		<section id="H3744C949EE49488B8C87670000CF0091" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Preservation of Federalism in Banking
			 Act</short-title></quote>.</text>
		</section><title id="H7C3AF63F34E94ACC84EC4DD937A33969"><enum>I</enum><header>National
			 banks</header>
			<section id="H65825752AEDB4DDD9F0000E2D79144F0"><enum>101.</enum><header>State law
			 preemption standards for national banks clarified</header>
				<subsection id="H183506BF065144B081AB003827D722A8"><enum>(a)</enum><header>In
			 general</header><text>Chapter One of title LXII of the Revised Statutes of the
			 United States (<external-xref legal-doc="usc" parsable-cite="usc/12/21">12 U.S.C. 21 et seq.</external-xref>) is amended by inserting after section
			 5136B the following new section:</text>
					<quoted-block display-inline="no-display-inline" id="H54BB6C7F777942A0BD2373C9A095EB46" style="OLC">
						<section id="H65C7DA5B9BC048E8815E1C96FBBB65FD"><enum>5136C.</enum><header>State law
				preemption standards for national banks and subsidiaries clarified</header>
							<subsection id="HD9C7EF83A64B4DEB89B0A1F53F504700"><enum>(a)</enum><header>State consumer
				laws of general application</header>
								<paragraph display-inline="no-display-inline" id="HC54B7FB1A5F741BBB654F186A64E0037"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Notwithstanding any
				other provision of Federal law, any consumer protection in State consumer law
				of general application (including any law relating to unfair or deceptive acts
				or practices, any consumer fraud law and repossession, foreclosure, and
				collection) shall apply to any national bank.</text>
								</paragraph><paragraph id="HB67FF6D9BCC7450383DD7376D16584F1"><enum>(2)</enum><header>National bank
				defined</header><text display-inline="yes-display-inline">For purposes of this
				section, the term <term>national bank</term> includes any Federal branch
				established in accordance with the International Banking Act of 1978.</text>
								</paragraph></subsection><subsection id="H0B5E633AAD814248AEA6B7A0E57D385C"><enum>(b)</enum><header>State laws
				related to laws used by national banks for their benefit</header><text>When a
				national bank avails itself of a State law for its benefit, all related
				consumer protections in State law shall apply.</text>
							</subsection><subsection id="HDF0CD753F4F643CF9FB2DFBCFD6D077E"><enum>(c)</enum><header>State banking
				laws enacted pursuant to Federal law</header>
								<paragraph id="H7797179DA05A4989B122F99EF9A4AC95"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Notwithstanding any
				other provision of Federal law and except as provided in paragraph (2), any
				State law that—</text>
									<subparagraph id="H2363972FDCF345EEA8DDA3F71B99DE5"><enum>(A)</enum><text display-inline="yes-display-inline">is applicable to State banks; and</text>
									</subparagraph><subparagraph id="H71EEB334E3F349C300C75C2348F7ACFE"><enum>(B)</enum><text>was enacted
				pursuant to or in accordance with, and is not inconsistent with, an Act of
				Congress, including the Gramm-Leach-Bliley Act, the Consumer Credit Protection
				Act, and the Real Estate Settlement Procedures Act, that explicitly or by
				implication, permits States to exceed or supplement the requirements of any
				comparable Federal law,</text>
									</subparagraph><continuation-text continuation-text-level="paragraph">shall
				apply to any national bank.</continuation-text></paragraph><paragraph id="HFC7F7963F29149D987003BED94D3DDE"><enum>(2)</enum><header>Exceptions</header><text>Paragraph
				(1) shall not apply with respect to any State law if—</text>
									<subparagraph id="H1523577D5CE543DA849744C576666712"><enum>(A)</enum><text display-inline="yes-display-inline">the State law discriminates against
				national banks; or</text>
									</subparagraph><subparagraph id="H72DC2EECC2664C91936854A32440F8C2"><enum>(B)</enum><text>State law is
				inconsistent with provisions of Federal law other than this title LXII, but
				only to the extent of the inconsistency (as determined in accordance with the
				provision of the other Federal Law).</text>
									</subparagraph></paragraph></subsection><subsection id="H9E2B8A6E880143A89B4CA28DD582BF5D"><enum>(d)</enum><header>State laws
				protecting against predatory mortgage loans</header><text display-inline="yes-display-inline">To the extent not otherwise addressed in
				this section, State laws providing greater protection in high cost mortgage
