		<official-title display="yes">To authorize the Secretary of the Interior,
		  acting through the Bureau of Reclamation to enter into a cooperative agreement
		  with the Madera Irrigation District for purposes of supporting the Madera Water
		  Supply Enhancement Project.</official-title>

		<section id="HBC6D0F9661CD44B2A61EF3752F646F6F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Madera Water Supply Enhancement
			 Act</short-title></quote>.</text>
		</section><section id="H2DBE9EBF729B45F28D33A8775667EE5C"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">For the purposes of this Act:</text>
			<paragraph id="H92CD9002F1D44046894091B72E33BF1D"><enum>(1)</enum><header>District</header><text>The
			 term <quote>District</quote> means the Madera Irrigation District, Madera,
			 California.</text>
			</paragraph><paragraph id="HB4128DF20C054C3E8B4822B44E1434C0"><enum>(2)</enum><header>Project</header><text>The
			 term <quote>Project</quote> means the Madera Water Supply Enhancement Project,
			 a groundwater bank on the 13,646-acre Madera Ranch in Madera, California,
			 owned, operated, maintained, and managed by the District that will plan,
			 design, and construct recharge, recovery, and delivery systems able to store up
			 to 250,000 acre-feet of water and recover up to 55,000 acre-feet of water per
			 year, as substantially described in the California Environmental Quality Act,
			 Final Environmental Impact Report for the Madera Irrigation District Water
			 Supply Enhancement Project, September 2005.</text>
			</paragraph><paragraph id="H3739877CE6F4496FA5C95F88131F91A1"><enum>(3)</enum><header>Secretary</header><text>The
			 term <quote>Secretary</quote> means the Secretary of the United States
			 Department of the Interior.</text>
			</paragraph><paragraph id="H8E237E998F13437A8893ABC60078061D"><enum>(4)</enum><header>Total
			 cost</header><text>The term <quote>total cost</quote> means all reasonable
			 costs, such as the planning, design, permitting, and construction of the
			 Project and the acquisition costs of lands used or acquired by the District for
			 the Project.</text>
			</paragraph></section><section id="HAD291773520C421B995F26959B6BE87E"><enum>3.</enum><header>Project
			 feasibility</header>
			<subsection id="H0C52CF2FF2FB42EE93A30089CC7FE1AB"><enum>(a)</enum><header>Project
			 feasible</header><text>Pursuant to the Reclamation Act of 1902 (32 Stat. 388)
			 and Acts amendatory thereof and supplemental thereto, the Project is feasible
			 and no further studies or actions regarding feasibility are necessary.</text>
			</subsection><subsection id="HFEC687A7199F445EBA98BD1369B72E9"><enum>(b)</enum><header>Applicability of
			 other laws</header><text display-inline="yes-display-inline">The Secretary
			 shall implement the authority provided in this Act in accordance with all
			 applicable Federal laws, including the National Environmental Policy Act of
			 1969 (42 U.S.C. 4321
			 et seq.) and the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/7/136">7 U.S.C. 136</external-xref>;
			 16 U.S.C. 460 et
			 seq.).</text>
			</subsection></section><section id="H411B2F184DB844B493515B0080144CE1"><enum>4.</enum><header>Cooperative
			 agreement</header><text display-inline="no-display-inline">All final planning
			 and design and the construction of the Project authorized by this Act shall be
			 undertaken in accordance with a cooperative agreement between the Secretary and
			 the District for the Project. Such cooperative agreement shall set forth in a
			 manner acceptable to the Secretary and the District the responsibilities of the
			 District for participating, which shall include—</text>
			<paragraph id="H559DC1D2C9FD41F6B8FE083873BEB372"><enum>(1)</enum><text>engineering and
			 design;</text>
			</paragraph><paragraph id="HC07CB6051647414581E7C003CC0CFB2"><enum>(2)</enum><text>construction;
			 and</text>
			</paragraph><paragraph id="HA403CEB49132441C9DAA314EF8020122"><enum>(3)</enum><text>the administration
			 of contracts pertaining to any of the foregoing.</text>
			</paragraph></section><section id="HE6DAA2C25D18404D912F2CC5C3F59667"><enum>5.</enum><header>Authorization for
