		<official-title>To direct the Consumer Product Safety Commission to
		  promulgate a consumer product safety standard for each durable infant or
		  toddler product, and for other purposes.</official-title>

		<section display-inline="no-display-inline" id="HCA96C52C590C46CE8CC1A9B1FB39D433" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Infant and Toddler Durable Product
			 Safety Act</short-title></quote>.</text>
		</section><section id="H2B4EA43FF47C4E83934D7256D6EC6FB0"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph id="HA73536C6F2BA4C509C2F5E7143F286E5"><enum>(1)</enum><text>Unintentional
			 injuries are the leading cause of death among children, and for every such
			 injury that is fatal, approximately 18 children are hospitalized and 1,250 are
			 treated by emergency departments for such injuries that are nonfatal.</text>
			</paragraph><paragraph id="H57B81174E0BA499387002E26088DC391"><enum>(2)</enum><text>According to the
			 Consumer Product Safety Commission, an average of 50 children under the age of
			 5 die each year in incidents associated with nursery products, and about 16 of
			 these deaths each year are associated with cribs.</text>
			</paragraph><paragraph id="H6B3F91985C874C71A600201FA47E3E5C"><enum>(3)</enum><text>In 2003, an
			 estimated 60,700 children under the age of 5 were treated in United States
			 hospital emergency rooms for injuries associated with nursery products, and
			 there were 10,700 injuries to children under the age of 5 years associated with
			 strollers alone.</text>
			</paragraph><paragraph id="HA00575E1CECA4CE68155746331A51C22"><enum>(4)</enum><text>Of the 397 recalls
			 issued by the Consumer Product Safety Commission in fiscal year 2005, 109 (or
			 28 percent) were children’s products. Children’s products were recalled, on
			 average, over 2 times per week, and accounted for 19,635,627 individual
			 units.</text>
			</paragraph></section><section id="H25F6B2EE75E74C6BA2FFFA1EBA59FAF3"><enum>3.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to prevent
			 dangerous children’s products from getting to the market, by requiring
			 independent testing of all durable infant and toddler products before they
			 enter commerce.</text>
		</section><section id="HAC7270D4A8C14B4D8800C7CADAD64DB2"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H77EB8F62E6A04C128BD397EE6DEB0228"><enum>(1)</enum><header>Commission</header><text>The
			 term <term>Commission</term> means the Consumer Product Safety
			 Commission.</text>
			</paragraph><paragraph id="H481B35BFFD654901BC3C220771FC0095"><enum>(2)</enum><header>Durable infant
			 or toddler product</header><text>The term <term>durable infant or toddler
			 product</term>—</text>
				<subparagraph id="HD095B22E65FA410C91B851E6E5EE329D"><enum>(A)</enum><text>means a durable
			 product intended for use, or that may be reasonably expected to be used, by
			 children under the age of 5 years; and</text>
				</subparagraph><subparagraph id="H46ED3EEE703F4ADBA0E0BCC4C42EC001"><enum>(B)</enum><text>includes—</text>
					<clause id="HE62DFF1CAEEE4B2C867012591175603F"><enum>(i)</enum><text>full-size cribs
			 and nonfull-size cribs;</text>
					</clause><clause id="H162FCFED22D2465BA6602D116E6CFCB7"><enum>(ii)</enum><text>toddler
			 beds;</text>
					</clause><clause id="H972752BEEF514F9BAC89C841A476EFB"><enum>(iii)</enum><text>high chairs,
			 booster chairs, and hook-on chairs;</text>
					</clause><clause id="HEB33F1A23148492AA0228363D19B4189"><enum>(iv)</enum><text>bath
			 seats;</text>
					</clause><clause id="H604B3269D3DE497FA17FEA00AF065F66"><enum>(v)</enum><text>gates and other
			 enclosures for confining a child;</text>
					</clause><clause id="H123E7D4057FC41DE8D34E2D0EE5F00F4"><enum>(vi)</enum><text>play
			 yards;</text>
					</clause><clause id="HB093717D47434841ACB9EC57828E8D9"><enum>(vii)</enum><text>stationary
			 activity centers;</text>
					</clause><clause id="H3C999784832E44189CCF397CE5050055"><enum>(viii)</enum><text>infant
			 carriers;</text>
					</clause><clause id="H8CE21EA137C24C068871DD99387E3929"><enum>(ix)</enum><text>strollers;</text>
					</clause><clause id="H503515AED87842B3A1456BDF97778621"><enum>(x)</enum><text>walkers;</text>
					</clause><clause id="H7AD085093AAA408AB4274479C2E9B6A9"><enum>(xi)</enum><text>swings;
			 and</text>
					</clause><clause id="H116D58A5F799463EA6F70061C9679814"><enum>(xii)</enum><text>bassinets and
			 cradles.</text>
					</clause></subparagraph></paragraph><paragraph id="H2ED3B0CAF14642FCA4423CB4399EE9F5"><enum>(3)</enum><header>Panel</header><text>The
			 term <term>Panel</term> means the Infant and Toddler Product Review Panel
			 established under section 7.</text>
			</paragraph></section><section id="H472BA191B79F42FA8450C1856FCF44C"><enum>5.</enum><header>Consumer product
			 safety standards for durable infant and toddler products</header>
			<subsection id="HBC85CFF17AE24B11A891B342383C57B3"><enum>(a)</enum><header>In
			 General</header><text>The Consumer Products Safety Commission shall, without
			 regard to sections 7(b)(1) and 9(f)(3)(D) of the <act-name parsable-cite="CPSA">Consumer Product Safety Act</act-name> (15 U.S.C.
