<title id="HA85FE42E09154E1C95D6C758B1E8DE44"><enum>I</enum><header>Ensuring Competition in the Rail Industry </header> 
<section id="H8EE68BBA1C504992AB7FD53C328DE9E9"><enum>101.</enum><header>Clarification of rail transportation policy and directives for implementation</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/49/10101">Section 10101</external-xref> is amended—</text> 
<paragraph id="H37F00EE4CC67466695660199116FAA7B"><enum>(1)</enum><text>by inserting <quote>(a) <header-in-text level="subsection" style="OLC">In General</header-in-text>.—</quote> before <quote>In regulating</quote>; and</text></paragraph> 
<paragraph id="H36B685A38D6A4B85ACBAADB200C46B6B"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block id="HD8995E69F6104F998BEA208540581B73" style="OLC"> 
<subsection id="HD4CE55E0284E447090C734009C44CBE6"><enum>(b)</enum><header>Implementation directives</header><text display-inline="yes-display-inline">In implementing subtitle IV, the Board shall—</text> 
<paragraph id="H4691CAD5B10C426BA59971CB59F3DB87"><enum>(1)</enum><text>ensure, to the maximum extent possible, effective competition among rail carriers at origins and destinations;</text></paragraph> 
<paragraph id="H49DA27647909404B999002BF8D176799"><enum>(2)</enum><text>ensure reasonable rates for rail customers in the absence of competition; and</text></paragraph> 
<paragraph id="HF97E851E61F1432FB986EDFA2EFFC01"><enum>(3)</enum><text>ensure consistent, efficient, and reliable rail transportation service for rail customers, including the timely provision of rail cars requested by rail customers.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H25EE473EDB114D7E8903E900AA984E00"><enum>102.</enum><header>Requirement for Railroads to Provide Rates for Transportation</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/49/11101">Section 11101(a)</external-xref> is amended—</text> 
<paragraph id="HC64D7A314C1E46E2BE8B1525BE008BC5"><enum>(1)</enum><text>by inserting <quote>(1)</quote> after <quote>(a)</quote>;</text></paragraph> 
<paragraph id="HB6AC3814D38D4869AA96C4ACB3C66799"><enum>(2)</enum><text>by redesignating the second and third sentences as paragraph (3) and indenting accordingly; and</text></paragraph> 
<paragraph id="H4DFA47E1B0284D388315FDA5EE006227"><enum>(3)</enum><text>by inserting a new paragraph (2) as follows:</text> 
<quoted-block id="H66315664AE3C498EB64D5C00DFB7AD5F" style="OLC"> 
<paragraph id="H9124EA92DE50440A9214BF006BB8563" indent="up1"><enum>(2)</enum><text>Upon the request of a shipper, a rail carrier shall establish a rate for transportation and provide service requested by the shipper between any two points on the system of that carrier where traffic originates, terminates, or may reasonably be interchanged. A carrier shall establish a rate and provide service upon such request without regard to—</text> 
<subparagraph id="H6C927C510BA64A50941CDFFBD0FF027B"><enum>(A)</enum><text>the location of the movement on the rail system, including terminal areas;</text></subparagraph> 
<subparagraph id="H7078FE70CFE24C9B82685D002275567B"><enum>(B)</enum><text>whether the rate established is for part of a movement between a point of origin and a destination;</text></subparagraph> 
<subparagraph id="H476FDE619A86473AB20400B38B68F973"><enum>(C)</enum><text>whether the shipper has made arrangements for transportation for any other part of that movement; or</text></subparagraph> 
<subparagraph id="H6EA780009C8B4E21A9E71CEEF1A687C"><enum>(D)</enum><text display-inline="yes-display-inline">whether the shipper has a contract with any rail carrier for part or all of its transportation needs over the route of movement.</text></subparagraph> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H4B2B72AD333848BEB9D821E89507B039"><enum>103.</enum><header>Elimination of barriers to competition between Class I, Class II, and Class III rail carriers</header> 
<subsection id="H551399AD6FF54C1CB2929CF14CBFBDEF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/49/10901">Section 10901</external-xref> is amended by adding at the end the following new subsection:</text> 
<quoted-block id="HD2E6C17FF76D4B488B75EA0806F986C1" style="OLC"> 
