		<section commented="no" display-inline="no-display-inline" id="H3831F402F68F44E68DB2EC3F5067D8D8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Housing America's Workforce
			 Act</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="H7341B39F97944E9597F97F02C970C477" section-type="subsequent-section"><enum>2.</enum><header>Findings and
			 Purposes</header>
			<subsection commented="no" display-inline="no-display-inline" id="H5CFAF33126134C66A7005BDDF8E17FA9"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">The Congress finds the following:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H6DBDD3856C4049AAB2A7BA230015D1BE"><enum>(1)</enum><text display-inline="yes-display-inline">Resurgent housing markets are pricing out
			 low- and moderate-income families and are producing few lower-cost
			 units.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H47BAE34D91904871945D70696D2CB479"><enum>(2)</enum><text display-inline="yes-display-inline">In many markets, housing costs have far
			 outgrown the rate of inflation and the gap between wages and housing costs is
			 widening, pushing affordable housing beyond the reach of an increasing number
			 of working families.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8B67448EC5B349629F67288B9000C8C"><enum>(3)</enum><text display-inline="yes-display-inline">Despite the lowest mortgage rates in our
			 Nation’s history, millions of working families still find it extremely
			 difficult to rent or purchase a home. Many workers who fill jobs that provide
			 the backbone of our communities—teachers, firefighters, and police
			 officers—often cannot afford to live in the communities in which they
			 serve.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8E9D17B78642488682787CCDF59E2B78"><enum>(4)</enum><text display-inline="yes-display-inline">The United States Department of Housing and
			 Urban Development (HUD) considers housing affordable when a family spends no
			 more than 30 percent of its monthly income on rent and utilities. Entry-level
			 wage earners with annual incomes of up to $30,000 spending no more than 30
			 percent of their income on rent can only afford to pay up to $750 for rent. In
			 the high job-growth areas, such rents are not readily available.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC18765391DAD44358F3FF29E219739F4"><enum>(5)</enum><text display-inline="yes-display-inline">According to a study by the Center for
			 Housing Policy in Washington, DC, the latest data available shows that in 2003,
			 approximately 5 million families paid more than half of their income for
			 housing or lived in dilapidated conditions, or both, despite the fact they were
			 working full time jobs. Moreover, the number of working families with critical
			 housing problems has increased 67 percent between 1997 and 2003.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H40F9C2458C784ED09CFC8B08DFF16000"><enum>(6)</enum><text display-inline="yes-display-inline">Affordable housing is the key to creating
			 and sustaining healthy, economically vibrant communities.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H13487F4AE80440E3A5E6DA8B8C52C070"><enum>(7)</enum><text display-inline="yes-display-inline">The lack of affordable housing across the
			 United States has been shown to cause or contribute to labor shortages.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8FF1E646C3C24D3EAE3D69EDC4DD1938"><enum>(8)</enum><text display-inline="yes-display-inline">Under employer-assisted housing (EAH)
			 programs employers provide much needed housing assistance to their
			 employees.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H12A29CC74B03438D9F9FA8E8C66074D2"><enum>(9)</enum><text display-inline="yes-display-inline">EAH programs are innovative local solutions
			 that have increased affordable housing opportunities for thousands of working
			 families across America while benefitting the economy.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HACE091CE26E34C94B1C42CBBE06C6D23"><enum>(10)</enum><text display-inline="yes-display-inline">According to findings of the Rutgers
			 University American Affordable Housing Institute, employer-assisted housing
			 increases productivity by reducing commuting time as well as saves money on
			 recruitment and retention.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H16B009CF2BCB4962BC007469B1BB00CD"><enum>(11)</enum><text display-inline="yes-display-inline">The future growth of EAH programs will
			 remain dependent upon increasing individual employer knowledge and
			 implementation of these programs.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA9692FAD9B00482000496B2FF795D7E"><enum>(12)</enum><text display-inline="yes-display-inline">EAH programs will not solve the Nation’s
			 housing problems but such programs do seek to address the challenge from a new
			 perspective and allow the private sector to play a direct role in promoting
			 housing affordability. Additionally, EAH programs can help to promote
			 redevelopment and reinvestment in distressed communities.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H1AB6EA949F164A13BBEF5417A6F2562"><enum>(b)</enum><header>Purposes</header><text display-inline="yes-display-inline">The purposes of this Act are as
			 follows:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H1B53F77D1F3741FF9DE1655142D2DAE"><enum>(1)</enum><text display-inline="yes-display-inline">To expand affordable housing opportunities
