		<official-title>To amend the Internal Revenue Code of 1986 to expand, and
		  extend for 10 years, the American Samoa economic development
		  credit.</official-title>

		<section id="H4CA7D046D7BD49C49BB5A414C200D8E5" section-type="section-one"><enum>1.</enum><header>Expansion and extension of
			 American Samoa economic development credit</header>
			<subsection id="H3D6E4B17C4334E028926D702006060A7"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subpart B of part IV
			 of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by
			 adding at the end the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="H6D5E53CED950424F9C001100EFF40036" style="OLC">
					<section id="HAFAAB9A996174F739BFA08B7CF7F98C6"><enum>30D.</enum><header>American Samoa
				economic development credit</header>
						<subsection id="H524A6D455616415FA5B0C7ED1F763BEF"><enum>(a)</enum><header>Allowance of
				credit</header><text display-inline="yes-display-inline">In the case of a
				qualified domestic corporation, there shall be allowed as a credit against the
				tax imposed by this chapter an amount equal to the portion of the tax which is
				attributable to the taxable income, from sources without the United States,
				from—</text>
							<paragraph id="H3F8F2738B79B482CAE8FB03B2BA982B3"><enum>(1)</enum><text display-inline="yes-display-inline">the active conduct of a trade or business
				within American Samoa, or</text>
							</paragraph><paragraph id="HC5F13CCE03CA4CAB813F793BBF8E97FF"><enum>(2)</enum><text>the sale or
				exchange of substantially all of the assets used by the taxpayer in the active
				conduct of such trade or business.</text>
							</paragraph></subsection><subsection id="HE98B656AA06E43868E2EABB080683600"><enum>(b)</enum><header>Limitation</header><text display-inline="yes-display-inline">The amount of the credit determined under
				subsection (a) for any taxable year shall not exceed the sum of the following
				amounts (determined by treating American Samoa as the only possession of the
				United States):</text>
							<paragraph id="H055350EDEC914AE3931C153C09D5403C"><enum>(1)</enum><text display-inline="yes-display-inline">60 percent of the sum of—</text>
								<subparagraph id="H2B12474DC0BA494E897BA60088D61271"><enum>(A)</enum><text>the aggregate
				amount of the qualified domestic corporation's qualified possession wages for
				such taxable year, plus</text>
								</subparagraph><subparagraph id="H0525D64589124C4D9597CFF151503362"><enum>(B)</enum><text display-inline="yes-display-inline">the allocable employee fringe benefit
				expenses of the qualified domestic corporation for such taxable year.</text>
								</subparagraph></paragraph><paragraph id="HDFC01522939A40CE9675571B8EFF786C"><enum>(2)</enum><text>The sum of—</text>
								<subparagraph id="H870E5CE4E8DB490D9C40A228FCE54995"><enum>(A)</enum><text>15 percent of the
				depreciation allowances for the taxable year with respect to short-life
				qualified tangible property,</text>
								</subparagraph><subparagraph id="H087CC6AF57AD414398BB00E3C03E46BC"><enum>(B)</enum><text>40 percent of the
				depreciation allowances for the taxable year with respect to medium-life
				qualified tangible property, and</text>
								</subparagraph><subparagraph id="H4B06AD9E6453455898A8FCE2B6BEC478"><enum>(C)</enum><text>65 percent of the
				depreciation allowances for the taxable year with respect to long-life
				qualified tangible property.</text>
								</subparagraph></paragraph></subsection><subsection id="H435C85F22CEE43AEB64E9B79914CE441"><enum>(c)</enum><header>Qualified
				domestic corporation</header><text display-inline="yes-display-inline">For
				purposes of this section, the term <term>qualified domestic corporation</term>
				means any domestic corporation which meets the conditions of both paragraphs
				(1) and (2) of section 30A(b).</text>
						</subsection><subsection id="HA091A24AED2A4659AE777D840939C545"><enum>(d)</enum><header>Credit not
				allowed against certain taxes</header><text display-inline="yes-display-inline">The credit provided by subsection (a) shall
				not be allowed against any tax referred to in a paragraph of section
				30A(c).</text>
