		  national screening program at the Centers for Disease Control and Prevention
		  and to amend title XIX of the Social Security Act to provide States the option
		  to provide medical assistance for men and women screened and found to have
		  colorectal cancer or colorectal polyps.</official-title>

		<section id="H2CACF0BD570A47C5ABAB9314700EAE3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Colorectal Cancer Prevention, Early
			 Detection, and Treatment Act</short-title> of 2007</quote>.</text>
		</section><section id="HEC18972697564583BFA700A0AAE7FC77"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following
			 findings:</text>
			<paragraph id="H2C2201C129F94B84A5ACAD4D4B3387A4"><enum>(1)</enum><text>Colorectal cancer
			 is the second leading cause of cancer deaths in the United States for men and
			 women combined.</text>
			</paragraph><paragraph id="HC1E40B1AD37D42BF0014BE594DB74E31"><enum>(2)</enum><text>According to the
			 American Cancer Society, in 2007, an estimated 153,760 new cases of colorectal
			 cancer will be diagnosed in the United States and this cancer will kill an
			 estimated 52,180 individuals, constituting almost 10 percent of all cancer
			 deaths.</text>
			</paragraph><paragraph id="H655DC7D956E74B5000C644CB9EBD00F1"><enum>(3)</enum><text>Screening and
			 early detection saves lives. When colorectal cancer is diagnosed at an early
			 stage, the 5-year survival rate is 90 percent.</text>
			</paragraph><paragraph id="HBD651DB45ECD48B8BCB37E52000066CD"><enum>(4)</enum><text>When colorectal
			 cancer is not diagnosed until it has spread to distant organs, the 5-year
			 survival rate drops to 10 percent.</text>
			</paragraph><paragraph id="H60A1329E03674A20A5EDD578E8F7DAF6"><enum>(5)</enum><text>Only 39 percent of
			 colorectal cancer patients have their cancers detected at an early
			 stage.</text>
			</paragraph><paragraph id="H3613F2FD6AF24C8087412996404059E"><enum>(6)</enum><text>Despite the
			 scientific evidence supporting the effectiveness of screening, there is only a
			 50 percent screening rate of people in the United States who are 50 years of
			 age and older.</text>
			</paragraph><paragraph id="HD901DE991FB54E8BA9BAF90044AF76BE"><enum>(7)</enum><text>Only 21 percent of
			 those without health coverage in the United States have currently been screened
			 for colorectal cancer.</text>
			</paragraph><paragraph id="H50D2730F3E1D465BB380AA1570717575"><enum>(8)</enum><text>Far too many
			 avoidable deaths are occurring from a disease that can be prevented through the
			 early identification and removal of pre-cancerous polyps, detectable only
			 through colorectal cancer screenings.</text>
			</paragraph><paragraph id="H22AF1031A9C94EBCB9F83C09900C800"><enum>(9)</enum><text>The Centers for
			 Disease Control and Prevention is in its ninth year of the Screen for Life:
			 National Colorectal Cancer Action Campaign, which informs men and women aged 50
			 years or older about the importance of having regular colorectal cancer
			 screening tests.</text>
			</paragraph><paragraph id="HC7F388AD1AAC4467A906EDEBF753463D"><enum>(10)</enum><text>If adults in the
			 United States had received colorectal cancer screenings as recommended, at
			 least 31,500 deaths would have been prevented and 338,000 years of life would
			 be gained this year.</text>
			</paragraph><paragraph id="H95B720FDDD244DE18C00DCD76B454D06"><enum>(11)</enum><text>Colorectal cancer
			 screening has been shown to be more cost effective than screening for breast
			 cancer and screening for cervical cancer, with the potential to save between
			 30,000 and 44,000 lives a year if all individuals who are 50 years of age or
			 older got screened for colorectal cancer.</text>
			</paragraph><paragraph id="H33CE451F82A94EEFA91FF165036C7F52"><enum>(12)</enum><text>Treatment costs
			 for colorectal cancer are extremely high, and could be significantly reduced
			 with widespread screening for colorectal cancer. Costs associated with
			 treatment for colorectal cancer are estimated at $8,400,000,000 for
			 2004.</text>
			</paragraph><paragraph id="HBBC516C5159343B290F5C364DFD47C4"><enum>(13)</enum><text>Colorectal cancer
			 screening is not only life saving, it is cost-effective. If recommended
			 screenings were provided to an increased number of people in the United States
