		<section id="HD7B5851E20BB423592B1597FBEB1E011" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote>Agricultural Disaster Assistance and Western States Emergency Unfinished
			 Business Appropriations Act, 2007</quote>.</text>

		</section><section id="H77F57621488C4068A140C4926A975299"><enum>3.</enum><header>Statement of
			 appropriations</header><text display-inline="no-display-inline">The following
			 sums in this Act are appropriated, out of any money in the Treasury not
			 otherwise appropriated, for the fiscal year ending September 30, 2007.</text>
		</section><title id="H4CAA870673F54A788F075F993B0549A8"><enum>I</enum><header>AGRICULTURAL
			 ASSISTANCE</header>
			<section id="H5B108742AD35496094DE6C942D51D6F7"><enum>1001.</enum><header>Crop disaster
			 assistance</header>
				<subsection id="H52897F7D81EF410089B5ED35FBE408A1"><enum>(a)</enum><header>Assistance
			 Available</header><text>There are hereby appropriated to the Secretary of
			 Agriculture such sums as are necessary, to remain available until expended, to
			 make emergency financial assistance available to producers on a farm that
			 incurred qualifying quantity or quality losses for the 2005 or 2006 crop, or
			 that part of the 2007 crop year before February 28, 2007, due to damaging
			 weather or any related condition (including losses due to crop diseases,
			 insects, and delayed planting), as determined by the Secretary. However, to be
			 eligible for assistance, the crop subject to the loss must have been planted
			 before February 28, 2007 or, in the case of prevented planting or other total
			 loss, would have been planted before February 28, 2007 in the absence of the
			 damaging weather or any related condition.</text>
				</subsection><subsection id="H1AF8107AC3514C48BE7F24D041A2FF38"><enum>(b)</enum><header>Election of Crop
			 Year</header><text>If a producer incurred qualifying crop losses in more than
			 one of the 2005, 2006, or 2007 crop years, the producer shall elect to receive
			 assistance under this section for losses incurred in only one of such crop
			 years. The producer may not receive assistance under this section for more than
			 one crop year.</text>
				</subsection><subsection id="HD36FAE23626B4C79A85C20CE18508C60"><enum>(c)</enum><header>Administration</header>
					<paragraph id="H6E060FE8D2B64930ABCC15A9E1D5F59B"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in paragraph (2), the Secretary of
			 Agriculture shall make assistance available under this section in the same
			 manner as provided under section 815 of the Agriculture, Rural Development,
			 Food and Drug Administration and Related Agencies Appropriations Act, 2001
			 (<external-xref legal-doc="public-law" parsable-cite="pl/106/387">Public Law 106–387</external-xref>; 114 Stat. 1549A–55), including using the same loss
			 thresholds for quantity and economic losses as were used in administering that
			 section, except that the payment rate shall be 50 percent of the established
			 price, instead of 65 percent.</text>
					</paragraph><paragraph id="HD392C9EB9E0D44B1AABD09979222CEBC"><enum>(2)</enum><header>Loss thresholds
			 for quality losses</header><text>In the case of a payment for quality loss for
			 a crop under subsection (a), the loss thresholds for quality loss for the crop
			 shall be determined under subsection (d).</text>
					</paragraph></subsection><subsection id="H1D8F9F48F4014C6CAD6598340D9ADC7E"><enum>(d)</enum><header>Quality
			 Losses</header>
					<paragraph id="H6068681D957E474D865FC21868F6E030"><enum>(1)</enum><header>In
			 general</header><text>Subject to paragraph (3), the amount of a payment made to
			 producers on a farm for a quality loss for a crop under subsection (a) shall be
			 equal to the amount obtained by multiplying—</text>
						<subparagraph id="H675E92FC04CE458094912D8175208FA8"><enum>(A)</enum><text>65 percent of the
			 payment quantity determined under paragraph (2); by</text>
						</subparagraph><subparagraph id="HDD773C138E5A4BBEB046F7A45694532D"><enum>(B)</enum><text>50 percent of the
			 payment rate determined under paragraph (3).</text>
