<official-title display="yes">To authorize the acquisition of land and interests in land from willing sellers to improve the conservation of, and to enhance the ecological values and functions of, coastal and estuarine areas to benefit both the environment and the economies of coastal communities, and for other purposes.</official-title>

<section id="H059FDF55EC804593B663AE295800D249" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Coastal and Estuarine Land Conservation Program Act</short-title></quote>.</text></section> 
<section id="H4C8706F8DC6244B7829574DEF42DBC00"><enum>2.</enum><header>Authorization of Coastal and Estuarine Land Conservation Program</header><text display-inline="no-display-inline">The Coastal Zone Management Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1451">16 U.S.C. 1451 et seq.</external-xref>) is amended by inserting after section 307 the following new section:</text>

<section id="H7114AF306B4B4F1797E86C6D26F96C5D"><enum>307A.</enum><header>Authorization of the Coastal and Estuarine Land Conservation Program</header> 
<subsection id="HD2EED835EE424E1AAEC7E33180A7E084" display-inline="yes-display-inline"><enum>(a)</enum><header>In general</header><text>The Secretary may conduct a Coastal and Estuarine Land Conservation Program, in cooperation with appropriate State, regional, and other units of government, for the purposes of protecting important coastal and estuarine areas that have significant conservation, recreation, ecological, historical, or aesthetic values, or that are threatened by conversion from their natural, undeveloped, or recreational state to other uses or could be managed or restored to effectively conserve, enhance, or restore ecological function. The program shall be administered by the National Ocean Service of the National Oceanic and Atmospheric Administration through the Office of Ocean and Coastal Resource Management.</text></subsection> 
<subsection id="H528046C3F6C242C28DD0A22E0C0DBD8"><enum>(b)</enum><header>Property acquisition grants</header><text>The Secretary shall make grants under the program to coastal states with approved coastal zone management plans or National Estuarine Research Reserve units for the purpose of acquiring property or interests in property described in subsection (a) that will further the goals of—</text> 
<paragraph id="H5E13F5D96EB74CEFA3F6CE72D900871D"><enum>(1)</enum><text>a Coastal Zone Management Plan or Program approved under this title;</text></paragraph> 
<paragraph id="HEB73D0473391436CAD89F5785683DC85"><enum>(2)</enum><text>a National Estuarine Research Reserve management plan; </text></paragraph> 
<paragraph id="HB86A10144DD84E6C8E836580CF4D12A7"><enum>(3)</enum><text>a regional or State watershed protection or management plan involving coastal states with approved coastal zone management programs; or</text></paragraph> 
<paragraph id="H131FB80A48EB4F3798D199C408800A9"><enum>(4)</enum><text>a State coastal land acquisition plan that is consistent with an approved coastal zone management program.</text></paragraph></subsection> 
<subsection id="H0FC8029518BC41F0A1DA36B213BCE5E"><enum>(c)</enum><header>Grant process</header><text>The Secretary shall allocate funds to coastal states or National Estuarine Research Reserves under this section through a competitive grant process in accordance with guidelines that meet the following requirements:</text> 
<paragraph id="H46B673A5BAD64CBAB300C4605925D3E4"><enum>(1)</enum><text>The Secretary shall consult with the coastal state’s coastal zone management program, any National Estuarine Research Reserve in that State, and the lead agency designated by the Governor for coordinating the implementation of this section (if different from the coastal zone management program).</text></paragraph> 
<paragraph id="H74A3022FE78F40929D50371304802732"><enum>(2)</enum><text>Each participating coastal state, after consultation with local governmental entities and other interested stakeholders, shall identify priority conservation needs within the State, the values to be protected by inclusion of lands in the program, and the threats to those values that should be avoided.</text></paragraph> 
<paragraph id="H3DD9E5091BB6404F92F744A143EB2B8"><enum>(3)</enum><text>Each participating coastal state shall to the extent practicable ensure that the acquisition of property or easements shall complement working waterfront needs.</text></paragraph> 
<paragraph id="HAC75117B14B44D7BA801003DDABEC579"><enum>(4)</enum><text>The applicant shall identify the values to be protected by inclusion of the lands in the program, management activities that are planned and the manner in which they may affect the values identified, and any other information from the landowner relevant to administration and management of the land.</text></paragraph> 
<paragraph id="HC8070E4F8D1F4835BA186EC56359A0AA"><enum>(5)</enum><text>Awards shall be based on demonstrated need for protection and ability to successfully leverage funds among participating entities, including Federal programs, regional organizations, State and other governmental units, landowners, corporations, or private organizations.</text></paragraph> 
<paragraph id="H1CA2A60242184EE0A39B36DA8B665CFB"><enum>(6)</enum><text>The governor, or the lead agency designated by the governor for coordinating the implementation of this section, where appropriate in consultation with the appropriate local government, shall determine that the application is consistent with the State’s or territory’s approved coastal zone plan, program, and policies prior to submittal to the Secretary.</text></paragraph> 
