		  to assure access to durable medical equipment under the Medicare

		<section display-inline="no-display-inline" id="H6E6F2469D7B1401CB8AC6ED8421F398F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Medicare Durable Medical Equipment
			 Access Act of 2007</short-title></quote>.</text>
		</section><section id="HAE9D828BE48E41E2B9F4D73437C27237"><enum>2.</enum><header>Beneficiary
			 protections</header>
			<subsection id="H75943AAD64944A8BB100DDDECA10CF06"><enum>(a)</enum><header>Application of
			 quality standards</header><text>Section 1847(b)(2)(B) of the Social Security
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-3">42 U.S.C. 1395w–3(b)(2)(B)</external-xref>) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H3CA47C512C5D4E09ADE58977F5D6F0E2" style="OLC">
					<subparagraph id="H42ED9703DF1445A8A5C3FAF3CCF981A5"><enum>(B)</enum><header>Application of
				quality standards and receipt of advice from oversight
				committee</header><text>The Secretary may not award any contracts under the
				competitive acquisition program under this section unless—</text>
						<clause id="HB8F1731DDFD4421596A61842E253206D"><enum>(i)</enum><text>the quality
				standards have been implemented under section 1834(a)(20); and</text>
						</clause><clause id="H5ECC463169F24BE8B57135EFFDE3AF49"><enum>(ii)</enum><text display-inline="yes-display-inline">the Secretary has received advice from the
				program oversight committee established under subsection
				(c).</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H9022A399C1D74CD69C88388F7D3EA673"><enum>(b)</enum><header>Requiring use of
			 exemptions</header><text>Section 1847(a)(3) of such Act (42 U.S.C.
			 1395w–3(a)(3)) is amended by striking <quote>may exempt</quote> and inserting
			 <quote>shall exempt</quote>.</text>
			</subsection><subsection id="HE338A6E87DD8403B921E816D89EE7824"><enum>(c)</enum><header>Exemption of
			 smaller MSAs</header><text>Section 1847(a)(3)(A) of such Act (42 U.S.C.
			 1395w–3(a)(3)(A)) is amended by inserting <quote>(including any metropolitan
			 statistical area with a population of less than 500,000)</quote> after
			 <quote>rural areas</quote>.</text>
			</subsection><subsection id="H12528BB79852480095DA50EFC6660545"><enum>(d)</enum><header>Application of
			 Federal Advisory Committee Act (FACA) to Program Advisory and Oversight
			 Committee (PAOC)</header><text>Section 1847(c)(4) of such Act (42 U.S.C.
			 1395w–3(c)(4)) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H29F5BFA4AF3F4D3C9CF42F7DFE5F007F" style="OLC">
					<paragraph id="HA92A4255A528413EBE32F69A8E2FA9"><enum>(4)</enum><header>Applicability of
				faca</header><text display-inline="yes-display-inline">The provisions of the
				Federal Advisory Committee Act (5 U.S.C. App.) shall apply to the
				Committee.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HDB4D4F2D54C4485198E327FDC459AAB9"><enum>(e)</enum><header>Effective
			 date</header><text>The amendments made by this section shall be effective as if
			 included in the enactment of the Medicare Prescription Drug, Improvement, and
			 Modernization Act of 2003 (<external-xref legal-doc="public-law" parsable-cite="pl/108/173">Public Law 108–173</external-xref>).</text>
			</subsection></section><section id="H86BEC679E0CB431298847318B0139323"><enum>3.</enum><header>Small supplier
			 protections</header>
			<subsection display-inline="no-display-inline" id="HDA279F93FE2146BE80ECE293377BF3F"><enum>(a)</enum><header>Qualified
			 supplier participation</header><text>Section 1847(b) of the Social Security Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-3">42 U.S.C. 1395w–3(b)</external-xref>) is amended—</text>
				<paragraph id="H130263A66DC341C391F198E8F6021094"><enum>(1)</enum><text>in paragraph
			 (4)(A), by striking <quote>The Secretary may limit</quote> and inserting
			 <quote>Subject to paragraph (6)(D), the Secretary may limit</quote>; and</text>
				</paragraph><paragraph id="HF4F97C4DC8CB48A0A15559AC006F64F6"><enum>(2)</enum><text>in paragraph
			 (6)(D), by adding at the end the following: <quote>Such appropriate steps shall
			 include permitting all suppliers to continue to participate as suppliers at the
			 selected award price so long as they submit bids at less than the fee schedule
			 amount otherwise applicable to the items and they otherwise comply with
			 applicable program requirements.</quote>.</text>
				</paragraph></subsection><subsection id="H540F3E3F928D4C4EA84222D500BF1770"><enum>(b)</enum><header>Restoration of
			 due process</header><text>Section 1847(b)(10) of such Act (42 U.S.C.
