<section id="H6DEBFC31ECE44820ABF4ECEA63AF6FEC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Bureau of Reclamation Site Security Costs Act of 2007</short-title></quote>.</text></section>
<section id="H0286507E1AED4EF4AF7CC5D3028166D8"><enum>2.</enum><header>Treatment of capital costs</header><text display-inline="no-display-inline">Costs incurred by the Secretary of the Interior for the physical fortification of Bureau of Reclamation facilities to satisfy increased post-September 11, 2001, security needs, including the construction, modification, upgrade, or replacement of such facility fortifications, shall be nonreimbursable.</text></section>
<section id="HA68A11451DDD4416AF4638874C67821F"><enum>3.</enum><header>Treatment of security-related operation and maintenance costs</header>
<subsection id="H631DC37F0D3A4BBBA02198F7BB97CD5"><enum>(a)</enum><header>Reimbursable costs</header><text>The Secretary of the Interior shall include no more than $18,900,000 per fiscal year, indexed each fiscal year after fiscal year 2008 according to the preceding year’s Consumer Price Index, of those costs incurred for increased levels of guards and patrols, training, patrols by local and tribal law enforcement entities, operation, maintenance, and replacement of guard and response force equipment, and operation and maintenance of facility fortifications at Bureau of Reclamation facilities after the events of September 11, 2001, as reimbursable operation and maintenance costs under Reclamation law.</text></subsection>
<subsection id="HACC0B72D6244494CA611BAB1D94B00DD"><enum>(b)</enum><header>Costs collected through water rates</header><text>In the case of the Central Valley Project of California, site security costs allocated to irrigation and municipal and industrial water service in accordance with this Act shall be collected by the Secretary exclusively through inclusion of these costs in the operation and maintenance water rates.</text></subsection></section>
<section id="H88E8F5AB82164F40ACFBCF1FAD3B49AF"><enum>4.</enum><header>Transparency and report to congress</header>
<subsection id="H4A1BA0DA36C8441BAD37D08F9E08003E"><enum>(a)</enum><header>Policies and procedures</header><text>The Secretary is authorized to develop policies and procedures with project beneficiaries, consistent with the requirements of subsections (b) and (c), to provide for the payment of the reimbursable costs described in section 3.</text></subsection>
<subsection id="HFD0E14AF381447538974C0B495DFD0CC"><enum>(b)</enum><header>Notice</header><text>On identifying a Bureau of Reclamation facility for a site security measure, the Secretary shall provide to the project beneficiaries written notice—</text>
<paragraph id="H8469AE15CAA04A46A7BE0050997E314B"><enum>(1)</enum><text>describing the need for the site security measure and the process for identifying and implementing the site security measure; and</text></paragraph>
<paragraph id="H83FBF816B86C4DE1B9B26128C479F62"><enum>(2)</enum><text display-inline="yes-display-inline">summarizing the administrative and legal requirements relating to the site security measure. </text></paragraph></subsection>
<subsection id="HA86B1006D0ED4250A0D6044F30732C97"><enum>(c)</enum><header>Consultation</header><text display-inline="yes-display-inline">The Secretary shall—</text>
<paragraph id="H9B13EB067EA04F4596A6D7A226ECE870" display-inline="no-display-inline"><enum>(1)</enum><text>provide project beneficiaries an opportunity to consult with the Bureau of Reclamation on the planning, design, and construction of the site security measure; and</text></paragraph>
<paragraph id="H1322F73D858F400DAF8D416CAC33F698"><enum>(2)</enum><text>in consultation with project beneficiaries, develop and provide timeframes for the consultation described in paragraph (1).</text></paragraph></subsection>
<subsection id="H7B17D9427D924738AB001B5F4E265C2C"><enum>(d)</enum><header>Response; notice</header><text>Before incurring costs pursuant to activities described in section 3, the Secretary shall consider cost containment measures recommended by a project beneficiary that has elected to consult with the Bureau of Reclamation on such activities. The Secretary shall provide to the project beneficiary—</text>
<paragraph id="H314C7BBA0DB3473EA02BC549F2F9EB72"><enum>(1)</enum><text>a timely written response describing proposed actions, if any, to address the recommendation; and</text></paragraph>
<paragraph id="HD2D163857299420281655B8D312D02FF"><enum>(2)</enum><text>notice regarding the costs and status of such activities on a periodic basis.</text></paragraph></subsection>
<subsection id="H6C481E24F6454C5DAFC43BC5B6A65EF"><enum>(e)</enum><header>Report</header><text>The Secretary shall report annually to the Natural Resources Committee of the House of Representatives and the Energy and Natural Resources Committee of the Senate on site security actions and activities undertaken pursuant to this Act for each fiscal year. The report shall include a summary of Federal and non-Federal expenditures for the fiscal year and information relating to a 5-year planning horizon for the program, detailed to show pre-September 11, 2001, and post-September 11, 2001, costs for the site security activities.</text></subsection></section>
<section id="H9217F5BDC20B44FA9699CF00FE3B5552"><enum>5.</enum><header>Pre-september 11, 2001 security cost levels</header><text display-inline="no-display-inline"> Reclamation project security costs at the levels of activity that existed prior to September 11, 2001, shall remain reimbursable.</text></section>
