			</subsection></section><section id="H675856DBAF5E406BBAD5ADFD9C000025"><enum>2.</enum><header>Findings and
			 purposes</header>
			<subsection id="HCD64916B14A04356001CCDD3421D651"><enum>(a)</enum><header>Findings</header><text>The
			 Congress finds that—</text>
				<paragraph id="H9A3B169CA1EC46309C2C9811A9620392"><enum>(1)</enum><text>one of the primary
			 missions of the Federal Housing Administration (FHA) single family mortgage
			 insurance program is to reach borrowers who are underserved, or not served, by
			 the existing conventional mortgage marketplace;</text>
				</paragraph><paragraph id="H9DA7074E6B3E441900CD6781418DF00"><enum>(2)</enum><text>the FHA program has
			 a long history of innovation, which includes pioneering the 30-year
			 self-amortizing mortgage and a safe-to-seniors reverse mortgage product, both
			 of which were once thought too risky to private lenders;</text>
				</paragraph><paragraph id="H9BE6B26364254B4D92EA9EB8FDF31732"><enum>(3)</enum><text>the FHA single
			 family mortgage insurance program traditionally has been a major provider of
			 mortgage insurance for home purchases;</text>
				</paragraph><paragraph id="H02155CAD031F4F759D9303AA03DADB31"><enum>(4)</enum><text>the FHA mortgage
			 insurance premium structure, as well as FHA’s product offerings, should be
			 revised to reflect FHA’s enhanced ability to determine risk at the loan level
			 and to allow FHA to better respond to changes in the mortgage market;</text>
				</paragraph><paragraph id="H62BC0D93CA9E4FE4BDEDC3397078CA31"><enum>(5)</enum><text>during past
			 recessions, including the oil-patch downturns in the mid-1980s, FHA remained a
			 viable credit enhancer and was therefore instrumental in preventing a more
			 catastrophic collapse in housing markets and a greater loss of homeowner
			 equity; and</text>
				</paragraph><paragraph id="HB9A71F2437B24470B9E7FA1CAF9D7ECB"><enum>(6)</enum><text>as housing price
			 appreciation slows and interest rates rise, many homeowners and prospective
			 homebuyers will need the less-expensive, safer financing alternative that FHA
			 mortgage insurance provides.</text>
				</paragraph></subsection><subsection id="H4AFFC0FE7F5F45DB96C2228C8E1D049B"><enum>(b)</enum><header>Purposes</header><text>The
			 purposes of this Act are—</text>
				<paragraph id="HD22524506CC5404F9D41B87BEC246223"><enum>(1)</enum><text>to provide
			 flexibility to FHA to allow for the insurance of housing loans for low- and
			 moderate-income homebuyers during all economic cycles in the mortgage
			 market;</text>
				</paragraph><paragraph id="H3255F2EFB9374290988FC21D46722E11"><enum>(2)</enum><text>to modernize the
			 FHA single family mortgage insurance program by making it more reflective of
			 enhancements to loan-level risk assessments and changes to the mortgage market;
			 and</text>
				</paragraph><paragraph id="H1C25D89748674B55B5247D1F3500DA73"><enum>(3)</enum><text>to adjust the loan
			 limits for the single family mortgage insurance program to reflect rising house
			 prices and the increased costs associated with new construction.</text>
				</paragraph></subsection></section><section display-inline="no-display-inline" id="H3E06F2B4AC244F648E11B2C4DCDB77EE"><enum>3.</enum><header>Maximum principal
			 loan obligation</header><text display-inline="no-display-inline">Section
			 203(b)(2) of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1709">12 U.S.C. 1709(b)(2)(A)</external-xref>) is amended
			 by striking subparagraph (A) and inserting the following new
			 subparagraph:</text>
			<quoted-block display-inline="no-display-inline" id="HDB475F3F4E75437D8228284586A647A9" style="OLC">
				<subparagraph id="HFC40240962964433AF9583134E344B00"><enum>(A)</enum><text display-inline="yes-display-inline">not to exceed the lesser of—</text>
					<clause id="H9F612D3ABA9F43E7B5C03597480170C7"><enum>(i)</enum><text display-inline="yes-display-inline">in the case of a 1-family residence, 125
				percent of the median 1-family house price in the area, as determined by the
				Secretary; and in the case of a 2-, 3-, or 4-family residence, the percentage
				of such median price that bears the same ratio to such median price as the
				dollar amount limitation in effect for 2007 under section 305(a)(2) of the
				<act-name parsable-cite="FHLMCA">Federal Home Loan Mortgage Corporation
				Act</act-name> (12
				U.S.C. 1454(a)(2)) for a 2-, 3-, or 4-family residence,
				respectively, bears to the dollar amount limitation in effect for 2007 under
				such section for a 1-family residence; or</text>
					</clause><clause id="H79C2BE41307F48D8B1928C5FB6F67300"><enum>(ii)</enum><text display-inline="yes-display-inline">175 percent of the dollar amount limitation
				in effect for 2007 under such section 305(a)(2) for a residence of the
				applicable size (without regard to any authority to increase such limitations
				with respect to properties located in Alaska, Guam, Hawaii, or the Virgin
				Islands), except that each such maximum dollar amount shall be adjusted
				effective January 1 of each year beginning with 2008, by adding to or
				subtracting from each such amount (as it may have been previously adjusted) a
				percentage thereof equal to the percentage increase or decrease, during the
				most recently completed 12-month or 4-quarter period ending before the time of
				determining such annual adjustment, in an housing price index developed or
				selected by the Secretary for purposes of adjustments under this clause;</text>
					</clause><continuation-text continuation-text-level="subparagraph">except
				that the dollar amount limitation in effect under this subparagraph for any
				size residence for any area may not be less than the greater of: (I) the dollar
				amount limitation in effect under this section for the area on October 21,
				1998; or (II) 65 percent of the dollar amount limitation in effect for 2007
				under such section 305(a)(2) for a residence of the applicable size, as such
				limitation is adjusted by any subsequent percentage adjustments determined
				under clause (ii) of this subparagraph; and except that, if the Secretary
				determines that market conditions warrant such an increase, the Secretary may,
				for such period as the Secretary considers appropriate, increase the maximum
				dollar amount limitation determined pursuant to the preceding provisions of
				this subparagraph with respect to any particular size or sizes of residences,
				or with respect to residences located in any particular area or areas, to an
				amount that does not exceed the maximum dollar amount then otherwise in effect
				pursuant to the preceding provisions of this subparagraph for such size
				residence, or for such area (if applicable), by not more than $100,000;
				and</continuation-text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H485AD9517DB64D4B91DA2B78184E1537"><enum>4.</enum><header>Extension of
			 mortgage term</header><text display-inline="no-display-inline">Paragraph (3) of
			 section 203(b) of the <act-name parsable-cite="NHA">National Housing
			 Act</act-name> (12
			 U.S.C. 1709(b)(3)) is amended—</text>
			<paragraph id="H16891B83F07344F3AD26BFF1094274BB"><enum>(1)</enum><text>by striking
			 <quote>thirty-five years</quote> and inserting <quote>forty years</quote>;
			 and</text>
			</paragraph><paragraph id="H42DC0B48B63941B19CA99787CE4D53DF"><enum>(2)</enum><text>by striking
			 <quote>(or thirty years if such mortgage is not approved for insurance prior to
			 construction)</quote>.</text>
			</paragraph></section><section id="H99444395654544A2A8AFADE606C5896"><enum>5.</enum><header>Downpayment
			 simplification</header><text display-inline="no-display-inline">Section 203(b)
			 of the <act-name parsable-cite="NHA">National Housing Act</act-name>
			 (12 U.S.C.
			 1709(b)) is amended—</text>
			<paragraph id="H358D2200BCFA4A8100CEF04A333BED"><enum>(1)</enum><text>in
			 paragraph (2)—</text>
				<subparagraph id="HDE8605963FA14362942CB59695D5F3D0"><enum>(A)</enum><text>by striking
			 subparagraph (B) and inserting the following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="H5912EB26E11346A0B8AE177B4DF59D7B" style="OLC">
						<subparagraph id="HC3B1D1DF7E9C4C97AACF4FD5489DA7A7"><enum>(B)</enum><text>not to exceed an
				amount equal to the sum of—</text>
							<clause id="H2A6747B5EA504457ACFC3B8475C49F7B"><enum>(i)</enum><text display-inline="yes-display-inline">the amount of the mortgage premium paid at
				the time the mortgage is insured; and</text>
							</clause><clause id="H2D338936303C41C2868E92C9CA114D18"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="H7A0F325A6106496E96F7102E05F5AABB"><enum>(I)</enum><text display-inline="yes-display-inline">except as provided in subclause (II), 97.75
				percent of the appraised value of the property; or</text>
								</subclause><subclause id="H1FDDF90E9A3448A4B7F9E000AD3453B1" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">in
				the case only of a mortgage described in subsection (c)(3), the appraised value
				of the property, plus any initial service charges, appraisal, inspection, and
				other fees in connection with the mortgage as approved by the
				Secretary.</text>
								</subclause></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph><subparagraph id="H0DC3913506FF495A9C2FA7793E005E06"><enum>(B)</enum><text>in the matter
			 after and below subparagraph (B), by striking the second sentence (relating to
			 a definition of <quote>average closing cost</quote>) and all that follows
			 through <quote>title 38, United States Code.</quote>; and</text>
				</subparagraph><subparagraph id="HDFA1EB237E3042E1895ED00783009FCC"><enum>(C)</enum><text>by striking the
			 last undesignated paragraph (relating to counseling with respect to the
			 responsibilities and financial management involved in homeownership);
			 and</text>
				</subparagraph></paragraph><paragraph id="HF1A3B8B2DCCA4569B275C1A9CF8B7200"><enum>(2)</enum><text>in paragraph
			 (9)—</text>
				<subparagraph id="H69722484DCA240C6897F47758D110089"><enum>(A)</enum><text>by striking the
			 paragraph designation and all that follows through <quote><italic>Provided
			 further</italic>, That for</quote> and inserting the following:</text>
					<quoted-block act-name="National Housing Act" id="HBD585C0B48C04EEEA2002D6F77D04175" style="OLC">
						<paragraph id="H77993BC59CB64DCFBF09A120ACBB055D"><enum>(9)</enum><text display-inline="yes-display-inline">Except in the case of a mortgage described
				in subsection (c)(3), be executed by a mortgagor who shall have paid on account
				of the property, in cash or its equivalent, at least 3 percent of the
				Secretary’s estimate of the cost of acquisition (excluding the mortgage
				insurance premium paid at the time the mortgage is insured).
				For</text>
						</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph><subparagraph id="HC0D9648D45F3481CBCAAC6B9783D46B4"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting after the period at the end
			 the following: <quote>For purposes of this paragraph, the Secretary shall
			 consider as cash or its equivalent any amounts gifted by a family member (as
			 such term is defined in section 201), the mortgagor’s employer or labor union,
			 or a qualified homeownership assistance entity, but only if there is no
			 obligation on the part of the mortgagor to repay the gift: For purposes of the
			 preceding sentence, the term <term>qualified homeownership assistance
			 entity</term> means any governmental agency or charity that has a program to
			 provide homeownership assistance to low- and moderate-income families or
			 first-time home buyers, or any private nonprofit organization that has such a
			 program and evidences sufficient fiscal soundness to protect the fiscal
			 integrity of the Mutual Mortgage Insurance Fund by maintaining a minimum net
			 worth of $4,000,000 of acceptable assets.</quote>.</text>
				</subparagraph></paragraph></section><section id="HC30C7F13DA6C45D5A5AD189C55009FC8"><enum>6.</enum><header>Mortgage
			 insurance premiums for zero- and lower-downpayment borrowers</header><text display-inline="no-display-inline">Section 203(c) of the National Housing Act
			 (12 U.S.C.
			 1709(c) is amended by adding at the end the following new
			 paragraph:</text>
			<quoted-block display-inline="no-display-inline" id="H0957CCD941E540F5AEE29D00DDC64778" style="OLC">
				<paragraph id="HA482D14532F94C81B3F1D4E1F400A6E" indent="up1"><enum>(3)</enum><header>Zero- and lower-downpayment
				borrowers</header>
					<subparagraph id="H7764039602524419B076E64BD9FC3FB3"><enum>(A)</enum><header>Applicability</header><text>This
				paragraph shall apply to any mortgage that—</text>
						<clause id="H55F77610BA604171AE2F3B697BA2604E"><enum>(i)</enum><text display-inline="yes-display-inline">is secured by a 1- to 4-family dwelling
				that will be occupied by the mortgagor as his or her principal
				residence;</text>
						</clause><clause id="HABBA3C3AB24A4372B1CBFFC2EDF75C5E"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="H8E44F52CAD604C369DC0007FE1D11081"><enum>(I)</enum><text display-inline="yes-display-inline">is an obligation of the Mutual Mortgage
				Insurance Fund or of the General Insurance Fund pursuant to subsection (v) of
				this section; or</text>
							</subclause><subclause display-inline="no-display-inline" id="HCD28823BD92F42D191DBAD5D5D02B185" indent="up1"><enum>(II)</enum><text>is insured under subsection (k) of
				this section or section 234(c);</text>
							</subclause></clause><clause display-inline="no-display-inline" id="HE24E7AF9F7074BBFBED511F1DA8E8E78"><enum>(iii)</enum><subclause commented="no" display-inline="yes-display-inline" id="H99A715B19B2E4B5AA19E9CC9FF46F3C2"><enum>(I)</enum><text display-inline="yes-display-inline">is executed by a mortgagor who has not had
				any present ownership interest in a principal residence, and whose spouse has
				not had any such interest, during 12-month period ending upon purchase of the
				residence with the mortgage to which this paragraph applies, except that this
				subclause shall be considered a program to assist first-time homebuyers for
				purposes of section 956 of the Cranston-Gonzalez National Affordable Housing
				Act (42 U.S.C.
