a variety of types of institutions of higher education and nonprofit, nondegree-granting research organizations. In support of this goal, the Director shall broadly disseminate information about when and how to apply for grants under this section, including by conducting outreach to Historically Black Colleges and Universities that are part B institutions as defined in section 322(2) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1061">20 U.S.C. 1061(2)</external-xref>) and minority institutions (as defined in section 365(3) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1067k">20 U.S.C. 1067k(3)</external-xref>)).</text> </subsection> <subsection id="H8E5003AA72B04B1289C330E4E949E8E"><enum>(h)</enum><header>Authorization of Appropriations</header><text>There are authorized to be appropriated to the Secretary of Energy to carry out the Director’s responsibilities under this section $25,000,000 for each of the fiscal years 2008 through 2012.</text> </subsection> <subsection id="H97386211A67944379600588071007CEA"><enum>(i)</enum><header>Report on Recruiting and Retaining Early Career Science and Engineering Researchers at the National Laboratories</header><text>Not later than 3 months after the date of enactment of this Act, the Director of the Office of Science shall transmit to the Committee on Science and Technology of the House of Representatives and to the Committee on Energy and Natural Resources of the Senate a report on efforts to recruit and retain young scientists and engineers at the early stages of their careers at the Department of Energy National Laboratories. The report shall include—</text> <paragraph id="H5F987177D221498F8183DED225CBDE10"><enum>(1)</enum><text>a description of Department of Energy and National Laboratory policies and procedures, including financial incentives, awards, promotions, time set aside for independent research, access to equipment or facilities, and other forms of recognition, designed to attract and retain young scientists and engineers;</text> </paragraph> <paragraph id="HCD5E69B3C0AB4C67891FC8A2007606A4"><enum>(2)</enum><text>an evaluation of the impact of these incentives on the careers of young scientists and engineers at Department of Energy National Laboratories, and also on the quality of the research at the National Laboratories and in Department of Energy programs;</text> </paragraph> <paragraph id="H6C570B0EF6964C83BF39F3CCC8F767E4"><enum>(3)</enum><text>a description of what barriers, if any, exist to efforts to recruit and retain young scientists and engineers, including limited availability of full time equivalent positions, legal and procedural requirements, and pay grading systems; and</text> </paragraph> <paragraph id="H859EF3476DFC4340A629CEECB9AC9985"><enum>(4)</enum><text>the amount of funding devoted to efforts to recruit and retain young researchers and the source of such funds.</text> </paragraph></subsection></section> <section id="HD4BDC1A9310F4D09A4ADA9956955C1E5"><enum>204.</enum><header>Integrative graduate education and research traineeship program</header> <subsection id="H1E060DC311F54AEE8C0053687968078C"><enum>(a)</enum><header>Funding</header><text>For each of the fiscal years 2008 through 2012, the Director of the National Science Foundation shall allocate at least 1.5 percent of funds appropriated for Research and Related Activities to the Integrative Graduate Education and Research Traineeship program.</text> </subsection> <subsection id="H0934BAE9E51C400D008FC5DD8F778C13"><enum>(b)</enum><header>Coordination</header><text>The Director shall coordinate with Federal departments and agencies, as appropriate, to expand the interdisciplinary nature of the Integrative Graduate Education and Research Traineeship program.</text> </subsection> <subsection id="H35FDB56E5C524E5887575CC2812EA8E4"><enum>(c)</enum><header>Authority To Accept Funds From Other Agencies</header><text>The Director is authorized to accept funds from other Federal departments and agencies to carry out the Integrative Graduate Education and Research Traineeship program.</text> </subsection></section> <section id="HEF4447579F8E4282B409DAE7BBC72483"><enum>205.</enum><header>Presidential innovation award</header> <subsection id="HFC3061283A9B4D82BE0035F599045C75"><enum>(a)</enum><header>Establishment</header><text>The President shall periodically present the Presidential Innovation Award, on the basis of recommendations received from the Director of the Office of Science and Technology Policy or on the basis of such other information as the President considers appropriate, to individuals who develop one or more unique scientific or engineering ideas in the national interest at the time the innovation occurs.</text> </subsection> <subsection id="H0725F3DD78DE497298BCFE45E7BD6CEB"><enum>(b)</enum><header>Purpose</header><text>The awards under this section shall be made to—</text> <paragraph id="H6061C065CB2043A890802B791FBA88C1"><enum>(1)</enum><text>stimulate scientific and engineering advances in the national interest;</text> </paragraph> <paragraph id="H7859B7EAB2864DC6AC911BA059BE544B"><enum>(2)</enum><text>illustrate the linkage between science and engineering and national needs;</text> </paragraph> <paragraph id="HE0117D23C34F4FF693584C79424D00C7"><enum>(3)</enum><text>show the potential of such innovation to substantively enhance the economic competitiveness of the United States through development of commercializable intellectual property; and</text> </paragraph> <paragraph id="HCD947AAFAE3A4630BB2C4EFE0503CAC1"><enum>(4)</enum><text>provide an example to students of the contribution they could make to society by entering the science and engineering profession.</text> </paragraph></subsection> <subsection id="H97804CF225204C96AE75724445A4EDD4"><enum>(c)</enum><header>Citizenship</header><text>An individual is not eligible to receive the award under this section unless at the time such award is made the individual—</text> <paragraph id="H58E9AE5DC2CA46DD006D849899E15030"><enum>(1)</enum><text>is a citizen or other national of the United States; or</text> </paragraph> <paragraph id="H27ED94C463CB40EEB4853E81A558ACFE"><enum>(2)</enum><text>is an alien lawfully admitted to the United States for permanent residence who—</text> <subparagraph id="HEEFD7E31DD9145B9B54C74E34867178F"><enum>(A)</enum><text>has filed an application for naturalization in the manner prescribed by section 334 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1445">8 U.S.C. 1445</external-xref>); and</text> </subparagraph> <subparagraph id="H0603271FBB9D4BCBB71C9FDD959376CA"><enum>(B)</enum><text>is not permanently ineligible to become a citizen of the United States.</text> </subparagraph></paragraph></subsection> <subsection id="H67B463709A914211A7A47E521502715C"><enum>(d)</enum><header>Presentation</header><text>The presentation of the award shall be made by the President with such ceremonies as he may deem proper, including attendance by appropriate Members of Congress.</text> </subsection></section> <section id="HCEE4659976FC42F095294E067E8BC96C"><enum>206.</enum><header>National Coordination Office for Research Infrastructure</header> <subsection id="H811386D87D3449379610972381AAF8F9"><enum>(a)</enum><header>In general</header><text>The Office of Science and Technology Policy shall establish a National Coordination Office for Research Infrastructure. Such Office shall—</text> <paragraph id="HE37E77D3970E4437A1E7CFE8DB5413DF"><enum>(1)</enum><text>identify and prioritize the deficiencies in research facilities and major instrumentation located at academic institutions and at national laboratories that are available for use by academic researchers; and</text> </paragraph> <paragraph id="HF7DE9DB23F2645CC9873E40670CE0DF"><enum>(2)</enum><text>institute and coordinate the planning by Federal agencies for the acquisition, refurbishment, and maintenance of research facilities and major instrumentation required to address the deficiencies identified under paragraph (1).</text> </paragraph><continuation-text continuation-text-level="subsection">In prioritizing the deficiencies identified under paragraph (1), the Office shall consider research needs in areas relevant to the Nation’s economic competitiveness.</continuation-text></subsection> <subsection id="HD23B78DEA2E04ABF8926D48BBD01EF04"><enum>(b)</enum><header>Staffing</header><text>The Director of the Office of Science and Technology Policy shall appoint individuals to serve in the Office established under subsection (a) from among the principal Federal agencies that support research in the sciences, mathematics, and engineering, and shall at a minimum include individuals from the National Science Foundation and the Department of Energy.</text> </subsection> <subsection id="HB8DF90627A404CFF836587725345EEC5"><enum>(c)</enum><header>Report</header><text>The Director of the Office of Science and Technology Policy shall provide annually a report to Congress at the time of the President’s budget proposal—</text> <paragraph id="H928EA56E7A7849CCB383C500C63FADB"><enum>(1)</enum><text>describing the research infrastructure needs identified in accordance with subsection (a);</text> </paragraph> <paragraph id="H804E6FB20AD644CE921976F54C5769EA"><enum>(2)</enum><text>listing research facilities projects and budget proposals, by agency, for major instrumentation acquisitions that are included in the President’s budget proposal; and</text> </paragraph> <paragraph id="H879857E0F39F4C9DBE39D898B285CBD1"><enum>(3)</enum><text>explaining how these facilities projects and instrumentation acquisitions relate to the deficiencies and priorities arrived at in accordance with subsection (a).</text> </paragraph></subsection></section> <section id="HE04F64093C7C48A083B41F57425BE912"><enum>207.</enum><header>Research on innovation and inventiveness</header><text display-inline="no-display-inline">In carrying out its research programs on science policy and on the science of learning, the National Science Foundation may support research on the process of innovation and the teaching of inventiveness.</text> </section> <section id="H32B5892836F449668F8884D097ED894B"><enum>208.</enum><header>Report on National Institute of Standards and Technology efforts to recruit and retain early CAREER science and engineering researchers</header><text display-inline="no-display-inline">Not later than 3 months after the date of enactment of this Act, the Director of the National Institute of Standards and Technology shall transmit to the Committee on Science and Technology of the House of Representatives and to the Committee on Commerce, Science, and Transportation of the Senate a report on efforts to recruit and retain young scientists and engineers at the early stages of their careers at the National Institute of Standards and Technology laboratories and joint institutes. The report shall include—</text> <paragraph id="H29EABC1E2B5F4E2E9858FC463834C778"><enum>(1)</enum><text>a description of National Institute of Standards and Technology policies and procedures, including financial incentives, awards, promotions, time set aside for independent research, access to equipment or facilities, and other forms of recognition, designed to attract and retain young scientists and engineers;</text> </paragraph> <paragraph id="H32D7A2E37A524D88BDEE049927057FCD"><enum>(2)</enum><text>an evaluation of the impact of these incentives on the careers of young scientists and engineers at the National Institute of Standards and Technology, and also on the quality of the research at the National Institute of Standards and Technology’s laboratories and in the National Institute of Standards and Technology’s programs;</text> </paragraph> <paragraph id="HBF5CA56DDF564840B14F0471B4E216FE"><enum>(3)</enum><text>a description of what barriers, if any, exist to efforts to recruit and retain young scientists and engineers, including limited availability of full time equivalent positions, legal and procedural requirements, and pay grading systems; and</text> </paragraph> <paragraph id="H567AD56CF4F94AA4A28F41FACA010000"><enum>(4)</enum><text>the amount of funding devoted to efforts to recruit and retain young researchers and the source of such funds.</text> </paragraph></section> <section display-inline="no-display-inline" id="H77622FFB7FF447679808C979F9289DD0" section-type="subsequent-section"><enum>209.</enum><header>NASA’s contribution to innovation</header> <subsection id="HE9BC3FD424CC427EB34787BF2082D800"><enum>(a)</enum><header>Sense of the Congress</header><text>It is the sense of the Congress that—</text> <paragraph id="HD6EF3291F21342408470BE87D646225F"><enum>(1)</enum><text>a balanced science program as authorized by section 101(d) of the National Aeronautics and Space Administration Authorization Act of 2005 (<external-xref legal-doc="public-law" parsable-cite="pl/109/155">Public Law 109–155</external-xref>) contributes significantly to innovation in and the economic competitiveness of the United States; and</text> </paragraph> <paragraph id="H3B976325A7C140B400F996FDC9381644"><enum>(2)</enum><text>a robust National Aeronautics and Space Administration, funded at the levels authorized under sections 202 and 203 of that Act, would offer a balance among science, aeronautics, exploration, and human space flight programs, all of which can attract and employ scientists, engineers, and technicians across a broad range of fields in science, technology, mathematics, and engineering.</text> </paragraph></subsection> <subsection id="HD88B53306AFE4CC98CADE13B869D9D7"><enum>(b)</enum><header>Participation in innovation and competitiveness programs</header><text>The Administrator of the National Aeronautics and Space Administration shall fully participate in any interagency efforts to promote innovation and economic competitiveness through scientific research and development within the spending levels cited in subsection (a).</text> </subsection></section> <section id="H6C5AD3D596534F108DCF7040026D5545"><enum>210.</enum><header>Undergraduate scholarships for science, technology, engineering, and mathematics</header> <subsection id="HE1F9EDD020994291A0D7FAB5936531A5"><enum>(a)</enum><header>Establishment</header><text>The National Science Foundation shall establish a program, to be known as the Undergraduate Scholarships for Science, Technology, Engineering, and Mathematics, or US–STEM, program, for awarding scholarships to undergraduate scholars in science, technology, engineering, and mathematics.