<section id="H7F0AE8EB6D124057B8037600F18BDDCA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Managing Arson Through Criminal History (MATCH) Act of 2007</short-title></quote>.</text></section> 
<section id="H37CA8D143C754C1D98CEC154189BDFCE"><enum>2.</enum><header>Arsonist registration and notification program</header> 
<subsection id="HA2D3CA8939224A238F35A52CA6467663"><enum>(a)</enum><header>Registry requirements for jurisdictions</header> 
<paragraph id="H8AC1C1290D774E83863D7C408CD22E87"><enum>(1)</enum><header>Jurisdiction to maintain a registry</header><text>Each jurisdiction shall establish and maintain a jurisdiction-wide arsonist registry conforming to the requirements of this section.</text></paragraph> 
<paragraph id="HA6C6496B284A4B96835E6E2F4B3F7BAE"><enum>(2)</enum><header>Guidelines and regulations</header><text>The Attorney General shall issue guidelines and regulations to interpret and implement this section.</text></paragraph></subsection> 
<subsection id="H9123CB5B87BD4ED9AC687210004CF719"><enum>(b)</enum><header>Registry requirements for criminal arsonists</header> 
<paragraph id="H3AD031CD656340A5ACEE244F90DB31BC"><enum>(1)</enum><header>In general</header><text>A criminal arsonist shall register, and shall keep the registration current, in each jurisdiction where the arsonist resides, where the arsonist is an employee, and where the arsonist is a student. For initial registration purposes only, a criminal arsonist shall also register in the jurisdiction in which convicted if such jurisdiction is different from the jurisdiction of residence.</text></paragraph> 
<paragraph id="H4AB0B5365B75424FBD90011483FF53AD"><enum>(2)</enum><header>Initial registration</header><text>The criminal arsonist shall initially register—</text> 
<subparagraph id="HE6B661D1161246F2B61E007550FD37E4"><enum>(A)</enum><text>before completing a sentence of imprisonment with respect to the offense giving rise to the registration requirement; or</text></subparagraph> 
<subparagraph id="HD409BCF0878242A3BFCCE7DD614DF69E"><enum>(B)</enum><text>not later than 5 business days after being sentenced for that offense, if the criminal arsonist is not sentenced to a term of imprisonment.</text></subparagraph></paragraph> 
<paragraph id="H0966A61E749443BB9E51C6FF161150CA"><enum>(3)</enum><header>Keeping the registration current</header><text>A criminal arsonist shall, not later than 10 business days after each change of name, residence, employment, or student status, appear in person in at least one jurisdiction involved pursuant to paragraph (1) and inform that jurisdiction of all changes in the information required for that arsonist in the arsonist registry involved. That jurisdiction shall immediately provide the revised information to all other jurisdictions in which the arsonist is required to register.</text></paragraph> 
<paragraph id="H6456C31E35A94F5782F7655FED7F317"><enum>(4)</enum><header>Application of registration requirements</header> 
<subparagraph id="HDECF48196BFA4D1E8FA7AB655CA69302"><enum>(A)</enum><header>In general</header><text>Except as provided in guidelines under subparagraph (B), the requirements of this section, including the duties to register and to keep a registration current, shall apply only to a criminal arsonist who was convicted of a criminal offense involving arson on or after the date of the enactment of this Act, and who was notified of such duties and registered in accordance with subsection (f).</text></subparagraph> 
<subparagraph id="H1B351755B65F49F190041461556366B4"><enum>(B)</enum><header>Application to criminal arsonists unable to comply with paragraph (2)</header> 
<clause id="HB4E23F6E240647249EF3FD4347EE62A2"><enum>(i)</enum><header>Guidelines</header><text display-inline="yes-display-inline">The Attorney General shall establish guidelines in accordance with the provisions of this subparagraph for each jurisdiction for the application of the requirements of this section to criminal arsonists convicted before the date of the enactment of this Act or the date of its implementation in such a jurisdiction, and shall prescribe rules for the registration of any such criminal arsonists who are otherwise unable to comply with paragraph (2).</text></clause> 
<clause id="H6136E936A8834252AE004BEEA664A717"><enum>(ii)</enum><header>Information required to be included in registry</header><text>With respect to each criminal arsonist described in clause (i) convicted during the 10-year period preceding the date of the enactment of this Act, the guidelines under clause (i) shall provide for the inclusion in the arsonist registry of each applicable jurisdiction (and, in accordance with subsection (j), the provision by such jurisdiction to each entity described in such subsection) of the following information:</text> 
<subclause id="H6519D1A0696D45F398AED77DC9702485"><enum>(I)</enum><text display-inline="yes-display-inline">The name of the arsonist (including any alias used by the arsonist).</text></subclause> 
<subclause id="H928C2F2404264ADC9985EA59F7A2D9F6"><enum>(II)</enum><text>The Social Security number of the arsonist.</text></subclause> 
<subclause id="H23D31CEFD8B641D59100E3273958BA00"><enum>(III)</enum><text>The most recent known address of the residence at which the arsonist has resided.</text></subclause> 
