		<section id="H99853BC31410491A836D392608205BEB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Design Piracy Prohibition
			 Act</short-title></quote>.</text>
		</section><section display-inline="no-display-inline" id="HFDD5D08A3E4048EFAF86D9CCA69627FF" section-type="subsequent-section"><enum>2.</enum><header>Protection for fashion
			 design</header>
			<subsection id="H7690B627910049B0A1B54348EEA07129"><enum>(a)</enum><header>Designs
			 protected</header><text><external-xref legal-doc="usc" parsable-cite="usc/17/1301">Section 1301</external-xref> of title 17, United States Code, is
			 amended—</text>
				<paragraph id="HDA9B637977D6487597E091D580940062"><enum>(1)</enum><text>in subsection (a),
			 by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H4C907BE781144DEA8257F154F76E6259" style="OLC">
						<paragraph id="H82572098CABA4EFFA92FCCF9922597BA"><enum>(3)</enum><header>Fashion
				design</header><text>A fashion design is subject to protection under this
				chapter.</text>
						</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H39E1CC7E0734491E9E8EE7D4D8101EA8"><enum>(2)</enum><text>in subsection
			 (b)—</text>
					<subparagraph id="HFBEE190FA93B4426B6D9F2A7CBEDA03E"><enum>(A)</enum><text>in paragraph (2),
			 by inserting <quote>or an article of apparel,</quote> after <quote>plug or
			 mold,</quote>; and</text>
					</subparagraph><subparagraph id="H673B5DAA6AC94D20B4F46F6193C3EC64"><enum>(B)</enum><text>by adding at the
			 end the following new paragraphs:</text>
						<quoted-block display-inline="no-display-inline" id="H5FCD9AC8518946D7B26449A47EABE378" style="OLC">
							<paragraph id="H9523E0CEF0A84F38B100010030E9D974"><enum>(7)</enum><text>A <term>fashion
				design</term> is the appearance as a whole of an article of apparel, including
				its ornamentation.</text>
							</paragraph><paragraph id="HB476F6B9C9094DBD90586CCDC1A79512"><enum>(8)</enum><text>The term
				<term>design</term> includes fashion design, except to the extent expressly
				limited to the design of a vessel.</text>
							</paragraph><paragraph id="H0744EA1F68564C95A6DF7535FC23F1B6"><enum>(9)</enum><text>The term
				<term>apparel</term> means—</text>
								<subparagraph id="H34E8E313DC7E4C83A978399DD7B16408"><enum>(A)</enum><text>an article of
				men’s, women’s, or children’s clothing, including undergarments, outerwear,
				gloves, footwear, and headgear;</text>
								</subparagraph><subparagraph id="H09DCFB6F7AC0478FA145791B0338BE57"><enum>(B)</enum><text>handbags, purses,
				and tote bags;</text>
								</subparagraph><subparagraph id="H75ED0F92BDFD4544B4C6A6FE84E85482"><enum>(C)</enum><text>belts; and</text>
								</subparagraph><subparagraph id="HD2DD6BE4357D4BF7B8A5F1C02C36FDE"><enum>(D)</enum><text>eyeglass
				frames.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="H0E00F16E7A154AF8BF4EBE8C1301FF8E"><enum>(b)</enum><header>Designs not
			 subject to protection</header><text><external-xref legal-doc="usc" parsable-cite="usc/17/1302">Section 1302</external-xref> of title 17, United States
			 Code, is amended in paragraph (5)—</text>
				<paragraph id="H102578B019894377829D0078FA18DF3D"><enum>(1)</enum><text>by striking
			 <quote>(5)</quote> and inserting <quote>(5)(A) in the case of a design of a
			 vessel hull,</quote>;</text>
				</paragraph><paragraph id="H01227D17BB21427EA67F45002572EA63"><enum>(2)</enum><text>by striking the
			 period and inserting <quote>; or</quote>; and</text>
				</paragraph><paragraph id="H9447DBB497674169ACE2AF95802F9967"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H0F2D26125414483E936608C63C4D002D" style="OLC">
						<subparagraph id="H47A61EDD5D9D4F85A3EC2E005E524F60" indent="up1"><enum>(B)</enum><text>in the case of a fashion design,
				embodied in a useful article that was made public by the designer or owner in
				the United States or a foreign country more than 3 months before the date of
				the application for registration under this
				chapter.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H295B30BF7EA74A6F9CF4316FBB8B93B"><enum>(c)</enum><header>Term of
			 protection</header><text><external-xref legal-doc="usc" parsable-cite="usc/17/1305">Section 1305(a)</external-xref> of title 17, United States Code, is
			 amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H7C6FF6BECD214A178EEB4B47007BB3CC" style="OLC">
					<subsection id="H2B90E3F5752F49D98330C9B1E44B821B"><enum>(a)</enum><header>In
				general</header><text>Subject to subsection (b), the protection provided under
				this chapter—</text>
						<paragraph id="H1C2EDF87FDBF4FFE96B845843C818D6D"><enum>(1)</enum><text>for a design of a
				vessel hull shall continue for a term of 10 years beginning on the date of the
				commencement of protection under section 1304; and</text>
						</paragraph><paragraph id="HF0CA2FF6A51B42978B9CDE5CBA3492F0"><enum>(2)</enum><text display-inline="yes-display-inline">for a fashion design shall continue for a
