<official-title>To require prisons and other correctional facilities holding Federal prisoners under a contract with the Federal Government to make the same information available to the public that Federal prisons and correctional facilities are required to do by law.</official-title>

<section id="H74709E4DF450427AAC038FA0286EC28" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Private Prison Information Act of 2007</short-title></quote>.</text> </section> 
<section id="H084A2AC184174C138F7CCA40004D2E0"><enum>2.</enum><header>Freedom of information requirement for contract prisons</header> 
<subsection id="HFC58F6DDEB9A4054B982E499CEB74C6E"><enum>(a)</enum><header>In General</header><text>Each nongovernmental entity contracting with the Federal Government to incarcerate or detain Federal prisoners in a privately owned prison or other correctional facility shall have the same duty to release information about the operation of that prison or correctional facility as a Federal agency operating such a facility would have under the Freedom of Information Act (<external-xref legal-doc="usc" parsable-cite="usc/5/552">5 U.S.C. 552</external-xref>).</text></subsection> 
<subsection id="HD765019033AE4D0282C9B642BE1D084D"><enum>(b)</enum><header>Regulations</header><text>A Federal agency that contracts with a nongovernmental entity to incarcerate or detain Federal prisoners in a privately owned prison or other correctional facility shall promulgate regulations or guidance to ensure compliance by the nongovernmental entity with the terms of such contract.</text></subsection> 
<subsection id="H9B1D9F20744B483B92DF50003BD1978F"><enum>(c)</enum><header>Civil Action</header><text>Any party aggrieved by a violation of the duty established in <internal-xref idref="HFC58F6DDEB9A4054B982E499CEB74C6E" legis-path="2.(a)">subsection (a)</internal-xref> may, in a civil action, obtain appropriate relief against the nongovernmental entity operating the facility or against any other proper party.</text></subsection> 
<subsection id="H771332375A904D9AB901EDE3C8056E6"><enum>(d)</enum><header>Definition</header><text>In this section, the term <term>privately owned prison or other correctional facility</term> includes privately owned prisons or other correctional facilities that incarcerate or detain prisoners pursuant to a contract with—</text> 
<paragraph id="HA8CC85CE44C448D50019004644095030"><enum>(1)</enum><text>the Federal Bureau of Prisons;</text></paragraph> 
<paragraph id="H989E8EB9BC714A9F9ECFB857DF403526"><enum>(2)</enum><text>Immigration and Customs Enforcement; or</text></paragraph> 
<paragraph id="H4C2E3828E2DB482F97198907001DA5B3"><enum>(3)</enum><text>any other Federal agency.</text></paragraph></subsection></section>