</text> </subsection> <subsection id="H6D117C423AF448D49929668F55404088"><enum>(b)</enum><header>Eligibility</header><text>A student is eligible for a scholarship under this section only if the student—</text> <paragraph id="HC0AEC535201F45960094F8725339ED90"><enum>(1)</enum><text>is enrolled at a public, 4-year college or university;</text> </paragraph> <paragraph id="H1A6765965BF4476B828D266F32A04160"><enum>(2)</enum><text>will have completed at least one-half of the credit requirements for an undergraduate degree before beginning studies to be funded by the scholarship;</text> </paragraph> <paragraph id="H7FBC355F50364A79AE8C2700CC5901B5"><enum>(3)</enum><text>has maintained a grade point average in undergraduate studies of at least 3.0 on a scale of 4.0, or an equivalent level as calculated by the National Science Foundation, except that if the student’s institution appeals this criterion on the basis of undue hardship on the student, the National Science Foundation may waive this paragraph;</text> </paragraph> <paragraph id="H2A7380B7CCED44018D007F24BA511CA8"><enum>(4)</enum><text>has a total family income of less than $75,000 per year, with such amount to be adjusted annually by the National Science Foundation for inflation;</text> </paragraph> <paragraph id="HD3721B2D77CE4DD792C68EC81EB36D23"><enum>(5)</enum><text>has not been convicted of a felony; and</text> </paragraph> <paragraph id="H1A1592BD61DA43D9807732B94EAC149C"><enum>(6)</enum><text>is a citizen or permanent resident alien of the United States.</text> </paragraph></subsection> <subsection id="H8AD3D54A597B4F4A955CBBFC67753B53"><enum>(c)</enum><header>Selection criteria</header><text>Scholarship recipients shall be selected on the basis of merit and such other criteria as the National Science Foundation shall establish.</text> </subsection> <subsection id="H8F45555BFC8643CDA0DC3D46796250C7"><enum>(d)</enum><header>Awards</header><text>The National Science Foundation shall announce awards before April 1 for each upcoming academic year, and may make up to 2,500 awards per year. Awards may be made for a maximum of 2 academic years for each student, and scholarship amounts shall be paid to the institution.</text> </subsection> <subsection id="H0D1A8639E5C84944A3A02E2458B8E105"><enum>(e)</enum><header>Advisory Board</header><text>The Director of the National Science Foundation shall establish an advisory board, which shall make recommendations to the Director for selection criteria for scholarship recipients, and provide guidance and oversight for the program.</text> </subsection></section> <enum>III</enum><header>National Science Foundation</header> <section display-inline="no-display-inline" id="HBD3E540444674E5CBB8F46B1337BECC" section-type="subsequent-section"><enum>301.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>National Science Foundation Authorization Act of 2007</short-title></quote>.</text> </section> <section id="HA7E2128F90CC403E958D00345E6B3CFB"><enum>302.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text> <paragraph id="H126DE1EFE6E5467F8965AB7F95838DA0"><enum>(1)</enum><header>Board</header><text>The term <term>Board</term> means the National Science Board established under section 2 of the National Science Foundation Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/42/1861">42 U.S.C. 1861</external-xref>).</text> </paragraph> <paragraph id="H6E5EAB497878471EA229FE6866097F48"><enum>(2)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Foundation.</text> </paragraph> <paragraph id="H3ED6497D4DBC4C2489579BC4BC6DBEB0"><enum>(3)</enum><header>Elementary school</header><text>The term <term>elementary school</term> has the meaning given that term by section 9101(18) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801(18)</external-xref>).</text> </paragraph> <paragraph id="H77956E99BB724A8B8E71CB50083ABCC"><enum>(4)</enum><header>Foundation</header><text>The term <term>Foundation</term> means the National Science Foundation.</text> </paragraph> <paragraph id="HFD251B13F99B4A439D267D008D91A3E"><enum>(5)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> has the meaning given such term in section 101(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>).</text> </paragraph> <paragraph id="H88EC7D04CB604C8ABFBCB084FCDF4E56"><enum>(6)</enum><header>Secondary school</header><text>The term <term>secondary school</term> has the meaning given that term by section 9101(38) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801(38)</external-xref>).</text> </paragraph></section> <section id="HAAD2B8CD13B54175825C77BE34398CDC"><enum>303.</enum><header>Authorization of appropriations</header> <subsection id="H70B7F57DE437414DB84E5136A8B6D700"><enum>(a)</enum><header>Fiscal year 2008</header> <paragraph id="H3F070C5D95484F1282DA1E5119F03418"><enum>(1)</enum><header>In general</header><text>There are authorized to be appropriated to the Foundation $6,500,000,000 for fiscal year 2008.</text> </paragraph> <paragraph id="H9844A7D91E154E4B90BF17B136A18D47"><enum>(2)</enum><header>Specific allocations</header><text>Of the amount authorized under paragraph (1)—</text> established by section 3(a) of the Scientific and Advanced-Technology Act of 1992 (<external-xref legal-doc="public-law" parsable-cite="pl/102/476">Public Law 102–476</external-xref>);</text> </clause></subparagraph> <subparagraph id="HB056D1D32C154678AEF486B1A29232B2"><enum>(C)</enum><text>$280,000,000 shall be made available for major research equipment and facilities construction;</text> </subparagraph> <subparagraph id="HF0A514CB38324D6591F99700AD3CB35C"><enum>(D)</enum><text>$329,450,000 shall be made available for agency operations and award management;</text> </subparagraph> <subparagraph id="HAE13982ECB794EF0B1EFA752792B65C"><enum>(E)</enum><text>$4,250,000 shall be made available for the Office of the National Science Board; and</text> </subparagraph> <subparagraph id="HA6976FD22F4E452699607F7C6DBAEB26"><enum>(F)</enum><text>$13,100,000 shall be made available for the Office of Inspector General.</text> </subparagraph></paragraph></subsection> <subsection id="H5612F670B6494DF69CD61638E37D5D8"><enum>(d)</enum><header>Major research instrumentation</header> <paragraph id="HD35CAEB410E64BC8894428B667B63ECD"><enum>(1)</enum><header>Award amount</header><text>The minimum amount of an award under the Major Research Instrumentation program shall be $100,000. The maximum amount of an award under the program shall be $4,000,000, except if the total amount appropriated for the program for a fiscal year exceeds $125,000,000, in which case the maximum amount of an award shall be $6,000,000.</text> </paragraph> <paragraph id="H0C54C3BD94034F57AFBABB8CBDDB2B0"><enum>(2)</enum><header>Use of funds</header><text>In addition to the acquisition of instrumentation and equipment, funds made available by awards under the Major Research Instrumentation program may be used to support the operations and maintenance of such instrumentation and equipment.</text> </paragraph> <paragraph id="H8D385AA0BC8044F69D90CC00006C0BF"><enum>(3)</enum><header>Cost sharing</header> <subparagraph id="H16695458D32A4E4F9EF59223D3803B1"><enum>(A)</enum><header>In general</header><text>An institution of higher education receiving an award shall provide at least 30 percent of the cost from private or non-Federal sources.</text> </subparagraph> <subparagraph id="HE96EC996FBF94EDDB0AC26987778009D"><enum>(B)</enum><header>Exceptions</header><text>Institutions of higher education that are not Ph.D.-granting institutions are exempt from the cost sharing requirement in subparagraph (A), and the Director may reduce or waive the cost sharing requirement for—</text> <clause id="H197267D6F1EB413284172BEDB9F93FD9"><enum>(i)</enum><text>institutions—</text> <subclause id="H62986A89BB3546F39CC7E91FE2EB67E3"><enum>(I)</enum><text>which are not ranked among the top 100 institutions receiving Federal research and development funding, as documented by the statistical data published by the Foundation; and</text> </subclause> <subclause id="H3C1EA713E2F74D22AF990079288B1351"><enum>(II)</enum><text display-inline="yes-display-inline">for which the proposed project will make a substantial improvement in the institution’s capabilities to conduct leading edge research, to provide research experiences for undergraduate students using leading edge facilities, and to broaden the participation in science and engineering research by individuals identified in section 33 or 34 of the Science and Engineering Equal Opportunities Act (42 U.S.C. 1885a or 1885b); and</text> </subclause></clause> <clause id="HC3F35817B1DF46DCA1C93D31F90020A8"><enum>(ii)</enum><text>consortia of institutions of higher education that include at least one institution that is not a Ph.D-granting institution.</text> </clause></subparagraph></paragraph></subsection> <subsection id="HE59D2DF9B9AF477793083EF689BD3324"><enum>(e)</enum><header>Undergraduate education programs</header><text>The Director shall continue to carry out programs in support of undergraduate education, including those authorized in section 17 of the National Science Foundation Authorization Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/1862n-6">42 U.S.C. 1862n–6</external-xref>). Funding for these programs shall increase in proportion to the increase in the total amount appropriated to the Foundation in any year for which appropriations are authorized by this title.</text> </subsection> <subsection id="H2940842520B74C14B877E270C84CC5CB"><enum>(f)</enum><header>Limit on proposals</header> <paragraph id="H341CA7CDCC594F0CAA1900EF00F612FE"><enum>(1)</enum><header>Policy</header><text>For programs that require as part of the selection process for awards the submission of preproposals and that also limit the number of preproposals that may be submitted by an institution, the Director shall allow the subsequent submission of a full proposal based on each preproposal that is determined to have merit following the Foundation’s merit review process.</text> </paragraph> <paragraph id="H68D55C5F134C423CB440C7F2B180A12"><enum>(2)</enum><header>Review and assessment of policies</header><text>The Board shall review and assess the effects on institutions of higher education of the policies of the Foundation regarding the imposition of limitations on the number of proposals that may be submitted by a single institution for programs supported by the Foundation. The Board shall determine whether current policies are well justified and appropriate for the types of programs that limit the number of proposal submissions. Not later that 1 year after the date of enactment of this Act, the Board shall summarize its findings and any recommendations regarding changes to the current policy on the restriction of proposal submissions in a report to the Committee on Science and Technology of the House of Representatives and to the Committee on Commerce, Science, and Transportation and the Committee on Health, Education, Labor, and Pensions of the Senate.</text> </paragraph></subsection> <subsection display-inline="no-display-inline" id="HB6497F3DEE0D48AD9405ED922415D5B6"><enum>(g)</enum><header>Research experiences for undergraduates</header><text display-inline="yes-display-inline">The Director shall increase funding for the Research Experiences for Undergraduates program in proportion to the increase in the total amount appropriated to the Foundation for research and related activities in any year for which appropriations are authorized by this title.</text> </subsection> <subsection id="HE107440D6A584B30801354BEDDE1623E"><enum>(h)</enum><header>Global Warming Education</header> <paragraph id="H5C941287412C4C73000500DDB7710014"><enum>(1)</enum><header>Informal Education</header><text>As part of Informal Science Education activities, the Director shall support activities to create informal educational materials, exhibits, and multimedia presentations relevant to global warming, climate science, and greenhouse gas reduction strategies.</text> </paragraph> <paragraph id="H8657663ED9294CD68547D2EE0023F575"><enum>(2)</enum><header>K–12 Instructional Materials</header><text display-inline="yes-display-inline">As part of Discovery Research K–12 activities, the Director shall support the development of K–12 educational materials relevant to global warming, climate science, and greenhouse gas reduction strategies.</text> </paragraph></subsection></section> <section id="HBE857702299D4C42B792BCAA1B1600B5"><enum>304.</enum><header>Centers for research on learning and education improvement</header> <subsection id="H5561107B39B948D18F19BA59AFD8F1BA"><enum>(a)</enum><header>Funding for Centers</header><text display-inline="yes-display-inline">The Director shall continue to carry out the program of Centers for Research on Learning and Education Improvement as established in section 11 of the National Science Foundation Authorization Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/1862n-2">42 U.S.C. 1862n–2</external-xref>).</text> </subsection> <subsection id="HDF212FD68F6E4FD5AE10FD3B22E4C46D"><enum>(b)</enum><header>Eligibility for centers</header><text display-inline="yes-display-inline">Section 11 of the National Science Foundation Authorization Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/1862n-2">42 U.S.C. 1862n–2</external-xref>) is amended—</text> <paragraph id="HF6C82E3B7BB24D98B5DB3CBC95050082"><enum>(1)</enum><text>in subsection (a)(1), by inserting <quote>or eligible nonprofit organizations</quote> after <quote>institutions of higher education</quote>;</text> </paragraph> <paragraph id="HAFFCB618943846AEBA2C6148B9DA08CE"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b)(1) by inserting <quote>or an eligible nonprofit organization</quote> after <quote>institution of higher education</quote>; and</text> </paragraph> <paragraph id="HD0C05FEE9EDE4440B26C0001D943C408"><enum>(3)</enum><text>in subsection (b)(1) by striking <quote>of such institutions</quote> and inserting <quote>thereof</quote>.</text> </paragraph></subsection></section> <section id="H2916A042E86D40DDA3DAE08F3661CF60"><enum>305.</enum><header>Interdisciplinary research</header> <subsection id="HF6D66DE3EC32446F80C01B761BD97641"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Board shall evaluate the role of the Foundation in supporting interdisciplinary research, including through the Major Research Instrumentation program, the effectiveness of the Foundation’s efforts in providing information to the scientific community about opportunities for funding of interdisciplinary research proposals, and the process through which interdisciplinary proposals are selected for support. The Board shall also evaluate the effectiveness of the Foundation’s efforts to engage undergraduate students in research experiences in interdisciplinary settings, including through the Research in Undergraduate Institutions program and the Research Experiences for Undergraduates program.