				term of 3 years beginning on the date of the commencement of protection under
				section
				1304.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H44DE46163D6342E7BBF13966C54567E2"><enum>(d)</enum><header>Infringement</header><text>Section
			 1309 of title 17, United States Code, is amended—</text>
				<paragraph id="HFDC5D5083F2A4696B651FF02375E16CC"><enum>(1)</enum><text>in subsection (c),
			 by striking <quote>that a design was protected</quote> and inserting <quote>or
			 reasonable grounds to know that protection for the design is
			 claimed</quote>;</text>
				</paragraph><paragraph id="H17124167340448A0AC4EAC516D3CB0B5"><enum>(2)</enum><text>in subsection (e),
			 by inserting <quote>or from an image thereof,</quote> after <quote>copied from
			 a design protected under this chapter,</quote>; and</text>
				</paragraph><paragraph id="H06A96E6DA41C431BB2A7B8004DE9F815"><enum>(3)</enum><text>by adding at the
			 end the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="H89F312DA93974EE7A4273D26AB122ED0" style="OLC">
						<subsection id="HE06DFF96169E40F6A57229005472DA9B"><enum>(h)</enum><header>Secondary
				liability</header><text>The doctrines of secondary infringement and secondary
				liability that are applied in actions under chapter 5 of this title apply to
				the same extent to actions under this chapter. Any person who is liable under
				either such doctrine under this chapter is subject to all the remedies provided
				under this chapter, including those attributable to any underlying or resulting
				infringement.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HCB394A98F44E40E68C001662A2CC7ECE"><enum>(e)</enum><header>Application for
			 registration</header><text><external-xref legal-doc="usc" parsable-cite="usc/17/1310">Section 1310</external-xref> of title 17, United States Code, is
			 amended—</text>
				<paragraph id="H7EEE7B1382C44D6EB9C200EE58959700"><enum>(1)</enum><text>in subsection (a),
			 by striking the text and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="H3A3A019C3EA94DD8AB60CA5FD1745E1D" style="OLC">
						<paragraph id="H4201D1F4E0AC4EE89B7C53303E80546C"><enum>(1)</enum><header>Vessel hull
				design</header><text>In the case of a design of a vessel hull, protection under
				this chapter shall be lost if application for registration of the design is not
				made within 2 years after the date on which the design is first made
				public.</text>
						</paragraph><paragraph id="H1E2C828E04B34AC289E35CEF99D8D79B"><enum>(2)</enum><header>Fashion
				design</header><text>In the case of a fashion design, protection under this
				chapter shall be lost if application for registration of the design is not made
				within 3 months after the date on which the design is first made
				public.</text>
						</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HCA78995539234C8B8FC454EE00F7A0E5"><enum>(2)</enum><text>in subsection (b),
			 by striking <quote>for sale</quote> and inserting <quote>for individual or
			 public sale</quote>.</text>
				</paragraph></subsection><subsection id="H99A5A332F66D41D3BC691D79DA74D600"><enum>(f)</enum><header>Examination of
			 application and issue or refusal of registration</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/17/1313">Section 1313(a)</external-xref> of title 17, United States
			 Code, is amended by striking <quote>subject to protection under this
			 chapter</quote> and inserting <quote>within the subject matter protected under
			 this chapter</quote>.</text>
			</subsection><subsection id="H1296366C5F65486A93AADF89B06957A"><enum>(g)</enum><header>Recovery for
			 infringement</header><text display-inline="yes-display-inline">Section 1323(a)
			 of title 17, United States Code, is amended by striking <quote>$50,000 or $1
			 per copy</quote> and inserting <quote>$250,000 or $5 per copy</quote>.</text>
			</subsection><subsection id="HFD8BBCD31469411F90AB3397B9082766"><enum>(h)</enum><header>Other rights not
			 affected</header><text><external-xref legal-doc="usc" parsable-cite="usc/17/1330">Section 1330</external-xref> of title 17, United States Code, is
			 amended—</text>
				<paragraph id="HF12E43234D7C4AA8BD9983FF24F33200"><enum>(1)</enum><text>in paragraph (1),
			 by striking <quote>or</quote> after the semicolon;</text>
				</paragraph><paragraph id="H5E70A77763E04400A71C85A7C8B271AE"><enum>(2)</enum><text>in paragraph (2),
			 by striking the period and inserting <quote>; or</quote>; and</text>
				</paragraph><paragraph id="H262873A84E2C426B98D2D0EE886D925E"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H07CD5B732F214308B957451384ACDB27" style="OLC">
						<paragraph id="H6DED8BA6198A499DAE70A7362B25A5"><enum>(3)</enum><text>any rights that may
				exist under provisions of this title other than this
				chapter.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section></legis-body>
