<legis-type>AN ACT</legis-type> 
<official-title display="yes">To assist in the conservation of cranes by supporting and providing, through projects of persons and organizations with expertise in crane conservation, financial resources for the conservation programs of countries the activities of which directly or indirectly affect cranes and the ecosystems of cranes.</official-title>

<section id="HD105FE04A9444E7DA0274234FFDD9C7C" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Crane Conservation Act of 2008</short-title></quote>.</text></section> 
<section id="HFD29B59F2F8648FE84734C79BB9FBA"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text> 
<paragraph id="HBACB65A4D65C4944BBEEC7F9D79EF7C"><enum>(1)</enum><text>to perpetuate healthy populations of cranes;</text></paragraph> 
<paragraph id="HC13096D90E99446C92AC9799AB8E0713"><enum>(2)</enum><text>to assist in the conservation and protection of cranes by supporting—</text> 
<subparagraph id="H41CCBF5C4C1E4395B8ACB9EE9928C480"><enum>(A)</enum><text>conservation programs in countries in which endangered and threatened cranes occur; and</text></subparagraph> 
<subparagraph id="HE0FF181C09364745BC04B7C897CC332F"><enum>(B)</enum><text>the efforts of private organizations committed to helping cranes; and</text></subparagraph></paragraph> 
<paragraph id="HCC8A5142E37B494085348823A99E0081"><enum>(3)</enum><text>to provide financial resources for those programs and efforts.</text></paragraph></section> 
<section id="H0D2CF210B62D4D2A84F767433E57BFA1"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="H5449C0E586174DA0A856655B5D5D80B1"><enum>(1)</enum><header>Conservation</header> 
<subparagraph id="HAFD85199038D4DE9B9A1132BCF92BD82"><enum>(A)</enum><header>In general</header><text>The term <term>conservation</term> means the use of any method or procedure to improve the viability of crane populations and the quality of the ecosystems and habitats on which the crane populations depend to help the species achieve sufficient populations in the wild to ensure the long-term viability of the species.</text></subparagraph> 
<subparagraph id="H80FF87191A38457197840976A966B4D0"><enum>(B)</enum><header>Inclusions</header><text>The term <term>conservation</term> includes the carrying out of any activity associated with scientific resource management, such as—</text> 
<clause id="H1E9EF13283B04A1B973400C80098D23C"><enum>(i)</enum><text>protection, restoration, and management of habitat;</text></clause> 
<clause id="H6C008AC5411C4351BFE5F702951CE824"><enum>(ii)</enum><text>research and monitoring of known populations;</text></clause> 
<clause id="HAF9452E92B9F4E778BDD899DEE3332"><enum>(iii)</enum><text>the provision of assistance in the development of management plans for managed crane ranges;</text></clause> 
<clause id="HC5A61C1324CB41AD982946D1CD444E58"><enum>(iv)</enum><text>enforcement of the Convention;</text></clause> 
<clause id="H5C16B3FA949F419DBC907DEF06E64D88"><enum>(v)</enum><text>law enforcement and habitat protection through community participation;</text></clause> 
<clause id="H15456ED8AB3D49259968390095A1DA1C"><enum>(vi)</enum><text>reintroduction of cranes to the wild;</text></clause> 
<clause id="H87D5BF5D76264D9B8732804F351071DB"><enum>(vii)</enum><text>conflict resolution initiatives; and</text></clause> 
<clause id="H09174A9574674AE1B451C12EB68D7B1D"><enum>(viii)</enum><text>community outreach and education.</text></clause></subparagraph></paragraph> 
<paragraph id="H88E10AC7F1864846877F7BFA50C7FB09"><enum>(2)</enum><header>Convention</header><text>The term <term>Convention</term> has the meaning given the term in section 3 of the <act-name parsable-cite="ESA">Endangered Species Act of 1973</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/16/1532">16 U.S.C. 1532</external-xref>).</text></paragraph> 
<paragraph id="H5A7F79C95C4F4A3FA8A5BFD714F98E8"><enum>(3)</enum><header>Fund</header><text>The term <term>Fund</term> means the Crane Conservation Fund established by section 5(a).</text></paragraph> 