			 2056(b)(1), 2058(f)(3)(D)), promulgate a consumer product safety standard under
			 section 7(a) of the <act-name parsable-cite="CPSA">Consumer Product Safety
			 Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/2056">15 U.S.C. 2056(a)</external-xref>) for each durable infant or toddler
			 product.</text>
			</subsection><subsection id="H4A05C45AF59F4DCCBFD65900DD191D99"><enum>(b)</enum><header>Schedule</header><text>The
			 Commission shall promulgate consumer product safety standards under this
			 section—</text>
				<paragraph id="H10AE9A2EF1D3408E00CAB94B877F8611"><enum>(1)</enum><text>for at least 7
			 durable infant or toddler products every 2 calendar years beginning after the
			 date of the enactment of this Act, through 2013; and</text>
				</paragraph><paragraph id="HDADD52CF1ADD47689D41DAD677FD3132"><enum>(2)</enum><text>for all durable
			 infant or toddler products by not later than December 31, 2013.</text>
				</paragraph></subsection><subsection id="HED0E8A526F4D465F00214ED3277BAE00"><enum>(c)</enum><header>Consultation
			 With Panel</header><text>The Commission shall promulgate any consumer product
			 safety standard under this section for a durable infant or toddler
			 product—</text>
				<paragraph id="H44C3C3CDBB964C66A8875202B0253E76"><enum>(1)</enum><text>in consultation
			 with the Panel; and</text>
				</paragraph><paragraph id="H929E255153844E2BB2036C6486284532"><enum>(2)</enum><text>after considering
			 the results of a review by such panel of any existing guidelines for that
			 product.</text>
				</paragraph></subsection></section><section id="H99C44662DBBB4F80AE4C59AE575F5916"><enum>6.</enum><header>Durable infant
			 and toddler product compliance certification</header>
			<subsection id="HBC25A563F0EB4FBDAD4DA89FA0316575"><enum>(a)</enum><header>In
			 General</header><text>The Commission shall by rule—</text>
				<paragraph id="H186D21CF0C884CD49B00A118F141B95B"><enum>(1)</enum><text>require that
			 testing and certification required under section 14 of the
			 <act-name parsable-cite="CPSA">Consumer Product Safety Act</act-name> (15
			 U.S.C. 2063) for a durable infant or toddler product shall be performed by an
			 independent third party; and</text>
				</paragraph><paragraph id="HE2987862019D44E3AC85E71821A741CE"><enum>(2)</enum><text>require the use,
			 and prescribe the form and content, of a label under section 14(c) for such
			 products for which such a certificate is issued, including a seal prescribed
			 under subsection (b).</text>
				</paragraph></subsection><subsection id="H980A4E3C82D74CD9A8B3C527D9A132F8"><enum>(b)</enum><header>Consultation
			 With Panel</header><text>The Commission shall delegate to the Panel the
			 authority to prescribe a seal that shall be used, under the labeling
			 requirements under subsection (a)(2), for infant or toddler products that are
			 certified pursuant to section 14(a) of the <act-name parsable-cite="CPSA">Consumer Product Safety Act</act-name> (15 U.S.C.
