		<section id="H68AA264333FA4B8EA3E9C3FE2FD67D80" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Ambulatory Surgical Center Medicare
			 Payment Modernization Act of 2007</short-title></quote>.</text>
		</section><section id="H074047EE787F429000FE95684220A73F" section-type="subsequent-section"><enum>2.</enum><header>Medicare payment for
			 ambulatory surgical center services</header>
			<subsection id="H10B7E1E609E64E58AEB91D9515008667"><enum>(a)</enum><header>In
			 General</header><text>Section 1833(i) of the Social Security Act (42 U.S.C.
			 1395l(i)) is amended to read as follows:</text>
				<quoted-block id="HF6D1A9352DB9439EA2EBCE00001C23DA" style="OLC">
					<subsection id="H5CDEC11760164B0090E19E52BD1CC26E"><enum>(i)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H0E7E925418194C3B8622881F0019E39D"><enum>(1)</enum><text>Payment shall be made
				under this part in the amount specified under paragraph (2) for facility
				services furnished to an individual in an ambulatory surgical center in
				connection with any outpatient surgical procedure covered under this part as a
				hospital outpatient department service, except for those procedures that the
				Secretary designates, in consultation with appropriate trade and professional
				organizations (including those having direct experience with ambulatory
				surgical centers), as posing a significant safety risk or requiring an
				overnight stay when performed in ambulatory surgical centers. Absent an
				identifiable safety risk specific to the performance of a particular procedure
				in an ambulatory surgical center, the Secretary shall presume that an
				outpatient surgical procedure covered under this part as a hospital outpatient
				department service does not pose a significant safety risk when performed in
				ambulatory surgical centers. Not less frequently than once every two years the
				Secretary shall review and, may, after public comment, make appropriate
				adjustments to this list of procedures excluded from coverage when performed in
				ambulatory surgical centers as the Secretary deems necessary.</text>
						</paragraph><paragraph id="HB3BD3D2FE53D4AF2ABDD59CD54A1BC32" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H07CCE281DAA345C39FB7AB2747DEFBB7"><enum>(A)</enum><text>Subject to subparagraphs
				(B) (C), and (D) the amount of payment to be made under this subsection for
				facility services furnished to an individual in an ambulatory surgical center
				in accordance with paragraph (1) shall be equal to 75 percent of the fee
				schedule amount determined under paragraph (3)(A) of subsection (t) for payment
				of the same service furnished in hospital outpatient departments, as adjusted
				under paragraphs (4)(A), (6), and (15) of such subsection, less a 20 percent
				beneficiary copayment.</text>
							</subparagraph><subparagraph id="H0BC66EA5674B4483AE9F29F10004032C" indent="up1"><enum>(B)</enum><text>For covered ambulatory surgical
				center services furnished on or after January 1, 2008, and before January 1,
				2012, for which the ambulatory surgical center payment amount payable under
				this subsection in 2007 (in this subsection referred to as the <quote>2007 ASC
				payment amount</quote>) is less than 75 percent of the hospital OPD fee
				schedule amount under subsection (t) in 2007 for the same services, the amount
				of payment under this subsection shall be calculated as follows:</text>
								<clause id="H3414A6D834E54DA0B0F07E71D920D11F"><enum>(i)</enum><text>For services furnished during 2008,
				the amount shall be equal to the sum of—</text>
									<subclause id="H65650E6905D14C35B03C21AF86606FBC"><enum>(I)</enum><text>80 percent of the 2007 ASC payment
				amount, as increased by the market basket percentage increase applicable under
				subsection (t)(3)(C)(iv) for OPD services occurring during the fiscal year
				ending in such year; and</text>
									</subclause><subclause id="HC14F6836D18944CAABD0C97859560410"><enum>(II)</enum><text>20 percent of the payment amount
				under paragraph (2)(A) for 2008.</text>
									</subclause></clause><clause id="HA2284D5634B44CDCB4C8B163EE07CB"><enum>(ii)</enum><text>For services furnished during 2009,
