		  1965 to direct the Secretary of Education to make grants to States for
		  assistance in hiring additional school-based mental health and student service

		<section display-inline="no-display-inline" id="H7179E675E1E647D2815C5F07504298AF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>The Student Support
			 Act</short-title></quote>.</text>
		</section><section display-inline="no-display-inline" id="HF87B1D6EAE154C839B64DCBDFF8C256B"><enum>2.</enum><header>School-based
			 mental health and student service providers</header>
			<subsection id="H94FCF51574A44016A2724F28B11C11D7"><enum>(a)</enum><header>In
			 General</header><text>Subpart 14 of title V of the
			 <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of
			 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/7269">20 U.S.C. 7269 et seq.</external-xref>) is amended—</text>
				<paragraph id="HB81F59209C19410095C800D67D5299A1"><enum>(1)</enum><text>by inserting after
			 the subpart heading the following:</text>

						<chapter id="H1BE831BDB3954AC59F3935C0B6394000"><enum>A</enum><header>SYSTEMS
				INTEGRATION; PROMOTION OF SCHOOL
				READINESS</header>
						</chapter><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H471FE51741AA43308D9F00C9016D5697" indent="up1"><enum></enum><text>and</text>
				</paragraph><paragraph id="H4D82E0FAF91743659C6200DA119C94F9"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block id="HC34907A9954941CFA1D45C80D7509854" style="OLC">
						<chapter id="HD9646CE4584543CBB6CF16277D2EF1DA"><enum>B</enum><header>SCHOOL-BASED
				MENTAL HEALTH AND STUDENT SERVICE PROVIDERS</header>
							<section id="HB9D602B54AED4CD989D6395BA6131FFC"><enum>5545.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
								<paragraph id="H418B410D191E4F9098D37798EA004E33"><enum>(1)</enum><text>The Surgeon
				General of the Public Health Service has found that although 1 in 10 children
				and adolescents suffer from mental illness severe enough to cause some level of
				impairment, in any given year fewer than 1 in 5 of these children receives
				needed treatment. The short- and long-term consequences of untreated childhood
				mental disorders are costly, in both human and fiscal terms.</text>
								</paragraph><paragraph id="H0F18507B89874B17006438E75D138C47"><enum>(2)</enum><text display-inline="yes-display-inline">School counselors, school psychologists,
				other qualified psychologists, child and adolescent psychiatrists, and school
				social workers are needed to help these children and to provide a variety of
				crucial support services.</text>
								</paragraph><paragraph id="HA2BBB92A0371438A94AD576DCE4F98F"><enum>(3)</enum><text>Across the United
				States, there are insufficient resources for school-based counseling
				professionals, and often students do not get the help they need. The current
				national average ratio of students to school counselors in elementary and
				secondary schools is 561 to 1.</text>
								</paragraph><paragraph id="H5A14F220C6634AD4A9CC32B33361E1C6"><enum>(4)</enum><text>United States
				schools need more mental health professionals, and they need the flexibility to
				hire the professionals that will best serve their students.</text>
								</paragraph><paragraph id="HC43E6C49DC844C57A0BC948C436CA2BA"><enum>(5)</enum><text>According to the
				Institute of Medicine of the National Academy of Sciences, the maximum
				recommended ratio of—</text>
									<subparagraph id="H12295B2FE8254FCBBAC06C00316F411C"><enum>(A)</enum><text>students to school
				counselors is 250 to 1;</text>
									</subparagraph><subparagraph id="H4E3B8EDEEE5944AA87493D35F62FA4BD"><enum>(B)</enum><text>students to school
				psychologists is 1,000 to 1; and</text>
									</subparagraph><subparagraph id="H6D771848CD1244EDA1AF47AF9513247F"><enum>(C)</enum><text>students to school
				social workers is 800 to 1.</text>
									</subparagraph></paragraph><paragraph id="H493DF400018D4573AE118C18DDCA84E"><enum>(6)</enum><text>In some States, 1
				school counselor typically serves over 1,000 students. Ratios for school
				psychologists and school social workers are also extremely high. In some
				schools, there are no school-based mental health and student service providers
				available to assist students in times of crisis, or at any other time.</text>
								</paragraph><paragraph id="H25E7F53AD2D94D1BBD9B81418414A29F"><enum>(7)</enum><text>The number of
				students is expected to grow significantly over the next few years. During this
				time, many school-based mental health professionals who currently serve the
				Nation’s youth will retire.</text>