				12713); or</text>
							</subclause><subclause id="H9558D8148EF44829B8F00246CDB243" indent="up1"><enum>(II)</enum><item commented="no" display-inline="yes-display-inline" id="H6B753E5A43B74A5F836DE706EAF3116D"><enum>(aa)</enum><text>is made to pay or
				prepay, and fully extinguish, the outstanding obligations under an existing
				mortgage or mortgages on the same property; and</text>
								</item><item id="HF8C730C9DA954E5A9487B46294D66665" indent="up1"><enum>(bb)</enum><text>involves a principal obligation
				not exceeding the amount necessary to fully pay or prepay such outstanding
				obligations under the existing mortgage or mortgages, plus any charges and fees
				involved in such transaction and any charges and fees in connection with the
				payment or prepayment of such outstanding obligations.</text>
								</item></subclause></clause><clause id="H6ED60DB211F142F98C67E7EDECF7A644"><enum>(iv)</enum><subclause commented="no" display-inline="yes-display-inline" id="H4A4C71147F754472B5984EDB761E1645"><enum>(I)</enum><text>involves a principal
				obligation that does not comply with subclause (I) of subsection (b)(2)(B)(ii)
				(relating to loan-to-value ratio); or</text>
							</subclause><subclause id="HEE8D2FDC5CC4429E9F80597D264327B2" indent="up1"><enum>(II)</enum><text>is executed by a mortgagor who has
				not paid on account of the property, in cash or its equivalent, at least 3
				percent of the Secretary’s estimate of the cost of acquisition (excluding the
				mortgage insurance premium paid at the time the mortgage is insured).</text>
							</subclause></clause></subparagraph><subparagraph id="HF32DF0A96467479DBF4F8C85291EB7FF"><enum>(B)</enum><header>Up-front premiums</header><text>The
				amount of any single premium payment collected at the time of insurance may not
				exceed 3.0 percent of the amount of the original insured principal obligation
				of the mortgage.</text>
					</subparagraph><subparagraph id="H28717484188E4C4F9943FFD94BBE1D6"><enum>(C)</enum><header>Annual premiums</header><text display-inline="yes-display-inline">Except as provided in subparagraph (D), the
				amount of any annual premium payment collected may not exceed 0.75 percent of
				the remaining insured principal obligation of the mortgage.</text>
					</subparagraph><subparagraph id="HC5250AE0746F4683AFC10076D18476C7"><enum>(D)</enum><header>Annual redetermination of premium
				rate</header><text display-inline="yes-display-inline">The Secretary shall
				redetermine the rates of premiums not less than once every 12
				months.</text>
					</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HF1818F2A525A4B7C9CC0600379418D5"><enum>7.</enum><header>Mortgage insurance
			 premiums for standard and higher-risk borrowers</header><text display-inline="no-display-inline">Paragraph (2) of section 203(c) of the
			 National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1709">12 U.S.C. 1709(c)(2)</external-xref>) is
			 amended—</text>
			<paragraph id="HA859C8CDCA2B4BAFA8B84C48C68000CB"><enum>(1)</enum><text>by striking the
			 matter that precedes subparagraph (A) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="H420130C74B664DBF906E3172B54460BC" style="OLC">
					<paragraph id="HEBFCC32F0BC741EBB513C0AF003233B" indent="up1"><enum>(2)</enum><header>Standard-risk
				mortgages</header><text display-inline="yes-display-inline">In the case of any
				mortgage that is secured by a 1- to 4-family dwelling, is an obligation of the
				Mutual Mortgage Insurance Fund or of the General Insurance Fund pursuant to
				subsection (v) of this section or is insured under subsection (k) of this
				section or section 234(c), for which the mortgagor has paid on account of the
				property, in cash or its equivalent, at least 3 percent of the Secretary’s
				estimate of the cost of acquisition (excluding the mortgage insurance premium
				paid at the time the mortgage is insured), and that involves a principal
				obligation that complies with subclause (I) of subsection (b)(2)(B)(ii), the
				following requirements shall apply:</text>
					</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H506BEB2415B84A35AD6F9848B4A9BD95"><enum>(2)</enum><text>by adding at the
			 end the following new subparagraph:</text>
				<quoted-block display-inline="no-display-inline" id="HB43B8B01CCFE40D69486B428F478589" style="OLC">
					<subparagraph id="H6593FDC1BA1E4EDFBCC86497B622F1F2" indent="up1"><enum>(C)</enum><header>Higher-risk borrowers</header><text display-inline="yes-display-inline">The Secretary shall establish underwriting
				standards that provide for insurance under this section of mortgages described
				in the matter in this paragraph preceding subparagraph (A) for which the
				mortgagor has a credit score equivalent to a FICO score of less than 560, and
				may insure, and make commitments to insure, such mortgages. Such underwriting
				standards shall include establishing and collecting premium payments that
				comply with the requirements of this paragraph, except that notwithstanding
				subparagraph (A), the single premium payment collected at the time of insurance
				may be established in an amount that does not exceed 3.0 percent of the amount
				of the original insured principal obligation of the
				mortgage.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H27BB8524601742B4B3503193FA00C745"><enum>8.</enum><header>Risk-based
			 mortgage insurance premiums</header><text display-inline="no-display-inline">Section 203(c) of the
			 <act-name parsable-cite="NHA">National Housing Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/12/1709">12 U.S.C. 1709(c)</external-xref>),
			 as amended by the preceding provisions of this Act, is further amended by
			 adding at the end the following new paragraphs:</text>
			<quoted-block display-inline="no-display-inline" id="H6E5748135F2543ED8C42B7D465FF31B7" style="OLC">
				<paragraph id="HC2F66AD9940F46F5AEF72E0946F4D63E" indent="up1"><enum>(4)</enum><header>Flexible risk-based
				premiums</header><text display-inline="yes-display-inline">In the case of a
				mortgage referred to in paragraph (2)(C) or (3)(A) for which the loan
				application is received by the mortgagee on or after October 1, 2007:</text>
					<subparagraph id="H7801C6F2E00748E48F4BB03B00CD11D"><enum>(A)</enum><header>In general</header><text>The
				Secretary may establish a mortgage insurance premium structure involving a
				single premium payment collected prior to the insurance of the mortgage or
				annual payments (which may be collected on a periodic basis), or both, subject
				to the requirements of subparagraph (B) and paragraph (5). Under such
				structure, the rate of premiums for such a mortgage may vary according to the
				credit risk associated with the mortgage and the rate of any annual premium for
				such a mortgage may vary during the mortgage term as long as the basis for
				determining the variable rate is established before the execution of the
				mortgage. The Secretary may change a premium structure established under this
				subclause but only to the extent that such change is not applied to any
				mortgage already executed.</text>
					</subparagraph><subparagraph id="H0A1CA4C6483540CB97039DD12D877F36"><enum>(B)</enum><header>Establishment and alteration of
				premium structure</header><text display-inline="yes-display-inline">A premium
				structure shall be established or changed under subparagraph (A) only by
				providing notice to mortgagees and to the Congress, at least 30 days before the
				premium structure is established or changed.</text>
					</subparagraph><subparagraph id="HD13BB442C6464DA88D318D825F720535"><enum>(C)</enum><header>Annual report regarding
				premiums</header><text>The Secretary shall submit a report to the Congress
				annually setting forth the rate structures and rates established and altered
				pursuant to this paragraph during the preceding 12-month period and describing
				how such rates were determined.</text>
					</subparagraph></paragraph><paragraph id="H09497DA2C647415FAF73084ECFEEABAF" indent="up1"><enum>(5)</enum><header>Considerations for premium
				structure</header><text>When establishing premiums for mortgages referred to in
				paragraph (2)(C), establishing premiums pursuant to paragraph (3), establishing
				a premium structure under paragraph (4), and when changing such a premium
				structure, the Secretary shall consider the following:</text>
					<subparagraph display-inline="no-display-inline" id="H0F23BBED75824BBB9863FD53DB59BCCC"><enum>(A)</enum><text>The effect of the proposed premiums or
				structure on the Secretary’s ability to meet the operational goals of the
				Mutual Mortgage Insurance Fund as provided in section 202(a).</text>
					</subparagraph><subparagraph id="H3673967B8B054A05BA8288A92B08C15F"><enum>(B)</enum><text>Underwriting variables.</text>
					</subparagraph><subparagraph id="H3E0399B3ADC949C6A6D5DEE5190E4DD"><enum>(C)</enum><text>The extent to which new pricing under
				the proposed premiums or structure has potential for acceptance in the private
				market.</text>
					</subparagraph><subparagraph id="HF72AB623565C4DED838CDA20AAFE5BB7"><enum>(D)</enum><text>The administrative capability of the
				Secretary to administer the proposed premiums or structure.</text>
					</subparagraph><subparagraph id="HCC5C7E48DCDD46A996B61053F7844FF4"><enum>(E)</enum><text>The effect of the proposed premiums or
				structure on the Secretary’s ability to maintain the availability of mortgage
				credit and provide stability to mortgage markets.</text>
					</subparagraph></paragraph><paragraph id="HCF75B2A96E4F404CA4F1A5F3222B2E6" indent="up1"><enum>(6)</enum><header>Authority To base premium prices on
				product risk</header>
					<subparagraph id="H5971A43DEC884629A002D87E2DD166E0"><enum>(A)</enum><header>Authority</header><text>In
				establishing premium rates under paragraphs (2), (3), and (4), the Secretary
				may provide for variations in such rates according to the credit risk
				associated with the type of mortgage product that is being insured under this
				title, which may include providing that premium rates differ between fixed-rate
				mortgages and adjustable-rate mortgages insured pursuant to section 251,
				between mortgages insured pursuant to section 203(b) and mortgages for
				condominiums insured pursuant to section 234, and between such other products
				as the Secretary considers appropriate.</text>
					</subparagraph><subparagraph id="H0C5614065EC8461F936FCA22C41370F2"><enum>(B)</enum><header>Limitation</header><text display-inline="yes-display-inline">Subparagraph (A) may not be construed to
				authorize the Secretary to establish, for any mortgage product, any mortgage
				insurance premium rate that does not comply with the requirements and
				limitations under paragraphs (2) through
				(5).</text>
					</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H5A41247A15544B1F9D1B64D9A4052020"><enum>9.</enum><header>Payment
			 incentives</header><text display-inline="no-display-inline">Section 203(c) of
			 the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1709">12 U.S.C. 1709(c)</external-xref>), as amended by
			 the preceding provisions of this Act, is further amended by adding at the end
			 the following new paragraph:</text>
			<quoted-block display-inline="no-display-inline" id="H671813602C784276B8C39E9739986B96" style="OLC">
				<paragraph id="H41DB199C69404AE69016CD8F5EA41BAE" indent="up1"><enum>(7)</enum><header>Payment incentives</header>
					<subparagraph id="HE20FB001FA1147BA84A7304BE741F262"><enum>(A)</enum><header>Authority</header><text>With respect
				to mortgages referred to in paragraph (2)(C) or (3):</text>
						<clause id="H314F66F85C7A4913A785CE780F5DC14"><enum>(i)</enum><header>Discretionary 3-year payment
				incentive</header><text display-inline="yes-display-inline">The Secretary may
				provide, in the discretion of the Secretary, that the payment incentive under
				subparagraph (B) shall apply upon the expiration of the 3-year period beginning
				upon the time of insurance of such a mortgage.</text>
						</clause><clause id="HE88B40676D95450EA0D14D36D798BA15"><enum>(ii)</enum><header>Mandatory 5-year payment
				incentive</header><text>The Secretary shall provide that the payment incentive
				under subparagraph (B) applies upon the expiration of the 5-year period
				beginning upon the time of insurance of such a mortgage.</text>
						</clause></subparagraph><subparagraph id="HE1954F6D5F6442E7A9AF8890C8C39CA9"><enum>(B)</enum><header>Payment incentive</header><text display-inline="yes-display-inline">In the case of any mortgage to which the
				payment incentive under this subparagraph applies, if, during the period
				referred to in clause (i) or (ii) of subparagraph (A), as applicable, all
				mortgage insurance premiums for such mortgage have been paid on a timely basis,
				upon the expiration of such period the Secretary shall—</text>
						<clause id="H2BFC1F40321C478984CFEBEE7F59BDB1"><enum>(i)</enum><text>reduce the amount of the annual
				premium payments otherwise due thereafter under such mortgage—</text>
							<subclause id="HAE2E3835EF744BAEA542E8B24BAF5460"><enum>(I)</enum><text>in the case of a mortgage referred to in
				paragraph (3), to an amount that does not exceed the amount of the maximum
				annual premium allowable under paragraph (2)(B); and</text>
							</subclause><subclause id="HB3CC7DFBEC454789AF00B8B3B99B3868"><enum>(II)</enum><text display-inline="yes-display-inline">in
				the case of a mortgage referred to in paragraph (2)(C), to an amount that does
				not exceed the amount of the annual premium payable at the time of insurance of
				the mortgage on a mortgage of the same product type having the same terms, but
				for which the mortgagor has a credit score equivalent to a FICO score of 560 or
				more; and</text>
							</subclause></clause><clause id="H85BF6FC41D1F475BB5E8D3C738E8050"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case only of a mortgage referred to
				in paragraph (2)(C), refund to the mortgagor, upon payment in full of the
				obligation of the mortgage, any amount by which the single premium payment for
				such mortgage collected at the time of insurance exceeded the amount of the
				single premium payment chargeable under paragraph (2)(A) at the time of
				insurance for a mortgage of the same product type having the same terms, but
				for which the mortgagor has a credit score equivalent to a FICO score of 560 or
				more.</text>
						</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section display-inline="no-display-inline" id="H1233CA6FF83746FE8F29A229ED000693" section-type="subsequent-section"><enum>10.</enum><header>Borrower protections
			 for higher risk mortgages</header><text display-inline="no-display-inline">Section 203(b) of the National Housing Act
			 (12 U.S.C.