						</subparagraph></paragraph><paragraph id="HD479FF587ADF4FE98A9BC3C0CDD3DF37"><enum>(2)</enum><header>Payment
			 quantity</header><text>For the purpose of paragraph (1)(A), the payment
			 quantity for quality losses for a crop of a commodity on a farm shall equal the
			 lesser of—</text>
						<subparagraph id="H686036035C054BECB54AC7F5ED175D49"><enum>(A)</enum><text>the actual
			 production of the crop affected by a quality loss of the commodity on the farm;
			 or</text>
						</subparagraph><subparagraph id="H052D811E78704A22962DDD35251F6837"><enum>(B)</enum><text>the quantity of
			 expected production of the crop affected by a quality loss of the commodity on
			 the farm, using the formula used by the Secretary of Agriculture to determine
			 quantity losses for the crop of the commodity under subsection (a).</text>
						</subparagraph></paragraph><paragraph id="HEF357E787040495A8AE73190C1BC929B"><enum>(3)</enum><header>Payment
			 rate</header><text>For the purpose of paragraph (1)(B) and in accordance with
			 paragraphs (5) and (6), the payment rate for quality losses for a crop of a
			 commodity on a farm shall be equal to the difference between—</text>
						<subparagraph id="HEA1659EB4AA64A11AD4888E2AF7D3C18"><enum>(A)</enum><text>the per unit
			 market value that the units of the crop affected by the quality loss would have
			 had if the crop had not suffered a quality loss; and</text>
						</subparagraph><subparagraph id="HF30267339E29431E95933206C417EEA6"><enum>(B)</enum><text>the per unit
			 market value of the units of the crop affected by the quality loss.</text>
						</subparagraph></paragraph><paragraph id="H197EFF436D634FC8AB41A0EABB13CBE8"><enum>(4)</enum><header>Eligibility</header><text>For
			 producers on a farm to be eligible to obtain a payment for a quality loss for a
			 crop under subsection (a), the amount obtained by multiplying the per unit loss
			 determined under paragraph (1) by the number of units affected by the quality
			 loss shall be at least 25 percent of the value that all affected production of
			 the crop would have had if the crop had not suffered a quality loss.</text>
					</paragraph><paragraph id="HECCEF1C01B5147A3AA20EDECEA7071DA"><enum>(5)</enum><header>Marketing
			 contracts</header><text>In the case of any production of a commodity that is
			 sold pursuant to one or more marketing contracts (regardless of whether the
			 contract is entered into by the producers on the farm before or after harvest)
			 and for which appropriate documentation exists, the quantity designated in the
			 contracts shall be eligible for quality loss assistance based on the one or
			 more prices specified in the contracts.</text>
					</paragraph><paragraph id="H14FA4630AC93474989193A41F321F9E6"><enum>(6)</enum><header>Other
			 production</header><text>For any additional production of a commodity for which
			 a marketing contract does not exist or for which production continues to be
			 owned by the producer, quality losses shall be based on the average local
			 market discounts for reduced quality, as determined by the appropriate State
			 committee of the Farm Service Agency.</text>
					</paragraph><paragraph id="H8F632F67F4C94402AA5D7E44CE626BBC"><enum>(7)</enum><header>Quality
			 adjustments and discounts</header><text>The appropriate State committee of the
			 Farm Service Agency shall identify the appropriate quality adjustment and
			 discount factors to be considered in carrying out this subsection,
			 including—</text>
						<subparagraph id="HD54E243907DF4CF2A4C001C2FF8A1757"><enum>(A)</enum><text>the average local
			 discounts actually applied to a crop; and</text>
						</subparagraph><subparagraph id="H4891A2FFDFB94BEAB3D1566B0352C6CF"><enum>(B)</enum><text>the discount
			 schedules applied to loans made by the Farm Service Agency or crop insurance
			 coverage under the Federal Crop Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1501">7 U.S.C. 1501 et seq.</external-xref>).</text>
						</subparagraph></paragraph><paragraph id="HE7F56A94BA31401BB1B722AAF25AE9A1"><enum>(8)</enum><header>Eligible
