		  Scholarship Program to award scholarships to recruit and prepare students for
		  careers in the National Weather Service and in National Oceanic and Atmospheric
		  Administration marine research, atmospheric research, and satellite
		  programs.</official-title>

		<section display-inline="no-display-inline" id="H0321C5E03FB644B791AB00ED1832022C" section-type="section-one"><enum>1.</enum><header>Science and technology
			 scholarship program</header>
			<subsection id="H8534DDEB5D0D4458AFC8E536EA338FEA"><enum>(a)</enum><header>Establishment of
			 program</header>
				<paragraph id="H536717CCB7004244BEB92749FAA6B84E"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Administrator is
			 authorized to establish a Science and Technology Scholarship Program to award
			 scholarships to individuals that is designed to recruit and prepare students
			 for careers in the National Weather Service and in Administration marine
			 research, atmospheric research, and satellite programs.</text>
				</paragraph><paragraph id="HEF2542749CAE4522A8006800AE79D3A2"><enum>(2)</enum><header>Competitive
			 process</header><text>Individuals shall be selected to receive scholarships
			 under this section through a competitive process primarily on the basis of
			 academic merit, with consideration given to financial need and the goal of
			 promoting the participation of individuals identified in section 33 or 34 of
			 the Science and Engineering Equal Opportunities Act (42 U.S.C. 1885a or
			 1885b).</text>
				</paragraph><paragraph id="H1851D41777B243229B02D1CA3FACD353"><enum>(3)</enum><header>Service
			 agreements</header><text>To carry out the scholarship program, the
			 Administrator shall enter into contractual agreements with individuals selected
			 under paragraph (2) under which the individuals agree to serve as full-time
			 employees of the Administration, for the period described in subsection (f)(1),
			 in positions needed by the Administration in fields described in paragraph (1)
			 and for which the individuals are qualified, in exchange for receiving a
			 scholarship.</text>
				</paragraph></subsection><subsection id="H38F55CEA3B1F4523919EA89B1F9FE94"><enum>(b)</enum><header>Scholarship
			 eligibility</header><text display-inline="yes-display-inline">In order to be
			 eligible to participate in the scholarship program, an individual shall—</text>
				<paragraph id="H890F56D953E347ECBADC1B2C36C001FA"><enum>(1)</enum><text>be enrolled or
			 accepted for enrollment as a full-time student at an institution of higher
			 education in an academic program or field of study described in the list made
			 available under subsection (d);</text>
				</paragraph><paragraph id="H56E8EF4DA2EE4070B3C82DD7E81E9B65"><enum>(2)</enum><text>be a United States
			 citizen or permanent resident; and</text>
				</paragraph><paragraph id="H36E44B13236C4EAE89AB32357B4E34BF"><enum>(3)</enum><text>at the time of the
			 initial scholarship award, not be a Federal employee as defined in section 2105
			 of title 5 of the United States Code.</text>
				</paragraph></subsection><subsection id="HA70D41B79AF140498DFF83115191E654"><enum>(c)</enum><header>Application
			 required</header><text>An individual seeking a scholarship under this section
			 shall submit an application to the Administrator at such time, in such manner,
			 and containing such information, agreements, or assurances as the Administrator
			 may require to carry out this section.</text>
			</subsection><subsection id="H3A7037E009F4459A8738CAACFDE906B6"><enum>(d)</enum><header>Eligible
			 academic programs</header><text>The Administrator shall make publicly available
			 a list of academic programs and fields of study for which scholarships may be
			 utilized in fields described in subsection (a)(1), and shall update the list as
			 necessary.</text>
			</subsection><subsection id="HFDEDF2C1DEDC439986F474BED61D70F2"><enum>(e)</enum><header>Scholarship
			 requirement</header>
				<paragraph id="HD50879A532C64463B017D34DDE00D03E"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Administrator may