			 1709(b)) is amended by adding at the end the following new
			 paragraph:</text>
			<quoted-block display-inline="no-display-inline" id="HE1DD9E9A10044DD48C8737AE7180D426" style="OLC">
				<paragraph id="HC391561FD88146258F3B8144E42EAFB3"><enum>(10)</enum><header>Borrower
				protections for certain mortgages</header><text>Except as otherwise
				specifically provided in this paragraph, in the case of any mortgage referred
				to in paragraph (2)(C) or (3) of subsection (c), the following requirements
				shall apply:</text>
					<subparagraph id="H67294A379EDF4683B31583C497BE991E"><enum>(A)</enum><header>Disclosures</header>
						<clause id="H5DAD1F1B3648486F006EBE499C3BB464"><enum>(i)</enum><header>Required
				disclosures</header><text display-inline="yes-display-inline">In addition to
				any disclosures that are otherwise required by law or by the Secretary for
				single family mortgages, the mortgagee shall disclose to the mortgagor the
				following information:</text>
							<subclause id="HFD8F496FEC4344FE8FC1EBA97D53C56B"><enum>(I)</enum><header>At
				application</header><text>At the time of application for the loan involved in
				the mortgage, a list of counseling agencies, approved by the Secretary, in the
				area of the applicant.</text>
							</subclause><subclause id="HD2B2B971E33542410011231FF31540D9"><enum>(II)</enum><header>At
				execution</header><text display-inline="yes-display-inline">At the time of
				entering into the mortgage—</text>
								<item id="H7A623A242ED64FBDAB20EEC8FF009741"><enum>(aa)</enum><text>the
				terms of the mandatory 5-year payment incentive required under subsection
				(c)(7)(A)(ii); and</text>
								</item><item id="H18E4E4042486400E896B3E51B730B85"><enum>(bb)</enum><text>a
				statement that the mortgagor has a right under contract to loss
				mitigation.</text>
								</item></subclause><subclause id="H139DAB71E3404244B705EFA16E59D255"><enum>(III)</enum><header>Other
				information</header><text display-inline="yes-display-inline">Any other
				additional information that the Secretary determines is appropriate to ensure
				that the mortgagor has received timely and accurate information about the
				program under paragraph (2)(C) or (3) of subsection (c), as applicable.</text>
							</subclause></clause><clause display-inline="no-display-inline" id="H0F112A1D1CB74ABEA861DEF409BB055"><enum>(ii)</enum><header>Penalties for
				failure to provide required disclosures</header><text>The Secretary may
				establish and impose appropriate penalties for failure of a mortgagee to
				provide any disclosure required under clause (i).</text>
						</clause><clause display-inline="no-display-inline" id="H473D62B243094BB692DBD28831F851AC"><enum>(iii)</enum><header>No private
				right of action</header><text>This subparagraph shall not create any private
				right of action on behalf of the mortgagor.</text>
						</clause></subparagraph><subparagraph id="HC0B46022FE3449B8A3DDBA38BFA3F6B8"><enum>(B)</enum><header>Counseling</header>
						<clause id="HE11D970A998148B696007F90F142EE3D"><enum>(i)</enum><header>Requirement</header><text display-inline="yes-display-inline">The Secretary shall require that the
				mortgagor shall have received counseling that complies with the requirements of
				this subparagraph.</text>
						</clause><clause id="H85D0BE5BD4874379BACEB94FE8EC45C"><enum>(ii)</enum><header>Terms of
				counseling</header><text>Counseling under this subparagraph shall be
				provided—</text>
							<subclause id="HF471A52D787D4EBBADACAEBFA2E1317"><enum>(I)</enum><text display-inline="yes-display-inline">prior to closing for the loan involved in
				the mortgage;</text>
							</subclause><subclause id="HEA44BB7705D64881B1C8A26C405EFBC5"><enum>(II)</enum><text>by a third party
				(other than the mortgagee) who is approved by the Secretary, with respect to
				the responsibilities and financial management involved in homeownership;</text>
							</subclause><subclause id="HC6901DE499C546C6A9DB94B2C598DCC9"><enum>(III)</enum><text>on an individual
				basis to the mortgagor by a representative of the approved third-party
				counseling entity; and</text>
							</subclause><subclause id="HC819532DF3084F0F922BB1A140880096"><enum>(IV)</enum><text>in person, to the
				maximum extent possible.</text>
							</subclause></clause><clause display-inline="no-display-inline" id="HEEDEF0CEC5B843B49805B1376933DFC"><enum>(iii)</enum><header>Topics</header><text>In
				the case only of a mortgage referred to in subsection (c)(3), counseling under
				this subparagraph shall include providing to, and discussing with, the
				mortgagor—</text>
							<subclause id="H71A291EA561D41D0B61D9131C59FAB78"><enum>(I)</enum><text>information
				regarding homeownership options other than a mortgage that is subject to this
				paragraph, other zero- or low-downpayment mortgage options that are or may
				become available to the mortgagor, the financial implications of entering into
				a mortgage (including a mortgage subject to this paragraph), and any other
				information that the Secretary may require;</text>
							</subclause><subclause id="H1205E0CCC2A646DAB9D7062538E6E69"><enum>(II)</enum><text>a written
				disclosure that sets forth the amount and the percentage by which a property
				with a mortgage that is subject to this paragraph must appreciate for the
				mortgagor to recover the principal amount of the mortgage, the costs financed
				under the mortgage, and the estimated costs involved in selling the property,
				if the mortgagor were to sell the property on each of the second, fifth, and
				tenth anniversaries of the mortgage; and</text>
							</subclause><subclause id="HB564B6619BE34929B53BFD393EA454BE"><enum>(III)</enum><text>a written
				disclosure, as the Secretary shall require, that specifies the effective cost
				to a mortgagor of borrowing the amount by which the maximum amount that could
				be borrowed under a mortgage that is referred to in subsection (c)(3) exceeds
				the maximum amount that could be borrowed under a mortgage insured under this
				subsection that is not a mortgage referred to in such subsection, based on
				average closing costs with respect to such amount, as determined by the
				Secretary; such cost shall be expressed as an annual interest rate over the
				first 5 years of a mortgage; the disclosure required under this subclause may
				be provided in conjunction with the notice required under subsection
				(f).</text>
							</subclause></clause><clause display-inline="no-display-inline" id="H74E952EA94864E5B9DB6AE35ECA00033"><enum>(iv)</enum><header>2- and 3-family
				residences</header><text>In the case of a mortgage involving a 2- or 3-family
				residence, counseling under this subparagraph shall include (in addition to the
				information required under clause (iii)) information regarding real estate
				property management.</text>
						</clause></subparagraph><subparagraph id="H9D5EDD8521FE448A81AD253115464041"><enum>(C)</enum><header>Notice of
				foreclosure prevention counseling availability</header>
						<clause id="H8C600A77A2A84D809C5C8BC4A4B3F95E"><enum>(i)</enum><header>Written
				agreement</header><text display-inline="yes-display-inline">To be eligible for
				insurance under this subsection, the mortgagee shall provide the mortgagor, at
				the time of the execution of the mortgage, a written agreement which shall be
				signed by the mortgagor and under which the mortgagee shall provide notice
				described in clause (ii) to a housing counseling entity that has agreed to
				provide the notice and counseling required under clause (iii) and is approved
				by the Secretary.</text>
						</clause><clause id="H58EF737C8A2E41DCB96D372289D3DE05"><enum>(ii)</enum><header>Notice to
				counseling agency</header><text>The notice described in this clause, with
				respect to a mortgage, is notice, provided at the earliest time practicable
				after the mortgagor becomes 60 days delinquent with respect to any payment due
				under the mortgage, that the mortgagor is so delinquent and of how to contact
				the mortgagor. Such notice may only be provided once with respect to each
				delinquency period for a mortgage.</text>
						</clause><clause id="H9A237A1DC38342C89B84E13DB2A144DE"><enum>(iii)</enum><header>Notice to
				mortgagor</header><text>Upon notice from a mortgagee that a mortgagor is 60
				days delinquent with respect to payments due under the mortgage, the housing
				counseling entity shall at the earliest time practicable notify the mortgagor
				of such delinquency, that the entity makes available foreclosure prevention
				counseling that may assist the mortgagor in resolving the delinquency, and of
				how to contact the entity to arrange for such counseling.</text>
						</clause><clause id="HD1EAAB32C02D47FFA9DA90F4A078C841"><enum>(iv)</enum><header>Ability to
				cure</header><text>Failure to provide the written agreement required under
				clause (i) may be corrected by sending such agreement to the mortgagor not
				later than the earliest time practicable after the mortgagor first becomes 60
				days delinquent with respect to payments due under the mortgage. Insurance
				provided under this subsection may not be terminated and penalties for such
				failure may not be prospectively or retroactively imposed if such failure is
				corrected in accordance with this clause.</text>
						</clause><clause id="H4D34360381614EC000CBC14BC581A8EA"><enum>(v)</enum><header>Penalties for
				failure to provide agreement</header><text>The Secretary may establish and
				impose appropriate penalties for failure of a mortgagee to provide the written
				agreement required under clause (i).</text>
						</clause><clause id="H3390426D3CE746BB9F19264700C208C"><enum>(vi)</enum><header>Limitation on
				liability of mortgagee</header><text>A mortgagee shall not incur any liability
				or penalties for any failure of a housing counseling entity to provide notice
				under clause (iii).</text>
						</clause><clause id="HC3E1821D6E7848BD9B7062AF57816801"><enum>(vii)</enum><header>No private
				right of action</header><text>This subparagraph shall not create any private
				right of action on behalf of the mortgagor.</text>
						</clause><clause id="H54E83C9A9EF84CDBB18B1187976BB6B7"><enum>(viii)</enum><header>Delinquency
				period</header><text>For purposes of this subparagraph, the term
				<term>delinquency period</term> means, with respect to a mortgage, a period
				that begins upon the mortgagor becoming delinquent with respect to payments due
				under the mortgage and ends upon the first subsequent occurrence of such
				payments under the mortgage becoming current or the property subject to the
				mortgage being foreclosed or otherwise disposed
				of.</text>
						</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section display-inline="no-display-inline" id="H771C84B17A5345859D7F2B63287D4C00"><enum>11.</enum><header>Refinancing
			 mortgages</header><text display-inline="no-display-inline">Section 203 of the
			 National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1709">12 U.S.C. 1709</external-xref>) is amended by
			 inserting after subsection (k) the following new subsection:</text>
			<quoted-block display-inline="no-display-inline" id="H668031C2E7C04A5A8D89E164D8A36035" style="OLC">
				<subsection id="H45B422EC70804FD69519F0C24CD447F7"><enum>(l)</enum><header>Refinancing
				mortgages</header>
					<paragraph id="H51C7AE558BF24E8494170088B1E92200"><enum>(1)</enum><header>Establishment of
				underwriting standards</header><text display-inline="yes-display-inline">The
				Secretary shall establish underwriting standards that provide for insurance
				under this title of mortgage loans, and take actions to facilitate the
				availability of mortgage loans insured under this title, for qualified
				borrowers that are made for the purpose of paying or prepaying outstanding
				obligations under existing mortgages for borrowers that—</text>
						<subparagraph id="H9F3752FDF4DF408080A8731074527544"><enum>(A)</enum><text>have existing
				mortgages with adverse terms or rates, or</text>
						</subparagraph><subparagraph id="H5D45856952AF46B79278F83C00A05E00"><enum>(B)</enum><text>do not have access
				to mortgages at reasonable rates and terms for such refinancings due to adverse
				market conditions.</text>
						</subparagraph></paragraph><paragraph id="H962E56AB87CF4CCE9F8DB32B2CB06E43"><enum>(2)</enum><header>Insurance of
				mortgages to borrowers in default or at risk of default</header><text display-inline="yes-display-inline">In facilitating insurance for such
				mortgages, the Secretary may insure mortgages to borrowers who are, currently
				in default or at imminent risk of being in default, but only if such loans meet
				reasonable underwriting standards established by the
				Secretary.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H65AD58AA15854EE29353A4B2EB5DB263"><enum>12.</enum><header>Annual reports
			 on new programs and loss mitigation</header><text display-inline="no-display-inline">Section 540(b)(2) of the National Housing
			 Act (12 U.S.C.
			 1735f–18(b)(2)) is amended, by adding at the end the following
			 new subparagraphs:</text>

		</section><section id="H1633B120FFF74944B8EAACBAB86F4E"><enum>13.</enum><header>Insurance for
			 single family homes with licensed child care facilities</header>
			<subsection id="H5389D4BDBD4548139BED8F2BCCC55242"><enum>(a)</enum><header>Definition of
			 child care facility</header><text>Section 201 of the National Housing Act
			 (12 U.S.C.
