		<official-title>To amend the Public Health Service Act, the Employee
		  Retirement Income Security Act of 1974, and the Internal Revenue Code of 1986
		  to require that group and individual health insurance coverage and group health
		  plans provide coverage for treatment of a minor child’s congenital or
		  developmental deformity or disorder due to trauma, infection, tumor, or

		<section display-inline="no-display-inline" id="HB236685210BA42D1AA71F1FBFDA2805" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Children’s Access to Reconstructive
			 Evaluation &amp; Surgery (CARES) Act of 2007</short-title></quote>.</text>
		</section><section id="HB4E5279E055548848EEACE11EC5E55C4"><enum>2.</enum><header>Coverage of minor
			 child’s congenital or developmental deformity or disorder</header>
			<subsection id="H3818309D368D48899D8963F56C4C48E6"><enum>(a)</enum><header>Group health
			 plans</header>
				<paragraph id="HD56D120C6A0E4E47931CEDDE7D9317FA"><enum>(1)</enum><header><act-name parsable-cite="PHSA">Public Health Service Act</act-name>
			 amendments</header><subparagraph commented="no" display-inline="yes-display-inline" id="HA3E56A3CCF4D45659FD7A810B816846"><enum>(A)</enum><text>Subpart 2 of part A of
			 title XXVII of the <act-name parsable-cite="PHSA">Public Health Service
			 Act</act-name> is amended by adding at the end the following new
			 section:</text>

							<section id="H8A66F8B09C884227ABC4C96CEAF10001"><enum>2707.</enum><header>Standards
				relating to benefits for minor child’s congenital or developmental deformity or
				disorder</header>
								<subsection id="H07A228E85C0F4E73A04DEDBD28188BF8"><enum>(a)</enum><header>Requirements for
				reconstructive surgery</header>
									<paragraph id="HD874F04D21194419B32D3FEA9BB1EB74"><enum>(1)</enum><header>In
				general</header><text>A group health plan, and a health insurance issuer
				offering group health insurance coverage, that provides coverage for surgical
				benefits shall provide coverage for outpatient and inpatient diagnosis and
				treatment of a minor child’s congenital or developmental deformity, disease, or
				injury. A minor child shall include any individual through 21 years of
				age.</text>
									</paragraph><paragraph id="H9A3348AC21394B11AD4BBC639600BA6B"><enum>(2)</enum><header>Requirements</header><text>Any
				coverage provided under paragraph (1) shall be subject to pre-authorization or
				pre-certification as required by the plan or issuer, and such coverage shall
				include any surgical treatment which, in the opinion of the treating physician,
				is medically necessary to approximate a normal appearance.</text>
									</paragraph><paragraph id="HFEBF15FFB02B42E19982804442A32D32"><enum>(3)</enum><header>Treatment
				defined</header>
										<subparagraph id="HB2219D30EEF2474F88B7D9C00C86F35"><enum>(A)</enum><header>In
				general</header><text>In this section, the term <term>treatment</term> includes
				reconstructive surgical procedures (procedures that are generally performed to
				improve function, but may also be performed to approximate a normal appearance)
				that are performed on abnormal structures of the body caused by congenital
				defects, developmental abnormalities, trauma, infection, tumors, or disease,
				including—</text>
											<clause id="H2DBEB2FD46934B76B8237047F8A5846F"><enum>(i)</enum><text>procedures that do
				not materially affect the function of the body part being treated; and</text>
											</clause><clause id="HD060C52D78704DA18CAAA300C15D8BD3"><enum>(ii)</enum><text>procedures for
				secondary conditions and follow-up treatment.</text>
											</clause></subparagraph><subparagraph id="H4E39B73D340A46FB9EE550847BD43BB1"><enum>(B)</enum><header>Exception</header><text>Such
				term does not include cosmetic surgery performed to reshape normal structures
				of the body to improve appearance or self-esteem.</text>
										</subparagraph></paragraph></subsection><subsection id="H752650D5CC1846B18B88436D99043CD8"><enum>(b)</enum><header>Notice</header><text>A
				group health plan under this part shall comply with the notice requirement
				under section 714(b) of the <act-name parsable-cite="ERISA">Employee Retirement
				Income Security Act of 1974</act-name> with respect to the requirements of this
				section as if such section applied to such
				plan.</text>
								</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H7208C232E28A44ED9FAF5854B1000062" indent="up1"><enum>(B)</enum><text>Section 2723(c) of such Act (42 U.S.C.
			 300gg–23(c)) is amended by striking <quote>section 2704</quote> and inserting
			 <quote>sections 2704 and 2707</quote>.</text>
					</subparagraph></paragraph><paragraph id="HEB9507F48ED5415C8FF028FC368C011D"><enum>(2)</enum><header>ERISA
			 amendments</header><subparagraph commented="no" display-inline="yes-display-inline" id="HEA32735F909C4D519DFA2B94DF8CF8C1"><enum>(A)</enum><text>Subpart B of part 7 of
			 subtitle B of title I of the <act-name parsable-cite="ERISA">Employee
			 Retirement Income Security Act of 1974</act-name> is amended by adding at the
			 end the following new section:</text>