				loans, however denominated, both in coverage and content, than is provided
				under the Truth in Lending Act (including the provisions amended by the Home
				Ownership and Equity Protection Act of 1994) shall apply to any national
				bank.</text>
							</subsection><subsection id="HCAA1F976E171475ABE006F50031D78FE"><enum>(e)</enum><header>Comparable
				Federal regulation required</header><text display-inline="yes-display-inline">In relation to the regulation of consumer
				credit and deposit transactions, the Comptroller may preempt State law pursuant
				to this title only when there is a comparable Federal statute, or regulations
				pursuant to a Federal statute other than this title, expressly governing the
				activity, except in relation to interest pursuant to section 5197.</text>
							</subsection><subsection id="H450EF026630D4FBEB7E505C3B300C21D"><enum>(f)</enum><header>No negative
				implications for applicability of other state laws</header><text display-inline="yes-display-inline">No
				provision of this section shall be construed as altering or affecting the
				applicability, to national banks, of any State law which is not described in
				this section.</text>
							</subsection><subsection id="HF4E3B5152E00408B9EB30018022F4CB9"><enum>(g)</enum><header>Effect of
				transfer of transaction</header><text>A transaction that is not entitled to
				preemption at the time of the origination of the transaction does not become
				entitled to preemption under this title by virtue of its subsequent acquisition
				by a national bank.</text>
							</subsection><subsection display-inline="no-display-inline" id="H5A7D36CB7ADC4ABDA6D4591CE2AF2186"><enum>(h)</enum><header>Denial of
				preemption not a deprivation of a civil right</header><text display-inline="yes-display-inline">The preemption of any provision of the law
				of any State with respect to any national bank shall not be treated as a right,
				privilege, or immunity for purposes of section 1979 of the Revised Statutes of
				the United States (<external-xref legal-doc="usc" parsable-cite="usc/42/1983">42 U.S.C. 1983</external-xref>).</text>
							</subsection><subsection id="H0FFADC6F23C045159013AD13FA7E9B45"><enum>(i)</enum><header>Definition</header><text>For
				purposes of this section, the terms <term>includes</term> and
				<term>including</term> have the same meaning as in section 3(t) of the Federal
				Deposit Insurance
				Act.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection display-inline="no-display-inline" id="H6CDE137CE3BC4201A96100BEF4224943"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections for chapter One of title LXII of
			 the Revised Statutes of the United States is amended by inserting after the
			 item relating to section 5136B the following new item:</text>

				</subsection></section><section display-inline="no-display-inline" id="H8BAEAD97FEB741B7A4F639FF810EB73" section-type="subsequent-section"><enum>102.</enum><header>Visitorial
			 standards</header><text display-inline="no-display-inline">Section 5136C of the
			 Revised Statutes of the United States (as added by
			 <internal-xref idref="H76803B496F94411FB83D5232A4CAE79" legis-path="4.">section
			 101</internal-xref>(a) of this Act) is amended by adding at the end the
			 following new subsections:</text>
				<quoted-block display-inline="no-display-inline" id="HBE84CD09E6AD4C48BCAD6C23D13874B1" style="OLC">
					<subsection id="HF1A338580A3144FFA7D0784412C65ED5"><enum>(j)</enum><header>Visitorial
				powers</header><text display-inline="yes-display-inline">No provision of this
				title which relates to visitorial powers or otherwise limits or restricts the
				supervisory, examination, or regulatory authority to which any national bank is
				subject shall be construed as limiting or restricting the authority of any
				attorney general (or other chief law enforcement officer) of any State to bring
				any action in any court of appropriate jurisdiction—</text>
						<paragraph id="HFAF7A413FA384DB38EA7E7FD9848B625"><enum>(1)</enum><text>to enforce any
				applicable Federal or State law, as authorized by such law; or</text>
						</paragraph><paragraph id="H4BF7DC7CF3314B31B92894D9AF29F7F4"><enum>(2)</enum><text>on behalf of
				residents of such State, to enforce any applicable provision of any Federal or
				State law against a national bank, as authorized by such law, or to seek relief
				and recover damages for such residents from any violation of any such law by
				any national bank.</text>