			 to low- and moderate-income working individuals and families.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF82DDD40EFF9472CADFBFEEED2266834"><enum>(2)</enum><text display-inline="yes-display-inline">To encourage employers, counties, and
			 municipalities to invest in employer-assisted housing programs.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H533F33AAB9EE4A2FBC9183AE135F29A8" section-type="subsequent-section"><enum>3.</enum><header>Tax credit for
			 employer-provided employee housing assistance</header>
			<subsection commented="no" display-inline="no-display-inline" id="H5D77E81F57A741F2B3EBDE275288E961"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subpart D of part IV
			 of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 (relating to
			 business related credits) is amended by adding at the end the following new
			 section:</text>
				<quoted-block display-inline="no-display-inline" id="H01379670E4D8491EBF76D8F086058F11" style="OLC">
					<section commented="no" display-inline="no-display-inline" id="H2B49BADBEF3B4E968F00D54C10329D06" section-type="subsequent-section"><enum>45O.</enum><header>Employer-provided
				employee housing assistance</header>
						<subsection commented="no" display-inline="no-display-inline" id="HABB225BBD40A4B8E9F278BE78FF0265F"><enum>(a)</enum><header>Allowance of
				credit</header>
							<paragraph commented="no" display-inline="no-display-inline" id="H72C6FB87914949699D67373FDD75C8D8"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">For purposes of
				section 38, the employer-provided employee housing assistance credit determined
				under this section for any taxable year is an amount equal to 50 percent of the
				qualified housing expenses paid by the employer during the taxable year if such
				expenses are furnished pursuant to a program described in subsection
				(b).</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8CD348492EF94CC79BD6969467A777B6"><enum>(2)</enum><header>Per employee
				limitation</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="H201249C60C154006A1C2E411C04AF97"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The aggregate amount
				of qualified housing expenses taken into account with respect to any eligible
				employee for any taxable year shall not exceed, when added to any qualified
				housing expenses taken into account for any preceding taxable year with respect
				to such employee—</text>
									<clause commented="no" display-inline="no-display-inline" id="H206FFCBB5911413382E82291AE66E99F"><enum>(i)</enum><text display-inline="yes-display-inline">in the case of homeownership assistance,
				the lesser of $10,000 or 6 percent of the purchase price of such employee's
				principal residence, and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="H90289C5867824D22007C612C1078AF83"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of rental assistance,
				$2,000.</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7A0533A4CFCF4D798F6978D77562E70"><enum>(B)</enum><header>Inflation
				adjustment</header>
									<clause commented="no" display-inline="no-display-inline" id="H9A617733FE9240F8AFF493503369E117"><enum>(i)</enum><header>In
				general</header><text display-inline="yes-display-inline">In the case of any
				taxable year beginning after 2009, each dollar amount referred to in
				subparagraph (A) shall be increased by an amount equal to—</text>
										<subclause commented="no" display-inline="no-display-inline" id="HC0A9463623274EA4A18F346E5067C2EA"><enum>(I)</enum><text display-inline="yes-display-inline">such dollar amount, multiplied by</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="HC21EE87087AD4EF58691F5CF751B4D98"><enum>(II)</enum><text display-inline="yes-display-inline">the cost-of-living adjustment determined
				under section (1)(f)(3) for the calendar year in which the taxable year begins,
				by substituting <quote>2008</quote> for <quote>1992</quote>.</text>
										</subclause></clause><clause commented="no" display-inline="no-display-inline" id="HDEAA5760172242958F1BB900395BDCF2"><enum>(ii)</enum><header>Rounding</header><text display-inline="yes-display-inline">If any amount as adjusted under clause (i)
				is not a multiple of $50, such amount shall be rounded to the nearest multiple
				of $50.</text>
									</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H81EABF383C2F4D4EAF62DAA04768DE50"><enum>(b)</enum><header>Housing
				assistance program</header><text display-inline="yes-display-inline">For
				purposes of this section, a housing assistance program is a separate written
				plan of an employer for the exclusive benefit of such employer's employees to
				provide the qualified housing expenses of such employees and which meets
				requirements similar to the requirements of paragraphs (2) through (6) of
				section 127(b).</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="HA595DC4292B64265BD76BD83D655E92B"><enum>(c)</enum><header>Definitions and
				special rules</header><text display-inline="yes-display-inline">For purposes of
				this section—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="HDE66560B7D32413FA5590973302B06E8"><enum>(1)</enum><header>Eligible
				employee</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="H46DCFF8BFA49484685C0EB3FFCA1D646"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The term
