		<section id="H20884849C3934AB88E1647549E9E88EE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Medicare
			 Part D Improvement Act of 2007</quote>.</text>
		</section><section id="H65C7264A60D6496A9B49B9C84E00A1F4"><enum>2.</enum><header>Reform of
			 <quote>donut hole</quote></header>
			<subsection commented="no" display-inline="no-display-inline" id="HB5EA991361FA46A8B85B0011052F4F6B"><enum>(a)</enum><header>Counting certain
			 expenditures towards out-of-pocket limits</header>
				<paragraph id="HFA3C92DA83274AC481AD40A2468793A5"><enum>(1)</enum><header>In
			 general</header><text>Section 1860D–2(b)(4)(C) of the Social Security Act (42
			 U.S.C. 1395w–102(b)(4)(C)) is amended—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="HC399E64D9D5F4F33A0442E4707EEEEFD"><enum>(A)</enum><text>in clause (i), by
			 striking <quote>and</quote> at the end;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6C1E6A77BAAA43A1BA3C00CE33755486"><enum>(B)</enum><text>in clause
			 (ii)—</text>
						<clause commented="no" display-inline="no-display-inline" id="HD0FFAFFC2F0E403DA005C6A1FCEBF4D2"><enum>(i)</enum><text>by striking
			 <quote>such costs shall be treated as incurred only if</quote> and inserting
			 <quote>subject to clause (iii), such costs shall be treated as incurred
			 if</quote>;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="HEC399A107A5E421180C775D6171631B8"><enum>(ii)</enum><text>by striking
			 <quote>, under section 1860D–14, or under a State Pharmaceutical Assistance
			 Program</quote>;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="HFF9B4F03B853413D9C002300C2463195"><enum>(iii)</enum><text>by striking
			 <quote>(other than under such section or such a Program)</quote>; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H3B7469D6ACD14953A9AF75AD3E242D6C"><enum>(iv)</enum><text>by striking the
			 period at the end and inserting <quote>; and</quote>; and</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H20F85C50EF51454EB6F000DA399860BD"><enum>(C)</enum><text>by inserting after
			 clause (ii) the following new clause:</text>
						<quoted-block display-inline="no-display-inline" id="H800FD99A32FE400DABC5124F9B009901" style="OLC">
							<clause commented="no" display-inline="no-display-inline" id="H247ECC846E3E44D089887581AF8DF1F9"><enum>(iii)</enum><text>such costs shall
				be treated as incurred and shall not be considered to be reimbursed under
				clause (ii) if such costs are borne or paid—</text>
								<subclause commented="no" display-inline="no-display-inline" id="H81F0520CF769486B91F9E307482B66DB"><enum>(I)</enum><text>under section
				1860D–14;</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="H1282DBE38F284C16A600C48F00068896"><enum>(II)</enum><text>under a State
				Pharmaceutical Assistance Program;</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="H4118DE10874045848DD14800D1530729"><enum>(III)</enum><text>by the Indian
				Health Service, an Indian tribe or tribal organization, or an urban Indian
				organization (as defined in section 4 of the Indian Health Care Improvement
				Act);</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="H5F04EE6F00BE4A6E00A9C9A8A5D1F4A5"><enum>(IV)</enum><text>by a rural health
				clinic or Federally qualified health center (as defined in section
				1861(aa));</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="H638D20D22A524C85A981F70986A75FAC"><enum>(V)</enum><text>under an AIDS Drug
				Assistance Program under part B of title XXVI of the Public Health Service
				Act;</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="HAC639D809DFB4F4BA57B6436D57D0808"><enum>(VI)</enum><text>by a
				pharmaceutical manufacturer patient assistance program, either directly or
				through the distribution or donation of covered part D drugs, which shall be
				valued at the negotiated price of such covered part D drug under the enrollee’s
				prescription drug plan or MA–PD plan as of the date that the drug was
				distributed or donated; or</text>
								</subclause><subclause id="H3401E1C2460C4588BCD8A0FD4C7BBD3E"><enum>(VII)</enum><text display-inline="yes-display-inline">by a subsection (d) hospital (as defined in
				section 1886(d)(1)(B) that meets the requirements of clauses (i) and (ii) of
				the section 340B(a)(4)(L) of the Public Health Service
				Act.</text>
								</subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HDC1F08FDBA034F659362DDA7A3D6CD0"><enum>(2)</enum><header>Effective
			 date</header><text>The amendments made by paragraph (1) shall apply to costs
			 incurred on or after January 1, 2008, for plan years beginning on or after such
			 date.</text>