						</paragraph></subsection><subsection id="HF4374C8D5DB641B3920032E076818269"><enum>(k)</enum><header>Enforcement
				actions</header><text display-inline="yes-display-inline">The ability of the
				Comptroller to bring an enforcement action under this title or section 5 of the
				Federal Trade Commission Act does not preclude private parties from enforcing
				rights granted under Federal or State law in the
				courts.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section display-inline="no-display-inline" id="HA785E24F178E41129D00087C43F176BA"><enum>103.</enum><header>Clarification
			 of law applicable to State-chartered nondepository institution
			 subsidiaries</header><text display-inline="no-display-inline">Section 5136C of
			 the Revised Statutes of the United States (as added by
			 <internal-xref idref="H76803B496F94411FB83D5232A4CAE79" legis-path="3.(a)">section 101</internal-xref>(a) of this Act) is amended by
			 inserting after subsection (k) (as added by section 102) the following new
			 subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H4C1325421F9048AE822C2411DDB6E53C" style="OLC">
					<subsection id="H86B32BC7928343159457598FDE3D1B7D"><enum>(l)</enum><header>Clarification of
				law applicable to nondepository institution subsidiaries and affiliates of
				national banks; definitions</header>
						<paragraph id="H6A5FA5A7F1CE474E9927003930B9DAF6"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">No provision of this
				title shall be construed as preempting the applicability of State law to any
				State-chartered nondepository institution, subsidiary, other affiliate, or
				agent of a national bank.</text>
						</paragraph><paragraph id="HA44524C2DE5E44C2A4ABFC19363D499D"><enum>(2)</enum><header>Definitions</header><text>For
				purposes of this section, the following definitions shall apply:</text>
							<subparagraph id="H62D07CD9898B44ED9C968D7C9DF725B8"><enum>(A)</enum><header>Depository
				institution, subsidiary, affiliate</header><text>The terms <term>depository
				institution</term>, <term>subsidiary</term>, and <term>affiliate</term> have
				the same meanings as in section 3 of the Federal Deposit Insurance Act.</text>
							</subparagraph><subparagraph id="H62AB4916A38E45059C17D783B05FAA72"><enum>(B)</enum><header>Nondepository
				institution</header><text>The term <term>nondepository institution</term> means
				any entity that is not a depository
				institution.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="HFD57BD8D2046433CA912A133FDF1283C"><enum>104.</enum><header>Data collection
			 and reporting</header>
				<subsection id="H418BFF113A2C491EBA1972F7109F6151"><enum>(a)</enum><header>Collecting and
			 monitoring consumer complaints</header>
					<paragraph id="H2360903786104E308FCD997FF56714C5"><enum>(1)</enum><header>In
			 general</header><text>The Comptroller of the Currency shall record and monitor
			 each complaint received directly or indirectly from a consumer regarding a
			 national bank or any subsidiary of a national bank and record the resolution of
			 the complaint.</text>
					</paragraph><paragraph id="H5884F821814448E2979066F8EF00794B"><enum>(2)</enum><header>Factors to be
			 included</header><text>In carrying out the requirements of paragraph (1), the
			 Comptroller of the Currency shall include—</text>
						<subparagraph id="H9CB0A6812F1940C581D55C12C862800"><enum>(A)</enum><text>the date the
			 consumer complaint was received;</text>
						</subparagraph><subparagraph id="HD16B37C706F44714AF2587CB998EAD27"><enum>(B)</enum><text>the nature of the
			 complaint;</text>
						</subparagraph><subparagraph id="H012AACD0EA054C17B1313CF3F224AE55"><enum>(C)</enum><text>when and how the
			 complaint was resolved, including a brief description of the extent, and the
			 results, of the investigation made by the Comptroller into the complaint, a
			 brief description of any notices given and inquiries made to any other Federal
			 or State officer or agency in the course of the investigation or resolution of
			 the complaint, a summary of the enforcement action taken upon completion of the
			 investigation, and a summary of the results of subsequent periodic reviews by
			 the Comptroller of the extent and nature of compliance by the national bank or
			 subsidiary with the enforcement action; and</text>
						</subparagraph><subparagraph id="HA724BC3F8D1048DD85F1DF5A2A9B449"><enum>(D)</enum><text>if the complaint
			 involves any alleged violation of a State law (whether or not Federal law