			 1395w–3(b)(10)) is amended—</text>
				<paragraph id="HF702651439C540729C1863B0A71F1556"><enum>(1)</enum><text>by striking
			 <quote><header-in-text level="paragraph" style="OLC">No administrative or
			 judicial review</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">Restoration of appeal
			 rights</header-in-text></quote>; and</text>
				</paragraph><paragraph id="H0BBFC3A38E2F4CDC9D6D3401E2A99100"><enum>(2)</enum><text>by striking
			 <quote>There shall be no administrative or judicial review under section 1869,
			 section 1878, or otherwise of</quote> and inserting <quote>Administrative and
			 judicial review shall only be available under section 1869 (and not otherwise)
			 of</quote>.</text>
				</paragraph></subsection><subsection id="HD004C3DF11C049DC9579219C9257C7F9"><enum>(c)</enum><header>Application of
			 requirement for significant savings</header><text>Section 1847(a) of such Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-3">42 U.S.C. 1395w–3(a)</external-xref>) is amended—</text>
				<paragraph id="H97A93D0D1B2C412E9D87B4913D002300"><enum>(1)</enum><text>in paragraph
			 (3)(B), by inserting <quote>of at least 10 percent</quote> after
			 <quote>significant savings</quote>; and</text>
				</paragraph><paragraph id="HB23D580210D14E53A62900BE2E3E20BC"><enum>(2)</enum><text>in paragraph (1),
			 by adding at the end the following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="H2768F246AF2C4BBEA61BF16BA90014D8" style="OLC">
						<subparagraph id="H974D6496B51B49BD851DFFA009CFD400"><enum>(D)</enum><header>Requirement for
				significant savings</header><text>The Secretary shall not implement a program
				under this section with respect to an item or service unless the Secretary
				demonstrates a probability of achieving significant savings of at least 10
				percent, compared to the fee schedule in effect on January 1, 2007, by
				including the item or service in the
				program.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H5A41CAA67A7A4E7480D37E8B065E5747"><enum>(d)</enum><header>Comparability
			 analysis</header><text>Section 1834(a)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(a)(1)</external-xref>)
			 is amended—</text>
				<paragraph id="H9A146356DA314D4183AF73489776CF21"><enum>(1)</enum><text>in subparagraph
			 (F), by inserting <quote>subject to subparagraph (G),</quote> after
			 <quote>2009,</quote>; and</text>
				</paragraph><paragraph id="H35A24844EFC9472AAC11ABB0E2399495"><enum>(2)</enum><text>by adding at the
			 end the following new subparagraphs:</text>
					<quoted-block display-inline="no-display-inline" id="H3C56D1B77F7B4A22A084284440E9B907" style="OLC">
						<subparagraph id="HFE90346AC7AD40B797BE08D2A3508420"><enum>(G)</enum><header>Requirement for
				comparability analysis before implementation</header><text display-inline="yes-display-inline">The Secretary may not implement
				subparagraph (F) with respect to the application of rates in an area that is
				not a competitive acquisition area under section 1847 unless the Secretary has
				completed and published in the Federal Register a comparability analysis to
				ensure the application is appropriate. The comparability analysis shall include
				at least an analysis of the relative costs of providing the particular items
				and services in the respective metropolitan statistical areas and an assessment
				of whether application of the bid rate in an area that is not a competitive
				acquisition area would adversely impact beneficiary access to quality items and
				services.</text>
						</subparagraph><subparagraph id="H782DA04ED9F4466884D45743AB1149F8"><enum>(H)</enum><header>Application of
				comparability analysis requirement to certain other part B items and
				services</header><text display-inline="yes-display-inline">Subparagraph (G)
				shall also apply to the implementation of section 1847(a) with respect to items
				described in paragraph (2)(B) or (2)(C) of such section that are furnished on
				or after January 1,
				2009.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection display-inline="no-display-inline" id="HAD0B9A4DEAAD444FA771BB414C6D85D7"><enum>(e)</enum><header>Effective
			 date</header><text>The amendments made by this section shall be effective as if
			 included in the enactment of the Medicare Prescription Drug, Improvement, and
			 Modernization Act of 2003 (<external-xref legal-doc="public-law" parsable-cite="pl/108/173">Public Law 108–173</external-xref>).</text>
			</subsection></section><section id="H8B1524B5F3804C93BCA2CF7706877203"><enum>4.</enum><header>Report on quality
			 and access impact of implementation at 10 initial competitive acquisition
			 areas</header>
			<subsection id="HD1731ED027634279B8EA52A273A9B860"><enum>(a)</enum><header>Analysis and
			 report</header><text display-inline="yes-display-inline">After the Secretary of
			 Health and Human Services has fully implemented the initial 10 competitive
			 acquisition areas under section 1847 of the Social Security Act, the Secretary
			 shall conduct a complete analysis of the impact of competitive bidding in those
			 areas, including its impact on beneficiary access to quality products and its
			 impact on providers of items and services covered under competition and shall
			 submit a report to Congress on such analysis.</text>
			</subsection><subsection id="H191E124E2B624B02007FA38182704B01"><enum>(b)</enum><header>Moratorium on
			 further implementation until Congressional action</header>
				<paragraph id="H0D6AC0EE70B941E48770F68555C10052"><enum>(1)</enum><header>In
			 general</header><text>Notwithstanding any other provision of law, the Secretary
			 shall not expand the coverage of competitive acquisition programs under section
			 1847(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-3">42 U.S.C. 1395w–3(a)</external-xref>), or apply bid rates
			 to non-bid areas under such section, beyond the 10 competitive acquisition
			 areas identified under paragraph (1)(B)(i)(I) of such section as of the date of
			 the enactment of this Act, unless specifically authorized by Congress after
			 such date.</text>
				</paragraph><paragraph id="HDFBD79869F234D6A8C97F337EBAB156C"><enum>(2)</enum><header>Conforming
			 reference</header><text>Section 1847(a)(1)(B) of the Social Security Act (42
			 U.S.C. 1395w–3(a)(1)(B)) is amended, in the matter before clause (i), by
			 striking <quote>The programs</quote> and inserting <quote>Subject to section
			 4(b)(1) of the <short-title>Medicare Durable Medical
			 Equipment Access Act of 2007</short-title>, the programs</quote>.</text>