			 production</header><text>The Secretary of Agriculture shall carry out this
			 subsection in a fair and equitable manner for all eligible production,
			 including the production of fruits and vegetables, other specialty crops, and
			 field crops.</text>
					</paragraph></subsection><subsection id="HC67AE2BAA5F0468CA96800E0E760C686"><enum>(e)</enum><header>Payment
			 Limitations</header>
					<paragraph id="HE206A71AD46B485997BF8D2E5E5B5A30"><enum>(1)</enum><header>Limit on amount
			 of assistance</header><text>Assistance provided under this section to a
			 producer for losses to a crop, together with the amounts specified in paragraph
			 (2) applicable to the same crop, may not exceed 95 percent of what the value of
			 the crop would have been in the absence of the losses, as estimated by the
			 Secretary of Agriculture.</text>
					</paragraph><paragraph id="H72D2B7EC56C44516AD208764F7EA9AFF"><enum>(2)</enum><header>Other
			 payments</header><text>In applying the limitation in paragraph (1), the
			 Secretary shall include the following:</text>
						<subparagraph id="HE0EC51E4809C465891A529A657102CC6"><enum>(A)</enum><text>Any crop insurance
			 payment made under the Federal Crop Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1501">7 U.S.C. 1501 et seq.</external-xref>) or
			 payment under section 196 of the Federal Agricultural Improvement and Reform
			 Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/7/7333">7 U.S.C. 7333</external-xref>) that the producer receives for losses to the same
			 crop.</text>
						</subparagraph><subparagraph id="H7E6B210C115842E6BD8EEFC1A4ED7438"><enum>(B)</enum><text>The value of the
			 crop that was not lost (if any), as estimated by the Secretary.</text>
						</subparagraph></paragraph></subsection><subsection id="H926A15970C35439C996DCA029280CEB1"><enum>(f)</enum><header>Eligibility
			 Requirements and Limitations</header><text>The producers on a farm shall not be
			 eligible for assistance under this section with respect to losses to an
			 insurable commodity or noninsurable commodity if the producers on the
			 farm—</text>
					<paragraph id="HF53070D0FC9F4CCAA47B967F124674D0"><enum>(1)</enum><text>in the case of an
			 insurable commodity, did not obtain a policy or plan of insurance for the
			 insurable commodity under the Federal Crop Insurance Act (7 U.S.C. 1501 et
			 seq.) for the crop incurring the losses;</text>
					</paragraph><paragraph id="H2D5B44A836714D4C801773130F15AAD1"><enum>(2)</enum><text>in the case of a
			 noninsurable commodity, did not file the required paperwork, and pay the
			 administrative fee by the applicable State filing deadline, for the
			 noninsurable commodity under section 196 of the Federal Agriculture Improvement
			 and Reform Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/7/7333">7 U.S.C. 7333</external-xref>) for the crop incurring the losses;
			 or</text>
					</paragraph><paragraph id="H457434A600A1400592DCB67F0F58DADC"><enum>(3)</enum><text>were not in
			 compliance with highly erodible land conservation and wetland conservation
			 provisions.</text>
					</paragraph></subsection><subsection id="H4A6684385E304155B021F7E39519EF79"><enum>(g)</enum><header>Timing</header>
					<paragraph id="H79E8292844B041BC82F0EBD4802D6625"><enum>(1)</enum><header>In
			 general</header><text>Subject to paragraph (2), the Secretary of Agriculture
			 shall make payments to producers on a farm for a crop under this section not
			 later than 60 days after the date the producers on the farm submit to the
			 Secretary a completed application for the payments.</text>
					</paragraph><paragraph id="H4317BB06C5324C69A0DC8532A5957AAD"><enum>(2)</enum><header>Interest</header><text>If
			 the Secretary does not make payments to the producers on a farm by the date
			 described in paragraph (1), the Secretary shall pay to the producers on a farm
			 interest on the payments at a rate equal to the current (as of the sign-up
			 deadline established by the Secretary) market yield on outstanding, marketable