			 preempts the application of such State law to such national bank) by such bank,
			 a cite to and a description of the State law that formed the basis of the
			 complaint.</text>
						</subparagraph></paragraph></subsection><subsection id="H43956713CD80410F8D719700001E7714"><enum>(b)</enum><header>Report to the
			 Congress</header>
					<paragraph id="H1E77C43DF5864D6781A4E7604CA3D18"><enum>(1)</enum><header>Periodic reports
			 required</header><text>The Comptroller of the Currency shall submit a report
			 semi-annually to the Congress on the consumer protection efforts of the Office
			 of the Comptroller of the Currency.</text>
					</paragraph><paragraph id="HFE077B6A6CD949C6B6F829412714D71"><enum>(2)</enum><header>Contents of
			 report</header><text>Each report submitted under paragraph (1) shall include
			 the following:</text>
						<subparagraph id="H823181B354084C14BC18E1C49E40015"><enum>(A)</enum><text>The total number of
			 consumer complaints received by the Comptroller during the period covered by
			 the report with respect to alleged violations of consumer protection laws by
			 national banks and subsidiaries of national banks.</text>
						</subparagraph><subparagraph id="H54C79CD440E34FC0B9DE67B25832659F"><enum>(B)</enum><text>The total number
			 of consumer complaints received during the reporting period that are based on
			 each of the following:</text>
							<clause id="H42DABCEC0C4747779300F7399FF314F2"><enum>(i)</enum><text>Each
			 title of the Consumer Credit Protection Act (reported as a separate aggregate
			 number for each such title).</text>
							</clause><clause id="HA5B26DC8557D45F2952816E55F8E45B4"><enum>(ii)</enum><text>The
			 Truth in Savings Act.</text>
							</clause><clause id="HC09E0C18A17A40C7AE7061B6E0AA4511"><enum>(iii)</enum><text>The Right to
			 Financial Privacy Act of 1978.</text>
							</clause><clause id="HDA61A8479F2741AD9210C223FA00AB2E"><enum>(iv)</enum><text>The
			 Expedited Funds Availability Act.</text>
							</clause><clause id="H0378388513E147EFA81FD8601273249B"><enum>(v)</enum><text>The
			 Community Reinvestment Act of 1977.</text>
							</clause><clause id="HBF0B5849F1944210AE5FED2500BF5F4C"><enum>(vi)</enum><text>The
			 Bank Protection Act of 1968.</text>
							</clause><clause id="H4ACD223D68674D6FA538184F13C45C23"><enum>(vii)</enum><text>Title LXII of
			 the Revised Statutes of the United States.</text>
							</clause><clause id="HEAE8D0F5585F4583AFF991C9954417E"><enum>(viii)</enum><text>The Federal
			 Deposit Insurance Act.</text>
							</clause><clause id="H684E32B8933F4FBD99A1373FBA1F74DC"><enum>(ix)</enum><text>The
			 Real Estate Settlement Procedures Act of 1974.</text>
							</clause><clause id="H72F14503C8CD4213B3F2DEC19F0852E9"><enum>(x)</enum><text>The
			 Home Mortgage Disclosure Act of 1975.</text>
							</clause><clause id="H4C3915EE9C134A3C96EE3CC78E631654"><enum>(xi)</enum><text>Any
			 other Federal law.</text>
							</clause><clause id="H37F07B6B5E44438DB6910180E45EBC89"><enum>(xii)</enum><text>State consumer
			 protection laws (reported as a separate aggregate number for each State and
			 each State consumer protection law).</text>
							</clause><clause id="HB052B8BC06C24EF7AA001523997FD684"><enum>(xiii)</enum><text display-inline="yes-display-inline">Any other State law (reported separately
			 for each State and each State law).</text>
							</clause></subparagraph><subparagraph id="H7A3A249CE7F245CFAC27B386E8D4C941"><enum>(C)</enum><text>A summary
			 description of the resolution efforts by the Comptroller for complaints
			 received during the period covered, including—</text>
							<clause id="H52B08EABA494419FA096B750D9503B33"><enum>(i)</enum><text>the
			 average amount of time to resolve each complaint;</text>
							</clause><clause id="H9B056A9FEC1141319E9E8F9632672E67"><enum>(ii)</enum><text>the
			 median period of time to resolve each complaint;</text>
							</clause><clause id="H957BD463C1B746DDA96BE044325EA1C6"><enum>(iii)</enum><text>the average and
			 median time to resolve complaints in each category of complaints described in
			 each clause of subparagraph (B); and</text>
							</clause><clause id="HA70C2FA09626458B9B4436DC352E0362"><enum>(iv)</enum><text>a
			 summary description of the longest outstanding complaint during the reporting
			 period and the reason for the difficulty in resolving such complaint in a more
			 timely fashion.</text>
							</clause></subparagraph></paragraph><paragraph id="H30662EB742CB454284204F44B8F04C52"><enum>(3)</enum><header>Disclosure of
