			 title</header><text>This Act may be cited as the <quote><short-title>Menopausal Hormone Replacement Therapies and Alternative
			 Treatments and Fairness Act of 2007</short-title></quote>.</text>

			</subsection></section><section id="H4775F37FA87B42F2B500CEA2D9E09CA"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph id="H3368F39AD5974AEB9670FE00216FBEC8"><enum>(1)</enum><text>The Women’s Health
			 Initiative terminated its study of hormone therapy three years early because of
			 findings that the combination of estrogen and progestin increases the risk of
			 heart disease, stroke, blood clots, and breast cancer, and that estrogen alone
			 increases the risk of stroke and, in women over 65 years of age, increases the
			 risk of dementia.</text>
			</paragraph><paragraph id="H3A80A115D97B4BFCBECEBC97718C4718"><enum>(2)</enum><text>The National
			 Institutes of Health has stated unequivocally that while menopause is a natural
			 process in women’s lives, some women at midlife experience hot flashes, night
			 sweats, vaginal dryness, sleep disturbances, and mood disturbances that disrupt
			 quality of life. Women who have had menopause induced by surgery, chemotherapy,
			 or radiation are more likely to experience these symptoms.</text>
			</paragraph><paragraph id="H5CC209612A924563AC8009735FCC53C"><enum>(3)</enum><text>Women deserve
			 relief from menopause-related symptoms.</text>
			</paragraph><paragraph id="HE07163469C1A42C6BFBA9991DD594F05"><enum>(4)</enum><text>The National
			 Institutes of Health have stated that while estrogen and progestin have been
			 found to be effective remedies for these symptoms, these remedies are not
			 without risk.</text>
			</paragraph><paragraph id="H51BD0B79AAF049A8A50058489E2217E8"><enum>(5)</enum><text>Concerned about
			 these risks, women seek alternative types of treatments for symptoms that
			 disrupt quality of life, such as hot flashes, night sweats, vaginal dryness,
			 sleep disturbances, and mood disturbances.</text>
			</paragraph><paragraph id="HF019B666BF6E40B391F4B7F49541D21"><enum>(6)</enum><text>The National
			 Institutes of Health have found that although there are many alternatives to
			 synthetic hormones available, including bio-identical or <quote>natural</quote>
			 hormones as well as herbal remedies and food supplements, the effectiveness and
			 long-term safety of these products need to be rigorously studied in diverse
			 populations.</text>
			</paragraph><paragraph id="HF6D465FB4263469EACD9D2003C65E312"><enum>(7)</enum><text>Government
			 insurance programs, such as Medicare, Medicaid, the Federal Employees Health
			 Benefits Program (FEHBP), and the Department of Veterans Affairs, do not cover
			 non-prescription alternative treatments for menopause-related symptoms because
			 of a lack of demonstrated safety and efficacy of these products.</text>
			</paragraph><paragraph id="H97A70504A3BE4784AF15964572C38792"><enum>(8)</enum><text>Most private
			 health insurance coverage does not cover non-prescription alternative
			 treatments for menopause-related symptoms because of a lack of demonstrated
			 safety and efficacy of these products.</text>
			</paragraph></section><section id="H470A8574069A4B5FB33FA97CE05EDAC3"><enum>3.</enum><header>Medicare coverage
			 of menopausal hormone replacement therapy and alternative treatments for
			 menopausal hormone replacement therapy</header>
			<subsection id="H40EF1FB9BBE64217A3EA2809A8C2888F"><enum>(a)</enum><header>In
			 general</header><text>Section 1861(s)(2) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(s)(2)</external-xref>) is
			 amended—</text>
				<paragraph id="H04012EAB024B4EAEA982BE5237AC6375"><enum>(1)</enum><text>by striking
			 <quote>and</quote> at the end of subparagraph (Z);</text>
				</paragraph><paragraph id="HF2E5E0C20ED34359982E174389AFFD70"><enum>(2)</enum><text>by adding
			 <quote>and</quote> at the end of subparagraph (AA); and</text>
				</paragraph><paragraph id="H04B9808D8D284A239381AA59A2040989"><enum>(3)</enum><text>by adding at the
			 end the following new subparagraph:</text>
					<quoted-block id="H6E93FD72A3D940C8AC88BCB1EB7C5DBD">
						<subparagraph id="HBEE469A5984F48BDB63858E7076372AF" indent="up1"><enum>(BB)</enum><clause commented="no" display-inline="yes-display-inline" id="H2F69CD3B2D414775841ECA312CAA20C9"><enum>(i)</enum><text display-inline="yes-display-inline">hormone replacement therapy for treatment
				of menopausal symptoms and (ii) an alternative therapy for hormone replacement
				therapy for treatment of menopausal symptoms if the therapy is recommended by a
				health care provider who is licensed, accredited, or certified under State law,
				if it has been proven safe and effective in peer-reviewed scientific studies,
				and if it is administered only after the health care provider obtains the
				informed consent of the patient to receive
				it;</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H9709DC9A3CEC401697F83166146B971"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by subsection (a) shall apply to
			 therapies furnished on or after the date of the enactment of this Act.</text>
			</subsection></section><section id="H04F77F34B9754584AD50DDF8113CC4AA"><enum>4.</enum><header>Medicaid coverage
			 of alternative treatments for menopausal hormone replacement therapy</header>
			<subsection id="H6CCA964F94E44AB794D0A66B16BE5232"><enum>(a)</enum><header>Requirement for
			 coverage</header><text>Section 1902(a)(10) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)(10)</external-xref>) is
			 amended—</text>
				<paragraph id="HA5CAB6EC7A884C87B7CF006193F86B5F"><enum>(1)</enum><text>in subparagraph
			 (A) in the matter before clause (i), by striking <quote>and (21)</quote> and
			 inserting <quote>, (21), and (28)</quote>; and</text>
				</paragraph><paragraph id="H9732E223889E4240926F6E14CCB7F30"><enum>(2)</enum><text>in
			 subparagraph (C)(iv)—</text>
					<subparagraph id="H8D7698E3C01A4176ADB81F6363E2D4F"><enum>(A)</enum><text>by striking
			 <quote>and (17)</quote> and inserting <quote>, (17), and (28)</quote>;
			 and</text>
					</subparagraph><subparagraph id="H490CEDEBB0AC425F825F4C4B52837414"><enum>(B)</enum><text>by striking
			 <quote>through (24)</quote> and inserting <quote>through (28)</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="H0A1DEFC62485469293B16F961D84E319"><enum>(b)</enum><header>Description of
			 covered therapies</header><text>Section 1905(a) of such Act (42 U.S.C.
			 1396d(a)) is amended—</text>
				<paragraph id="HF2A481C9B9ED4BCDBCBF996C1135EC16"><enum>(1)</enum><text>by striking
			 <quote>and</quote> at the end of paragraph (27);</text>
				</paragraph><paragraph id="H0E16057D821D4A748B91FEF3FEA68B5"><enum>(2)</enum><text>by
			 redesignating paragraph (28) as paragraph (29); and</text>
				</paragraph><paragraph id="H5B990FCBE344409596EC1E284923193B"><enum>(3)</enum><text>by inserting after
			 paragraph (27) the following new paragraph:</text>

