<section id="H54DEC3EED4B14D1C9F3518B867002BF9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Reading First Improvement Act</short-title></quote>.</text></section> 
<section id="HD2C3E016B4784FDABEB034004E404090"><enum>2.</enum><header>Progress report</header><text display-inline="no-display-inline">Section 1202(e)(2) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6362">20 U.S.C. 6362(e)(5)</external-xref>) is amended by striking <quote>peer review panel</quote> and inserting <quote>Committee</quote>.</text></section> 
<section id="H5F9A63ABB4964B879F82EE02C5769D82"><enum>3.</enum><header>Peer review</header><text display-inline="no-display-inline">Section 1203(c)(2) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/20/6363">20 U.S.C. 6363(c)(2)</external-xref>) is amended—</text> 
<paragraph id="H85CB78AB82DA4C998BC24800E6496180"><enum>(1)</enum><text>in subparagraph (A)—</text> 
<subparagraph id="HC0F2E8D4DD3C4C529F9660001FE5D65C"><enum>(A)</enum><text>in the first sentence, by striking <quote>a panel</quote> and inserting <quote>a Reading First Advisory Committee</quote>; and</text></subparagraph> 
<subparagraph id="H8B222AB4C3AD404E9873F88F9E05492"><enum>(B)</enum><text>in the second sentence, by striking <quote>panel</quote> and inserting <quote>Committee</quote>;</text></subparagraph></paragraph> 
<paragraph id="H3B8AB8312BC041E7971B884DAE73C7AB"><enum>(2)</enum><text>by redesignating subparagraphs (B) and (C) as subparagraphs (C) and (D), respectively;</text></paragraph> 
<paragraph id="H95CCF88E798D4FBD00CCDFAD2E9C2328"><enum>(3)</enum><text>by inserting after subparagraph (A) the following:</text>

<subparagraph id="HE898F8C3E2FE4A1EBEE89EA666BE52"><enum>(B)</enum><header>Limitation</header><text>The Committee shall not be comprised of a majority of members selected by one individual or entity described in subparagraph (A).</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H15145F48B99D4A96B8BFE92736DCE63"><enum>(4)</enum><text>in subparagraph (C) (as redesignated by paragraph (2)) by striking <quote>panel</quote> and inserting <quote>Committee</quote>;</text></paragraph> 
<paragraph id="HDCAD44359D6C4289822DBCC010D77798"><enum>(5)</enum><text>in subparagraph (D) (as redesignated by paragraph (2)) by striking <quote>panel</quote> and inserting <quote>Committee</quote>; and</text></paragraph> 
<paragraph id="H67C68596EB964645AFFB6EEB4C165052"><enum>(6)</enum><text>by adding at the end the following:</text>

<subparagraph id="H2885B4BE291E4748AE83692642ED76E3"><enum>(E)</enum><header>Subcommittees</header> 
<clause id="H3796FD00CE8D4D03AF06209BA090E5C4"><enum>(i)</enum><header>In general</header><text>At its sole discretion, the Committee may form one or more subcommittees to assist the Committee with the functions described in this paragraph.</text></clause> 
<clause id="HDF6ED9EA13604D3DB0263C1FD2422458"><enum>(ii)</enum><header>Representation</header><text display-inline="yes-display-inline">If the Committee chooses to form such subcommittees, each subcommittee shall include at least one member selected by each individual or entity described in subparagraph (A), and in no case shall be comprised of a majority of members selected by one such entity. Members of the Committee may serve on one or more subcommittees.</text></clause> 
<clause id="HDD8FAB81136F4C66BB97B8F683E190AC"><enum>(iii)</enum><header>Committee review</header><text>The Committee shall review the recommendations of each subcommittee, and, following such review, make a final recommendation to the Secretary in accordance with subparagraph (D).</text></clause></subparagraph> 
<subparagraph id="HEA12BA555F844BB1B4BEFC18929156AF"><enum>(F)</enum><header>Governance</header><text>The Federal Advisory Committee Act (5 U.S.C. App.) shall govern the activities of the Committee.</text></subparagraph> 
<subparagraph id="H8465B7ACD8724D31BFE6989986C4ED"><enum>(G)</enum><header>Conflicts of interest</header> 
<clause id="H74313BE3FBAD4F99A3A4F77C00DBAA15"><enum>(i)</enum><header>In general</header><text>The Secretary shall establish a process through which members of the Committee or any subcommittees will be screened for potential conflicts of interest.</text></clause> 
<clause id="HD2562DB8D1BD42BB8F359C9E37E6BF84"><enum>(ii)</enum><header>Screening</header><text>Such screening process shall—</text> 
<subclause id="H1C199AD954EB4F31A8FDCEC21CB2EE6B"><enum>(I)</enum><text>be reviewed and approved by the Office of General Counsel of the Department;</text></subclause> 
<subclause id="H0013CCE68CB54FF399ED922EC4959B0"><enum>(II)</enum><text display-inline="yes-display-inline">include, at a minimum, a review of each potential Committee or subcommittee member’s connection to any State’s program under this subpart, each potential Committee or subcommittee member’s potential financial interest in products that might be purchased by a State educational agency or local educational agency in the course of such agency’s implementation of the program under this subpart, and each potential Committee or subcommittee member’s professional connections to teaching methodologies that might require the use of specific products; and</text></subclause> 
