		<official-title>To amend the Immigration and Nationality Act to permit
		  the admission to the United States of nonimmigrant students and visitors who
		  are the spouses and children of United States permanent resident aliens, and
		  for other purposes.</official-title>

		<section display-inline="no-display-inline" id="H645062930BCC40059C41841DEF4CA4" section-type="section-one"><enum>1.</enum><header>Admission of certain
			 <quote>b</quote> and <quote>f</quote> visa nonimmigrants who are spouses or
			 children of United States permanent resident aliens</header><text display-inline="no-display-inline">Section 212 of the
			 <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (8
			 U.S.C. 1182) is amended—</text>
			<paragraph id="H6C08E76A9B3B4D8BAD2CEC4600B82DE5"><enum>(1)</enum><text>by redesignating
			 the subsection (t) added by section 1(b)(2) of <external-xref legal-doc="public-law" parsable-cite="pl/108/449">Public Law 108–449</external-xref> (118 Stat.
			 3469) as a subsection (u); and</text>
			</paragraph><paragraph id="H9E4618D4E6444B0698C7C7804BA4BA8B"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block id="HFF696359CA4A403196AAFDA89F239AC">
					<subsection id="H6838A19B61B04CBA87F3EA660128EFC6"><enum>(v)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H6F23B762F86F4FB4957BC7D19FA300F7"><enum>(1)</enum><text>Notwithstanding any
				other provision of law, no alien—</text>
							<subparagraph id="H5B4AC3ABF6904300B28F4BE97015072" indent="up1"><enum>(A)</enum><text>who is—</text>
								<clause id="H9D4F9B69C2F444F5840325F15B850048"><enum>(i)</enum><text>the spouse or child of an alien
				lawfully admitted for permanent residence to the United States; and</text>
								</clause><clause id="H268C814DF10246BCA7268B005EB759AE"><enum>(ii)</enum><text>not eligible to enter the United
				States as an immigrant except by reason of being such a spouse or child;
				and</text>
								</clause></subparagraph><subparagraph id="H3F2B43DEB02E40F7B9FBB253E702FB60" indent="up1"><enum>(B)</enum><text>who seeks admission to the United
				States for purposes of visiting the permanent resident spouse or parent or for
				studying in the United States; and</text>
							</subparagraph><subparagraph id="H0EFE2DA3A013477B9272DCC3140787FC" indent="up1"><enum>(C)</enum><text>who is otherwise qualified;</text>
							</subparagraph></paragraph><continuation-text continuation-text-level="subsection">may be
				denied issuance of a visa, or may be denied admission to the United States, as
				a nonimmigrant alien described in section 101(a)(15)(B) who is coming to the
				United States temporarily for pleasure or as a nonimmigrant alien described in
				section 101(a)(15)(F).</continuation-text><paragraph id="HF4E3669983144636A6F8851470507FE9" indent="up1"><enum>(2)</enum><text>Whenever an alien described in
				paragraph (1) seeks admission to the United States as a nonimmigrant alien
				described in section 101(a)(15)(B) who is coming temporarily for pleasure or as
				a nonimmigrant alien described in section 101(a)(15)(F), the fact that a
				petition has been filed on the alien’s behalf for classification of the alien
				as an alien lawfully admitted for permanent residence shall not constitute
				evidence of the alien’s intention to abandon his or her foreign
				residence.</text>