				<term>eligible employee</term> means any individual—</text>
									<clause commented="no" display-inline="no-display-inline" id="H88D548B53C104A31A884C71B3251CF81"><enum>(i)</enum><text display-inline="yes-display-inline">employed by an employer,</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="H07C50E86C7AA4C47AF10CCF99BBEF925"><enum>(ii)</enum><text display-inline="yes-display-inline">whose household income does not exceed 120
				percent of the area median gross income (adjusted for household size) for the
				metropolitan statistical area (as defined in section 143(k)(2)(B)) in which the
				housing is located, and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="H782998C2C5E34EF2A537EF2118E9D2D6"><enum>(iii)</enum><text display-inline="yes-display-inline">in the case of homeownership assistance,
				who is a qualified homebuyer.</text>
									</clause><continuation-text commented="no" continuation-text-level="subparagraph">If the housing with respect to
				such employee is located in a high housing cost area (as defined in section
				143(f)(5)(C)), the income limitation under subparagraph (B) shall be adjusted
				(but not reduced) by the application of the rule under section 143(f)(5) by
				substituting <quote>120 percent</quote> for <quote>115 percent</quote> in
				subparagraph (B)(I) thereof.</continuation-text></subparagraph><subparagraph id="H717A9ECA2BD4472FAA1EB1B3C36797F7"><enum>(B)</enum><header>Certain
				employees not eligible</header><text>The term <term>eligible employee</term>
				shall not include—</text>
									<clause id="H954BD2FEECCD4B268FE83FF375E9924B"><enum>(i)</enum><text>any individual
				described in subparagraph (A), (B), or (C) of section 51(i)(1), and</text>
									</clause><clause id="H555F055636194808A957FAE4F527D4DE"><enum>(ii)</enum><text>any 5-percent
				owner (as defined in section 416(i)(1)(B)).</text>
									</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H666288BEFB1D474AB389F1EEAC616D00"><enum>(2)</enum><header>Qualified
				housing expenses</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="H34808EFBCED249D69F2254455C3914EA"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The term
				<term>qualified housing expenses</term> means rental assistance or
				homeownership assistance towards the lease or purchase of housing.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H56E356693F1A4C7AB2046EC6F2B05BC6"><enum>(B)</enum><header>Rental
				assistance</header><text display-inline="yes-display-inline">The term
				<term>rental assistance</term> means assistance with security deposits and
				rental payments.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7968278280174C098D3EA300C3F640F1"><enum>(C)</enum><header>Homeownership
				assistance</header><text display-inline="yes-display-inline">The term
				<term>homeownership assistance</term> means assistance for the purchase of a
				principal residence, including—</text>
									<clause commented="no" display-inline="no-display-inline" id="HD52DA4A8253A4F7B9D36CE05C1784989"><enum>(i)</enum><text display-inline="yes-display-inline">payment of qualified acquisition costs (as
				defined in section 72(t)(8)(C)),</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="H714928B60C2542E69510C7EEE6D85FD5"><enum>(ii)</enum><text display-inline="yes-display-inline">providing (or reducing the costs of)
				financing, including the funding of a permanent interest rate buydown,</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="H595E903316A748968655A0D8B93E5EF"><enum>(iii)</enum><text display-inline="yes-display-inline">contributions to second mortgage pools or
				low interest loan programs accessible to eligible employees,</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="HC7B06B5DD61E4E3DAAE2510186287D4B"><enum>(iv)</enum><text display-inline="yes-display-inline">mortgage guarantee programs for the
				repayment of any loans in default that are secured by an eligible employee and
				guaranteed by the employer,</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="H41FA62CA909F49649F5CA1F23A221AC"><enum>(v)</enum><text display-inline="yes-display-inline">contributions to Individual Development
				Accounts (within the meaning of section 404(h) of the Social Security Act)
				which are designated exclusively for the purchase of a home, and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="H69E3FFE9E5684B30A3EB4468CCC10285"><enum>(vi)</enum><text display-inline="yes-display-inline">contributions to homebuyer education and
				homeownership counseling of eligible employees.</text>
									</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0C67255684DE43FA87BBF3A566586220"><enum>(3)</enum><header>Principal
				residence</header><text display-inline="yes-display-inline">The term
				<term>principal residence</term> has the same meaning as when used in section
				121, except such term shall not include a residence with a purchase price
				exceeding the greater of—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="HFB2034AAF44C476090DAC4E94072B02E"><enum>(A)</enum><text display-inline="yes-display-inline">90 percent of the average area purchase
				price applicable to the residence, or</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H364D9D3CD22A4105A32C828B603B5B99"><enum>(B)</enum><text display-inline="yes-display-inline">3.5 times the family income limit
