<section id="HD455586F39224DAF92D3787ECE5DC88" section-type="section-one"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Mail-In Ballot Tracking Act of 2007</short-title></quote>. </text></section> 
<section id="H44F592AE9C86448B812DB6008CE712F"><enum>2.</enum><header>Requirements For Tracking Ballots Transmitted by Mail</header> 
<subsection id="H40B07AE9D72C416200F8D9006D47D048"><enum>(a)</enum><header>Requiring States To Meet Requirements</header><text>Subtitle A of title III of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/15481">42 U.S.C. 15481 et seq.</external-xref>) is amended—</text> 
<paragraph id="HAC48EA32C7E54761A0007FDC00B7FD00"><enum>(1)</enum><text>by redesignating sections 304 and 305 as sections 305 and 306; and</text></paragraph> 
<paragraph id="HDCB9A33B6F434B09A767EE5944276200"><enum>(2)</enum><text>by inserting after section 303 the following new section:</text>

<section id="H9EEF95D3C7E2405EAE00CE1195DC5CA2"><enum>304.</enum><header>Requirements for Tracking Ballots Transmitted by Mail</header> 
<subsection id="H72CE05CEDA93498989C7A46BBC655709"><enum>(a)</enum><header>In General</header> 
<paragraph id="HB95F1DCDD30C453A8F45E3084557682"><enum>(1)</enum><header>Tracking requirements</header><text>Each State and jurisdiction which transmits ballots by mail in the administration of an election for Federal office shall implement such procedures as the State or jurisdiction considers appropriate to ensure that the ballots may be tracked throughout the administration of the election, including procedures to ensure that—</text> 
<subparagraph id="H70A1E8DF28994BDD00C169B800304100"><enum>(A)</enum><text>the appropriate election official may track the progress of the ballot through the mail from the time it is transmitted to the voter until it is received by the appropriate election official; and</text></subparagraph> 
<subparagraph id="HADC75968C91E4EB4B9634C451577D9E4"><enum>(B)</enum><text display-inline="yes-display-inline">a voter who casts a ballot by mail may track the progress of the ballot using the Internet, an automated telephone system, and such other methods as the State or jurisdiction considers appropriate.</text></subparagraph></paragraph> 
<paragraph id="H6728B129A8724A1EA980879E88007B26"><enum>(2)</enum><header>Specific events to be tracked</header><text>Under the procedures implemented pursuant to this subsection, an individual shall be able to determine whether each of the following has occurred with respect to a ballot transmitted by mail:</text> 
<subparagraph id="H4EAB7887BC654A2989E73D2571910C1"><enum>(A)</enum><text>The ballot has been transmitted by the appropriate election official.</text></subparagraph> 
<subparagraph id="HAA2C42A463D04404AD649E9186585421"><enum>(B)</enum><text>The ballot has been processed by the Postal Service, including the determination of the date and time of processing and the location of the processing facility involved.</text></subparagraph> 
<subparagraph id="H492B2B311D584D64998BA366236B42AB"><enum>(C)</enum><text>After the individual has submitted the ballot by mail, the ballot has been received by the appropriate election official.</text></subparagraph> 
<subparagraph id="H98C55ACA9B1E4300A6FCC653F3FFE32D"><enum>(D)</enum><text>The appropriate election official has made a determination as to whether or not the ballot has been validly cast, including whether or not the individual has met any applicable signature requirements.</text></subparagraph> 
<subparagraph id="HB3034B60EDC04A37B206E6F47EB3D49B"><enum>(E)</enum><text>The ballot has been counted or rejected by the appropriate election official.</text></subparagraph></paragraph> 
<paragraph id="H199E9A10055D488C9E4CB6E7F22780EF"><enum>(3)</enum><header>Protection of privacy of information</header><text>In carrying out paragraph (1), the State and jurisdiction shall ensure that a ballot may be tracked without revealing or exposing the content of the ballot to unauthorized individuals.</text></paragraph></subsection> 
<subsection id="H62E3946DAABF41ECADDA6E371EA1EC8"><enum>(b)</enum><header>Exception for Ballots of Absent Overseas and Military Voters</header><text>The requirements of this section do not apply with respect to a ballot which is transmitted to or submitted by an individual who is entitled to vote by absentee ballot under the Uniformed and Overseas Citizens Absentee Voting Act.</text></subsection> 
<subsection id="H8818FA7A02A242EDAAE1DC8149AE7823"><enum>(c)</enum><header>Effective Date</header><text>This section shall apply with respect to the regularly scheduled general election for Federal office held in November 2010 and each succeeding election for Federal office.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H9F968187E44548479BFE80811B4468CF"><enum>(b)</enum><header>Availability of Enforcement</header><text>Section 401 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/15511">42 U.S.C. 15511</external-xref>) is amended by striking <quote>and 303</quote> and inserting <quote>303, and 304</quote>. </text></subsection> 
<subsection id="H88F68F83C0F945D9813BB5D3A87BDFB1"><enum>(c)</enum><header>Clerical Amendment</header><text>The table of contents of such Act is amended—</text> 
<paragraph id="H5456042F230541EBAC511EB65872E3D6"><enum>(1)</enum><text>by redesignating the items relating to sections 304 and 305 as relating to sections 305 and 306; and</text></paragraph> 
<paragraph id="H3027359C959E40BB9CBC04E4DD48B365"><enum>(2)</enum><text>by inserting after the item relating to section 303 the following new item:</text>

<section id="H311043F327214E86B897443E008407AB"><enum>3.</enum><header>Reauthorization of Requirements Payments for States</header><text display-inline="no-display-inline">Section 257(a) of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/15407">42 U.S.C. 15407(a)</external-xref>) is amended by adding at the end the following new paragraph:</text>