			 who are between the ages of 50 years and 64 years of age, there would be a
			 significant savings of billions of dollars to the Medicare program in screening
			 and treatment costs.</text>
			</paragraph><paragraph id="H5064BB9C6B5F4D5FA0EAD9F0A3D26E35"><enum>(14)</enum><text>In 2005, the
			 Centers for Disease Control and Prevention established a demonstration
			 colorectal cancer screening program at five sites across the United States to
			 learn about the feasibility of delivering screening and follow-up services to
			 the population of low-income, uninsured, and underinsured individuals. The
			 demonstration program has already produced many findings that can inform a
			 national effort to screen this population for colorectal cancer.</text>
			</paragraph></section><section id="H54C69CF3691E4F85B909142DC9B40721"><enum>2.</enum><header>Preventive health
			 measures with respect to colorectal cancer</header><text display-inline="no-display-inline">Part B of title III of the Public Health
			 Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/243">42 U.S.C. 243 et seq.</external-xref>) is amended by inserting after section 317S
			 the following new section:</text>
			<quoted-block display-inline="no-display-inline" id="H265094F0295849478E86A75C5068BFC6" style="OLC">
				<section id="HA46D729583C741EA9F8701576E42D698"><enum>317T.</enum><header>Preventive
				health measures with respect to colorectal cancer</header>
					<subsection id="HE7DB4888EB0A4908A9CD7297A27D1CD4"><enum>(a)</enum><header>Grant program
				authorization</header>
						<paragraph id="H8ECC7F49D1104D0D84EC9DE37B1C982D"><enum>(1)</enum><header>In
				general</header><text>The Secretary, acting through the Director of the Centers
				for Disease Control and Prevention, may make grants to eligible entities for
				the purpose of carrying out a program described in subsection (b). An eligible
				entity that is a recipient of a grant under this subsection may use such grant
				to carry out such programs directly or through grants to, or contracts with,
				public and not-for-profit private entities.</text>
						</paragraph><paragraph id="H866981D2459E490FB9FF2E686D755113"><enum>(2)</enum><header>Eligible entity
				defined</header><text>For purposes of this section, the term <term>eligible
				entity</term> includes the following:</text>
							<subparagraph id="H644A087DB6124377AC4B19E79CB5F089"><enum>(A)</enum><text display-inline="yes-display-inline">A State, including, in addition to the
				several States, the District of Columbia, Guam, the Commonwealth of Puerto
				Rico, the Northern Mariana Islands, the Virgin Islands, American Samoa, and the
				Trust Territory of the Pacific Islands.</text>
							</subparagraph><subparagraph id="H333A67F57DCB4F0F990064006E42CC5E"><enum>(B)</enum><text display-inline="yes-display-inline">An Indian tribe or tribal organization, as
				such terms are defined in section 4 of the Indian Self-Determination and
				Education Assistance Act.</text>
							</subparagraph></paragraph></subsection><subsection id="H0D0BB995D506490E8199A963D87691B1"><enum>(b)</enum><header>Programs
				described</header>
						<paragraph id="H21416AE60DE84AD7A76194DECBE00D4"><enum>(1)</enum><header>In
				general</header><text>Subject to paragraph (2), a program described in this
				subsection is a program for planning or implementing the following:</text>
							<subparagraph id="HCD901D41188C40FF8172D73DA02D5B5B"><enum>(A)</enum><text>Providing
				screenings for colorectal cancer to individuals who—</text>
								<clause id="H893F96CD75934F08A6215561DD32039B"><enum>(i)</enum><text>are 50 years of
				age or older; or</text>
								</clause><clause id="HE841E98E3B894A6694E9B07D1303925C"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="H0817B637E0624539B2262FAA7683ED46"><enum>(I)</enum><text>are under 50 years of
				age; and</text>
									</subclause><subclause id="H4807DE922EDD44E18901BE00AF65E384" indent="up1"><enum>(II)</enum><text>are at high risk for such cancer.</text>
									</subclause></clause></subparagraph><subparagraph id="HCCC7191A91D4456AA26731AD65DD1CFD"><enum>(B)</enum><text>Providing
				appropriate case management and referrals for medical treatment of individuals
				screened pursuant to subparagraph (A).</text>
