		<official-title>To amend the National Defense Authorization Act for
		  Fiscal Year 2006 to expand the provision of special immigrant status for
		  certain aliens, including translators or interpreters, serving with Federal
		  agencies in Iraq and Afghanistan.</official-title>

		<section display-inline="no-display-inline" id="H59EF98A7D6824612009FC153C9728490" section-type="section-one"><enum>1.</enum><header>Special immigrant status for
			 certain aliens, including translators and interpreters, serving with Federal
			 agencies in Iraq and Afghanistan</header>
			<subsection id="H9730AE0C6BFB4799A21225DC8D004B8B"><enum>(a)</enum><header>Increase in
			 numbers admitted and aliens eligible</header>
				<paragraph id="HE23A5FA7283947C4B77F1855B08061D5"><enum>(1)</enum><header>In
			 general</header><text>Section 1059 of the National Defense Authorization Act
			 for Fiscal Year 2006 (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref> note) is amended—</text>
					<subparagraph id="HE6750776D2D949D4A41E7BC9BF575FB9"><enum>(A)</enum><text>in the heading, by
			 striking <quote><header-in-text level="section" style="OLC">as translators with
			 united states armed forces</header-in-text></quote> and inserting
			 <quote><header-in-text level="section" style="OLC">with federal agencies in
			 Iraq and Afghanistan</header-in-text></quote>;</text>
					</subparagraph><subparagraph id="H58AAD3D63CB147F4B47407675BEAE8FD"><enum>(B)</enum><text>in subsection
			 (b)(1)—</text>
						<clause id="H78DF68540E7E4F73881B4DFBE96623D2"><enum>(i)</enum><text>in
			 subparagraph (B), by striking <quote>as a translator</quote> and inserting
			 <quote>, or under Chief of Mission authority, as a translator, interpreter, or
			 other capacity</quote> ;</text>
						</clause><clause id="H7D8232DCD7594A0FB98560DAF23CF79"><enum>(ii)</enum><text>in
			 subparagraph (C), by inserting <quote>the Chief of Mission or</quote> after
			 <quote>recommendation from</quote>; and</text>
						</clause><clause id="H21AB5DD5006A47F698D4FCA96B243FC3"><enum>(iii)</enum><text>in
			 subparagraph (D), by inserting <quote>the Chief of Mission or</quote> after
			 <quote>as determined by</quote>; and</text>
						</clause></subparagraph><subparagraph id="H0C55BA63EA9C4A2A8B233285F3CFB13"><enum>(C)</enum><text>in subsection
			 (c)(1), by inserting <quote>(or, beginning with fiscal year 2007, 500 or such
			 greater number as the Secretary of Homeland Security determines is warranted by
			 the circumstances)</quote> after <quote>50</quote>.</text>
					</subparagraph></paragraph><paragraph id="HAE3AA364E79446F788A3273D8CCFD67"><enum>(2)</enum><header>Review</header><text>If
			 the circumstances warrant, the Secretary of Homeland Security, in consultation
			 with the Secretary of State, shall review the numerical limitation established
			 under section 1059(c)(1) of such Act, as amended by paragraph (1)(B), and may
			 submit a report to Congress recommending an increase in such limitation.</text>
				</paragraph><paragraph id="H1A5B495F4C6D4B07825822ACC2D844F8"><enum>(3)</enum><header>Report</header><text>The
			 Secretary of Homeland Security shall submit to Congress a report whenever the
			 Secretary increases, under subsection (c)(1) of section 1059 of such Act, as
			 amended by paragraph (1)(B), the number of aliens provided special immigrant
			 status under under such section. Such report shall include an explanation of
			 the circumstances warranting such increase.</text>
				</paragraph></subsection><subsection id="HE8FD821C07AB4F11A1E711D683DE482"><enum>(b)</enum><header>Exclusion from
			 numerical limitation</header><text>Section 1059(c)(2) of such Act is
			 amended—</text>
				<paragraph id="HEC3A669334A341EA8B1CF8D387EC23D2"><enum>(1)</enum><text>in the heading, by
			 striking <quote><header-in-text level="paragraph" style="OLC">Counting
			 against</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">Exclusion from</header-in-text></quote>;
			 and</text>
				</paragraph><paragraph id="HD9B38AFD4E664A49B0446964424F3EEA"><enum>(2)</enum><text>by inserting
