		<official-title>To amend title 31, United States Code, to prohibit
		  delinquent Federal debtors from being eligible to enter into Federal contracts,
		  and for other purposes.</official-title>

		<section display-inline="no-display-inline" id="H3EEFD50018CD4B88A948ECE705EE2862" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Contractor Tax Enforcement
			 Act</short-title></quote>.</text>
		</section><section id="H957E1FD83FF749758165B5C2A3B9228E"><enum>2.</enum><header>Amendments to
			 provision regarding delinquent Federal debtors</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/31/3720B">Section 3720B</external-xref> of title 31, United States
			 Code, is amended—</text>
			<paragraph id="HDD457D324D2742E1B40500594C27A236"><enum>(1)</enum><text>in the section
			 heading, by adding at the end <quote><header-in-text level="section">or
			 contracts</header-in-text></quote>;</text>
			</paragraph><paragraph id="HB2359B46F45C4A1EA5B6F4E47E1F1713"><enum>(2)</enum><text>in subsection
			 (a)—</text>
				<subparagraph id="H7E4C4DD5C8454CA58078DEF44CECA698"><enum>(A)</enum><text>by inserting
			 <quote>or be eligible to enter into a Federal contract with the agency</quote>
			 after <quote>administered by the agency</quote>;</text>
				</subparagraph><subparagraph id="HDF6237B420FD48D000BA5E3FD83077D"><enum>(B)</enum><text>by inserting
			 <quote>, including</quote> after <quote>debt</quote> the first place such term
			 appears;</text>
				</subparagraph><subparagraph id="H66B0C1FD8CF64E708B252EBBDE137DD0"><enum>(C)</enum><text>by striking
			 <quote>(other than</quote> the second place such words appear;</text>
				</subparagraph><subparagraph id="H739891D9BBD249B4BD317CC6F97002ED"><enum>(D)</enum><text>by striking the
			 closing parenthesis after <quote>1986</quote>; and</text>
				</subparagraph><subparagraph id="HD3A5BAD347684F7B8BA600B12E62D91C"><enum>(E)</enum><text>by inserting
			 <quote>and be eligible to enter into Federal contracts</quote> after
			 <quote>loan guarantees</quote>; and</text>
				</subparagraph></paragraph><paragraph id="H135971A7A5974A6181B7B97304526C2E"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block id="H95FF3C1878E74D0F8CB6CABF2F00B89E" style="OLC">
					<subsection id="H3EB05E6643C243E2976EB113EFAB5569"><enum>(c)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H6D880284BDFA4ECFB238AF3E29406223"><enum>(1)</enum><text>The head of any Federal
				agency that administers a Federal loan or loan guarantee program or that issues
				a request for proposals for a Federal contract shall require each applicant for
				a Federal loan or loan guarantee and each entity that submits a proposal to
				enter into a contract with the agency to submit with the loan or loan guarantee
				application or the contract proposal a form authorizing the Secretary of the
				Treasury to disclose to the head of the agency information limited to
				describing whether the applicant or prospective contractor has an outstanding
				debt under the Internal Revenue Code of 1986 in delinquent status (as defined
				in this section).</text>
						</paragraph><paragraph id="H698B0326A4394F9ABEF04B88F2808E78" indent="up1"><enum>(2)</enum><text>Not later than 30 days after the date
				of the enactment of this subsection, the Secretary shall develop and make
				available to all Federal agencies a standard form, the purpose which shall be
				to authorize the disclosure described in paragraph (1).</text>
						</paragraph></subsection><subsection id="H93EAD22C11E548B7AA78829484A2D349"><enum>(d)</enum><text>For purposes of
				this section:</text>
						<paragraph id="HE7707362DB9A40F389C6F05CEB8A86"><enum>(1)</enum><text>The term
				<term>contract</term> means a binding agreement entered into by a Federal
				agency for the purpose of obtaining supplies, materials, equipment, or
				services, but does not include—</text>
							<subparagraph id="H68A2DC09B17A4B20B4E3008D674CCE80"><enum>(A)</enum><text>a contract to
				assist the agency in the performance of disaster relief authorities, as
				designated in standards prescribed by the Secretary of the Treasury; or</text>
							</subparagraph><subparagraph id="H957A7CD2AF6348C3BE50222ED9C45401"><enum>(B)</enum><text>a contract
				designated by the head of the agency as necessary to the national security of
				the United States.</text>
							</subparagraph></paragraph><paragraph id="H352B65F3CAB549829D00025F28CD160"><enum>(2)</enum><text>The term
				<term>person</term> includes—</text>
							<subparagraph id="H4E18B0D908634BE9AD8626F8D6C1002"><enum>(A)</enum><text>any partnership
				with a partner who has been assessed a penalty under section 6672 of the
				Internal Revenue Code of 1986 with respect to a debt which is in delinquent
				status as described in paragraph (3); and</text>
							</subparagraph><subparagraph id="H489F309F20F844BD87FF62E18319C2E7"><enum>(B)</enum><text>any corporation
				with an officer or a shareholder who holds 25 percent or more of the
				outstanding shares of corporate stock in that corporation who has been assessed
				a penalty under <external-xref legal-doc="usc" parsable-cite="usc/26/6672">section 6672</external-xref> of the Internal Revenue Code of 1986 with respect
				to a debt that is in delinquent status as described in paragraph (3).</text>
							</subparagraph></paragraph><paragraph id="HBDB67CB33CE64DC090375696E156C669"><enum>(3)</enum><text>A debt under the
				Internal Revenue Code of 1986 shall be considered to be in delinquent status if
				it has not been paid within 180 days of an assessment of a tax, penalty, or
				interest under the Internal Revenue Code of 1986. Such a debt does not include
				a debt that is being paid in a timely manner pursuant to an agreement under
				section 6159 or section 7122 of the Internal Revenue Code of
				1986.</text>