				the amount shall be equal to the sum of—</text>
									<subclause id="H18B2BE8E9C11401EB760A8D6C8B295BD"><enum>(I)</enum><text>60 percent of the 2007 ASC payment
				amount as increased under clause (i)(I) and as further increased by the market
				basket percentage increase applicable under subsection (t)(3)(C)(iv) for OPD
				services occurring during the fiscal year ending in such year; and</text>
									</subclause><subclause id="HF0F5EF75749842F997C6DA8449CD2456"><enum>(II)</enum><text>40 percent of the payment amount
				under paragraph (2)(A) for 2009.</text>
									</subclause></clause><clause id="HABF91030ED034E3BBA82133B6BD1D27D"><enum>(iii)</enum><text>For services furnished during 2010,
				the amount shall be equal to the sum of—</text>
									<subclause id="H60ECD7B470FA499480D2EBE2D800CE00"><enum>(I)</enum><text>40 percent of the 2007 ASC payment
				amount as increased under clauses (i)(I) and (ii)(I) and as further increased
				by the market basket percentage increase applicable under subsection
				(t)(3)(C)(iv) for OPD services occurring during the fiscal year ending in such
				year; and</text>
									</subclause><subclause id="H8F1FD6E2E39F46E781B6C12B002E6C86"><enum>(II)</enum><text>60 percent of the payment amount
				under paragraph (2)(A) for 2010.</text>
									</subclause></clause><clause id="H4B413262C0A54B2B8DA613773DC3E89"><enum>(iv)</enum><text>For services furnished during 2011,
				the amount shall be equal to the sum of—</text>
									<subclause id="HDAC7D388558D4D6CB14438009CCE00AB"><enum>(I)</enum><text>20 percent of the 2007 ASC payment
				amount as increased under clauses (i)(I), (ii)(I), and (iii)(I) and as further
				increased by the market basket percentage increase applicable under subsection
				(t)(3)(C)(iv) for OPD services occurring during the fiscal year ending in such
				year; and</text>
									</subclause><subclause id="H95FCB00215AD4AD69EE6B3A86F9CC575"><enum>(II)</enum><text>80 percent of the payment amount
				under paragraph (2)(A) for 2011.</text>
									</subclause></clause></subparagraph><subparagraph id="HB5EF5D168DD545C096FB9C5D81A0D8EE" indent="up1"><enum>(C)</enum><text>For covered ambulatory surgical
				center services for which the 2007 ASC payment amount is—</text>
								<clause id="H4CAB2C84D7474DC3924B4F7F64AB9600"><enum>(i)</enum><text>greater than 75 percent, but less than
				100 percent, of the hospital OPD fee schedule amount under subsection (t) in
				2007 for the same services, the amount of payment under this subsection shall
				be the greater of the 2007 ASC payment amount or—</text>
									<subclause id="HD4977D89DBD644ED9B71C9E8922407AA"><enum>(I)</enum><text>for services furnished in 2008, the
				payment amount under subparagraph (B)(i);</text>
									</subclause><subclause id="HD585B4CB34A04854AED53FDDEE952960"><enum>(II)</enum><text>for services furnished in 2009,
				the payment amount under subparagraph (B)(ii);</text>
									</subclause><subclause id="HB8092A8921484CC28311817CFD661F5"><enum>(III)</enum><text>for services furnished in 2010,
				the payment amount under subparagraph (B)(iii);</text>
									</subclause><subclause id="H93318D74D86741A5B3535200A5EB86FC"><enum>(IV)</enum><text>for services furnished in 2011,
				the payment amount under subparagraph (B)(iv); or</text>
									</subclause><subclause id="H4DE78AF2F34144FB00CC431FB8DA0081"><enum>(V)</enum><text>in 2012 and subsequent years, the
				payment amount under subparagraph (A),</text>
									</subclause><continuation-text continuation-text-level="clause">but in no
				case in excess of the then applicable hospital OPD fee schedule amount;
				or</continuation-text></clause><clause id="H0EDAE6C731C04AF9AA08D8C5860076FC"><enum>(ii)</enum><text>greater than the hospital OPD fee
				schedule amount under subsection (t) in 2007 for the same services, the amount
				of payment under this subsection—</text>
									<subclause id="H202A6D7AE3C644048FF95DB5D0AC9BC9"><enum>(I)</enum><text>for services furnished during 2008,
				is equal to the midpoint between the 2007 ASC payment amount and 100 percent of