							</subparagraph><subparagraph id="HB033E651C91947299BD6E7912004E62"><enum>(C)</enum><text display-inline="yes-display-inline">Ensuring (directly or through coordination
				or an arrangement with health care providers or programs) the full continuum of
				followup and cancer care for individuals so screened, including appropriate
				follow-up for abnormal tests, diagnostic services, therapeutic services, and
				treatment of detected cancers and management of unanticipated medical
				complications.</text>
							</subparagraph><subparagraph id="H1B4DFB03FA7A488397FAE4A87625F6E3"><enum>(D)</enum><text>Carrying out
				activities to improve the education, training, and skills of health
				professionals (including allied health professionals) in the detection and
				control of colorectal cancer, which activities are carried out pursuant to the
				participation of the health professionals in the program.</text>
							</subparagraph><subparagraph id="H2AB427853A224957A19CAC465FB48343"><enum>(E)</enum><text>Establishing
				mechanisms through which the eligible entity involved can monitor the quality
				of screening and diagnostic follow-up procedures for colorectal cancer,
				including the interpretation of such procedures.</text>
							</subparagraph><subparagraph id="HC90FBB71C1C848B10047A0CBA5BC7832"><enum>(F)</enum><text>Evaluating the
				activities described in this subsection through appropriate surveillance and
				program monitoring activities.</text>
							</subparagraph><subparagraph id="HE21C91A20AE64D31BD7DDF091B602C36"><enum>(G)</enum><text>Developing and
				disseminating findings derived through such evaluations and the collection of
				data on outcomes.</text>
							</subparagraph><subparagraph id="H389B7A3535A246618CDBA9F43CDC31B3"><enum>(H)</enum><text>Developing and
				disseminating public information and education programs for the detection and
				control of colorectal cancer and promoting the benefits of receiving screenings
				through this program.</text>
							</subparagraph></paragraph><paragraph id="H890096D150E647B5B3004FBE13EEA72E"><enum>(2)</enum><header>Supplement not
				supplant</header><text display-inline="yes-display-inline">In the case of an
				eligible entity that implements a universal colorectal screening program that
				funds activities described in subparagraph (A), (B), or (C) of paragraph (1),
				such entity shall be able to receive grant funds under subsection (a) only for
				purposes of—</text>
							<subparagraph display-inline="no-display-inline" id="H8526AF85E87E47839EDB19F0967000E3"><enum>(A)</enum><text>carrying out those
				activities under this subsection that are not so funded; or</text>
							</subparagraph><subparagraph id="H38A3D0EF3AF545EE9FB790F1BEA42961"><enum>(B)</enum><text>supplementing (and
				not supplanting) funds made available by the entity for such funded
				program.</text>
							</subparagraph></paragraph></subsection><subsection id="H2C6E01C332894DE69788715F76FA00C6"><enum>(c)</enum><header>Priority for
				low-income, uninsured and underinsured individuals</header><text>A grant may be
				made under subsection (a) to an eligible entity only if the eligible entity
				agrees that, in providing screenings under subsection (b)(1)(A), the eligible
				entity will give priority to low-income individuals who lack adequate coverage
				under health insurance and health plans with respect to screenings for
				colorectal cancer.</text>
					</subsection><subsection id="HF896E5E85B0D4D9F9BBA600E7C8E8D"><enum>(d)</enum><header>Special
				consideration for certain applicants</header><text>In making grants under
				subsection (a) for a fiscal year, the Secretary shall give special
				consideration to the following eligible entities:</text>
						<paragraph id="H0913C79FADF448539D5E4B111B64A3A7"><enum>(1)</enum><text>In the case of
				services under such subsection for women, to such entities that, for such year,
				are grantees under title XV.</text>
						</paragraph><paragraph id="HB73B887FD19C40E09B9FFE6C99BA6FAA"><enum>(2)</enum><text>In the case of
				services under such subsection for men, to such entities that, for such year,
				are grantees under section 317D.</text>
						</paragraph><paragraph commented="no" id="H7964DB4296ED4C4000D29D835826857C"><enum>(3)</enum><text>To such entities
				that coordinate with other Federal, State, and local colorectal cancer
