		<official-title display="yes">To provide for and approve the settlement
		  of certain land claims of the Bay Mills Indian Community.</official-title>

		<section display-inline="no-display-inline" id="H86A2BC0841994E0787D0A31342F61D74" section-type="section-one"><enum>1.</enum><header>Definitions</header><text display-inline="no-display-inline">For the purposes of this Act, the following
			 definitions apply:</text>
			<paragraph id="H0656BD6DF0DC41CAB42CD8D5A62C2F03"><enum>(1)</enum><header>Alternative
			 lands</header><text>The term <term>alternative lands</term> means those lands
			 identified as alternative lands in the Settlement of Land Claim.</text>
			</paragraph><paragraph id="H41AB2333F80446FF824EA9128000A9F"><enum>(2)</enum><header>Charlotte beach
			 lands</header><text>The term <term>Charlotte Beach lands</term> means those
			 lands in the Charlotte Beach area of Michigan and described as follows:
			 Government Lots 1, 2, 3, and 4 of Section 7, T45N, R2E, and Lot 1 of Section
			 18, T45N, R2E, Chippewa County, State of Michigan.</text>
			</paragraph><paragraph id="H04278DCD8BD44BC991D142EADAFB5532"><enum>(3)</enum><header>Community</header><text>The
			 term <term>Community</term> means the Bay Mills Indian Community, a federally
			 recognized Indian tribe.</text>
			</paragraph><paragraph id="HDED146B650A24CD1A6B271BB3EF9B18B"><enum>(4)</enum><header>Settlement of land
			 claim</header><text display-inline="yes-display-inline">The term
			 <term>Settlement of Land Claim</term> means the agreement between the Community
			 and the Governor of the State of Michigan executed on August 23, 2002, and
			 filed with the Office of Secretary of State of the State of Michigan, including
			 the document titled <quote>Addendum to Settlement of Land Claim</quote>,
			 executed by the parties on November 13, 2007.</text>
			</paragraph><paragraph id="HFD0B500376A74EEDAEA8180700A9D7EF"><enum>(5)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
			</paragraph></section><section id="HFA080A29E59644F789E97BECABDFE527"><enum>2.</enum><header>Acceptance of
			 alternative lands and extinguishment of claims</header>
			<subsection id="HC60AE8B4F3E14F51894189182B95E29D"><enum>(a)</enum><header>Land Into Trust; Part
			 of Reservation</header>
				<paragraph id="HF93FCCA460B64624A8FC8C51B51DE796"><enum>(1)</enum><header>Land into
			 trust</header><text display-inline="yes-display-inline">The Secretary shall
			 take the alternative lands into trust for the benefit of the Community not
			 later than 30 days after both of the following have occurred:</text>
					<subparagraph id="HB290583B7CB34281859728D89ECAFAFE"><enum>(A)</enum><text>The Secretary has
			 received a title insurance policy for the alternative lands that shows that the
			 alternative lands are not subject to mortgages, liens, deeds of trust, options
			 to purchase, or other security interests.</text>
					</subparagraph><subparagraph id="HF07DC2BE9D064136A2DCEDA7673DE788"><enum>(B)</enum><text display-inline="yes-display-inline">The Secretary has confirmed that the
			 National Environmental Policy Act of 1969 has been complied with regarding the
			 trust acquisition of the property.</text>
					</subparagraph></paragraph><paragraph id="H555910E8EE884A5898DEC9FBBD1C8E3E"><enum>(2)</enum><header>Part of
			 reservation</header><text>The alternative lands shall become part of the
			 Community’s reservation immediately upon attaining trust status.</text>
				</paragraph></subsection><subsection id="H304A530A811244D3B473B37884B2ED2D"><enum>(b)</enum><header>Gaming</header><text>The
			 alternative lands shall be taken into trust as provided in this section as part
			 of the settlement and extinguishment of the Community’s Charlotte Beach land
			 claims, and so shall be deemed lands obtained in settlement of a land claim
			 within the meaning of section 20(b)(1)(B)(i) of the Indian Gaming Regulatory
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2719">25 U.S.C. 2719</external-xref>; <external-xref legal-doc="public-law" parsable-cite="pl/100/497">Public Law 100–497</external-xref>).</text>
			</subsection><subsection id="HA257E8DB20B04A74A95020A90931C14E"><enum>(c)</enum><header>Extinguishment of
			 Claims</header><text>Concurrent with the Secretary taking the alternative lands
			 into trust under subsection (a), any and all claims by the Community to the
			 Charlotte Beach lands or against the United States, the State of Michigan or
			 any subdivision thereof, the Governor of the State of Michigan, or any other
			 person or entity by the Community based on or relating to claims to the
			 Charlotte Beach lands (including without limitation, claims for trespass
			 damages, use, or occupancy), whether based on aboriginal or recognized title,
			 are hereby extinguished. The extinguishment of these claims is in consideration
			 for the benefits to the Community under this Act.</text>
			</subsection></section><section id="H8EA80B99C425477CBB6B268DA416C7E"><enum>3.</enum><header>Effectuation and
			 ratification of agreement</header>
			<subsection id="HE07D1C6ECF3843258234EC2170F700B3"><enum>(a)</enum><header>Ratification</header><text>The
			 United States approves and ratifies the Settlement of Land Claim, except that
			 the last sentence in section 10 of the Settlement of Land Claim is hereby
			 deleted.</text>
			</subsection><subsection id="H0ECEF1EDF9E744BBA7A8E2B3038E63EF"><enum>(b)</enum><header>Not
			 Precedent</header><text>The provisions contained in the Settlement of Land
			 Claim are unique and shall not be considered precedent for any future agreement
			 between any tribe and State.</text>
			</subsection><subsection id="HBC6114A0C092454E97CAA25139A15B82"><enum>(c)</enum><header>Enforcement</header><text>The
			 Settlement of Land Claim shall be enforceable by either the Community or the
			 Governor according to its terms. Exclusive jurisdiction over any enforcement
			 action is vested in the United States District Court for the Western District
			 of Michigan.</text>