				applicable to the eligible employee under paragraph (1)(A)(ii).</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H73176EF902FC449A91AB118B7672E294"><enum>(4)</enum><header>Qualified
				homebuyer</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="H2ACEB701EEEA4F1F9137F0D3AFC83F6F"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The term
				<term>qualified homebuyer</term> means any individual if such individual (and
				if married, such individual’s spouse) had no present ownership in a principal
				residence during the 3-year period ending on the date of the purchase of the
				principal residence to which this section applies.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA600B54349894AB599001F0000DF6CB7"><enum>(B)</enum><header>One-time
				only</header><text display-inline="yes-display-inline">If an individual is
				treated as a qualified homebuyer with respect to any principal residence, such
				individual may not be treated as a qualified homebuyer with respect to any
				other principal residence.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HEEA61849FA8D463C9F738FB53F7CCA17"><enum>(5)</enum><header>Applicable
				rules</header><text display-inline="yes-display-inline">Rules similar to the
				rules under section 127(c)(5)(A) shall apply for the purposes of this
				section.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HBED4F79117194E23A1C71336AA405FD0"><enum>(d)</enum><header>Treatment of
				employers not able To use entire credit</header>
							<paragraph commented="no" display-inline="no-display-inline" id="HBEBF092797EF46838EB87E51C85988B7"><enum>(1)</enum><header>Allowance of
				credit</header><text display-inline="yes-display-inline">Except as otherwise
				provided in this subsection, any credit allowable under subsection (a) to any
				employer described in paragraph (2)(C) may be transferred as provided in this
				subsection and the determination as to whether the credit is allowable shall be
				made without regard to the tax-exempt status of the employer.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1E61A3B86B7E404695D03DA61544A2AB"><enum>(2)</enum><header>Transfer of
				credit</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="HB6400A90465E45A7840587E75C60692"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">An employer described
				in subparagraph (C) may transfer any credit to which paragraph (1) applies
				through an assignment to any other person. Such transfer may be revoked only
				with the consent of the Secretary.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H0D6CFB15B8C9477FBCCC7D558E1B9D86"><enum>(B)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Secretary shall prescribe such
				regulations as necessary to ensure that any credit described in subparagraph
				(A) is assigned once and not reassigned by such other person.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H43DFA80EFEBE46E7857D47BC142DBCB5"><enum>(C)</enum><header>Employer
				described</header><text display-inline="yes-display-inline">An employer is
				described in this subparagraph if the employer is—</text>
									<clause commented="no" display-inline="no-display-inline" id="H5DD205D2B65A43F3B7C6E9D5C8AA3398"><enum>(i)</enum><text display-inline="yes-display-inline">a State or political subdivision thereof,
				the District of Columbia, a possession of the United States, or an agency or
				instrumentality of any of the foregoing,</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="H4A0B934011B04DF7B3D9DDEC2C80CEF9"><enum>(ii)</enum><text display-inline="yes-display-inline">an Indian tribal government (within the
				meaning of section 7871) or any agency or instrumentality thereof, or</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="HC43F6A09513C430C9F246C8400243C80"><enum>(iii)</enum><text display-inline="yes-display-inline">any entity exempt from taxation under
				section 501(a).</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE7ADBDDF8D194348A2E600E92BA4A831"><enum>(D)</enum><header>Transfer
				proceeds treated as arising from essential government function</header><text display-inline="yes-display-inline">Any proceeds derived by a person described
				in clause (i) or (ii) of subparagraph (C) from the transfer under subparagraph
				(A) of any credit to which paragraph (1) applies shall be treated as arising
				from the exercise of an essential government function.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H661E9F4A871C4C9B8C00F8CB0EDB9"><enum>(E)</enum><header>Credit not
				income</header><text display-inline="yes-display-inline">Any transfer under
				subparagraph (A) of any credit to which paragraph (1) applies shall not be
				treated as income for purposes of section

			 subchapter B of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 (relating to
			 items specifically excluded from gross income) is amended by inserting after
			 section 139A the following new section:</text>

							<paragraph commented="no" display-inline="no-display-inline" id="H5C28B263CCB94D7599F841B8C29DB13F"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Gross income of an
				eligible employee does not include amounts paid or incurred by the employer of
				such employee for qualified housing expenses provided to the employee if the
				assistance is furnished pursuant to a program described in subsection