			 report on occ website</header><text display-inline="yes-display-inline">Each
			 report submitted to the Congress under this subsection shall be posted, by the
			 Comptroller of the Currency, in a timely fashion and maintained on the website
			 of the Office of the Comptroller of the Currency on the World Wide Web.</text>
					</paragraph></subsection></section></title><title id="H748D0B536EFC464BB54C4E618DC8BD9"><enum>II</enum><header>Savings
			 associations</header>
			<section id="HCBB4ACE55A9B4CB68980A607E1F7A8B8"><enum>201.</enum><header>State law
			 preemption standards for federal savings associations clarified</header>
				<subsection id="H6EC9BE5B57134709BD03E82CC8798400"><enum>(a)</enum><header>In
			 general</header><text>The Home Owners' Loan Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1461">12 U.S.C. 1461 et seq.</external-xref>) is
			 amended by inserting after section 5 the following new section:</text>
					<quoted-block display-inline="no-display-inline" id="H43D5A1BB2A954476A5F793B80009444B" style="OLC">
						<section id="HD79EA5676B914A5F00BCD4A33548EB1"><enum>6.</enum><header>State law
				preemption standards for federal savings associations and affiliates
				clarified</header>
							<subsection id="H3C1A0833F63D4340B696055863A3A179"><enum>(a)</enum><header>State consumer
				laws of general application</header><text display-inline="yes-display-inline">Notwithstanding any other provision of
				Federal law, any consumer protection in State consumer law of general
				application (including any law relating to unfair or deceptive acts or
				practices, any consumer fraud law and repossession, foreclosure, and
				collection) shall apply to any Federal savings association.</text>
							</subsection><subsection id="H60E206372DA7463CB446B5AA9449C6D"><enum>(b)</enum><header>State laws
				related to laws used by Federal savings associations for their
				benefit</header><text display-inline="yes-display-inline">When a Federal
				savings association avails itself of a State law for its benefit, all related
				consumer protections in State law shall apply.</text>
							</subsection><subsection id="H4632DE5596AD46CEBDD895326F577030"><enum>(c)</enum><header>State banking or
				thrift laws enacted pursuant to Federal law</header>
								<paragraph id="H62DB7ACB228F46678BE1418EF9735C76"><enum>(1)</enum><header>In
				general</header><text>Notwithstanding any other provision of Federal law and
				except as provided in paragraph (2), any State law that—</text>
									<subparagraph id="HEB8545BF887142848361D3B499667732"><enum>(A)</enum><text>is applicable to
				State savings associations (as defined in section 3 of the Federal Deposit
				Insurance Act); and</text>
									</subparagraph><subparagraph id="HA5E7DA43B01B4E7B9570AA39A092D6"><enum>(B)</enum><text display-inline="yes-display-inline">was enacted pursuant to or in accordance
				with, and is not inconsistent with, an Act of Congress, including the
				Gramm-Leach-Bliley Act, the Consumer Credit Protection Act, and the Real Estate
				Settlement Procedures Act, that explicitly or by implication, permits States to
				exceed or supplement the requirements of any comparable Federal law,</text>
									</subparagraph><continuation-text continuation-text-level="paragraph">shall
				apply to any Federal savings association.</continuation-text></paragraph><paragraph id="H578E4353A11D4FA1B2D198D6D22C0219"><enum>(2)</enum><header>Exceptions</header><text>Paragraph
				(1) shall not apply with respect to any State law if—</text>
									<subparagraph id="HE4813AC603C1425F9409875F7591D52E"><enum>(A)</enum><text>the State law
				discriminates against Federal savings associations; or</text>
									</subparagraph><subparagraph id="HF428711ECA3949CEABAA6FC535D8E78"><enum>(B)</enum><text>the State law is
				inconsistent with provisions of Federal law other than this Act, but only to
				the extent of the inconsistency (as determined in accordance with the provision
				of the other Federal law).</text>
									</subparagraph></paragraph></subsection><subsection display-inline="no-display-inline" id="HF07B2D2520B4494A99B775183417C200"><enum>(d)</enum><header>State laws
				protecting against predatory mortgage loans</header><text display-inline="yes-display-inline">To the extent not otherwise addressed in
				this section, State laws providing greater protection in high cost mortgage

							</subsection><subsection id="H491E40B287E04876A64C8FF494849375"><enum>(e)</enum><header>Comparable