			 obligations of the United States with maturities of 30 years.</text>
					</paragraph></subsection><subsection id="H4E885CD1049244C89B05DAB59282D69B"><enum>(h)</enum><header>Definitions</header><text>In
			 this section:</text>
					<paragraph id="H29507375942043EB8AF9890B0F288808"><enum>(1)</enum><header>Insurable
			 commodity</header><text>The term <term>insurable commodity</term> means an
			 agricultural commodity (excluding livestock) for which the producers on a farm
			 are eligible to obtain a policy or plan of insurance under the Federal Crop
			 Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1501">7 U.S.C. 1501 et seq.</external-xref>).</text>
					</paragraph><paragraph id="HE6A4BFD72B584128AB34C71840CACB96"><enum>(2)</enum><header>Noninsurable
			 commodity</header><text>The term <term>noninsurable commodity</term> means a
			 crop for which the producers on a farm are eligible to obtain assistance under
			 section 196 of the Federal Agriculture Improvement and Reform Act of 1996 (7
			 U.S.C. 7333).</text>
					</paragraph></subsection></section><section id="H21BB332CE6AA4E0C98838A54DE710735"><enum>1002.</enum><header>Livestock
			 assistance</header>
				<subsection id="H3216DEE13C9849DE806C6248CF2C459B"><enum>(a)</enum><header>Livestock
			 Compensation Program</header>
					<paragraph id="HAE39D260BC464AA3941D33AA1874D780"><enum>(1)</enum><header>Availability of
			 assistance</header><text>There are hereby appropriated to the Secretary of
			 Agriculture such sums as are necessary, to remain available until expended, to
			 carry out the livestock compensation program established under subpart B of
			 part 1416 of title 7, Code of Federal Regulations, as announced by the
			 Secretary on February 12, 2007 (72 Fed. Reg. 6443), to provide compensation for
			 livestock losses between January 1, 2005 and February 28, 2007, due to a
			 disaster, as determined by the Secretary (including losses due to blizzards
			 that started in 2006 and continued into January 2007). However, the payment
			 rate for compensation under this subsection shall be 70 percent of the payment
			 rate otherwise applicable under such program. In addition, section
			 1416.102(b)(2)(ii) of title 7, Code of Federal Regulations (72 Fed. Reg. 6444)
			 shall not apply.</text>
					</paragraph><paragraph id="HAAFCA3C53B424C5E9230F83382F02EEE"><enum>(2)</enum><header>Eligible
			 applicants</header><text>In carrying out the program described in paragraph
			 (1), the Secretary shall provide assistance to any applicant that—</text>
						<subparagraph id="HEE2AB85125D54AECB94010EC1B9229B7"><enum>(A)</enum><text>conducts a
			 livestock operation that is located in a disaster county with eligible
			 livestock specified in paragraph (1) of <external-xref legal-doc="usc" parsable-cite="usc/7/1416">section 1416.102(a)</external-xref> of title 7, Code of
			 Federal Regulations (72 Fed. Reg. 6444), an animal described in section
			 10806(a)(1) of the Farm Security and Rural Investment Act of 2002 (21 U.S.C.
			 321d(a)(1)), or other animals designated by the Secretary as livestock for
			 purposes of this subsection; and</text>
						</subparagraph><subparagraph id="HD2ACECC06B054F24BEEBD37AB3064D15"><enum>(B)</enum><text>meets the
			 requirements of paragraphs (3) and (4) of <external-xref legal-doc="usc" parsable-cite="usc/7/1416">section 1416.102(a)</external-xref> of title 7, Code
			 of Federal Regulations, and all other eligibility requirements established by
			 the Secretary for the program.</text>
						</subparagraph></paragraph><paragraph id="HE8491AB911ED483CAB659E3C3DCA598D"><enum>(3)</enum><header>Election of
			 losses</header>
						<subparagraph id="H32BAE412AAE644F18ED68955522946BF"><enum>(A)</enum><text>If a producer
			 incurred eligible livestock losses in more than one of the 2005, 2006, or 2007
			 calendar years, the producer shall elect to receive payments under this
			 subsection for losses incurred in only one of such calendar years, and such
			 losses must have been incurred in a county declared or designated as a disaster
			 county in that same calendar year.</text>