			 1707) is amended by adding at the end the following new
			 subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HF8D3F8EE6C524112BB77A3A43E70DFE7" style="OLC">
					<subsection id="H01728E37E4084ED9006F8D96B78BEC36"><enum>(g)</enum><text display-inline="yes-display-inline">The term <term>child care facility</term>
				means a facility that—</text>
						<paragraph id="H63E8928664BE4912AE32F1E983AE33FB"><enum>(A)</enum><text>has as its purpose
				the care of children who are less than 12 years of age; and</text>
						</paragraph><paragraph id="HF7A58182FB4D4CC687015D33F6F28ED7"><enum>(B)</enum><text>is licensed or
				regulated by the State in which it is located (or, if there is no State law
				providing for such licensing and regulation by the State, by the municipality
				or other political subdivision in which the facility is located).</text>
						</paragraph><continuation-text continuation-text-level="subsection">Such term
				does not include facilities for school-age children primarily for use during
				normal school
				hours.</continuation-text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H182F352397424BF594023F003706F3C7"><enum>(b)</enum><header>Increase in
			 maximum mortgage amount limitation</header><text display-inline="yes-display-inline">Paragraph (2) of section 203(b) of the
			 National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1709">12 U.S.C. 1709(b)(2)</external-xref>), as amended
			 by the preceding provisions of this Act, is further amended by adding at end

				been issued for such facility as of the date of the execution of the mortgage,
				and only if such increase in the amount insured is proportional to the amount
				of space of such residence that will be used for such
				facility.</text>

			 real estate</header><text>Section 201 of the National Housing Act
			 (12 U.S.C.
			 1707), as amended by the preceding provisions of this Act, is
			 further amended by adding at the end the following new subsection:</text>

					<subsection id="H928DC41E3258437491E46CC4A4FEB01"><enum>(h)</enum><text display-inline="yes-display-inline">The term <term>real estate</term> means
				land and all natural resources and structures permanently affixed to the land,
				including residential buildings and stationary manufactured housing. The
				Secretary may not require, for treatment of any land or other property as real
				estate for purposes of this title, that such land or property be treated as
				real estate for purposes of State
				taxation.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="HE5DB1D2280114BB4BECB78F568ABD95B"><enum>17.</enum><header>Mutual Mortgage
			 Insurance Fund</header>
			<subsection id="HF24197BF348640FA9C50DFA5B7CBD982"><enum>(a)</enum><header>In
			 General</header><text>Subsection (a) of section 202 of the
			 <act-name parsable-cite="NHA">National Housing Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/12/1708">12 U.S.C. 1708(a)</external-xref>)
			 is amended to read as follows:</text>
				<quoted-block act-name="National Housing Act" id="H4DBA08A12A3746069F0031A3F834A7A2" style="OLC">
					<subsection id="H903F5B03580B43169F77915329882B87"><enum>(a)</enum><header>Mutual Mortgage
				Insurance Fund</header>
						<paragraph id="H9FE7F59A0D274F04907D35B51BD1B7A7"><enum>(1)</enum><header>Establishment</header><text>Subject
				to the provisions of the <act-name parsable-cite="FCRA90">Federal Credit Reform
				Act of 1990</act-name>, there is hereby created a Mutual Mortgage Insurance
				Fund (in this title referred to as the <quote>Fund</quote>), which shall be
				used by the Secretary to carry out the provisions of this title with respect to
				mortgages insured under section 203. The Secretary may enter into commitments
				to guarantee, and may guarantee, such insured mortgages.</text>
						</paragraph><paragraph id="H86BAAC3E3B8C4AC29DCC52F328004907"><enum>(2)</enum><header>Limit on loan
				guarantees</header><text>The authority of the Secretary to enter into
				commitments to guarantee such insured mortgages shall be effective for any
				fiscal year only to the extent that the aggregate original principal loan
				amount under such mortgages, any part of which is guaranteed, does not exceed
				the amount specified in appropriations Acts for such fiscal year.</text>
						</paragraph><paragraph id="H790CDE4E5962411F8154FFB9B635E7A"><enum>(3)</enum><header>Fiduciary
				responsibility</header><text>The Secretary has a responsibility to ensure that
				the Mutual Mortgage Insurance Fund remains financially sound.</text>
						</paragraph><paragraph id="H37058A03D13541B492004EF059C937F7"><enum>(4)</enum><header>Annual
				independent actuarial study</header><text>The Secretary shall provide for an
				independent actuarial study of the Fund to be conducted annually, which shall
				analyze the financial position of the Fund. The Secretary shall submit a report
				annually to the Congress describing the results of such study and assessing the
				financial status of the Fund. The report shall recommend adjustments to
				underwriting standards, program participation, or premiums, if necessary, to
				ensure that the Fund remains financially sound.</text>
						</paragraph><paragraph id="H7BE22B5B00544B3CBA4D246CE867B37C"><enum>(5)</enum><header>Quarterly
				reports</header><text>During each fiscal year, the Secretary shall submit a
				report to the Congress for each quarter, which shall specify for mortgages that
				are obligations of the Fund—</text>
							<subparagraph id="HAD85EB3D43C945928573FB48FB7D7720"><enum>(A)</enum><text>the cumulative
				volume of loan guarantee commitments that have been made during such fiscal
				year through the end of the quarter for which the report is submitted;</text>
							</subparagraph><subparagraph id="HAA5E5DB08F8C42E0985C3BFA8EA97BDA"><enum>(B)</enum><text>the types of loans
				insured, categorized by risk;</text>
							</subparagraph><subparagraph id="HCCD8B3FA68504BEC99E2C40231505E5"><enum>(C)</enum><text>any significant
				changes between actual and projected claim and prepayment activity;</text>
							</subparagraph><subparagraph id="HE79108517B0B4BE6A6ADAA2590DBB074"><enum>(D)</enum><text>projected versus
				actual loss rates; and</text>
							</subparagraph><subparagraph id="HC5D6D6741ABA42E3A1658197B371F22F"><enum>(E)</enum><text>updated
				projections of the annual subsidy rates to ensure that increases in risk to the
				Fund are identified and mitigated by adjustments to underwriting standards,
				program participation, or premiums, and the financial soundness of the Fund is
				maintained.</text>
							</subparagraph><continuation-text continuation-text-level="paragraph">The first
				quarterly report under this paragraph shall be submitted on the last day of the
				first quarter of fiscal year 2008, or upon the expiration of the 90-day period
				beginning on the date of the enactment of the <short-title>Expanding American Homeownership Act of
				2007</short-title>, whichever is later.</continuation-text></paragraph><paragraph id="H95A4F15548FF4DC79100C2DFB1C6BAE"><enum>(6)</enum><header>Adjustment of
				premiums</header><text>If, pursuant to the independent actuarial study of the
				Fund required under paragraph (5), the Secretary determines that the Fund is
				not meeting the operational goals established under paragraph (8) or there is a
				substantial probability that the Fund will not maintain its established target
				subsidy rate, the Secretary may either make programmatic adjustments under
				section 203 as necessary to reduce the risk to the Fund, or make appropriate
				premium adjustments.</text>
						</paragraph><paragraph id="H21CC08AB23BB4A3F84CB9BBED6BDC49F"><enum>(7)</enum><header>Operational
				goals</header><text>The operational goals for the Fund are—</text>
							<subparagraph id="H5DF3FED2363F416E9F1213BFEB07ABF"><enum>(A)</enum><text>to charge borrowers
				under loans that are obligations of the Fund an appropriate premium for the
				risk that such loans pose to the Fund;</text>
							</subparagraph><subparagraph id="H5E9B6A2C8DE64627805E75CE2C0BC64"><enum>(B)</enum><text>to minimize the
				default risk to the Fund and to homeowners;</text>
							</subparagraph><subparagraph id="H2D124C32C6304690817B100952482570"><enum>(C)</enum><text>to curtail the
				impact of adverse selection on the Fund; and</text>
							</subparagraph><subparagraph id="H5D485AF3231D41919BCFA679D36BCD4D"><enum>(D)</enum><text>to meet the
				housing needs of the borrowers that the single family mortgage insurance
				program under this title is designed to
				serve.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H9CD1ECF68A20475D982B97591680648F"><enum>(b)</enum><header>Obligations of
			 Fund</header><text>The <act-name parsable-cite="NHA">National Housing
			 Act</act-name> is amended as follows:</text>

			 is amended by striking <quote>the Trust Territory of the Pacific
			 Islands</quote> and inserting <quote>the Commonwealth of the Northern Mariana
			 Islands</quote>.</text>
			</subsection></section><section id="H3E57A7AF24894A139FC8C5087EB873C0"><enum>20.</enum><header>Home equity
			 conversion mortgages</header>
			<subsection id="H7E5DBF1FB2294F26A90648F8BA5C7CA8"><enum>(a)</enum><header>In
			 General</header><text>Section 255 of the <act-name parsable-cite="NHA">National
			 Housing Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/12/1715z-20">12 U.S.C. 1715z–20</external-xref>) is
			 amended—</text>
				<paragraph display-inline="no-display-inline" id="HFF466F944C2F4A869C97E3033418951D"><enum>(1)</enum><text>in subsection
			 (b)(2), insert <quote><quote>real estate,</quote></quote> after
			 <quote><quote>mortgagor</quote>,</quote>;</text>
				</paragraph><paragraph display-inline="no-display-inline" id="HC79919F25DC3474F9B2458DAFC2660DD"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b)(4), by striking
			 subparagraph (B) and inserting the following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="HB94510B838664C1C9BFD25478CE16516" style="OLC">
						<subparagraph id="HA97CE0E3445D4C71AB42F28FF00C007"><enum>(B)</enum><text display-inline="yes-display-inline">under a lease that has a term that ends no
				earlier than the minimum number of years, as specified by the Secretary, beyond
				the actuarial life expectancy of the mortgagor or comortgagor, whichever is the
				later
				date.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H6A3591BB22904827846C00AB6DFDD19F"><enum>(3)</enum><text>in subsection
			 (g)—</text>
					<subparagraph id="H0495366D0A974A91A77FE29BCA092DFA"><enum>(A)</enum><text>by striking the
			 first sentence; and</text>
					</subparagraph><subparagraph id="H257FDE6A07BC4A40AB6BC5A4B09F00F6"><enum>(B)</enum><text>by striking
			 <quote>established under section 203(b)(2)</quote> and all that follows through
			 <quote>located</quote> and inserting <quote>limitation established under
			 section 305(a)(2) of the <act-name parsable-cite="FHLMCA">Federal Home Loan
			 Mortgage Corporation Act</act-name> for a 1-family residence</quote>;</text>
					</subparagraph></paragraph><paragraph id="H63CE18215B1A414D00D13C60B59347CE"><enum>(4)</enum><text>in subsection
			 (i)(1)(C), by striking <quote>limitations</quote> and inserting
			 <quote>limitation</quote>; and</text>
				</paragraph><paragraph id="HB0399C151AF44AB8A48F578900D8CBB2"><enum>(5)</enum><text>by adding at the
			 end the following new subsection:</text>
					<quoted-block id="H34C3F0E1DFFE4C93AA63B154DD2CA597" style="OLC">
						<subsection id="HF59798CA590845B3B1EC922B786E5F46"><enum>(o)</enum><header>Authority To
				Insure Home Purchase Mortgage</header>
							<paragraph id="H30699D06E4C44EEF86F272C7E6F8A855"><enum>(1)</enum><header>In
				general</header><text>Notwithstanding any other provision in this section, the
				Secretary may insure, upon application by a mortgagee, a home equity conversion
				mortgage upon such terms and conditions as the Secretary may prescribe, when
				the primary purpose of the home equity conversion mortgage is to enable an
				elderly mortgagor to purchase a 1- to 4-family dwelling in which the mortgagor
				will occupy or occupies one of the units.</text>
							</paragraph><paragraph id="HF26A1BCC45A94D2FA8407DDBA4E1AB07"><enum>(2)</enum><header>Limitation on
				principal obligation</header><text>A home equity conversion mortgage insured
				pursuant to paragraph (1) shall involve a principal obligation that does not
				exceed the dollar amount limitation determined under section 305(a)(2) of the
				<act-name parsable-cite="FHLMCA">Federal Home Loan Mortgage Corporation
				Act</act-name> for a residence of the applicable
				size.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H807E8D50A67D4DE3AE8C372B7B3F7630"><enum>(b)</enum><header>Mortgages for
			 Cooperatives</header><text>Subsection (b) of section 255 of the
			 <act-name parsable-cite="NHA">National Housing Act</act-name> (12 U.S.C.
			 1715z–20(b)) is amended—</text>
				<paragraph id="H6DD469FBA14742C5BC518F19D3B4B711"><enum>(1)</enum><text>in paragraph
			 (4)—</text>
					<subparagraph id="H7EA8E1EC7C71472587CAE0F9A4601333"><enum>(A)</enum><text>by inserting
			 <quote>a first or subordinate mortgage or lien</quote> before <quote>on all
			 stock</quote>;</text>
					</subparagraph><subparagraph id="H7EB49BE095474EC29B1700263F781959"><enum>(B)</enum><text>by inserting
			 <quote>unit</quote> after <quote>dwelling</quote>; and</text>
					</subparagraph><subparagraph id="HBA7F317086BB4B6BB1DBADE9A6472BF"><enum>(C)</enum><text>by inserting
			 <quote>a first mortgage or first lien</quote> before <quote>on a
			 leasehold</quote>; and</text>
					</subparagraph></paragraph><paragraph id="HC1245008064F4E3BA6EBE3BFA8856B00"><enum>(2)</enum><text>in paragraph (5),
			 by inserting <quote>a first or subordinate lien on</quote> before <quote>all
			 stock</quote>.</text>
				</paragraph></subsection><subsection id="HE190CA3D783F4F7F99297EA71E724B3C"><enum>(c)</enum><header>Limitation on
			 origination fees</header><text>Section 255 of the National Housing Act
			 (12 U.S.C.