<subclause id="H6147904B53464BD18CE4BA36B37BB4B"><enum>(III)</enum><text>be designed to prevent, to the extent possible, bias or the appearance thereof in the Committee’s performance of its responsibilities under this paragraph.</text></subclause></clause></subparagraph> 
<subparagraph id="HACE68D38C6944B88B16737114E88872C"><enum>(H)</enum><header>Guidance</header> 
<clause id="H004172FB19E24C79B024157CBD5D894D"><enum>(i)</enum><header>In general</header><text>The Secretary shall develop guidance for how the Committee and any subcommittees created in accordance with subparagraph (E) will review applications submitted under this section and provide feedback to State educational agencies and recommendations to the Secretary. The Secretary shall also develop guidance for how the Secretary will review the recommendations of the Committee and any subcommittees and make final determinations of approval or disapproval of an application submitted under this section.</text></clause> 
<clause id="HD8B9AA42C8664090BDCDB69F333BA942"><enum>(ii)</enum><header>Requirements</header><text>Such guidance shall, at a minimum—</text> 
<subclause id="HDC9B0AFBC8EF4FCC93648765BEC3A8B7"><enum>(I)</enum><text>create a transparent process through which the Committee and subcommittees provide clear, consistent, and publicly available documentation in support of all recommendations;</text></subclause> 
<subclause id="HA696C34B04874ECBB12F32FB98DF775C"><enum>(II)</enum><text>ensure that the Committee reviews any subcommittee feedback prior to that feedback being submitted to a State educational agency;</text></subclause> 
<subclause id="H8003D041670D45788BFCC62897E50089"><enum>(III)</enum><text>ensure that State educational agencies have the opportunity for direct interaction with the Committee and any subcommittee, as appropriate, when revising an application under this section as a result of feedback submitted by the Committee or a subcommittee;</text></subclause> 
<subclause id="HC69225AFF9A6485EB0D6FB8C937C3927"><enum>(IV)</enum><text>require that the Committee, any subcommittee, and the Secretary clearly and consistently document that all criteria contained in subsection (b) are met before an application submitted under this section is approved; and</text></subclause> 
<subclause id="H08EE8554ADD74687811EF34DFBFFDE74"><enum>(V)</enum><text>create a transparent process through which the Secretary clearly, consistently, and publicly documents decisions to approve or disapprove an application submitted under this section and the reasons for such decisions.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H0D07E8438D7C44BCB5B63D706E97A094"><enum>4.</enum><header>Targeted assistance grants</header><text display-inline="no-display-inline">Section 1204(c)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/6364">20 U.S.C. 6364(c)(2)</external-xref>) is amended—</text> 
<paragraph id="HA400877436ED4A88A5DA5809A6F4E087"><enum>(1)</enum><text>in the first sentence, by striking <quote>peer review panel</quote> and inserting <quote>Committee</quote>; and</text></paragraph> 
<paragraph id="H801531D6DA28401286CCBEF002BA998"><enum>(2)</enum><text>in the second sentence, by striking <quote>panel</quote> and inserting <quote>Committee</quote>.</text></paragraph></section> 
<section id="H17FEF8D7CE9C46EBA0827BFE1FB1803F"><enum>5.</enum><header>External evaluation</header><text display-inline="no-display-inline">Section 1205 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/6365">20 U.S.C. 6365</external-xref>) is amended by adding at the end the following:</text>

<subsection id="H8C727249EAA14E04BCE8E6EDC83F4B3"><enum>(e)</enum><header>Limitation</header> 
<paragraph id="H1C952608921240AABD11663211F66709"><enum>(1)</enum><header>In general</header><text>The Secretary shall ensure that the independent organization described in subsection (a) does not hold a contract or subcontract to implement any aspect of the program under this subpart.</text></paragraph> 
<paragraph id="HFA6DFB86E9E146ECBC3B60C6D117366"><enum>(2)</enum><header>Subcontractors</header><text>The contract entered into under subsection (a) shall prohibit the independent organization conducting the evaluation from subcontracting with any entity that holds a contract or subcontract for any aspect of the implementation of this subpart.</text></paragraph> </subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HC58DD8896DC64575B9AAB8B66DD99D3D"><enum>6.</enum><header>National activities</header><text display-inline="no-display-inline">Section 1206 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/20/6366">20 U.S.C. 6366</external-xref>) is amended—</text> 
<paragraph id="HCCCA7BA87D5842F0AB8FAD182B362FE2"><enum>(1)</enum><text>by inserting before <quote>From funds</quote> the following:</text> 
<quoted-block id="H0980D02779CC4DA98804773875EBF6FE" style="OLC"> 
<subsection id="H9848000A71244638A4F7E05F3D6B255"><enum>(a)</enum><header>Technical assistance and evaluation</header></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HFB507EC054F14C4F9CDF2889AA9F01FC"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block style="OLC" id="H87857CE89C7744839F6781EF5F000003" display-inline="no-display-inline"> 