						<paragraph id="H6CE8D4CAD3B44F4BA21C1300BAF89E09"><enum>(28)</enum><text display-inline="yes-display-inline">an alternative therapy for hormone
				replacement therapy for treatment of menopausal symptoms if the therapy is
				recommended by a health care provider who is licensed, accredited, or certified
				under State law, if it has been proven safe and effective in peer-reviewed
				scientific studies, and if it is administered only after the health care
				provider obtains the informed consent of the patient to receive it;
				and</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H7F3842F4F06E4522A548C0A7C756D057"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section apply to therapies
			 furnished on or after the date of the enactment of this Act, without regard to
			 whether or not final regulations to carry out such amendments have been
			 promulgated by such date.</text>
			</subsection></section><section id="H1C4C53095A55416C0064EC9800962EC5"><enum>5.</enum><header>Coverage of
			 menopausal hormone replacement therapy and alternative treatments for
			 menopausal hormone replacement therapy under group health plans and individual
			 health insurance coverage</header>
			<subsection id="H21DC8BFD7F834C169891E8D4FF052178"><enum>(a)</enum><header>Group health
			 plans</header>
				<paragraph id="HB7FBE0F0AE544C878627167F06D5A9F"><enum>(1)</enum><header><act-name parsable-cite="PHSA">Public Health Service Act</act-name> amendments</header>
					<subparagraph display-inline="no-display-inline" id="H9E6D711C988B4921A62E00BB77172743"><enum>(A)</enum><header>In
			 general</header><text>Subpart 2 of part A of title XXVII of the
			 <act-name parsable-cite="PHSA">Public Health Service Act</act-name> is amended
			 by adding at the end the following new section:</text>