			 1715z–20), as amended by the preceding provisions of this
			 section, is further amended—</text>
				<paragraph id="H0999D3A48B1F418E9400833D36D638BA"><enum>(1)</enum><text>by redesignating
			 subsections (k), (l), and (m) as subsections (l), (m), and (n), respectively;
			 and</text>
				</paragraph><paragraph id="HB97AACA8DAA9480A80BC8D16E5FFD49B"><enum>(2)</enum><text>by inserting after
			 subsection (j) the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="H34979EFD7C4941B6BB93247ECE332564" style="OLC">
						<subsection id="H561223F74F714AD99492E18536FA15F3"><enum>(k)</enum><header>Limitation on
				origination fees</header><text display-inline="yes-display-inline">The
				Secretary shall establish limits on the origination fee that may be charged to
				a mortgagor under a mortgage insured under this section, which limitations
				shall—</text>
							<paragraph id="H79E76FB4A59648659BB81D1EC673F02"><enum>(1)</enum><text display-inline="yes-display-inline">equal to 1.5 percent of the maximum claim
				amount of the mortgage, except that the Secretary may adjust the limitation
				under this paragraph on the basis of an analysis of:</text><subparagraph commented="no" display-inline="yes-display-inline" id="HC3F9B9B444484E16A8315E9C08A4FAA6"><enum>(A)</enum><text>costs to mortgagors;
				and</text><clause commented="no" display-inline="yes-display-inline" id="H743578398DAB438ABBF157BAAB534329"><enum>(B)</enum><text>the
				impact on the reverse mortgage market;</text>
									</clause></subparagraph></paragraph><paragraph id="HE204BEE665614F41BDC04EE48900EFFA"><enum>(2)</enum><text>be subject to a
				minimum allowable amount;</text>
							</paragraph><paragraph id="H5F01A217F0704CAE8EF4C77DC5325B59"><enum>(3)</enum><text>provide that the
				origination fee may be fully financed with the mortgage;</text>
							</paragraph><paragraph id="H1F9C1B5376AC4D22B8675D34CB417EC5"><enum>(4)</enum><text>include any fees
				paid to correspondent mortgagees approved by the Secretary or to mortgage
				brokers; and</text>
							</paragraph><paragraph id="H9F184ABB004F462C98805F9B30007DEF"><enum>(5)</enum><text display-inline="yes-display-inline">apply beginning upon the date that the
				maximum dollar amount limitation on the benefits of insurance under this
				section is first increased pursuant to the amendments made by section 19(a)(2)
				of the <short-title>Expanding American Homeownership Act
				of
				2007</short-title>.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H2E151D039EAB4FF5A52CFAAAD8D148B1"><enum>(d)</enum><header>Study Regarding
			 Mortgage Insurance Premiums</header><text>The Secretary of Housing and Urban
			 Development shall conduct a study regarding mortgage insurance premiums charged
			 under the program under section 255 of the <act-name parsable-cite="NHA">National Housing Act</act-name> (12 U.S.C.
			 1715z–20) for insurance of home equity conversion mortgages to
			 analyze and determine the effects of reducing the amounts of such premiums from
			 the amounts charged as of the date of the enactment of this Act on: (1) costs
			 to mortgagors; and (2) the financial soundness of the program. Not later than
			 the expiration of the 12-month period beginning on the date of the enactment of
			 this Act, the Secretary shall submit a report to the Congress setting forth the
			 results and conclusions of the study.</text>
			</subsection></section><section id="HF62CD0820BA746C8998D8E1C07E2E499"><enum>21.</enum><header>Participation of
			 mortgage brokers and correspondent lenders</header>
			<subsection id="H47C48F43CFB6469FA08DD9556598EDA6"><enum>(a)</enum><header>In
			 general</header>
				<paragraph id="HD4FAC3265257422CAD8405D928D81714"><enum>(1)</enum><header>Definitions</header>
					<subparagraph id="H1202CF14FC5C48F98BBB8B4614425C52"><enum>(A)</enum><header>In
			 general</header><text>Section 201 of the <act-name parsable-cite="NHA">National
			 Housing Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/12/1707">12 U.S.C. 1707</external-xref>), as amended by the
			 preceding provisions of this Act, is further amended—</text>
						<clause id="H2A4D39714DDA487C92C011E656325BD4"><enum>(i)</enum><text>by
			 striking <quote>As used in section 203 of this title—</quote> and inserting
			 <quote>As used in this title and for purposes of participation in insurance
			 programs under this title, except as specifically provided otherwise, the
			 following definitions shall apply:</quote>;</text>
						</clause><clause id="H02A6D1D0A5B74571B27EE2B32300E5E0"><enum>(ii)</enum><text>by
			 striking subsection (b) and inserting the following:</text>
							<quoted-block id="H448B0D233AA14774AF07DD878C59088D" style="OLC">
								<paragraph id="HAA787EAD1B1344A78BE2741FDBEBAE10"><enum>(2)</enum><text>The term
				<term>mortgagee</term> means any of the following entities, and its successors
				and assigns, to the extent such entity is approved by the Secretary:</text>
									<subparagraph id="H30F2FADDB7434954AD90AC23CA56E600"><enum>(A)</enum><header>Qualification by
				audit and net worth</header><text display-inline="yes-display-inline">A lender
				who—</text>
										<clause id="HD31C2D0C7862494DA0DA87DD46552A0"><enum>(i)</enum><text>closes a mortgage
				in its name and underwrites the mortgage, services the mortgage, or both
				underwrites and services the mortgage;</text>
										</clause><clause id="H9F38A283AFA246B7AFAC5918D1966AB"><enum>(ii)</enum><text>submits to the
				Secretary such financial audits performed in accordance with the standards for
				financial audits of the Government Auditing Standards issued by the Comptroller
				General of the United States;</text>
										</clause><clause id="HD479C45F6DFD4D8A83A9C1E3D52F63B4"><enum>(iii)</enum><text>meet the minimum
				net worth requirement that the Secretary shall establish;</text>
										</clause><clause display-inline="no-display-inline" id="H392C3C10D0E4432DBAEAEF1F3B45DC23"><enum>(iv)</enum><text display-inline="yes-display-inline">is licensed, under the laws of the State in
				which the property that is subject to the mortgage is located, to act as a
				lender in such State; and</text>
										</clause><clause id="HF28255641F07486A9B2865EEA15FE08"><enum>(v)</enum><text>complies with such
				other requirements as the Secretary may establish.</text>
										</clause></subparagraph><subparagraph id="H970BF8A332C84BA2B5B1E03DF888A297"><enum>(B)</enum><header>Qualification of
				correspondent lenders by surety bond</header><text>Except as provided in
				subparagraph (D), a correspondent lender who—</text>
										<clause id="HC32845A499514904A69671FC083CE2B2"><enum>(i)</enum><text>closes a mortgage
				in its name, but does not underwrite and does not service the mortgage;</text>
										</clause><clause display-inline="no-display-inline" id="HF7CC24A98F6E41F6A9D25F0056EF2455"><enum>(ii)</enum><text>is licensed,
				under the laws of the State in which the property that is subject to the
				mortgage is located, to act as a correspondent lender in such State;</text>
										</clause><clause id="HFA9930DF269B4B9BAE6CBB0781A20000"><enum>(iii)</enum><text>posts a surety
				bond, in lieu of any requirement to provide audited financial statements or
				meet a minimum net worth requirement, that—</text>
											<subclause id="HF4D3BA357C5B47B8835E3736DE276FAF"><enum>(I)</enum><text>is in a form
				satisfactory to the Secretary;</text>
											</subclause><subclause id="H5A76CD7EFADA49AEA3FA6BB8DE8C6327"><enum>(II)</enum><text display-inline="yes-display-inline">is in an aggregate amount, to be determined
				by the Secretary based on the aggregate principal amount of single-family
				mortgages insured under this title that are placed in a calendar year, which
				shall not be less than $50,000 or more than $100,000, as such amount is
				adjusted annually by the Secretary (as determined by the Secretary) by the
				change for such year in the Consumer Price Index for All Urban Consumers
				published monthly by the Bureau of Labor Statistics of the Department of
				Labor;</text>
											</subclause><subclause id="HBE421CCB9BFF413ABDB726581049D440"><enum>(III)</enum><text display-inline="yes-display-inline">guarantees payment of any liability of the
				correspondent lender arising from its participation in the program, up to the
				penal sum of the surety bond; without regard to the number of years the bond
				remains in effect, the number of claims or claimants, and the number of
				premiums paid, in no event shall the aggregate liability of the surety exceed
				the penal sum of the bond; and</text>
											</subclause><subclause id="HBF4A337050AC40E5879F126818E6B240"><enum>(IV)</enum><text>may be cancelled
				by the surety as to future liability by giving 30 days notice in writing to the
				Secretary, except that any such cancellation shall not alter the liability of
				the surety for actions of the correspondent lender prior to the effective date
				of the cancellation; and</text>
											</subclause></clause><clause id="H5BBB0B9E5CEA4B4D89A44EC3B8C750CE"><enum>(iv)</enum><text display-inline="yes-display-inline">complies with such other requirements as
				the Secretary may establish, except that the Secretary shall not require any
				minimum net worth or certified financial statements.</text>
										</clause></subparagraph><subparagraph id="HB9EDF5FBC4744EFFB8A828ED1969DAD4"><enum>(C)</enum><header>Qualification of
				brokers by surety bond</header><text>Except as provided in subparagraph (D), a
				mortgage broker who—</text>
										<clause id="HC7A4CE3A695446A995B2008695C651C"><enum>(i)</enum><text>closes the mortgage
				in the name of the lender, and does not underwrite and does not service the
				mortgage;</text>
										</clause><clause id="H913D2437B9F64290A8AD63C564F9FB00"><enum>(ii)</enum><text>is licensed,
				under the laws of the State in which the property that is subject to the
				mortgage is located, to act as a mortgage broker in such State;</text>
										</clause><clause id="H6FA6F07765E0408A8CE788E864B8F429"><enum>(iii)</enum><text>posts a surety
				bond in accordance with the requirements of subparagraph (B)(ii); and</text>
										</clause><clause id="H3EA698C904414D168C8655FE0085A054"><enum>(iv)</enum><text display-inline="yes-display-inline">complies with such other requirements as
				the Secretary may establish, except that the Secretary shall not require any
				minimum net worth or certified financial statements.</text>
										</clause></subparagraph><subparagraph id="H2F13E44EF6AB45CCA55EC85FC49254AE"><enum>(D)</enum><header>Conditions for
				continued applicability</header><clause commented="no" display-inline="yes-display-inline" id="H3FB899FE23ED4079860922A9F6BBA00"><enum>(i)</enum><text>Subparagraphs (B) and (C)
				shall continue to apply after the expiration of the 5-year period beginning on
				the date of the enactment of the <short-title>Expanding
				American Homeownership Act of 2007</short-title> only if, after the expiration
				of the 4-year period beginning upon such date of enactment and taking into
				consideration the report submitted in accordance with section 19(b) of such
				Act, the Secretary—</text>
											<subclause id="H54E8E59F3B6046A9B5F203EB12AD3049" indent="up1"><enum>(I)</enum><text>makes a determination that such
				subparagraphs provide protection to mortgage insurance funds for mortgages
				insured under this title that are comparable to the protection provided by the
				requirements for mortgagees under this title as in effect immediately before
				the enactment of such Act; and</text>
											</subclause><subclause id="H54DB218F53F74A118E51CC9C31E71D3" indent="up1"><enum>(II)</enum><text>publishes in the Federal Register a
				notice of such determination and an order extending the applicability of such
				subparagraphs.</text>
											</subclause></clause><clause id="H6C991B7C599F41FD96708E6EF69C7E2" indent="up1"><enum>(ii)</enum><text>If, taking into consideration such
				report, the Secretary makes a determination after the expiration of such 4-year
				period that subparagraphs (B) and (C) do not provide protection as referred to
				in clause (i) of this subparagraph, the Secretary may, by order published in
				the Federal Register, provide for the participation, after the expiration of
				the 5-year period referred to in clause (i), of correspondent lenders and
				mortgage brokers as mortgagees in the insurance programs under this title in
				accordance with subparagraphs (B) and (C) as modified by the Secretary as the
				Secretary considers appropriate to provide such protection.</text>
										</clause></subparagraph><subparagraph display-inline="no-display-inline" id="H857935C1D4134F8CBFA54C46F500D4A0"><enum>(E)</enum><header>Additional
				mortgage broker requirements</header>
										<clause id="H682EDAE830AA4D538C613D4382B8EC5"><enum>(i)</enum><text>In
				addition to the requirements under subparagraphs (A) and (C) and to duties
				imposed under other statutes or common law, to be eligible as a mortgagee under
				this section, a broker shall—</text>
											<subclause id="HBA1B061B2A1D4B5EA2F0F075E5658261"><enum>(I)</enum><text display-inline="yes-display-inline">safeguard and account for any money handled
				for the borrower;</text>
											</subclause><subclause id="HECE005CF1A0149A398332310E26EB163"><enum>(II)</enum><text>follow reasonable
				and lawful instructions from the borrower; and</text>
											</subclause><subclause id="H54BC76F65F2B46698417009ED5740705"><enum>(III)</enum><text>act with
				reasonable skill, care, and diligence.</text>
											</subclause></clause><clause id="H0FE40BA05E4B41ACABA39BE68424CDF"><enum>(ii)</enum><text>For purposes of
				this subparagraph, a loan correspondent shall be considered to be a mortgage
				broker.</text>
										</clause><clause id="H75F7A7200CEB41B2B1B95F00BC3F8D76"><enum>(iii)</enum><text>The duties and
				standards of care created in this subparagraph shall not be waived or
				modified.</text>
										</clause><clause id="H03641A2569E248939F2B4C12B638B53C"><enum>(iv)</enum><text>Any broker found
				by the Secretary to have violated the requirements of this subparagraph may not
				originate mortgage loans insured under this title.</text>
										</clause></subparagraph></paragraph><paragraph id="H84DE59D04C1F47228F9B07C83178028"><enum>(3)</enum><text>The term
				<term>mortgagor</term> includes the original borrower under a mortgage and the
				successors and assigns of the original
				borrower.</text>
								</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</clause><clause id="HAC237C7F019C422F8CB21D93C0CC2CDC"><enum>(iii)</enum><text>by
			 redesignating subsections (a), (c), (d), (e), (f), (g), and (h) as paragraphs
			 (1), (4), (5), (6), (7), (8), and (9), respectively, and indenting such
			 paragraphs two ems so as to align the left margins of such paragraphs with the
			 left margins of paragraphs (2) and (3) (as added by clause (ii) of this
			 subparagraph).</text>
						</clause></subparagraph><subparagraph id="H2AB93C6489264A1597810553A8584DA4"><enum>(B)</enum><header>Mortgagee
			 review</header><text>Section 202(c)(7) of the <act-name parsable-cite="NHA">National Housing Act</act-name> (12 U.S.C.