<subsection id="H8C3E0D7AD7F34B61B102042972F495D4"><enum>(e)</enum> 
<paragraph id="HA1973ECFD75D42D2AC63E84F88B44790" display-inline="yes-display-inline"><enum>(1)</enum><text>The Board may not issue a certificate authorizing an activity described in subsection (a), section 10902, or section 11323, or exempt a person, class of persons, or a transaction or service from the applicability of this section with respect to such an activity under section 10502, if the activity involves a transfer of interest in a line of railroad, from a Class I rail carrier to a Class II rail carrier or Class III rail carrier and the activity directly or indirectly would—</text> 
<subparagraph id="H5FF399A9F431436E9B37F4FA9402D057" indent="up1"><enum>(A)</enum><text>restrict or limit the ability of the Class II or Class III rail carrier to interchange traffic with other rail carriers; </text></subparagraph> 
<subparagraph id="H989396A004524D82BF19E0018BE20C7" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">restrict or limit competition of rail carriers in the region affected by the activity in a manner that would violate antitrust laws of the United States (notwithstanding any exemption from the applicability of antitrust laws that is provided under section 10706 or any other provision of law); or</text></subparagraph> 
<subparagraph id="H99F2E097231A4CAE97E1FDEF99000004" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">require higher per car interchange rates for Class II or Class III rail carriers to interchange traffic with other rail carriers.</text></subparagraph></paragraph> 
<paragraph id="H6C84F6790F2F4325A46EEF6C00DDE92" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Any party to an activity described in paragraph (1) that has been carried out, or any rail shipper affected by such an activity, may request that the Board review the activity to determine whether the activity has resulted in a restriction described in that paragraph. If, upon review of the activity, the Board determines that the activity resulted in such a restriction, the Board shall declare the restriction to be unlawful and terminate the restriction unless the Board determines that the termination of the restriction would materially impair the ability of an affected rail carrier to provide service to the public or would otherwise be inconsistent with the public interest.</text></paragraph> 
<paragraph id="H4423316E8D7A4B49B5D6A4973E5BFDA3" indent="up1"><enum>(3)</enum><text>In this subsection, the term <quote>antitrust laws</quote> has the meaning given that term in subsection (a) of the first section of the Clayton Act (<external-xref legal-doc="usc" parsable-cite="usc/15/12">15 U.S.C. 12(a)</external-xref>), except that such term also means section 5 of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/45">15 U.S.C. 45</external-xref>) to the extent that section 5 applies to unfair methods of competition.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H4D84F7E721C34BA283021FF50300D11D"><enum>(b)</enum><header>Applicability</header><text display-inline="yes-display-inline">Paragraph (2) of section 10901(e) (as added by subsection (a) of this section) shall apply with respect to any activity referred to in that paragraph for which the Surface Transportation Board issued a certificate authorizing the activity under section 10502 before, on, or after the date of enactment of this Act.</text></subsection></section> 
<section id="H92C0CFC5A55E4CDC945426A2EF07F51F"><enum>104.</enum><header>Reciprocal switching</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/49/11102">Section 11102(c)</external-xref> is amended—</text> 
<paragraph id="HA455306C691043A7A2C704BE13A37092"><enum>(1)</enum><text>in paragraph (1)—</text> 
<subparagraph id="H76AA49D1E59842FBA9F3CF6FE6006963"><enum>(A)</enum><text>by striking <quote>may require</quote> in the first sentence and inserting <quote>shall require</quote>; and</text></subparagraph> 
<subparagraph id="H4425143CB5A74CEEB102DF1C50E82306"><enum>(B)</enum><text>by striking <quote>may establish</quote> in the second sentence and inserting <quote>shall establish</quote>; and</text></subparagraph></paragraph> 
