<section id="H442B850055934142809C00082086DE4F" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Livestock Assistance Act of 2007</short-title></quote>.</text></section> 
<section id="HDAD4A0B53001463C87C3A51500E7020"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="HC399F5E26F704EFD8D8B11A700B849BB"><enum>(1)</enum><header>Disaster county</header> 
<subparagraph id="H187C417CE0D54B509F749D5CD1899681"><enum>(A)</enum><header>In general</header><text>The term <term>disaster county</term> means a county included in the geographic area covered by a qualifying natural disaster declaration for calendar year 2006 or 2007, or both, for which the request for the declaration was submitted during the period beginning on January 1, 2006, and ending on the date of enactment of this Act.</text></subparagraph> 
<subparagraph id="H70231548307E43C1921FFAE0AC21487C"><enum>(B)</enum><header>Inclusion</header><text>The term <term>disaster county</term> includes a county contiguous to a county described in subparagraph (A).</text></subparagraph></paragraph> 
<paragraph id="H97B4D40B4BB1483DBB713DE230443D4E"><enum>(2)</enum><header>Qualifying natural disaster declaration</header><text>The term <term>qualifying natural disaster declaration</term> means—</text> 
<subparagraph id="HA79B1B3B60E846FDA77BEAF93D9FEEA4"><enum>(A)</enum><text>a natural disaster declared by the Secretary under section 321(a) of the <act-name parsable-cite="CFRDA">Consolidated Farm and Rural Development Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/7/1961">7 U.S.C. 1961(a)</external-xref>); or</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H99D2366373AA419A855445ED0036004D"><enum>(B)</enum><text>a major disaster or emergency designated by the President under the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>).</text></subparagraph></paragraph> 
<paragraph id="HFECADAAFBF3C446592000042863335A5"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture.</text></paragraph></section> 
<section id="H21DBEB38E72347B88D9C07E0821600AA"><enum>3.</enum><header>Livestock assistance</header> 
<subsection id="H004E2902110349CD9C001265568E39D9"><enum>(a)</enum><header>Livestock compensation program</header> 
<paragraph id="HF73F3CF9881345BDBF8800F4E3D900AB"><enum>(1)</enum><header>Use of commodity credit corporation funds</header><text>Effective beginning on the date of enactment of this Act, the Secretary shall use funds of the Commodity Credit Corporation to carry out the 2002 Livestock Compensation Program announced by the Secretary on October 10, 2002 (67 Fed. Reg. 63070), to provide compensation for livestock losses due to blizzard and drought in the States of Colorado, Kansas, Nebraska, New Mexico, and Oklahoma.</text></paragraph> 
<paragraph id="H6887A59701F64E43A056A22D635F4350"><enum>(2)</enum><header>Eligible applicants</header><text>In carrying out the program described in paragraph (1), the Secretary shall provide assistance to any applicant that—</text> 
<subparagraph id="HC68C91A8EF1D48399B364009A466BB00"><enum>(A)</enum> 
<clause commented="no" display-inline="yes-display-inline" id="HCCDBA817C72741F5B81D14AAC517DB73"><enum>(i)</enum><text>conducts a livestock operation that is located in a disaster county, including any applicant conducting a livestock operation involving eligible livestock (within the meaning of the livestock assistance program under section 101(b) of division B of <external-xref legal-doc="public-law" parsable-cite="pl/108/324">Public Law 108–324</external-xref> (118 Stat. 1234)); or</text></clause> 
<clause id="H97807FBB7B364D74B94228005376A4D7" indent="up1"><enum>(ii)</enum><text>produces an animal described in section 10806(a)(1) of the Farm Security and Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/21/321d">21 U.S.C. 321d(a)(1)</external-xref>); and</text></clause></subparagraph> 
<subparagraph id="HC9D3C3E114454E99A3D000D1A34DF8A6"><enum>(B)</enum><text>meets all other eligibility requirements established by the Secretary for the program.</text></subparagraph></paragraph> 
<paragraph id="HC3731F9E885B41D4B36FF5E73837BA78"><enum>(3)</enum><header>Mitigation</header><text>In determining the eligibility for or amount of payments for which a producer is eligible under the livestock compensation program, the Secretary shall not penalize a producer that takes actions (recognizing disaster conditions) that reduce the average number of livestock the producer owned for grazing during the production year for which assistance is being provided.</text></paragraph></subsection> 
<subsection id="H3CED287A4FCB403BB97705AEE7E36C35"><enum>(b)</enum><header>Livestock indemnity payments</header> 
<paragraph id="H679B51F68718447089E223A24DB5C39C"><enum>(1)</enum><header>In general</header><text>The Secretary shall use such sums as are necessary of funds of the Commodity Credit Corporation to make livestock indemnity payments to producers on farms that have incurred livestock losses during calendar year 2006 or 2007, or both, due to a disaster, as determined by the Secretary, including losses due to blizzard and drought.</text></paragraph> 
<paragraph id="HABA05D1DEC93465A99BCBA384475C6C7"><enum>(2)</enum><header>Payment rates</header><text>Indemnity payments to a producer on a farm under paragraph (1) shall be made at a rate of not less than 30 percent of the market value of the applicable livestock on the day before the date of death of the livestock, as determined by the Secretary.</text></paragraph></subsection></section>
