<official-title>To promote public safety and improve the welfare of captive big cats, and for other purposes.</official-title>

<section id="HA1D4AC310F8345C2AEAD747929202000" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as <quote>Haley’s Act</quote>.</text></section> 
<section id="H81F9D69A56544FE79969B010BBF76CD4"><enum>2.</enum><header>Big cats</header> 
<subsection id="H83DCE8E3E0594A1588BCF94B0018349F"><enum>(a)</enum><header>Definitions</header><text>Section 2 of the Animal Welfare Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2132">7 U.S.C. 2132</external-xref>) is amended by adding at the end the following new subsections:</text> 
<quoted-block display-inline="no-display-inline" id="HDF33ABD3412540B485B9A4CBA22F310" style="OLC"> 
<subsection id="H54CB68D27F5D4AFA8E4575F711026628"><enum>(p)</enum><text display-inline="yes-display-inline">The term <quote>big cat</quote> means any live species of lion, tiger, leopard, cheetah, jaguar, or cougar or any hybrid of such species.</text></subsection> 
<subsection id="HC135892E5F364ABABBBBD997F34FAB32"><enum>(q)</enum><text display-inline="yes-display-inline">The term <quote>direct contact</quote> means any situation in which an individual may potentially touch or otherwise come into physical contact with any live specimen of a species.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H3E5BF032C1584B45A9B9C1BC31563059"><enum>(b)</enum><header>Applicability of state law</header><text>Section 3 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2133">7 U.S.C. 2133</external-xref>) is amended by adding at the end the following: <quote>The Secretary may deny or revoke a license based on a recommendation from the appropriate State or local officials with jurisdiction over captive wildlife.</quote></text></subsection> 
<subsection id="H3AC9E0C7621D4222817407C4B607D20"><enum>(c)</enum><header>Public safety</header><text>Section 13(a)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2143">7 U.S.C. 2143(a)(2)</external-xref>) is amended—</text> 
<paragraph id="H15310F2B605246F084336B6200F775AE"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>and</quote> at the end;</text></paragraph> 
<paragraph id="HBC1EB967BB4B4A40BFF109A7F3F13B76"><enum>(2)</enum><text>in subparagraph (B), by striking the final period and inserting <quote>; and</quote>; and</text></paragraph> 
<paragraph id="HE8D9BC551F924DEB9EFAECE65E5D5EF6"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text> 
<quoted-block display-inline="no-display-inline" id="H56E1EBFA4CA54D1795E600A04C875F00" style="traditional"> 
<subparagraph id="H4DEA5678C4394EA7BA5F06EA26B8D570"><enum>(C)</enum><text>to provide for public safety.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H7E14103B889F48B39DA18D12A7005215"><enum>(d)</enum><header>Increased fines</header><text>Section 19 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2149">7 U.S.C. 2149</external-xref>) is amended—</text> 
<paragraph id="H7472D10AE2444C0F00C6751E85B5B42C"><enum>(1)</enum><text>in subsection (b)—</text> 
<subparagraph id="HCEDA899427544EA380ABBF5E3C32CC"><enum>(A)</enum><text>in the first sentence, by striking <quote>$2,500</quote> and inserting <quote>$10,000</quote>; and</text></subparagraph> 
<subparagraph id="H3092C415A4A24E13BBFB31ED1559FA72"><enum>(B)</enum><text>in the seventh sentence, by striking <quote>shall be subject to</quote> and all that follows through <quote>each offense</quote> and inserting <quote>shall be subject to a civil penalty of $5,000 for each offense</quote> ; and</text></subparagraph></paragraph> 
<paragraph id="HF4F8BB9640CB4793931FC78483B5E79B"><enum>(2)</enum><text>in subsection (d) in the first sentence, by striking <quote>$2,500</quote> and inserting <quote>$10,000</quote>.</text></paragraph></subsection> 
<subsection id="HB2E0A3389B9C4F44ACA7DCF9F622A0DF"><enum>(e)</enum><header>Prohibition on direct contact with big cats</header><text>Such Act is further amended by adding at the end the following new section:</text>

<section id="HB9144EBD90FD45E2B8F443BE173C71FE"><enum>30.</enum><header>Prohibition on direct contact between public and big cats</header> 
<subsection id="HF8179C6C23ED451798E06E26911D82CC"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to subsection (b), it shall be unlawful for an exhibitor or dealer licensed by the Secretary under this Act to allow direct contact between a big cat and a member of the public.</text></subsection> 
<subsection id="HB51B9DB181F641EDB5133CAE4C3E5BB2"><enum>(b)</enum><header>Exception</header> 
<paragraph id="H3DA17F48FE824D3B9BAA20AB9443D62E"><enum>(1)</enum><header>In general</header><text>Subsection (a) shall not apply to an exhibitor that is a zoo, as determined by the Secretary.</text></paragraph> 
<paragraph id="HA78DB41D962543EF89D42B2CA7C9B80"><enum>(2)</enum><header>Consideration of accreditation</header><text>In determining whether an exhibitor is a zoo under paragraph (1), the Secretary shall consider—</text> 
<subparagraph id="H90CAEA382B2841B4B67405BFADD8CB4"><enum>(A)</enum><text>whether the exhibitor is accredited by, and in good standing with, the Association of Zoos and Aquariums; and</text></subparagraph> 
<subparagraph id="H10836858411A4F0FBF4FC25265F4D6DE"><enum>(B)</enum><text display-inline="yes-display-inline">whether the exhibitor operates with sufficient regard for public safety.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H5951B66C4C7A418287A9ED8FD8565CE6"><enum>(f)</enum><header>Regulations</header> 
<paragraph id="H692C168924CE484B908F1186DD9DE87E"><enum>(1)</enum><header>In general</header><text>Not later than 18 months after the date of the enactment of this Act, the Secretary of Agriculture shall issue regulations pursuant to section 21 of the Animal Welfare Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2151">7 U.S.C. 2151</external-xref>) to implement the amendments made by this Act.</text></paragraph> 
<paragraph id="H653D04AD7D004ACE8ED00839B2BD58F"><enum>(2)</enum><header>Restriction on licenses</header> 
<subparagraph id="HD84AA2664062404281AD6E4E4906F0F0"><enum>(A)</enum><header>In general</header><text>The Secretary of Agriculture may not grant a license under section 3 of such Act to a dealer or exhibitor that possesses or intends to possess a big cat until the regulations described in paragraph (1) have been issued.</text></subparagraph> 
<subparagraph id="H7F9564715E664D0A94939F91FB705D67"><enum>(B)</enum><header>Exception</header><text>The restriction described in subparagraph (A) shall not apply to the renewal of an existing license.</text></subparagraph></paragraph></subsection></section>