<paragraph id="H4F0BAB762B18405C8B5FAFB009B73D0"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text> 
<quoted-block id="H399B84742A7E42CA96152426E0525EC6" style="OLC"> 
<paragraph id="H3A5D812696084A069F88915388A72DBD" indent="up1"><enum>(3)</enum><text>In making any finding under paragraph (1), the Board shall not require that there be evidence of anticompetitive conduct by a rail carrier from which access is sought.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HF42574FB494C40F595F04742ED5C22AC"><enum>105.</enum><header>Areas of inadequate rail competition</header> 
<subsection id="H16110792248B4B939CE25BBF235370EC"><enum>(a)</enum><header>Designation and remedies</header> 
<paragraph id="HFE1E30C271CC4BF28F2522A037B1418E"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/105">Chapter 105</external-xref> is amended by adding at the end the following new section:</text> 
<quoted-block id="H0C70249672FF4FCD8566158B706428A3" style="USC"> 
<section id="HB29218CEBBD8468F968FEA5B0254C600"><enum>10503.</enum><header>Areas of inadequate rail competition</header> 
<subsection id="HD4BA940324ED47B7B3A76B0200562670"><enum>(a)</enum><header>In general</header><text>The Board shall designate any State or substantial part of a State as an area of inadequate rail competition after finding that—</text> 
<paragraph id="H9B4F2F9431544ACCB25EC74262B03D94"><enum>(1)</enum><text>the State or substantial part of the State encompasses rail shipping origins and destinations that are served exclusively by one Class I railroad; and</text></paragraph> 
<paragraph id="H04008E08E35E4429ADCCA46246DD979C"><enum>(2)</enum><text>persons that ship by rail or receive rail shipments in the State or substantial part of the State—</text> 
<subparagraph id="H3226B77F201B4902A670A161B9B17BB"><enum>(A)</enum><text>pay rates for the rail shipments that exceed the rates necessary to yield recovery by the rail carrier of 180 percent of revenue-variable costs, as determined under standards applied in the administration of section 10707(d); or</text></subparagraph> 
<subparagraph id="HE27EB1EDC9E94D1390213784F1181200"><enum>(B)</enum><text>have experienced competitive disadvantage in the marketplace or other economic adversity because of high cost or poor quality of rail service in the State or substantial part of the State.</text></subparagraph></paragraph></subsection> 
<subsection id="HBFA99095107945FBB4AAD3CBD6CEC79F"><enum>(b)</enum><header>Specific commodities</header><text>An area of inadequate rail competition may be composed of the facilities of a group of shippers or receivers of one or more specific commodities within a geographic area.</text></subsection> 
<subsection id="H2A0F98E706094763AF71DDDD7E6CAEF7"><enum>(c)</enum><header>Authorized petitioners</header><text>A Governor of a State is authorized to petition the Board for a designation of a State or substantial part of a State as an area of inadequate rail competition.</text></subsection> 
<subsection id="H35E9695EB1104B67BC4F006B483D86D5"><enum>(d)</enum><header>Actions</header><text display-inline="yes-display-inline">Upon designating a State or substantial part of a State as an area of inadequate rail competition, the Board shall resolve, not later than 60 days after the date of the designation, the conditions described in subsection (a) that justify the designation. In taking such action, the Board shall not require rates lower than those necessary to yield recovery of 180 percent of revenue-variable costs. In addition to providing other remedies authorized by law, the Board may order any of the following actions:</text> 
<paragraph id="HEFF07C5470EC48CBBCD6D5D2BCA4CC6"><enum>(1)</enum><text display-inline="yes-display-inline">Provision of reciprocal switching as provided for in section 11102(c) and terminal trackage rights beyond the limits specified in section 11102(a).</text></paragraph> 
<paragraph id="H2C5379D628CD465B9CDCABC6BA56710"><enum>(2)</enum><text>Haulage transportation of railroad cars by a rail carrier to or from facilities that such carrier physically serves on behalf of another rail carrier, for a fee prescribed by the Board.</text></paragraph> 