						</subparagraph><subparagraph id="HC8E035FB69844936A88ACAD2C4D7F056"><enum>(B)</enum><text>Producers may
			 elect to receive compensation for losses in the calendar year 2007 grazing
			 season that are attributable to wildfires occurring during the applicable
			 period, as determined by the Secretary.</text>
						</subparagraph></paragraph><paragraph id="H050E019D35C3454B990B0134EAD588FE"><enum>(4)</enum><header>Mitigation</header><text>In
			 determining the eligibility for or amount of payments for which a producer is
			 eligible under the livestock compensation program, the Secretary shall not
			 penalize a producer that takes actions (recognizing disaster conditions) that
			 reduce the average number of livestock the producer owned for grazing during
			 the production year for which assistance is being provided.</text>
					</paragraph><paragraph id="HDD01E1A871CF488495CFACA41AECFED8"><enum>(5)</enum><header>Definitions</header><text>In
			 this subsection:</text>
						<subparagraph id="H2FA836148DB849B7BFF6F655B9273192"><enum>(A)</enum><header>Disaster
			 county</header><text>The term <term>disaster county</term> means—</text>
							<clause id="HD4F7EB766A9747A0BD657DA7FD791B01"><enum>(i)</enum><text>a
			 county included in the geographic area covered by a natural disaster
			 declaration; and</text>
							</clause><clause id="H78B3CE3AA77444FC9960FA93E9D7483E"><enum>(ii)</enum><text>each county
			 contiguous to a county described in clause (i).</text>
							</clause></subparagraph><subparagraph id="H63F1D4516F094330B881437E9AE4848D"><enum>(B)</enum><header>Natural disaster
			 declaration</header><text>The term <term>natural disaster declaration</term>
			 means—</text>
							<clause id="H4FF737054A7E4C70B4A962CA65D091BA"><enum>(i)</enum><text>a
			 natural disaster declared by the Secretary between January 1, 2005 and February
			 28, 2007, under section 321(a) of the <act-name parsable-cite="CFRDA">Consolidated Farm and Rural Development Act</act-name> (7
			 U.S.C. 1961(a));</text>
							</clause><clause id="H9DECACE24BF64795A309D8652B05E1F8"><enum>(ii)</enum><text>a
			 major disaster or emergency designated by the President between January 1, 2005
			 and February 28, 2007, under the Robert T. Stafford Disaster Relief and
			 Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>); or</text>
							</clause><clause id="H55BD75218D0940CFADC28A440D88B506"><enum>(iii)</enum><text>a
			 determination of a Farm Service Agency Administrator’s Physical Loss Notice if
			 such notice applies to a county included under (ii).</text>
							</clause></subparagraph></paragraph></subsection><subsection id="HD6473DC7B7274089B9D8D0ACF8201BBD"><enum>(b)</enum><header>Livestock
			 Indemnity Payments</header>
					<paragraph id="H36D7532825774DAA9ED748805084817D"><enum>(1)</enum><header>Availability of
			 assistance</header><text>There are hereby appropriated to the Secretary of
			 Agriculture such sums as are necessary, to remain available until expended, to
			 make livestock indemnity payments to producers on farms that have incurred
			 livestock losses between January 1, 2005 and February 28, 2007, due to a
			 disaster, as determined by the Secretary (including losses due to blizzards
			 that started in 2006 and continued into January 2007) in a disaster county. To
			 be eligible for assistance, applicants must meet all eligibility requirements
			 established by the Secretary for the program.</text>
					</paragraph><paragraph id="HD1C65EEF036C4CB8B3FAF0058D78DC07"><enum>(2)</enum><header>Election of
			 losses</header><text>If a producer incurred eligible livestock losses in more
			 than one of the 2005, 2006, or 2007 calendar years, the producer shall elect to
			 receive payments under this subsection for losses incurred in only one of such
			 calendar years. The producer may not receive payments under this subsection for
			 more than one calendar year.</text>
					</paragraph><paragraph id="HF430879179AF4A149FD8F11B5AA765B0"><enum>(3)</enum><header>Payment
			 rates</header><text>Indemnity payments to a producer on a farm under paragraph