				reconstructive surgery</header>
									<paragraph id="HB391374323F1484984E46EA1D4A0EBDD"><enum>(1)</enum><header>In
				general</header><text>A group health plan, and a health insurance issuer
				offering group health insurance coverage, that provides coverage for surgical
				benefits shall provide coverage for outpatient and inpatient diagnosis and
				treatment of a minor child’s congenital or developmental deformity, disease, or
				injury. A minor child shall include any individual who has not attained age
				22.</text>
									</paragraph><paragraph id="H585EA1628A9148B1B4E74E3B6F8C3D2D"><enum>(2)</enum><header>Requirements</header><text>Any
				coverage provided under paragraph (1) shall be subject to pre-authorization or
				pre-certification as required by the plan or issuer, and such coverage shall
				include any surgical treatment which, in the opinion of the treating physician,
				is medically necessary to approximate a normal appearance.</text>

				defined</header>
										<subparagraph id="HC939C7A958A74C3200751C9B68084DEE"><enum>(A)</enum><header>In
				general</header><text>For purposes of this section, the term
				<term>treatment</term> includes reconstructive surgical procedures (procedures
				that are generally performed to improve function, but may also be performed to
				approximate a normal appearance) that are performed on abnormal structures of
				the body caused by congenital defects, developmental abnormalities, trauma,
				infection, tumors, or disease, including—</text>
											<clause id="H08E51482D2E44051A2A35FD8ABC8F5B"><enum>(i)</enum><text>procedures that do
				not materially affect the function of the body part being treated; and</text>
											</clause><clause id="H1959C857C03B46E68FAA4CEC628E4F4"><enum>(ii)</enum><text>procedures for
				secondary conditions and follow-up treatment.</text>
											</clause></subparagraph><subparagraph id="H0F900E819CD74A9996FF83B1DAE736A0"><enum>(B)</enum><header>Exception</header><text>Such
				term does not include cosmetic surgery performed to reshape normal structures
				of the body to improve appearance or self-esteem.</text>
										</subparagraph></paragraph></subsection><subsection id="HE395080012E64FAB0076869E7BA21552"><enum>(b)</enum><header>Notice under
				group health plan</header><text>The imposition of the requirements of this
				section shall be treated as a material modification in the terms of the plan
				described in the last sentence of section 102(a), for purposes of assuring
				notice of such requirements under the plan; except that the summary description
				required to be provided under the fourth sentence of section 104(b)(1) with
				respect to such modification shall be provided by not later than 60 days after
				the first day of the first plan year in which such requirements
				apply.</text>
								</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H77A1D23373F640A18C2344C31EF6A205" indent="up1"><enum>(B)</enum><text>Section 731(c) of such Act (29 U.S.C.
			 1191(c)) is amended by striking <quote>section 711</quote> and inserting
			 <quote>sections 711 and 714</quote>.</text>
					</subparagraph><subparagraph id="HA7597FFCEA8744C8943D87F9062C42BF" indent="up1"><enum>(C)</enum><text>Section 732(a) of such Act (29 U.S.C.
			 1191a(a)) is amended by striking <quote>section 711</quote> and inserting
			 <quote>sections 711 and 714</quote>.</text>
					</subparagraph><subparagraph id="H45C9BD16355242DE9C3DDD9E4B504CEB" indent="up1"><enum>(D)</enum><text>The table of contents in section 1 of
			 such Act is amended by inserting after the item relating to section 713 the
			 following new item:</text>