								<subsection id="H0C959B7A600847C4B55C5E5C80FEAE1D"><enum>(a)</enum><header>Requirements</header>
									<paragraph id="HB2902B078B364EB7A65D4610D2C7AD9D"><enum>(1)</enum><header>Menopausal
				hormone replacement therapy</header><text>If a group health plan, or a health
				insurance issuer offering group health insurance coverage, provides benefits
				for outpatient prescription drugs, the plan or coverage may not exclude or
				restrict benefits for hormone replacement therapy for treatment of menopausal
				symptoms.</text>
									</paragraph><paragraph id="H2D05C96FCBFB4E9091E6B6A86993EAA6"><enum>(2)</enum><header>Alternative
				treatments for menopausal hormone replacement therapy</header><text>If a group
				health plan, or a health insurance issuer offering group health insurance
				coverage, provides benefits for hormone replacement therapy for treatment of
				menopausal symptoms, the plan or coverage may not exclude or restrict benefits
				for an alternative therapy for hormone replacement therapy for treatment of
				menopausal symptoms if—</text>
										<subparagraph id="HE95ED18506964483A0504D8FDBC100C9"><enum>(A)</enum><text>the therapy is
				recommended by a health care provider who is licensed, accredited, or certified
				under State law;</text>
										</subparagraph><subparagraph id="HCC869C6D944E4727B0A51552D57B09E"><enum>(B)</enum><text>it has been proven
				safe and effective in peer-reviewed scientific studies; and</text>
										</subparagraph><subparagraph id="HA663F1CF973C4B57B0C0E76745B22584"><enum>(C)</enum><text display-inline="yes-display-inline">it is administered only after the health
				care provider obtains the informed consent of the patient to receive it.</text>
										</subparagraph></paragraph></subsection><subsection id="H44CA4CD2931F4AB682CF542160C110C6"><enum>(b)</enum><header>Notice</header><text>A
				group health plan under this part shall comply with the notice requirement
				under section 714(b) of the <act-name parsable-cite="ERISA">Employee Retirement
				Income Security Act of 1974</act-name> with respect to the requirements of this
				section as if such section applied to such
				plan.</text>
								</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H0F13AB8C64DC454F8EF73E50565312EE"><enum>(B)</enum><header>Conforming
			 amendment</header><text>Section 2723(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-23">42 U.S.C. 300gg–23(c)</external-xref>) is
			 amended by striking <quote>section 2704</quote> and inserting <quote>sections
			 2704 and 2707</quote>.</text>
					</subparagraph></paragraph><paragraph id="H809E765810084ABCA948009613D4BD96"><enum>(2)</enum><header>ERISA
			 amendments</header>
					<subparagraph display-inline="no-display-inline" id="H6A1D829D5AAC4467919E35F872CF16B4"><enum>(A)</enum><header>In
			 general</header><text>Subpart B of part 7 of subtitle B of title I of the
			 <act-name parsable-cite="ERISA">Employee Retirement Income Security Act of
			 1974</act-name> is amended by adding at the end the following new
			 section:</text>

									<paragraph id="HDB09FCD06755490794D600D3F8F41E40"><enum>(1)</enum><header>Menopausal
				hormone replacement therapy</header><text>If a group health plan, or a health
				insurance issuer offering group health insurance coverage, provides benefits
				for outpatient prescription drugs, the plan or coverage may not exclude or
				restrict benefits for hormone replacement therapy for treatment of menopausal
				symptoms.</text>
									</paragraph><paragraph id="HAC157A24411B428F96434430E2DEBFF6"><enum>(2)</enum><header>Alternative
				treatments for menopausal hormone replacement therapy</header><text>If a group
				health plan, or a health insurance issuer offering group health insurance
				coverage, provides benefits for hormone replacement therapy for treatment of
				menopausal symptoms, the plan or coverage may not exclude or restrict benefits
				for an alternative therapy for hormone replacement therapy for treatment of
				menopausal symptoms if—</text>
										<subparagraph id="H49ADB095058544379000A80334E38900"><enum>(A)</enum><text>the therapy is
				recommended by a health care provider who is licensed, accredited, or certified
				under State law;</text>
										</subparagraph><subparagraph id="HD507E638438D44C69D93657ED5337D49"><enum>(B)</enum><text>it has been proven
				safe and effective in peer-reviewed scientific studies; and</text>
										</subparagraph><subparagraph id="HB7105AFE0BED4E0C90F7FA00E3DD887"><enum>(C)</enum><text display-inline="yes-display-inline">it is administered only after the health
				care provider obtains the informed consent of the patient to receive it.</text>
										</subparagraph></paragraph></subsection><subsection id="HDDF76A1592074F0991C5BC32180776D"><enum>(b)</enum><header>Notice under
				group health plan</header><text>The imposition of the requirement of this
				section shall be treated as a material modification in the terms of the plan
				described in the last sentence of section 102(a), for purposes of assuring
				notice of such requirements under the plan; except that the summary description
				required to be provided under the fourth sentence of section 104(b)(1) with
				respect to such modification shall be provided by not later than 60 days after
				the first day of the first plan year in which such requirement
				applies.</text>
								</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="HDA0032B31D2D49758B01717370BA9835" indent="up1"><enum>(B)</enum><header>Conforming amendments</header>