<paragraph id="H8832450A44A34DDF82BE745C4607B1E9"><enum>(7)</enum> 
<subparagraph id="HE10334BDA1134D1DAAAB25FAF8B739D3" display-inline="yes-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">Priority shall be given to lands described in subsection (a) that can be effectively managed and protected and that have significant ecological value.</text></subparagraph> 
<subparagraph id="H86F35FE948774489B54E931000B3B8CE" indent="up1"><enum>(B)</enum><text>Of the projects that meet the standard in subparagraph (A), priority shall be given to lands that—</text> 
<clause id="H9AE5D7771E0B4E7AB1E601B9100E8F7"><enum>(i)</enum><text>are under an imminent threat of conversion to a use that will degrade or otherwise diminish their natural, undeveloped, or recreational state; and</text></clause> 
<clause id="H135A745718AA43C18CD6F6C4F6280037"><enum>(ii)</enum><text>serve to mitigate the adverse impacts caused by coastal population growth in the coastal environment.</text></clause></subparagraph></paragraph> 
<paragraph id="H815D565657514D3CAD14005F8EA19B7"><enum>(8)</enum><text>In developing guidelines under this section, the Secretary shall consult with coastal states, other Federal agencies, and other interested stakeholders with expertise in land acquisition and conservation procedures.</text></paragraph> 
<paragraph id="H39046122CBBD4658B28B6544A3CCBAFE"><enum>(9)</enum><text>Eligible coastal states or National Estuarine Research Reserves may allocate grants to local governments or agencies eligible for assistance under section 306A(e).</text></paragraph> 
<paragraph id="H3DA494D6E36346E4A43E42043F3700BA"><enum>(10)</enum><text>The Secretary shall develop performance measures that the Secretary shall use to evaluate and report on the program’s effectiveness in accomplishing its purposes, and shall submit such evaluations to Congress triennially.</text></paragraph></subsection> 
<subsection id="H7BEC092878DA4A3CAAEF863BEA20868D"><enum>(d)</enum><header>Limitations and private property protections</header><text display-inline="yes-display-inline"></text> 
<paragraph id="H9BB0EA1C885E4C0780EEC7F9DE53BF71"><enum>(1)</enum><text>A grant awarded under this section may be used to purchase land or an interest in land, including an easement, only from a willing seller. Any such purchase shall not be the result of a forced taking under this section. Nothing in this section requires a private property owner to participate in the program under this section.</text></paragraph> 
<paragraph id="HC43F3C6773BD446AAE2988938F7059CA"><enum>(2)</enum><text>Any interest in land, including any easement, acquired with a grant under this section shall not be considered to create any new liability, or have any effect on liability under any other law, of any private property owner with respect to any person injured on the private property.</text></paragraph> 
<paragraph id="H1C933313688C44C79D07B4EEE6319085"><enum>(3)</enum><text>Nothing in this section requires a private property owner to provide access (including Federal, State, or local government access) to or use of private property unless such property or an interest in such property (including a conservation easement) has been purchased with funds made available under this section.</text> </paragraph></subsection> 
<subsection id="HBEEFDAB0508D4750A24BE3E55FD0B506"><enum>(e)</enum><header>Recognition of authority to control land use</header><text display-inline="yes-display-inline">Nothing in this title modifies the authority of Federal, State, or local governments to regulate land use.</text></subsection> 
<subsection id="H96218FB1FDD64C11BA45EE214C24B4D3"><enum>(f)</enum><header>Matching requirements</header> 
<paragraph id="HE633BB1D014748C2AFD5F5EB9CFB6768"><enum>(1)</enum><header>In general</header><text>The Secretary may not make a grant under the program unless the Federal funds are matched by non-Federal funds in accordance with this subsection.</text></paragraph> 
<paragraph id="H971C8E7772D84E12BBF8BBE0091B3E3"><enum>(2)</enum><header>Cost share requirement</header> 
<subparagraph id="HC95263AC7D4D4366A2307017D0E6065B"><enum>(A)</enum><header>In general</header><text>Grant funds under the program shall require a 100 percent match from other non-Federal sources.</text></subparagraph> 
<subparagraph id="HBB24738FA7F8481F00A58D7B8C2F490"><enum>(B)</enum><header>Waiver of requirement</header><text>The Secretary may grant a waiver of subparagraph (A) for underserved communities, communities that have an inability to draw on other sources of funding because of the small population or low income of the community, or for other reasons the Secretary deems appropriate and consistent with the purposes of the program.</text></subparagraph></paragraph> 
<paragraph id="HFE6A7EAC8BF547698609B813C893ED00"><enum>(3)</enum><header>Other Federal funds</header><text>Where financial assistance awarded under this section represents only a portion of the total cost of a project, funding from other Federal sources may be applied to the cost of the project. Each portion shall be subject to match requirements under the applicable provision of law.</text></paragraph> 
<paragraph id="H737BE349C55F44E793AB7D63D731694B"><enum>(4)</enum><header>Source of matching cost share</header><text>For purposes of paragraph (2)(A), the non-Federal cost share for a project may be determined by taking into account the following:</text> 
<subparagraph id="HA8BF5AF7F4BF416FBAB5535D7B92F52D"><enum>(A)</enum><text>The value of land or a conservation easement may be used by a project applicant as non-Federal match, if the Secretary determines that—</text> 