			 (1) shall be made at a rate of not less than 30 percent of the market value of
			 the applicable livestock on the day before the date of death of the livestock,
			 as determined by the Secretary.</text>
					</paragraph><paragraph id="HA0F262E3A8A94FB781864497ABE1D371"><enum>(4)</enum><header>Livestock
			 defined</header><text>In this subsection, the term <term>livestock</term> means
			 an animal that—</text>
						<subparagraph id="H5C712DBA1D3C4AF2B16C078B769FD6B6"><enum>(A)</enum><text>is specified in
			 clause (i) of <external-xref legal-doc="regulation" parsable-cite="cfr/7/1416.203">section 1416.203(a)(2)</external-xref> of title 7, Code of Federal Regulations
			 (72 Fed. Reg. 6445), or is designated by the Secretary as livestock for
			 purposes of this subsection; and</text>
						</subparagraph><subparagraph id="HD1B1543A1DAD48CEA4F7F786C5E2B3BA"><enum>(B)</enum><text>meets the
			 requirements of clauses (iii) and (iv) of such section.</text>
						</subparagraph></paragraph><paragraph id="HE24A56EF45D84C82A6EB59EFA1B80E8A"><enum>(5)</enum><header>Definitions</header><text>In
			 this subsection:</text>
						<subparagraph id="H526145D090DA4A319ECC74A2970360BA"><enum>(A)</enum><header>Disaster
			 county</header><text>The term <term>disaster county</term> means—</text>
							<clause id="HDB7E343ECD0944D69EC7E355CAE78952"><enum>(i)</enum><text>a
			 county included in the geographic area covered by a natural disaster
			 declaration; and</text>
							</clause><clause id="HF3E405E1768F4DF9BA35BCAACDA54222"><enum>(ii)</enum><text>each county
			 contiguous to a county described in clause (i).</text>
							</clause></subparagraph><subparagraph id="H15294C0CE8E34C688299C651DA3409DA"><enum>(B)</enum><header>Natural disaster
			 declaration</header><text>The term <term>natural disaster declaration</term>
			 means—</text>
							<clause id="HB383D4E673A642D39FB41813B241ACCC"><enum>(i)</enum><text>a
			 natural disaster declared by the Secretary between January 1, 2005 and February
			 28, 2007 under section 321(a) of the <act-name parsable-cite="CFRDA">Consolidated Farm and Rural Development Act</act-name> (7
			 U.S.C. 1961(a));</text>
							</clause><clause id="H7BF5A09464A74F569438AEDEC156A3ED"><enum>(ii)</enum><text>a
			 major disaster or emergency designated by the President between January 1, 2005
			 and February 28, 2007 under the Robert T. Stafford Disaster Relief and
			 Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>); or</text>
							</clause><clause id="H87ABF68C673C403B98514A3372AFC6FE"><enum>(iii)</enum><text>a
			 determination of a Farm Service Agency Administrator’s Physical Loss Notice if
			 such notice applies to a county included under (ii).</text>
							</clause></subparagraph></paragraph></subsection></section><section id="HF9BA0C3847B94A958F6F383B6E87A0B5"><enum>1003.</enum><header>Emergency
			 Conservation Program</header><text display-inline="no-display-inline">There is
			 hereby appropriated to the Secretary of Agriculture $20,000,000, to remain
			 available until expended, to provide assistance under the Emergency
			 Conservation Program under title IV of the Agriculture Credit Act of 1978 (16
			 U.S.C. 2201 et seq.) for the cleanup and restoration of farm and agricultural
			 production lands.</text>
			</section><section id="H106009B3976D4B26B5DB8A25B95E2338"><enum>1004.</enum><header>Payment
			 limitations</header>
				<subsection id="H15718CD6F7894719997D242C5CBB5500"><enum>(a)</enum><header>Reduction in
			 Payments to Reflect Payments for Same or Similar Losses</header><text>The
			 amount of any payment for which a producer is eligible under sections 5101 and
			 5102 shall be reduced by any amount received by the producer for the same loss
			 or any similar loss under—</text>
					<paragraph id="H721DF715960A492B81B3C698DA98A149"><enum>(1)</enum><text>the Department of
			 Defense, Emergency Supplemental Appropriations to Address Hurricanes in the
			 Gulf of Mexico, and Pandemic Influenza Act, 2006 (<external-xref legal-doc="public-law" parsable-cite="pl/109/148">Public Law 109–148</external-xref>; 119 Stat.