				</paragraph></subsection><subsection id="HFB1AE712B9524720831819DFDB07C75F"><enum>(b)</enum><header>Report on
			 closing the gap</header><text display-inline="yes-display-inline">The Secretary
			 of Health and Human Services shall conduct a study on how to eliminate the gap
			 in Medicare part D prescription drug coverage created through the application
			 of an initial coverage limit and how to finance such elimination. Not later
			 than 180 days after the date of the enactment of this Act, the Secretary shall
			 submit to Congress a report on such study.</text>
			</subsection></section><section id="H9CCF416893DB486D9DD5819EDE23334F"><enum>3.</enum><header>Conforming late
			 enrollment penalty to Medicare part B penalty structure</header>
			<subsection id="H0EF7FE7F92FC4138A8513743A01AC65"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section
			 1860D–13(b)(3) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-113">42 U.S.C. 1395w–113(b)(3)</external-xref>) is
			 amended by striking <quote>is the greater of</quote> and all that follows and
			 inserting the following: <quote>is 10 percent of the base beneficiary premium
			 (as computed under subsection (a)(2)) for each continuous period of 12
			 consecutive uncovered months in such period</quote>.</text>
			</subsection><subsection id="H918352DCDA9D4D80AF609BE11BC597B6"><enum>(b)</enum><header>Not counting
			 periods of non-enrollment during first year of
			 program</header><text>Subparagraph (B) of such section is amended by inserting
			 <quote>(after December 2007)</quote> after <quote>any month</quote>.</text>
			</subsection><subsection id="H85BDB19685DA439DA8D800755C775B90"><enum>(c)</enum><header>Presumption of
			 errors in enrollment or nonenrollment due to official
			 error</header><text>Section 1837(h) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395p">42 U.S.C. 1395p(h)</external-xref>) is amended
			 by adding at the end the following: <quote>In applying the previous sentence,
			 an individual's unintentional, inadvertent, or erroneous enrollment or
			 nonenrollment shall be presumed to be the result of an error,
			 misrepresentation, or inaction of an officer, employee, or agent of the Federal
			 Government, or its instrumentalities, unless the Secretary demonstrates
			 otherwise.</quote>.</text>
			</subsection><subsection id="HFA7B385522594E18AC96B3C05B47F9EE"><enum>(d)</enum><header>Effective
			 dates</header><text>The amendments made by subsections (a) and (b) shall apply
			 to late enrollment penalties for months beginning with January 2008. The
			 amendment made by subsection (c) shall take effect on January 1, 2008, and
			 shall apply as of such date to enrollments (and non-enrollments) occurring
			 before, on, or after such date.</text>
			</subsection></section><section id="H4CCA0C1C68414E5B00A915EAC83480DC"><enum>4.</enum><header>More frequent
			 changes in plans permitted</header>
			<subsection id="HB6BA63E86C254657931D58FB585BDB5C"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 1860D–1(b)(3)
			 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-101">42 U.S.C. 1395w–101(b)(3)</external-xref>) is amended by adding at
			 the end the following new subparagraph:</text>
				<quoted-block display-inline="no-display-inline" id="H9390F7F127D548608D16CAC33F009DA4" style="OLC">
					<subparagraph id="H8D5ED6D7B0924E4CB831E2B8F8B750A4"><enum>(F)</enum><header>Same frequency
				as changes in formularies</header><text>In the case of an individual enrolled
				in a prescription drug plan (or MA–PD plan), as often as the Secretary permits
				such plan to make changes in its
				formulary.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H172CFFF7A14443E1BD92C2CC5856C515"><enum>(b)</enum><header>Permitting
			 change in enrollment during first 3 months of each year as permitted under the
			 Medicare Advantage program</header><text>Section 1860D–1(b)(1)(B)(iii) of such
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-101">42 U.S.C. 1395w–101(b)(1)(B)(iii)</external-xref>) is amended by striking <quote>, (C),
			 </quote>.</text>
			</subsection><subsection id="H3FB87AD344AD4873BAF5CB8544EC5C1C"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall take effect on
			 January 1, 2008.</text>
			</subsection></section><section id="HF13D168A6CA94ECF8C7E9365E3931E6B"><enum>5.</enum><header>Low income
			 subsidy improvements</header>
			<subsection id="HC322FF5C71F5462F9BBDECBFCD2014D4"><enum>(a)</enum><header>Removal of asset
			 test</header>
				<paragraph id="H6EB0E191420E4F9A9B4DF25263533B8E"><enum>(1)</enum><header>In
			 general</header><text>Section 1860D–14(a) of the Social Security Act (42 U.S.C.