				programs.</text>
						</paragraph><paragraph commented="no" id="H23C0E26DCA8A49198F447FAF3C33EC90"><enum>(4)</enum><text display-inline="yes-display-inline">To such entities with an existing program
				to provide cancer screening to individuals.</text>
						</paragraph></subsection><subsection id="H31F708E94764494CA3CC545D38B81C89"><enum>(e)</enum><header>Use of certain
				standards under Medicare program</header><text>A grant may be made under
				subsection (a) to an eligible entity only if the eligible entity provides, as
				applicable, assurances as follows:</text>
						<paragraph id="H866688510F3A4E01AA3FE0539F890311"><enum>(1)</enum><text>Screenings under
				subsection (b)(1)(A) will be carried out as preventive health measures in
				accordance with evidence-based screening guidelines and procedures as specified
				in section 1861(pp)(1) of the Social Security Act.</text>
						</paragraph><paragraph id="HBF43B5380328486CBEE7C1F1A6DB9602"><enum>(2)</enum><text>An individual will
				be considered high risk for purposes of subsection (b)(1)(A)(ii) only if the
				individual is high risk within the meaning of section 1861(pp)(2) of such
				Act.</text>
						</paragraph><paragraph id="HD114539006134BD996C97601EC1D9596"><enum>(3)</enum><text>The payment made
				from the grant for a screening procedure under subsection (b)(1)(A) will not
				exceed the amount that would be paid under part B of title XVIII of such Act if
				payment were made under such part for furnishing the procedure to an individual
				enrolled under such part.</text>
						</paragraph></subsection><subsection id="HEDE30FC96CED4033858C3720D3A2C02"><enum>(f)</enum><header>Relationship to
				items and services under other programs</header><text>A grant under subsection
				(a) may be made to an eligible entity only if the eligible entity, as
				applicable, provides assurances that the grant will not be expended to make
				payment for any item or service to the extent that payment has been made, or
				can reasonably be expected to be made, with respect to such item or
				service—</text>
						<paragraph id="HCBADCC2C6578401E83D786F8A5F79F97"><enum>(1)</enum><text>under any State
				compensation program, under an insurance policy, or under any Federal or State
				health benefits program; or</text>
						</paragraph><paragraph id="H9F0D8D46D8A14E76822904D9F4217DBF"><enum>(2)</enum><text>by an entity that
				provides health services on a prepaid basis.</text>
						</paragraph></subsection><subsection id="H435BF0BDF3EC4E02A7D7005263DB8C5C"><enum>(g)</enum><header>Records and
				audits</header><text>A grant under subsection (a) may be made to an eligible
				entity only if the eligible entity provides assurances that the eligible entity
				will—</text>
						<paragraph id="H9FB98CC51E26496186AB81AEF2A94B1D"><enum>(1)</enum><text>establish such
				fiscal control and fund accounting procedures as may be necessary to ensure
				proper disbursal of, and accounting for, amounts received under subsection (a);
				and</text>
						</paragraph><paragraph id="HD4B729141D094834AA6665FEF3A52772"><enum>(2)</enum><text>upon request,
				provide records maintained pursuant to paragraph (1) to the Secretary or the
				Comptroller General of the United States for purposes of auditing the
				expenditures of the grant by the eligible entity.</text>
						</paragraph></subsection><subsection commented="no" id="HB1CB403E170B4EF191EAFE9B00D3CA17"><enum>(h)</enum><header>Requirement of
				matching funds</header>
						<paragraph commented="no" id="H06D9D75D75504C46B39029BB1C231093"><enum>(1)</enum><header>In
				general</header><text>The Secretary may not make a grant under subsection (a)
				to an eligible entity for a fiscal year unless the eligible entity agrees, with
				respect to the costs to be incurred by the eligible entity for such fiscal year
				in carrying out the activities described in subsection (b), to make available
				non-Federal contributions (in cash or in kind under paragraph (2)) toward such
				costs in an amount equal to not less than $1 for each $3 of Federal funds
				provided in the grant for such fiscal year. Such contributions may be made
				directly or through donations from public or private entities.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HEDF928CA5D034197991521DDAFA51CF"><enum>(2)</enum><header>Determination of