								</paragraph><paragraph id="HB303C358F23D4FE4AD0023C500991736"><enum>(8)</enum><text>Model programs
				using school-based mental health and student service providers have reduced
				school suspensions, reduced referrals to the principal’s office, reduced the
				use of weapons, force, and threats, and increased students’ feelings of
				safety.</text>
								</paragraph></section><section id="HE7623287BBC942D5855445B218D000F2"><enum>5546.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this chapter are to assist
				States and local educational agencies in hiring additional school-based mental
				health providers, including additional school counselors, school psychologists,
				other qualified psychologists, child and adolescent psychiatrists, and school
				social workers to achieve each of the following:</text>
								<paragraph id="H19E488919D8D4D6BB4C53C838F5BE396"><enum>(1)</enum><text>To reduce the
				ratios of school-based mental health and student service providers to students
				in elementary and secondary schools in the United States to the following
				minimum ratios recommended by the Institute of Medicine of the National Academy
				of Sciences in its 1997 report <quote>Schools and Health: Our Nation’s
				Investment</quote>:</text>
									<subparagraph id="HF975CACDF0324311A0FDE2E88D761E12"><enum>(A)</enum><text>1 school counselor
				for every 250 students;</text>
									</subparagraph><subparagraph id="H74C564712DF840AD85246F8554F5692B"><enum>(B)</enum><text>1 school
				psychologist for every 1,000 students; and</text>
									</subparagraph><subparagraph id="H3BA08C52C44843B591B480995053D4A5"><enum>(C)</enum><text>1 school social
				worker for every 800 students.</text>
									</subparagraph></paragraph><paragraph id="H1E3EA0C566764704A6B2E78A2976141"><enum>(2)</enum><text>To provide
				school-based mental health and student services.</text>
								</paragraph><paragraph id="HE17E7E0D41A94D869B2C932EDDF3884C"><enum>(3)</enum><text>To remove
				emotional, behavioral, and psychosocial barriers to learning so as to enhance
				students classroom preparedness and ability to learn.</text>
								</paragraph><paragraph id="H2BB2BF1531C54B7E93532D1BC13C3B00"><enum>(4)</enum><text>To support school
				staff and teachers in improving classroom management, conducting behavioral
				interventions to improve school discipline, and developing the awareness and
				skills to identify early warning signs of violence and the need for mental
				health services.</text>
								</paragraph><paragraph id="H48E3C566D9E844748C6157F3DAD436E2"><enum>(5)</enum><text>To support
				parental involvement in improving the school behavior and academic success of
				their children.</text>
								</paragraph></section><section id="HE01D485CF79341F885294267A9B3C494"><enum>5547.</enum><header>Definitions</header><text display-inline="no-display-inline">In this chapter, the following definitions
				apply:</text>
								<paragraph id="H97FC06C53B1145C7A2D3DF1716A25377"><enum>(1)</enum><header>Child</header><text>The
				term <term>child</term> means an individual who is not less than 5 years old
				and not more than 17 years old.</text>
								</paragraph><paragraph id="H695E6751B51A47079DF0ED410004F6EA"><enum>(2)</enum><header>Child and
				adolescent psychiatrist</header><text>The term <quote>child and adolescent
				psychiatrist</quote> has the meaning given such term in section 5421(e).</text>
								</paragraph><paragraph id="H6C5DE7B9A5314022B44425DD72C8AEE5"><enum>(3)</enum><header>Child in
				poverty</header><text>The term <term>child in poverty</term> means a child from
				a family with an income below the poverty line.</text>
								</paragraph><paragraph id="H2CB2BDB01FDE4F148BDA8C9CA04D3704"><enum>(4)</enum><header>Mental health
				and student service provider</header><text>The term <term>mental health and
				student service provider</term> means a qualified individual who provides
				mental health and student services, including any individual who is a qualified
				school counselor, a qualified school psychologist or any other qualified
				psychologist, a child or adolescent psychiatrist, or a qualified school social
				worker.</text>
								</paragraph><paragraph id="H06B373296D5B41B0BE01C36D79D80BD"><enum>(5)</enum><header>Mental health and
				student services</header><text>The term <term>mental health and student
				services</term> includes direct, individual, and group services provided to
				students, parents, and school personnel by mental health and student service
				providers, and the coordination of prevention strategies in schools or