<paragraph id="HDC60B549E03F4C55AB1F00C3C6AABB7C"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph></section> 
<section id="HBF7C178A5AD141AFA0202C5D04F32424"><enum>4.</enum><header>Crane conservation assistance</header> 
<subsection id="HED8F861AF5124FFAAA34000075813079"><enum>(a)</enum><header>In General</header><text>Subject to the availability of appropriations and in consultation with other appropriate Federal officials, the Secretary shall use amounts in the Fund to provide financial assistance for projects relating to the conservation of cranes for which project proposals are approved by the Secretary in accordance with this section.</text></subsection> 
<subsection id="HDB60D9BBF62F4FFF883249A4FB049A9"><enum>(b)</enum><header>Project Proposals</header> 
<paragraph id="H0E2A3D5E24E3482EB2F4A6985814CD98"><enum>(1)</enum><header>Applicants</header> 
<subparagraph id="HD9A6AF71BE5746CA8B1EEB57CBE16670"><enum>(A)</enum><header>In general</header><text>An applicant described in subparagraph (B) that seeks to receive assistance under this section to carry out a project relating to the conservation of cranes shall submit to the Secretary a project proposal that meets the requirements of this section.</text></subparagraph> 
<subparagraph id="HF337A0EA52924607BC00C798BD38DFB0"><enum>(B)</enum><header>Eligible applicants</header><text>An applicant described in this subparagraph is—</text> 
<clause id="HDBA8CA985F5D4700A5D700CB57F6F000"><enum>(i)</enum><text>any relevant wildlife management authority of a country that—</text> 
<subclause id="H909D4F3384D441CA8BC9ACE4897CEB44"><enum>(I)</enum><text>is located within the African, Asian, European, or North American range of a species of crane; and</text></subclause> 
<subclause id="H9303E66D9518456383C371276378D950"><enum>(II)</enum><text>carries out 1 or more activities that directly or indirectly affect crane populations;</text></subclause></clause> 
<clause id="HE0469501D7134E4282094FB951AD3F00"><enum>(ii)</enum><text>the Secretariat of the Convention; and</text></clause> 
<clause id="HC480FAEC55DC4F6CA935EB5E95953BEC"><enum>(iii)</enum><text>any person or organization with demonstrated expertise in the conservation of cranes.</text></clause></subparagraph></paragraph> 
<paragraph id="H9B8C708F802B44980086565000F2D02"><enum>(2)</enum><header>Required elements</header><text>A project proposal submitted under paragraph (1)(A) shall include—</text> 
<subparagraph id="H88C412A1BA934601947C06AFDC6108D8"><enum>(A)</enum><text>a concise statement of the purpose of the project;</text></subparagraph> 
<subparagraph id="H25586817E9C047EAB23D8E7F957D2FEC"><enum>(B)</enum> 
<clause commented="no" display-inline="yes-display-inline" id="H469388A0155D445187579D88020369A6"><enum>(i)</enum><text>the name of each individual responsible for conducting the project; and</text></clause> 
<clause id="HBFDAE4247D864ED4BDC8AD5E9158E983" indent="up1"><enum>(ii)</enum><text>a description of the qualifications of each of those individuals;</text></clause></subparagraph> 
<subparagraph id="HF44E2EA412164AF181054969C9501400"><enum>(C)</enum><text>a concise description of—</text> 
<clause id="H712EA9A27B644F9CAD983F33D4B8AAF5"><enum>(i)</enum><text>methods to be used to implement and assess the outcome of the project;</text></clause> 
<clause id="H4195157F912F46D7BE3F76AAE53918E5"><enum>(ii)</enum><text>staff and community management for the project; and</text></clause> 
<clause id="H5BEFECA253B34223B4D230EB546695B2"><enum>(iii)</enum><text>the logistics of the project;</text></clause></subparagraph> 
<subparagraph id="H2AD857602F994C8BAA1BB597003287E0"><enum>(D)</enum><text>an estimate of the funds and the period of time required to complete the project;</text></subparagraph> 
<subparagraph id="H253B88488C9D4B2F81103BFB6500A930"><enum>(E)</enum><text>evidence of support for the project by appropriate government entities of countries in which the project will be conducted, if the Secretary determines that such support is required to ensure the success of the project;</text></subparagraph> 