				amount of non-Federal contribution</header>
							<subparagraph commented="no" id="H20BF4494EA4146EB8E66CBD72276734F"><enum>(A)</enum><header>In
				general</header><text>Non-Federal contributions required in paragraph (1) may
				be in cash or in kind, fairly evaluated, including equipment or services (and
				excluding indirect or overhead costs). Amounts provided by the Federal
				Government, or services assisted or subsidized to any significant extent by the
				Federal Government, may not be included in determining the amount of such
				non-Federal contributions.</text>
							</subparagraph><subparagraph commented="no" id="H9CE2B9DCE55F499500D14EBA63E6519C"><enum>(B)</enum><header>Maintenance of
				effort</header><text>In making a determination of the amount of non-Federal
				contributions for purposes of paragraph (1), the Secretary may include only
				non-Federal contributions in excess of the average amount of non-Federal
				contributions made by the eligible entity involved toward the activities
				described in subsection (b) for the 2-year period preceding the first fiscal
				year for which the eligible entity is applying to receive a grant under
				subsection (a).</text>
							</subparagraph><subparagraph commented="no" id="H8CD1815733574DB9910785DEC5F9EFB"><enum>(C)</enum><header>Inclusion of
				relevant non-Federal contributions for Medicaid</header><text>In making a
				determination of the amount of non-Federal contributions for purposes of
				paragraph (1), the Secretary shall, subject to subparagraphs (A) and (B) of
				this paragraph, include any non-Federal amounts expended pursuant to title XIX
				of the Social Security Act by the eligible entity involved toward the
				activities described in subparagraphs (A) and (B) of subsection (b)(1).</text>
							</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H60CC3A39183241DF92DF04F7E67003E"><enum>(i)</enum><header>Additional
				requirements</header>
						<paragraph commented="no" id="H90E962704392401CBC246DEEDEEF951E"><enum>(1)</enum><header>Limitation on
				administrative expenses</header><text>The Secretary may not make a grant to an
				eligible entity under subsection (a) unless the eligible entity provides
				assurances that not more than 10 percent of the grant will be expended for
				administrative expenses with respect to the activities funded by the
				grant.</text>
						</paragraph><paragraph commented="no" id="H70DF81462A1C43C9B600F6E39C41281B"><enum>(2)</enum><header>Statewide
				provision of services</header>
							<subparagraph commented="no" id="HF66B7A0D63A54755807592612314F57D"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">Subject to
				subparagraph (B), the Secretary may not make a grant under subsection (a) to an
				eligible entity unless the eligible entity provides assurances that any program
				funded by such grant will be made available throughout the State, including
				availability to members of an Indian tribe or tribal organization (as such
				terms are defined in section 4 of the Indian Self-Determination and Education
				Assistance Act).</text>
							</subparagraph><subparagraph commented="no" id="H239C0B772E824B359FEBA25863C9BBE0"><enum>(B)</enum><header>Waiver</header><text>The
				Secretary may waive the requirement under subparagraph (A) for an eligible
				entity if the Secretary determines that compliance by the eligible entity with
				the requirement would result in an inefficient allocation of resources with
				respect to carrying out the purposes described in subsection (a).</text>
							</subparagraph></paragraph></subsection><subsection commented="no" id="H554AA42EA42C4E14B845F2E0092823DF"><enum>(j)</enum><header>Technical
				assistance and provision of supplies and services in lieu of grant
				funds</header>
						<paragraph commented="no" id="H1F1F6472D07A41849897D701D27E8F82"><enum>(1)</enum><header>Technical
				assistance</header><text>The Secretary may provide training and technical
				assistance with respect to the planning, development, and operation of any
				program funded by a grant under subsection (a). The Secretary may provide such
				technical assistance directly to eligible entities or through grants to, or
				contracts with, public and private entities.</text>