			 2063(a)(2)) to comply with applicable consumer product safety standards
			 promulgated under this Act.</text>
			</subsection></section><section id="H07E239217C6F46FB9546484D13136D9F"><enum>7.</enum><header>Infant and
			 Toddler Product Review Panel</header>
			<subsection id="H6ADD34EEF3F14AA9AE67D8D28D77D704"><enum>(a)</enum><header>Establishment</header><text>The
			 Commission shall establish an Infant and Toddler Product Review Panel to advise
			 the Commission regarding the implementation of this Act.</text>
			</subsection><subsection id="H1352DE8C2BB846E098008464428E4759"><enum>(b)</enum><header>Functions</header><text>The
			 Panel shall—</text>
				<paragraph id="H2DDA11724EB14962911B0069C53551F2"><enum>(1)</enum><text>review and report
			 to the Commission regarding the existing guidelines for durable infant or
			 toddler products; and</text>
				</paragraph><paragraph id="H98069A5E047849E495248CFAAB99D826"><enum>(2)</enum><text>advise the
			 Commission regarding the promulgation of consumer product safety standards
			 under this Act.</text>
				</paragraph></subsection><subsection id="HA1C67FEC9E2140D499EE075E5C59D5BE"><enum>(c)</enum><header>Membership</header>
				<paragraph id="HA7015B2AD75F4DA994995943A699E86E"><enum>(1)</enum><header>In
			 general</header><text>The Panel shall be comprised of—</text>
					<subparagraph id="H6E809488BE2248188E8CB0E5E767BAE0"><enum>(A)</enum><text>representatives
			 of—</text>
						<clause id="H9A0AC33D7F7344BB98194EEDD230E71C"><enum>(i)</enum><text>the
			 juvenile product manufacturers industry;</text>
						</clause><clause id="HE97CE1E84F6041EC82A2B6CFA64A0FD"><enum>(ii)</enum><text>consumer groups;
			 and</text>
						</clause><clause id="H266131F643944C0281EEA8BFD4914851"><enum>(iii)</enum><text>independent
			 child product engineers and experts; and</text>
						</clause></subparagraph><subparagraph id="H44F86AB6FE144BA7912218AFA99600EC"><enum>(B)</enum><text>Consumer Product
			 Safety Commission engineers.</text>
					</subparagraph></paragraph><paragraph id="H3096E82F1EFE4CA98476E1B31B00AEF6"><enum>(2)</enum><header>Limitation</header><text>Representatives
			 under paragraph (1)(A)(i) shall not exceed 40 percent of the membership of the
			 Panel.</text>
				</paragraph></subsection></section><section id="H7F35871393684FDC94D6E2A9ED1FB822"><enum>8.</enum><header>Amendments to
			 <act-name parsable-cite="CPSA">Consumer Product Safety Act</act-name></header>
			<subsection id="H694167DE37B4438E8011DD652D3C4EC0"><enum>(a)</enum><header>Removal of
			 Limitation on Maximum Civil Penalty</header><text>Section 20(a) of the
			 <act-name parsable-cite="CPSA">Consumer Product Safety Act</act-name> (15
			 U.S.C. 2069(a)) is amended—</text>
				<paragraph id="HCCED63E04E5E46EEB7260258E0D27B11"><enum>(1)</enum><text>in the second
			 sentence by striking <quote>Subject to paragraph (2),</quote> and inserting
			 <quote>Subject to paragraphs (2) and (3),</quote>; and</text>
				</paragraph><paragraph id="H7328D78A24EF46B6A38852AB6B331700"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block id="H8F4440693606403EA937165F02C95D33" style="OLC">
						<paragraph id="HB1DB12E0A0054269BF0039FE72DEFB8" indent="up1"><enum>(4)</enum><text>The second sentence of paragraph (1)
				shall not apply to any violation with respect to a durable infant or toddler
				product.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HB852E6EB09BD49F582191663E2C321DF"><enum>(b)</enum><header>Requirements
			 Regarding Disclosure of Information Not Applicable</header><text>Section 6(b)
			 of the <act-name parsable-cite="CPSA">Consumer Product Safety Act</act-name>
			 (<external-xref legal-doc="usc" parsable-cite="usc/15/2055">15 U.S.C. 2055(b)</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block act-name="Consumer Product Safety Act" id="HBDCE3CA98995410FB822DAEBCF357D2" style="OLC">
					<paragraph id="H838A20786C6148E3B4F6DF4FAF410357" indent="up1"><enum>(9)</enum><text>This subsection shall not apply with
				respect to any durable infant or toddler
				product.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H44EB7C49DBDB49689F509BF987345207"><enum>(c)</enum><header>Definition of
			 Durable Infant or Toddler Product</header><text>Section 3(a) of the
			 <act-name parsable-cite="CPSA">Consumer Product Safety Act</act-name> (15
			 U.S.C. 2052(a)) is amended by adding at the end the following:</text>
				<quoted-block act-name="Consumer Product Safety Act" id="HDE59FE9991B94C17ACED84201FDD2FFD" style="OLC">
					<paragraph id="HBE532221887E4B4D00F9844516F57E17"><enum>(15)</enum><text>The term
				<term>durable infant or toddler product</term> has the meaning given that term
				in the Infant and Toddler Product Safety
				Act.</text>