<subsection id="H89CE2D7DAE844D988B00D000C4B4C300"><enum>(b)</enum><header>Contracts for technical assistance</header> 
<paragraph id="H16ABBEBE3D3D4993B246C1072D6D0090"><enum>(1)</enum><header>In general</header><text>The Secretary may enter into contracts with independent entities to perform the activities described in subsection (a)(1).</text></paragraph> 
<paragraph id="HF1B25873F56C47C79878A9ACFAAACD3E"><enum>(2)</enum><header>Conflicts of interest</header> 
<subparagraph id="H1C4A43A21F2A4B48B1CF678932104923"><enum>(A)</enum><header>In general</header><text>If the Secretary enters into such contracts, the Secretary shall—</text> 
<clause id="H9CACB2776A034FB0B89757C3E1005F56"><enum>(i)</enum><text>ensure that such contracts require the contracted entity to screen for conflicts of interest when hiring individuals to carry out the responsibilities under the contract;</text></clause> 
<clause id="HA3800D7BD7A84086A094D9CE3EAE95B4"><enum>(ii)</enum><text>ensure that such contracts require the contracted entity to include the requirement in clause (i) in any subcontracts such entity enters into to fulfill the responsibilities described in paragraph (1).</text></clause></subparagraph> 
<subparagraph id="H1A4721FA84464F1FB6FDB0A33794B5AD"><enum>(B)</enum><header>Screening process</header><text>The screening process described in subparagraph (A) shall—</text> 
<clause id="HBCC3E5EE82894DE3AA69EC25B6B7238"><enum>(i)</enum><text>include, at a minimum, a review of each individual performing duties under the contract or subcontract for connections to any State’s program under this subpart, potential financial interests in, or other connection to, products that might be purchased by a State educational agency or local educational agency in the course of such agency’s implementation of the program under this subpart, and connections to teaching methodologies that might require the use of specific products; and</text></clause> 
<clause id="HF85D5C75D0EC4CCB9C96E6372B2029B8"><enum>(ii)</enum><text>be designed to prevent, to the extent possible, bias or the appearance thereof in the performance of the responsibilities outlined in the contract or subcontract.</text></clause></subparagraph></paragraph> 
<paragraph id="H9E6F643CB0CC417BBFBE2414DA957CCD"><enum>(3)</enum><header>Information dissemination</header><text>If the Secretary enters into such contracts, and if a contracted entity enters into such subcontracts, those contracts and subcontracts shall require the technical assistance providers to clearly separate technical assistance provided under such contract or subcontract from information provided, or activities engaged in, as part of the normal operations of the contractor or subcontractor. Efforts to comply with this paragraph may include, but are not limited to, the creation of separate web pages for the purpose of fulfilling a contract or subcontract entered into under this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H8634C3404F1945849E2FFF18E95400B5"><enum>7.</enum><header>Prohibition on Federal Government</header><text display-inline="no-display-inline">Subpart 1 of part B of title I of that Act is amended by adding after section 1208 (<external-xref legal-doc="usc" parsable-cite="usc/20/6368">20 U.S.C. 6368</external-xref>) the following:</text> 
<quoted-block style="OLC" id="H5FA04EF969D943478D7ECF6296ADA086" display-inline="no-display-inline"> 
<section id="H7C80F54B702542C8BE9CF506294872FE"><enum>1209.</enum><header>Prohibition on Federal Government</header> 
<subsection id="HF647574342FE479081786B63286DD3D3"><enum>(a)</enum><header>In general</header><text>Nothing in this subpart shall be construed to alter or lessen the prohibition contained in section 9527(b) of this Act or section 103(b) of the Department of Education Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/20/3403">20 U.S.C. 3403(b)</external-xref>).</text></subsection> 
<subsection id="HD6E6AF1DF2DF4307854365D0763FCFAD"><enum>(b)</enum><header>Guidance</header> 
<paragraph id="H070308B7B90F4FDA0097A01C82372B5E"><enum>(1)</enum><header>In general</header><text>The Secretary shall develop guidance for Department employees responsible for the implementation of this subpart that will assist those employees in complying with the prohibitions included in subsection (a).</text></paragraph> 
<paragraph id="HCC4A685B6A554018005274CFC44FD477"><enum>(2)</enum><header>Consultation</header><text>Such guidance shall emphasize the importance of consultation with the Office of General Counsel of the Department on issues related to such prohibitions.</text></paragraph> 
<paragraph id="HAC496DACDFEA4C7DACC3F6B1B2DEA37"><enum>(3)</enum><header>Technical assistance</header><text>Such guidance shall stress that any information disseminated, or technical assistance provided, related to this subpart, shall represent multiple perspectives and not in any way endorse or appear to endorse any particular product or service that might be purchased by a State educational agency or local educational agency in the course of such agency’s implementation of the program under this subpart.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