						</paragraph><paragraph commented="no" id="HBD05A85ED9D841048DDCBA3EEFB0C1C0"><enum>(2)</enum><header>Provision of
				supplies and services in lieu of grant funds</header>
							<subparagraph commented="no" id="H082C004DB6C54ECD8FEE51020091822F"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">Subject to
				subparagraph (B), upon the request of an eligible entity receiving a grant
				under subsection (a), the Secretary for the purpose of aiding the eligible
				entity to carry out a program under subsection (b)—</text>
								<clause id="H2254E5215F8D410293AAB2C29D1C4530"><enum>(i)</enum><text>may provide
				supplies, equipment, and services to the eligible entity; and</text>
								</clause><clause id="HF6B53C6D1ED741DFAF21030297C63D7D"><enum>(ii)</enum><text>may detail to the
				eligible entity any officer or employee of the Department of Health and Human
				Services.</text>
								</clause></subparagraph><subparagraph commented="no" id="H803D8AC9A8DA4F989CA77C72991EF537"><enum>(B)</enum><header>Corresponding
				reduction in payments</header><text display-inline="yes-display-inline">With
				respect to a request made by an eligible entity under subparagraph (A), the
				Secretary shall reduce the amount of payments made under the grant under
				subsection (a) to the eligible entity by an amount equal to the fair market
				value of any supplies, equipment, or services provided by the Secretary and the
				costs of detailing personnel (including pay, allowances, and travel expenses)
				under subparagraph (A). The Secretary shall, for the payment of expenses
				incurred in complying with such request, expend the amounts withheld.</text>
							</subparagraph></paragraph></subsection><subsection id="H6544F15281914985934CE191EE66243"><enum>(k)</enum><header>Reports</header><text>A
				grant under subsection (a) may be made only if the applicant involved agrees to
				submit to the Secretary such reports as the Secretary may require with respect
				to the grant.</text>
					</subsection><subsection id="H1FC0A9D91032437180ABDF327B85DD51"><enum>(l)</enum><header>Authorization of
				appropriations</header>
						<paragraph id="H43C28D8C99844B0C98FBB77B69FA8E26"><enum>(1)</enum><header>In
				general</header><text>For the purpose of carrying out this section, there are
				authorized to be appropriated $50,000,000 for fiscal year 2008, and such sums
				as may be necessary for each of the fiscal years 2009 through 2012.</text>
						</paragraph><paragraph id="H438F3190C79A4515A54982006B394DB0"><enum>(2)</enum><header>Set-aside for
				technical assistance and provision of supplies and services</header><text>Of
				the amount appropriated under paragraph (1) for a fiscal year, the Secretary
				shall reserve not to exceed 20 percent for carrying out subsection
				(j).</text>
						</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H2FE332F69D904E16BA1981F2179C47A7"><enum>3.</enum><header>Optional medicaid
			 coverage of certain persons screened and found to have colorectal
			 cancer</header>
			<subsection id="H3C59080599EA4E5EB4E311D857F6ECB"><enum>(a)</enum><header>Coverage as
			 optional categorically needy group</header>
				<paragraph id="H1B4010AD7A42425FA866B060FAA3FCB9"><enum>(1)</enum><header>In
			 general</header><text>Section 1902(a)(10)(A)(ii) of the Social Security Act (42
			 U.S.C. 1396a(a)(10)(A)(ii)) is amended—</text>
					<subparagraph id="H4114E220861F4A12874CC2A415308751"><enum>(A)</enum><text>in subclause
			 (XVIII), by striking <quote>or</quote> at the end;</text>
					</subparagraph><subparagraph id="H876481737CE44872A8ABCCA6E2DBF414"><enum>(B)</enum><text>in subclause
			 (XIX), by adding <quote>or</quote> at the end; and</text>
					</subparagraph><subparagraph id="H0D2FEE843D87422283F06B9930726D8E"><enum>(C)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block id="H6850C1172D29497BBD38195BD6ADAADB" style="OLC">
							<subclause id="H636D9625C41245ECB70222D835EB1678"><enum>(XX)</enum><text>who are described
				in subsection (dd) (relating to certain persons screened and found to need
				treatment from complications from screening or have colorectal
				cancer);</text>
							</subclause><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H65267F863848480FB2A6C1AAC5C123A4"><enum>(2)</enum><header>Group
			 described</header><text>Section 1902 of the Social Security Act (42 U.S.C.