</text> </subsection> <subsection id="H106232DF95854787A94BD1520082FD66"><enum>(b)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, the Board shall provide the results of its evaluation under subsection (a), including a recommendation for the proportion of the Foundation’s research and related activities funding that should be allocated for interdisciplinary research, to the Committee on Science and Technology of the House of Representatives and the Committee on Commerce, Science, and Transportation and the Committee on Health, Education, Labor, and Pensions of the Senate.</text> </subsection></section> <section id="H14D7C01912D54224B01E68F075B867D3"><enum>306.</enum><header>Pilot program of grants for new investigators</header> <subsection id="H644C3849901A402CAFCAC94FE945A35E"><enum>(a)</enum><header>In general</header><text>The Director shall carry out a pilot program to award one-year grants to individuals to assist them in improving research proposals that were previously submitted to the Foundation but not selected for funding.</text> </subsection> <subsection display-inline="no-display-inline" id="H8505CEEE473240BFAD00C76313F464DE"><enum>(b)</enum><header>Use of funds</header><text>Grants awarded under this section shall be used to enable an individual to resubmit an updated research proposal for review by the Foundation through the agency’s competitive merit review process. Uses of funds made available under this section may include the generation of new data and the performance of additional analysis.</text> </subsection> <subsection id="H22AD6288D9BF4CA5A4EB223FCE19D240"><enum>(c)</enum><header>Eligibility</header><text>To be eligible to receive a grant under this section, an individual shall—</text> <paragraph id="HA1EABFB3D97B4404B3BF9559F583815F"><enum>(1)</enum><text>not have previously received funding as the principal investigator of a research grant from the Foundation; and</text> </paragraph> <paragraph id="H139E20DCE5E244BEA079C191C0E1B2E9"><enum>(2)</enum><text display-inline="yes-display-inline">have submitted a proposal to the Foundation, which may include a proposal submitted to the Research in Undergraduate Institutions program, that was rated very good or excellent under the Foundation’s competitive merit review process.</text> </paragraph></subsection> <subsection id="HA4A8364E9F09410D009888CBA5072CEE"><enum>(d)</enum><header>Selection process</header><text>The Director shall make awards under this section based on the advice of the program officers of the Foundation.</text> </subsection> <subsection id="H1C4635C22DC6454C97E8DAFE014E5EA"><enum>(e)</enum><header>Program administration</header><text>The Director may carry out this section through the Small Grants for Exploratory Research program.</text> </subsection> <subsection id="H96887CD5A94548C0A345EF94F0AF163D"><enum>(f)</enum><header>National science board review</header><text display-inline="yes-display-inline">The Board shall conduct a review and assessment of the pilot program under this section, including the number of new investigators funded, the distribution of awards by type of institution of higher education, and the success rate upon resubmittal of proposals by new investigators funded through this pilot program. Not later than 3 years after the date of enactment of this Act, the Board shall summarize its findings and any recommendations regarding changes to or the continuation of the pilot program in a report to the Committee on Science and Technology of the House of Representatives and the Committee on Commerce, Science, and Transportation and the Committee on Health, Education, Labor, and Pensions of the Senate.</text> </subsection></section> <section id="HDB07B97ED7704FD993AEDFE91E1E6B8"><enum>307.</enum><header>Broader impacts merit review criterion</header> <subsection id="H8B570F75B48642B4A0E7009B2D8B943F"><enum>(a)</enum><header>In general</header><text>In evaluating research proposals under the Foundation’s broader impacts criterion, the Director shall give special consideration to proposals that involve partnerships between academic researchers and industrial scientists and engineers that address research areas that have been identified as having high importance for future national economic competitiveness, such as nanotechnology.</text> </subsection> <subsection id="HD3B65B59A35C459383D1B791F1A34796"><enum>(b)</enum><header>Partnerships with industry</header><text display-inline="yes-display-inline">The Director shall encourage research proposals from institutions of higher education that involve partnerships with businesses and organizations representing businesses in fields that have been identified as having high importance for future national economic competitiveness and that include input on the research agenda from and cost-sharing by the industry partners.</text> </subsection> <subsection id="HD4EFBDD6FC2B4E3AA9B3BC49184398B1"><enum>(c)</enum><header>Report on broader impacts criterion</header><text>Not later than 1 year after the date of enactment of this Act, the Director shall transmit to Congress a report on the impact of the broader impacts grant criterion used by the Foundation. The report shall—</text> <paragraph id="H3357871014354A7694A9C1A1EFF86FEF"><enum>(1)</enum><text>identify the criteria that each division and directorate of the Foundation uses to evaluate the broader impacts aspects of research proposals;</text> </paragraph> <paragraph id="H68CA749F89EA437C929FD8F1DAF4BA6D"><enum>(2)</enum><text>provide a breakdown of the types of activities by division that awardees have proposed to carry out to meet the broader impacts criterion;</text> </paragraph> <paragraph id="HD339E205C24D451696582D19C1002F7D"><enum>(3)</enum><text>provide any evaluations performed by the Foundation to assess the degree to which the broader impacts aspects of research proposals were carried out and how effective they have been at meeting the goals described in the research proposals;</text> </paragraph> <paragraph id="HE54169E8CBBE40D1922EABDD7F0939E"><enum>(4)</enum><text>describe what national goals, such as improving undergraduate science, mathematics, and engineering education, improving K–12 science and mathematics education, promoting university-industry collaboration and technology transfer, and broadening participation of underrepresented groups, the broader impacts criterion is best suited to promote; and</text> </paragraph> <paragraph id="H7495CEA15F0B42D3822DEC007C20B9A"><enum>(5)</enum><text>describe what steps the Foundation is taking and should take to use the broader impacts criterion to improve undergraduate science, mathematics, and engineering education.</text> </paragraph></subsection></section> <section id="HC87DF4B9A4CE45F19B19B1342210B3DF"><enum>308.</enum><header>Postdoctoral research fellows</header> <subsection id="H8715E95D9BDC41AC8078BC8509C94890"><enum>(a)</enum><header>Mentoring</header><text>The Director shall require that all grant applications that include funding to support postdoctoral researchers include a description of the mentoring activities that will be provided for such individuals, and shall ensure that this part of the application is evaluated under the Foundation’s broader impacts merit review criterion. Mentoring activities may include career counseling, training in preparing grant applications, guidance on ways to improve teaching skills, and training in research ethics.</text> </subsection> <subsection id="H43948ECC63D14305BC4C17F00001FC2C"><enum>(b)</enum><header>Reports</header><text>The Director shall require that annual reports and the final report for research grants that include funding to support postdoctoral researchers include a description of the mentoring activities provided to such researchers.</text> </subsection></section> <section id="HAC46127035124AF4A3004E7487682707"><enum>309.</enum><header>Responsible conduct of research</header><text display-inline="no-display-inline">The Director shall require that each institution that applies for financial assistance from the Foundation for science and engineering research or education describe in its grant proposal a plan to provide appropriate training and oversight in the responsible and ethical conduct of research to undergraduate students, graduate students, and postdoctoral researchers participating in the proposed research project.</text> </section> <section id="HD56A6ED6493F43C1814244A4C2C3CAD9"><enum>310.</enum><header>Reporting of research results</header><text display-inline="no-display-inline">The Director shall ensure that all final project reports and citations of published research documents resulting from research funded, in whole or in part, by the Foundation, are made available to the public in a timely manner and in electronic form through the Foundation’s Web site.</text> </section> <section id="HC78D86729C914359BBDDFC3BFEB8C76"><enum>311.</enum><header>Sharing research results</header><text display-inline="no-display-inline">An investigator supported under a Foundation award, whom the Director determines has failed to comply with the provisions of section 734 of the Foundation Grant Policy Manual, shall be ineligible for a future award under any Foundation supported program or activity. The Director may restore the eligibility of such an investigator on the basis of the investigator’s subsequent compliance with the provisions of section 734 of the Foundation Grant Policy Manual and with such other terms and conditions as the Director may impose.</text> </section> <section id="H57756ADEEB3742889C8537EC19E03740"><enum>312.</enum><header>Funding for successful stem education programs</header> <subsection id="H997EEFFBC71746EEA5943000D4DF0089"><enum>(a)</enum><header>Evaluation of programs</header><text>The Director shall, on an annual basis, evaluate all of the Foundation’s grants that are scheduled to expire within one year and—</text> <paragraph id="HEE6CD42045BB404B9C2EE87F44D22B4B"><enum>(1)</enum><text>that have the primary purpose of meeting the objectives of the Science and Engineering Equal Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1885">42 U.S.C. 1885 et seq.</external-xref>); or</text> </paragraph> <paragraph id="HE2470053FFCF424C956DB69E16CC81E0"><enum>(2)</enum><text>that have the primary purpose of providing teacher professional development.</text> </paragraph></subsection> <subsection id="H8BA4C3C4844D4F4881893EE40BCCB24"><enum>(b)</enum><header>Continuation of funding</header><text>For grants that are identified under subsection (a) and that are deemed by the Director to be successful in meeting the objectives of the initial grant solicitation, the Director may extend the duration of those grants for up to 3 additional years beyond their scheduled expiration without the requirement for a recompetition. The Director may extend such grants for an additional 3 years following a second review within 1 year before the extended completion date, in accordance with subsection (a), and the determination by the Director that the objectives of the grant are being achieved.</text> </subsection> <subsection id="H94E2C5F64372439B923533D9F1B0D91C"><enum>(c)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this Act, the Director shall submit a report to the Committee on Science and Technology of the House of Representatives and to the Committee on Commerce, Science, and Transportation and the Committee on Health, Education, Labor, and Pensions of the Senate that—</text> <paragraph id="H94949B53AFA347E696CB0155038FDD1F"><enum>(1)</enum><text>lists the grants which have been extended in duration by the authority provided under this section; and</text> </paragraph> <paragraph id="H54CFF4804C724B2DA1A24E985B000801"><enum>(2)</enum><text>provides any recommendations the Director may have regarding the extension of the authority provided under this section to programs other than those specified in subsection (a).</text> </paragraph></subsection></section> <section id="HAF98064E9C9E4B23A339C9A895A06B1B"><enum>313.</enum><header>Cost sharing</header> <subsection id="H762B174C6C364A0CAF59F9DD512B5D55"><enum>(a)</enum><header>In general</header><text>The Board shall evaluate the impact of its policy to eliminate cost sharing for research grants and cooperative agreements for existing programs that were developed around industry partnerships and historically required industry cost sharing, such as the Engineering Research Centers and Industry/University Cooperative Research Centers. The Board shall also consider the impact that the cost sharing policy has on initiating new programs for which industry interest and participation are sought.</text> </subsection> <subsection id="H43033706C2844E789450701CAD595CB1"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 6 months after the date of enactment of this Act, the Board shall report to the Committee on Science and Technology and the Committee on Appropriations of the House of Representatives, and the Committee on Commerce, Science, and Transportation, the Committee on Health, Education, Labor, and Pensions, and the Committee on Appropriations of the Senate, on the results of the evaluation under subsection (a).</text> </subsection></section> <section id="H91384B3EB69F48D5858700DCAEEAE159"><enum>314.</enum><header>Donations</header><text display-inline="no-display-inline">Section 11(f) of the National Science Foundation Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/42/1870">42 U.S.C. 1870(f)</external-xref>) is amended by inserting at the end before the semicolon <quote>, except that funds may be donated for specific prize competitions</quote>.</text> </section> <section id="HEB24DC8E1C70473C9D2741FAA7EE008F"><enum>315.</enum><header>Additional reports</header> <subsection id="H4D2CB14D670C4DD7A00085FFB6C472F4"><enum>(a)</enum><header>Report on funding for major facilities</header> <paragraph id="HC93D2189BC554C76A3EA2BA057A99F00"><enum>(1)</enum><header>Preconstruction funding</header><text>The Board shall evaluate the appropriateness of the requirement that funding for detailed design work and other preconstruction activities for major research equipment and facilities come exclusively from the sponsoring research division rather than being available, at least in part, from the Major Research Equipment and Facilities Construction account.