<section commented="no" display-inline="no-display-inline" id="H1F6A464E587840A39FAD72BA539BBCFF" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Vote by Mail Act of 2007</short-title></quote>.</text></section> 
<section commented="no" display-inline="no-display-inline" id="H034F4BCD0013492DA600B084C249F7DA" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="no-display-inline">Congress makes the following findings:</text> 
<paragraph commented="no" display-inline="no-display-inline" id="HABC9751B2D5D433CA9DB8DDC27C4A5BA"><enum>(1)</enum><text display-inline="yes-display-inline">The Supreme Court declared in Reynolds v. Sims that <quote>[i]t has been repeatedly recognized that all qualified voters have a constitutionally protected right to vote . . . and to have their votes counted.</quote>.</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H6C33CC6641434012A9DCED37A3661200"><enum>(2)</enum><text display-inline="yes-display-inline">In the 2000 and 2004 presidential elections, voting technology failures and procedural irregularities deprived some Americans of their fundamental right to vote.</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HFE655BAE17E94FD89B8300FEF9092DB"><enum>(3)</enum><text display-inline="yes-display-inline">In 2000, faulty punch card ballots and other equipment failures prevented accurate vote counts nationwide. A report by the Caltech/MIT Voting Technology Project estimates that approximately 1,500,000 votes for president were intended to be cast but not counted in the 2000 election because of equipment failures.</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H70C7026C30D843FB88C920324C11A575"><enum>(4)</enum><text display-inline="yes-display-inline">In 2004, software errors, malfunctioning electronic voting systems, and long lines at the polls prevented accurate vote counts and prevented some people from voting. For instance, voters at Kenyon College in Gambier, Ohio waited in line for up to 12 hours because there were only 2 machines available for 1,300 voters.</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HBCD5708FF91542A291E1CFFF137E37F5"><enum>(5)</enum><text>In 2006, election day problems plagued voters in a number of States as well. For instance, in Denver, Colorado, hundreds of voters were turned away when the database of registered voters crashed. In Allegheny County, Pennsylvania, malfunctioning machines and an inadequate number of provisional ballots generated long lines, causing many voters to leave without casting a vote.</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H6B2A2EA1A3CA4D16007FE6A9D6E21FBC"><enum>(6)</enum><text display-inline="yes-display-inline">Under the Oregon Vote by Mail system, election officials mail ballots to all registered voters at least 2 weeks before election day. Voters mark their ballots, seal the ballots in both unmarked secrecy envelopes and signed return envelopes, and return the ballots by mail or to secure drop boxes. Once a ballot is received, election officials scan the bar code on the ballot envelope, which brings up the voter’s signature on a computer screen. The election official compares the signature on the screen and the signature on the ballot envelope. Only if the signature on the ballot envelope is determined to be authentic is the ballot forwarded on to be counted.</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HDD77B6C191744F9600444D42C771BB6B"><enum>(7)</enum><text display-inline="yes-display-inline">Oregon’s Vote by Mail system has deterred voter fraud because the system includes numerous security measures such as the signature authentication system. Potential misconduct is also discouraged by the power of the State to punish those who engage in voter fraud with up to five years in prison, $100,000 in fines, and the loss of their vote.</text> </paragraph> 
<paragraph id="H6DF20D02F11A4883A82B2D4500AC5FEC"><enum>(8)</enum><text>Oregon’s Vote by Mail system promotes uniformity and strict compliance with Federal and State voting laws because ballot processing is centralized in county clerk’s offices, rather than at numerous polling places.</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H06023A0FE7F54CD6BC639F77FBBAB822"><enum>(9)</enum><text display-inline="yes-display-inline">Vote by Mail is one factor making voter turnout in Oregon consistently higher than the average national voter turnout. For example, Oregon experienced a record voting-age-eligible population turnout of 70.6 percent in the 2004 presidential election, compared to 58.4 percent nationally. Oregon’s turnout of registered voters for that election was 86.48 percent.</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HBAC1054D26A5432AA0E79874BB40034F"><enum>(10)</enum><text display-inline="yes-display-inline">Women, younger voters, and homemakers also report that they vote more often using Vote by Mail.</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H1743CC1DA292410A938F1C6D981B00A"><enum>(11)</enum><text display-inline="yes-display-inline">Vote by Mail reduces election costs by eliminating the need to transport equipment to polling stations and to hire and train poll workers. Oregon has reduced its election-related costs by 30 percent since implementing Vote by Mail.