<subclause id="HA842C31ED9E34203BE1FD12322005B7E"><enum>(IV)</enum><text>A physical description of the arsonist.</text></subclause> 
<subclause id="H8D137A3BA8FA4F63B0B58E01E60024DD"><enum>(V)</enum><text>The text of the provision of law defining the criminal offense related to arson for which the arsonist is convicted.</text></subclause> 
<subclause id="H3CAF44D8C18E4C89007C789987D168B"><enum>(VI)</enum><text>A set of fingerprints and palm prints of the arsonist.</text></subclause> 
<subclause id="HD92BA1F424AA4E57B8F8268422ACB254"><enum>(VII)</enum><text>A photocopy of a valid driver’s license or identification card issued to the arsonist by a jurisdiction, if available.</text></subclause> 
<subclause id="H1FE35F596470437C987EF51C05BB8706"><enum>(VIII)</enum><text>Any other information required by the Attorney General.</text></subclause></clause> 
<clause id="HA467249702DA4DFCB4ABAD354FC678C7"><enum>(iii)</enum><header>Notice required</header><text>The guidelines under clause (i) shall provide notice to each criminal arsonist included in an arsonist registry pursuant to this subparagraph of such inclusion.</text></clause></subparagraph></paragraph> 
<paragraph id="H17DCF77EAD1E4981A5EEB24306AA6BF1"><enum>(5)</enum><header>State penalty for failure to comply</header><text>Each jurisdiction, other than a Federally recognized Indian tribe, shall provide a criminal penalty that includes a maximum term of imprisonment that is greater than one year for the failure of a criminal arsonist to comply with the requirements of this section.</text></paragraph> 
<paragraph id="H8A78C94E32F646D2AE2EAC6BCEA157F"><enum>(6)</enum><header>Authority to exempt certain criminal arsonists from registry requirements</header><text>A jurisdiction shall have the authority to exempt a criminal arsonist who has been convicted of the offense of arson in violation of the laws of the jurisdiction in which the offense was committed or the United States for the first time from the registration requirements under this section in exchange for such arsonist’s substantial assistance in the investigation or prosecution of another person who has committed an offense. The Attorney General shall assure that any regulations promulgated under this section include guidelines that reflect the general appropriateness of exempting such an arsonist from the registration requirements under this section.</text></paragraph></subsection> 
<subsection id="HAF0694F013634FDEAD8BEBD42CE29704"><enum>(c)</enum><header>Information required in registration</header> 
<paragraph id="H9F5C13FD3F944579AFD725085CE80563"><enum>(1)</enum><header>Provided by the arsonist</header><text>A criminal arsonist shall provide the following information to the appropriate official for inclusion in the arsonist registry of a jurisdiction in which such arsonist is required to register:</text> 
<subparagraph id="H4106E7FECE6142B89351B4AF45375BC6"><enum>(A)</enum><text>The name of the arsonist (including any alias used by the arsonist).</text></subparagraph> 
<subparagraph id="H85FE22BF7BBF43378F71998633A48100"><enum>(B)</enum><text>The Social Security number of the arsonist.</text></subparagraph> 
<subparagraph id="H9B35C655146D4F85B032134B72BBB19D"><enum>(C)</enum><text>The address of each residence at which the arsonist resides or will reside.</text></subparagraph> 
<subparagraph id="HE9124BDA32C44E0EBB48C4F1A6352B8B"><enum>(D)</enum><text>The name and address of any place where the arsonist is an employee or will be an employee.</text></subparagraph> 
<subparagraph id="H7849FA4059694F928B51684C32A400C1"><enum>(E)</enum><text>The name and address of any place where the arsonist is a student or will be a student.</text></subparagraph> 
<subparagraph id="H553311200982434700D372B90081C9ED"><enum>(F)</enum><text>The license plate number and a description of any vehicle owned or operated by the arsonist.</text></subparagraph> 
<subparagraph id="H40986436C8904E789D1144AB29623B02"><enum>(G)</enum><text>Any other information required by the Attorney General.</text></subparagraph></paragraph> 
<paragraph id="HF4E3D642662145AD98DC94CE5E00B4AF"><enum>(2)</enum><header>Provided by the jurisdiction</header><text>The jurisdiction in which a criminal arsonist registers shall ensure that the following information is included in the registry for such arsonist:</text> 
<subparagraph id="H6D2750C68BC2403F8024079BC898A9CB"><enum>(A)</enum><text>A physical description of the arsonist.</text></subparagraph> 
<subparagraph id="H945B165B3864408EBFF3A60000062F2B"><enum>(B)</enum><text>The text of the provision of law defining the criminal offense for which the arsonist is registered.</text></subparagraph> 
<subparagraph id="HEC487EF12A604FE2BF003B19625D9884"><enum>(C)</enum><text>The criminal history of the arsonist, including the date of all arrests and convictions; the status of parole, probation, or supervised release; registration status; and the existence of any outstanding arrest warrants for the arsonist.</text></subparagraph> 
<subparagraph id="H69D3BA37ED2444E0A3DE3C6FE16920F9"><enum>(D)</enum><text>A current photograph of the arsonist.</text></subparagraph> 
<subparagraph id="H6A0A0FEDA528444BA0A233226584C2CD"><enum>(E)</enum><text>A set of fingerprints and palm prints of the arsonist.</text></subparagraph> 