</text> </paragraph> <paragraph id="H656E256168C544B9B9B5FD5E2CDD8FA"><enum>(2)</enum><header>Maintenance and operation costs</header><text>The Board shall evaluate the appropriateness of the Foundation’s policies for allocation of costs for, and oversight of, maintenance and operation of major research equipment and facilities.</text> </paragraph> <paragraph id="H49109752A6DB499BBFB8F21EE7D52CFB"><enum>(3)</enum><header>Report</header><text>Not later than 6 months after the date of enactment of this Act, the Board shall report on the results of the evaluations under paragraphs (1) and (2) and on any recommendations for modifying the current policies related to allocation of funding for major research equipment and facilities to the Committee on Science and Technology and the Committee on Appropriations of the House of Representatives, and to the Committee on Commerce, Science, and Transportation, the Committee on Health, Education, Labor, and Pensions, and the Committee on Appropriations of the Senate.</text> </paragraph></subsection> <subsection commented="no" id="HA077950342704290BF577371798F71E"><enum>(b)</enum><header>Inclusion of polar facilities upgrades in major research equipment and facilities construction plan</header><text display-inline="yes-display-inline">Section 201(a)(2)(D) of the National Science Foundation Authorization Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/42/1862l">42 U.S.C. 1862l(a)(2)(D)</external-xref>) is amended by inserting <quote>and for major upgrades of facilities in support of Antarctic research programs</quote> after <quote>facilities construction account</quote>.</text> </subsection> <subsection id="HFCE339269C5747459B77949DED659EB"><enum>(c)</enum><header>Report on education programs within the research directorates</header><text display-inline="yes-display-inline">Not later than 6 months after the date of enactment of this Act, the Director shall transmit to the Committee on Science and Technology of the House of Representatives and the Committee on Commerce, Science, and Transportation and the Committee on Health, Education, Labor, and Pensions of the Senate a report cataloging all elementary and secondary school, informal, and undergraduate educational programs and activities supported through appropriations for Research and Related Activities. The report shall display the programs and activities by directorate, along with estimated funding levels for the fiscal years 2006, 2007, and 2008, and shall provide a description of the goals of each program and activity. The report shall also describe how the programs and activities relate to or are coordinated with the programs supported by the Education and Human Resources Directorate.</text> </subsection> <subsection id="H9EBF4A67DEE240E79C4BA8692FB5CFC5"><enum>(d)</enum><header>Report on research in undergraduate institutions program</header><text>The Director shall transmit to Congress along with the fiscal year 2011 budget request a report listing the funding success rates and distribution of awards for the Research in Undergraduate Institutions program, by type of institution based on the highest academic degree conferred by the institution, for fiscal years 2008, 2009, and 2010.</text> </subsection> <subsection id="H6006CF57DD864E00BBBDD43351B6BE24"><enum>(e)</enum><header>Annual plan for allocation of education and human resources funding</header> <paragraph id="HCF22DDBA7FE34A1DA16FC38DB2806BD1"><enum>(1)</enum><header>In general</header><text>Not later than 60 days after the date of enactment of legislation providing for the annual appropriation of funds for the Foundation, the Director shall submit to the Committee on Science and Technology and the Committee on Appropriations of the House of Representatives, and to the Committee on Commerce, Science, and Transportation, the Committee on Health, Education, Labor, and Pensions, and the Committee on Appropriations of the Senate, a plan for the allocation of education and human resources funds authorized by this title for the corresponding fiscal year, including any funds from within the research and related activities account used to support activities that have the primary purpose of improving education or broadening participation.</text> </paragraph> <paragraph id="H4A91037895A84F1F9D870000D3B1BDA8"><enum>(2)</enum><header>Specific requirements</header><text>The plan shall include a description of how the allocation of funding—</text> <subparagraph id="H7824C44FFF1C4676BA98D086253C8002"><enum>(A)</enum><text>will affect the average size and duration of education and human resources grants supported by the Foundation;</text> </subparagraph> <subparagraph id="H3F209B9652D94BA59ED3FFF93B57E509"><enum>(B)</enum><text>will affect trends in research support for the effective instruction of mathematics, science, engineering, and technology;</text> </subparagraph> <subparagraph id="H49580AD6A9E1418A8C0303A530037A7"><enum>(C)</enum><text display-inline="yes-display-inline">will affect the K–20 pipeline for the study of mathematics, science, engineering, and technology; and</text> </subparagraph> <subparagraph id="HEA302B1E49DE4968AE555FC43FFEB635"><enum>(D)</enum><text>will encourage the interest of individuals identified in section 33 or 34 of the Science and Engineering Equal Opportunities Act (42 U.S.C. 1885a or 1885b) in mathematics, science, engineering, and technology, and help prepare such individuals to pursue postsecondary studies in these fields.</text> </subparagraph></paragraph></subsection></section> <section id="HD55C3DC7DBB6419497C1212CF3B200CF"><enum>316.</enum><header>Administrative amendments</header> <subsection id="H477C3E1F102C4ABD9B00E93EF15800AF"><enum>(a)</enum><header>Triannual audit of the office of the National Science Board</header><text>Section 15(a) of the National Science Foundation Authorization Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/4862n-5">42 U.S.C. 4862n–5</external-xref>) is amended—</text> <paragraph id="H264C8D3346E84E908BB00000CA9F9D2D"><enum>(1)</enum><text>in paragraph (3), by striking <quote>an annual audit</quote> and inserting <quote>an audit every three years</quote>;</text> </paragraph> <paragraph id="H63F107348A58466BA0A2DB4641CF7844"><enum>(2)</enum><text>in paragraph (4), by striking <quote>each year</quote> and inserting <quote>every third year</quote>; and</text> </paragraph> <paragraph id="H6851DCD26AA942149DAA89B7CB9145F"><enum>(3)</enum><text>by inserting after paragraph (4) the following new paragraph:</text> <quoted-block id="HF29FFB7BF1F249D69DA99066219064AD" style="OLC"> <paragraph id="H6A92412B865E4BAF00D754EE1F129E5B"><enum>(5)</enum><header>Materials relating to closed portions of meetings</header><text>To facilitate the audit required under paragraph (3) of this subsection, the Office of the National Science Board shall maintain the General Counsel’s certificate, the presiding officer’s statement, and a transcript or recording of any closed meeting, for at least 3 years after such meeting.</text> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection> <subsection commented="no" id="H34C020ACE0AF48C5A73B87541CAC1B02"><enum>(b)</enum><header>Limited term personnel for the national science board</header><text display-inline="yes-display-inline">Subsection (g) of section 4 of the National Science Foundation Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/42/1863">42 U.S.C. 1863(g)</external-xref>) is amended to read as follows:</text> <quoted-block display-inline="no-display-inline" id="H43C4953A0CEE4A8D94EED9B276295DAA" style="OLC"> <subsection id="HC9775C17393D40909E4261A52D95C593"><enum>(g)</enum><text>The Board may, with the concurrence of a majority of its members, permit the appointment of a staff consisting of not more than 5 professional staff members, technical and professional personnel on leave of absence from academic, industrial, or research institutions for a limited term and such operations and support staff members as may be necessary. Such staff shall be appointed by the Chairman and assigned at the direction of the Board. The professional members and limited term technical and professional personnel of such staff may be appointed without regard to the provisions of title 5, United States Code, governing appointments in the competitive service, and the provisions of chapter 51 of such title relating to classification, and shall be compensated at a rate not exceeding the maximum rate payable under section 5376 of such title, as may be necessary to provide for the performance of such duties as may be prescribed by the Board in connection with the exercise of its powers and functions under this Act. Section 14(a)(3) shall apply to each limited term appointment of technical and professional personnel under this subsection. Each appointment under this subsection shall be subject to the same security requirements as those required for personnel of the Foundation appointed under section 14(a).</text> </subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> <subsection id="HE1602EB784B74BC09BDDF99987E3EFDE"><enum>(c)</enum><header>Increase in number of waterman awards to three</header><text display-inline="yes-display-inline">Section 6(c) of the National Science Foundation Authorization Act of 1975 (<external-xref legal-doc="usc" parsable-cite="usc/42/1881a">42 U.S.C. 1881a</external-xref>) is amended to read as follows:</text> <quoted-block display-inline="no-display-inline" id="HAA796EFB066C49EABEB4D088B95C8DA2" style="OLC"> <subsection id="H0C0DEA00B5F54145B3C2DE8383BEBD6E"><enum>(c)</enum><text>Up to three awards may be made under this section in any one fiscal year.</text> </subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section> <section id="H6B2654142B9E4B14864CEADE62C01BE0"><enum>317.</enum><header>National Science Board reports</header><text display-inline="no-display-inline">Paragraphs (1) and (2) of section 4(j) of the National Science Foundation Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/42/1863">42 U.S.C. 1863(j)(1)</external-xref> and (2)) are amended by striking <quote>, for submission to</quote> and <quote>for submission to</quote>, respectively, and inserting <quote>and</quote>.</text> </section> <section id="H55BC5D56D08C48829F5E4BE4CC2413D1"><enum>318.</enum><header>National Academy of Science Report on Diversity in STEM fields</header> <subsection id="HA3B33FA83C564A75990354B7261B814"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Foundation shall enter into an arrangement with the National Academy of Sciences for a report, to be transmitted to the Congress not later than 1 year after the date of enactment of this Act, about barriers to increasing the number of underrepresented minorities in science, technology, engineering, and mathematics fields and to identify strategies for bringing more underrepresented minorities into the science, technology, engineering, and mathematics workforce.</text> </subsection> <subsection id="H9C09405D02F04491BD3100967B345822"><enum>(b)</enum><header>Specific requirements</header><text display-inline="yes-display-inline">The Director shall ensure that the study described in subsection (a) addresses—</text> <paragraph id="H6CA02792C5F7409DB97931609D282FC8"><enum>(1)</enum><text>social and institutional factors that shape the decisions of minority students to commit to education and careers in the science, technology, engineering, and mathematics fields;</text> </paragraph> <paragraph id="HD3E354D9E7C446E9BC00191C4D576C30"><enum>(2)</enum><text>specific barriers preventing greater minority student participation in the science, technology, engineering, and mathematics fields;</text> </paragraph> <paragraph id="H5A23E3677BBB45F2AEB07727B4E8C8F"><enum>(3)</enum><text>primary focus points for policy intervention to increase the recruitment and retention of underrepresented minorities in America's future workforce;</text> </paragraph> <paragraph id="HAA29FA783FB748F5A6F709FE18897DE"><enum>(4)</enum><text>programs already underway to increase diversity in the science, technology, engineering, and mathematics fields, and their level of effectiveness;</text> </paragraph> <paragraph id="HF757D28684164C1100C9FC29B8485DB7"><enum>(5)</enum><text>factors that make such programs effective, and how to expand and improve upon existing programs;</text> </paragraph> <paragraph id="H7A6ED7180BFD43D9AABBB85B7453936B"><enum>(6)</enum><text>the role of minority-serving institutions in the diversification of America’s workforce in these fields and how that role can be supported and strengthened; and</text> </paragraph> <paragraph id="H50E0A8E1DC334016BE268E483D736169"><enum>(7)</enum><text>how the public and private sectors can better assist minority students in their efforts to join America’s workforce in these fields.</text> </paragraph></subsection></section> <section id="H136E76268B914EB7BDF4CDA63896C1C9"><enum>319.</enum><header>Sense of the Congress regarding the mathematics and science partnership programs of the Department of Education and the National Science Foundation</header><text display-inline="no-display-inline">It is the sense of the Congress that—</text> <paragraph id="HBAA5E9927C374AAC941CC66005A1144B"><enum>(1)</enum><text display-inline="yes-display-inline">although the mathematics and science education partnership program at the National Science Foundation and the mathematics and science partnership program at the Department of Education practically share the same name, the 2 programs are intended to be complementary, not duplicative;</text> </paragraph> <paragraph id="H654E745CB4F948C6979900EDBC76ED4"><enum>(2)</enum><text display-inline="yes-display-inline">the National Science Foundation partnership programs are innovative, model reform initiatives that move promising ideas in education from research into practice to improve teacher quality, develop challenging curricula, and increase student achievement in mathematics and science, and Congress intends that the National Science Foundation peer-reviewed partnership programs found to be effective should be put into wider practice by dissemination through the Department of Education partnership programs; and</text> </paragraph> <paragraph id="HD38344CF97D847A7918359A8E3C3B054"><enum>(3)</enum><text display-inline="yes-display-inline">the Director of the National Science Foundation and the Secretary of Education should have ongoing collaboration to ensure that the 2 components of this priority effort for mathematics and science education continue to work in concert for the benefit of States and local practitioners nationwide.</text> </paragraph></section> <section id="H646D9714C9BF4EAFBE19B768005E5EAB"><enum>320.