</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HB066FDFE930A47D89350EE722D5BB51B"><enum>(12)</enum><text display-inline="yes-display-inline">Vote by Mail allows voters to educate themselves because they receive ballots well before election day, which provides them with ample time to research issues, study ballots, and deliberate in a way that is not possible at a polling place.</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H2C1F34C7A14D46E485A4FB6894BAE522"><enum>(13)</enum><text display-inline="yes-display-inline">Vote by Mail is accurate—at least 2 studies comparing voting technologies show that absentee voting methods, including Vote by Mail systems, result in a more accurate vote count.</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HE9D466EAF16C4A649D8C6486932CCB5E"><enum>(14)</enum><text display-inline="yes-display-inline">Vote by Mail results in more up-to-date voter rolls, since election officials use forwarding information from the post office to update voter registration.</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H45875AB096314E7E81C0846B7F013B35"><enum>(15)</enum><text display-inline="yes-display-inline">Vote by Mail allows voters to visually verify that their votes were cast correctly and produces a paper trail for recounts.</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HE42CEB9D101C42E9894368A000E3D8B1"><enum>(16)</enum><text display-inline="yes-display-inline">In a survey taken 5 years after Oregon implemented the Vote by Mail system, more than 8 in 10 Oregon voters said they preferred voting by mail to traditional voting.</text> </paragraph></section> 
<section commented="no" display-inline="no-display-inline" id="HDCE2D5C94D2D446189283D839E30FBC0" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H6123C5263F9D4A90AD72BF70CA6E5667"><enum>(1)</enum><header display-inline="yes-display-inline">Election</header><text display-inline="yes-display-inline">The term <term>election</term> means any general, special, primary, or runoff election.</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HF82548163E9F4D208D38AC03CF0041BB"><enum>(2)</enum><header display-inline="yes-display-inline">Participating State</header><text display-inline="yes-display-inline">The term <quote>participating State</quote> means a State receiving a grant under the Vote by Mail grant program under section 4.</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H6C8250789B644CC38044F7BD47009CA9"><enum>(3)</enum><header>Residual vote rate</header><text>The term <quote>residual vote rate</quote> means the sum of all votes that cannot be counted in an election (overvotes, undervotes, and otherwise spoiled ballots) divided by the total number of votes cast.</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HC3AE48E2EADD4E7E99B2E67795677DD9"><enum>(4)</enum><header display-inline="yes-display-inline">State</header><text display-inline="yes-display-inline">The term <term>State</term> means a State of the United States, the District of Columbia, the Commonwealth of Puerto Rico, or a territory or possession of the United States.</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H28E1C3658A9C4BB794398FDB2C7B47C2"><enum>(5)</enum><header display-inline="yes-display-inline">Voting system</header><text display-inline="yes-display-inline">The term <term>voting system</term> has the meaning given such term under section 301(b) of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/15481">42 U.S.C. 15481(b)</external-xref>).</text> </paragraph></section> 
<section commented="no" display-inline="no-display-inline" id="H9669C6C6CEA341A7819D582C23BCAF80" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Vote by mail grant program</header> 
<subsection commented="no" display-inline="no-display-inline" id="HE8DF404CE53A497D0005A327CB04E0F0"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">Not later than 270 days after the date of enactment of this Act, the Election Assistance Commission shall establish a Vote by Mail grant program (in this section referred to as the <quote>program</quote>).</text> </subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HD557E779F91E4ED99EA83652CAC8305D"><enum>(b)</enum><header display-inline="yes-display-inline">Purpose</header><text display-inline="yes-display-inline">The purpose of the program is to make implementation grants to participating States solely for the implementation of procedures for the conduct of all elections by mail at the State or local government level.</text> </subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H50E8C5807DC04C98A3481531BFAAC927"><enum>(c)</enum><header display-inline="yes-display-inline">Limitation on use of funds</header><text display-inline="yes-display-inline">In no case may grants made under this section be used to reimburse a State for costs incurred in implementing mail-in voting for elections at the State or local government level if such costs were incurred prior to the date of enactment of this Act.</text> </subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HC70EDC46F8C0435B80B8EAF3A1FA33FC"><enum>(d)</enum><header display-inline="yes-display-inline">Application</header><text display-inline="yes-display-inline">A State seeking to participate in the program under this section shall submit an application to the Election Assistance Commission containing such information, and at such time, as the Election Assistance Commission may specify.</text> </subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HDC92A201A15449A9947C1ECD32114CF"><enum>(e)</enum><header display-inline="yes-display-inline">Amount and awarding of implementation grants; duration of program</header> 