			 1708(c)(7)) is amended—</text>
						<clause id="H771ECB3FF932470782BB5019555E71B3"><enum>(i)</enum><text>in
			 subparagraph (A), by inserting <quote>, as defined in section 201,</quote>
			 after <quote>mortgagee</quote>;</text>
						</clause><clause id="H3E6C857C938E4D759127624971B2A8A2"><enum>(ii)</enum><text>by
			 striking subparagraph (B); and</text>

			 1713(a)(2)) is amended by striking <quote>means the original
			 lender under a mortgage, and its successors and assigns, and</quote> and
			 inserting <quote>has the meaning given such term in section 201, except that
			 such term also</quote>.</text>
					</subparagraph><subparagraph id="HBBF467EE1F5E420AA3F5D5BB6498B86E"><enum>(D)</enum><header>War housing
			 insurance</header><text>Section 601(b) of the <act-name parsable-cite="NHA">National Housing Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/12/1736">12 U.S.C. 1736(b)</external-xref>)
			 is amended by striking <quote>includes the original lender under a mortgage,
			 and his successors and assigns approved by the Secretary</quote> and inserting
			 <quote>has the meaning given such term in section 201</quote>.</text>
					</subparagraph><subparagraph id="HCF01653CD08046F8A6BD76964BEA36CB"><enum>(E)</enum><header>Armed services
			 housing mortgage insurance</header><text>Section 801(b) of the
			 <act-name parsable-cite="NHA">National Housing Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/12/1748">12 U.S.C. 1748(b)</external-xref>)
			 is amended by striking <quote>includes the original lender under a mortgage,
			 and his successors and assigns approved by the Secretary</quote> and inserting
			 <quote>has the meaning given such term in section 201</quote>.</text>
					</subparagraph><subparagraph id="H242BD37E8D174EA5A3FD1804C767C22D"><enum>(F)</enum><header>Group practice
			 facilities mortgage insurance</header><text>Section 1106(8) of the
			 <act-name parsable-cite="NHA">National Housing Act</act-name> (12 U.S.C.
			 1749aaa–5(8)) is amended by striking <quote>means the original
			 lender under a mortgage, and his or its successors and assigns, and</quote> and
			 inserting <quote>has the meaning given such term in section 201, except that
			 such term also</quote>.</text>
					</subparagraph></paragraph><paragraph id="H1DF3FCBD4D534213A6292750BFBB3734"><enum>(2)</enum><header>Eligibility for
			 Insurance</header>
					<subparagraph id="H75A2AD5BC1154CCC92214B0732282981"><enum>(A)</enum><header>Title
			 i</header><text>Paragraph (1) of section 8(b) of the
			 <act-name parsable-cite="NHA">National Housing Act</act-name> (12 U.S.C.
			 1706c(b)(1)) is amended—</text>
						<clause id="HBA295BBBBE52492291EED5F356847975"><enum>(i)</enum><text>by

						</clause></subparagraph><subparagraph id="HAEE6F49D021D4CC59D00BB61EA7C2750"><enum>(I)</enum><header>Contingent
			 repeal</header><text display-inline="yes-display-inline">Unless there is
			 published in the Federal Register, before the expiration of the 5-year period
			 beginning on the date of the enactment of this Act, an order under clause (i)
			 or (ii) of section 201(2)(D) of the National Housing Act (12 U.S.C.
			 1707(2)(D)), as added by paragraph (1)(A)(2) of this
			 subsection, upon the expiration of such period the provisions of such Act
			 amended by this paragraph are amended to read as such provisions would be in
			 effect upon such expiration if this Act had not been enacted (taking into
			 consideration any amendments, after such date of enactment, to such provisions
			 other than under this Act).</text>
					</subparagraph></paragraph></subsection><subsection id="HAAE14251E1DD457FB24EBAAEEDB23213"><enum>(b)</enum><header>GAO study and
			 report</header>
				<paragraph id="HFF39EE436AE0444292A1CBD122DD6FB3"><enum>(1)</enum><header>Study</header><text display-inline="yes-display-inline">The Comptroller General of the United
			 States shall conduct a study, upon the expiration of the 42-month period
			 beginning on the date of the enactment of this Act, regarding the effect of the
			 amendments made by subsection (a), which shall analyze and determine—</text>
					<subparagraph id="HEE4E7BFC0166483AACF466FDF4857D3F"><enum>(A)</enum><text display-inline="yes-display-inline">the extent to which such amendments have
			 resulted in increased participation, by mortgage brokers and correspondent
			 lenders, in the mortgage insurance programs under the National Housing Act, as
			 measured by the number and amounts of such insured mortgages, disaggregated by
			 the States in which the properties subject to such mortgages are
			 located;</text>
					</subparagraph><subparagraph id="HDE3BB59C48254D2DB3E8D352207330CD"><enum>(B)</enum><text display-inline="yes-display-inline">with respect to mortgages insured under
			 such Act, a comparison in the numbers and rate of defaults, foreclosures, and
			 mortgage insurance claims on such mortgages originated by mortgage brokers and
			 correspondent lenders authorized to participate in the programs under such Act
			 pursuant to the amendments made by subsection (a) to such numbers and rates on
			 such mortgages originated by lenders who would be authorized to participate in
			 such programs notwithstanding such amendments;</text>
					</subparagraph><subparagraph id="HC4DBFCEC5EFD4BE9B5636B91CE6F2E27"><enum>(C)</enum><text display-inline="yes-display-inline">any impact of such amendments on the costs
			 to the Secretary of Housing and Urban Development of administering the mortgage
			 insurance programs under such title; and</text>
					</subparagraph><subparagraph id="H4E994D42D68F452CB6BF1DBEA907E2EB"><enum>(D)</enum><text>the extent and
			 effectiveness of the supervision and enforcement, by the Secretary, of the
			 additional authority provided under the amendments made by subsection
			 (a).</text>
					</subparagraph></paragraph><paragraph id="H3E147E0A69584221B6229D54CFD07E13"><enum>(2)</enum><header>Report</header><text>Not
			 later than the expiration of 4-year period beginning on the date of the
			 enactment of this Act, the Comptroller General shall submit a report to the
			 Congress and the Secretary of Housing and Urban Development setting forth the
			 results and conclusions of the study conducted pursuant to paragraph
			 (1).</text>
				</paragraph></subsection></section><section id="H545019A77FD94D2EB86F99DC26D9467C"><enum>22.</enum><header>Conforming loan
			 limit in disaster areas</header><text display-inline="no-display-inline">Section 203(h) of the
			 <act-name parsable-cite="NHA">National Housing Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/12/1709">12 U.S.C. 1709</external-xref>) is
			 amended—</text>
			<paragraph id="H7BB8C39227D54719A365963518B9DEA6"><enum>(1)</enum><text>by inserting after
			 <quote>property</quote> the following: <quote>plus any initial service charges,
			 appraisal, inspection and other fees in connection with the mortgage as
			 approved by the Secretary,</quote>;</text>
			</paragraph><paragraph id="H642BB0F38ED44AB6AE404FE205C2A43C"><enum>(2)</enum><text>by striking the
			 second sentence (as added by chapter 7 of the Emergency Supplemental
			 Appropriations Act of 1994 (Public Law
			 103–211; 108 Stat. 12)); and</text>
			</paragraph><paragraph id="H182FE79A7F7145FB9583C29E9137FE2F"><enum>(3)</enum><text>by adding at the
			 end the following new sentence: <quote>In any case in which the single family
			 residence to be insured under this subsection is within a jurisdiction in which
			 the President has declared a major disaster to have occurred, the Secretary is
			 authorized, for a temporary period not to exceed 36 months from the date of
			 such Presidential declaration, to enter into agreements to insure a mortgage
			 which involves a principal obligation of up to 100 percent of the dollar
			 limitation determined under section 305(a)(2) of the
			 <act-name parsable-cite="FHLMCA">Federal Home Loan Mortgage Corporation
			 Act</act-name> for a single family residence, and not in excess of 100 percent
			 of the appraised value of the property plus any initial service charges,
			 appraisal, inspection and other fees in connection with the mortgage as
			 approved by the Secretary.</quote>.</text>
			</paragraph></section><section display-inline="no-display-inline" id="H32C07413F9BD41FEBC9401DD45120011" section-type="subsequent-section"><enum>23.</enum><header>Failure to pay
			 amounts from escrow accounts for single family mortgages</header>
			<subsection id="H98C53BC9493848B280E2A47B81E3F503"><enum>(a)</enum><header>Penalties</header><text>Section
			 536 of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1735f-14">12 U.S.C. 1735f–14</external-xref>) is
			 amended—</text>
				<paragraph id="H24DF6A2AAABF43A685DF3F21C8BABE00"><enum>(1)</enum><text>in subsection
			 (a)(1), by inserting <quote>servicers (including escrow account
			 servicers),</quote> after <quote>appraisers,</quote>;</text>
				</paragraph><paragraph id="HEE74182916F14D08BE70FF69E6D4AAE9"><enum>(2)</enum><text>in subsection
			 (b)(1)—</text>
					<subparagraph id="H9A9CFB015E544C0A8472DCFAE82D72EC"><enum>(A)</enum><text>in the matter
			 preceding subparagraph (A), by inserting <quote>or other participant referred
			 to in subsection (a),</quote> after <quote>lender,</quote>; and</text>
					</subparagraph><subparagraph id="H1300BC0BBD164E5BBDD257EC0047612C"><enum>(B)</enum><text>by inserting at
			 the end the following new subparagraphs:</text>
						<quoted-block display-inline="no-display-inline" id="H929CB2F2A1CC4728A9C5D53634EE51E4" style="OLC">
							<subparagraph id="H34207983DEDE4A76836FA2E749F29738"><enum>(K)</enum><text display-inline="yes-display-inline">In the case of a mortgage for a 1- to
				4-family residence insured under title II that requires the mortgagor to make
				payments to the mortgagee or other servicer of the mortgage for deposit into an
				escrow account for the purpose of assuring payment of taxes, insurance
				premiums, and other charges with respect to the property, failure on the part
				of the servicer to make any such payment from the escrow account by the
				deadline to avoid a penalty with respect to such payment provided for in the
				mortgage, unless the servicer was not provided notice of such deadline.</text>
							</subparagraph><subparagraph id="H5FE71DB28BFE4EE1A7026DDAB37E3D6"><enum>(L)</enum><text>In the case of any
				failure to make any payment as described in subparagraph (K), submitting any
				information to a consumer reporting agency (as such term is defined in section
				603(f) of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681a">15 U.S.C. 1681a(f)</external-xref>)) regarding
				such failure that is adverse to the credit rating or interest of the
				mortgagor.</text>
							</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HE0ADA70D14CD4DFB9B95165BE5FA1166"><enum>(3)</enum><text>in subsection
			 (c)(3), by adding at the end the following: <quote>In the case of any failure
			 to make a payment described in subsection (b)(1)(K) for which the servicer
			 fails to reimburse the mortgagor (A) before the expiration of the 60-day period
			 beginning on the deadline to avoid a penalty with respect to such payment, in
			 the sum of the amount not paid from the escrow account by such deadline and the
			 amount of any penalties accruing to the mortgagor that are attributable to such
			 failure, or (B) in the amount of any attorneys fees incurred by the mortgagor
			 and attributable to such failure, the Secretary shall increase the amount of
			 the penalty under subsection (a) for any such failure to reimburse, unless the
			 Secretary determines there are mitigating circumstances.</quote>.</text>
				</paragraph></subsection><subsection id="H36D63337A2CD4666AD57EAB654285891"><enum>(b)</enum><header>Prohibition on
			 submission of information by HUD</header><text>Title II of the National Housing
			 Act (12 U.S.C. 1707
			 et seq.) is amended by adding at the end the following new
			 section:</text>
				<quoted-block display-inline="no-display-inline" id="H1485F7ED3C4A4AF8B26ED83344886821" style="OLC">
					<section id="H1A27E24F55C246978195272D40E995BC"><enum>257.</enum><header>Prohibition
				regarding failure on part of servicer to make escrow payments</header><text display-inline="no-display-inline">In the case of any failure to make any
				payment as described in section 536(b)(1)(K), the Secretary may not submit any
				information to a consumer reporting agency (as such term is defined in section
				603(f) of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681a">15 U.S.C. 1681a(f)</external-xref>)) regarding
				such failure that is adverse to the credit rating or interest of the
				mortgagor.</text>
					</section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H34C55796DFA44BFA83A10245C517BFBE"><enum>24.</enum><header>Acceptable
			 identification for FHA mortgagors</header>
			<subsection id="H142C611EE7FD4AB283036C50A6EAA7C4"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Title II of the
			 National Housing Act is amended by inserting after section 209 (<external-xref legal-doc="usc" parsable-cite="usc/12/1715">12 U.S.C. 1715</external-xref>) the
			 following new section:</text>
				<quoted-block display-inline="no-display-inline" id="H4BBB23F2A48D40FA97717570713CAEF5" style="OLC">
					<section id="H63B44158B4EB469CA34000FA287D2CC"><enum>210.</enum><header>Forms of
				acceptable identification</header><text display-inline="no-display-inline">The
				Secretary may not insure a mortgage under any provision of this title unless
				the mortgagor under the mortgage provides personal identification in one of the
				following forms:</text>
						<paragraph id="H6CEF94960370482580D91C87656B829F"><enum>(1)</enum><header>Social security
				card with photo identification card or Real ID Act identification</header>
							<subparagraph id="H8EEC4DF9BF4B47B58783EA7349EACD4"><enum>(A)</enum><text>A social security
				card accompanied by a photo identification card issued by the Federal
				Government or a State Government; or</text>
							</subparagraph><subparagraph id="H5F1CD4B3C8F44421913351B4C0FCD95C"><enum>(B)</enum><text>A driver’s license
				or identification card issued by a State in the case of a State that is in
				compliance with title II of the REAL ID Act of 2005 (title II of division B of
				Public Law
				109–13;