<paragraph id="HB38D11DA8ED043EAB98300349040AE00"><enum>(3)</enum><text>Regarding rates on any rail segments within or connected to the area of inadequate rail competition on which rail service is susceptible to delay or interruption due to traffic congestion, expedited final offer arbitration under section 11708(e).</text></paragraph> 
<paragraph id="H21327FF99C924B83B5EEAEFF4E00F2AE"><enum>(4)</enum><text>Expedited review of whether a rate violates the prohibition against discriminatory rates contained in section 10741, without regard to subsection (b)(2) of such section.</text></paragraph></subsection> 
<subsection id="H75A077BD231549ABB96F8977FD390187"><enum>(e)</enum><header>Procedures</header><text>In the case of a petition for an order for reciprocal switching or terminal trackage rights under subsection (d)(1), the Board may not require that there be evidence of anticompetitive conduct by a rail carrier as a prerequisite for ordering such action.</text> </subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HE6B18986479B4252BC1C702DC763C20"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/105">chapter 105</external-xref> is amended by adding at the end the following new item:</text>

<toc-entry level="section">10503. Areas of inadequate rail competition.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HD787FCB0F353429D9D54137107746039"><enum>(b)</enum><header>Study on areas of inadequate rail competition</header><text>Not later than 1 year after the date of enactment of this Act, the Rail Customer Advocate of the Department of Transportation shall—</text> 
<paragraph id="H4FBA22943975418AB36F53D7AC48E700"><enum>(1)</enum><text display-inline="yes-display-inline">review the effectiveness of the procedures under section 10503 for challenging and remedying conditions adversely affecting rail shippers of agricultural and forestry commodities and products, including commodities and products shipped by rail in annual volumes of 1500 rail cars or less, and the applicability of such procedures for ameliorating rail rate and service problems, in areas of inadequate rail competition; and</text></paragraph> 
<paragraph id="H05ABD67B35E14E9D8B12602538570689"><enum>(2)</enum><text>report the results of the study, together with any recommendations that the Rail Customer Advocate may have for improving the procedures, to Congress.</text></paragraph></subsection></section> </title> 
<title id="H6008FC084E2B481E94A8C252871F39D"><enum>II</enum><header>Improving Service to Rail Customers</header> 
<section id="H15DC5A26213E4A38B9A52066EB76CF7B"><enum>201.</enum><header>Rail service</header> 
<subsection id="HF7706BC197D44878986583506F3948E6"><enum>(a)</enum><header>Public notice</header><text>The Surface Transportation Board shall, within 7 days after receipt by the Board or any Member or staff of the Board of a complaint from a customer about rail service, post on the Board’s Internet Web site a description of the complaint, including information identifying the railroad or railroads providing the service that is the subject of the complaint, the general geographic area of the customer’s movement, the date upon which the service problem occurred and the date notice of the complaint was made to the Board or any Member or staff of the Board. The Internet posting shall identify the rail customer only upon the written consent of the rail customer. Not later than 5 days after the date the complaint is resolved, the Board shall update the information posted on the Board’s Internet Web site to indicate that the complaint has been resolved, the means of its resolution, and the date of its resolution.</text></subsection> 
<subsection id="H7D3FF10BC26F4F04BE193BEDC7F855AB"><enum>(b)</enum><header>Annual Report to Congress</header><text>Not later than March 15, 2008, and annually thereafter, the Surface Transportation Board shall transmit to Congress a report regarding the service complaints received by the Board, or any Member or staff of the Board, in the previous calendar year for each Class I railroad. The report shall include a description of each service complaint, including information identifying the railroad in question, the geographic area of the customer’s movements, the date upon which the service problem occurred, the date notice of the service complaint was made to the Board or any Member or staff of the Board, and the date of, and a detailed description of, the resolution of the complaint. The report shall be posted on the Board’s Internet Web site.</text></subsection> 