			 2680);</text>
					</paragraph><paragraph id="H6235FE633BAD41CA8D6A24E42E6B39E7"><enum>(2)</enum><text>an agricultural
			 disaster assistance provision contained in the announcement of the Secretary on
			 January 26, 2006, or August 29, 2006; or</text>
					</paragraph><paragraph id="HA6958BBEC5C448FA885CC1454BB396E5"><enum>(3)</enum><text>the Emergency
			 Supplemental Appropriations Act for Defense, the Global War on Terror, and
			 Hurricane Recovery, 2006 (<external-xref legal-doc="public-law" parsable-cite="pl/109/234">Public Law 109–234</external-xref>; 120 Stat. 418).</text>
					</paragraph></subsection><subsection id="HD3F28BC4332147E38494A0056DEB25E3"><enum>(b)</enum><header>Adjusted Gross
			 Income Limitation</header><text>Section 1001D of the Food Security Act of 1985
			 (<external-xref legal-doc="usc" parsable-cite="usc/7/1308-3a">7 U.S.C. 1308–3a</external-xref>) shall apply with respect to assistance provided under
			 sections 5101, 5102, and 5103.</text>
				</subsection></section><section id="HD574A4EE81B74A36BA39A24751B9E614"><enum>1005.</enum><header>Administration</header>
				<subsection id="H42976B8358E54E249F4DFB15A45F7443"><enum>(a)</enum><header>Regulations</header><text>The
			 Secretary of Agriculture may promulgate such regulations as are necessary to
			 implement sections 5101 and 5102.</text>
				</subsection><subsection id="H4823872989724B23BBC471DC5E15405F"><enum>(b)</enum><header>Procedure</header><text>The
			 promulgation of the implementing regulations and the administration of sections
			 5101 and 5102 shall be made without regard to—</text>
					<paragraph id="H2752C94B28834580B543F72EA05ED23F"><enum>(1)</enum><text>the notice and
			 comment provisions of <external-xref legal-doc="usc" parsable-cite="usc/5/553">section 553</external-xref> of title 5, United States Code;</text>
					</paragraph><paragraph id="H36863A07AC4A48A5BE0FDBD3E202129A"><enum>(2)</enum><text>the Statement of
			 Policy of the Secretary of Agriculture effective July 24, 1971 (36 Fed. Reg.
			 13804), relating to notices of proposed rulemaking and public participation in
			 rulemaking; and</text>
					</paragraph><paragraph id="HBBB70D4B48EA4C87A1C56E32A54E361D"><enum>(3)</enum><text>chapter 35 of
			 title 44, United States Code (commonly known as the <quote>Paperwork Reduction
			 Act</quote>).</text>
					</paragraph></subsection><subsection id="H0498BECE09034E3AB28D91C1AA0FC7DA"><enum>(c)</enum><header>Congressional
			 Review of Agency Rulemaking</header><text>In carrying out this section, the
			 Secretary of Agriculture shall use the authority provided under section 808 of
			 title 5, United States Code.</text>
				</subsection><subsection id="H8DB2C1B2F1414DBEAD36274D22B8DF91"><enum>(d)</enum><header>Use of Commodity
			 Credit Corporation; Limitation</header><text>In implementing sections 5101 and
			 5102, the Secretary of Agriculture may use the facilities, services, and
			 authorities of the Commodity Credit Corporation. The Corporation shall not make
			 any expenditures to carry out sections 5101 and 5102 unless funds have been
			 specifically appropriated for such purpose.</text>
				</subsection></section><section id="H10343EC4E273498DACF5DFC65ACFB4E0"><enum>1006.</enum><header>Milk income
			 loss contract program</header><text display-inline="no-display-inline">Section
			 1502(c)(3) of the Farm Security and Rural Investment Act of 2002 (7 U.S.C.