</enum><header>Hispanic-serving institutions undergraduate program</header> <subsection id="H61DC77FD2983447EA3DA196E7134F6E8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Director is authorized to establish a new program to award grants on a competitive, merit-reviewed basis to Hispanic-serving institutions to enhance the quality of undergraduate science, mathematics, engineering, and technology education at such institutions and to increase the retention and graduation rates of students pursuing associate's or baccalaureate degrees in science, mathematics, engineering, or technology.</text> </subsection> <subsection id="H8BA740BE26214BBEAE55CFA9601F40BC"><enum>(b)</enum><header>Program Components</header><text>Grants awarded under this section shall support—</text> <paragraph id="H011DEBB490CE432F84C58502A1DDEDE2"><enum>(1)</enum><text display-inline="yes-display-inline">activities to improve courses and curriculum in science, mathematics, engineering, and technology;</text> </paragraph> <paragraph id="H9DA7FF64A0EF46F49602B198B6A3216B"><enum>(2)</enum><text display-inline="yes-display-inline">faculty development;</text> </paragraph> <paragraph id="H6D1D1FCDC20D4A22A300CBBF6B913C06"><enum>(3)</enum><text display-inline="yes-display-inline">stipends for undergraduate students participating in research; and</text> </paragraph> <paragraph id="H1BF4125A8C874B94BF84609B9458E052"><enum>(4)</enum><text display-inline="yes-display-inline">other activities consistent with subsection (a), as determined by the Director.</text> </paragraph></subsection> <subsection id="HC5D5572F7F994B77B65E5EF5E879A77D"><enum>(c)</enum><header>Instrumentation</header><text display-inline="yes-display-inline">Funding for instrumentation is an allowed use of grants awarded under this section.</text> </subsection></section> <section id="HA6997A58B17C48C4B96600F3866BCB28"><enum>321.</enum><header>Communications training for scientists</header> <subsection id="H8A8318B722764A7EB8A5514CDECA63D"><enum>(a)</enum><header>Grant supplements for communications training</header><text display-inline="yes-display-inline">The Director shall provide grant supplements, on a competitive, merit-reviewed basis, to institutions receiving awards under the Integrative Graduate Education and Research Traineeship program.  The grant supplements shall be used to train graduate students in the communication of the substance and importance of their research to nonscientist audiences, including policymakers.</text> </subsection> <subsection id="HC811F2BD80B94FF70041B36C2747015E"><enum>(b)</enum><header>Report to congress</header><text display-inline="yes-display-inline">Not later than 3 years after the date of enactment of this Act, the Director shall transmit a report to the Committee on Science and Technology of the House of Representatives, and to the Committee on Commerce, Science, and Transportation and the Committee on Health, Education, Labor, and Pensions of the Senate, describing how the activities required under subsection (a) have been implemented.  The report shall include data on the number of graduate students trained and the number and size of grant supplements awarded, and a description of the types of activities funded through the grant supplements.</text> </subsection></section> <enum>IV</enum><header>National Institute of Standards and Technology</header> <section display-inline="no-display-inline" id="H40D25D644A0A4E82A592A119D5EBE208" section-type="subsequent-section"><enum>401.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Technology Innovation and Manufacturing Stimulation Act of 2007</short-title></quote>.</text> </section> <subtitle id="HB2F3430EFF3D4F65A20037261CA2B98F"><enum>A</enum><header>Authorization of Appropriations</header> <section id="H4BD176EF63E94194BF4F1BB547229586"><enum>411.</enum><header>Scientific and technical research and services</header> <subsection id="HF4E13328CAAC47F1A0092906F6A6298D"><enum>(a)</enum><header>Laboratory Activities</header><text>There are authorized to be appropriated to the Secretary of Commerce for the scientific and technical research and services laboratory activities of the National Institute of Standards and Technology—</text> <paragraph id="H81025E1BDDD14FDFBBBB6BD97D6A47E"><enum>(1)</enum><text display-inline="yes-display-inline">$470,879,000 for fiscal year 2008;</text> </paragraph> <paragraph id="H1F33D22ED37B4799A701B50063418718"><enum>(2)</enum><text display-inline="yes-display-inline">$497,750,000 for fiscal year 2009; and</text> </subparagraph> <subparagraph id="H29B31945B2FA429885EAC8F80052F416"><enum>(B)</enum><text display-inline="yes-display-inline">$131,766,000 shall be for the Manufacturing Extension Partnership Program under sections 25 and 26 of the National Institute of Standards and Technology Act (15 U.S.C. 278k and 278l), of which not more than $4,000,000 shall be for the competitive grant program under section 25(f) of such Act.</text> </subparagraph></paragraph></section></subtitle> <subtitle id="H0E455854107345058E356E44EDA95CB9"><enum>B</enum><header>Innovation and Technology Policy Reforms</header> <section id="HC2B1E5281AB641738D33B2CCA5D55EC7"><enum>421.</enum><header>Institute-wide planning report</header><text display-inline="no-display-inline">Section 23 of the National Institute of Standards and Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/15/278i">15 U.S.C. 278i</external-xref>) is amended by adding at the end the following new subsections:</text> <quoted-block id="H8FD9B6D3B5D446268030B208941E0037" style="OLC"> <subsection id="HBFF17841E9734299A5E434FB557C39F"><enum>(c)</enum><text>Concurrent with the submission to Congress of the President’s annual budget request in the first year after the date of enactment of the <short-title>Technology Innovation and Manufacturing Stimulation Act of 2007</short-title>, the Director shall transmit to the Congress a 3-year programmatic planning document for the Institute, including programs under the Scientific and Technical Research and Services, Industrial Technology Services, and Construction of Research Facilities functions.</text> </subsection> <subsection id="H5DA6F7CA75FC4E97A2A367E82949F08F"><enum>(d)</enum><text display-inline="yes-display-inline">Concurrent with the submission to the Congress of the President’s annual budget request in each year after the date of enactment of the Technology Innovation and Manufacturing Stimulation Act of 2007, the Director shall transmit to the Congress an update to the 3-year programmatic planning document transmitted under subsection (c), revised to cover the first 3 fiscal years after the date of that update.</text> </subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section> <section id="HAA3AC40F25754E17B0579F91E87F2F87"><enum>422.</enum><header>Report by Visiting Committee</header><text display-inline="no-display-inline">Section 10(h)(1) of the National Institute of Standards and Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/15/278">15 U.S.C. 278(h)(1)</external-xref>) is amended—</text> <paragraph id="H3C514A6C25C04677AC43FA87EC88006F"><enum>(1)</enum><text>by striking <quote>on or before January 31 in each year</quote> and inserting <quote>within 30 days after the submission to Congress of the President’s annual budget request in each year</quote>; and</text> </paragraph> <paragraph id="H517AA5360B47485B86AEBD23EBF1AA67"><enum>(2)</enum><text>by adding to the end the following: <quote>Such report also shall comment on the programmatic planning document and updates thereto transmitted to the Congress by the Director under section 23(c) and (d).</quote>.</text> </paragraph></section> <section id="H0F9CA48126C648B8A13D6F4605860938"><enum>423.</enum><header>Manufacturing extension partnership</header> <subsection id="H3F68DD4EC21E4917BC774F6F063DAB1C"><enum>(a)</enum><header>MEP advisory board</header><text>Section 25 of the National Institute of Standards and Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/15/278k">15 U.S.C. 278k</external-xref>) is amended by adding at the end the following new subsection:</text> <quoted-block id="H0396473E9994473BBE4D482B03393137" style="OLC"> <subsection id="HF22A224A8E6C41EE974DA5BBA45BD9B7"><enum>(e)</enum><header>MEP Advisory Board</header> <paragraph commented="no" display-inline="yes-display-inline" id="HC0205DE673D74F6A887989C6F94BB13C"><enum>(1)</enum><text>There is established within the Institute a Manufacturing Extension Partnership Advisory Board (in this Act referred to as the <quote>MEP Advisory Board</quote>). The MEP Advisory Board shall consist of 10 members broadly representative of stakeholders, to be appointed by the Director. At least 2 members shall be employed by or on an advisory board for the Centers, and at least 5 other members shall be from United States small businesses in the manufacturing sector. No member shall be an employee of the Federal Government.</text> </paragraph> <paragraph id="H533396B4181442AF9E470646A76C5C09" indent="up1"><enum>(2)</enum> <subparagraph commented="no" display-inline="yes-display-inline" id="H2FF9ABDC549C4333B3B54886B87C00D0"><enum>(A)</enum><text>Except as provided in subparagraph (B) or (C), the term of office of each member of the MEP Advisory Board shall be 3 years.</text> </subparagraph> <subparagraph id="H9BE48D8A6D724CA9B98EF94D60B1E548" indent="up1"><enum>(B)</enum><text>The original members of the MEP Advisory Board shall be appointed to 3 classes. One class of 3 members shall have an initial term of 1 year, one class of 3 members shall have an initial term of 2 years, and one class of 4 members shall have an initial term of 3 years.</text> </subparagraph> <subparagraph id="H5029E108CC8A44B792ACC948A2D620D1" indent="up1"><enum>(C)</enum><text>Any member appointed to fill a vacancy occurring prior to the expiration of the term for which his predecessor was appointed shall be appointed for the remainder of such term.</text> </subparagraph> <subparagraph id="HB5B1A8779DA54D7DA8ABE0EBC3ABA1D7" indent="up1"><enum>(D)</enum><text>Any person who has completed two consecutive full terms of service on the MEP Advisory Board shall thereafter be ineligible for appointment during the one-year period following the expiration of the second such term.</text> </subparagraph></paragraph> <paragraph id="H9321B076484341AB0000AD348B08F48C" indent="up1"><enum>(3)</enum><text>The MEP Advisory Board shall meet no less than 2 times annually, and provide to the Director—</text> <subparagraph id="H599560D174F84BF28C36E0D2AC3900CC"><enum>(A)</enum><text>advice on Manufacturing Extension Partnership programs, plans, and policies;</text> </subparagraph> <subparagraph id="HC6FAFE0B75EE4AF2B8787CB24B349393"><enum>(B)</enum><text display-inline="yes-display-inline">assessments of the soundness of Manufacturing Extension Partnership plans and strategies; and</text> </subparagraph> <subparagraph id="H35A7CDFDF439449E85DEF02200093D85"><enum>(C)</enum><text display-inline="yes-display-inline">assessments of current performance against Manufacturing Extension Partnership program plans.</text> </subparagraph></paragraph> <paragraph id="H5A7FD9D797344BCDBB7670ED00897C00" indent="up1"><enum>(4)</enum><text>In discharging its duties under this subsection, the MEP Advisory Board shall function solely in an advisory capacity, in accordance with the Federal Advisory Committee Act.</text> </paragraph> <paragraph id="H25008C573FB944BDADB20028AD01046C" indent="up1"><enum>(5)</enum><text display-inline="yes-display-inline">The MEP Advisory Board shall transmit an annual report to the Secretary for transmittal to the Congress within 30 days after the submission to the Congress of the President’s annual budget request in each year. Such report shall address the status of the Manufacturing Extension Partnership program and comment on the relevant sections of the programmatic planning document and updates thereto transmitted to the Congress by the Director under section 23(c) and (d).</text> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> <subsection id="H3CE89D5113734D4FA3028BF476D11956"><enum>(b)</enum><header>Acceptance of funds</header><text display-inline="yes-display-inline">Section 25(d) of the National Institute of Standards and Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/15/278k">15 U.S.C. 278k(d)</external-xref>) is amended to read as follows:</text> <quoted-block display-inline="no-display-inline" id="HD5F95A3AD70F4AA0905CDE977EF92195" style="OLC"> <subsection id="H269BB02F6F6C4BF29C4EB4D9FEA4FC67"><enum>(d)</enum><header>Acceptance of funds</header><text>In addition to such sums as may be appropriated to the Secretary and Director to operate the Centers program, the Secretary and Director also may accept funds from other Federal departments and agencies and under section 2(c)(7) from the private sector for the purpose of strengthening United States manufacturing. Such funds, if allocated to a Center or Centers, shall not be considered in the calculation of the Federal share of capital and annual operating and maintenance costs under subsection (c).</text> </subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> <subsection id="HEC34AAEEF325401AABC73300000DECE"><enum>(c)</enum><header>Manufacturing Extension Center Competitive Grant Program</header><text display-inline="yes-display-inline">Section 25 of the National Institute of Standards and Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/15/278k">15 U.S.C. 278k</external-xref>), as amended by subsection (a) of this section, is further amended by adding at the end the following new subsection:</text> <quoted-block display-inline="no-display-inline" id="H468D723B3A034ABAA31BD4E699F01F24" style="OLC"> <subsection display-inline="no-display-inline" id="H4C147E1DFB574F15B0933D427583009E"><enum>(f)</enum><header>Competitive Grant Program</header> <paragraph id="HC7BA58CC062842268B6622E9011E827C"><enum>(1)</enum><header>Establishment</header><text>The Director shall establish, within the Manufacturing Extension Partnership program under this section and section 26 of this Act, a program of competitive awards among participants described in paragraph (2) for the purposes described in paragraph (3).</text> </paragraph> <paragraph id="H9D59B30AE3E74903BBCF5DBBE1CB8285"><enum>(2)</enum><header>Participants</header><text>Participants receiving awards under this subsection shall be the Centers, or a consortium of such Centers.