			 1396a) is amended by adding at the end the following:</text>
					<quoted-block id="H35E9CEEE63E64250AF3EC015961F4546" style="OLC">
						<subsection id="H36CA580C0B0C42FD00F8681B4E35F576"><enum>(dd)</enum><text>Individuals
				described in this subsection are individuals who—</text>
							<paragraph id="HCAD425A9735C4CEAAABDC4DED0057BC"><enum>(1)</enum><text>are not described
				in subsection (a)(10)(A)(i);</text>
							</paragraph><paragraph id="H43125266BE9F495D8C66D84F8FB5B45"><enum>(2)</enum><text>have not attained
				age 65;</text>
							</paragraph><paragraph id="H779FFA266FF34D6584F923E8A675876F"><enum>(3)</enum><text>have been screened
				for colorectal cancer and need treatment for complications due to screening or
				colorectal cancer; and</text>
							</paragraph><paragraph id="HDA6C150A6F6B4FA5A23237B209DD893"><enum>(4)</enum><text>are not otherwise
				covered under creditable coverage, as defined in section 2701(c) of the Public
				Health Service
				Act.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H470CE73A1F44403B89524319A32D00FB"><enum>(3)</enum><header>Limitation on
			 benefits</header><text>Section 1902(a)(10) of the Social Security Act (42
			 U.S.C. 1396a(a)(10)) is amended in the matter following subparagraph
			 (G)—</text>
					<subparagraph id="H388BBEC1ED1345EBBF127211495785E2"><enum>(A)</enum><text>by striking
			 <quote>and (XIV)</quote> and inserting <quote>(XIV)</quote>; and</text>
					</subparagraph><subparagraph id="HF3747F6932344B228BFB63B2BB3832F9"><enum>(B)</enum><text>by inserting
			 <quote>, and (XV) the medical assistance made available to an individual
			 described in subsection (dd) who is eligible for medical assistance only
			 because of subparagraph (A)(10)(ii)(XX) shall be limited to medical assistance
			 provided during the period in which such an individual requires treatment for
			 complications due to screening or colorectal cancer</quote> before the
			 semicolon.</text>
					</subparagraph></paragraph><paragraph id="HE34038A8CE99486F84004FEEDE9064D"><enum>(4)</enum><header>Conforming
			 amendments</header><text>Section 1905(a) of the Social Security Act (42 U.S.C.