<subsection id="H2E273373097E49F9BF26BE355E190022"><enum>(c)</enum><header>Time limits on petitions for injunctive relief</header><text><external-xref legal-doc="usc" parsable-cite="usc/49/721">Section 721(b)(4)</external-xref> is amended by adding at the end the following: <quote>Where a complaint is filed and injunctive or similar relief is sought within 20 days after the publication of a new or revised rail rate, rule, or practice, based on an allegation of unlawfulness other than an allegation that a rate level is not reasonable within the meaning of section 10701(d), the Board shall determine, based on applicable law, not later than 90 days after receiving the request for injunctive or similar relief, whether or not to grant such relief. If the moving party establishes that the rule or practice involved in the complaint is unlawful per se, there shall be a strong presumption of irreparable harm regardless of the availability of monetary relief. The Board shall not deny injunctive or similar relief based in whole or in part on the absence of irreparable harm due to the availability of adequate monetary relief unless monetary damages have been awarded to the complaining party.</quote>.</text></subsection></section>

<subsection id="H5DE71326D33C40C799B5282D52D62000"><enum>(b)</enum><header>Rail Customer Advocate</header><text>The head of the Office of Rail Customer Advocacy shall be the Rail Customer Advocate, who shall be appointed in the competitive service by the Secretary of Transportation, in consultation with the Secretary of Agriculture.</text></subsection> 
<subsection id="H6190450CF39646EB8274686158C450C0"><enum>(c)</enum><header>Duties and Powers of Rail Customer Advocate</header><text>The Rail Customer Advocate shall—</text> 
<paragraph id="H077130F03B5E4EEDA7F4BA2F5E906C61"><enum>(1)</enum><text>accept rail customer complaints;</text></paragraph> 
<paragraph id="HE395CA83193E4C78BFBC15C6F69C608"><enum>(2)</enum><text>participate as a party in proceedings of the Board on petitions for action by the Board regarding the regulation of rail transportation, and may initiate such an action;</text></paragraph> 
<paragraph id="HBA27615EA64F434D9038B28FB5F7C256"><enum>(3)</enum><text>collect, compile, and maintain information regarding the cost and efficiency of rail transportation; and</text></paragraph> 
<paragraph id="H46EF94EFD3534BB4B6523588A76F6C8F"><enum>(4)</enum><text>carry out other duties and powers prescribed by the Board.</text></paragraph></subsection> 
<subsection id="HC2FF4F02BB6647749B16FB4BDDCADBB4"><enum>(d)</enum><header>Access to information</header><text>To carry out the duties and powers under subsection (c), the Rail Customer Advocate shall have access to information, including databases, of the Board.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<paragraph id="H085812467A00489E8C23F937E7D49352" indent="up1"><enum>(4)</enum> 
<subparagraph id="HD181068C541D4484B9FC996422968821" display-inline="yes-display-inline"><enum>(A)</enum><text>Not later than one year after the date of enactment of this paragraph, the Board shall adopt a method for determining the reasonableness of rail rates based on the railroad’s actual costs, including a portion of fixed costs and an adequate return on debt and equity. The method adopted shall permit a final determination within 9 months after filing a complaint, shall ensure that necessary cost and operational information is available to the complainant, and shall not require excessive litigation costs.</text></subparagraph> 
<subparagraph id="HF29EA47C447D4A8AAADFB0DCB37E92E9" indent="up1"><enum>(B)</enum><text>The Board shall not use any method for determining the reasonableness of rail rates based on the costs of a hypothetical competitor, except that, in any rate reasonableness proceeding filed before the method required under subparagraph (A) is adopted, the complaint, upon the election of the complainant, shall be decided based on applicable rate standards in effect on the date of the filing, including small rate guidelines.</text></subparagraph> 