			 before the period at the end the following: <quote>but shall not be counted
			 against any numerical limitation under section 201(d), 202(a), or 203(b)(4) of
			 such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151(d)</external-xref>, 1152(a), and 1153(b)(4))</quote>.</text>
				</paragraph></subsection><subsection id="HEB25E392C1F54087BB96D6C17886A4C5"><enum>(c)</enum><header>Adjustment of
			 status</header><text>Section 1059 of such Act is further amended—</text>
				<paragraph id="H28189E786FFA401C9BD14B3C000039D1"><enum>(1)</enum><text>by redesignating
			 subsection (d) as subsection (e); and</text>
				</paragraph><paragraph id="H29B57D2A63EC429AA81CECEED98D1B1C"><enum>(2)</enum><text>by inserting after
			 subsection (c) the following:</text>
					<quoted-block display-inline="no-display-inline" id="H5F6C86EED3C940EC00664E429763A918" style="OLC">
						<subsection id="HA8D9D26F8E8F466998094F1B2215305B"><enum>(d)</enum><header>Adjustment of
				status</header><text>Notwithstanding paragraphs (2), (7), and (8) of section
				245(c) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1255">8 U.S.C. 1255(c)</external-xref>), the Secretary
				of Homeland Security may adjust the status of an alien to that of a lawful
				permanent resident under section 245(a) of such Act if the alien—</text>
							<paragraph id="HC86DCF57825049658321B86927C06E4B"><enum>(1)</enum><text>was paroled or
				admitted as a nonimmigrant into the United States; and</text>
							</paragraph><paragraph id="HFCA63FE97B3F49D79DC774E5EEEC1DEC"><enum>(2)</enum><text>is otherwise
				eligible for special immigrant status under this section and under the
				Immigration and Nationality
				Act.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H6EF51DEFAA4D4A4AB3D14EAFB726CFB1"><enum>(d)</enum><header>Refugee
			 assistance eligibility</header><text>Section 1059 of such Act, as amended by
			 subsection (c), is further amended—</text>
				<paragraph id="H30F92E77D644433CAB8834425EBCE125"><enum>(1)</enum><text>by redesignating
			 (e) as subsection (f); and</text>
				</paragraph><paragraph id="H7EB169259B9A4DA9AC6D69406417503F"><enum>(2)</enum><text>by inserting after
			 subsection (d) the following:</text>
					<quoted-block display-inline="no-display-inline" id="H464C227702F44954BB5EF0E4F541FDB" style="OLC">
						<subsection id="HF882D40060A34FD783B8138F6B293BB7"><enum>(e)</enum><header>Eligibility for
				refugee assistance</header><text display-inline="yes-display-inline">Any alien
				provided special immigrant status under this section shall be eligible for
				benefits under chapter 2 of title IV of the Immigration and Nationality Act to
				the same extent as individuals admitted (or awaiting admission) to the United
				States under section 207 of such Act are eligible for benefits under such
				chapter.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H3D6093048B954BFB85B9ABB62629E8E"><enum>(e)</enum><header>Sunset
			 provision</header><text>Section 1059 of such Act, as amended by subsections (c)
			 and (d), is further amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H617DC85D329248058060D75200F96195" style="OLC">
					<subsection id="H34F8255BD2474A6CA3FA0096E80212F6"><enum>(g)</enum><header>Sunset
				provision</header>
						<paragraph id="H3997DB52754542F2880018D455771697"><enum>(1)</enum><header>In
				general</header><text>This section is repealed on the date that is 3 years
				after the date of the enactment of this subsection.</text>
						</paragraph><paragraph id="HF85664D14EE448049018743015FD1405"><enum>(2)</enum><header>Applicability</header><text>Notwithstanding
				paragraph (1), the Secretary of Homeland Security may provide an alien with the
				status of a special immigrant under this section if—</text>
							<subparagraph id="H661682A5C28E4CF0AA4F2D38062692A8"><enum>(A)</enum><text>the alien’s
				petition for such status was pending before the date described in paragraph
				(1); and</text>
							</subparagraph><subparagraph id="HB3DFD309375F4160AEBCCA32A5BFE394"><enum>(B)</enum><text>the alien was
				eligible for such status at the time the petition was
				filed.</text>