			 U.S.C. 1191(c)) is amended by striking <quote>section 711</quote> and inserting
			 <quote>sections 711 and 714</quote>.</text>

			 U.S.C. 1191a(a)) is amended by striking <quote>section 711</quote> and

			 of 1986 is amended by adding at the end the following:</text>

				hormone replacement therapy</header><text>If a group health plan provides
				benefits for outpatient prescription drugs, the plan may not exclude or
				restrict benefits for hormone replacement therapy for treatment of menopausal
				symptoms.</text>
								</subsection><subsection id="H0D59A39E6D564022AC95E163001FE035"><enum>(b)</enum><header>Alternative
				treatments for menopausal hormone replacement therapy</header><text>If a group
				health plan provides benefits for hormone replacement therapy for treatment of
				menopausal symptoms, the plan may not exclude or restrict benefits for an
				alternative therapy for hormone replacement therapy for treatment of menopausal
				symptoms if—</text>
									<paragraph id="H766C40804F5F4B898DCDCC0BED9A405"><enum>(1)</enum><text>the therapy is
				recommended by a health care provider who is licensed, accredited, or certified
				under State law;</text>
									</paragraph><paragraph id="H0AD2EA60AC5F4C3F9E48A8C55EF28E70"><enum>(2)</enum><text>it has been proven
				safe and effective in peer-reviewed scientific studies; and</text>
									</paragraph><paragraph id="HBB16CB9E2DB24728BBF99D171BD78365"><enum>(3)</enum><text display-inline="yes-display-inline">it is administered only after the health
				care provider obtains the informed consent of the patient to receive
				it.</text>
									</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H855CC97C58BD4B73AFC97B46B02B3E36"><enum>(B)</enum><header>Conforming
			 amendments</header>
						<clause id="HEA118FCB92C94276A028F6EFD0C007F1"><enum>(i)</enum><text>Section
			 4980D(d)(1) of such Code is amended by striking <quote>section 9811</quote> and

				</paragraph></subsection><subsection id="HEE3CDF106CB048CBA9FAFE3D659857A5"><enum>(b)</enum><header>Individual
			 health insurance</header>
				<paragraph display-inline="no-display-inline" id="H14365519705449F69950F97C8300C571"><enum>(1)</enum><header>In
			 general</header><text>Part B of title XXVII of the
			 <act-name parsable-cite="PHSA">Public Health Service Act</act-name> is amended
			 by inserting after section 2752 the following new section:</text>