<subparagraph id="HCF9CE183A5A244FAAED35FB26C2414F2" indent="up1"><enum>(C)</enum><text>The Board shall adopt a method under this paragraph that applies the <quote>phasing constraint</quote> in its existing rail rate method so that it can be practically administered without substantial litigation-related costs in any proceeding involving a challenge to a rail rate in which the Board determines that the phasing constraint applies.</text></subparagraph></paragraph> 
<paragraph id="H4C53B0DCCED64EADBD00604F445BFC4B" indent="up1"><enum>(5)</enum><text>Upon receiving notification of a challenge made by a shipper to the reasonableness of any rate established by a rail carrier, the Board shall determine the reasonableness of the rate without regard to—</text> 
<subparagraph id="HBD13919BF1DA4A98B29E802C4800D3AA"><enum>(A)</enum><text>whether the rate is for part of a movement between a point of origin and a destination;</text></subparagraph> 
<subparagraph id="H4A4656C47D064E1184364637E484F5C3"><enum>(B)</enum><text>whether the shipper has made arrangements for transportation for any other part of that movement; or</text></subparagraph> 
<subparagraph id="H24766CF88F4F474B9D7FC4007F6486D9"><enum>(C)</enum><text>any other contract the shipper has with a rail carrier for any part of the rail traffic involved.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H32E592F47C2444FF8BC78986C4B01ECA"><enum>303.</enum><header>Filing fees on petitions for captive rate relief</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/49/721">Section 721</external-xref> is amended by adding at the end the following new subsection:</text>

<subsection id="H88E12EB4C2B84506B569ACC8A4E239DD"><enum>(f)</enum><header>Limitation on fees</header><text>The Board may not charge a fee for the filing of a complaint, protest, or other request for relief in an amount greater than fees charged by district courts of the United States for a comparable filing.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HB64FD17F32EA407693A2EE621C8ECFAE"><enum>304.</enum><header>Arbitration of rail disputes</header> 
<subsection id="H96C1EF76B354463BA9C4B06C873E26FB"><enum>(a)</enum><header>Amendment</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/117">Chapter 117</external-xref> is amended by adding the following section after section 11707:</text>

<section id="HE3EE98BFAF8E492000DE1CBD06F1C2E2"><enum>11708.</enum><header>Arbitration of rail disputes</header> 
<subsection id="H708AD0074EC1474E84454CC500795367"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Whenever a dispute described in subsection (b) arises between a rail shipper and a rail carrier under this part, the Board shall, upon written request of any party to the dispute, submit the dispute to final offer arbitration.</text></subsection> 
<subsection id="H2220A93709D0492580D8E4E5BA9E3D2"><enum>(b)</enum><header>Covered disputes</header> 
<paragraph id="H4B4CAE6A0DB34C3AA84B6B4700C7CDD5" display-inline="yes-display-inline"><enum>(1)</enum><text>Except as provided in paragraph (2), subsection (a) shall apply to any dispute between a party and a rail carrier that—</text> 
<subparagraph id="H82D081A580954607B84354C59B9ED7E3" indent="up1"><enum>(A)</enum><text>arises under section 10701(c), 10701(d), 10702, 10704(a)(1), 10707, 10741, 10745, 10746, 11101(a), 11102, 11121, 11122, or 11706; </text></subparagraph> 
<subparagraph id="H1CC5E16CB2DF45B1BCB99000ED9C82F3" indent="up1"><enum>(B)</enum><text>involves the transportation of any agricultural product, including timber, paper, and fertilizer; and </text></subparagraph> 
<subparagraph id="H7B2D56AD726C4EDBBE56817CFD5CF84" indent="up1"><enum>(C)</enum><text>involves—</text> 
<clause id="HA04FB56018474710BCD496CDF34CAEB"><enum>(i)</enum><text>the payment of money;</text></clause> 
<clause id="H1BD6494B1E6B453297BF80BFCBDF6E57"><enum>(ii)</enum><text>a rate or charge imposed by the rail carrier; or </text></clause> 