<subparagraph id="HBDA2D9E743C942F58CAE7C2DA00295"><enum>(F)</enum><text>A photocopy of a valid driver’s license or identification card issued to the arsonist by a jurisdiction.</text></subparagraph> 
<subparagraph id="HA13654EC97BA4157A562BD8FB2E5E813"><enum>(G)</enum><text>Any other information required by the Attorney General.</text></subparagraph></paragraph></subsection> 
<subsection id="H5D9B81AC0FEE48BE816402E77575F6DA"><enum>(d)</enum><header>Duration of registration requirement; expunging registries of information for certain juvenile criminal arsonists</header> 
<paragraph id="HA1B19C87723547BEB1781419E2ED7D79"><enum>(1)</enum><header>Duration of registration requirement</header><text>A criminal arsonist shall keep the registration information provided under subsection (c) current for the full registration period (excluding any time the arsonist is in custody). For purposes of this subsection, the full registration period—</text> 
<subparagraph id="HBC2F975B6B664377AAB407CF35779BF0"><enum>(A)</enum><text>shall commence on the later of the date on which the arsonist is convicted of an offense of arson in violation of the laws of the jurisdiction in which the offense was committed or the United States, the date on which the arsonist is released from prison for such conviction, or the date on which such arsonist is placed on parole, supervised release, or probation for such conviction; and</text></subparagraph> 
<subparagraph id="HD616F156188F406DA3611E70D3564933"><enum>(B)</enum><text>shall be—</text> 
<clause id="HEEC6D14AAB764ACA99CBC55C15725200"><enum>(i)</enum><text>five years for an arsonist who has been convicted of such an offense for the first time;</text></clause> 
<clause id="H2815223D922347989066123046868F88"><enum>(ii)</enum><text>ten years for an arsonist who has been convicted of such an offense for the second time; and</text></clause> 
<clause id="H40EA676202B145B98DEF44FEF7953D1E"><enum>(iii)</enum><text>for the life of the arsonist for an arsonist who has been convicted of such an offense more than twice.</text></clause></subparagraph></paragraph> 
<paragraph id="H6CAFDD43E7BA458780B9A539CB1994FB"><enum>(2)</enum><header>Expunging registries of information for certain juvenile criminal arsonists</header> 
<subparagraph id="H91C180F314244090AED83CB9009128F3"><enum>(A)</enum><header>In general</header><text>In the case of a criminal arsonist described in subparagraph (B), a jurisdiction shall expunge the arson registry of such jurisdiction of information related to such criminal arsonist as of the date that is 5 years after the last day of the applicable full registration period under paragraph (1). </text></subparagraph> 
<subparagraph id="HA9E665EF45CD4F4B8D3FE9102FB201D9"><enum>(B)</enum><header>Criminal arsonist described</header><text>For purposes of subparagraph (A), a criminal arsonist described in this subparagraph is a criminal arsonist who—</text> 
<clause id="H7E0121905FA24F3CA2C4782F82CE13A0"><enum>(i)</enum><text>was a juvenile tried as an adult for the offense giving rise to the duty to register; and</text></clause> 
<clause id="H230B005F6B9D48E5AE536410D5076FD9"><enum>(ii)</enum><text>was not convicted of any other criminal felony during the period beginning on the first day of the applicable full registration period under paragraph (1) and ending on the last day of the 5-year period described in subparagraph (A).</text></clause></subparagraph> 
<subparagraph id="HC891214AFA384A53B3B09FD84D586EAC"><enum>(C)</enum><header>Application to other databases</header><text>The Attorney General shall establish a process to ensure that each entity that receives information under subsection (j) with respect to a criminal arsonist described in subparagraph (B) shall expunge the applicable database of such information as of the date that is 5 years after the last day of the applicable full registration period under paragraph (1).</text></subparagraph></paragraph></subsection> 
<subsection id="HF41F2227DAAA4F7E8F00334BC0000008"><enum>(e)</enum><header>Annual verification</header><text>Not less than once in each calendar year during the full registration period, a criminal arsonist required to register under this section shall—</text> 
<paragraph id="HDAB140A491CD4ABEB333C663CEB85C9C"><enum>(1)</enum><text>appear in person at not less than one jurisdiction in which such arsonist is required to register;</text></paragraph> 
<paragraph id="HA836AD02DB4944B3BEEF9500FF02DA00"><enum>(2)</enum><text>allow such jurisdiction to take a current photograph of the arsonist; and</text></paragraph> 
<paragraph id="HF296F03C98F5484B90DFD05996744D45"><enum>(3)</enum><text>while present at such jurisdiction, verify the information in each registry in which that arsonist is required to be registered.</text></paragraph></subsection> 
<subsection id="H949E293ED8CE4FB5BF86C20046469F64"><enum>(f)</enum><header>Duty to notify criminal arsonists of registration requirements and to register</header> 
<paragraph id="H2C25C8D1A1FC43B4B0D2DFBBC0894FE5"><enum>(1)</enum><header>In general</header><text>An appropriate official shall, shortly before release of a criminal arsonist from custody, or, if the arsonist is not in custody, immediately after the sentencing of the arsonist for the offense giving rise to the duty to register—</text> 