			 the madera water supply and enhancement project</header>
			<subsection id="H81F1814669B54C4B8B446F69B3E41600"><enum>(a)</enum><header>Authorization of
			 Construction</header><text>The Secretary, acting pursuant to the Federal
			 reclamation laws (Act of June 17, 1902; 32 Stat. 388), and Acts amendatory
			 thereof or supplementary thereto, is authorized to enter into a cooperative
			 agreement through the Bureau of Reclamation with the District for the support
			 of the final design and construction of the Project.</text>
			</subsection><subsection id="HE76DD117111048F400A352CFC3A5595D"><enum>(b)</enum><header>Total
			 cost</header><text display-inline="yes-display-inline">The total cost of the
			 Project for the purposes of determining the Federal cost share shall not exceed
			 $90,000,000.</text>
			</subsection><subsection id="HF8E2B9AE2F274BBE9B229396E83EFB9B"><enum>(c)</enum><header>Cost
			 Share</header><text>The Federal share of the capital costs of the Project shall
			 not exceed 25 percent of the total cost. Capital, planning, design, permitting,
			 construction, and land acquisition costs incurred by the District prior to the
			 date of the enactment of this Act shall be considered a portion of the
			 non-Federal cost share.</text>
			</subsection><subsection id="H13DE4A5B21B0433E86191D3F52BA6FF4"><enum>(d)</enum><header>Credit for
			 Non-Federal Work</header><text>The District shall receive credit toward the
			 non-Federal share of the cost of the Project for—</text>
				<paragraph id="H21715800CC78471BBCDBCA1E5C00EA7F"><enum>(1)</enum><text display-inline="yes-display-inline">in-kind services that the Secretary
			 determines would contribute substantially toward the completion of the
			 project;</text>
				</paragraph><paragraph id="HE4C0360D13E34D4D95BAC3C4A1F78602"><enum>(2)</enum><text>reasonable costs
			 incurred by the District as a result of participation in the planning, design,
			 permitting, and construction of the Project; and</text>
				</paragraph><paragraph id="H23C77A581F2C43718FC1658DBAD4641"><enum>(3)</enum><text>the acquisition
			 costs of lands used or acquired by the District for the Project.</text>
				</paragraph></subsection><subsection id="H063BBF5CD2E74F4395B887E8BC643822"><enum>(e)</enum><header>Limitation</header><text>The
			 Secretary shall not provide funds for the operation or maintenance of the
			 Project authorized by this section. The operation, ownership, and maintenance
			 of the Project shall be the sole responsibility of the District.</text>
			</subsection><subsection id="H4F2B519338994CC9B83DD23DDCB160B4"><enum>(f)</enum><header>Plans and
			 Analyses Consistent With Federal Law</header><text>Before obligating funds for
			 design or construction under this section, the Secretary shall work
			 cooperatively with the District to use, to the extent possible, plans, designs,
			 and engineering and environmental analyses that have already been prepared by
			 the District for the Project. The Secretary shall ensure that such information
			 as is used is consistent with applicable Federal laws and regulations.</text>
			</subsection><subsection id="H4F70D95EC17F40638D9810D3025F00AA"><enum>(g)</enum><header>Title;
			 Responsibility; Liability</header><text>Nothing in this section or the
			 assistance provided under this section shall be construed to transfer title,
			 responsibility, or liability related to the Project to the United
			 States.</text>
			</subsection><subsection id="H87B4FB5A54D246A68841BBB65D6BCE2"><enum>(h)</enum><header>Authorization of
			 Appropriation</header><text>There is authorized to be appropriated to the
			 Secretary to carry out this Act $22,500,000 or 25 percent of the total cost of
			 the Project, whichever is less.</text>
			</subsection></section><section id="H25BEB9FC7BEB443AB36C4EDE1FAD00CB"><enum>6.</enum><header>Sunset</header><text display-inline="no-display-inline">The authority of the Secretary to carry out
			 any provisions of this Act shall terminate 10 years after the date of the
			 enactment of this Act.</text>