<paragraph commented="no" display-inline="no-display-inline" id="H3357277943724ABEA8BBA52311928D3"><enum>(1)</enum><header display-inline="yes-display-inline">Amount of implementation grants</header> 
<subparagraph commented="no" display-inline="no-display-inline" id="HEC9912DBC1DD457695EA436AEC22B5E"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to subparagraph (B), the amount of an implementation grant made to a participating State shall be, in the case of a State that certifies that it will implement all elections by mail in accordance with the requirements of subsection (f), with respect to—</text> 
<clause commented="no" display-inline="no-display-inline" id="HAA7B85F049144BF783C2086674FD7BD0"><enum>(i)</enum><text display-inline="yes-display-inline">the entire State, $2,000,000; or</text> </clause> 
<clause commented="no" display-inline="no-display-inline" id="HEF237BDF3A394DBE862B0099CC003B5C"><enum>(ii)</enum><text display-inline="yes-display-inline">any single unit or multiple units of local government within the State, $1,000,000.</text> </clause></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H06354B6258FB4FC086D7CEC168CEF6C2"><enum>(B)</enum><header display-inline="yes-display-inline">Excess funds</header> 
<clause commented="no" display-inline="no-display-inline" id="HF9590F0631BD4CED00321F07F1DFD1D3"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">To the extent that there are excess funds in either of the first 2 years of the program, such funds may be used to award implementation grants to participating States in subsequent years.</text> </clause> 
<clause commented="no" display-inline="no-display-inline" id="H21888626CA694E33B662941F9000EDA1"><enum>(ii)</enum><header display-inline="yes-display-inline">Excess funds defined</header><text display-inline="yes-display-inline">For purposes of clause (i), the term <quote>excess funds</quote> means any amounts appropriated pursuant to the authorization under subsection (h)(1) with respect to a fiscal year that are not awarded to a participating State under an implementation grant during such fiscal year.</text> </clause></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H67206E4C05B341A787E380B56974AE94"><enum>(C)</enum><header display-inline="yes-display-inline">Continuing availability of funds after appropriation</header><text display-inline="yes-display-inline">An implementation grant made to a participating State under this section shall be available to the State without fiscal year limitation.</text> </subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H3F8B4121B4DF4FB49C04B816182DBC50"><enum>(2)</enum><header display-inline="yes-display-inline">Awarding of implementation grants</header> 
<subparagraph commented="no" display-inline="no-display-inline" id="H2A85B19674A34BB6AE003F65EC5C6754"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Election Assistance Commission shall award implementation grants during each year in which the program is conducted.</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HD773E59A7C7D48A5834B7CE408653038"><enum>(B)</enum><header display-inline="yes-display-inline">One grant per state</header><text display-inline="yes-display-inline">The Election Assistance Commission shall not award more than 1 implementation grant to any participating State under this section over the duration of the program.</text> </subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H482FDA1873F74DE38DB5F188F480CE21"><enum>(3)</enum><header display-inline="yes-display-inline">Duration</header><text display-inline="yes-display-inline">The program shall be conducted for a period of 3 years.</text> </paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H6B43E5E6182E4FC683254C44D6AB6FDE"><enum>(f)</enum><header display-inline="yes-display-inline">Requirements</header> 
<paragraph commented="no" display-inline="no-display-inline" id="HE2FE7016C7D44289A6FC3854D7F969B"><enum>(1)</enum><header display-inline="yes-display-inline">Required procedures</header><text display-inline="yes-display-inline">A participating State shall establish and implement procedures for conducting all elections by mail in the area with respect to which it receives an implementation grant to conduct such elections, including the following:</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H4B53C31FADAB4678B799D5EF9D9EFF8E"><enum>(A)</enum><text display-inline="yes-display-inline">A process for recording electronically each voter’s registration information and signature.</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H0BCA8BD138AE43CA93290003E9E12BBE"><enum>(B)</enum><text display-inline="yes-display-inline">A process for mailing ballots to all eligible voters.</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H8C234AE1B9024831933773C20961F0EB"><enum>(C)</enum><text display-inline="yes-display-inline">The designation of places for the deposit of ballots cast in an election.</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H36C969B1018D4201A99814584C6C6E39"><enum>(D)</enum><text display-inline="yes-display-inline">A process for ensuring the secrecy and integrity of ballots cast in the election.