		  Income Security Act of 1974 to modify the definition of governmental plan with

		<section id="H1A83F63D1CA847E9ABAFF7CB9000485" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Tribal Government Pension Equality Act
			 of 2007</short-title></quote>.</text>
		</section><section id="HF0920F3B92C94934B6B9C1EB99D77CB7" section-type="subsequent-section"><enum>2.</enum><header>Treatment of certain
			 pension plans of Indian tribal governments</header>
			<subsection id="H029E4A66693E4723A57D394D4C98A15C"><enum>(a)</enum><header>Amendment to the
			 Internal Revenue Code of 1986</header><text>The last sentence of section 414(d)
			 of the Internal Revenue Code of 1986 (definition of governmental plan) is
			 amended to read as follows: <quote>The term <quote>governmental plan</quote>
			 includes a plan established or maintained for its employees by an Indian tribal
			 government (as defined in section 7701(a)(40)), a subdivision of an Indian
			 tribal government (determined in accordance with section 7871(d)), an agency,
			 instrumentality, or subdivision of an Indian tribal government, or an entity
			 established under Federal, State, or tribal law which is wholly owned or
			 controlled by any of the foregoing.</quote>.</text>
			</subsection><subsection id="H5C6D31F4E50F40ED9016259262E2B552"><enum>(b)</enum><header>Amendments to
			 the Employee Retirement Income Security Act of 1974</header>
				<paragraph id="H2CCD64D0B52C421E8BF194DCAA439969"><enum>(1)</enum><header>In
			 general</header><text>The last sentence of section 3(32) of the Employee
			 Retirement Income Security Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/29/1002">29 U.S.C. 1002(32)</external-xref>) is amended to read
			 as follows: <quote>The term <quote>governmental plan</quote> includes a plan
			 established or maintained for its employees by an Indian tribal government (as
			 defined in <external-xref legal-doc="usc" parsable-cite="usc/26/7701">section 7701(a)(40)</external-xref> of the Internal Revenue Code of 1986), a
			 subdivision of an Indian tribal government (determined in accordance with
			 section 7871(d) of such Code), an agency, instrumentality, or subdivision of an
			 Indian tribal government, or an entity established under Federal, State, or
			 tribal law which is wholly owned or controlled by any of the
			 foregoing.</quote>.</text>
				</paragraph><paragraph id="HD18C96F2AA3443FBA118BA2151AE1CC"><enum>(2)</enum><header>Conforming
			 amendments</header>
					<subparagraph id="HA26C4F2EDB3A4C75A8E65270444CFE64"><enum>(A)</enum><text>Paragraph (14) of
			 section 4021(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/1321">29 U.S.C. 1321(b)(14)</external-xref>) is amended to read as
			 follows:</text>
						<quoted-block display-inline="no-display-inline" id="H2583EE954B4247F389DBBF6CA999BCA8" style="traditional">
							<paragraph id="H408E4ACD60834E1FB3880572A3D21073"><enum>(14)</enum><text display-inline="yes-display-inline">established or maintained for its employees
				by an Indian tribal government (as defined in section 7701(a)(40) of the
				Internal Revenue Code of 1986), a subdivision of an Indian tribal government
				(determined in accordance with section 7871(d) of such Code), an agency,
				instrumentality, or subdivision of an Indian tribal government, or an entity
				established under Federal, State, or tribal law which is wholly owned or
				controlled by any of the
				foregoing.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H4DC6B31BF9954BADB6A4ED5E5544400"><enum>(B)</enum><text>Section 4021(b)(2)
			 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/1321">29 U.S.C. 1321(b)(2)</external-xref>) is amended by striking <quote>or which is
			 described in the last sentence of section 3(32)</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="HE6AFB6F1BD3B490B8CB6D801C196C608"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall take effect as if
			 included in section 906 of the Pension Protection Act of 2006.</text>