<subparagraph id="H01B53C12CD6446A300D484FDA17680BB"><enum>(A)</enum><text>inform the arsonist of the duties of the arsonist under this section and explain those duties in a manner that the arsonist can understand in light of the arsonist’s native language, mental capability, and age;</text></subparagraph> 
<subparagraph id="H30A04872BA0C4A4BAD8E86E14B34B690"><enum>(B)</enum><text>ensure that the arsonist understands the registration requirement, and if so, require the arsonist to read and sign a form stating that the duty to register has been explained and that the arsonist understands the registration requirement;</text></subparagraph> 
<subparagraph id="HF44CA3DEA34643A28CCB65C4E160D875"><enum>(C)</enum><text>if the arsonist is unable to understand the registration requirements, the official shall sign a form stating that the arsonist is unable to understand the registration requirements; and</text></subparagraph> 
<subparagraph id="HD93BFF89F86A43419C8410C4CBF72F00"><enum>(D)</enum><text>ensure that the arsonist is registered.</text></subparagraph></paragraph> 
<paragraph id="H779941B3F8714D37B5B36300B331C765"><enum>(2)</enum><header>Notification of criminal arsonists who cannot comply with paragraph (1)</header><text>The Attorney General shall prescribe rules to ensure the notification and registration of criminal arsonists in accordance with paragraph (1) who cannot be notified and registered at the time set forth in paragraph (1).</text></paragraph></subsection> 
<subsection id="HD0B491D761AA461B810938629BB03D6B"><enum>(g)</enum><header>Access to criminal arsonist information through the internet</header> 
<paragraph id="HD50912E0B6BA46D8BE5447FBC77DA3"><enum>(1)</enum><header>In general</header><text>Except as provided in this subsection, each jurisdiction shall make available on the Internet, in a manner that is readily accessible to law enforcement personnel and fire safety officers located in the jurisdiction, all information about each criminal arsonist in the registry. The jurisdiction shall also include in the design of its Internet site all field search capabilities needed for full participation in the National criminal arsonist Internet site established under subsection (i) and shall participate in that Internet site as provided by the Attorney General in regulations which comply with this paragraph.</text></paragraph> 
<paragraph id="H6DAADCA54A6E438D9E1C92DAB5B1EB7"><enum>(2)</enum><header>Prohibition on access by the public</header><text>Information about a criminal arsonist shall not be made available under paragraph (1) on the Internet to the public.</text></paragraph> 
<paragraph id="HA84ABAD87DAB4444A7FC7B08D7D6EEA"><enum>(3)</enum><header>Mandatory exemptions</header><text>A jurisdiction shall exempt from disclosure on the Internet site of the jurisdiction described in paragraph (1), with respect to information about a criminal arsonist—</text> 
<subparagraph id="H31B7F7D038F2459AB78214A5070488A3"><enum>(A)</enum><text>any information about the arsonist involving conviction for an offense other than the offense or offenses for which the arsonist is registered;</text></subparagraph> 
<subparagraph id="H9F22B6466C72424384D89FC99C15733C"><enum>(B)</enum><text>any information about the arsonist if the arsonist is participating in a witness protection program and the release of such information could jeopardize the safety of the arsonist or any other individual; and</text></subparagraph> 
<subparagraph id="H565772330B0541C3A845D24080498E96"><enum>(C)</enum><text>any other information identified as a mandatory exemption from disclosure by the Attorney General.</text></subparagraph></paragraph> 
<paragraph id="HCA9EBBF2EC6D404DB3B5C5BACE08D6C"><enum>(4)</enum><header>Optional exemptions</header><text display-inline="yes-display-inline">A jurisdiction is authorized to exempt from disclosure on the Internet site of the jurisdiction described in paragraph (1), with respect to information about a criminal arsonist—</text> 
<subparagraph id="H9F1F653E4DDE4A3E979DDC0024ECEB2C"><enum>(A)</enum><text>the name of an employer of the arsonist; and</text></subparagraph> 
<subparagraph id="H1590C32D63D1451592667767C3115763"><enum>(B)</enum><text>the name of an educational institution where the arsonist is a student.</text></subparagraph></paragraph> 
<paragraph id="H2F85A2B6C20C4AE3B0C7B0355B5D54CE"><enum>(5)</enum><header>Correction of errors</header><text>The Attorney General shall establish guidelines for each jurisdiction for a process to seek correction of information included in the Internet site established by the jurisdiction pursuant to paragraph (1) in the case that an individual contends such information is erroneous. Such guidelines shall provide for an adequate period following the date on which the individual has knowledge of the information’s inclusion in the Internet site for the individual to seek such correction of information.</text></paragraph> 
<paragraph id="HA72465130EBD4EE5AB928980AAC2A64"><enum>(6)</enum><header>Warning</header><text>An Internet site established by a jurisdiction pursuant to paragraph (1) shall include a warning that information on the site is to be used for law enforcement purposes only and may only be disclosed in connection with such purposes. The warning shall note that any action in violation of the previous sentence may result in a civil or criminal penalty.</text></paragraph></subsection> 