			 provide a scholarship under the scholarship program for an academic year if the
			 individual applying for the scholarship has submitted to the Administrator, as
			 part of the application required under subsection (c), a proposed academic
			 program leading to a degree in a program or field of study on the list made
			 available under subsection (d).</text>
				</paragraph><paragraph id="H0DB3C3F0EAC748078458C1D5E4428B74"><enum>(2)</enum><header>Duration of
			 eligibility</header><text>An individual may not receive a scholarship under
			 this section for more than 4 academic years, unless the Administrator grants a
			 waiver.</text>
				</paragraph><paragraph id="HE6F483F17D7F4CF1B278522CAA2BCA5E"><enum>(3)</enum><header>Scholarship
			 amount</header><text>The dollar amount of a scholarship under this section for
			 an academic year shall be determined under regulations issued by the
			 Administrator, but shall in no case exceed the cost of attendance.</text>
				</paragraph><paragraph id="H6E4E561793374A9D90BD914587968846"><enum>(4)</enum><header>Authorized
			 uses</header><text>A scholarship provided under this section may be expended
			 for tuition, fees, and other authorized expenses as established by the
			 Administrator by regulation.</text>
				</paragraph><paragraph id="H54C628606D264D6200EC2C784DDDCAC"><enum>(5)</enum><header>Contracts
			 regarding direct payments to institutions</header><text>The Administrator may
			 enter into a contractual agreement with an institution of higher education
			 under which the amounts provided for a scholarship under this section for
			 tuition, fees, and other authorized expenses are paid directly to the
			 institution with respect to which the scholarship is provided.</text>
				</paragraph></subsection><subsection id="H7D6842B6842D43C8A5D025E812F5C08"><enum>(f)</enum><header>Period of
			 obligated service</header>
				<paragraph id="H4BCC93FB27BF410BACD600D618B31901"><enum>(1)</enum><header>Duration of
			 service</header><text>Except as provided in subsection (h)(2), the period of
			 service for which an individual shall be obligated to serve as an employee of
			 the Administration shall be 24 months for each academic year for which a
			 scholarship under this section is provided.</text>
				</paragraph><paragraph id="HC8108CE8CF8F4C71A50024FF00640483"><enum>(2)</enum><header>Schedule for
			 service</header>
					<subparagraph id="HFF6679A1399A40AAA0EBD89BCCD18772"><enum>(A)</enum><header>In
			 general</header><text>Except as provided in subparagraph (B), obligated service
			 under paragraph (1) shall begin not later than 60 days after the individual
			 obtains the educational degree for which the scholarship was provided.</text>
					</subparagraph><subparagraph id="HFDCBFEE12AC34CD581B765F2ADF2CA32"><enum>(B)</enum><header>Deferral</header><text>The
			 Administrator may defer the obligation of an individual to provide a period of
			 service under paragraph (1) if the Administrator determines that such a
			 deferral is appropriate. The Administrator shall prescribe the terms and
			 conditions under which a service obligation may be deferred through
			 regulation.</text>
					</subparagraph></paragraph></subsection><subsection id="HADEE6166EB6742FCB4D5D04658FF3F71"><enum>(g)</enum><header>Penalties for
			 breach of scholarship agreement</header>
				<paragraph id="H332EBE82A2BC4215918F7E5886D9028E"><enum>(1)</enum><header>Failure to
			 complete academic training</header><text>Scholarship recipients who fail to
			 maintain a high level of academic standing, as defined by the Administrator by
			 regulation, who are dismissed from their educational institutions for
			 disciplinary reasons, or who voluntarily terminate academic training before
			 graduation from the educational program for which the scholarship was awarded,
			 shall be in breach of their contractual agreement and, in lieu of any service
			 obligation arising under such agreement, shall be liable to the United States
			 for repayment not later than 1 year after the date of default of all
			 scholarship funds paid to them and to the institution of higher education on