<subparagraph id="HC4914F4C2D104FB685E54C216B2E5D58"><enum>(F)</enum><text>information regarding the source and amount of matching funding available for the project; and</text></subparagraph> 
<subparagraph id="H362AA4B5B96740CFA7707CB43E955FAD"><enum>(G)</enum><text>any other information that the Secretary considers to be necessary for evaluating the eligibility of the project to receive assistance under this Act.</text></subparagraph></paragraph></subsection> 
<subsection id="HC25491F6D5B74DDAB33495D468A9D14E"><enum>(c)</enum><header>Project Review and Approval</header> 
<paragraph id="H035FB386442E41AF8F6CBAFB26922315"><enum>(1)</enum><header>In general</header><text>The Secretary shall—</text> 
<subparagraph id="H333CE0C78C994AC1946C2E923C008D45"><enum>(A)</enum><text>not later than 30 days after receiving a final project proposal, provide a copy of the proposal to other appropriate Federal officials; and</text></subparagraph> 
<subparagraph id="H0275877436264E98AD00A799DFB8B2F"><enum>(B)</enum><text>review each project proposal in a timely manner to determine whether the proposal meets the criteria described in subsection (d).</text></subparagraph></paragraph> 
<paragraph id="HEA12FCD6C04B42BB9B9B83003BC793D"><enum>(2)</enum><header>Consultation; approval or disapproval</header><text>Not later than 180 days after receiving a project proposal, and subject to the availability of appropriations, the Secretary, after consulting with other appropriate Federal officials, shall—</text> 
<subparagraph id="H575B1334F8F043920015ABDB005F668E"><enum>(A)</enum><text>consult on the proposal with the government of each country in which the project is to be carried out;</text></subparagraph> 
<subparagraph id="H885D73AAB6084E72B9FAF4098E38D3E"><enum>(B)</enum><text>after taking into consideration any comments resulting from the consultation, approve or disapprove the proposal; and</text></subparagraph> 
<subparagraph id="HA7541C288398415BAF152353C115B8D3"><enum>(C)</enum><text>provide written notification of the approval or disapproval to—</text> 
<clause id="HAA111C57B3D446FE9E757091E422CAC9"><enum>(i)</enum><text>the applicant that submitted the proposal;</text></clause> 
<clause id="H2ABFEBFBC3584A9FB4CA1251E400A542"><enum>(ii)</enum><text>other appropriate Federal officials; and</text></clause> 
<clause id="H5AB0FF32722E478FA4EC2896D45F036E"><enum>(iii)</enum><text>each country described in subparagraph (A).</text></clause></subparagraph></paragraph></subsection> 
<subsection id="H735CD2008263496FA919437300F73871"><enum>(d)</enum><header>Criteria for Approval</header><text>The Secretary may approve a project proposal under this section if the Secretary determines that the proposed project will enhance programs for conservation of cranes by assisting efforts to—</text> 
<paragraph id="HD082D8EBBCD84AC28445CB5650FA001D"><enum>(1)</enum><text>implement conservation programs;</text></paragraph> 
<paragraph id="H951D04B3DEBE40AC9C15B690F910861B"><enum>(2)</enum><text>address the conflicts between humans and cranes that arise from competition for the same habitat or resources;</text></paragraph> 
<paragraph id="H29BB890B98CC446EAE24B23E68841B48"><enum>(3)</enum><text>enhance compliance with the Convention and other applicable laws that—</text> 
<subparagraph id="HB63895B3A5CB4DEC9DB55FE85712A0F3"><enum>(A)</enum><text>prohibit or regulate the taking or trade of cranes; or</text></subparagraph> 
<subparagraph id="HD78037F1F87B46E0A6F2A30094DAFC9C"><enum>(B)</enum><text>regulate the use and management of crane habitat;</text></subparagraph></paragraph> 
<paragraph id="H519D6EF8B2E34712911C1E82D985DC2D"><enum>(4)</enum><text>develop sound scientific information on, or methods for monitoring—</text> 
<subparagraph id="HD57B3480077244889B1393AD7EEB53CA"><enum>(A)</enum><text>the condition of crane habitat;</text></subparagraph> 
<subparagraph id="H91655538A0B140E6A583C2E2263BA6A0"><enum>(B)</enum><text>crane population numbers and trends; or</text></subparagraph> 
<subparagraph id="H59622820192C4C71A100D25EFB25D4BD"><enum>(C)</enum><text>the current and projected threats to crane habitat and population numbers and trends;</text></subparagraph></paragraph> 