				community-based programs.</text>
								</paragraph><paragraph id="HB3512BB1124A485E90C7005988DEEACD"><enum>(6)</enum><header>Other qualified
				psychologist</header><text>The term <quote>other qualified psychologist</quote>
				has the meaning given such term in section 5421(e).</text>
								</paragraph><paragraph id="HEEBC25D16A84484DB8BE1800C3FA697D"><enum>(7)</enum><header>Poverty
				line</header><text>The term <term>poverty line</term> means the poverty line
				(as defined by the Office of Management and Budget, and revised annually in
				accordance with section 673(2) of the Community Services Block Grant Act (42
				U.S.C. 9902(2)) applicable to a family of the size involved.</text>
								</paragraph><paragraph id="HC4F733F8196C4D78A73B3B02994243D2"><enum>(8)</enum><header>School
				counselor</header><text>The term <term>school counselor</term> means an
				individual who has documented competence in counseling children and adolescents
				in a school setting and who—</text>
									<subparagraph id="H655A178651494845BFCBDABCF9AC2300"><enum>(A)</enum><text>possesses State
				licensure or certification granted by an independent professional regulatory
				authority;</text>
									</subparagraph><subparagraph id="HDECB8EFAFDCF4D4C007B2317247274C3"><enum>(B)</enum><text>possesses national
				certification in school counseling or a specialty of counseling granted by an
				independent professional organization; or</text>
									</subparagraph><subparagraph id="H5D749467EE67483EA93432117BA54FC"><enum>(C)</enum><text>holds a minimum of
				a master’s degree in school counseling from a program accredited by the Council
				for Accreditation of Counseling and Related Educational Programs or the
				equivalent.</text>
									</subparagraph></paragraph><paragraph id="H296469D447D24605AA57008BBFDCA518"><enum>(9)</enum><header>School
				psychologist</header><text>The term <term>school psychologist</term> means an
				individual who—</text>
									<subparagraph id="H7D755586A3E84B2791989B39F103E7B1"><enum>(A)</enum><text>possesses a
				minimum of 60 graduate semester hours in school psychology from an institution
				of higher education and has completed 1,200 clock hours in a supervised school
				psychology internship, of which 600 hours shall be in a school setting;</text>
									</subparagraph><subparagraph id="H8187B7B94F5B41E691C0BB1FD177286C"><enum>(B)</enum><text>possesses State
				licensure or certification in school psychology in the State in which the
				individual works; or</text>
									</subparagraph><subparagraph id="HFC7E31E4AC8043CEB2A5F68784007CC5"><enum>(C)</enum><text>possesses national
				certification by the National School Psychology Certification Board.</text>
									</subparagraph></paragraph><paragraph id="HF69EF8C092CC4B95BCEBA5DD745BF5BF"><enum>(10)</enum><header>School social
				worker</header><text>The term <term>school social worker</term> means an
				individual who—</text>
									<subparagraph id="HF84A51091EB4410CAD1EE9C0CE41DD8E"><enum>(A)</enum><text>holds a master’s
				degree in social work from a program accredited by the Council on Social Work
				Education;</text>
									</subparagraph><subparagraph id="H713FCC2CFA1D4C9A9E1E15E62ED66B94"><enum>(B)</enum><text>is licensed or
				certified by the State in which services are provided; or</text>
									</subparagraph><subparagraph id="H5C615AA4890547C1A5D32C3D449B7233"><enum>(C)</enum><text>possesses a
				national credential or national certification as a school social work
				specialist granted by an independent professional organization.</text>
									</subparagraph></paragraph><paragraph id="HF7C9FE5088C24B45B023B54545CF3374"><enum>(11)</enum><header>State</header><text>The
				term <term>State</term> means each of the several States, the District of
				Columbia, and the Commonwealth of Puerto Rico.</text>
								</paragraph></section><section id="HFFF51230785D41BE8CA156A47CD028C6"><enum>5548.</enum><header>School-based
				mental health and student service provider grant program</header>
								<subsection id="H71251DF5A14A4F07A97C64D35B7249B8"><enum>(a)</enum><header>In
				General</header><text>In accordance with this chapter, the Secretary shall make
				grants to eligible States to assist local educational agencies in those States
				in hiring additional school-based mental health and student service
				providers.</text>
								</subsection><subsection id="H88C5B8605D15478BB3333C9C3B7E09FA"><enum>(b)</enum><header>Allocation of
				Funds</header><text>From the total amount appropriated for a fiscal year to
				carry out this chapter, the Secretary shall—</text>