<clause id="H1E413A27187C4A359BA144F886C92D5"><enum>(i)</enum><text display-inline="yes-display-inline">the land meets the criteria set forth in section 2(b) and is acquired in the period beginning 3 years before the date of the submission of the grant application and ending 3 years after the date of the award of the grant;</text></clause> 
<clause id="H1B2A1A70EE154F2FBCBF00A875F4E6EC"><enum>(ii)</enum><text> the value of the land or easement is held by a non-governmental organization included in the grant application in perpetuity for conservation purposes of the program; and</text></clause> 
<clause id="H7A3CED5E36FA41A98EA3E477346D0626"><enum>(iii)</enum><text>the land or easement is connected either physically or through a conservation planning process to the land or easement that would be acquired.</text></clause></subparagraph> 
<subparagraph id="H3446CCEF3CEE427DAFA9A6A98E6292C"><enum>(B)</enum><text display-inline="yes-display-inline">The appraised value of the land or conservation easement at the time of the grant closing will be considered and applied as the non-Federal cost share.</text></subparagraph> 
<subparagraph id="H33DA47EB87604B648E27F39115EF47CA"><enum>(C)</enum><text>Costs associated with land acquisition, land management planning, remediation, restoration, and enhancement may be used as non- Federal match if the activities are identified in the plan and expenses are incurred within the period of the grant award, or, for lands described in (A), within the same time limits described therein. These costs may include either cash or in-kind contributions.</text></subparagraph></paragraph></subsection> 
<subsection id="H5469DDDBADA443A8A0E4A1CB010871A"><enum>(g)</enum><header>Reservation of funds for national estuarine research reserve sites</header><text>No less than 15 percent of funds made available under this section shall be available for acquisitions benefitting National Estuarine Research Reserves.</text></subsection> 
<subsection id="H2E4B10D571484794808CF1C903DFB697"><enum>(h)</enum><header>Limit on administrative costs</header><text>No more than 5 percent of the funds made available to the Secretary under this section shall be used by the Secretary for planning or administration of the program. The Secretary shall provide a report to Congress with an account of all expenditures under this section for fiscal year 2009 and triennially thereafter.</text></subsection> 
<subsection id="HDFFF0A198503402B93FC23748574001B"><enum>(i)</enum><header>Title and management of acquired property</header><text>If any property is acquired in whole or in part with funds made available through a grant under this section, the grant recipient shall provide—</text> 
<paragraph id="HBAD8091096E4420194343E01DD002890"><enum>(1)</enum><text>such assurances as the Secretary may require that—</text> 
<subparagraph id="HC8C367F481514AF0BF44D694DDC124D"><enum>(A)</enum><text>the title to the property will be held by the grant recipient or another appropriate public agency designated by the recipient in perpetuity;</text></subparagraph> 
<subparagraph id="HB7BB1CC929FF4A5BAD4D11AE388700E6"><enum>(B)</enum><text>the property will be managed in a manner that is consistent with the purposes for which the land entered into the program and shall not convert such property to other uses; and</text></subparagraph> 
<subparagraph id="H86F9F999611A422AB57101007FF42C13"><enum>(C)</enum><text>if the property or interest in land is sold, exchanged, or divested, funds equal to the current value will be returned to the Secretary in accordance with applicable Federal law for redistribution in the grant process; and</text></subparagraph></paragraph> 
<paragraph id="H7A8C1111255B4C83A66F4BC5C4D7833"><enum>(2)</enum><text>certification that the property (including any interest in land) will be acquired from a willing seller.</text></paragraph></subsection> 
<subsection id="HAB7A70C385EC4D21B300780931FCFEA2"><enum>(j)</enum><header>Requirement for property used for non-Federal match</header><text>If the grant recipient elects to use any land or interest in land held by a non-governmental organization as a non-Federal match under subsection (g), the grant recipient must to the Secretary’s satisfaction demonstrate in the grant application that such land or interest will satisfy the same requirements as the lands or interests in lands acquired under the program.</text></subsection> 
<subsection id="H3E9B71349EF7401B9FC7B93F83C9CD9C"><enum>(k)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H4374460B3A044128009BB323BABD2C4B"><enum>(1)</enum><header>Conservation easement</header><text>The term <quote>conservation easement</quote> includes an easement or restriction, recorded deed, or a reserve interest deed where the grantee acquires all rights, title, and interest in a property, that do not conflict with the goals of this section except those rights, title, and interests that may run with the land that are expressly reserved by a grantor and are agreed to at the time of purchase.</text></paragraph> 
<paragraph id="H614288C0F690420BA305DE65BBAAFE49"><enum>(2)</enum><header>Interest in property</header><text>The term <quote>interest in property</quote> includes a conservation easement.</text></paragraph></subsection> 
<subsection id="H2F3D28C4DEE8489EA866FE91689DF002"><enum>(l)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Secretary to carry out this section $60,000,000 for each of fiscal years 2009 through 2013.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
