		<official-title>To amend title XVIII of the Social Security Act to waive
		  the late enrollment penalty under the Medicare part D benefit for certain
		  months for individuals who are first eligible to enroll for such benefit for
		  2006 or 2007 and who enroll by the end of the first annual, coordinated
		  election period following their initial enrollment period, to limit the amount
		  of such penalty, and to require the Secretary of Health and Human Services to
		  conduct a study on such penalty.</official-title>

		<section display-inline="no-display-inline" id="H4CCAF48F4AB94FAAA800F3137F81ECB7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote>Healthcare Eligibility for Late Participants (HELP) in Medicare Part D
			 Act of 2007</quote>.</text>
		</section><section id="HBBDBAD23985E4BAFAB432707DDE02D5D"><enum>2.</enum><header>Medicare part D
			 late enrollment penalty waived for months before initial enrollment of
			 individuals who are first eligible to enroll for 2006 or 2007 and who enroll by
			 the end of the first annual, coordinated election period following their
			 initial enrollment period</header>
			<subsection id="HFC73B7ED832A4FA8BB73C55507DDE707"><enum>(a)</enum><header>In
			 general</header><text>Section 1860D–13(b)(3) of the Social Security Act (42
			 U.S.C. 1395w–113(b)(3)) is amended—</text>
				<paragraph id="H76E7407993A84760A834C2EEA6CB0AE"><enum>(1)</enum><text>in
			 subparagraph (B), by inserting <quote>subject to subparagraph (C),</quote>
			 after <quote>For purposes of this subsection,</quote>; and</text>
				</paragraph><paragraph id="H946538C2FC0A4295AE47C6F8C946E61F"><enum>(2)</enum><text>by adding at the
			 end the following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="HE0D36C8D5E4E45B5A4F49767D13E1728" style="OLC">
						<subparagraph id="H569E8525EBF347E48953E467DF3F94A4"><enum>(C)</enum><header>Special rule for
				2006 and 2007</header><text>For purposes of subparagraph (B), the term
				<quote>uncovered month</quote> shall not include—</text>
							<clause id="H8D767F2C8AED464E9CF2B5DFAAB66AD"><enum>(i)</enum><text>in
				the case of an individual whose initial enrollment period under section
				1860D–1(b)(2) ends before November 15, 2006, and who enrolls under a
				prescription drug plan or MA–PD plan during the annual, coordinated election
				period under section 1851(e)(3)(B), as applied under section
				1860D–1(b)(1)(B)(iii), that begins on such date, any month before January 2007;
				and</text>
							</clause><clause id="H5FC66FD675DF46C99D6E9342D11135CB"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of an individual whose initial
				enrollment period under section 1860D–1(b)(2) begins on or after November 15,
				2006, but ends before November 15, 2007, and who enrolls under a prescription
				drug plan or MA–PD plan during the annual, coordinated election period under
				section 1851(e)(3)(B), as applied under section 1860D–1(b)(1)(B)(iii), that
				begins on November 15, 2007, any month before January
				2008.</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HBACEB48C3AC942D0B3A2DCEBEE42A0BA"><enum>(b)</enum><header>Effective date;
			 rebates for penalties previously collected</header>
				<paragraph id="HA69524BE371F466997FAFAE8F501093"><enum>(1)</enum><header>Effective
			 date</header><text>The amendments made by subsection (a) shall be effective as
			 if included in the enactment of the Medicare Prescription Drug, Improvement,
			 and Modernization Act of 2003 (<external-xref legal-doc="public-law" parsable-cite="pl/108/173">Public Law 108–173</external-xref>).</text>
				</paragraph><paragraph id="HD10C92FE888844E9B39B974C7DDAC8D"><enum>(2)</enum><header>Rebates for
			 penalties previously collected</header><text>The Secretary of Health and Human
			 Services shall establish a method for providing rebates of late enrollment
			 penalties paid pursuant to section 1860D–13(b) of the Social Security Act (42
			 U.S.C. 1395w–113(b)(3)(B)) for months before the date of the enactment of this
			 Act for which a penalty does not apply under the amendments made by subsection
			 (a) but for which a penalty was previously collected.</text>
				</paragraph></subsection></section><section id="H371DA000A2904896B5C70024D4D7DA10"><enum>3.</enum><header>Limitation on
			 amount of Medicare prescription drug late enrollment penalty</header>
			<subsection id="H897BA4BC0D2F450B8BCC3DF0211EB9BD"><enum>(a)</enum><header>In
			 general</header><text>Such section, as amended by section 2, is further
			 amended—</text>
				<paragraph id="H530C5B049BD44E5CA600ED3D3812B1D3"><enum>(1)</enum><text>in subparagraph
			 (A), by striking <quote>The amount</quote> and inserting <quote>Subject to
			 subparagraph (C), the amount</quote>; and</text>
				</paragraph><paragraph id="HDFB09464BE914190001D67007EA9CA22"><enum>(2)</enum><text>by adding at the
			 end the following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="HE77F491C9DE5486CAD589455CD30D519" style="OLC">
						<subparagraph id="HCD923A8EE7FE4BCDBE9C40EAEB9E1C0"><enum>(D)</enum><header>Limitation on
				amount of penalty</header><text>In no case shall the amount determined under
				subparagraph (A) for a part D eligible individual for a continuous period of
				eligibility exceed 25 percent of the base beneficiary premium computed under
				subsection
				(a)(2).</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H68EFD58BB0D449D680FF299D1B3CD786"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by subsection (a) shall be effective as
			 if included in the enactment of the Medicare Prescription Drug, Improvement,
			 and Modernization Act of 2003 (<external-xref legal-doc="public-law" parsable-cite="pl/108/173">Public Law 108–173</external-xref>).</text>
			</subsection></section><section id="H69D26908B3554389B09C9B9D039F3E1C"><enum>4.</enum><header>Report on
			 Medicare part D late enrollment penalty</header><text display-inline="no-display-inline">Not later than one year after the date of
			 the enactment of this Act, the Secretary of Health and Human Services shall
			 submit to Congress a report on the Medicare prescription drug late enrollment
			 penalty under section 1860D–13(b) of the Social Security Act (42 U.S.C.
			 1395w–113(b)). Such report shall include the following information:</text>
			<paragraph id="H89DD39C24F8149A2A98719004BE5A74E"><enum>(1)</enum><text display-inline="yes-display-inline">The number of individuals who are subject
			 to and paying such penalty.</text>
			</paragraph><paragraph id="H424620D4D2A2408B9DA3B3844C63295B"><enum>(2)</enum><text>The average amount
			 of such penalty.</text>
			</paragraph><paragraph id="H083D46B89E8745C7B31EA1D48D2F2935"><enum>(3)</enum><text>The number of
			 subsidy eligible individuals (as defined in section 1860D–14(a)(3) of such Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-114">42 U.S.C. 1395w–114(a)(3)</external-xref>)) who are individuals described in paragraph (1) and
			 the average amount of such penalty paid by such subsidy eligible individuals.</text>