<paragraph id="HA9BBAD65FC4F411EA531952252AA5D07"><enum>(5)</enum><text>promote cooperative projects on the issues described in paragraph (4) among—</text> 
<subparagraph id="H288A97A33A084C34A9B4EF6C9B00622D"><enum>(A)</enum><text>governmental entities;</text></subparagraph> 
<subparagraph id="HAFBDD567FCC94C0EA8DA03371000A363"><enum>(B)</enum><text>affected local communities;</text></subparagraph> 
<subparagraph id="H116C734B147147EF82D4C010BE878446"><enum>(C)</enum><text>nongovernmental organizations; or</text></subparagraph> 
<subparagraph id="HC6F8FB4CF16345C49CDCF209A8D3A550"><enum>(D)</enum><text>other persons in the private sector;</text></subparagraph></paragraph> 
<paragraph id="H66ACBE1AE8084BA2ABD042C00CB5674"><enum>(6)</enum><text>carry out necessary scientific research on cranes;</text></paragraph> 
<paragraph id="H4B9DF99A211543D184C7E88D14009D00"><enum>(7)</enum><text>provide relevant training to, or support technical exchanges involving, staff responsible for managing cranes or habitats of cranes, to enhance capacity for effective conservation; or</text></paragraph> 
<paragraph id="H054437E1AD0347E500FD2054EE48A6B4"><enum>(8)</enum><text>reintroduce cranes successfully back into the wild, including propagation of a sufficient number of cranes required for this purpose.</text></paragraph></subsection> 
<subsection id="HEF8AFEBF39DD4899A3CEE3BC65E67387"><enum>(e)</enum><header>Project Sustainability; Matching Funds</header><text>To the maximum extent practicable, in determining whether to approve a project proposal under this section, the Secretary shall give preference to a proposed project—</text> 
<paragraph id="H0F04528DDA34441A00D48C0494CBA302"><enum>(1)</enum><text>that is designed to ensure effective, long-term conservation of cranes and habitats of cranes; or</text></paragraph> 
<paragraph id="H386D6E2335234478BA4C3630E3A5A3C2"><enum>(2)</enum><text>for which matching funds are available.</text></paragraph></subsection> 
<subsection id="HAE31D3C7EC7E4E5DBFBBBCF4DA04A8CF"><enum>(f)</enum><header>Project Reporting</header> 
<paragraph id="H07741822717E44C1BBD83122AAACA508"><enum>(1)</enum><header>In general</header><text>Each person that receives assistance under this section for a project shall submit to the Secretary, at such periodic intervals as are determined by the Secretary, reports that include all information that the Secretary, after consulting with other appropriate government officials, determines to be necessary to evaluate the progress and success of the project for the purposes of—</text> 
<subparagraph id="H066ACC034FB146298DEEA5FE0087F828"><enum>(A)</enum><text>ensuring positive results;</text></subparagraph> 
<subparagraph id="HF73B06291FCD4D38A025A05EA1B200F"><enum>(B)</enum><text>assessing problems; and</text></subparagraph> 
<subparagraph id="HA190D941C57C4913A38800077432D760"><enum>(C)</enum><text>fostering improvements.</text></subparagraph></paragraph> 
<paragraph id="HC7B6ADBF3E8B4B239922DB69000782A3"><enum>(2)</enum><header>Availability to the public</header><text>Each report submitted under paragraph (1), and any other documents relating to a project for which financial assistance is provided under this Act, shall be made available to the public.</text></paragraph></subsection></section> 
<section id="H6CC37DC358E743E9BD7778DE411B551"><enum>5.</enum><header>Crane Conservation Fund</header> 
<subsection id="HEA965F355D1E4A408E00F6B0014063D2"><enum>(a)</enum><header>Establishment</header><text>There is established in the Multinational Species Conservation Fund established by the matter under the heading <quote>MULTINATIONAL SPECIES CONSERVATION FUND</quote> in title I of the Department of the Interior and Related Agencies Appropriations Act, 1999 (112 Stat. 2681–237; <external-xref legal-doc="usc" parsable-cite="usc/16/4246">16 U.S.C. 4246</external-xref>) a separate account to be known as the <quote>Crane Conservation Fund</quote>, consisting of—</text> 