</text> </paragraph> <paragraph id="H89D3E166B7C64AF60028E00A309EE53"><enum>(3)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of the program under this subsection is to develop projects to solve new or emerging manufacturing problems as determined by the Director, in consultation with the Director of the Manufacturing Extension Partnership program, the Manufacturing Extension Partnership Advisory Board, and small and medium-sized manufacturers. One or more themes for the competition may be identified, which may vary from year to year, depending on the needs of manufacturers and the success of previous competitions. These themes shall be related to projects associated with manufacturing extension activities, including supply chain integration and quality management, and including the transfer of technology based on the technological needs of manufacturers and available technologies from institutions of higher education, laboratories, and other technology producing entities, or extend beyond these traditional areas.</text> </paragraph> <paragraph id="HB21554BB65534A0486E46343BE68DA0"><enum>(4)</enum><header>Applications</header><text>Applications for awards under this subsection shall be submitted in such manner, at such time, and containing such information as the Director shall require, in consultation with the Manufacturing Extension Partnership Advisory Board.</text> </paragraph> <paragraph id="HA07A65F9DDCF46BD8445F7CD21526486"><enum>(5)</enum><header>Selection</header><text>Awards under this subsection shall be peer reviewed and competitively awarded. The Director shall select proposals to receive awards—</text> <subparagraph id="H7A5481A90029424CAE80ADDC532CE327"><enum>(A)</enum><text>that utilize innovative or collaborative approaches to solving the problem described in the competition;</text> </subparagraph> <subparagraph id="H6303EC757B384D2A009C0546B7F3CC75"><enum>(B)</enum><text>that will improve the competitiveness of industries in the region in which the Center or Centers are located; and</text> </subparagraph> <subparagraph id="H5A748CDA89044616AB5624ACF4BB9765"><enum>(C)</enum><text>that will contribute to the long-term economic stability of that region.</text> </subparagraph></paragraph> <paragraph id="H36D82DFA5C484E2E81B85607A5F5EF91"><enum>(6)</enum><header>Program contribution</header><text>Recipients of awards under this subsection shall not be required to provide a matching contribution.</text> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section> <section id="HB49CB544AA994831B59E00539D00C816"><enum>424.</enum><header>Technology Innovation Program</header><text display-inline="no-display-inline">Section 28 of the National Institute of Standards and Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/15/278n">15 U.S.C. 278n</external-xref>) is amended to read as follows:</text> <quoted-block display-inline="no-display-inline" id="HDAD3E79615924FB7B345B6CF3277FC7D" style="traditional"> <section id="H4C85C4D263C44A6E8BA284D5026E2561"><enum>28.</enum><header>Technology Innovation Program</header> <subsection commented="no" display-inline="yes-display-inline" id="H6387ABBEB9B0469E97C2A085C87C6FB8"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established in the Institute a Technology Innovation Program for the purpose of assisting United States businesses and institutions of higher education or other organizations, such as national laboratories and nonprofit research institutes, to accelerate the research and development and application of challenging, high-risk, high-reward technologies in areas of critical national need that promise widespread economic benefits for the Nation.</text> </subsection> <subsection id="H978C43A934374975BF235360F5496574"><enum>(b)</enum><header>Grants</header> <paragraph id="HB3E47127D8474AC2A84EB67E44DB5841"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Director shall make grants under this section for research and development on high-risk, high-reward emerging and enabling technologies (including any technological application that uses biological systems, living organisms, or derivatives thereof, to make or modify products or processes for specific use) that address critical national needs and have a wide breadth of potential application, and form an important technical basis for future innovations. Such grants shall be made to—</text> <subparagraph id="H873654258580467C90654005146343A0"><enum>(A)</enum><text display-inline="yes-display-inline">eligible companies that are small- or medium-sized businesses that are substantially involved in the research and development, including having a leadership role in programmatically steering the project and defining the research agenda; or</text> </subparagraph> <subparagraph id="HD7C8796805844966BFF144F500B4EE99"><enum>(B)</enum><text>joint ventures.</text> </subparagraph></paragraph> <paragraph id="H12CF4DE6EC1747EEA7F521341F5B7B"><enum>(2)</enum><header>Single company grants</header><text display-inline="yes-display-inline">No grant made under paragraph (1)(A) shall exceed $3,000,000 over 3 years. The Federal share of a project funded by such a grant shall not be more than 50 percent of total project costs. An award under paragraph (1)(A) may be extended beyond 3 years only if the Director transmits to the Committee on Science and Technology of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a full and complete explanation of such award, including reasons for exceeding 3 years. Federal funds granted under paragraph (1)(A) may be used only for direct costs and not for indirect costs, profits, or management fees of a contractor.</text> </paragraph> <paragraph id="HF49425F5C5B24FEAAC595B53D960954B"><enum>(3)</enum><header>Joint venture grants</header><text display-inline="yes-display-inline">No grant made under paragraph (1)(B) shall exceed $9,000,000 over 5 years. The Federal share of a project funded by such a grant shall not be more than 50 percent of total project costs.</text> </paragraph></subsection> <subsection id="HDA9192DBAF944D7BA5C071FBED31A900"><enum>(c)</enum><header>Award criteria</header><text>The Director shall award grants under this section only to an eligible company—</text> <paragraph id="H9431CA9C756F422F9D04ED97BB8411F2"><enum>(1)</enum><text display-inline="yes-display-inline">whose proposal has scientific and technological merit;</text> </paragraph> <paragraph id="H294167572F4844F489B475D49D003F00"><enum>(2)</enum><text>whose application establishes that the proposed technology has strong potential to generate substantial benefits to the Nation that extend significantly beyond the direct return to the applicant;</text> </paragraph> <paragraph id="H8C9338A66C5045508E8EEFDC3C9F4E50"><enum>(3)</enum><text display-inline="yes-display-inline">whose application establishes that the research has strong potential for advancing the state-of-the-art and contributing significantly to the United States scientific and technical knowledge base;</text> </paragraph> <paragraph id="H7EE4FC2468DB48CF8E36973D26976DF3"><enum>(4)</enum><text display-inline="yes-display-inline">whose application establishes that the research is aimed at overcoming a scientific or technological barrier;</text> </paragraph> <paragraph id="H05F4D33C70474B5D909897E4C5C03225"><enum>(5)</enum><text>who has provided a technical plan that clearly identifies the core innovation, the technical approach, major technical hurdles, and the attendant risks, and that clearly establishes the feasibility of the technology through adequately detailed plans linked to major technical barriers;</text> </paragraph> <paragraph id="H4AF3713EE849484F96A18FC4C6C9DF07"><enum>(6)</enum><text display-inline="yes-display-inline">whose application establishes that the team proposed to carry out the work has a high level of scientific and technical expertise to conduct research and development, has a high level of commitment to the project, and has access to appropriate research facilities;</text> </paragraph> <paragraph id="HD2594F3B2D564E409FF33DE551722E31"><enum>(7)</enum><text>whose proposal explains why Technology Innovation Program support is necessary;</text> </paragraph> <paragraph id="H9EFFDDCF34A24F858895595BC51E592F"><enum>(8)</enum><text display-inline="yes-display-inline">whose application includes a plan for advancing the technology into commercial use; and</text> </paragraph> <paragraph id="HDC70BA95526D45BC8E60F957F6C03C85"><enum>(9)</enum><text>whose application assesses the project’s organizational structure and management plan.</text> </paragraph></subsection> <subsection id="HCA066F6CBC6A4961BFEC84A0337D184F"><enum>(d)</enum><header>External Review of Proposals</header><text display-inline="yes-display-inline">In order to analyze the need for or the value of any proposal made by a joint venture or company requesting the Director’s assistance under this section, or to monitor the progress of any project which receives funds under this section, the Director shall consult with industry or other expert sources that do not have a proprietary or financial interest in the proposal or project.</text> </subsection> <subsection id="HF1BDFA568ACB4FB4A12D00928EA283B"><enum>(e)</enum><header>Intellectual Property Rights Ownership</header> <paragraph id="H467060ADBEDD40A8003003D7C91DD3CD"><enum>(1)</enum><header>In general</header><text>Title to any intellectual property developed by a joint venture from assistance provided under this section may vest in any participant in the joint venture, as agreed by the members of the joint venture, notwithstanding section 202(a) and (b) of title 35, United States Code. The United States may reserve a nonexclusive, nontransferable, irrevocable paid-up license, to have practiced for or on behalf of the United States in connection with any such intellectual property, but shall not in the exercise of such license publicly disclose proprietary information related to the license. Title to any such intellectual property shall not be transferred or passed, except to a participant in the joint venture, until the expiration of the first patent obtained in connection with such intellectual property.</text> </paragraph> <paragraph id="H7996E3ABA3B2482A911C82DC4CD60780"><enum>(2)</enum><header>Licensing</header><text>Nothing in this subsection shall be construed to prohibit the licensing to any company of intellectual property rights arising from assistance provided under this section.</text> </paragraph> <paragraph id="H95986FF0331D45EB9F6B1D65002DDF9F"><enum>(3)</enum><header>Definition</header><text display-inline="yes-display-inline">For purposes of this subsection, the term <term>intellectual property</term> means an invention patentable under title 35, United States Code, or any patent on such an invention, or any work for which copyright protection is available under title 17, United States Code.</text> </paragraph></subsection> <subsection id="HA163130D2DDC47818F5CBA96E4DE46AA"><enum>(f)</enum><header>Program Operation</header><text display-inline="yes-display-inline">Not later than 9 months after the date of enactment of the <short-title>Technology Innovation and Manufacturing Stimulation Act of 2007</short-title>, the Director shall issue regulations—</text> <paragraph id="H4AD3E4A330AB42CB8966DECB4E41D079"><enum>(1)</enum><text>establishing criteria for the selection of recipients of assistance under this section;</text> </paragraph> <paragraph id="HF329772D45384796BDD25EBDBEA33DCA"><enum>(2)</enum><text>establishing procedures regarding financial reporting and auditing to ensure that contracts and awards are used for the purposes specified in this section, are in accordance with sound accounting practices, and are not funding existing or planned research programs that would be conducted in the same time period in the absence of financial assistance under this section; and</text> </paragraph> <paragraph id="H43B79A6083A0498C8DDA3B5DB6DAD1D7"><enum>(3)</enum><text>providing for appropriate dissemination of Technology Innovation Program research results.</text> </paragraph></subsection> <subsection id="HC2ABBEB9E8D44BF8BEFCF227E8814FE3"><enum>(g)</enum><header>Continuation of ATP grants</header><text display-inline="yes-display-inline">The Director shall, through the Technology Innovation Program, continue to provide support originally awarded under the Advanced Technology Program, in accordance with the terms of the original award.</text> </subsection> <subsection id="H2EC4D6CEA9EA44E19D8025F298807091"><enum>(h)</enum><header>Coordination with other State and Federal Technology Programs</header><text display-inline="yes-display-inline">In carrying out this section, the Director shall, as appropriate, coordinate with other senior State and Federal officials to ensure cooperation and coordination in State and Federal technology programs and to avoid unnecessary duplication of efforts.</text> </subsection> <subsection id="H118C6AC8E6F64172967C228891C0DC5"><enum>(i)</enum><header>Acceptance of funds from other Federal agencies</header><text display-inline="yes-display-inline">In addition to amounts appropriated to carry out this section, the Secretary and the Director may accept funds from other Federal agencies to support awards under the Technology Innovation Program. Any award under this section which is supported with funds from other Federal agencies shall be selected and carried out according to the provisions of this section.</text> </subsection> <subsection id="HB3544CBF041145A8B086851F600069E1"><enum>(j)</enum><header>TIP Advisory Board</header> <paragraph id="HD6E3BA58B4284507941C862FFF4E197"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established within the Institute a Technology Innovation Program Advisory Board. The TIP Advisory Board shall consist of 10 members appointed by the Director, at least 7 of which shall be from United States industry, chosen to reflect the wide diversity of technical disciplines and industrial sectors represented in Technology Innovation Program projects. No member shall be an employee of the Federal Government.</text> </paragraph> <paragraph id="HD5B7042634734337B4B2EED55E35B2DB"><enum>(2)</enum><header>Terms of office</header> <subparagraph commented="no" display-inline="yes-display-inline" id="H50981D46B1854A72AD32C286FBF46BCA"><enum>(A)</enum><text>Except as provided in subparagraph (B) or (C), the term of office of each member of the TIP Advisory Board shall be 3 years.</text> </subparagraph> <subparagraph id="HD624730FBA5546D5A2F9F4315D75AE5D" indent="up1"><enum>(B)</enum><text>The original members of the TIP Advisory Board shall be appointed to 3 classes. One class of 3 members shall have an initial term of 1 year, one class of 3 members shall have an initial term of 2 years, and one class of 4 members shall have an initial term of 3 years.