			 Code amendments</header><text></text>
					<subparagraph id="H4C4C09D53EA64426BDA3DCBFCFF600D2"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subchapter B of
			 <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/100">chapter 100</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the
			 end the following new section:</text>

				reconstructive surgery</header>
									<paragraph id="H3B8EC3DA82ED41C7BE1D1C68FE910610"><enum>(1)</enum><header>In
				general</header><text>A group health plan, and a health insurance issuer
				offering group health insurance coverage, that provides coverage for surgical
				benefits shall provide coverage for outpatient and inpatient diagnosis and
				treatment of a minor child’s congenital or developmental deformity, disease, or
				injury. A minor child shall include any individual who has not attained age

											</clause></subparagraph><subparagraph id="H42C03A46B0AF49A8B3C8FC6B6E83648F"><enum>(B)</enum><header>Exception</header><text>Such
				term does not include cosmetic surgery performed to reshape normal structures
				of the body to improve appearance or
				self-esteem.</text>
										</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="HFE1B3FFC920B4EE79EB8E7EF27C9E6B"><enum>(B)</enum><header>Clerical
			 amendment</header><text>The table of sections for such subchapter is amended by
			 adding at the end the following new item:</text>

			 the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> is
			 amended by inserting after section 2752 the following new section:</text>

				offering group health insurance coverage, that provides coverage for surgical
				benefits shall provide coverage for outpatient and inpatient diagnosis and
				treatment of a minor child’s congenital or developmental deformity, disease, or

				term does not include cosmetic surgery performed to reshape normal structures
				of the body to improve appearance or self-esteem.</text>
									</subparagraph></paragraph></subsection><subsection id="H85EF5E12B9AD4611A0A5D8DEDC399D32"><enum>(b)</enum><header>Notice</header><text>A
				health insurance issuer under this part shall comply with the notice
				requirement under section 714(b) of the <act-name parsable-cite="ERISA">Employee Retirement Income Security Act of
				1974</act-name> with respect to the requirements referred to in subsection (a)
				as if such section applied to such issuer and such issuer were a group health
				plan.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H9B1CA5B5BCF1417AB832D3637BFD92A9" indent="up1"><enum>(2)</enum><text>Section 2762(b)(2) of such Act (42
			 U.S.C. 300gg–62(b)(2)) is amended by striking <quote>section 2751</quote> and
			 inserting <quote>sections 2751 and 2753</quote>.</text>
				</paragraph></subsection><subsection id="HEA1541D733FF4DCB88841C99D5DF42A6"><enum>(c)</enum><header>Effective
			 dates</header><paragraph commented="no" display-inline="yes-display-inline" id="H3561F43E9DC6429790F3BD966E659662"><enum>(1)</enum><text>The
			 amendments made by subsection (a) shall apply with respect to group health
			 plans for plan years beginning on or after January 1, 2008.</text>
				</paragraph><paragraph id="HF1C8E5B02CBB49A3873467FDB9B24996" indent="up1"><enum>(2)</enum><text>The amendment made by subsection (b)
			 shall apply with respect to health insurance coverage offered, sold, issued,
			 renewed, in effect, or operated in the individual market on or after such
			 date.</text>
				</paragraph></subsection><subsection id="H1BF99AE5FBEF475686F86C940647E5E"><enum>(d)</enum><header>Coordinated
			 regulations</header><text>Section 104(1) of <act-name parsable-cite="HIPAA">Health Insurance Portability and Accountability Act of
			 1996</act-name> is amended by striking <quote>this subtitle (and the amendments
			 made by this subtitle and section 401)</quote> and inserting <quote>the
			 provisions of part 7 of subtitle B of title I of the
			 <act-name parsable-cite="ERISA">Employee Retirement Income Security Act of
			 1974</act-name>, the provisions of parts A and C of title XXVII of the
			 <act-name parsable-cite="PHSA">Public Health Service Act</act-name>, and
			 <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/100">chapter 100</external-xref> of the Internal Revenue Code of 1986</quote>.</text>