</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H97DC9226ED4D4DFB8DB77C4FE690A721"><enum>(E)</enum><text display-inline="yes-display-inline">Procedures and penalties for preventing election fraud and ballot tampering, including procedures for the verification of the signature of the voter accompanying the ballot through comparison of such signature with the signature of the voter maintained by the State in accordance with subparagraph (A).</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H204E217B97BF46FB81254DCF315BF828"><enum>(F)</enum><text display-inline="yes-display-inline">Procedures for verifying that a ballot has been received by the appropriate authority.</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HDE965E9A9E43473EB27590AB5C82806C"><enum>(G)</enum><text display-inline="yes-display-inline">Procedures for obtaining a replacement ballot in the case of a ballot which is destroyed, spoiled, lost, or not received by the voter.</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H5A9E62F98B0742E8BF0012D773BA62B4"><enum>(H)</enum><text display-inline="yes-display-inline">A plan for training election workers in signature verification techniques.</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H05F36AAA5C9B42DAB396BF07373FD77E"><enum>(I)</enum><text display-inline="yes-display-inline">Plans and procedures to ensure that voters who are blind, visually-impaired, or otherwise disabled have the opportunity to participate in elections conducted by mail and to ensure compliance with the Help America Vote Act of 2002. Such plans and procedures shall be developed in consultation with disabled and other civil rights organizations, voting rights groups, State election officials, voter protection groups, and other interested community organizations.</text> </subparagraph> 
<subparagraph id="HA77E401CD7F04461A4009F77F57E5800"><enum>(J)</enum><text>Plans and procedures to ensure the translation of ballots and voting materials in accordance with section 203 of the Voting Rights Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/1973aa-1a">42 U.S.C. 1973aa–1a</external-xref>)).</text> </subparagraph></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HDB5392EF739B4B5194EA899D3E707002"><enum>(g)</enum><header display-inline="yes-display-inline">Best practices, technical assistance, and reports</header> 
<paragraph commented="no" display-inline="no-display-inline" id="H55266DCD568D4425B32FD71985E5BB00"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Election Assistance Commission shall—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H8AA57551D9CA4A90AE00CA2B047E7367"><enum>(A)</enum><text display-inline="yes-display-inline">develop, periodically issue, and, as appropriate, update best practices for conducting elections by mail;</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HBB6976ACC8B241CF960425DD693B2591"><enum>(B)</enum><text display-inline="yes-display-inline">provide technical assistance to participating States for the purpose of implementing procedures for conducting elections by mail; and</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HA331F5C345C2403AAEBBAE643B187C69"><enum>(C)</enum><text display-inline="yes-display-inline">submit to the appropriate committees of Congress—</text> 
<clause commented="no" display-inline="no-display-inline" id="H460169DD2798466488EFFC9B5FB33B65"><enum>(i)</enum><text display-inline="yes-display-inline">annual reports on the implementation of such procedures by participating States during each year in which the program is conducted; and</text> </clause> 
<clause commented="no" display-inline="no-display-inline" id="HB829EAC9EADC49DE00A7DD4341AD14A3"><enum>(ii)</enum><text display-inline="yes-display-inline">upon completion of the program conducted under this section, a final report on the program, together with recommendations for such legislation or administrative action as the Election Assistance Commission determines to be appropriate.</text> </clause></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H57C5E8A3635A4DCAB6C201A4ACAF559C"><enum>(2)</enum><header>Consultation</header><text>In developing, issuing, and updating best practices, developing materials to provide technical assistance to participating States, and developing the annual and final reports under paragraph (1), the Election Assistance Commission shall consult with interested parties, including—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H16A5AAD54FB846CBB8349517FCE2E1B"><enum>(A)</enum><text>State and local election officials;</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HA9E9C7B59BB6435E92D2D575BE6EC313"><enum>(B)</enum><text>the United States Postal Service;</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H7B0DBE35405947A381D75E00B1D89C70"><enum>(C)</enum><text>the Postal Regulatory Commission established under <external-xref legal-doc="usc" parsable-cite="usc/39/501">section 501</external-xref> of title 39, United States Code; and</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HFA726E3DBB9447B3B2D044400380F814"><enum>(D)</enum><text>voting rights groups, voter protection groups, groups representing the disabled, and other civil rights or community organizations.</text> </subparagraph></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H943038F4AF124F9A897187CE65E7F6A"><enum>(h)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header> 