			 1396d(a)) is amended in the matter preceding paragraph (1)—</text>
					<subparagraph id="HAA2AAA091A6B45A18800A85B1EDDB7E1"><enum>(A)</enum><text>in clause (xii),
			 by striking <quote>or</quote> at the end;</text>
					</subparagraph><subparagraph id="H249C23DC1A734FD19E33614DDC6C0066"><enum>(B)</enum><text>in clause (xiii),
			 by adding <quote>or</quote> at the end; and</text>
					</subparagraph><subparagraph id="H63E98DB7B6534B2B82DCE6895F6225E8"><enum>(C)</enum><text>by inserting after
			 clause (xiii) the following:</text>

			 eligibility</header>
				<paragraph id="H850EDF5A6AE54AB88509DE39EEB9C0A9"><enum>(1)</enum><header>In
			 general</header><text>Title XIX of the Social Security Act (42 U.S.C. 1396 et
			 seq.) is amended by inserting after section 1920B the following:</text>
					<quoted-block display-inline="no-display-inline" id="H3DD667E246D5482DAA6B8844074F2FA6" style="traditional">
						<section id="HDD05941D6B594341A5E8248C61445800"><enum>1920C.</enum><header>Optional application of presumptive eligibility provisions
		  for certain persons with colorectal cancer</header><text display-inline="yes-display-inline">A State may elect to apply the provisions
				of section 1920B to individuals described in section 1902(dd) (relating to
				certain colorectal cancer patients) in the same manner as such section applies
				to individuals described in section 1902(aa) (relating to certain breast or
				cervical cancer patients).</text>
						</section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HEB8A47C3FFDD42B8BC921190B249F7F4"><enum>(2)</enum><header>Conforming
			 amendments</header>
					<subparagraph id="H43E6589D674842609C005EE5EC7683E"><enum>(A)</enum><text>Section 1902(a)(47)
			 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)(47)</external-xref>) is amended—</text>
						<clause id="H51B6EC141E6D4ACAB8949FFCFF159E2C"><enum>(i)</enum><text>by
			 striking <quote>and</quote> after <quote>section 1920</quote> and inserting a
			 comma;</text>
						</clause><clause id="H6A4498D6DE1C4B8FAACDB90004B04DB0"><enum>(ii)</enum><text>by
			 striking <quote>and</quote> after <quote>with such section</quote> and
			 inserting a comma; and</text>
						</clause><clause id="H2576D4076C994DCFB8A058B4B6FCA80"><enum>(iii)</enum><text>by
			 inserting before the semicolon at the end the following: <quote>, and provide
			 for making medical assistance available to individuals described in section
			 1920C during a presumptive eligibility period in accordance with such
			 section</quote>.</text>
						</clause></subparagraph><subparagraph id="H8F71A585D503415FA9E4FDD902618601"><enum>(B)</enum><text>Section
			 1903(u)(1)(d)(v) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396b">42 U.S.C. 1396b(u)(1)(d)(v)</external-xref>) is amended—</text>
						<clause id="HF9FE7A5DC70A4F0B90B89F951530381E"><enum>(i)</enum><text>by
			 striking <quote>or for</quote> and inserting <quote>, for</quote>; and</text>
						</clause><clause id="HF9D23416F861494298E0CB559D68F8B2"><enum>(ii)</enum><text>by
			 inserting before the period the following: <quote>, or for medical assistance
			 provided to an individual described in section 1920C during a presumptive
			 eligibility period under such section</quote>.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="HBCE2A30C886147B89263B56C67C1DF1E"><enum>(e)</enum><header>Enhanced
			 match</header><text>The first sentence of section 1905(b) of the Social
			 Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(b)</external-xref>) is amended—</text>
				<paragraph id="H7514533CA7BB4DE8A08B00C58151BF21"><enum>(1)</enum><text>by striking
			 <quote>and</quote> before <quote>(4)</quote>; and</text>
				</paragraph><paragraph id="HF6BFF3CC940A4EDCB7C212BAFD99E368"><enum>(2)</enum><text>by inserting
			 before the period at the end the following: <quote>, and (5) the Federal
			 medical assistance percentage shall be equal to the enhanced FMAP described in
			 section 2105(b) with respect to medical assistance provided to individuals who
			 are eligible for such assistance only on the basis of section
			 1902(a)(10)(A)(ii)(XX)</quote>.</text>
				</paragraph></subsection><subsection id="HF945F843B6124C478EE0958E46B30041"><enum>(f)</enum><header>Effective
			 date</header><text>The amendments made by this section apply to medical
			 assistance for items and services furnished on or after October 1, 2007,
			 without regard to whether final regulations to carry out such amendments have
			 been promulgated by such date.</text>