<subsection id="H6730881C03B7478B836322C6F0BE82E5"><enum>(h)</enum><header>National Criminal Arsonist Registry</header> 
<paragraph id="H824E496428B74A128D2E202152D74ED4"><enum>(1)</enum><header>In general</header><text>The Attorney General shall maintain a national database at the Bureau of Alcohol, Tobacco, Firearms and Explosives for each criminal arsonist. The database shall be known as the National Arsonist Registry.</text></paragraph> 
<paragraph id="HEBBE030AED1C487EAC25BEC6D3F91003"><enum>(2)</enum><header>Electronic forwarding</header><text>The Attorney General shall ensure (through the National Arsonist Registry or otherwise) that updated information about a criminal arsonist is immediately transmitted by electronic forwarding to all relevant jurisdictions.</text></paragraph></subsection> 
<subsection id="H6A966B988E5D477AA78C68C995712B18"><enum>(i)</enum><header>National arsonist internet site</header>
<paragraph id="HE1D9F484F4E74AF4BBCDFC1862D798DF"><enum>(1)</enum><header>In general</header><text>The Attorney General shall establish and maintain a national arsonist Internet site. The Internet site shall include relevant information for each criminal arsonist. The Internet site shall allow law enforcement officers and fire safety officers to obtain relevant information for each such arsonist by a single query for any given zip code or geographical radius set by the user in a form and with such limitations as may be established by the Attorney General and shall have such other field search capabilities as the Attorney General may provide.</text></paragraph>
<paragraph id="H08D1660E2D724AF6A167B700958EDAE8"><enum>(2)</enum><header>Prohibition on access by the public</header><text>Information about a criminal arsonist shall not be made available under paragraph (1) on the Internet to the public.</text></paragraph></subsection> 
<subsection id="H8660AF9199E74B71920098F8A49905B8"><enum>(j)</enum><header>Notification procedures</header><text>Under an arsonist registration program established by a jurisdiction pursuant to subsection (a), immediately after a criminal arsonist registers or updates a registration, an appropriate official in the jurisdiction shall provide the information in the registry (other than information exempted from disclosure by this section or by the Attorney General) about that offender to the following entities:</text> 
<paragraph id="HE2DC9B76E8844E8A841F6E662DE7FF65"><enum>(1)</enum><text>The Attorney General, who shall include that information in the National Arsonist Registry.</text></paragraph> 
<paragraph id="HDCAE046627E8488EB45B5C6DADD34E00"><enum>(2)</enum><text>Appropriate law enforcement agencies (including probation agencies, if appropriate) in each area in which the offender resides, is an employee, or is a student.</text></paragraph> 
<paragraph id="H03DF6037C4AE49E88D311DCB91F7436"><enum>(3)</enum><text>Each jurisdiction where the offender resides, is an employee, or is a student, and each jurisdiction from or to which a change of residence, employment, or student status occurs.</text></paragraph></subsection> 
<subsection id="H7C4A3A5B5F5743A5919B82D21B006CA4"><enum>(k)</enum><header>Actions to be taken when criminal arsonist fails to comply</header><text>Under an arsonist registration program established by a jurisdiction pursuant to subsection (a), an appropriate official of the jurisdiction shall notify the Attorney General and appropriate law enforcement agencies of any failure by a criminal arsonist to comply with the requirements of the arsonist registry for such jurisdiction, and shall revise the registry to reflect the nature of such failure. The appropriate official, the Attorney General, and each such law enforcement agency shall take any appropriate action to ensure compliance.</text></subsection> 
<subsection id="HD95F947BDB8A4AEEBE76005F542500F1"><enum>(l)</enum><header>Development and availability of registry management and website software</header> 
<paragraph id="H6E23D6013ACB45E996DA5CC5E2C2C02C"><enum>(1)</enum><header>Duty to develop and support</header><text>The Attorney General shall, in consultation with the jurisdictions, develop and support software to enable jurisdictions to establish and operate uniform arsonist registries and Internet sites.</text></paragraph> 
<paragraph id="H9347ABB1C72045299F23323391DACEDA"><enum>(2)</enum><header>Criteria</header><text>The software described in paragraph (1) should facilitate—</text> 
<subparagraph id="H9CD105C4669642C8AC525CDF94E3A16B"><enum>(A)</enum><text>immediate exchange of information among jurisdictions;</text></subparagraph> 
<subparagraph id="HB2C0F0C0219A4BEB8C4BB5F4AEA64136"><enum>(B)</enum><text>access over the Internet to appropriate information, including the number of registered criminal arsonists in each jurisdiction on a current basis;</text></subparagraph> 
<subparagraph id="H4E044241F844494BB047B2F7A84E275C"><enum>(C)</enum><text>full compliance with the requirements of this section; and</text></subparagraph> 
<subparagraph id="H8F96434D7FB34E92A6D6572855F8E3E3"><enum>(D)</enum><text>communication of information as required under subsection (j).</text></subparagraph></paragraph> 