									<paragraph id="HCD0E1AA71D704D79BED77D0341BD7BB7"><enum>(1)</enum><text>make available 1
				percent of such amount to the Secretary of the Interior (on behalf of the
				Bureau of Indian Affairs) and the outlying areas for activities that carry out
				the purposes of this chapter; and</text>
									</paragraph><paragraph id="H7EBD58A8047844DD9B478CFAE4C54BB9"><enum>(2)</enum><text>make available in
				the form of grants to each eligible State an amount equal to the sum of—</text>
										<subparagraph id="H82B7743A3B46428C86CA005306E62BC9"><enum>(A)</enum><text>an amount that
				bears the same relationship to 50 percent of such total amount as the number of
				children in poverty who reside in the State bears to the number of such
				children in all States; and</text>
										</subparagraph><subparagraph id="HD4DE7E89D0854AEC8CC964D5AFCEF03"><enum>(B)</enum><text>an amount that
				bears the same relationship to 50 percent of such total amount as the number of
				children enrolled in public and private nonprofit elementary schools and
				secondary schools in the State bears to the number of children enrolled in all
				such schools in all States.</text>
										</subparagraph></paragraph></subsection><subsection id="HA26F9CA26BC347BD00F7686EF24804ED"><enum>(c)</enum><header>Minimum
				Grant</header><text>Notwithstanding subsection (b), no grant under this section
				shall be for an amount less than $1,000,000.</text>
								</subsection><subsection id="H0C503468EC56447C90244EB1522FB117"><enum>(d)</enum><header>Reallocation</header><text>The
				Secretary shall reallocate to States that have received approval under
				subsection (e)(2) any funds allocated under subsection (b) to a State that
				fails to submit an application that is approved by the Secretary.</text>
								</subsection><subsection id="H20AAE19032E24400AC00D10BE4611B1"><enum>(e)</enum><header>Application by
				State</header>
									<paragraph id="H35FCBEDE334E437B872F67792842A5AE"><enum>(1)</enum><header>In
				general</header><text>To be eligible to receive a grant under this chapter, a
				State shall submit an application to the Secretary at such time, in such
				manner, and containing such information as the Secretary may require.</text>
									</paragraph><paragraph id="H0C193E54B25141C5919C4753CF02006F"><enum>(2)</enum><header>Approval</header><text>The
				Secretary may not approve an application under this subsection unless the State
				submitting the application—</text>
										<subparagraph id="H34942203A3FE4226A5FC138F88610055"><enum>(A)</enum><text>presents a plan,
				which the Secretary considers to be reasonable, under which the State will make
				grants, in accordance with the purposes of this chapter, to local educational
				agencies to fund the hiring of additional school counselors, school
				psychologists, other qualified psychologists, child and adolescent
				psychiatrists, and school social workers; and</text>
										</subparagraph><subparagraph id="H02806C1FF291483CA97152EA952815B4"><enum>(B)</enum><text>provides an
				assurance that the State will provide the matching amount required under
				subsection (g).</text>
										</subparagraph></paragraph></subsection><subsection id="H52D8850FD6D747A8B8ADDB7073077661"><enum>(f)</enum><header>Use of Funds by
				State</header>
									<paragraph id="HBB293360D89C4E2AA256847B63F5F545"><enum>(1)</enum><header>In
				general</header><text>In accordance with this subsection, the total of the
				amounts made available to a State under this section and the amounts of the
				non-Federal match required under subsection (g) may only be used by a State to
				make grants to local educational agencies to assist such agencies in hiring
				additional school-based mental health and student service providers.</text>
									</paragraph><paragraph id="H21D5A291C2024D08B743A6793378A0E0"><enum>(2)</enum><header>Administrative
				costs</header><text>In each fiscal year, a State may use not more than 5
				percent of the assistance made available to it under this chapter for the
				administrative costs of the State in carrying out the State’s responsibilities
				under this chapter.</text>
									</paragraph><paragraph id="H5E79C500CB1B4070B0AB9E009B2504F6"><enum>(3)</enum><header>Allocation of
				funds</header><text>In making grants in accordance with this subsection, the
				State shall allocate from the total described in paragraph (1) to each local
				educational agency an amount equal to the sum of—</text>
										<subparagraph id="H789D163E545344F395C18D056BC4B9AB"><enum>(A)</enum><text>an amount that
