		<official-title>To amend title XIX of the Social Security Act to improve
		  access to advanced practice nurses and physician assistants under the Medicaid
		  Program.</official-title>

		<section display-inline="no-display-inline" id="H6CE4FA8100CB4F7989581EE479EDDDD4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Medicaid Advanced Practice Nurses and
			 Physician Assistants Access Act of 2007</short-title></quote>.</text>
		</section><section id="HC864B463E0B84AFC00C81BFCBB7CE052"><enum>2.</enum><header>Improved access
			 to services of advanced practice nurses and physician assistants under State
			 medicaid programs</header>
			<subsection id="H4625C08894A94A7896F689E41E723491"><enum>(a)</enum><header>Primary care
			 case management</header><text>Section 1905(t)(2) of the
			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.
			 1396d(t)(2)) is amended by striking subparagraph (B) and
			 inserting the following:</text>
				<quoted-block act-name="Social Security Act" id="H143ADF61712B488295624F00ED7102CE">
					<subparagraph id="H4EC25FED7A4B4A1A0056DFE4018248C" indent="up1"><enum>(B)</enum><text>A nurse practitioner (as defined in
				section 1861(aa)(5)(A)).</text>
					</subparagraph><subparagraph id="HE8F539FEF6AF4A8B88DF9CB4E007947" indent="up1"><enum>(C)</enum><text>A certified nurse-midwife (as defined
				in section 1861(gg)).</text>
					</subparagraph><subparagraph id="HEF7B40DF68E0442EAD87DA03336945A0" indent="up1"><enum>(D)</enum><text>A physician assistant (as defined in
				section
				1861(aa)(5)(A)).</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H297214299C7741559BD2B1F66BBC7044"><enum>(b)</enum><header>Fee-for-service
			 program</header><text>Section 1905(a)(21) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(a)(21)</external-xref>) is
			 amended—</text>
				<paragraph id="H3274D802B3224E5FA4CBF577C4FB88B4"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote>(A)</quote> after
			 <quote>(21)</quote>;</text>
				</paragraph><paragraph id="H88D58DFAEBDA4B90A2EEA85F3B1D0018"><enum>(2)</enum><text>by striking
			 <quote>services furnished by a certified pediatric nurse practitioner or
			 certified family nurse practitioner (as defined by the Secretary) which the
			 certified pediatric nurse practitioner or certified family nurse
			 practitioner</quote> and inserting <quote>services furnished by a nurse
			 practitioner (as defined in section 1861(aa)(5)(A)) or by a clinical nurse
			 specialist (as defined in section 1861(aa)(5)(B)) which the nurse practitioner
			 or clinical nurse specialist</quote>;</text>
				</paragraph><paragraph id="H036F2A3360A04E43A1C6A035A871FC6F"><enum>(3)</enum><text>by striking
			 <quote>the certified pediatric nurse practitioner or certified family nurse
			 practitioner</quote> and inserting <quote>the nurse practitioner or clinical
			 nurse specialist</quote>; and</text>
				</paragraph><paragraph id="H7C6D0449D3D74D1EA04CB424F30831C1"><enum>(4)</enum><text>by inserting
			 before the semicolon at the end the following: <quote>and (B) services
			 furnished by a physician assistant (as defined in section 1861(aa)(5)) with the
			 supervision of a physician which the physician assistant is legally authorized
			 to perform under State law</quote>.</text>
				</paragraph></subsection><subsection id="HE4BC3F7D01EC4F37973761B3252BFB53"><enum>(c)</enum><header>Including in mix
			 of service providers under medicaid managed care
			 organizations</header><text>Section 1932(b)(5)(B) of such Act (42 U.S.C.
			 1396u–2(b)(5)(B)) is amended by inserting <quote>, with such
			 mix including nurse practitioners, clinical nurse specialists, physician
			 assistants, certified nurse midwives, and certified registered nurse
			 anesthetists (as defined in section 1861(bb)(2))</quote> after
			 <quote>services</quote>.</text>
			</subsection><subsection id="HBC75D1C4D9D345FEB3B9D0467E078D3C"><enum>(d)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to items and
			 services furnished in calendar quarters beginning on or after 90 days after the
			 date of the enactment of this Act, without regard to whether or not final
			 regulations to carry out such amendments have been promulgated by such
			 date.</text>
