<section section-type="section-one" id="H1A8AB823D8E744E5AB14E474FE9C8D51" display-inline="no-display-inline"><enum>1.</enum><header>Requirement for employers to conduct employment eligibility verification</header> 
<subsection id="H876730E868CD480284B0CE7585CA00C6"><enum>(a)</enum><header>Renaming of Basic Pilot Program</header><text>The basic pilot program established under section 403(a) of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (division C of <external-xref legal-doc="public-law" parsable-cite="pl/104/208">Public Law 104–208</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/8/1324a">8 U.S.C. 1324a</external-xref> note) is hereby renamed as the <quote>Employment Eligibility Verification System</quote> (and is referred to in this section as such).</text></subsection> 
<subsection id="HC69A579ED6654ECFB8C1F7C47C589BF5"><enum>(b)</enum><header>Extension of Scope of Program</header><text>The Secretary of Homeland Security shall provide for the implementation of the Employment Eligibility Verification System throughout the United States on a timely basis, consistent with the implementation of subsection (c) and such System shall continue in operation permanently and shall not terminate.</text></subsection> 
<subsection id="H3CD8046D70E54306A6ABAA6DCC5F85C3"><enum>(c)</enum><header>Requirement for Use of Employment Eligibility Verification</header> 
<paragraph id="H4035E5DA1B53405EA4F37DB3771790EA"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (3), any person or other entity that hires any individual for employment in the United States shall participate in the Employment Eligibility Verification System.</text></paragraph> 
<paragraph id="HF27B53DC2A8C48BDB91D568C751D1C1B"><enum>(2)</enum><header>Sanctions for noncompliance; continuation of current compliance authority</header><text>The provisions of paragraph (2) of section 402(e) of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (division C of <external-xref legal-doc="public-law" parsable-cite="pl/104/208">Public Law 104–208</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/8/1324a">8 U.S.C. 1324a</external-xref> note) shall apply with respect to a person or entity required to participate in the Employment Eligibility Verification System in the same manner as such paragraph applies to a person or entity required to participate under such subsection.</text></paragraph> 
<paragraph id="H5EF4558458F443BB9FB7826FA9483288"><enum>(3)</enum><header>Phasing-in of requirement</header><text>Subject to paragraph (2), the requirement of paragraph (1) shall only apply to persons and other entities as follows:</text> 
<subparagraph id="H3793FAA58B8C431EBE271F2BA9443300"><enum>(A)</enum><text>As of the date that is 1 year after the date of the enactment of this Act, such requirement shall apply only to a person or other entity that employs more than 10,000 individuals in the United States.</text></subparagraph> 
<subparagraph id="HE9549703CE9A41B8B4706990DBD31BA6"><enum>(B)</enum><text>As of the date that is 2 years after the date of the enactment of this Act, such requirement shall apply only to a person or other entity that employs more than 5,000 individuals in the United States.</text></subparagraph> 
<subparagraph id="HA457FE6CFC6E44F682913810589FA533"><enum>(C)</enum><text>As of the date that is 3 years after the date of the enactment of this Act, such requirement shall apply only to a person or other entity that employs more than 1,000 individuals in the United States.</text></subparagraph> 
<subparagraph id="HB457C09721C14B30A3AA3270D6C502D5"><enum>(D)</enum><text>As of the date that is 4 years after the date of the enactment of this Act, such requirement shall apply only to a person or other entity that employs more than 500 individuals in the United States.</text></subparagraph> 
<subparagraph id="H0C50A282B94D47A7892C2FBEC6C7ACBE"><enum>(E)</enum><text>As of the date that is 5 years after the date of the enactment of this Act, such requirement shall apply only to a person or other entity that employs more than 250 individuals in the United States.</text></subparagraph> 
<subparagraph id="H37B869035D1841429441CBD4201576CF"><enum>(F)</enum><text>As of the date that is 6 years after the date of the enactment of this Act, such requirement shall apply only to a person or other entity that employs more than 100 individuals in the United States.</text></subparagraph> 
<subparagraph id="HD3F730137244454FAEFFEEBFE6303739"><enum>(G)</enum><text>As of the date that is 7 years after the date of the enactment of this Act, such requirement shall apply to any person or other entity that employs 1 or more individuals in the United States.</text></subparagraph></paragraph> 
<paragraph id="H3E1281079D414BBDB8E500D9333CBC79"><enum>(4)</enum><header>Voluntary participation of employers not subject to requirement</header><text>Nothing in this subsection shall be construed as preventing a person or other entity that is not subject to the requirement of paragraph (1) pursuant to paragraph (2) or (3) from voluntarily participating in the Employment Eligibility Verification System.</text></paragraph></subsection> 
<subsection id="H7E7146A9463747D0AAC871372312AC3C"><enum>(d)</enum><header>Authorization of Appropriations</header><text>There are authorized to be appropriated such sums as may be required to carry out the Employment Eligibility Verification System throughout the United States</text></subsection></section>