				Federal regulation required</header><text display-inline="yes-display-inline">In relation to the regulation of consumer
				credit and deposit transactions, the Director of the Office of Thrift
				Supervision may preempt State law pursuant to this Act only when there is a
				comparable Federal statute, or regulations pursuant to a Federal statute other
				than this Act, expressly governing the activity, except in relation to interest
				pursuant to section 4(g).</text>
							</subsection><subsection display-inline="no-display-inline" id="HA8BF017AA6BE48CFB59E74261CD8FE38"><enum>(f)</enum><header>No negative
				implications for applicability of other state laws</header><text display-inline="yes-display-inline">No
				provision of this section shall be construed as altering or affecting the
				applicability, to Federal savings associations, of any State law which is not
				described in this section.</text>
							</subsection><subsection id="H1D1EB717EEEF49DEAEA79E6CB5EF3100"><enum>(g)</enum><header>Effect of
				transfer of transaction</header><text display-inline="yes-display-inline">A
				transaction that is not entitled to preemption at the time of the origination
				of the transaction does not become entitled to preemption under this Act by
				virtue of its subsequent acquisition by a Federal savings association.</text>
							</subsection><subsection display-inline="no-display-inline" id="H7452D3FD1D084DE7B6AEE6B990FB6944"><enum>(h)</enum><header>Denial of
				preemption not a deprivation of a civil right</header><text display-inline="yes-display-inline">The preemption of any provision of the law
				of any State with respect to any Federal savings association shall not be
				treated as a right, privilege, or immunity for purposes of section 1979 of the
				Revised Statutes of the United States (<external-xref legal-doc="usc" parsable-cite="usc/42/1983">42 U.S.C. 1983</external-xref>).</text>
							</subsection><subsection id="H8211FD190FE04BB4899683C5942BF448"><enum>(i)</enum><header>Definition</header><text>For
				purposes of this section, the terms <term>includes</term> and
				<term>including</term> have the same meaning as in section 3(t) of the Federal
				Deposit Insurance
				Act.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H8082955127D34105A9CEBFC7B312EB03"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections for the Home Owners' Loan Act (12
			 U.S.C. 1461 et seq.) is amended by striking the item relating to section 6 and
			 inserting the following new item:</text>

				</subsection></section><section display-inline="no-display-inline" id="HBAE438AB83A34A3FB47F0066B5C5F15E" section-type="subsequent-section"><enum>202.</enum><header>Visitorial
			 standards</header><text display-inline="no-display-inline">Section 6 of the
			 Home Owners' Loan Act (as added by section 201(a) of this title) is amended by
			 adding at the end the following new subsections:</text>
				<quoted-block display-inline="no-display-inline" id="H726E685846E4410700EF8183F07C8087" style="OLC">
					<subsection id="H5B04E47569634991B7FBA65293D9BDB"><enum>(j)</enum><header>Visitorial
				powers</header><text display-inline="yes-display-inline">No provision of this
				Act shall be construed as limiting or restricting the authority of any attorney
				general (or other chief law enforcement officer) of any State to bring any
				action in any court of appropriate jurisdiction—</text>
						<paragraph id="H9DFC4C692CF542D0BDF375FFB312EFD"><enum>(1)</enum><text>to enforce any
				applicable Federal or State law, as authorized by such law; or</text>
						</paragraph><paragraph id="H48EAB276F84749ADA7A4C6BD07681DBC"><enum>(2)</enum><text>on behalf of
				residents of such State, to enforce any applicable provision of any Federal or
				State law against a Federal savings association, as authorized by such law, or
				to seek relief and recover damages for such residents from any violation of any
				such law by any Federal savings association.</text>
						</paragraph></subsection><subsection id="HC41A072F2DC24840B563C05DFE5FB570"><enum>(k)</enum><header>Enforcement
				actions</header><text display-inline="yes-display-inline">The ability of the
				Director of the Office of Thrift Supervision to bring an enforcement action
				under this Act or section 5 of the Federal Trade Commission Act does not
				preclude private parties from enforcing rights granted under Federal or State
				law in the
				courts.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section display-inline="no-display-inline" id="HA87E61F082AC4E44B61FBC5F8F4909C7"><enum>203.</enum><header>Clarification