				49 U.S.C.
				30301 note).</text>
							</subparagraph></paragraph><paragraph id="H08BB2552ED744B6CBA8B9ECBB00CED5"><enum>(2)</enum><header>Passport</header><text>A
				passport issued by the United States or a foreign government.</text>
						</paragraph><paragraph id="H3AF857B169864F388CD266F9F781E86"><enum>(3)</enum><header>USCIS photo
				identification card</header><text>A photo identification card issued by the
				Secretary of Homeland Security (acting through the Director of the United
				States Citizenship and Immigration
				Services).</text>
						</paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H10A3B97E5CE442A7AEC71E631E0795B4"><enum>(b)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The requirements of
			 section 210 of the National Housing Act (as added by subsection (a) of this
			 section) shall take effect 6 months after the date of the enactment of this
			 Act.</text>
			</subsection></section><section id="H4BA4E5D8370446F9AA133CF42F76CD4B"><enum>25.</enum><header>Pilot program
			 for automated process for borrowers without sufficient credit history</header>
			<subsection id="H19AF2F1473DF41059D4803EC6F392953"><enum>(a)</enum><header>Establishment</header><text>Title
			 II of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1707">12 U.S.C. 1707 et seq.</external-xref>), as amended
			 by the preceding provisions of this Act, is further amended by adding at the
			 end the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="HBD94184629FB41B69C00275FBDBECE7D" style="OLC">
					<section id="HEA929A3C6C3F4619A3A27C44C675F8F8"><enum>258.</enum><header>Pilot program
				for automated process for borrowers without sufficient credit history</header>
						<subsection id="H4FC788E8F6964CA6BDCC97D04BB33110"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary shall carry out a pilot
				program to establish, and make available to mortgagees, an automated process
				for providing alternative credit rating information for mortgagors and
				prospective mortgagors under mortgages on 1- to 4-family residences to be
				insured under this title who have insufficient credit histories for determining
				their creditworthiness. Such alternative credit rating information may include
				rent, utilities, and insurance payment histories, and such other information as
				the Secretary considers appropriate.</text>
						</subsection><subsection id="H43D8DA1EF32643B5912DA786F499DCE"><enum>(b)</enum><header>Scope</header><text>The
				Secretary may carry out the pilot program under this section on a limited basis
				or scope, and may consider limiting the program—</text>
							<paragraph id="H927982644ECB48ECBFAE001967687E05"><enum>(1)</enum><text>to first-time
				homebuyers; or</text>
							</paragraph><paragraph id="H3FF126006B13478FA446EAB7E00947F0"><enum>(2)</enum><text>metropolitan
				statistical areas significantly impacted by subprime lending.</text>
							</paragraph></subsection><subsection id="H446D025B5EF94159B6274EEC34D51B18"><enum>(c)</enum><header>Limitation</header><text display-inline="yes-display-inline">In any fiscal year, the aggregate number of
				mortgages insured pursuant to the automated process established under this
				section may not exceed 5 percent of the aggregate number of mortgages for 1- to
				4-family residences insured by the Secretary under this title during the
				preceding fiscal year.</text>
						</subsection><subsection id="H1EAA979F91ED4F25B9CE27AA76097307"><enum>(d)</enum><header>Sunset</header><text>After
				the expiration of the 5-year period beginning on the date of the enactment of
				the Expanding American Homeownership Act of 2007, the Secretary may not enter
				into any new commitment to insure any mortgage, or newly insure any mortgage,
				pursuant to the automated process established under this
				section.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H15BF070E51C1498EB15C3FA306E600E"><enum>(b)</enum><header>GAO
			 report</header><text display-inline="yes-display-inline">Not later than the
			 expiration of the 4-year period beginning on the date that the Secretary of
			 Housing and Urban Development first insures any mortgage pursuant to the
			 automated process established under pilot program under section 258 of the
			 National Housing Act (as added by the amendment made by subsection (a) of this
			 section), the Comptroller General of the United States shall submit to the
			 Congress a report identifying the number of additional mortgagors served using
			 such automated process and the impact of such process and the insurance of
			 mortgages pursuant to such process on the safety and soundness of the insurance
			 funds under the National Housing Act of which such mortgages are
			 obligations.</text>
			</subsection></section><section id="H689322FE873249948067501165AC8D9B"><enum>26.</enum><header>Sense of
			 Congress regarding technology for financial systems</header>
			<subsection id="H560ED263AE4247289100AB6C5C8300C7"><enum>(a)</enum><header>Congressional
			 Findings</header><text>The Congress finds the following:</text>
				<paragraph id="HDBBFE6C30FA54EE88E55BF07B717AA11"><enum>(1)</enum><text>The Government
			 Accountability Office has cited the FHA single family housing mortgage
			 insurance program as a <quote>high-risk</quote> program, with a primary reason
			 being non-integrated and out-dated financial management systems.</text>
				</paragraph><paragraph id="H9D19439ACDAE4464AC3357F5D5A56C5B"><enum>(2)</enum><text>The <quote>Audit
			 of the Federal Housing Administration’s Financial Statements for Fiscal Years
			 2004 and 2003</quote>, conducted by the Inspector General of the Department of
			 Housing and Urban Development reported as a material weakness that
			 <quote>HUD/FHA’s automated data processing [ADP] system environment must be
			 enhanced to more effectively support FHA’s business and budget
			 processes</quote>.</text>
				</paragraph><paragraph id="HC1FC4E6A1B4B49B09289B2588313B015"><enum>(3)</enum><text>Existing
			 technology systems for the FHA program have not been updated to meet the latest
			 standards of the Mortgage Industry Standards Maintenance Organization and have
			 numerous deficiencies that lenders have outlined.</text>
				</paragraph><paragraph id="H7E14482A91C2407AADE39149E0448E48"><enum>(4)</enum><text>Improvements to
			 technology used in the FHA program will—</text>
					<subparagraph id="HC258E6C9D10341FE8833DC156665F374"><enum>(A)</enum><text>allow the FHA
			 program to improve the management of the FHA portfolio, garner greater
			 efficiencies in its operations, and lower costs across the program;</text>
					</subparagraph><subparagraph id="H8E59616CA6654456BE016500AA99D594"><enum>(B)</enum><text>result in
			 efficiencies and lower costs for lenders participating in the program, allowing
			 them to better use the FHA products in extending homeownership opportunities to
			 higher credit risk or lower-income families, in a sound manner.</text>
					</subparagraph></paragraph><paragraph id="HD69F8481CD8F48F185AC1EDD76BBEBB3"><enum>(5)</enum><text>The Mutual
			 Mortgage Insurance Fund operates without cost to the taxpayers and generates
			 revenues for the Federal Government.</text>
				</paragraph></subsection><subsection id="H3696276DA95046958F1BC633ADFB62AA"><enum>(b)</enum><header>Sense of
			 Congress</header><text>It is the sense of the Congress that—</text>
				<paragraph id="HCBC5962C02B04339A290F40000363E1B"><enum>(1)</enum><text>the Secretary of
			 Housing and Urban Development should use a portion of the funds received from
			 premiums paid for FHA single family housing mortgage insurance that are in
			 excess of the amounts paid out in claims to substantially increase the funding
			 for technology used in such FHA program;</text>
				</paragraph><paragraph id="H05109A1339374C3188E9524D83F73702"><enum>(2)</enum><text>the goal of this
			 investment should be to bring the technology used in such FHA program to the
			 level and sophistication of the technology used in the conventional mortgage
			 lending market, or to exceed such level; and</text>
				</paragraph><paragraph id="HE3A2363A2FE84A78960012FA21A4E3D3"><enum>(3)</enum><text>the Secretary of
			 Housing and Urban Development should report to the Congress not later than 180
			 days after the date of the enactment of this Act regarding the progress the
			 Department is making toward such goal and if progress is not sufficient, the
			 resources needed to make greater progress.</text>

			 mortgage limits in high cost areas</header><text display-inline="no-display-inline">The National Housing Act is amended—</text>
			<paragraph id="H6CE793F2C8F5443EB6871B59CC1556B1"><enum>(1)</enum><text>in sections
			 207(c)(3), 213(b)(2)(B)(i), 221(d)(3)(ii)(II), 221(d)(4)(ii)(II), 231(c)(2)(B),
			 and 234(e)(3)(B) (12
			 U.S.C. 1713(c)(3), 1715e(b)(2)(B)(i), 1715l(d)(3)(ii)(II),
			 1715l(d)(4)(ii)(II), 1715v(c)(2)(B), and 1715y(e)(3)(B))—</text>
				<subparagraph id="H9D26CE4E6C70480E003F63AC92430B1"><enum>(A)</enum><text>by striking “140
			 percent” each place such term appears and inserting “170 percent”; and</text>
				</subparagraph><subparagraph id="H52A8A9E0918C4A9191FD83B800B4CD74"><enum>(B)</enum><text>by striking “170
			 percent in high cost areas” each place such term appears and inserting “215
			 percent in high cost areas”; and</text>
				</subparagraph></paragraph><paragraph id="H6533B0A638834461BDCFE4A2AF7163A2"><enum>(2)</enum><text display-inline="yes-display-inline">in section 220(d)(3)(B)(iii)(III)
			 (12 U.S.C.
			 1715k(d)(3)(B)(iii)(III)) by striking <quote>206A</quote> and
			 all that follows through <quote>project-by-project basis</quote> and inserting
			 the following: <quote>206A of this Act) by not to exceed 170 percent in any
			 geographical area where the Secretary finds that cost levels so require and by
			 not to exceed 170 percent, or 215 percent in high cost areas, where the
			 Secretary determines it necessary on a project-by-project basis</quote>.</text>
			</paragraph></section><section display-inline="no-display-inline" id="HE8C97955FBCA43EA8E999713B293DAD0"><enum>28.</enum><header>Discount sales
			 of multifamily properties</header><text display-inline="no-display-inline">There is authorized to be appropriated, for
			 discount sales of multifamily real properties under section 207(l) or 246 of
			 the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1713">12 U.S.C. 1713(l)</external-xref>, 1715z–11),
			 section 203 of the Housing and Community Development Amendments of 1978
			 (12 U.S.C.
			 1701z–11), or section 204 of the Departments of Veterans
			 Affairs and Housing and Urban Development, and Independent Agencies
			 Appropriations Act, 1997 (<external-xref legal-doc="usc" parsable-cite="usc/12/1715z-11a">12 U.S.C. 1715z–11a</external-xref>), and for
			 discount loan sales under section 207(k) of the National Housing Act
			 (12 U.S.C.
			 1713(k)), section 203 of the Housing and Community Development
			 Amendments of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/12/1701z-11">12 U.S.C. 1701z–11(k)</external-xref>), or
			 section 204(a) of the Departments of Veterans Affairs and Housing and Urban
			 Development, and Independent Agencies Appropriations Act, 1997 (12 U.S.C.
			 1715z–11a(a)), $5,000,000, for fiscal year 2008.</text>
		</section><section id="HF2FDC8D8001B48BBAD8665BCE0096B"><enum>29.</enum><header>Clarification of
			 disposition of certain properties</header><text display-inline="no-display-inline">Notwithstanding any other provision of law,
			 subtitle A of title II of the Deficit Reduction Act of 2005 (12 U.S.C.
