<official-title>To provide alternative retired pay rates under title 10, United States Code, and alternative disability compensation rates under title 38, United States Code, for members of the Armed Forces with a combat-related disability, with such rates based on the average monthly salary for high school graduates in the United States, and for other purposes.</official-title>

<section id="HA214012B6B394DC5B42233CF315CF23D" section-type="section-one"><enum>1.</enum><header>Alternative retired pay rates for members of the Armed Forces with a combat-related disability</header> 
<subsection id="H6ACB99E4C8CC41DD98D539803B003E2F"><enum>(a)</enum><header>Alternative retired pay base for chapter 71 retired pay</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/10/1401">Section 1401</external-xref> of title 10, United States Code, is amended by adding at the end the following new subsection:</text>

<subsection id="H7AE71A158C4348E9A900DB45597CFD00"><enum>(c)</enum><header>Alternative retired pay base for members with a combat-related disability</header> 
<paragraph id="HAF694F0D1F9F4002A040F27FE2DA758F" display-inline="yes-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">In the case of a member of the armed forces with a combat-related disability who is entitled to monthly retired pay computed using a formula specified in subsection (a), the Secretary concerned shall permit the member to elect to have used in that formula, in lieu of the retired pay base of the member computed under <external-xref legal-doc="usc" parsable-cite="usc/10/1406">section 1406(b)</external-xref> or <external-xref legal-doc="usc" parsable-cite="usc/10/1407">1407</external-xref> of this title, a retired pay base equal to $2,917, which represents the average monthly salary for high school graduates in the United States, as determined by the Census Bureau for 2006.</text></paragraph> 
<paragraph id="H0E77422FA2214BF09E246D29A26858DD" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The alternative retired pay base in effect under paragraph (1) for a calendar year shall be adjusted on December 1 of that year in the manner provided by <external-xref legal-doc="usc" parsable-cite="usc/10/1401a">section 1401a(b)</external-xref> of this title for use during the next calendar year.</text></paragraph> 
<paragraph id="HF7D1DE3F1C2747BD8800004D52DF17F3" indent="up1"><enum>(3)</enum><text>In this subsection, the term <term>combat-related disability</term> means a disability that is compensable under the laws administered by the Secretary of Veterans Affairs and that—</text></paragraph> 
<paragraph id="H1ABA62C146A849FCAF24977477D1AA50"> <enum>(A)</enum> <text>is attributable to an injury for which the member was awarded the Purple Heart; or</text> </paragraph> 
<paragraph id="HD39ED51BCAE942FAB34C00A3AC408613"> <enum>(B)</enum> <text display-inline="yes-display-inline">was incurred (as determined under criteria prescribed by the Secretary of Defense for purposes of <external-xref legal-doc="usc" parsable-cite="usc/10/1413a">section 1413a</external-xref> of this title) as a direct result of armed conflict.</text> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="H1BBB776DD39C4EA391436FCF253840F9"><enum>(b)</enum><header>Alternative retired pay base for retired pay for non-Regular service</header><text display-inline="yes-display-inline">Section 12739 of such title is amended by adding at the end the following new subsection:</text>