			 of law applicable to State-chartered nondepository institution
			 subsidiaries</header><text display-inline="no-display-inline">Section 6 of the
			 Home Owners' Loan Act (as added by
			 <internal-xref idref="H76803B496F94411FB83D5232A4CAE79" legis-path="3.(a)">section 201</internal-xref>(a) of this title) is amended by
			 inserting after subsection (k) (as added by section 202) the following new
			 subsection:</text>

					<subsection id="H10C06A6F9B704B33BF6C1484056FA3DD"><enum>(l)</enum><header>Clarification of
				law applicable to nondepository institution affiliates of Federal savings
				associations</header>
						<paragraph id="HA04FAE7D1FEC449CA0F00958369D47B9"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">No provision of this
				Act shall be construed as preempting the applicability of State law to any
				State-chartered nondepository institution, subsidiary, other affiliate, or
				agent of a Federal savings association.</text>
						</paragraph><paragraph id="H8B94D64DB6644CE6A4D5A1008099A508"><enum>(2)</enum><header>Definitions</header><text>For
				purposes of this section, the following definitions shall apply:</text>
							<subparagraph id="HAD19221F419743F6A1B2AD657DE51043"><enum>(A)</enum><header>Depository
				institution, subsidiary, affiliate</header><text>The terms <term>depository
				institution</term>, <term>subsidiary</term>, and <term>affiliate</term> have
				the same meanings as in section 3 of the Federal Deposit Insurance Act.</text>
							</subparagraph><subparagraph id="H11EE127C8DB14D77B1BC14656CB0E79D"><enum>(B)</enum><header>Nondepository
				institution</header><text>The term <term>nondepository institution</term> means
				any entity that is not a depository
				institution.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="HF416940425B6489C9523ED1251C5F948"><enum>204.</enum><header>Data collection
			 and reporting</header>
				<subsection id="H74AB9F66BC5D4B36B9FA5D8EFF2FDA3F"><enum>(a)</enum><header>Collecting and
			 monitoring consumer complaints</header>
					<paragraph id="HCA0601BC42264F8A8584E2083C682039"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Director of the
			 Office of Thrift Supervision shall record and monitor each complaint received
			 directly or indirectly from a consumer regarding a Federal savings association
			 or any subsidiary of a Federal savings association and record the resolution of
			 the complaint.</text>
					</paragraph><paragraph id="HF4926FF0AD604BD280A9F13DC277F79E"><enum>(2)</enum><header>Factors to be
			 included</header><text>In carrying out the requirements of paragraph (1), the
			 Director of the Office of Thrift Supervision shall include—</text>
						<subparagraph id="H791C032ED2A147FDBC15242E095900C1"><enum>(A)</enum><text>the date the
			 consumer complaint was received;</text>
						</subparagraph><subparagraph id="H551FD96FCE714B1B951694995F1771F5"><enum>(B)</enum><text>the nature of the
			 complaint;</text>
						</subparagraph><subparagraph id="H075FEA332EDA41EB99B35331CE7880AF"><enum>(C)</enum><text display-inline="yes-display-inline">when and how the complaint was resolved,
			 including a brief description of the extent, and the results, of the
			 investigation made by the Director into the complaint, a brief description of
			 any notices given and inquiries made to any other Federal or State officer or
			 agency in the course of the investigation or resolution of the complaint, a
			 summary of the enforcement action taken upon completion of the investigation,
			 and a summary of the results of subsequent periodic reviews by the Comptroller
			 of the extent and nature of compliance by the Federal savings association or
			 subsidiary with the enforcement action; and</text>
						</subparagraph><subparagraph id="H7BC1CF56A3804FB6B9B4566C00A394BE"><enum>(D)</enum><text display-inline="yes-display-inline">if the complaint involves any alleged
			 violation of a State law (whether or not Federal law preempts the application
			 of such State law to such Federal savings association) by such savings
			 association, a cite to and a description of the State law that formed the basis
			 of the complaint.</text>
						</subparagraph></paragraph></subsection><subsection id="H63AF8B1855354375A70098987476A740"><enum>(b)</enum><header>Report to the
			 Congress</header>
					<paragraph id="H06DA666FD464488EB5031E8DBE769137"><enum>(1)</enum><header>Periodic reports
