<official-title>To amend the Omnibus Crime Control and Safe Streets Act of 1968 to expand the definition of firefighter to include apprentices and trainees, regardless of age or duty limitations.</official-title>

<section id="H06E6EF34BFB34C4580869384A3942F87" section-type="section-one"><enum>1.</enum><header>Short title; findings</header> 
<subsection id="HC00DC315721E4835A5C63D8EC1E8E97"><enum>(a)</enum><header>Short title</header><text display-inline="yes-display-inline"> This Act may be cited as the <quote><short-title>Christopher Kangas Fallen Firefighter Fairness Act</short-title></quote>.</text></subsection> 
<subsection id="HE72768B92E1D48AAB02E50C88227DF96"><enum>(b)</enum><header>Findings</header><text>Congress finds that—</text> 
<paragraph id="H44F6BE9DA66849B68E26180076091389"><enum>(1)</enum><text display-inline="yes-display-inline">approximately 50 percent of all firefighters start out as junior firefighters;</text></paragraph> 
<paragraph id="H2EBA961E064F4BA892F3578798776BE5"><enum>(2)</enum><text>Christopher Kangas was a 14 year old full member of the Brookhaven, Pennsylvania Volunteer Fire Department who tragically died when he was hit by a car while he was responding on his bicycle to a fire alarm; and</text></paragraph> 
<paragraph id="H293A19B7F88642368EDB53005FB48BE9"><enum>(3)</enum><text display-inline="yes-display-inline">because of his age, however, he is not recognized under the Public Safety Officer’s Death Benefit Act nor was he considered eligible to have his name added to the National Fallen Firefighter’s Memorial in Emmetsburg, Maryland.</text></paragraph></subsection></section> 
<section id="H974F178877434253B833FE02B1D19DB1"><enum>2.</enum><header>Inclusion of apprentices and trainees in definition of firefighter</header><text display-inline="no-display-inline"> Section 1204(4) of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3796b">42 U.S.C. 3796b(4)</external-xref>) is amended by inserting <quote>, regardless of age, status as an apprentice or trainee, or duty restrictions imposed because of age or status as an apprentice or trainee,</quote> after <quote>fire department</quote>.</text></section> 
<section id="HF16722B5AC0C45DE99C85DC897D4B86D"><enum>3.</enum><header>Effective date</header><text display-inline="no-display-inline"> The amendment made by this Act shall apply with respect to deaths and injuries which occur on or after May 4, 2002.</text></section>