<paragraph id="H7CE0FA4FC4A44D4CBC09AFB66B0000CE"><enum>(3)</enum><header>Deadline</header><text>The Attorney General shall make the first complete edition of this software available to jurisdictions not later than two years after the date of the enactment of this Act.</text></paragraph></subsection> 
<subsection id="H05A43CA021B248E386F2011582B5E7AA"><enum>(m)</enum><header>Period for implementation by jurisdictions</header> 
<paragraph id="H792758B43B644866B5E97D717DC5B7D5"><enum>(1)</enum><header>Deadline</header><text>To be in compliance with this section, a jurisdiction shall implement this section before the later of—</text> 
<subparagraph id="H89D3348A709E4015B56F62DB9139A065"><enum>(A)</enum><text>three years after the date of the enactment of this Act; or</text></subparagraph> 
<subparagraph id="HFC76DB2C808F461D9607DE608135E100"><enum>(B)</enum><text>one year after the date on which the software described in subsection (l) is made available to such jurisdiction.</text></subparagraph></paragraph> 
<paragraph id="H19EED2B88C8B4ED3A3BCD40000005557"><enum>(2)</enum><header>Extensions</header><text>The Attorney General may authorize not more than two one-year extensions of the deadline under paragraph (1).</text></paragraph></subsection> 
<subsection id="HB85E4F20FE304D60A647B090F800A68D"><enum>(n)</enum><header>Failure of jurisdiction to comply</header> 
<paragraph id="H05F1B6BA68294088853D42B8161197FF"><enum>(1)</enum><header>In general</header><text>For any fiscal year after the deadline described in subsection (m), a jurisdiction that fails, as determined by the Attorney General, to substantially implement this section shall not receive 10 percent of the funds that would otherwise be allocated for that fiscal year to the jurisdiction under subpart 1 of part E of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3750">42 U.S.C. 3750 et seq.</external-xref>).</text></paragraph> 
<paragraph id="HA5D23492B0B04E108406002DA9175BCB"><enum>(2)</enum><header>State constitutionality</header> 
<subparagraph id="H403EDF64D08147C2009E664065275923"><enum>(A)</enum><header>In general</header><text>When evaluating whether a jurisdiction has substantially implemented this section, the Attorney General shall consider whether the jurisdiction is unable to substantially implement this section because of a demonstrated inability to implement certain provisions that would place the jurisdiction in violation of its constitution, as determined by a ruling of the jurisdiction’s highest court.</text></subparagraph> 
<subparagraph id="H7875E221F6BE4CB39352727B59B0E39F"><enum>(B)</enum><header>Efforts</header><text>If the circumstances arise under subparagraph (A), then the Attorney General and the jurisdiction involved shall make good faith efforts to accomplish substantial implementation of this section and to reconcile any conflicts between this section and the jurisdiction’s constitution. In considering whether compliance with the requirements of this section would likely violate the jurisdiction’s constitution or an interpretation thereof by the jurisdiction’s highest court, the Attorney General shall consult with the chief executive and chief legal officer of the jurisdiction concerning the jurisdiction’s interpretation of the jurisdiction’s constitution and rulings thereon by the jurisdiction’s highest court.</text></subparagraph> 
<subparagraph id="H144297C4D78A459A9300D828E99F31C2"><enum>(C)</enum><header>Alternative procedures</header><text>If a jurisdiction is unable to substantially implement this section because of a limitation imposed by the jurisdiction’s constitution, the Attorney General may determine that the jurisdiction is in compliance with this section if the jurisdiction has made, or is in the process of implementing, reasonable alternative procedures or accommodations, which are consistent with the purposes of this section.</text></subparagraph></paragraph> 
<paragraph id="H72D9A94EF1984CAC89BBFBF91CA56343"><enum>(3)</enum><header>Reallocation</header><text>Amounts not allocated under a program referred to in this subsection to a jurisdiction for failure to substantially implement this section shall be reallocated under that program to jurisdictions that have not failed to substantially implement this section or may be reallocated to a jurisdiction from which they were withheld to be used solely for the purpose of implementing this section.</text></paragraph> 
<paragraph id="H8F58309E11164FAEB5C5617BE98F6485"><enum>(4)</enum><header>Rule of construction</header><text>The provisions of this section that are cast as directions to jurisdictions or their officials constitute, in relation to States, only conditions required to avoid the reduction of Federal funding under this subsection.</text></paragraph> 
<paragraph id="HC5B2966842D34410BB67D10521BF3DAD"><enum>(5)</enum><header>Exception for failures to receive Criminal Arsonist Management Assistance program grants</header><text>For any fiscal year for which a jurisdiction submits an application to the Attorney General under subsection (b) of section 3 for a grant under subsection (a) of such section and is not awarded any grant funding under such subsection such jurisdiction shall not be subject to paragraph (1).</text></paragraph></subsection> 
<subsection id="H1EE7412C22EF43B7B56CECFE1880DD8D"><enum>(o)</enum><header>Election by Indian tribes</header> 
<paragraph id="H40AC7F148C724335A84771CDFD43DA2"><enum>(1)</enum><header>Election</header> 