<clause id="HBBF3243EE79F4AAD9E5B00692EC60019"><enum>(iii)</enum><text>transportation or other service by the rail carrier.</text></clause></subparagraph></paragraph> 
<paragraph id="HE7B728D9664346C88F6299C6B7CAC00" indent="up1"><enum>(2)</enum><text>Subsection (a) shall not apply to a dispute if the resolution of the dispute would necessarily involve the promulgation of regulations generally applicable to all rail carriers.</text></paragraph></subsection> 
<subsection id="H6C3039A35DA64680AD1C00625E9D1F91"><enum>(c)</enum><header>Selection of arbitrators</header><text>The rail carrier or carriers that are parties to arbitration under this section shall collectively name one arbitrator, and the rail shipper or shippers that are parties to the arbitration shall collectively name one arbitrator. The two arbitrators thus chosen shall select a third arbitrator from the roster of arbitrators established under subsection (d). If the arbitrators chosen by the parties fail to name the third arbitrator within 5 days after their first meeting, such third arbitrator shall be named by the Secretary of Transportation from the roster of arbitrators established under subsection (d).</text></subsection> 
<subsection id="H0FA0BC477721402FBA40D42E785259F8"><enum>(d)</enum><header>Roster of arbitrators</header><text>The Secretary of Transportation shall establish, maintain, and revise as necessary a roster of arbitrators who—</text> 
<paragraph id="H28C794DE52C240B0B79F50BCDB8EE5A9"><enum>(1)</enum><text>are experienced in transportation or economic issues;</text></paragraph> 
<paragraph id="H828C612187A84A2081D6E657199FF3E0"><enum>(2)</enum><text>satisfy requirements for neutrality and other qualification requirements prescribed by the Secretary;</text></paragraph> 
<paragraph id="H3F978F8169BB47C2948427F579E19C07"><enum>(3)</enum><text>consent to serve as arbitrators under this section; and</text></paragraph> 
<paragraph id="HFE3623DA04BE446697DC6D31C06F7F60"><enum>(4)</enum><text>are not officers or employees of the United States.</text></paragraph></subsection> 
<subsection id="HBC35E95BE7F04A1F807E208400D91B3C"><enum>(e)</enum><header>Rules for arbitration</header><text>The arbitrators shall organize and select and make all necessary rules for conducting hearings. The arbitrators shall give the parties to the dispute a full and fair hearing, which shall include an opportunity to present evidence in support of their claims, and an opportunity to present their case in person, by counsel, or by other representative as they may elect.</text></subsection>
<subsection id="HFFD4954017284417A576C554FF3FDB7E"><enum>(f)</enum><header>Prohibited methods of decision</header><text>Disputes concerning rates and charges shall not be considered or decided under this section using any method based on stand-alone cost or the costs of a hypothetical competitor, or in reliance on precedent adopting or applying such methods.</text></subsection> 
<subsection id="H29A8C71D208C426B82CC2BDBF416D03E"><enum>(g)</enum><header>Decision</header><text>The decision of the arbitrators shall be the final offer of one of the parties to the dispute. </text></subsection> 
<subsection id="HADF9AB587A0A4498A520A8EA21B71097"><enum>(h)</enum><header>Revenue-Variable cost percentage</header><text>The decision may not provide for a rate for transportation by a rail carrier that would result in a revenue-variable cost percentage of such transportation that is less than 180 percent, as determined under standards applied in the administration of section 10707(d).</text></subsection> 
<subsection id="H25C8BDD027B341BBA0FFF729B74F9843"><enum>(i)</enum><header>Consideration of other rates or charges</header><text>The arbitrators, in making an award on the dispute, shall consider the rates or charges that are imposed by rail carriers for the transportation of similar goods under similar circumstances in rail transportation markets where there is effective competition, as determined under standards applied by the Board in the administration of section 10707(a).</text></subsection>