<paragraph id="H34B6FF64FA4046B687E947AC93D9CBB7"><enum>(1)</enum><text>amounts transferred to the Secretary of the Treasury for deposit into the Fund under subsection (c); and</text></paragraph> 
<paragraph id="H83BD7A17E60B443EA13EE5F248532170"><enum>(2)</enum><text>amounts appropriated to the Fund under section 7.</text></paragraph></subsection> 
<subsection id="H6DB1EAB9ADE54F69B3E73BD4B5AD625E"><enum>(b)</enum><header>Expenditures From Fund</header> 
<paragraph id="HCF8FA1C872784B2D8D6EA0534C33F5C2"><enum>(1)</enum><header>In general</header><text>Subject to paragraphs (2) and (3), upon request by the Secretary, the Secretary of the Treasury shall transfer from the Fund to the Secretary, without further appropriation, such amounts as the Secretary determines are necessary to provide assistance under section 4.</text></paragraph> 
<paragraph id="HAD43BE40A5AF4D4FB75DFFF153035C3"><enum>(2)</enum><header>Administrative expenses</header><text>Of the amounts in the Fund available for each fiscal year, the Secretary may expend not more than 3 percent, or $150,000, whichever is greater, to pay the administrative expenses necessary to carry out this Act.</text></paragraph> 
<paragraph id="H019D24AEA59144CAA0B7645507A0B641"><enum>(3)</enum><header>Limitation</header><text>Not more than 20 percent of the amounts made available from the Fund for any fiscal year may be used for projects relating to the conservation of North American crane species.</text></paragraph></subsection> 
<subsection id="HCD1953375B5447ADBF15836800DD79EB"><enum>(c)</enum><header>Acceptance and Use of Donations</header> 
<paragraph id="H8F59C29A800F49EEAEEC50C8B0532BEF"><enum>(1)</enum><header>In general</header><text>The Secretary may accept and use donations to provide assistance under section 4.</text></paragraph> 
<paragraph id="H70A32AD42DEA4699B9436612BF698FE"><enum>(2)</enum><header>Transfer of donations</header><text>Amounts received by the Secretary in the form of donations shall be transferred to the Secretary of the Treasury for deposit in the Fund.</text></paragraph></subsection></section> 
<section id="HF0D9B82E96BB479F9F756973BB87E222"><enum>6.</enum><header>Advisory group</header> 
<subsection id="H46D090EC715945ECB0DB4C7557B1E420"><enum>(a)</enum><header>In General</header><text>To assist in carrying out this Act, the Secretary may convene an advisory group consisting of individuals representing public and private organizations actively involved in the conservation of cranes.</text></subsection> 
<subsection id="HAEA2DE0AEEC3460BBF37D8D0D2500235"><enum>(b)</enum><header>Public Participation</header> 
<paragraph id="H282D316B8FAD49F59CC1EB0080732C29"><enum>(1)</enum><header>Meetings</header><text>The advisory group shall—</text> 
<subparagraph id="H4CE221D0A9424CE48B77B2857FDE11C2"><enum>(A)</enum><text>ensure that each meeting of the advisory group is open to the public; and</text></subparagraph> 
<subparagraph id="H5BD26C8955834531AB728E925442A69E"><enum>(B)</enum><text>provide, at each meeting, an opportunity for interested persons to present oral or written statements concerning items on the agenda.</text></subparagraph></paragraph> 
<paragraph id="HFA5A2F2E67BD4685B329CA5614292642"><enum>(2)</enum><header>Notice</header><text>The Secretary shall provide to the public timely notice of each meeting of the advisory group.</text></paragraph> 
<paragraph id="H2DDFF5DF0B73411BA7E2854D5E838DEF"><enum>(3)</enum><header>Minutes</header><text>Minutes of each meeting of the advisory group shall be kept by the Secretary and shall be made available to the public.</text></paragraph></subsection> 
<subsection id="H4607A0A4865E4586A0EC2D004900C68F"><enum>(c)</enum><header>Exemption from Federal Advisory Committee Act</header><text>The Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the advisory group.</text></subsection></section> 
<section id="HFB5A522FF79C44338C1ED51D83FD5EC5"><enum>7.</enum><header>Funding</header><text display-inline="no-display-inline">There is authorized to be appropriated to the Fund $5,000,000 for each of fiscal years 2009 through 2013, to remain available until expended.</text></section>
