			 consideration of such provisions as fall within the jurisdiction of the

		<official-title>To include costs incurred by the Indian Health Service, a
		  federally qualified health center, an AIDS drug assistance program, certain
		  hospitals, or a pharmaceutical manufacturer patient assistance program in
		  providing prescription drugs toward the annual out of pocket threshold under
		  part D of title XVIII of the Social Security Act and to provide a safe harbor
		  for assistance provided under a pharmaceutical manufacturer patient assistance
		  program.</official-title>

		<section display-inline="no-display-inline" id="HE4D0C0776C654CD49811ECC3A7FFCF6C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Helping Fill the Medicare Rx Gap Act
			 of 2007</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="H8492A7A3D2B24EF0962F8B1853DF78F0" section-type="subsequent-section"><enum>2.</enum><header>Including costs
			 incurred by the indian health service, a Federally qualified health center, an
			 AIDS drug assistance program, certain hospitals, or a pharmaceutical
			 manufacturer patient assistance program in providing prescription drugs toward
			 the annual out of pocket threshold under part D</header>
			<subsection commented="no" display-inline="no-display-inline" id="H07C3A7A7DF354551B6ED3972C1F546F1"><enum>(a)</enum><header>In
			 general</header><text>Section 1860D–2(b)(4)(C) of the Social Security Act (42
			 U.S.C. 1395w–102(b)(4)(C)) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H458077867ED84193A6F13235E6A92600"><enum>(1)</enum><text>in clause (i), by
			 striking <quote>and</quote> at the end;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD8B0D0E2C50E492A999809130256C000"><enum>(2)</enum><text>in clause
			 (ii)—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="HB66785690F1E4966B314DBE2BC7EB0E6"><enum>(A)</enum><text>by striking
			 <quote>such costs shall be treated as incurred only if</quote> and inserting
			 <quote>subject to clause (iii), such costs shall be treated as incurred
			 if</quote>;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H23B30C297DB744D2B5E43EA4F6F09301"><enum>(B)</enum><text>by striking
			 <quote>, under section 1860D–14, or under a State Pharmaceutical Assistance
			 Program</quote>; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H854E12B5E9C04CBEB361AAC455C97E09"><enum>(C)</enum><text>by striking the
			 period at the end and inserting <quote>; and</quote>; and</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H29F91139FC7D48A389E06107223E6B11"><enum>(3)</enum><text>by inserting after
			 clause (ii) the following new clause:</text>
					<quoted-block display-inline="no-display-inline" id="H6A4B1209AD8849D98F7BEEC46CE35617" style="OLC">
						<clause commented="no" display-inline="no-display-inline" id="HC3E3071D88AB4E3BA952A0D6B08028C6"><enum>(iii)</enum><text>such costs shall
				be treated as incurred and shall not be considered to be reimbursed under
				clause (ii) if such costs are borne or paid—</text>
							<subclause commented="no" display-inline="no-display-inline" id="H1B97F0AD30D7422FB654AC205BFC0108"><enum>(I)</enum><text>under section
				1860D–14;</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="H068BF7D3FCAD4CA5B3B898578D133722"><enum>(II)</enum><text>under a State
				Pharmaceutical Assistance Program;</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="HB6B4DD5B290B409AB84BA142B5B0EAE9"><enum>(III)</enum><text>by the Indian
				Health Service, an Indian tribe or tribal organization, or an urban Indian
				organization (as defined in section 4 of the Indian Health Care Improvement
				Act);</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="HC6DC75C11C5E4D82A6673FA00CF3B4D"><enum>(IV)</enum><text>by a federally
				qualified health center (as defined in section 1861(aa)(4));</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="HEBD68FBE5178402482B2DA73E6CC3BAC"><enum>(V)</enum><text>under an AIDS Drug
				Assistance Program under part B of title XXVI of the Public Health Service