<subsection id="HF1551D6F985E4474A0F14E4294CE5AF"><enum>(j)</enum><header>Duration of rates prescribed</header><text>A rate prescribed under this section may not remain in effect for longer than 5 years after the date on which the arbitrators’ decision becomes final.</text></subsection> 
<subsection id="H47D809908D6A4318AC66F77D4AEDABE"><enum>(k)</enum><header>Copies of award</header><text>The arbitrators shall furnish a certified copy of its award to the parties to the dispute, and shall transmit the original, together with the paper and proceedings and a transcript of the evidence taken at the hearings, certified under the hands of at least a majority of the arbitrators, to the Board, to be filed in its office. Not later than 7 days after receiving an award under this subsection, the Board shall make the award and all supporting documents available to the public.</text></subsection> 
<subsection id="HDE24FF46093647E48DEB6E3EB8CED08C"><enum>(l)</enum><header>Oaths; subpoenas</header><text>All testimony before arbitrators under this section shall be given under oath or affirmation, and any arbitrator shall have the power to administer oaths or affirmations. The arbitrators shall have the power to require the attendance of witnesses and the production of such books, papers, contracts, agreements, and documents as may be necessary to a just determination of the matters submitted to arbitration, and may request the district court of the United States for the district where the arbitration is being conducted to issue the necessary subpoenas. Any witness appearing before arbitrators under this section shall receive the same fees and mileage reimbursement as witnesses in courts of the United States, to be paid by the party securing the subpoena, or in the case of a subpoena secured by the arbitrators, to be paid by the Board.</text></subsection> 
<subsection id="HE30AA984649747D0AC2062DBEACCFF69"><enum>(m)</enum><header>Time for issuance of arbitration decision</header><text>The arbitration panel shall issue a final decision on a dispute under this section not later than 180 days after the date on which the panel of arbitrators is completed to resolve the dispute.</text></subsection> 
<subsection id="H755E2DF59D1F4CD0B96164156D007DE2"><enum>(n)</enum><header>Regulations</header><text>Not later than 90 days after the date of enactment of this section, the Secretary of Transportation shall issue final regulations establishing procedures for the resolution of disputes submitted for arbitration, in accordance with the requirements of this section.</text></subsection> 
<subsection id="H0C0E939FC3E2478FB2E311A7F7B23D23"><enum>(o)</enum><header>Applicability of title 9</header><text>The following provisions of title 9, United States Code, shall apply to an arbitration decision issued in a dispute under this section:</text> 
<paragraph id="H756CA2E09BD84487A6FDF7D67C69E984"><enum>(1)</enum><text>Section 9 (relating to confirmation of an award in an arbitration decision), which shall be applied as if the parties had entered into an agreement under title 9 to submit the dispute to the arbitration and had provided in that agreement for a judgement of an unspecified court to be entered on the award made pursuant to the arbitration.</text></paragraph> 
<paragraph id="HB7F253AD27154787B0A5E87EB84628F8"><enum>(2)</enum><text>Sections 10 and 11 (relating to judicial vacation, modification, or correction of an award in an arbitration decision).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<paragraph id="H63384F40AEF04468B5A3384BBEB00C5" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">When the Board receives a complaint alleging that a rail carrier may be violating this part, the Board shall initiate an investigation. When the alleged violation applies to more than one person and the Board has substantial reason to believe that the allegations in the complaint are likely to have merit and, if the allegations prove to have merit, it will be difficult to make complete restitution for the damage, the Board shall suspend the rail carrier activity in question, and shall not revoke that suspension unless the rail carrier justifies the practice to the satisfaction of the Board.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></title>
