<official-title>To amend the Animal Welfare Act to increase the penalties for violations of such Act, to prohibit the use of animals for marketing medical devices, and for other purposes.</official-title>

<section id="H454FFA76376B4AA0A0F811871544857E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Animal Protection Accountability Improvement Act</short-title></quote>.</text></section> 
<section id="HAF23A16E64384E269E8230D2F944B4CE"><enum>2.</enum><header>Prohibition on use of animals for marketing of medical devices</header><text display-inline="no-display-inline">The Animal Welfare Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2131">7 U.S.C. 2131 et seq.</external-xref>) is amended by inserting after section 17 the following new section:</text>

<section id="HE786CF13D20442F4B51B93A621E073DF"><enum>18.</enum><header>Prohibition on use of live animals for marketing medical devices</header> 
<subsection id="H195EC3F4EC4A4107B1EB023F00615C12" display-inline="yes-display-inline"><enum>(a)</enum><header>In general</header><text>No person may use a live animal to—</text> 
<paragraph id="HDFEB4499415641E0ADA5007CC98E6497" indent="up1"><enum>(1)</enum><text display-inline="yes-display-inline">demonstrate a medical device or product to a sales representative for the purpose of marketing such medical device or product;</text></paragraph> 
<paragraph id="HC5023C780CDA48AF80F98E616CC8CEE" indent="up1"><enum>(2)</enum><text>train a sales representative to use a medical device or product;</text></paragraph> 
<paragraph id="H958E9D033F964CBEAC20A58300500015" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">demonstrate a medical device or product in a workshop or training session for the purpose of marketing a medical device or product; or</text></paragraph> 
<paragraph id="HAEF5B877EF204570BD97B602C41381D8" indent="up1"><enum>(4)</enum><text>create a multimedia recording (including a video recording) for the purpose of marketing a medical device or product.</text></paragraph></subsection> 
<subsection id="HE0B8A8D3235A4A9487E3EDCAD5ACBDB0"><enum>(b)</enum><header>Exception</header><text>Subsection (a) shall not apply to the training of medical personnel for a purpose other than marketing a medical device or product.</text></subsection> 
<subsection id="H2B1907D42F2B4EB1AA27B19523DE3C00"><enum>(c)</enum><header>Device defined</header><text>In this section, the term <quote>device</quote> has the meaning given the term in section 201(h) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/321">21 U.S.C. 321(h)</external-xref>).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HC1C8917247774CEE836D40524F004B33" section-type="subsequent-section"><enum>3.</enum><header>Fines for violations of the Animal Welfare Act</header><text display-inline="no-display-inline">Section 19(b) of the Animal Welfare Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2149">7 U.S.C. 2149(b)</external-xref>) is amended—</text> 
<paragraph id="H0DF7D3BB8F6849E2A2B4692C6D908DFA"><enum>(1)</enum><text>in the first sentence by striking <quote>not more than $2,500 for each such violation</quote> and inserting <quote>not more than $10,000 for each such violation</quote>; and</text></paragraph> 
<paragraph id="H3945DBD64041457EA6A9EF1DEE128EB"><enum>(2)</enum><text>by striking the second sentence and inserting the following: <quote>Each violation, each day during which a violation continues, and, in the case of a violation with respect to animals, each animal that is the subject of such a violation shall be a separate offense.</quote>.</text> </paragraph></section> 
<section id="H8363D7938D5840480013B22498925B5D"><enum>4.</enum><header>Reports on activities under the Animal Welfare Act</header><text display-inline="no-display-inline">The Animal Welfare Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2131">7 U.S.C. 2131 et seq.</external-xref>) is further amended by striking section 25 and inserting the following new section:</text>

<section id="H0F920BFF53E44067ABFFEE0050CDFA85"><enum>25.</enum><header>Annual report</header><text display-inline="yes-display-inline">Not later than March 1 of each year, the Secretary shall submit to Congress a report containing—</text> 
<paragraph id="ID4D9FB589D11F4EFEB4D1E24B30AB68FB"> <enum>(1)</enum> <text>an identification of all research facilities, exhibitors, and other persons and establishments licensed by the Secretary under section 3 and section 12;</text></paragraph> 
<paragraph id="H3DB9483826764159BE93E37B386889F7"><enum>(2)</enum><text>an identification of all research facilities, intermediate handlers, carriers, and exhibitors registered under section 6;</text> </paragraph> 
<paragraph id="ID058F62A4452F4A72A70C39AD190C7473"> <enum>(3)</enum> <text>the nature and place of all investigations and inspections conducted by the Secretary under section 16, and all reports received by the Secretary under section 13;</text> </paragraph> 
<paragraph id="ID495FFA5A14B644DBA73DF7DABCF9C22D"> <enum>(4)</enum> <text>recommendations for legislation to improve the administration of this Act or any provisions of this Act; and</text> </paragraph> 
<paragraph id="ID5ACE6515685D46BE90CF94E6C3CCB9D3"> <enum>(5)</enum> <text>recommendations and conclusions concerning the aircraft environment as it relates to the carriage of live animals in air transportation.</text> </paragraph> </section><after-quoted-block>.</after-quoted-block></quoted-block> </section>