			 required</header><text>The Director of the Office of Thrift Supervision shall
			 submit a report semi-annually to the Congress on the consumer protection
			 efforts of the Office of Thrift Supervision.</text>
					</paragraph><paragraph id="HC5FBCA6DC5894935BF09BB4D12D597F"><enum>(2)</enum><header>Contents of
			 report</header><text>Each report submitted under paragraph (1) shall include
			 the following:</text>
						<subparagraph id="HD40D3806E79A443088AD4863898F5205"><enum>(A)</enum><text display-inline="yes-display-inline">The total number of consumer complaints
			 received by the Director during the period covered by the report with respect
			 to alleged violations of consumer protection laws by Federal savings
			 associations and subsidiaries of Federal savings associations.</text>
						</subparagraph><subparagraph id="H3AECA376E56C46C7B646C2DAFA776446"><enum>(B)</enum><text>The total number
			 of consumer complaints received during the reporting period that are based on
			 each of the following:</text>
							<clause id="H48A222B699884DAC83BCDE93BE329F6E"><enum>(i)</enum><text>Each
			 title of the Consumer Credit Protection Act (reported as a separate aggregate
			 number for each such title).</text>
							</clause><clause id="H213E8F4FA2B248B2B934DEDB99C939"><enum>(ii)</enum><text>The
			 Truth in Savings Act.</text>
							</clause><clause id="HD00A1E9B1D624FB5802299FDD3D1E0E"><enum>(iii)</enum><text>The
			 Right to Financial Privacy Act of 1978.</text>
							</clause><clause id="HF1214C6905574885AFD69470318F52E0"><enum>(iv)</enum><text>The
			 Expedited Funds Availability Act.</text>
							</clause><clause id="H8D09F4AD7E22423CA3FE425DC1FCF314"><enum>(v)</enum><text>The
			 Community Reinvestment Act of 1977.</text>
							</clause><clause id="H97749D6ED25249919221DC4E25974834"><enum>(vi)</enum><text>The
			 Bank Protection Act of 1968.</text>
							</clause><clause id="H35920F115326475DA9B0000AF5C8F"><enum>(vii)</enum><text>The
			 Home Owners' Loan Act.</text>
							</clause><clause id="H2C2ED2DE06354654945D92775DBBE711"><enum>(viii)</enum><text>The Federal
			 Deposit Insurance Act.</text>
							</clause><clause id="H17074F7C1C87448F8F224FD736584BDF"><enum>(ix)</enum><text>The
			 Real Estate Settlement Procedures Act of 1974.</text>
							</clause><clause id="H5A92B437BDA847DCBEF4A37CA792AF49"><enum>(x)</enum><text>The
			 Home Mortgage Disclosure Act of 1975.</text>
							</clause><clause id="H458532102D1C42878509C2DCD5C12945"><enum>(xi)</enum><text>Any
			 other Federal law.</text>
							</clause><clause id="HF61FE2F54225470E9054BCECD135A2BE"><enum>(xii)</enum><text>State consumer
			 protection laws (reported as a separate aggregate number for each State and
			 each State consumer protection law).</text>
							</clause><clause id="H500FD91B2DAE4B7B92E17702DB14C6D8"><enum>(xiii)</enum><text display-inline="yes-display-inline">Any other State law (reported separately
			 for each State and each State law).</text>
							</clause></subparagraph><subparagraph id="H6C14F7D6DB814B6BB6FBE4FE382812"><enum>(C)</enum><text>A summary
			 description of the resolution efforts by the Director for complaints received
			 during the period covered, including—</text>
							<clause id="HB15B1C79AF2A442A900053002296A6B7"><enum>(i)</enum><text>the
			 average amount of time to resolve each complaint;</text>
							</clause><clause id="HE9A96A2D7C414A8296D61C5CB9501431"><enum>(ii)</enum><text>the
			 median period of time to resolve each complaint;</text>
							</clause><clause id="H7BB4CF13D39F463E8BD68CCDEEB80835"><enum>(iii)</enum><text>the average and
			 median time to resolve complaints in each category of complaints described in
			 each clause of subparagraph (B); and</text>
							</clause><clause id="H3EF7DE05EE854B0E94F304FFDDD2E48"><enum>(iv)</enum><text>a
			 summary description of the longest outstanding complaint during the reporting
			 period and the reason for the difficulty in resolving such complaint in a more
			 timely fashion.</text>
							</clause></subparagraph></paragraph><paragraph id="H93358B12033F4617B7E34150F0489BE4"><enum>(3)</enum><header>Disclosure of
			 report on ots website</header><text display-inline="yes-display-inline">Each
			 report submitted to the Congress under this subsection shall be posted, by the
			 Director of the Office of Thrift Supervision, in a timely fashion and
			 maintained on the website of the Office of Thrift Supervision on the World Wide
			 Web.</text>
					</paragraph></subsection></section></title></legis-body>