<subparagraph id="H545A2F10693E48EF8C751CDB7B5860C1"><enum>(A)</enum><header>In general</header><text>A federally recognized Indian tribe may, by resolution or other enactment of the tribal council or comparable governmental body, elect to carry out this subtitle as a jurisdiction subject to its provisions.</text></subparagraph> 
<subparagraph id="HB0977C62A2E440DB9325D204593F7378"><enum>(B)</enum><header>Implementation</header><text>If a tribe does not, within one year of the enactment of this Act, make an election to take on these duties, it shall, by resolution or other enactment of the tribal council or comparable governmental body, enter into a cooperative agreement to arrange for a jurisdiction to carry out any function of the tribe under this Act until such time as the tribe elects to carry out this Act.</text></subparagraph></paragraph> 
<paragraph id="HEAAB2BEE49B34FEDA43E55073D53BAEF"><enum>(2)</enum><header>Cooperation between tribal authorities and other jurisdictions</header> 
<subparagraph id="H4885AFA2622347A1A2D13C377F00E077"><enum>(A)</enum><header>Nonduplication</header><text>A tribe subject to this subtitle is not required to duplicate functions under this subtitle which are fully carried out by another jurisdiction or jurisdictions within which the territory of the tribe is located.</text></subparagraph> 
<subparagraph id="HC99F757852B94D08BF1C1FB29778F5F7"><enum>(B)</enum><header>Cooperative agreements</header><text>A tribe may, through cooperative agreements with such a jurisdiction or jurisdictions—</text> 
<clause id="HAD22D633E81E473A83F3A52E38D260E2"><enum>(i)</enum><text>arrange for the tribe to carry out any function of such a jurisdiction under this subtitle with respect to arsonists subject to the tribe’s jurisdiction; and</text></clause> 
<clause id="H1BFBB9AEAAAD45ECAAD1AAE0303EB31"><enum>(ii)</enum><text>arrange for such a jurisdiction to carry out any function of the tribe under this subtitle with respect to arsonists subject to the tribe’s jurisdiction.</text></clause></subparagraph></paragraph> 
<paragraph id="H712466A188C1452697E376707C9C098D"><enum>(3)</enum><header>Law enforcement authority in Indian country</header><text>Enforcement of this Act in Indian country, as defined in <external-xref legal-doc="usc" parsable-cite="usc/18/1151">section 1151</external-xref> of title 18, United States Code, shall be carried out by Federal, Tribal, and State governments under existing jurisdictional authorities.</text></paragraph></subsection> 
<subsection id="H2F2D552443774AB893DECBC803E6C577"><enum>(p)</enum><header>Immunity for good faith conduct</header><text>The Federal Government, jurisdictions, political subdivisions of jurisdictions, and their agencies, officers, employees, and agents shall be immune from liability for good faith conduct under this section.</text></subsection> 
<subsection id="H5F29B00EE0134D6C9E7624072F79FD38"><enum>(q)</enum><header>Authorization of appropriations</header><text>In addition to any amounts otherwise authorized to be appropriated, there are authorized to be appropriated to the Attorney General, to carry out subsections (h) and (i) of this section, such sums as may be necessary for each of the fiscal years 2009 through 2014.</text></subsection></section> 
<section id="H0623A5AEA19D47C58477453512E5A0EC"><enum>3.</enum><header>Criminal arsonist management assistance program</header> 
<subsection id="H2B148638437D4FCFB8147920CD23CD6E"><enum>(a)</enum><header>In general</header><text>The Attorney General shall establish and implement a Criminal Arsonist Management Assistance program (in this section referred to as the <quote>Assistance Program</quote>), under which the Attorney General shall award grants to jurisdictions to offset the costs of implementing section 2.</text></subsection> 
<subsection id="H65AC7A61F31A4906AEDDB65E8E5BA75F"><enum>(b)</enum><header>Application</header><text>The chief executive of a jurisdiction desiring a grant under this section, with respect to a fiscal year, shall for each such fiscal year submit to the Attorney General an application in such form and containing such information as the Attorney General may require.</text></subsection> 
<subsection id="H61E8F1A386B9489A93E8567972CD3755"><enum>(c)</enum><header>Increased grant payments for prompt compliance</header><text>A jurisdiction that, as determined by the Attorney General, has substantially implemented section 2 not later than two years after the date of the enactment of this Act is eligible for a bonus payment in addition to the amount of grant funds available to such jurisdiction under subsection (a). The Attorney General may, with respect to a jurisdiction, make such a bonus payment to the jurisdiction for the first fiscal year beginning after the date such determination is made. The amount of the bonus payment shall be as follows:</text> 
<paragraph id="HA46FFEC237514C42004056C4B246C1DB"><enum>(1)</enum><text>In the case of a determination that the jurisdiction has substantially implemented such section by a date that is not later than the date that is one year after the date of the enactment of this Act, 10 percent of the total grant funds available to the jurisdiction under subsection (a) for such fiscal year.</text></paragraph> 