</text> </subparagraph> <subparagraph id="HE7DE561394CB449EBAE6E01B4CAB0DB" indent="up1"><enum>(C)</enum><text>Any member appointed to fill a vacancy occurring prior to the expiration of the term for which his predecessor was appointed shall be appointed for the remainder of such term.</text> </subparagraph> <subparagraph id="H3608C23754634E4EAD2B56E4A8F881FF" indent="up1"><enum>(D)</enum><text>Any person who has completed two consecutive full terms of service on the TIP Advisory Board shall thereafter be ineligible for appointment during the one-year period following the expiration of the second such term.</text> </subparagraph></paragraph> <paragraph id="HDE179288EEC4493AB872523FCFAE54A7"><enum>(3)</enum><header>Purpose</header><text display-inline="yes-display-inline">The TIP Advisory Board shall meet no less than 2 times annually, and provide to the Director—</text> <subparagraph id="H68B0B6EA8FDA43CB9222A8A7A4064458"><enum>(A)</enum><text>advice on programs, plans, and policies of the Technology Innovation Program;</text> </subparagraph> <subparagraph id="H116B95ACD86749049C1686F3F849681D"><enum>(B)</enum><text display-inline="yes-display-inline">reviews of the Technology Innovation Program’s efforts to assess its economic impact;</text> </subparagraph> <subparagraph id="H799ECE57B0EF439A84007365AF277792"><enum>(C)</enum><text>reports on the general health of the program and its effectiveness in achieving its legislatively mandated mission;</text> </subparagraph> <subparagraph id="H0EE65C78058B4D6EA61E71AF944C8DF2"><enum>(D)</enum><text display-inline="yes-display-inline">guidance on areas of technology that are appropriate for Technology Innovation Program funding; and</text> </subparagraph> <subparagraph id="H399EE6ED7C59487D8BFF1CFB03C45F4B"><enum>(E)</enum><text display-inline="yes-display-inline">recommendations as to whether, in order to better assess whether specific innovations to be pursued are being adequately supported by the private sector, the Director could benefit from advice and information from additional industry and other expert sources without a proprietary or financial interest in proposals being evaluated.</text> </subparagraph></paragraph> <paragraph id="H232A031CD8F448A9888B462F3BA789DE"><enum>(4)</enum><header>Advisory capacity</header><text display-inline="yes-display-inline">In discharging its duties under this subsection, the TIP Advisory Board shall function solely in an advisory capacity, in accordance with the Federal Advisory Committee Act.</text> </paragraph> <paragraph id="H2128481F4245473CA0A042EB4090FBE"><enum>(5)</enum><header>Annual report</header><text display-inline="yes-display-inline">The TIP Advisory Board shall transmit an annual report to the Secretary for transmittal to the Congress within 30 days after the submission to Congress of the President’s annual budget request in each year. Such report shall address the status of the Technology Innovation Program and comment on the relevant sections of the programmatic planning document and updates thereto transmitted to the Congress by the Director under section 23(c) and (d).</text> </paragraph></subsection> <subsection id="H25B5CC33491141B592EEF59795EC0543"><enum>(k)</enum><header>Definitions</header><text>For purposes of this section—</text> <paragraph id="HC696A5E0E40D4282B96F0054EF399470"><enum>(1)</enum><text>the term <term>eligible company</term> means a company that is incorporated in the United States and does a majority of its business in the United States, and that either—</text> <subparagraph id="HB52A0B82FDC0433D9C2BECFA75C1336F"><enum>(A)</enum><text>is majority owned by citizens of the United States; or</text> </subparagraph> <subparagraph id="H6BA58618EB8A4E97A2916159DBB6C6D"><enum>(B)</enum><text>is owned by a parent company incorporated in another country and the Director finds that—</text> <clause id="HF04E46504A344573AACA47D158895D20"><enum>(i)</enum><text display-inline="yes-display-inline">the company’s participation in the Technology Innovation Program would be in the economic interest of the United States, as evidenced by—</text> <subclause id="H7F6CDB19C7814EA7BC768179374B04FE"><enum>(I)</enum><text>investments in the United States in research and manufacturing (including the manufacture of major components or subassemblies in the United States);</text> </subclause> <subclause id="H2028878FD83D4D78913FF72C50A98204"><enum>(II)</enum><text>significant contributions to employment in the United States; and</text> </subclause> <subclause id="H34D956DD0D5546C88522053B5B7DA971"><enum>(III)</enum><text>agreement with respect to any technology arising from assistance provided under this section to promote the manufacture within the United States of products resulting from that technology (taking into account the goals of promoting the competitiveness of United States industry); and</text> </subclause></clause> <clause id="H34CD6164449E4936A9544CE5D7B12B37"><enum>(ii)</enum><text display-inline="yes-display-inline">the company is incorporated in a country which—</text> <subclause id="H54FA4CECB4A94830BEBD5C0424BD10F9"><enum>(I)</enum><text>affords to United States-owned companies opportunities, comparable to those afforded to any other company, to participate in any joint venture similar to those receiving funding under this section;</text> </subclause> <subclause id="HB25D1A3BC71741649EE09EB73C3B52B9"><enum>(II)</enum><text>affords to United States-owned companies local investment opportunities comparable to those afforded any other company; and</text> </subclause> <subclause id="HBD11E29E8C6E43B89C39470792C2FE03"><enum>(III)</enum><text>affords adequate and effective protection for the intellectual property rights of United States-owned companies;</text> </subclause></clause></subparagraph></paragraph> <paragraph display-inline="no-display-inline" id="H463CB48CAD584ABD959C4454A1C288C"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>high-risk, high-reward research</term> means research that—</text> <subparagraph id="HBEA185705CDD4AF29ED3427BF576B5F8"><enum>(A)</enum><text>has the potential for yielding results with far-ranging or wide-ranging implications;</text> </subparagraph> <subparagraph id="H0C5DE6E3938F45FF943F32032E3057C0"><enum>(B)</enum><text>addresses critical national needs related to technology and measurement standards; and</text> </subparagraph> <subparagraph id="H33538AD3E1F64BED8C5C409F94009454"><enum>(C)</enum><text>is too novel or spans too diverse a range of disciplines to fare well in the traditional peer review process.</text> </subparagraph></paragraph> <paragraph id="H111F160913B24040B397EDBD664D84CB"><enum>(3)</enum><text>the term <term>institution of higher education</term> has the meaning given that term in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>);</text> </paragraph> <paragraph id="HF27B93A801CF41CF8B877D0064F9C0AC"><enum>(4)</enum><text display-inline="yes-display-inline">the term <term>joint venture</term> means a joint venture that—</text> <subparagraph id="HDA27258D05FD446DA7C3A1B3CEC5A92E"><enum>(A)</enum><text>includes either—</text> <clause id="HEA9723FFD12241DD00AB5800CEC380CE"><enum>(i)</enum><text display-inline="yes-display-inline">at least 2 separately owned for-profit companies that are both substantially involved in the project and both of which are contributing to the cost-sharing required under this section, with the lead entity of the joint venture being one of those companies that is a small or medium-sized business; or</text> </clause> <clause id="H7DEEB122BB0341A69D3600F180DDFAC"><enum>(ii)</enum><text display-inline="yes-display-inline">at least one small or medium-sized business and one institution of higher education or other organization, such as a national laboratory or nonprofit research institute, that are both substantially involved in the project and both of which are contributing to the cost-sharing required under this section, with the lead entity of the joint venture being either that small or medium-sized business or that institution of higher education; and</text> </clause></subparagraph> <subparagraph id="HCC7C73903A0A4C98879DFC35FFB3B342"><enum>(B)</enum><text display-inline="yes-display-inline">may include additional for-profit companies, institutions of higher education, and other organizations, such as national laboratories and nonprofit research institutes, that may or may not contribute non-Federal funds to the project; and</text> </subparagraph></paragraph> <paragraph id="HBAD403B294FC47FBB0D92EDDECF0B963"><enum>(5)</enum><text>the term <term>TIP Advisory Board</term> means the advisory board established under subsection (j).</text> </paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </section> <section id="HACF54FF966F64BC28527563356796C4E"><enum>425.</enum><header>Research fellowships</header><text display-inline="no-display-inline">Section 18 of the National Institute of Standards and Technology Act (15 U.S.C. 278g–l) is amended by striking <quote>up to 1 per centum of the</quote> and inserting <quote>up to 1.5 percent of the</quote>.</text> </section> <section id="H4109C03680C64ED5A6F170084BB99838"><enum>426.</enum><header>Collaborative manufacturing research pilot grants</header><text display-inline="no-display-inline">The National Institute of Standards and Technology Act is amended—</text> <paragraph id="H0F6047180AA1450E97B934F6625C0207"><enum>(1)</enum><text>by redesignating the first section 32 (<external-xref legal-doc="usc" parsable-cite="usc/15/271">15 U.S.C. 271</external-xref> note) as section 34 and moving it to the end of the Act; and</text> </paragraph> <paragraph id="H7874B923FBA64BCE8514129821294F3F"><enum>(2)</enum><text>by inserting before the section moved by paragraph (1) the following new section:</text> <quoted-block id="H0C65E0A39BA34E64A09C09D3635FCD36" style="OLC"> <section id="H7B61B5480F814ADFB800B1C9FEB368C0"><enum>33.</enum><header>Collaborative Manufacturing Research Pilot Grants</header> <subsection id="H9E1241C0D0134648A610E9DED1CE637"><enum>(a)</enum><header>Authority</header> <paragraph id="H9C5D5BB6D760448CB527C540462241B0"><enum>(1)</enum><header>Establishment</header><text>The Director shall establish a pilot program of awards to partnerships among participants described in paragraph (2) for the purposes described in paragraph (3). Awards shall be made on a peer-reviewed, competitive basis.</text> </paragraph> <paragraph id="HB6AD3AAFB74A4473AA4592C903B00C6"><enum>(2)</enum><header>Participants</header><text>Such partnerships shall include at least—</text> <subparagraph id="HB564BDB409CE482EA7E9BB52DCB07351"><enum>(A)</enum><text>1 manufacturing industry partner; and</text> </subparagraph> <subparagraph id="HB9EDC7827B154036AA006B6BA046E3A2"><enum>(B)</enum><text>1 nonindustry partner.</text> </subparagraph></paragraph> <paragraph id="H1D21A316BFA341B3855400E0C9BD800"><enum>(3)</enum><header>Purpose</header><text>The purpose of the program under this section is to foster cost-shared collaborations among firms, educational institutions, research institutions, State agencies, and nonprofit organizations to encourage the development of innovative, multidisciplinary manufacturing technologies. Partnerships receiving awards under this section shall conduct applied research to develop new manufacturing processes, techniques, or materials that would contribute to improved performance, productivity, and competitiveness of United States manufacturing, and build lasting alliances among collaborators.</text> </paragraph></subsection> <subsection id="H568FC0381260430E00FDCF6CBAD4E77C"><enum>(b)</enum><header>Program Contribution</header><text>Awards under this section shall provide for not more than one-third of the costs of a partnership. Not more than an additional one-third of such costs may be obtained directly or indirectly from other Federal sources.</text> </subsection> <subsection id="HA71CDE65C7BA40C7A500079305F42E61"><enum>(c)</enum><header>Applications</header><text>Applications for awards under this section shall be submitted in such manner, at such time, and containing such information as the Director shall require. Such applications shall describe at a minimum—</text> <paragraph id="HBF1F3E45A72E401981AFE6646C639633"><enum>(1)</enum><text>how each partner will participate in developing and carrying out the research agenda of the partnership;</text> </paragraph> <paragraph id="H47060959EAAB40369D50A872A8035D79"><enum>(2)</enum><text>the research that the grant would fund; and</text> </paragraph> <paragraph id="H4B6CC15EDCBF4E4AB67E8F4B39B2B06"><enum>(3)</enum><text>how the research to be funded with the award would contribute to improved performance, productivity, and competitiveness of the United States manufacturing industry.</text> </paragraph></subsection> <subsection id="H09CB3ECD3F8F4BB48138AE12D7657DDC"><enum>(d)</enum><header>Selection Criteria</header><text>In selecting applications for awards under this section, the Director shall consider at a minimum—</text> <paragraph id="HEBE683A0727843F1985E008542CC15AB"><enum>(1)</enum><text>the degree to which projects will have a broad impact on manufacturing;</text> </paragraph> <paragraph id="H9BB8A2FA7314481E8F40011D4BAC1845"><enum>(2)</enum><text>the novelty and scientific and technical merit of the proposed projects; and</text> </paragraph> <paragraph id="H2B049A7C28DA4FF0B8FEECC5EEE7E14"><enum>(3)</enum><text>the demonstrated capabilities of the applicants to successfully carry out the proposed research.</text> </paragraph></subsection> <subsection id="H516BF3868B4E46F0866409DE0058B928"><enum>(e)</enum><header>Distribution</header><text>In selecting applications under this section the Director shall ensure, to the extent practicable, a distribution of overall awards among a variety of manufacturing industry sectors and a range of firm sizes.</text> </subsection> <subsection id="H290F6AE6EAC143899F8D23822CFF00AC"><enum>(f)</enum><header>Duration</header><text>In carrying out this section, the Director shall run a single pilot competition to solicit and make awards. Each award shall be for a 3-year period.</text> </subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section> <section id="HB49C122CCD4940DBAB64CB31E41DAA0"><enum>427.</enum><header>Manufacturing fellowship program</header><text display-inline="no-display-inline">Section 18 of the National Institute of Standards and Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/15/278g-1">15 U.S.C. 278g–1</external-xref>) is amended—</text> <paragraph id="H236E2C47439C40288729356031AAC045"><enum>(1)</enum><text>by inserting <quote>(a) <header-in-text level="subsection" style="OLC">In General</header-in-text>.