				(b).</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H69C05EBCC964441D9588ECEAF2AA43BF"><enum>(2)</enum><header>Limitation</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="H5BAB8958D9FF4E8D812975FA36A7AA37"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The aggregate amount
				of qualified housing expenses which may be excluded under paragraph (1) with
				respect to any eligible employee for any taxable year shall not exceed, when
				added to any qualified housing expenses excluded in any preceding taxable year
				with respect to such employee—</text>
									<clause commented="no" display-inline="no-display-inline" id="HFB9C860BDC1B4D53BE33FEE276931BED"><enum>(i)</enum><text display-inline="yes-display-inline">in the case of homeownership assistance,
				the lesser of $10,000 or 6 percent of the purchase price of such employee's
				principal residence, and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="HF5FC5A61FB594BA0AC45E0BBAA5E9185"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of rental assistance,
				$2,000.</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H38CFFC6F63C1498482F3D11439005791"><enum>(B)</enum><header>Inflation
				adjustment</header>
									<clause commented="no" display-inline="no-display-inline" id="H7F98E672D2724A3EB720A97714F71242"><enum>(i)</enum><header>In
				general</header><text display-inline="yes-display-inline">In the case of any
				taxable year beginning after 2009, each dollar amount referred to in
				subparagraph (A) shall be increased by an amount equal to—</text>
										<subclause commented="no" display-inline="no-display-inline" id="H5B9659DF7AB94AE19BD89436F69DE380"><enum>(I)</enum><text display-inline="yes-display-inline">such dollar amount, multiplied by</text>

				is not a multiple of $50, such amount shall be rounded to the nearest multiple
				of $50.</text>
									</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H9DF5A7EBA4744E408FB4E07A3F91CCB"><enum>(b)</enum><header>Housing
				assistance program</header><text display-inline="yes-display-inline">For
				purposes of this section, a housing assistance program is a separate written
				plan of an employer for the exclusive benefit of such employer's employees to
				provide the qualified housing expenses of such employees and which meets
				requirements similar to the requirements of paragraphs (2) through (6) of
				section 127(b).</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="HA51432209D974459BCD494D897B952B"><enum>(c)</enum><header>Definitions;
				special rules</header><text display-inline="yes-display-inline">For purposes of
				this section—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="H1A4BD709C3FD44D8A080A577E2207596"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Any term used in
				section 45O which is also used in this section shall have the same meaning as
				given such term by section 45O.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5E91E7C0269D4A22AF1838CEDAF9217"><enum>(2)</enum><header>Applicable
				rules</header><text display-inline="yes-display-inline">Rules similar to the
				rules under section 127(c)(5)(A) shall apply for purposes of this
				section.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H073F7435C83849D1BA071C04C6E74900"><enum>(3)</enum><header>Basis
				adjustment</header><text display-inline="yes-display-inline">For purposes of
				this subtitle, if an exclusion is allowed under subsection (a) with respect to
				a residence, the basis of such residence shall be reduced by the amount of the

			</subsection></section><section commented="no" display-inline="no-display-inline" id="HE8D026B1D1B8462494E153A3E00F475" section-type="subsequent-section"><enum>5.</enum><header>Grants to cover
			 employer-assisted housing program costs</header>
			<subsection commented="no" display-inline="no-display-inline" id="HD460114E2BD54EC4BD202E8872E26C4"><enum>(a)</enum><header>Grants
			 authorized</header>
				<paragraph commented="no" display-inline="no-display-inline" id="HAE38DF841326470F9E0712D1318D21A0"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary may
			 award a grant to an eligible entity to pay—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H9A48EEE58B2544F200F966DCEDAB268"><enum>(A)</enum><text display-inline="yes-display-inline">the operating costs of administering an
			 employer-assisted housing program;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H18C1D69571A24A9ABD7722BB56B9638C"><enum>(B)</enum><text display-inline="yes-display-inline">for technical assistance provided by the
			 eligible entity to an employer in connection with such a program; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD758EA7249984C8DA366F53543C23EA0"><enum>(C)</enum><text display-inline="yes-display-inline">for costs associated with promoting,
			 publicizing, or otherwise attempting to distribute information relating to such
			 a program.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0006157057CF4259B02DAABA73656879"><enum>(2)</enum><header>Duration</header><text display-inline="yes-display-inline">Grants in an annual aggregate total of not
			 more than $5,000,000 may be awarded under this subsection during each of fiscal
			 years 2008, 2009, and 2010.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAFD27935582F44E0AB512651A4D40047"><enum>(3)</enum><header>Award
			 basis</header><text display-inline="yes-display-inline">The Secretary shall
