<section id="HEF243C72466E4CE69940E9B361F40664" section-type="section-one"><enum>1.</enum><header>Disclosure of paid communications campaigns to influence the general public to lobby Congress</header> 
<subsection id="H8073AFD9F1AF420BB354BC3CDB34D685" commented="no"><enum>(a)</enum><header>Applicability</header><text display-inline="yes-display-inline">The amendments made by this section shall not apply to any person or entity other than a lobbying firm that is retained on behalf of a client other than that person or entity. No person or entity other than a lobbying firm is required to register or file a report under the amendments made by this section. </text></subsection> 
<subsection id="H57E649B185C146E7BCE83497B1A93223"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 3 of the Lobbying Disclosure Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1602">2 U.S.C. 1602</external-xref>) is amended—</text> 
<paragraph id="HC6B2B2567F1B45CCA21912B64E9EB2ED"><enum>(1)</enum><text>in paragraph (7), by adding at the end the following: <quote>For purposes of a lobbying firm only, the term <quote>lobbying activities</quote> includes paid communications campaigns to influence the general public to lobby Congress.</quote>;</text></paragraph> 
<paragraph id="H4C88D5C0DC1A413984574C42C8BD46CA"><enum>(2)</enum><text>in paragraph (9)—</text> 
<subparagraph id="HEC601EE7BDA94A4100D2837E68C04B72"><enum>(A)</enum><text>in the first sentence—</text> 
<clause id="HEE62BD769E9A42F499FAB02EC4F9BCF1"><enum>(i)</enum><text>by striking <quote>means a person</quote> and inserting </text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="HB08685486AFB4DB2B7010022F400478F"> 
<subparagraph id="H63EA1F512BD04A4291791C73FAFFF10"><enum>(A)</enum><text>means—</text> 
<clause id="H9B5413F68F6D4E4882BF3F10AFD10090"><enum>(i)</enum><text>a person</text></clause></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block></clause> 
<clause id="H13612DC0AE7F46CAAD8119D3C7025D7"><enum>(ii)</enum><text>by moving the remaining text of the sentence 4 ems to the right; and</text></clause> 
<clause id="H15D2CEDF983C47259C429495C9CF995E"><enum>(iii)</enum><text display-inline="yes-display-inline">by striking <quote>entity.</quote> and inserting</text> 
<quoted-block style="OLC" id="H66CF9284C0CB487891A3313EF7C5ADD4" display-inline="yes-display-inline"><text display-inline="yes-display-inline">entity; and</text> 
<clause id="H59C9546F1C83487083D54125F3FE34D"><enum>(ii) </enum><text display-inline="yes-display-inline">a person or entity that is retained by 1 or more clients (other than that person or entity) to engage in paid communications campaigns to influence the general public to lobby Congress, and receives income of, or spends or agrees to spend, an aggregate of $100,000 or more for such efforts in any quarterly period; and</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause> </subparagraph> 
<subparagraph id="H704A3233043F49AEA12FB745B5953DEB"><enum>(B)</enum><text>in the last sentence—</text> 
<clause id="H9F51ACD14DF04195ACD3EBADF3DE9C4D"><enum>(i)</enum><text> by striking <quote>The term also includes</quote> and inserting</text>

<paragraph id="H6F3FBD44B4194A3BBDF9D500003C50B1"><enum>(17)</enum><header>paid communications campaigns to influence the general public to lobby congress</header><text display-inline="yes-display-inline">The term <quote>paid communications campaigns to influence the general public to lobby Congress</quote> means any efforts by a lobbying firm, on behalf of a client that retains the firm, to influence the general public or segments thereof to contact 1 or more covered legislative or executive branch officials (or Congress generally) to urge such officials (or Congress) to take specific action with respect to a matter described in paragraph (8)(A), except that such term does not include—</text> 
<subparagraph id="HE15C47C48FE3403BB9CF27F1C84FFFA2"><enum>(A)</enum><text>communications made to the members of the client; or </text></subparagraph> 
<subparagraph id="H85C45943DFE64EB8885CD20055361304"><enum>(B)</enum><text>direct mail communications to the general public, or segments of the general public, that are made primarily for the purpose of recruiting members to join an organization. </text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H595036395F4F426E8B1591B281111E12"><enum>(c)</enum><header>Registration</header><text display-inline="yes-display-inline">Section 4(a) of the Lobbying Disclosure Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1603">2 U.S.C. 1603(a)</external-xref>) is amended by inserting after paragraph (2) the following and redesignating the succeeding paragraph accordingly:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="H91F569E497734422B6C63600936465A4"> 
<paragraph id="H2BDA07452C1E49A79472DA01A5CF6029"><enum>(3)</enum><header>Filing by certain lobbying firms</header><text display-inline="yes-display-inline">Any person or entity that qualifies as a lobbying firm under section 3(9)(A)(ii) shall register with the Secretary of the Senate and the Clerk of the House of Representatives not later than 45 days after such lobbying firm is first retained by a client to engage in paid communications campaigns to influence the general public to lobby Congress.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H61F20191CDC046FA9DEDDC8385CCAEDE"><enum>(d)</enum><header>Separate itemization of paid communications campaigns To influence the general public To lobby congress</header><text display-inline="yes-display-inline">Section 5(b) of the Act (<external-xref legal-doc="usc" parsable-cite="usc/2/1604">2 U.S.C. 1604(b)</external-xref>) is amended—</text> 
<paragraph id="H0B591C748BCE412FB918220022C6B767"><enum>(1)</enum><text>in paragraph (3)—</text> 
<subparagraph id="H68F6924CF76B44BA87001C361FF96C00"><enum>(A)</enum><text>by striking <quote>firm, a good</quote> and inserting</text> 
<quoted-block style="OLC" id="HAE40D59ED2444A1F818C8CFE7418BCE3" display-inline="yes-display-inline"><text display-inline="yes-display-inline">firm—</text> 
<subparagraph id="HD45309DC7A8B4403AE619397832D63A9"><enum>(A)</enum><text>a good</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="H1F9198BC63CC4E0F90B6085BEFEA50FA"><enum>(B)</enum><text display-inline="yes-display-inline">by moving the remaining text 2 ems to the right; and</text></subparagraph> 
<subparagraph id="H857119BCB62845DBAD676E35745B9C24"><enum>(C)</enum><text>by adding at the end the following:</text>

<subparagraph id="H45B55B7E01D24F3091E4AE684854D060"><enum>(B) </enum><text>a separate good faith estimate of the total amount of income relating specifically to paid communications campaigns to influence the general public to lobby Congress, if such income from the client exceeds $50,000 during the quarterly filing period; and </text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H7C13AC1136BF40D49BF47FBA78405EF7"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following: </text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="H9CDC26182CE04D00A168126100620010"> 
<quoted-block-continuation-text quoted-block-continuation-text-level="subsection">Subparagraphs (B) and (C) of paragraph (2) shall not apply with respect to reports relating to paid communications campaigns to influence the general public to lobby Congress.</quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section>