—</quote> before <quote>The Director is authorized</quote>; and</text> </paragraph> <paragraph id="H20A1B14162BE41C1B5A168DAB0FE6500"><enum>(2)</enum><text>by adding at the end the following new subsection:</text> <quoted-block display-inline="no-display-inline" id="HAA6C29C1DCAB4F6385CF02BAE8698F07" style="OLC"> <subsection id="HEADD9DC85D304D918160001518F47719"><enum>(b)</enum><header>Manufacturing Fellowship Program</header> <paragraph id="H3AD1B46C308248848753125C34B7DC6F"><enum>(1)</enum><header>Establishment</header><text>To promote the development of a robust research community working at the leading edge of manufacturing sciences, the Director shall establish a program to award—</text> <subparagraph id="H1760D987B2084AB6889B6F85606B3457"><enum>(A)</enum><text>postdoctoral research fellowships at the Institute for research activities related to manufacturing sciences; and</text> </subparagraph> <subparagraph id="H3F9FFE7D7D3B483389FBE81C40091CB"><enum>(B)</enum><text>senior research fellowships to established researchers in industry or at institutions of higher education who wish to pursue studies related to the manufacturing sciences at the Institute.</text> </subparagraph></paragraph> <paragraph id="H7743AFE56B7A42E08025F5EDBD5EA4ED"><enum>(2)</enum><header>Applications</header><text>To be eligible for an award under this subsection, an individual shall submit an application to the Director at such time, in such manner, and containing such information as the Director may require.</text> </paragraph> <paragraph id="H9EE4D8C01B994EF8BA00BCC9A573681D"><enum>(3)</enum><header>Stipend levels</header><text>Under this subsection, the Director shall provide stipends for postdoctoral research fellowships at a level consistent with the National Institute of Standards and Technology Postdoctoral Research Fellowship Program, and senior research fellowships at levels consistent with support for a faculty member in a sabbatical position.</text> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section> <section id="H8C045990B21D43D88BBD0068401F79C2"><enum>428.</enum><header>Meetings of Visiting Committee on Advanced Technology</header><text display-inline="no-display-inline">Section 10(d) of the National Institute of Standards and Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/15/278">15 U.S.C. 278(d)</external-xref>) is amended by striking <quote>quarterly</quote> and inserting <quote>twice each year</quote>.</text> </section> <section id="H5641397CC09C4DF1952F94C1F790AF4E"><enum>429.</enum><header>Manufacturing research database</header> <subsection id="H56349E696EDD4E3F8BAAFFD789E54BC2"><enum>(a)</enum><header>Establishment</header><text>The National Institute of Standards and Technology shall provide for the establishment of a manufacturing research database to enable private sector individuals and Federal officials to access a broad range of information on manufacturing research carried out with funding support from the Federal Government.</text> </subsection> <subsection id="HB61E1684C1D24A829DF403A2C2DD572D"><enum>(b)</enum><header>Contents</header><text>The database established under subsection (a) shall contain—</text> <paragraph id="H4F53682807A94E9287424DDE7936AD8C"><enum>(1)</enum><text>all publicly available information maintained by a Federal agency relating to manufacturing research projects funded in whole or in part by the Federal Government; and</text> </paragraph> <paragraph id="H1A5A59F6BFBC4B1DA361A77D6FF58792"><enum>(2)</enum><text>information about all Federal programs that may be of interest to manufacturers.</text> </paragraph></subsection> <subsection id="HF51DD77C35F644F8BBB619D89BBBFEDC"><enum>(c)</enum><header>Accessibility</header><text>Information contained in the database shall be accessible in a manner to enable users of the database to easily retrieve information of specific interest to them.</text> </subsection> <subsection id="H71FA13EBC7764F7BAEA144B02494D844"><enum>(d)</enum><header>Fees</header><text>The National Institute of Standards and Technology may authorize charging a nominal fee for using the database to access information described in subsection (b)(1) as necessary to recover the costs of maintaining the database.</text> </subsection> <subsection id="H44612FD692E7470D00AF50B44824C06D"><enum>(e)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the National Institute of Standards and Technology $2,000,000 for carrying out this section.</text> </subsection></section></subtitle> <subtitle id="HD7EF35D40509470D94E20036721FA677"><enum>C</enum><header>Miscellaneous</header> <section id="HA88573D72E2A454CADE43B166B807B2E"><enum>441.</enum><header>Post-doctoral fellows</header><text display-inline="no-display-inline">Section 19 of the National Institute of Standards and Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/15/278g-2">15 U.S.C. 278g–2</external-xref>) is amended by striking <quote>nor more than 60 new fellows</quote> and inserting <quote>nor more than 120 new fellows</quote>.</text> </section> <section id="HB8B1C89181E941ADA33E231308F19C7F"><enum>442.</enum><header>Financial agreements clarification</header><text display-inline="no-display-inline">Section 2(b)(4) of the National Institute of Standards and Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/15/272">15 U.S.C. 272(b)(4)</external-xref>) is amended by inserting <quote>and grants and cooperative agreements,</quote> after <quote>arrangements,</quote>.</text> </section> <section id="HEE447A6D39934B5D8117028B43161549"><enum>443.</enum><header>Working capital fund transfers</header><text display-inline="no-display-inline">Section 12 of the National Institute of Standards and Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/15/278b">15 U.S.C. 278b</external-xref>) is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="HD3B95844B5F6408F9E7FC5D17786DD59" style="OLC"> <subsection id="H92232C1816B54B88987600D243F7A543"><enum>(g)</enum><header>Amount and Source of Transfers</header><text>Not more than one-quarter of one percent of the amounts appropriated to the Institute for any fiscal year may be transferred to the fund, in addition to any other transfer authority. 278m</external-xref>) is repealed.</text> </section> <section id="H7D90C415FD664452B8282BEF2B3724B4"><enum>446.</enum><header>Redefinition of the metric system</header><text display-inline="no-display-inline">Section 3570 of the Revised Statues of the United States (derived from section 2 of the Act of July 28, 1866, entitled <quote>An Act to authorize the Use of the Metric System of Weights and Measures</quote> (<external-xref legal-doc="usc" parsable-cite="usc/15/205">15 U.S.C. 205</external-xref>; 14 Stat. 339)) is amended to read as follows:</text> <quoted-block display-inline="no-display-inline" id="H2C10BC2F47AD429E8D806D589E37A801" style="OLC"> <section id="H709D75B77CDE4063ABC3624BFBD3E3B7"><enum>3570.</enum><header>Metric system defined</header><text display-inline="no-display-inline">The metric system of measurement shall be defined as the International System of Units as established in 1960, and subsequently maintained, by the General Conference of Weights and Measures, and as interpreted or modified for the United States by the Secretary of Commerce.</text> zones</header> <subsection id="H836D2F98D2EB46F5858CB2F915D5A2D6"><enum>(a)</enum><text display-inline="yes-display-inline">Section 1 of the Act of March 19, 1918, (commonly known as the <quote>Calder Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/15/261">15 U.S.C. 261</external-xref>) is amended—</text> <paragraph id="H9BD9CAF4686E496F81815E7076506FC4"><enum>(1)</enum><text>by striking the second sentence and the extra period after it and inserting <quote>Except as provided in section 3(a) of the Uniform Time Act of 1966 (<external-xref legal-doc="usc" Navy.</quote>.</text> </paragraph></subsection> <subsection id="HB01079FC6D4549ADA3E4F5E00933017"><enum>(b)</enum><text>Section 3 of the Act of March 19, 1918, (commonly known as the <quote>Calder Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/15/264">15 U.S.C. 264</external-xref>) is amended by striking <quote>third zone</quote> and inserting <quote>fourth zone</quote>.</text> </subsection></section> <section id="H1B3ACA00900A4EF6920012C557541606"><enum>449.</enum><header>Procurement of temporary and intermittent services</header> <subsection id="HBB2F8497D8894CF98F7FC5F3DA00BF3"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Director of the National Institute of Standards and Technology may procure the temporary or intermittent services of experts or consultants (or organizations thereof) in accordance with <external-xref legal-doc="usc" parsable-cite="usc/5/3109">section 3109(b)</external-xref> of title 5, United States Code to assist on urgent or short-term research projects.</text> </subsection> <subsection id="H68A3D554BAA54D298C7866090091E7D8"><enum>(b)</enum><header>Extent of authority</header><text>A procurement under this section may not exceed 1 year in duration, and the Director shall procure no more than 200 experts and consultants per year.</text> </subsection> <subsection id="HF9547E9CE2E94EA5A39EFEB2B0895F2B"><enum>(c)</enum><header>Sunset</header><text>This section shall cease to be effective after September 30, 2010.</text> </subsection> <subsection id="H2E3FF55D37FB4E9DA93EF02278F58E5"><enum>(d)</enum><header>Report to congress</header><text>Not later than 2 years after the date of enactment of this Act, the Comptroller General shall report to the Committee on Science and Technology of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate on whether additional safeguards would be needed with respect to the use of authorities granted under this section if such authorities were to be made permanent.</text> </subsection></section> <section display-inline="no-display-inline" id="H6722E0182A8445889004662110B45074" section-type="subsequent-section"><enum>450.</enum><header>Malcolm Baldrige awards</header><text display-inline="no-display-inline">Section 17(c)(3) of the Stevenson-Wydler Technology Innovation Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/15/3711a">15 U.S.C. 3711a(c)(3)</external-xref>) is amended to read as follows:</text> <quoted-block display-inline="no-display-inline" id="HC3CDA9FD6B134DAD9D2DF93175EB6472" style="OLC"> <paragraph display-inline="no-display-inline">Title I of the High-Performance Computing Act of 1991 (<external-xref legal-doc="usc" parsable-cite="usc/15/5511">15 U.S.C. 5511 et seq.</external-xref>) is amended—</text> <paragraph id="HC9CA5989AC1E44BC9696263D202224CE"><enum>(1)</enum><text>in the title heading, by striking <quote><header-in-text level="title" style="OLC">AND THE NATIONAL RESEARCH AND productivity, capability, security, portability, and reliability;</text> </subparagraph> <subparagraph id="H2AE6D7C4251E426F81C55041A4C0191C" indent="up1"><enum>(E)</enum><text>provide for high-performance networks, including experimental testbed networks, to enable research and development on, and demonstration of, advanced applications enabled by such networks;</text> </subparagraph> <subparagraph id="H8E860CDA2CF14820B179B5800000A356" indent="up1"><enum>(F)</enum><text>provide for computational science and engineering research on mathematical modeling and algorithms for applications in all fields of science and engineering;</text> </subparagraph> <subparagraph id="HBFEEB5E15F32451982388662674BCDE0" indent="up1"><enum>(G)</enum><text>provide for the technical support of, and research and development on, high-performance computing systems and software required to address Grand Challenges;</text> </subparagraph> <subparagraph id="H462BBB67BAEC4ECCB5E865DAF9F1F1D4" indent="up1"><enum>(H)</enum><text>provide for educating and training additional undergraduate and graduate students in software engineering, computer science, computer and network security, applied mathematics, library and information science, and computational science; and</text> </subparagraph> <subparagraph id="H6D9960EE04814864BE7F8DB46C7DC847" indent="up1"><enum>(I)</enum><text>provide for improving the security of computing and networking systems, including Federal systems, including research required to establish security standards and practices for these systems.</text> </subparagraph><after-quoted-block>;</after-quoted-block></quoted-block> </subparagraph> <subparagraph id="HBE0CBF860072409E00B03B5700854857"><enum>(B)</enum><text>by striking paragraph (2) and id="HEBC6AC2E862944FD89D4CC5BAAA282D"><enum>(iv)</enum><text>by inserting after subparagraph (D), as so redesignated by clause (ii) of this subparagraph, the following new subparagraph:</text> display-inline="yes-display-inline" id="H70B64EDCA54841CC80384EBE5205F3FC"><enum>(1)</enum><text>The President shall establish an advisory committee on high-performance computing consisting of non-Federal members, including representatives of the research, education, and library communities, network providers, and industry, who are specially qualified to provide the Director with advice and information on high-performance computing. The recommendations of the advisory committee shall be considered in reviewing and revising the Program. The advisory committee shall provide the Director with an independent assessment of—</text> <subparagraph id="HBEC131A3C36F431690A96B595EEF0B7" indent="up1"><enum>(A)</enum><text>progress made in implementing the Program;</text> </subparagraph> <subparagraph id="HDEE0177E2F3E415EAEA7DECF8E4DEBCD" indent="up1"><enum>(B)</enum><text>the need to revise the Program;</text> </subparagraph> <subparagraph id="H884C4ED859664E9AAD9EA3A4477CB7F0" indent="up1"><enum>(C)</enum><text>the balance between the components of the Program, including funding levels for the Program Component Areas;</text> </subparagraph> <subparagraph id="HAC7BCA708E2F48F3A2CE5B81819306C6" indent="up1"><enum>(D)</enum><text>whether the research and development undertaken pursuant to the Program is helping to maintain United States leadership in high-performance computing and networking technology; and</text> </subparagraph> <subparagraph id="H39A6F8A8FF954AE900EFC4540098409C" indent="up1"><enum>(E)</enum><text>other issues identified by the Director.</text> </subparagraph></paragraph> <paragraph id="HC1F9B89D6A14425AA3F909728900EA46" indent="up1"><enum>(2)</enum><text>In addition to the duties outlined in paragraph (1), the advisory committee shall conduct periodic evaluations of the funding, management, coordination, implementation, and activities of the Program, and shall report not less frequently than once every two fiscal years to the Committee on Science and Technology of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate on its findings and recommendations.