						<section id="HDFFC61C1B40D4D30A72881166BE37223"><enum>2753.</enum><header>Standard
				relating to coverage of menopausal hormone replacement therapy and alternative
				treatments for menopausal hormone replacement therapy</header>
							<subsection id="H3739755024834B999451F00000E06964"><enum>(a)</enum><header>In
				general</header><text>The provisions of section 2707(a) shall apply to health
				insurance coverage offered by a health insurance issuer in the individual
				market in the same manner as they apply to health insurance coverage offered by
				a health insurance issuer in connection with a group health plan in the small
				or large group market.</text>
							</subsection><subsection id="HC68840E9518A4705B07C5BCAD8452627"><enum>(b)</enum><header>Notice</header><text>A
				health insurance issuer under this part shall comply with the notice
				requirement under section 714(b) of the <act-name parsable-cite="ERISA">Employee Retirement Income Security Act of
				1974</act-name> with respect to the requirements referred to in subsection (a)
				as if such section applied to such issuer and such issuer were a group health
				plan.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HDCA74786361F4042ADA53676CE116692"><enum>(2)</enum><header>Conforming
			 amendment</header><text>Section 2762(b)(2) of such Act (42 U.S.C.
			 300gg–62(b)(2)) is amended by striking <quote>section 2751</quote> and
			 inserting <quote>sections 2751 and 2753</quote>.</text>
				</paragraph><paragraph id="H90292BF084D040D690100000FE6B47D9"><enum>(3)</enum><header>Effective
			 date</header><text>The amendments made by this subsection shall apply with
			 respect to therapies furnished on or after the date of the enactment of this
			 Act.</text>
				</paragraph></subsection><subsection id="H7453AE657F234C86925D33841760FAEA"><enum>(c)</enum><header>Coordination of
			 administration</header><text>The Secretary of Labor, the Secretary of the
			 Treasury, and the Secretary of Health and Human Services shall ensure, through
			 the execution of an interagency memorandum of understanding among such
			 Secretaries, that—</text>
				<paragraph id="H323D9710FD084573A220137E56F608F1"><enum>(1)</enum><text>regulations,
			 rulings, and interpretations issued by such Secretaries relating to the same
			 matter over which two or more such Secretaries have responsibility under the
			 provisions of this section (and the amendments made thereby) are administered
			 so as to have the same effect at all times; and</text>
				</paragraph><paragraph id="HCB9062D538AD40288E675890186B1B35"><enum>(2)</enum><text>coordination of
			 policies relating to enforcing the same requirements through such Secretaries
			 in order to have a coordinated enforcement strategy that avoids duplication of
			 enforcement efforts and assigns priorities in enforcement.</text>
				</paragraph></subsection></section><section id="H1F19E4840B9E477387F8D38704F9E6D2"><enum>6.</enum><header>Coverage of
			 menopausal hormone replacement therapy and alternative treatments for
			 menopausal hormone replacement therapy under FEHBP</header>
			<subsection id="HBBAFCA182AA04DE2B5B98F14C1867F95"><enum>(a)</enum><header>In
			 general</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/8902">Section 8902</external-xref> of title 5, United States Code, is amended
			 by adding at the end the following new subsection:</text>
				<quoted-block id="HC012C6F506A74A32A2FE0F2B1D94D2C">
					<subsection id="H279864982B7F4007A9C65DD7D07EC098"><enum>(p)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H2F46A3C1F807434EAC9EEEDB103FF17"><enum>(1)</enum><text>If a contract or plan
				provides benefits for outpatient prescription drugs, the contract or plan may
				not exclude or restrict benefits for hormone replacement therapy for treatment
				of menopausal symptoms.</text>
						</paragraph><paragraph id="H65486A0525BC4C48A2073659B2E68B83" indent="up1"><enum>(2)</enum><text>If a contract or plan provides
				benefits for hormone replacement therapy for treatment of menopausal symptoms,
				the contract or plan may not exclude or restrict benefits for an alternative
				therapy for hormone replacement therapy for treatment of menopausal symptoms
				if—</text>
							<subparagraph id="H6A6B09EB54C547BFBE55169CBF57BC7C"><enum>(A)</enum><text>the therapy is recommended by a health
				care provider who is licensed, accredited, or certified under State law;</text>
							</subparagraph><subparagraph id="H1B3C96B04A0F41CEAA9113DB51EDE75D"><enum>(B)</enum><text>it has been proven safe and effective
				in peer-reviewed scientific studies; and</text>
							</subparagraph><subparagraph id="H78B7E4B2382C43CCBEF900D883BE294C"><enum>(C)</enum><text display-inline="yes-display-inline">it
				is administered only after the health care provider obtains the informed
				consent of the patient to receive
				it.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H32E06C2B297949FEBB82749FB340FC6D"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by this section shall apply with respect
			 to contracts made and plans approved on or after the date of the enactment of
			 this Act.</text>
			</subsection></section><section id="HC7F1E2EC1B854ACEB0BE90A10079CBA8"><enum>7.</enum><header>Coverage of
			 alternative treatments for menopausal hormone replacement therapy under
			 Department of Veterans Affairs health care system</header>
			<subsection id="H09C3A784EA524EA2AFCD85E8BA254FE6"><enum>(a)</enum><header>In
			 general</header><text><external-xref legal-doc="usc" parsable-cite="usc/38/1701">Section 1701(6)</external-xref> of title 38, United States Code, is
			 amended by adding at the end the following new subparagraph:</text>
				<quoted-block id="H280E803B96C6471594D1707CE82C2900">
					<paragraph id="H49BD969D38E543A9A0B59F12FDB4EE2"><enum>(G)</enum><text display-inline="yes-display-inline">An alternative therapy for hormone
				replacement therapy for treatment of menopausal symptoms if the therapy is
				recommended by a health care provider who is licensed, accredited, or certified
				under State law, if the therapy has been proven safe and effective in
				peer-reviewed scientific studies, and if it is administered only after the
				health care provider obtains the informed consent of the patient to receive
				it.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H8C312817A4E24B18B7C3152942373C4C"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by subsection (a) shall apply to
			 therapies furnished on or after the date of the enactment of this Act.</text>