<subsection id="H89BFFA1B73E444A60033BAADA7D3AAB8"><enum>(e)</enum> 
<paragraph id="HC2BD9681FCF6477690BF77A64DD398B" display-inline="yes-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">In the case of a member of the armed forces with a combat-related disability who is entitled to monthly retired pay computed under subsection (a), the Secretary concerned shall permit the member to elect to have used in paragraph (1) of such subsection, in lieu of the retired pay base of the member computed under section 1406(b) or 1407 of this title, a retired pay base equal to $2,917, which represents the average monthly salary for high school graduates in the United States, as determined by the Census Bureau for 2006.</text></paragraph> 
<paragraph id="H1935210DB6504F6FAD002CCC97902570" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The alternative retired pay base in effect under paragraph (1) for a calendar year shall be adjusted on December 1 of that year in the manner provided by section 1401a(b) of this title for use during the next calendar year.</text></paragraph> 
<paragraph id="H1C11DCB08C94422C840013DF9969F73D" indent="up1" display-inline="no-display-inline"><enum>(3)</enum><text>In this subsection, the term <term>combat-related disability</term> means a disability that is compensable under the laws administered by the Secretary of Veterans Affairs and that—</text></paragraph> 
<paragraph id="H0297479828044BB99F2EB13E636900DC"> <enum>(A)</enum> <text>is attributable to an injury for which the member was awarded the Purple Heart; or</text> </paragraph> 
<paragraph id="H9ABF427D6F4441F6BD02EE2070A060BD"> <enum>(B)</enum> <text display-inline="yes-display-inline">was incurred (as determined under criteria prescribed by the Secretary of Defense for purposes of section 1413a of this title) as a direct result of armed conflict.</text> </paragraph> </subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H536E54BADCEF43B0BAD5DF6FBEA2E35"><enum>(c)</enum><header>Application of amendments</header><text display-inline="yes-display-inline">The amendments made by subsections (a) and (b) shall apply with respect to members of the Armed Forces who retired or whose names were placed on the temporary disability retired list after September 11, 2001, except that any recomputation of the retired pay for a member on account of such amendments who retired or whose name was placed on the temporary disability retired list before the date of the enactment of this Act shall be effective only for months beginning after the date of the enactment of this Act. </text> </subsection></section> 
<section id="HBBC8E82998F24A429029DAB93613C1A5" section-type="subsequent-section" display-inline="no-display-inline"><enum>2.</enum><header>Alternative wartime disability compensation rates for certain veterans</header> 
<subsection id="HC79D3C89DDC24C3B8E4075466BE142A"><enum>(a)</enum><header>Alternative compensation base for chapter 11 wartime disability compensation</header><text><external-xref legal-doc="usc" parsable-cite="usc/38/1114">Section 1114</external-xref> of title 38, United States Code, is amended by adding at the end the following new subsection:</text> 
<quoted-block style="USC" id="H08CBDB0A5E834D58BB33D28C002F8E81" display-inline="no-display-inline"> 
<subsection id="HD996E1D32E2D4D988242B06B99D3B77B"><enum>(t)</enum> 
<paragraph id="H07502BA5E597493B9800031CD768A71B" display-inline="yes-display-inline"><enum>(1)</enum><text>In the case of a veteran—</text> 
<subparagraph id="HD4F0BB7B90E349AB9E1FBF82F837006E"><enum>(A)</enum><text>having a covered service-connected disability rated as total, the Secretary shall permit the veteran to elect to receive, in lieu of the monthly compensation rate in effect under subsection (j), a monthly compensation equal to $2,917, which represents the average monthly salary for high school graduates in the United States, as determined by the Census Bureau for 2006; and</text></subparagraph> 
<subparagraph id="H5727602BEFDF41A48285F023C356779F"><enum>(B)</enum><text>having a covered service-connected disability rated at a percentage other than total, the Secretary shall permit the veteran to elect to receive, in lieu of the monthly compensation rate in effect under subsections (a) through (i), as applicable, a monthly compensation equal to the amount that is the percentage of $2,917 that corresponds to the percentage of the service-connected disability rating of the veteran.</text></subparagraph></paragraph> 
<paragraph id="HAFF9067AA5EC49689FF5ECD1DE34C4FE" indent="up1"><enum>(2)</enum><text>For purposes of this subsection, the term <quote>covered service-connected disability</quote> means a service-connected disability that—</text> 
<subparagraph id="H644603B4A65148CFBFA9B67D2EA5ACF5"><enum>(A)</enum><text>is attributable to an injury for which the veteran was awarded the Purple Heart; or</text></subparagraph> 
<subparagraph id="H45C9FFEBA91C4483BF3B4164FF8FFCB8"><enum>(B)</enum><text>was incurred (as determined under criteria prescribed by the Secretary of Defense for purposes of <external-xref legal-doc="usc" parsable-cite="usc/10/1413a">section 1413a</external-xref> of title 10) as a direct result of armed conflict.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H529A27E8AF62441794FF430067DA6E12"><enum>(b)</enum><header>Application of amendment</header><text>The amendment made by subsection (a) shall apply with respect to veterans who became eligible to receive compensation under <external-xref legal-doc="usc" parsable-cite="usc/38/1110">section 1110</external-xref> of title 38, United States Code, after September 11, 2001, except that any recomputation of disability compensation for a veteran on account of such an amendment who so became eligible before the date of the enactment of this Act shall be effective only for months beginning after the date of the enactment of this Act.</text></subsection></section>