			 award grants under this section on a competitive basis.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H9087BF608B38463EB0519251B0009579"><enum>(b)</enum><header>Eligible
			 entities</header><text display-inline="yes-display-inline">To be eligible to
			 receive a grant under this section, an entity shall demonstrate that it
			 is—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H4974AC7931F84311B7ED8CD49FF90A2"><enum>(1)</enum><text display-inline="yes-display-inline">a nonprofit housing organization with a
			 relevant mission and demonstrated track record in housing counseling or
			 employer-assisted housing contracted by an employer to assist the employer in
			 establishing or maintaining an employer-assisted housing program; or</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H67D846AEE8BE4773AE23645B44F36089"><enum>(2)</enum><text display-inline="yes-display-inline">a city, county, town, township, parish,
			 village, hamlet, or other general purpose political subdivision of a State that
			 seeks to establish or maintain, or otherwise participate in an
			 employer-assisted housing program for its own employees.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HCD458EB91A1C4BD190A4CAA093F51253"><enum>(c)</enum><header>Application</header><text display-inline="yes-display-inline">Each eligible entity seeking a grant under
			 this section shall submit an application to the Secretary at such time, in such
			 manner, and containing such information as the Secretary may require.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HB18CDC81D6CD449AA382A157FBC9D04B"><enum>(d)</enum><header>Limitation on
			 use of funds</header><text display-inline="yes-display-inline">A grant awarded
			 to an eligible entity under this section shall be used only for the purposes
			 described under subsection (a).</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H06FC7A39619345AEB2B7B97D9993296D"><enum>(e)</enum><header>Reports</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H1A2FC91BF57B4EDF91F371C541E96D69"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Each eligible entity
			 receiving a grant under this section shall annually prepare and submit to the
			 Secretary a report that describes the—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H796E41176AC34F9F84DE3909B61252CA"><enum>(A)</enum><text display-inline="yes-display-inline">amount of grant funds expended during the
			 year;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8FDFD249574046878C880053DC901529"><enum>(B)</enum><text display-inline="yes-display-inline">total amount—</text>
						<clause commented="no" display-inline="no-display-inline" id="H7CC1205249BC45C0A02DA47EE593F81C"><enum>(i)</enum><text display-inline="yes-display-inline">of funds expended during the year to
			 administer an employer-assisted housing program; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H30351570E7D34EDF9F6C6D09DDEDDE77"><enum>(ii)</enum><text display-inline="yes-display-inline">of down payment assistance provided by such
			 a program;</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9590026AB61C4D9E91385BB5CB908644"><enum>(C)</enum><text display-inline="yes-display-inline">total number of employees utilizing such a
			 program;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HCF4152B083A14849A4C92DAB3E685B57"><enum>(D)</enum><text display-inline="yes-display-inline">number of employees utilizing such a
			 program—</text>
						<clause commented="no" display-inline="no-display-inline" id="H16EC9BB1D60E481D9D65F75F7743CBB9"><enum>(i)</enum><text display-inline="yes-display-inline">who are time homebuyers;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H46FEA921E8F54B6C99B247D6824EB46"><enum>(ii)</enum><text display-inline="yes-display-inline">who are previous homeowners; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H7ECD8105D6D2472A92E25310146E1FB9"><enum>(iii)</enum><text display-inline="yes-display-inline">who live in high-cost housing areas;</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H840549EC7630401589AE6100E393FEDB"><enum>(E)</enum><text display-inline="yes-display-inline">average—</text>
						<clause commented="no" display-inline="no-display-inline" id="H5B4BD9A60B3142169CDF36EA6C5FF63B"><enum>(i)</enum><text display-inline="yes-display-inline">income of employees utilizing such a
			 program;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H70955324146C44188F7C001D7C8F415B"><enum>(ii)</enum><text display-inline="yes-display-inline">age of employees utilizing such a program;
			 and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="HB870C9B0916A468900F67BD442EF72FE"><enum>(iii)</enum><text display-inline="yes-display-inline">cost of a home purchased under such a
			 program;</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBECB199FDDB74900A30065F7E9B59B48"><enum>(F)</enum><text display-inline="yes-display-inline">ethnicity of employees utilizing such a
			 program; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFEBAA0129F4045B7BD56D4B7E8E36C06"><enum>(G)</enum><text display-inline="yes-display-inline">number of housing units affected by such a
			 program.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3750787A91484E65B342BF851DB1AAE5"><enum>(2)</enum><header>Clearinghouse
			 and dissemination</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="HD1995C34609A4698884E2FB1AB657E54"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 1 year
			 after the date of enactment of this Act, the Secretary shall establish a