			 1395w–114(a)) is amended—</text>
					<subparagraph id="H9428A358E49446E9987B0086A6E3428F"><enum>(A)</enum><text>in paragraph (1),
			 in the matter before subparagraph (A), by striking <quote>and who meets the
			 resources requirement described in paragraph (3)(D)</quote>; and</text>
					</subparagraph><subparagraph id="H81FE26FB84824509BAC4A4BCFF53DBB"><enum>(B)</enum><text>in paragraph
			 (3)—</text>
						<clause id="H29C21207BBC84BCCA8B84CB41800B18F"><enum>(i)</enum><text>in
			 paragraph (3)(A), by adding <quote>and</quote> at the end of clause (i), by
			 striking <quote>; and</quote> at the end of clause (ii) and inserting a period,
			 and by striking clause (iii); and</text>
						</clause><clause id="H74DEA914939F462AB70017BFB145E864"><enum>(ii)</enum><text>by
			 striking subparagraphs (D) and (E).</text>
						</clause></subparagraph></paragraph><paragraph id="H2DBF219238664024AD89301D00FFCBF2"><enum>(2)</enum><header>Effective
			 date</header><text>The amendments made by paragraph (1) shall apply to benefits
			 for months beginning with January 2008.</text>
				</paragraph></subsection><subsection id="H3636E26F5D3B44F49357D07602AC3545"><enum>(b)</enum><header>Elimination of
			 late enrollment penalties for subsidy eligible individuals</header>
				<paragraph id="H69487D5709BC46519C8DB93436078D00"><enum>(1)</enum><header>In
			 general</header><text>Section 1860D–13(b)(2) of the Social Security Act (42
			 U.S.C. 1395w–113(b)(2)) is amended by inserting <quote>who is not a subsidy
			 eligible individual and</quote> after <quote>an individual</quote>.</text>
				</paragraph><paragraph id="HC51A191E772E49E3B382DC5281C8063"><enum>(2)</enum><header>Conforming
			 amendments</header><text>Section 1860D–14 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-114">42 U.S.C. 1395w–114</external-xref>) is
			 amended—</text>
					<subparagraph id="H02836885C8C24A248F5390D3002106A5"><enum>(A)</enum><text>in subsection
			 (a)(1)(A), by striking <quote>equal to</quote> and all that follows and
			 inserting the following: <quote>100 percent of the amount described in
			 subsection (b)(1), but not to exceed the premium amount specified in subsection
			 (b)(2)(B).</quote>; and</text>
					</subparagraph><subparagraph id="H9406E6B1C55A4188BE632F16A237D03C"><enum>(B)</enum><text>in subsection
			 (b)(2)(B), by striking the last sentence.</text>
					</subparagraph></paragraph><paragraph id="HB70C95C93AFE4D71A7F0B7BCF883B8D"><enum>(3)</enum><header>Effective
			 date</header><text>The amendments made by this subsection shall apply to late
			 enrollment penalties for months beginning with January 2008.</text>