			 their behalf under the agreement, except as provided in subsection (h)(2). The
			 repayment period may be extended by the Administrator when determined to be
			 necessary, as established by regulation.</text>
				</paragraph><paragraph id="HA09219F7594F430CBD83AD004200FA74"><enum>(2)</enum><header>Failure to begin
			 or complete the service obligation or meet the terms and conditions of
			 deferment</header><text>A scholarship recipient who, for any reason, fails to
			 begin or complete a service obligation under this section after completion of
			 academic training, or fails to comply with the terms and conditions of
			 deferment established by the Administrator pursuant to subsection (f)(2)(B),
			 shall be in breach of the contractual agreement. When a recipient breaches an
			 agreement for the reasons stated in the preceding sentence, the recipient shall
			 be liable to the United States for an amount equal to—</text>
					<subparagraph id="H76CAC4EBFF9F4E1D99AAE3C400B796E0"><enum>(A)</enum><text>the total amount
			 of scholarships received by such individual under this section; plus</text>
					</subparagraph><subparagraph id="H944FE20FE3324F4AADFEF709E624A102"><enum>(B)</enum><text>the interest on
			 the amounts of such awards which would be payable if at the time the awards
			 were received they were loans bearing interest at the maximum legal prevailing
			 rate, as determined by the Treasurer of the United States.</text>
					</subparagraph></paragraph></subsection><subsection id="H96E6E88CE8804396AE27D9BA93CE6775"><enum>(h)</enum><header>Waiver or
			 suspension of obligation</header>
				<paragraph id="H93C68CCF5EC049F7BE00C27318BA789D"><enum>(1)</enum><header>Death of
			 individual</header><text>Any obligation of an individual incurred under the
			 scholarship program (or a contractual agreement thereunder) for service or
			 payment shall be canceled upon the death of the individual.</text>
				</paragraph><paragraph id="H6CFD7988B11448A3831B25DBC2C42DF0"><enum>(2)</enum><header>Impossibility or
			 extreme hardship</header><text>The Administrator shall by regulation provide
			 for the partial or total waiver or suspension of any obligation of service or
			 payment incurred by an individual under the scholarship program (or a
			 contractual agreement thereunder) whenever compliance by the individual is
			 impossible or would involve extreme hardship to the individual, or if
			 enforcement of such obligation with respect to the individual would be contrary
			 to the best interests of the Government.</text>
				</paragraph></subsection><subsection id="HF04B87D5208E4E0E9600AD95EE31CD66"><enum>(i)</enum><header>Definitions</header><text>In
			 this Act the following definitions apply:</text>
				<paragraph id="H615F890B55574A31B48E91F5E770163D"><enum>(1)</enum><header>Administration</header><text>The
			 term <term>Administration</term> means the National Oceanic and Atmospheric
			 Administration.</text>
				</paragraph><paragraph id="H2C2D93EFD20B410B9350999133A18F50"><enum>(2)</enum><header>Administrator</header><text>The
			 term <term>Administrator</term> means the Administrator of the National Oceanic
			 and Atmospheric Administration.</text>
				</paragraph><paragraph id="H44ACBF40E630401583A4D2300FE1E85"><enum>(3)</enum><header>Cost of
			 attendance</header><text>The term <term>cost of attendance</term> has the
			 meaning given that term in section 472 of the Higher Education Act of 1965 (20
			 U.S.C. 1087ll).</text>
				</paragraph><paragraph id="H25E613624FAD45D8B82C47A010071CA"><enum>(4)</enum><header>Institution of
			 higher education</header><text>The term <term>institution of higher
			 education</term> has the meaning given that term in section 101(a) of the
			 Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>).</text>
				</paragraph><paragraph id="H2FC6AF40C047445A85264F08D546E4F0"><enum>(5)</enum><header>Scholarship
			 program</header><text>The term <term>scholarship program</term> means the
			 Science and Technology Scholarship Program established under this
			 section.</text>
				</paragraph></subsection></section></legis-body>