			 national clearinghouse, including a website, designed—</text>
						<clause commented="no" display-inline="no-display-inline" id="H62DBDC557CC24531A576F45FEB540184"><enum>(i)</enum><text display-inline="yes-display-inline">to provide information about
			 employer-assisted housing programs to—</text>
							<subclause commented="no" display-inline="no-display-inline" id="HAE3F402EF7F141838C0038E9F314715C"><enum>(I)</enum><text display-inline="yes-display-inline">Federal, State, and local government
			 entities; and</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="H947B3DE5CD4C4D37A4FB35FB7FCC75F6"><enum>(II)</enum><text display-inline="yes-display-inline">interested groups, businesses, persons, and
			 organizations; and</text>
							</subclause></clause><clause commented="no" display-inline="no-display-inline" id="H46720F53881345F2B47935035B7103D2"><enum>(ii)</enum><text display-inline="yes-display-inline">to collect and disseminate the information
			 gathered from the reports required under paragraph (1).</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6C4E88DB8B7040049DF680198935F525"><enum>(B)</enum><header>Webposting</header><text display-inline="yes-display-inline">The Secretary shall ensure that—</text>
						<clause commented="no" display-inline="no-display-inline" id="H21655B90C6A84CB1AF5C58361FA41B30"><enum>(i)</enum><text display-inline="yes-display-inline">each report submitted under paragraph (1)
			 is posted to the website of the national clearinghouse established under
			 subparagraph (A); and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H258653A6D4CC447E867D67532FE659E7"><enum>(ii)</enum><text display-inline="yes-display-inline">the website of the Department of Housing
			 and Urban Development provides a hyperlink to such reports on the website of
			 the national clearinghouse.</text>
						</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H679DBE16FAB84E518650EEE51A3A2DD"><enum>(f)</enum><header>Definitions</header><text display-inline="yes-display-inline">As used in this section:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HFF72043849924C438DE35764D2D8001"><enum>(1)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <quote>Secretary</quote> means the
			 Secretary of Housing and Urban Development.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB5FFA638E3B7409EBFCBFBE8001671DD"><enum>(2)</enum><header>Nonprofit
			 housing organization</header><text display-inline="yes-display-inline">The term
			 <quote>nonprofit housing organization</quote> means any organization
			 that—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H1D02C55C3F9B40EF8F471693B3EB35F1"><enum>(A)</enum><text display-inline="yes-display-inline">the Internal Revenue Service has ruled is
			 exempt from income taxation under paragraphs (3), (4), or (5) of section 501(c)
			 of the Internal Revenue Code of 1986; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1DA28D9848A342F5A9F0C27611577507"><enum>(B)</enum><text display-inline="yes-display-inline">has as its stated purpose to produce,
			 maintain, operate, or promote affordable housing.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HCC986D12157B4C36B415377C23363C3E"><enum>(g)</enum><header>Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There are
			 authorized to be appropriated $5,000,000 for each of fiscal years 2008, 2009,
			 and 2010 to carry out this section.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="H39E5B5BD2B8C4E84B058CA16B02C3FCC" section-type="subsequent-section"><enum>6.</enum><header>Evaluation of
			 employer-assisted housing programs</header>
			<subsection commented="no" display-inline="no-display-inline" id="H9771536B8F3F480EAB8DF12635C9393E"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">A study of
			 employer-assisted programs shall be carried out in accordance with subsection
			 (b) for the purposes of evaluating the effects of the tax benefits provided
			 under sections 3 and 4 and the grant program established under section 5
			 on—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H1BAE83B71C6C4674B4F161BBE8009090"><enum>(1)</enum><text display-inline="yes-display-inline">such programs; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4480A726A12A4CC4007F40DF00AD7BF8"><enum>(2)</enum><text display-inline="yes-display-inline">the private sector resources leveraged to
			 further fund such programs.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H9B932EA7B8F0439BBEE326557FC77828"><enum>(b)</enum><header>National
			 evaluation</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H4592165A22FF4CA6871292A55470096"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Comptroller
			 General of the United States (in this section referred to as the
			 <quote>Comptroller General</quote>) shall conduct the study required under
			 subsection (a).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1D080DD1453D4BA5AEA6E201FE25403B"><enum>(2)</enum><header>Requirements</header><text display-inline="yes-display-inline">The study required under subsection (a)
			 shall include an analysis and summary of—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H8558EC1837DA437CBB156C785EF121BA"><enum>(A)</enum><text display-inline="yes-display-inline">the total number of—</text>
						<clause commented="no" display-inline="no-display-inline" id="HBD0029A7E9C34B75A5E29C4FC446296"><enum>(i)</enum><text display-inline="yes-display-inline">employers participating in
