<section id="HC5E6FB3E7644461099FB789BC8D80054" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>New Mexico Water Planning Assistance Act</short-title></quote>.</text></section>
<section id="HDED0898FE2D3496FBB00212EDB6159A7"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
<paragraph id="H41D84F9675264054AB1ECF9DE0CC327D"><enum>(1)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior, acting through the Bureau of Reclamation and the United States Geological Survey.</text></paragraph>
<paragraph id="HE8B2580CC9BA4E92B3D3A3D32D75D072"><enum>(2)</enum><header>State</header><text>The term <term>State</term> means the State of New Mexico.</text></paragraph></section>
<section id="H18D0012B01B543E79CF2520663CFF1BB"><enum>3.</enum><header>Comprehensive water plan assistance</header>
<subsection id="HD8A2AA07053A4404BEE8D00034D252C"><enum>(a)</enum><header>In general</header><text>Upon the request of the Governor of the State and subject to subsections (b) through (f), the Secretary shall—</text>
<paragraph id="H7824D3F50B3A45B4867D79325B83E29C"><enum>(1)</enum><text>provide to the State technical assistance and grants for the development of comprehensive State water plans;</text></paragraph>
<paragraph id="H4AA1863A68804502AAFFDBC751DF009F"><enum>(2)</enum><text>conduct water resources mapping in the State; and</text></paragraph>
<paragraph id="HABC4249004D44D88AFF8115794131D5B"><enum>(3)</enum><text>conduct a comprehensive study of groundwater resources (including potable, brackish, and saline water resources) in the State to assess the quantity, quality, and interaction of groundwater and surface water resources.</text></paragraph></subsection>
<subsection id="H637219F7B7FF4B6DACA3B957A9769563"><enum>(b)</enum><header>Technical assistance</header><text>Technical assistance provided under subsection (a) may include—</text>
<paragraph id="HA61E4DC270D44A20B832B610E513C3A"><enum>(1)</enum><text>acquisition of hydrologic data, groundwater characterization, database development, and data distribution;</text></paragraph>
<paragraph id="HAD6A122F542D463A8C5897C509C70095"><enum>(2)</enum><text>expansion of climate, surface water, and groundwater monitoring networks;</text></paragraph>
<paragraph id="HCCF7E276A39F46F3BD38505326F239B9"><enum>(3)</enum><text>assessment of existing water resources, surface water storage, and groundwater storage potential;</text></paragraph>
<paragraph id="HD5106037CA414371B4C79290CB782461"><enum>(4)</enum><text>numerical analysis and modeling necessary to provide an integrated understanding of water resources and water management options;</text></paragraph>
<paragraph id="HDD8DE6D6AF844383B649FDC037DFB55E"><enum>(5)</enum><text>participation in State planning forums and planning groups;</text></paragraph>
<paragraph id="H795B8D4E2B0046AAAA757309AF777114"><enum>(6)</enum><text>coordination of Federal water management planning efforts;</text></paragraph>
<paragraph id="H34CA1DEDB8F9458D83944F6FBF6DC63C"><enum>(7)</enum><text>technical review of data, models, planning scenarios, and water plans developed by the State; and</text></paragraph>
<paragraph id="H47F376152F4347AF94241CA9AC8B6C00"><enum>(8)</enum><text>provision of scientific and technical specialists to support State and local activities.</text></paragraph></subsection>
<subsection id="H265DED2E1BCF416EA0C04BBB4B52798D"><enum>(c)</enum><header>Allocation</header><text>In providing grants under subsection (a), the Secretary shall, subject to the availability of appropriations, allocate—</text>
<paragraph id="HE14578D482A14B6E8C0000D052A3CC6F"><enum>(1)</enum><text>$5,000,000 to develop hydrologic models and acquire associated equipment for the New Mexico Rio Grande main stem sections and Rios Pueblo de Taos and Hondo, Rios Nambe, Pojoaque and Teseque, Rio Chama, and Lower Rio Grande tributaries;</text></paragraph>
<paragraph id="HA806FCC5E91C4053B3DEE789E5E381A5"><enum>(2)</enum><text>$1,500,000 to complete the hydrographic survey development of hydrologic models and acquire associated equipment for the San Juan River and tributaries;</text></paragraph>
<paragraph id="H01AF1C0FF9F7457BA27E00A082157E52"><enum>(3)</enum><text>$1,000,000 to complete the hydrographic survey development of hydrologic models and acquire associated equipment for Southwest New Mexico, including the Animas Basin, the Gila River, and tributaries;</text></paragraph>
<paragraph id="HD5F2417A93134B6CB74C15D81B193041"><enum>(4)</enum><text>$4,500,000 for statewide digital orthophotography mapping; and</text></paragraph>
<paragraph id="H7F9A1EB3BC614088BCC599F08820BF00"><enum>(5)</enum><text>such sums as are necessary to carry out additional projects consistent with subsection (b).</text></paragraph></subsection>
<subsection id="H6E469F4DC9FF49FFB2387836927DD430"><enum>(d)</enum><header>Cost-sharing requirement</header>
<paragraph id="H0210FBD282DC4EC2999C808200D14DE"><enum>(1)</enum><header>In general</header><text>The non-Federal share of the total cost of any activity carried out using a grant provided under subsection (a) shall be 50 percent.</text></paragraph>
<paragraph id="H35F04F7E1E33451F00202E678200D5F"><enum>(2)</enum><header>Form of non-federal share</header><text>The non-Federal share under paragraph (1) may be in the form of any in-kind services that the Secretary determines would contribute substantially toward the conduct and completion of the activity assisted.</text></paragraph></subsection>
<subsection id="H39F38680D63A4AD1842C12D5500060C1"><enum>(e)</enum><header>Nonreimbursable basis</header><text>Any assistance or grants provided to the State under this Act shall be made on a non-reimbursable basis.</text></subsection>
<subsection id="H7039E80DC3134723A5201CFF8E4947AB"><enum>(f)</enum><header>Authorized transfers</header><text>On request of the State, the Secretary shall directly transfer to 1 or more Federal agencies any amounts made available to the State to carry out this Act.</text></subsection></section>
<section id="HA9B9604F5C3748B08D08C3A298429451"><enum>4.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated to carry out this Act $3,000,000 for each of fiscal years 2008 through 2012.</text></section>
<section id="HDD6DE07A2E5242DAA0F5F09DE34B87BC"><enum>5.</enum><header>Sunset of authority</header><text display-inline="no-display-inline">The authority of the Secretary to carry out any provisions of this Act shall terminate 10 years after the date of the enactment of this Act.</text></section>