						</subsection><subsection id="HA0F60566533F41A7A995B49F59FDBA9F"><enum>(e)</enum><header>Treatment of
				certain foreign taxes</header><text display-inline="yes-display-inline">For
				purposes of this title, any tax of a foreign country or a possession of the
				United States which is paid or accrued with respect to taxable income which is
				taken into account in computing the credit under subsection (a) shall not be
				treated as income, war profits, or excess profits taxes paid or accrued to a
				foreign country or possession of the United States, and no deduction shall be
				allowed under this title with respect to any amounts so paid or accrued.</text>
						</subsection><subsection id="HF6EDB459E27D4ABA95DFA2A6A251BFBA"><enum>(f)</enum><header>Administrative
				provisions</header><text>For purposes of this title—</text>
							<paragraph id="HA8EEC468DA4B4568AE89F40064A44F10"><enum>(1)</enum><text display-inline="yes-display-inline">the credit under this section shall be
				treated in the same manner as the credit under section 936, and</text>
							</paragraph><paragraph id="H50F6545C8E7742DD904C8E918EB61BE5"><enum>(2)</enum><text display-inline="yes-display-inline">a corporation to which this section applies
				shall be treated in the same manner as if it were a corporation electing the
				application of section 936.</text>
							</paragraph></subsection><subsection id="H4EC11CB90F684B329FA5CD5F46289438"><enum>(g)</enum><header>Denial of double
				benefit</header><text display-inline="yes-display-inline">Any wages or other
				expenses taken into account in determining the credit under this section may
				not be taken into account in determining the credit under section 41.</text>
						</subsection><subsection id="H3B7C973D76184F0D9061CE228B9432B5"><enum>(h)</enum><header>Application of
				section</header><text display-inline="yes-display-inline">This section shall
				apply to taxable years beginning after December 31, 2007, and before January 1,
				2018.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HA4B1395870EF4B3DA7637B8737C6C7F9"><enum>(b)</enum><header>Conforming
			 amendments</header>
				<paragraph id="H8DA77FFEB59949EE91505BA52917009C"><enum>(1)</enum><text>Paragraph (1) of
			 section 55(c) of such Code is amended by striking <quote>and the Puerto Rico
			 economic activity credit under section 30A</quote> and inserting <quote>the
			 Puerto Rico economic activity credit under section 30A, and the American Samoa
			 economic development credit under section 30D</quote>.</text>
				</paragraph><paragraph id="H20DB1086D086480DB242917852E53B41"><enum>(2)</enum><text>Subclause (I) of
			 section 56(g)(4)(C)(ii) of such Code is amended by inserting
			 <quote>30D,</quote> after <quote>30A,</quote>.</text>
				</paragraph><paragraph id="H100714FA30284F27A927B4011CBDA439"><enum>(3)</enum><text>Subclause (VI) of
			 section 56(g)(4)(C)(iii) of such Code is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H65B7DAA81D2649AFB1BCE25B69D56D74" style="OLC">
						<subclause id="H90AAC855CE094E3399A2D9FF54E6A492"><enum>(VI)</enum><header>Application to
				sections 30A and 30D corporations</header><text display-inline="yes-display-inline">References in this clause to section 936
				shall be treated as including references to sections 30A and
				30D.</text>
						</subclause><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H60B40991F0D147F4B01253F6853B0F7"><enum>(4)</enum><text>Subsection (b) of
			 section 59 of such Code is amended by inserting <quote>, 30D, </quote> after
			 <quote>30A</quote> each place it appears, including the heading.</text>
				</paragraph><paragraph id="H0480E692802648928D67D4AEA06840ED"><enum>(5)</enum><text>The table of
			 sections for subpart B of part IV of subchapter A of chapter 1 of such Code is
			 amended by adding at the end the following new item:</text>
					<toc regeneration="no-regeneration">
						<toc-entry level="section"><quote>Sec. 30D. American Samoa economic
				development credit.</quote>.</toc-entry>
					</toc>
				</paragraph></subsection><subsection id="HCF4CA61C948E4F41ABC5B2D38DA07300"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to taxable
			 years beginning after December 31, 2007.</text>