				Act;</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="H49363E219AA9474A9C438444A200A04C"><enum>(VI)</enum><text>by a subsection
				(d) hospital (as defined in section 1886(d)(1)(B)) that meets the requirements
				of clauses (i) and (ii) of section 340B(a)(4)(L) of the Public Health Service
				Act; or</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="HDDC64F4AEC83474BA4549444AE4E06CF"><enum>(VII)</enum><text>by a
				pharmaceutical manufacturer patient assistance program, either directly or
				through the distribution or donation of covered part D drugs, which shall be
				valued at the negotiated price of such covered part D drug under the enrollee’s
				prescription drug plan or MA–PD plan as of the date that the drug was
				distributed or
				donated.</text>
							</subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H9B2C70C281CB4F9B88C45210D905F796"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by subsection (a) shall apply to costs
			 incurred on or after January 1, 2007.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="H048138DB1B7F4A28B83E26D8DD69CFD3"><enum>3.</enum><header>Providing a safe
			 harbor for pharmaceutical manufacturer patient assistance programs</header>
			<subsection id="HBF022205C10F41B7A28E623E020338E8"><enum>(a)</enum><header>Safe
			 Harbor</header><text>Section 1128B(b)(3) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C. 1320a–7b(b)(3))
			 is amended—</text>
				<paragraph id="H9E746EDD12214BD4890267EDEEEAC00"><enum>(1)</enum><text>in
			 subparagraph (G), by striking <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="HFF546C5FE4BA4D1B81B0C1DCEA5429D"><enum>(2)</enum><text>in
			 subparagraph (H), as added by section 237(d) of the Medicare Prescription Drug,
			 Improvement, and Modernization Act of 2003 (<external-xref legal-doc="public-law" parsable-cite="pl/108/173">Public Law 108–173</external-xref>; 117 Stat.
			 2213)—</text>
					<subparagraph id="H578607951CA240C8B3143017717DF593"><enum>(A)</enum><text>by moving such
			 subparagraph 2 ems to the left; and</text>
					</subparagraph><subparagraph id="H511CFBAFA10A4E08A0A3A843E9D32490"><enum>(B)</enum><text>by striking the
			 period at the end and inserting a semicolon;</text>
					</subparagraph></paragraph><paragraph id="HB428AC3D9F994DFC878C023EDC08EAB7"><enum>(3)</enum><text>by redesignating
			 subparagraph (H), as added by section 431(a) of the Medicare Prescription Drug,
			 Improvement, and Modernization Act of 2003 (<external-xref legal-doc="public-law" parsable-cite="pl/108/173">Public Law 108–173</external-xref>; 117 Stat.
			 2287), as subparagraph (I);</text>
				</paragraph><paragraph id="H380FA207C6FD4A10B2C0F43F2CA5459D"><enum>(4)</enum><text>in subparagraph
			 (I), as so redesignated—</text>
					<subparagraph id="H600F4426DD0B48738E08B248EB74763"><enum>(A)</enum><text>by moving such
			 subparagraph 2 ems to the left; and</text>
					</subparagraph><subparagraph id="H10DB49910BB14AEE998800F48122E18B"><enum>(B)</enum><text>by striking the
			 period at the end and inserting <quote>; and</quote>; and</text>
					</subparagraph></paragraph><paragraph id="H5C225590F34E441CA32D0047431D3B00"><enum>(5)</enum><text>by adding at the
			 end the following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="HAF8EF02F891840E6966420CF7C09E435" style="OLC">
						<subparagraph id="H1B8B5C837CC14CE68C5486CCDA18CB7E" indent="up1"><enum>(J)</enum><text>any remuneration paid by a
				pharmaceutical manufacturer patient assistance program, either in cash or
				through the distribution or donation of covered Part D drugs (as defined in
				section 1860D–2(e)), to an individual enrolled in a prescription drug plan
				under part D of title XVIII or in an MA–PD plan under part C of such
				title.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H769F268C49F94808ABDF00BE43B2C357"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by subsection (a) shall apply to
			 remuneration paid on or after January 1, 2007.</text>