				bears the same relationship to 50 percent of such total as the number of
				children in poverty who reside in the school district served by the local
				educational agency bears to the number of such children who reside in all the
				school districts in the State; and</text>
										</subparagraph><subparagraph id="H95F50E0C77BD428388320100F4384BB5"><enum>(B)</enum><text>an amount that
				bears the same relationship to 50 percent of such total as the number of
				children enrolled in public and private nonprofit elementary schools and
				secondary schools in the school district served by the local educational agency
				bears to the number of children enrolled in all such schools in the
				State.</text>
										</subparagraph></paragraph><paragraph id="H7F5B1A5CCD0A4D8688097809D388AD1F"><enum>(4)</enum><header>Minimum
				grant</header><text>Notwithstanding paragraph (3), no grant made by a State in
				accordance with this subsection shall be for an amount less than
				$50,000.</text>
									</paragraph><paragraph id="H3DA4662B44324379BC893B00218EF994"><enum>(5)</enum><header>Source of
				data</header><text>For purposes of paragraph (3), the State shall use data from
				the most recent fiscal year for which satisfactory data are available, except
				that the State may adjust such data, or use alternative child poverty data, if
				the State demonstrates to the Secretary’s satisfaction that such adjusted or
				alternative data more accurately reflect the relative incidence of children who
				are living in poverty and who reside in the school districts in the
				State.</text>
									</paragraph><paragraph id="HDB69D478CC664E949531D1C20067C0FF"><enum>(6)</enum><header>Application by
				local educational agencies</header><text>A State may require that, in order to
				be eligible for a grant made by the State in accordance with this subsection, a
				local educational agency shall submit an application to the State at such time,
				in such manner, and containing such information as the State may
				require.</text>
									</paragraph></subsection><subsection id="H6339A6A7FEEF404FA4D6ADA427C97C59"><enum>(g)</enum><header>Matching
				Funds</header>
									<paragraph id="H5D1723DF631449358D253317F3E8E306"><enum>(1)</enum><header>In
				general</header><text>As a condition of receiving a grant under this section,
				the Secretary shall require that a State provide from non-Federal sources an
				amount equal to the amount of the grant.</text>
									</paragraph><paragraph id="H40E7AFD808724949BDBB44AD92A923BB"><enum>(2)</enum><header>Local
				contribution</header><text>In making grants to local educational agencies in
				accordance with this subsection, a State may require that a local educational
				agency match a portion of the amount of the grant made to the agency.</text>
									</paragraph><paragraph id="HCF6084AD306E42AAACF85EC7B91591EC"><enum>(3)</enum><header>Form</header><text>The
				non-Federal share required by this subsection may be provided in cash or in
				kind, fairly evaluated, and may include facilities, equipment, or
				services.</text>
									</paragraph></subsection><subsection id="HCA93E2ED6B434D9BBA671B828808B2C2"><enum>(h)</enum><header>Funds To Be
				Supplementary</header><text>Assistance made available under this chapter shall
				be used to supplement, and may not supplant, Federal, State, or local funds
				used for employing school-based mental health and student service
				providers.</text>
								</subsection><subsection id="HDF98D7C21B2F4CA8AD4795C276AA7C98"><enum>(i)</enum><header>Data Collection
				and Report</header>
									<paragraph id="H1F2A3882801F4F10BE7CF05EE57D7400"><enum>(1)</enum><header>In
				general</header><text>For each fiscal year for which it receives assistance
				under this chapter, a State shall collect data describing how the assistance is
				used.</text>
									</paragraph><paragraph id="H09BD562E43744E4FB78660CD7BF2A1C3"><enum>(2)</enum><header>Report</header><text>Not
				later than 1 year after assistance is made available to a State under this
				chapter, the State shall transmit to the Secretary a report on the data
				described in paragraph (1), including information with respect to each local
				educational agency to which the State made a grant with assistance made
				available under this chapter—</text>
										<subparagraph id="H69161AF23A9F489BAF005B57EF7E49"><enum>(A)</enum><text>the number of school
				counselors, school psychologists, other qualified psychologists, child and
				adolescent psychiatrists, and school social workers employed by local
				educational agency; and</text>