				such 2007 hospital OPD fee schedule amount; or</text>
									</subclause><subclause id="H52FD38C9E923428BBA00004800ED4B9B"><enum>(II)</enum><text>for services furnished in a
				subsequent year is equal to the greater of the 2007 hospital OPD fee schedule
				amount or the payment amount specified under subclause (I) through (V) of
				clause (i) for the year involved, but in no case in excess of the then
				applicable hospital OPD fee schedule amount.</text>
									</subclause></clause></subparagraph><subparagraph id="H76E297AAB25942BC9392BDD657DE72C2"><enum>(D)</enum><text>Notwithstanding subparagraphs (A),
				(B), and (C), if a facility service furnished to an individual in an ambulatory
				surgical center includes an implantable medical device, the amount of payment
				for that service shall be equal to the sum of—</text>
								<clause id="H1CD4737C965B4B42807DD25D00CE452"><enum>(i)</enum><text>100 percent of the hospital OPD fee
				schedule amount that the Secretary determines is associated with the device;
				and</text>
								</clause><clause id="H926F0090D5DB410295A0F05864D14C01"><enum>(ii)</enum><text>75 percent of non-device-related
				component of the OPD fee schedule amount;</text>
								</clause><continuation-text continuation-text-level="subparagraph">less a
				20 percent beneficiary
				copayment.</continuation-text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H69635CB330BA4A1496E376A100DF2FF8"><enum>(b)</enum><header>Conforming
			 Amendments</header>
				<paragraph id="H13A48F1010B04BE1A4F5F6703CE3CD7"><enum>(1)</enum><text>Section
			 1832(a)(2)(F)(i) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395k">42 U.S.C. 1395k(a)(2)(F)(i)</external-xref>) is amended—</text>
					<subparagraph id="H008E4B1B2D5F4E63B64C807543FFE508"><enum>(A)</enum><text>by striking
			 <quote>section 1833(i)(1)(A)</quote> and inserting <quote>section
			 1833(i)(1)</quote>;</text>
					</subparagraph><subparagraph id="H178D645F05304A6D003B00122EBAF254"><enum>(B)</enum><text>by striking
			 <quote>the standard overhead amount as determined under section
			 1833(i)(2)(A)</quote> and inserting <quote>the amount determined under section
			 1833(i)(2)</quote>; and</text>
					</subparagraph><subparagraph id="H4411584D78C643A0853B2CC9E7B7BFAE"><enum>(C)</enum><text>by striking all
			 that follows <quote>as full payment for such services</quote> and inserting
			 <quote>, or</quote>.</text>
					</subparagraph></paragraph><paragraph id="HEECC6C89D3BE46E39156F4F288FDC73"><enum>(2)</enum><text>Section
			 1833(a)(1)(G) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l(a)(1)(G)</external-xref>) is amended—</text>
					<subparagraph id="HE1AAE556A15F477AAD1D50B9827ECB9B"><enum>(A)</enum><text>by striking
			 <quote>subsection (i)(1)(A)</quote> and inserting <quote>subsection
			 (i)(1)</quote>;</text>
					</subparagraph><subparagraph id="HEEEA07997F2E44F2B7CC529E8FE7596B"><enum>(B)</enum><text>by striking
			 <quote>for services furnished beginning</quote> and all that follows through
			 <quote>subsection (i)(2)(D)</quote>; and</text>
					</subparagraph><subparagraph id="HF1C8F4889D9940CDAC2538A4D5FE271"><enum>(C)</enum><text>by striking
			 <quote>such revised payment system</quote> and inserting <quote>under
			 subsection (i)(2)</quote>.</text>
					</subparagraph></paragraph><paragraph id="H344F40E3136F410EB2895DB8F4ACFC8B"><enum>(3)</enum><text>Section 1833(a)(4)
			 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l(a)(4)</external-xref>) is amended—</text>
					<subparagraph id="H4DEDE75A99E7432C8F13C7A9681000CB"><enum>(A)</enum><text>by striking
			 <quote>section 1833(i)(1)(A)</quote> and inserting <quote>subsection
			 (i)(1)</quote>; and</text>
					</subparagraph><subparagraph id="H62D9402D91F843188C177E2E51F1103F"><enum>(B)</enum><text>by striking
			 <quote>paragraph (2) or (3) of subsection (i)</quote> and inserting
			 <quote>subsection (i)(1)</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="H28C4F134756348FA955E218E653651AA"><enum>(c)</enum><header>Effective
			 Date</header><text>The amendments made by this section shall apply to
			 ambulatory surgical center services furnished on or after January 1,
			 2008.</text>