			 1701z–11 note) and the amendments made by such title shall not
			 apply to any transaction regarding a multifamily real property for
			 which—</text>
			<paragraph id="H1E748EFE58FA4613A164624383F3A83D"><enum>(1)</enum><text>the Secretary of
			 Housing and Urban Development has received, before the date of the enactment of
			 such Act, written expressions of interest in purchasing the property from both
			 a city government and the housing commission of such city;</text>
			</paragraph><paragraph id="H2A48F6E7A36A4820B3008771B36EC3E"><enum>(2)</enum><text>after such receipt,
			 the Secretary acquires title to the property at a foreclosure sale; and</text>
			</paragraph><paragraph id="HF938A20F6CDA4BE08B46A071A6F4C5AB"><enum>(3)</enum><text display-inline="yes-display-inline">such city government and housing commission
			 have resolved a previous disagreement with respect to the disposition of the
			 property.</text>
			</paragraph></section><section display-inline="no-display-inline" id="H21DED697389F4BCB94871FD9D3E54048"><enum>30.</enum><header>Noncompetitive
			 sales by HUD to states and localities</header><text display-inline="no-display-inline">Subtitle A of title II of the Deficit
			 Reduction Act of 2005 (<external-xref legal-doc="public-law" parsable-cite="pl/109/171">Public Law 109–171</external-xref>; 120 Stat. 7) is
			 amended by adding at the end the following new section:</text>
			<quoted-block display-inline="no-display-inline" id="H96042193E5424797AC003E54BBC78566" style="OLC">
				<section id="H5AA027370EBB44EDA418B473EE520116"><enum>2004.</enum><header>Noncompetitive
				sales in fiscal year 2011</header><text display-inline="no-display-inline">Notwithstanding any other provision of law,
				the Secretary may not sell any multifamily real property through any discount
				sale during fiscal year 2011 under the provisions of law referred to in section
				2002(a) or any multifamily loan through any discount loan sale during such
				fiscal year under the provisions referred to in section 2002(b), unless the
				property or loan is sold for an amount that is equal to or greater than 60
				percent of the property market value or loan market value,
				respectively.</text>
				</section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section display-inline="no-display-inline" id="H266DCE82F7204B9E9EF4B3D886510705" section-type="subsequent-section"><enum>31.</enum><header>Use of FHA savings
			 for costs of mortgage insurance, housing counseling, FHA technologies,
			 procedures, and processes, and for affordable housing grant fund, and
			 study</header>
			<subsection id="HCC8B53D4EF9D4BF88DE69D52C00004B"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subject to subsection
			 (c), there is authorized to be appropriated for each fiscal year an amount
			 equal to the net increase for such fiscal year in, except as provided in
			 subsection (b), the negative credit subsidy for the mortgage insurance programs
			 under title II of the National Housing Act resulting from this Act and the
			 amendments made by this Act, for the following purposes in the following
			 amounts:</text>
				<paragraph id="H535324132EDF40039B8079F4AF691CB2"><enum>(1)</enum><header>Single family
			 housing mortgage insurance</header><text>For each fiscal year, for costs (as
			 such term is defined in section 502 of the Federal Credit Reform Act of 1990
			 (2 U.S.C.
			 661a)) of mortgage insurance provided pursuant to section
			 203(b) of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1709">12 U.S.C. 1709(b)</external-xref>), the additional
			 amount (not including any costs of such mortgage insurance resulting from this
			 Act or the amendments made by this Act), if any, necessary to ensure that the
			 credit subsidy cost of such mortgage insurance for such fiscal year is
			 $0.</text>
				</paragraph><paragraph id="H130FAE56909E4C66A9749550754012A7"><enum>(2)</enum><header>Housing
			 counseling</header><text display-inline="yes-display-inline">For each of fiscal
			 years 2008 through 2012, the amount needed to increase funding, for the housing
			 counseling program under section 106 of the Housing and Urban Development Act
			 of 1968 (12 U.S.C.
			 1701x), in connection with homebuyers and homeowners with
			 mortgages insured under title II of the National Housing Act, from the amount
			 appropriated for the preceding fiscal year to $100,000,000.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD7EAD2591DF240D1812E2E4C782C786C"><enum>(3)</enum><header>Mortgage
			 insurance technology, procedures, processes, program performance, and
			 salaries</header><text display-inline="yes-display-inline">For each of fiscal
			 years 2008 through 2012, $25,000,000 for increasing funding for the purpose of
			 improving technology, procedures, processes, and program performance, and
			 salaries in connection with the mortgage insurance programs under title II of
			 the National Housing Act.</text>
				</paragraph><paragraph id="H4AFF404FD8EE4BEA8FFF00CA17E4CEC1"><enum>(4)</enum><header>Affordable
			 housing fund</header><text>For each fiscal year, for an affordable housing fund
			 available for use only for grants to provide affordable rental housing and
			 affordable homeownership opportunities for low-income families, the amount
			 remaining under this section after amounts are made available for such fiscal
			 year in accordance with paragraphs (1), (2), and (3).</text>
				</paragraph></subsection><subsection id="H8C66690223F5401CA6BDC65B00D70001"><enum>(b)</enum><header>Exclusion of
			 earnings from the single family mortgage insurance program</header><text display-inline="yes-display-inline">With respect to a fiscal year, the negative
			 credit subsidy determined under subsection (a) shall not include the negative
			 credit subsidy cost for such fiscal year, if any, for mortgage insurance
			 provided pursuant to section 203(b) of the National Housing Act.</text>
			</subsection><subsection display-inline="no-display-inline" id="H31A70009E4934396B4BE3F8520D0CD0"><enum>(c)</enum><header>Certification</header><text>Subsection
			 (a) shall not be effective for a fiscal year unless the Secretary of Housing
			 and Urban Development has, by rule making in accordance with
			 section
			 553 of title 5, United States Code (notwithstanding subsections
			 (a)(2), (b)(B), and (d)(3) of such section), made a determination that premiums
			 being, or to be, charged during such fiscal year for mortgage insurance under
			 title II of the National Housing Act are established at the minimum amount
			 sufficient to comply with the requirements of section 205(f) of such Act
			 (relating to required capital ratio for the Mutual Mortgage Insurance Fund) and
			 ensure the safety and soundness of the other mortgage insurance funds under
			 such Act, and any negative credit subsidy for such fiscal year resulting from
			 such mortgage insurance programs adequately ensures the efficient delivery and
			 availability of such programs.</text>
			</subsection><subsection id="HE51BCE12DDF44B1696B66BF833AEF51C"><enum>(d)</enum><header>Study and
			 report</header><text display-inline="yes-display-inline">The Secretary of
			 Housing and Urban Development shall conduct a study to obtain recommendations
			 from participants in the private residential mortgage lending business and the
			 secondary market for such mortgages on how best to update and upgrade
			 procedures, processes, and technologies for the mortgage insurance programs
			 under title II of the National Housing Act so that the policies and procedures
			 for originating, insuring, and servicing of such mortgages conform with those
			 customarily used by secondary market purchasers of residential mortgage loans.
			 Not later than the expiration of the 12-month period beginning on the date of
			 the enactment of this Act, the Secretary shall submit a report to the Congress
			 describing the progress made and to be made toward updating and upgrading such
			 procedures, processes, and technology, and providing appropriate staffing for
			 such mortgage insurance programs.</text>
			</subsection></section><section display-inline="no-display-inline" id="HBD60339D0A0240D38300B3122F42B213"><enum>32.</enum><header>Limitation on
			 mortgage insurance premium increases</header><text display-inline="no-display-inline">Notwithstanding any other provision of law,
			 including any provision of this Act and any amendment made by this Act—</text>
			<paragraph id="H1297A7903EFD418299E1B4F50266EE7E"><enum>(1)</enum><text display-inline="yes-display-inline">the premiums charged for mortgage insurance
			 under any program under the National Housing Act may not be increased above the
			 premium amounts in effect under such program on October 1, 2006, unless the
			 Secretary of Housing and Urban Development determines that, absent such
			 increase, insurance of additional mortgages under such program would, under the
			 Federal Credit Reform Act of 1990, require the appropriation of new budget
			 authority to cover the costs (as such term is defined in section 502 of the
			 Federal Credit Reform Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/2/661a">2 U.S.C. 661a</external-xref>) of
			 such insurance; and</text>
			</paragraph><paragraph id="HAB605C019202426B8B76AA00D6BB94DD"><enum>(2)</enum><text>a
			 premium increase pursuant to paragraph (1) may be made only by rule making in
			 accordance with the procedures under
			 section
			 553 of title 5, United States Code (notwithstanding subsections
			 (a)(2), (b)(B), and (d)(3) of such section).</text>
			</paragraph></section><section display-inline="no-display-inline" id="H9C2C88026FF64B3A00739899D8CFD62C"><enum>33.</enum><header>Civil money
			 penalties for improperly influencing appraisals</header><text display-inline="no-display-inline">Paragraph (2) of section 536(b) of the
			 National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1735f-14">12 U.S.C. 1735f–14(b)(2)</external-xref>) is
			 amended—</text>
			<paragraph id="HC6E57CB4060D477E85B972B7A921FADC"><enum>(1)</enum><text>in subparagraph
			 (B), by striking <quote>or</quote> at the end;</text>
			</paragraph><paragraph id="H99CE53AECDDD421D9F850037FC91EE8D"><enum>(2)</enum><text>in subparagraph
			 (C), by striking the period at the end and inserting <quote>; or</quote>;
			 and</text>
			</paragraph><paragraph id="HA5440363F3EA4A0BA236CD5C175BF5F3"><enum>(3)</enum><text>by adding at the
			 end the following new subparagraph:</text>
				<quoted-block id="H873EBC9EB7BA430BBCD984B28D498D00" style="OLC">
					<subparagraph id="H9B2C8D7992C44111B2D6B8DD00195286"><enum>(D)</enum><text>in the case of an
				insured mortgage under title II for a 1- to 4-family residence, compensating,
				instructing, inducing, coercing, or intimidating any person who conducts an
				appraisal of the property in connection with such mortgage, or attempting to
				compensate, instruct, induce, coerce, or intimidate such a person, for the
				purpose of causing the appraised value assigned to the property under the
				appraisal to be based on any other factor other than the independent judgment
				of such person exercised in accordance with applicable professional
				standards.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section display-inline="no-display-inline" id="H2AF24FC7E09946FBACF1DE5B97134583"><enum>34.</enum><header>Mortgage
			 insurance premium refunds</header>
			<subsection id="H9044DE6BFE804FF99B3CD8A11403555"><enum>(a)</enum><header>Authority</header><text display-inline="yes-display-inline">The Secretary of Housing and Urban
			 Development shall, to the extent that amounts are made available pursuant to
			 subsection (c), provide refunds of unearned premium charges paid, at the time
			 of insurance, for mortgage insurance under title II of the National Housing Act
			 (12 U.S.C. 1707 et
			 seq.) to or on behalf of mortgagors under mortgages described
			 in subsection (b).</text>
			</subsection><subsection id="H11C0048C68224FF091CD689767A5A8EC"><enum>(b)</enum><header>Eligible
			 mortgages</header><text display-inline="yes-display-inline">A mortgage
			 described in this section is a mortgage on a one- to four-family dwelling
			 that—</text>
				<paragraph id="HAB7461C6967640B2A8A31CBCD9FE226"><enum>(1)</enum><text>was insured under
			 title II of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1707">12 U.S.C. 1707 et seq.</external-xref>);</text>
				</paragraph><paragraph id="H182D01E1A21A4DD1A62959A67CA640F6"><enum>(2)</enum><text display-inline="yes-display-inline">is otherwise eligible, under the last
			 sentence of subparagraph (A) of section 203(c)(2) of such Act (12 U.S.C.
			 1709(c)(2)(A)), for a refund of all unearned premium charges
			 paid on the mortgage pursuant to such subparagraph, except that the
			 mortgage—</text>
					<subparagraph id="H95A4FF208D9E43E893C0007F25460001"><enum>(A)</enum><text>was closed before
			 December 8, 2004; and</text>
					</subparagraph><subparagraph id="HEF5695372D47413FBFD96E88CCE805EA"><enum>(B)</enum><text>was endorsed on or
			 after such date.</text>
					</subparagraph></paragraph></subsection><subsection id="HEFC36D434AAE4EE69D0093EF00883262"><enum>(c)</enum><header>Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There is
			 authorized to be appropriated for each fiscal year such sums as may be
			 necessary to provide refunds of unearned mortgage insurance premiums pursuant
			 to this section.</text>
			</subsection></section><section display-inline="no-display-inline" id="H61C269259EA647C0B0BE271C5D276F3D"><enum>35.</enum><header>Savings
			 provision</header><text display-inline="no-display-inline">Any mortgage insured
			 under title II of the <act-name parsable-cite="NHA">National Housing
			 Act</act-name> before the date of enactment of this title shall continue to be
			 governed by the laws, regulations, orders, and terms and conditions to which it
			 was subject on the day before the date of the enactment of this Act.</text>
		</section><section id="HC8B807D83DF74C4BB2D002700583440"><enum>36.</enum><header>Implementation</header><text display-inline="no-display-inline">Except as provided in section 23(b), the
			 Secretary of Housing and Urban Development shall by notice establish any
			 additional requirements that may be necessary to immediately carry out the
			 provisions of this Act. The notice shall take effect upon issuance.</text>