<paragraph commented="no" display-inline="no-display-inline" id="H86C5E222027D4F6599F5A404DE84AF6C"><enum>(1)</enum><header display-inline="yes-display-inline">Grants</header><text display-inline="yes-display-inline">There are authorized to be appropriated to award grants under this section, for each of fiscal years 2007 through 2009, $6,000,000, to remain available without fiscal year limitation until expended.</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H7E530B1E74DC48CAA1F245E4B023AD02"><enum>(2)</enum><header display-inline="yes-display-inline">Administration</header><text display-inline="yes-display-inline">There are authorized to be appropriated to administer the program under this section, $200,000 for the period of fiscal years 2007 through 2009, to remain available without fiscal year limitation until expended.</text> </paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H2A67C5D002E241B393CF135D6DDACBE0"><enum>(i)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in this Act may be construed to authorize or require conduct prohibited under any of the following laws, or to supersede, restrict, or limit the application of such laws:</text>

<subsection commented="no" display-inline="no-display-inline" id="H811D9F43806B4E0ABFEAB24D71C5D400"><enum>(a)</enum><header display-inline="yes-display-inline">Study</header> 
<paragraph commented="no" display-inline="no-display-inline" id="HD5CD620D8CB44774881E94265600F5A3"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Comptroller General of the United States (in this section referred to as the <quote>Comptroller General</quote>) shall conduct a study evaluating the benefits of broader implementation of mail-in voting in elections, taking into consideration the annual reports submitted by the Election Assistance Commission under section 4(g)(1)(C)(i) before November 1, 2009.</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H4B2CA3769B24466BB100DA67A9117915"><enum>(2)</enum><header display-inline="yes-display-inline">Specific issues studied</header><text display-inline="yes-display-inline">The study conducted under paragraph (1) shall include a comparison of traditional voting methods and mail-in voting with respect to—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="HAAFBE604D7C14E7D80C12642A5715C2C"><enum>(A)</enum><text display-inline="yes-display-inline">the likelihood of voter fraud and misconduct;</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HD3C9CD2C66334A9600ABA903FD59CCF8"><enum>(B)</enum><text display-inline="yes-display-inline">the accuracy of voter rolls;</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H7783EE85206C4D6A9CCF1BFEE71B81F"><enum>(C)</enum><text display-inline="yes-display-inline">the accuracy of election results;</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H0AE42F0C1B534EB79B5762986FA3BA47"><enum>(D)</enum><text display-inline="yes-display-inline">voter participation in urban and rural communities and by minorities, language minorities (as defined in section 203 of the Voting Rights Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/1973aa-1a">42 U.S.C. 1973aa–1a</external-xref>)), and individuals with disabilities and by individuals who are homeless or who frequently change their official residences;</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H55E39EAE346D49BE86E0793539EF87B5"><enum>(E)</enum><text display-inline="yes-display-inline">public confidence in the election system;</text> </subparagraph> 
<subparagraph id="H42D235ADA26E4FC38B007B3F1785E1F7"><enum>(F)</enum><text>the residual vote rate, including such rate based on voter age, education, income, race, or ethnicity or whether a voter lives in an urban or rural community, is disabled, or is a language minority (as so defined); and</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H87D5A9879FD2458CB2D8688B869F43C8"><enum>(G)</enum><text>cost savings.</text> </subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H2C81B332A2A3407FA44190B8CB6459C9"><enum>(3)</enum><header>Consultation</header><text>In conducting the study under paragraph (1), the Comptroller General shall consult with interested parties, including—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H00A650A7DC9C479CADEBE476D75D0036"><enum>(A)</enum><text>State and local election officials;</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HDFB922F96BE74DF5A0CCECD61C19F2CD"><enum>(B)</enum><text>the United States Postal Service;</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H5459FF7AD9A44EBFAAC7632595D34121"><enum>(C)</enum><text>the Postal Regulatory Commission established under <external-xref legal-doc="usc" parsable-cite="usc/39/501">section 501</external-xref> of title 39, United States Code; and</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H14B2E6B7CFD645B9005E62E78CF6BB20"><enum>(D)</enum><text>voting rights groups, voter protection groups, groups representing the disabled, and other civil rights or community organizations.</text> </subparagraph></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H3A9CB484E1C0496EA3A9940097820000"><enum>(b)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than November 1, 2009, the Comptroller General shall prepare and submit to the appropriate committees of Congress a report on the study conducted under subsection (a), together with such recommendations for legislation or administrative action as the Comptroller General determines to be appropriate.</text> </subsection></section>