			 7982(c)(3)) is amended—</text>
				<paragraph id="H875B9C058D8E4EBAAC979A8E9F96E857"><enum>(1)</enum><text>in subparagraph
			 (A), by adding <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="H513A36DC5F844D6AB99746AE61C0DC3C"><enum>(2)</enum><text>in subparagraph
			 (B), by striking <quote>August</quote> and all that follows through the end and
			 inserting <quote>September 30, 2007, 34 percent.</quote>; and</text>
				</paragraph><paragraph id="H7EC286E4C31147148AF3BB96B58122DF"><enum>(3)</enum><text>by striking
			 subparagraph (C).</text>
				</paragraph></section><section id="H0B45E4C34349440A96B926AF0D67FBB2"><enum>1007.</enum><header>Dairy
			 assistance</header><text display-inline="no-display-inline">There is hereby
			 appropriated $20,000,000 to make payments to dairy producers for dairy
			 production losses in disaster counties, as defined in section 1002 of this
			 title, to remain available until expended.</text>
			</section><section id="H67971DBF811C47A59250C8C92B767343"><enum>1008.</enum><header>Noninsured
			 crop assistance program</header><text display-inline="no-display-inline">For
			 states in which there is a shortage of claims adjustors, as determined by the
			 Secretary, the Secretary shall permit the use of one claims adjustor certified
			 by the Secretary in carrying out 7 CFR 1437.401.</text>
			</section><section id="H736FEA0D18CF4FD29C46A6B89DA25188"><enum>1009.</enum><header>Emergency
			 grants to assist low-income migrant and seasonal farmworkers</header><text display-inline="no-display-inline">There is hereby appropriated $21,000,000 to
			 carry out section 2281 of the Food, Agriculture, Conservation and Trade Act of
			 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/5177a">42 U.S.C. 5177a</external-xref>), to remain available until expended.</text>
			</section><section id="H5BD2C58B72F44D59B8340AC7AB0B2D82"><enum>1010.</enum><header>Conservation
			 security program</header><text display-inline="no-display-inline">Section 20115
			 of <external-xref legal-doc="public-law" parsable-cite="pl/110/5">Public Law 110–5</external-xref> is amended by striking <quote>section 726</quote> and
			 inserting in lieu thereof <quote>section 726; section 741</quote>.</text>
			</section><section id="H12D8731FF9224EA39BDED06F35C9DEE3"><enum>1011.</enum><header>Administrative
			 expenses</header><text display-inline="no-display-inline">There is hereby
			 appropriated $30,000,000 for the <quote>Farm Service Agency, Salaries and
			 Expenses</quote>, to remain available until September 30, 2008.</text>
			</section><section id="HFEF0146F51AE480797E923BA935A550E"><enum>1012.</enum><header>Contract
			 waiver</header><text display-inline="no-display-inline">In carrying out crop
			 disaster and livestock assistance in this title, the Secretary shall require
			 forage producers to have participated in a crop insurance pilot program or the
			 Non-Insured Crop Disaster Assistance Program during the crop year for which
			 compensation is received.</text>

			 designation</header><text display-inline="no-display-inline">Amounts in this

			 schools</header>
						<subsection id="H8245214553E74939916395ABAF9BE685"><enum>(a)</enum><text>For fiscal year
			 2007, payments shall be made from any revenues, fees, penalties, or
			 miscellaneous receipts described in sections 102(b)(3) and 103(b)(2) of the
			 Secure Rural Schools and Community Self-Determination Act of 2000 (Public Law
			 106–393; <external-xref legal-doc="usc" parsable-cite="usc/16/500">16 U.S.C. 500</external-xref> note), not to exceed $100,000,000, and the payments
			 shall be made, to the maximum extent practicable, in the same amounts, for the
			 same purposes, and in the same manner as were made to States and counties in
			 2006 under that Act.</text>
						</subsection><subsection id="HFF039773445A4B60B9CFC3B9A12249BB"><enum>(b)</enum><text>There is
			 appropriated $425,000,000, to remain available until December 31, 2007, to be
			 used to cover any shortfall for payments made under this section from funds not
			 otherwise appropriated.</text>
						</subsection><subsection id="H1223EC4CE62D4FC2AD120E08FA754589"><enum>(c)</enum><text>Titles II and III
			 of <external-xref legal-doc="public-law" parsable-cite="pl/106/393">Public Law 106–393</external-xref> are amended, effective September 30, 2006, by striking
			 <quote>2006</quote> and <quote>2007</quote> each place they appear and
			 inserting <quote>2007</quote> and <quote>2008</quote>, respectively.</text>