			 employer-assisted housing programs;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H41B6293BEC464EC8BF11EE053BA615CF"><enum>(ii)</enum><text display-inline="yes-display-inline">States that have enacted employer-assisted
			 housing program legislation; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H6F7E54DD866C4454926BB02CD95AC1E"><enum>(iii)</enum><text display-inline="yes-display-inline">States considering enacting such
			 legislation;</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H07BFBBE1431A4D83A15F58A4B982427D"><enum>(B)</enum><text display-inline="yes-display-inline">the extent to which Federal funds are being
			 used to support employer-assisted housing programs;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2A076133C7524066860832F88D9F2500"><enum>(C)</enum><text display-inline="yes-display-inline">the size and nature of existing Federal,
			 State, and private employer-assisted housing programs;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9F689E6FF8D04C1DB225C4729CDE39D8"><enum>(D)</enum><text display-inline="yes-display-inline">the types of assistance offered to
			 employees under employer-assisted housing programs;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HAE87CF27FAB64F809175B38B16BB64EF"><enum>(E)</enum><text display-inline="yes-display-inline">the distribution of employers offering
			 employer-assisted housing programs, including a review of the—</text>
						<clause commented="no" display-inline="no-display-inline" id="H5527490257E04B2EA00098DA1D4BDF99"><enum>(i)</enum><text display-inline="yes-display-inline">geographic distribution of such
			 employers;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="HEE414A95B0CE4A3DBCBF2C00DA48FD98"><enum>(ii)</enum><text display-inline="yes-display-inline">industry distribution of such employers;
			 and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H9DCFE6E10E494ADC97B560C5C0BBADDD"><enum>(iii)</enum><text display-inline="yes-display-inline">size distribution of such employers;</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H976A23E323E34F28A5497BAFF96200BC"><enum>(F)</enum><text display-inline="yes-display-inline">the extent to which employer-assisted
			 housing programs are located in <quote>high-cost</quote> housing
			 markets;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6FB4B62BEE454A9D984BA03B4317E775"><enum>(G)</enum><text display-inline="yes-display-inline">the extent to which employers are able to,
			 and have made, use of the tax benefits provided under this Act;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H09613B7F9CE142BD95B5AF1941A831B3"><enum>(H)</enum><text display-inline="yes-display-inline">the information contained in the reports
			 submitted under section 5(e); and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H93D2D6FB0818411492EEFCE4781145C6"><enum>(I)</enum><text display-inline="yes-display-inline">any other information that the Comptroller
			 General determines would be relevant and helpful to the Secretary of Housing
			 and Urban Development (in this section referred to as the
			 <quote>Secretary</quote>) in evaluating the effects of the tax benefits
			 provided under sections 3 and 4 and the grant program established under section
			 5.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H4AF05F976C284293A76CFD118B7D3EB"><enum>(c)</enum><header>Consultation</header><text display-inline="yes-display-inline">In conducting the study required under
			 subsection (a), the Comptroller General shall consult with—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HFF567D3C827E443B88B5E64E8B31B5DD"><enum>(1)</enum><text display-inline="yes-display-inline">appropriate Federal, State, and local
			 government entities; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H854E98A2CDAE4685BCCF670002767594"><enum>(2)</enum><text display-inline="yes-display-inline">interested groups, businesses, persons,
			 universities, and organizations.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HA278860AC40045F69D1B284B8F49F988"><enum>(d)</enum><header>Report</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H511335B4E8BB40DB8FFFA7990447E3A9"><enum>(1)</enum><header>Interim
			 report</header><text display-inline="yes-display-inline">Not later than January
			 1, 2011, the Comptroller General shall submit to the Secretary an interim
			 report on the findings of the study required under subsection (a).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H68E8D498077D4FFF8FDECA965EFD599E"><enum>(2)</enum><header>Final
			 report</header><text display-inline="yes-display-inline">Not later than
			 December 31, 2012, the Comptroller General shall submit to the Secretary a
			 final report that describes—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="HEA8859888FD340C7B4A791A35E095988"><enum>(A)</enum><text display-inline="yes-display-inline">the findings of the study required under
			 subsection (a); and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H620EAE19A825440BB52B4D1B4EF0CC00"><enum>(B)</enum><text display-inline="yes-display-inline">any conclusions and recommendations of such
			 study.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HABF93845043547A597D4DAE5EF88D39"><enum>(e)</enum><header>Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There are
			 authorized to be appropriated $1,000,000 to carry out this section.</text>