<paragraph id="HFF62E91FFBC54E3592059E85B69F3F06"><enum>(2)</enum><text>In the case of a determination that the jurisdiction has substantially implemented such section by a date that is later than one year after the date of the enactment of this Act, but not later than the date that is two years after such date of enactment, 5 percent of such total.</text></paragraph></subsection> 
<subsection id="H6AC676172BCD4795B20080C5D189C44F"><enum>(d)</enum><header>Authorization of appropriations</header><text>In addition to any amounts otherwise authorized to be appropriated, there are authorized to be appropriated to the Attorney General, to be available to carry out this section, such sums as may be necessary for each of the fiscal years 2009 through 2014.</text></subsection></section> 
<section id="HBAD1EF23ABDB4299B73CA3127559CF0"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this Act:</text> 
<paragraph id="H6F15CAACCA904B79898D76D7A706CC4C"><enum>(1)</enum><header>Criminal arsonist</header><text>The term <quote>criminal arsonist</quote> means an individual who is convicted of any criminal offense for committing arson in violation of the laws of the jurisdiction in which such offense was committed or the United States. Such term shall not include a juvenile who is convicted of such an offense unless such juvenile was tried as an adult for such offense.</text></paragraph> 
<paragraph id="H40A6D9C5BE0644F1AD43004803F3E8C2"><enum>(2)</enum><header>Arsonist registry</header><text>The term <quote>arsonist registry</quote> means a registry of criminal arsonists, and a notification program, maintained by a jurisdiction.</text></paragraph> 
<paragraph id="HE14EE9E54A624679A082B694DCD3F989"><enum>(3)</enum><header>Criminal offense</header><text>The term <quote>criminal offense</quote> means a State, local, tribal, foreign, or military offense (to the extent specified by the Secretary of Defense under section 115(a)(8)(C)(i) of <external-xref legal-doc="public-law" parsable-cite="pl/105/119">Public Law 105–119</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/10/951">10 U.S.C. 951</external-xref> note)) or other criminal offense.</text></paragraph> 
<paragraph id="H1B6B2F4779A94A079FEBDF36A122734D"><enum>(4)</enum><header>Employee</header><text>The term <quote>employee</quote> includes an individual who is self-employed or works for any other entity, whether compensated or not.</text></paragraph> 
<paragraph id="H69F6571F546947B594A08FA4F538D022"><enum>(5)</enum><header>Fire safety officer</header><text>The term <quote>fire safety officer</quote> means—</text> 
<subparagraph id="H35E84097D6BA469093006C9162FA00FB"><enum>(A)</enum><text>a firefighter, as such term is defined in section 1204 of the Omnibus Crime Control and Safe Street Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3796b">42 U.S.C. 3796b</external-xref>); or</text></subparagraph> 
<subparagraph id="HF145B2FC033F47D28BA9CB00951133AC"><enum>(B)</enum><text>an individual serving in an official capacity as a firefighter, fire investigator, or other arson investigator, as defined by the jurisdiction for the purposes of this Act.</text></subparagraph></paragraph> 
<paragraph id="HD44A2133476842F8942BB9C945BCA2E4"><enum>(6)</enum><header>Jurisdiction</header><text>The term <quote>jurisdiction</quote> means any of the following:</text> 
<subparagraph id="H32733F12EAC44B0FACBE52F3744F6B86"><enum>(A)</enum><text>A State.</text></subparagraph> 
<subparagraph id="HA13D3D8B8415472BB080FFF58593FCC5"><enum>(B)</enum><text>The District of Columbia.</text></subparagraph> 
<subparagraph id="H8501C2BF8FDA47AEA819BBE300C4592"><enum>(C)</enum><text>The Commonwealth of Puerto Rico.</text></subparagraph> 
<subparagraph id="HFD71F69958F44926A530AF78B5D70096"><enum>(D)</enum><text>Guam.</text></subparagraph> 
<subparagraph id="HECAEEC09340F406AA804A994489B224C"><enum>(E)</enum><text>American Samoa.</text></subparagraph> 
<subparagraph id="HB509AC6139C94B87B2D5CF6DAED5EB45"><enum>(F)</enum><text>The Northern Mariana Islands.</text></subparagraph> 
<subparagraph id="HFA19286174514073A0878285E44D89C6"><enum>(G)</enum><text>The United States Virgin Islands.</text></subparagraph> 
<subparagraph id="HF4116237064F472DBFB639737BECBCC4"><enum>(H)</enum><text>To the extent provided and subject to the requirements of section 2(o), a federally recognized Indian tribe.</text></subparagraph></paragraph> 
<paragraph id="H3A4C5E8DD0EA40F5942B92EC9917641D"><enum>(7)</enum><header>Law enforcement officer</header><text>The term <quote>law enforcement officer</quote> has the meaning given such term in section 1204 of the Omnibus Crime Control and Safe Street Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3796b">42 U.S.C. 3796b</external-xref>).</text></paragraph> 
<paragraph id="HF49507AFBB8440A9A2C11DB145DDA254"><enum>(8)</enum><header>Resides</header><text>The term <quote>resides</quote> means, with respect to an individual, the location of the individual’s home or other place where the individual habitually lives.</text></paragraph> 
<paragraph id="H569147609DE146CCAFDEF76186E7F7F5"><enum>(9)</enum><header>Student</header><text>The term <quote>student</quote> means an individual who enrolls in or attends an educational institution (whether public or private), including a secondary school, trade or professional school, and institution of higher education.</text></paragraph></section>
